The first comprehensive analysis of the philosophical issues raised by the hijab controversy in France, this book also conducts a dialogue between contemporary Anglo-American and French political theory and defends a progressive republican solution to so-called multicultural conflicts in contemporary societies. It critically assesses the official republican philosophy of laïcité which purported to justify the 2004 ban on religious signs in schools. Laïcité is shown to encompass a comprehensive theory of republican citizenship, centered on three ideals: equality (secular neutrality of (...) the public sphere), liberty (individual autonomy and emancipation) and fraternity (civic loyalty to the community of citizens). Challenging official interpretations of laïcité, the book then puts forward a critical republicanism which does not support the hijab ban, yet upholds a revised interpretation of three central republican commitments: secularism, non-domination and civic solidarity. Thus, it articulates a version of secularism which squarely addresses the problem of status quo bias - the fact that Western societies are historically not neutral towards all religions. It also defends a vision of female emancipation which rejects the coercive paternalism inherent in the regulation of religious dress, yet does not leave individuals unaided in the face of religious and secular, patriarchal and ethnocentric domination. Finally, the book outlines a theory of immigrant integration which places the burden of civic integration on basic socio-political institutions, rather than on citizens themselves. Critical republicanism proposes an entirely new approach to the management of religious and cultural pluralism, centred on the pursuit of the progressive ideal of non-domination in existing, non-ideal societies. Liberal societies conventionally treat religion as unique under the law, requiring both special protection and special containment. But recently this idea that religion requires a legal exception has come under fire from those who argue that religion is no different from any other conception of the good, and the state should treat all such conceptions according to principles of neutrality and equal liberty. Cécile Laborde agrees with much of this liberal egalitarian critique, but she argues that a simple analogy (...) between the good and religion misrepresents the complex relationships among religion, law, and the state. Religion serves as more than a statement of belief about what is true, or a code of moral and ethical conduct. It also refers to comprehensive ways of life, political theories of justice, modes of voluntary association, and vulnerable collective identities. Disaggregating religion into its various dimensions, as Laborde does, has two clear advantages. First, it shows greater respect for ethical and social pluralism by ensuring that whatever treatment religion receives from the law, it receives because of features that it shares with nonreligious beliefs, conceptions, and identities. Second, it dispenses with the Western, Christian-inflected conception of religion that liberal political theory relies on, especially in dealing with the issue of separation between religion and state. Members of racial and sexual minorities often live in the fear of arbitrary interference from others—rogue police officers or sexual harassers. Are they unfree by dint of believing they are unfree? I draw on the republican theory of freedom—according to which we are unfree if we are subjected to a risk of arbitrary interference—to offer a qualified positive answer. I clarify the role of probabilistic judgements about risk in republican political theory. I argue that under specific circumstances, diagnoses of republican (...) freedom can be indexed to a certain belief about probability—what it is warranted for someone to believe in light of their distinctive epistemic perspective. Egalitarian theories of religious freedom deny that religion is entitled to special treatment in law above and beyond that granted to comparable beliefs and practices. The most detailed and influential defense of such an approach is Christopher Eisgruber and Lawrence Sager's Religious Freedom and the Constitution (2007). In this essay I develop, elucidate, and show the limits of the strategy adopted by Eisgruber and Sager. The strategy requires that religion be analogized with other beliefs and practices according to a robust (...) metric of comparison. I argue that Eisgruber and Sager fail to develop a consistent and coherent metric and I further suggest that this failure is symptomatic of the broader difficulty encountered by liberal theory in fitting the concept of religious freedom into a broadly egalitarian framework. The republican tradition seems to have a blind spot about global justice. It has had little to say about pressing international issues such as world poverty or global inequalities. According to the old, if apocryphal, adage: extra rempublicam nulla justitia. Some may doubt that distributive justice (as opposed to freedom or citizenship) is the primary virtue of republican institutions; and at any rate most would agree that republican values have traditionally been realized in the polis not in the (oxymoronic) cosmopolis. (...) The article sketches a republican account of global non-domination which suggests that duties of distributive justice are not bounded to the institutions of a single society. This article asks whether discrimination law should be symmetrical: whether it should offer the same level of protection to dominant and dominated groups. It articulates a structural inequality theory of the moral foundations of discrimination law and defends it against prominent alternatives, such as the view that discrimination is wrong because it is irrational or disrespectful. The paper then argues that while direct discrimination is symmetrical, indirect discrimination is asymmetrical. It cannot be claimed by those – men, or white persons (...) – who are not at the sharp end of structural inequality. Furthermore, even dominated groups cannot claim to be indirectly discriminated against by just any law that has a disparate impact on them. If the structural inequality view is correct, the protectorate of discrimination law is not as extensive as is commonly assumed. (shrink)

Should religion be singled out in the law? This Article evaluates two influential theories of freedom of religion in political theory, before introducing an alternative one. The first approach, the Substitution approach, argues that freedom of religion can be adequately expressed by a substitute category: typically, freedom of conscience. The second, the Proxy approach, argues that the notion of religion should be upheld in the law, albeit as a proxy for a range of different goods. After showing that neither approach (...) adequately meets crucial desiderata for an inclusive theory of religious freedom, the Article sets out the Disaggregation approach and defends against the alternatives. After presenting the recent republican revival, focusing in particular on the neo-republican school of thought, this chapter assesses the exact nature of the differences between liberalism and republicanism, and notably the republicanism of freedom as non-domination associated with Philip Pettit. Drawing on the tools of ideological analysis, as laid out by Michael Freeden, it shows that some of these disagreements are conceptual; others are normative; and yet others are strategic. In particular, republicans have a distinctive understanding of the concept of (...) liberty; their focus on non-domination and ‘anti-power’ shapes a more comprehensive, progressive political agenda; and their language is more effective as a critique of real-world neoliberal politics. The aim of this commentary is to contextualise the findings of the study “Emotional intelligence impact on half-marathon finish times”, which concluded that trait emotional intelligence predicted half-marathon finish times above and beyond training. The aim of this commentary is to highlight some methodological and interpretation limitations that may undermine the conclusions of this paper. These limitations are concerning the acknowledgement of previous research, the choice of the variables included in the study, and the over speculation of findings with respect (...) to study design. The first recommendation is related to the acknowledgement of previous research findings. The authors do not recognise several pieces of prior work, which would directly inform their research hypotheses and build on pre-existing knowledge within the field. The first paper of interest which was not mentioned is the systematic review of emotional intelligence in the field of sport and exercise (Laborde, Dosseville, & Allen, 2016). The systematic review discussed the theoretical implications of trait emotional intelligence on short-term and long-term sport performance outcomes. It concluded that trait emotional intelligence, given its trait nature, was more likely to have a stronger influence on long-term outcomes in comparison to short-term outcomes. Short-term outcomes may also be impacted, however it is then critical to provide a convincing rationale about why this may be the case, and to choose... (shrink)

Objective: This cross-sectional questionnaire-based study aims to compare physical activity and nature exposure levels between people living in France and Germany during the lockdown. Furthermore, the secondary aim is to observe the relationship between perceived stress, psychological health, physical activity, and nature exposure in Germany and France during the coronavirus disease 2019 -related lockdown of April/May 2020.Methods: The study includes 419 participants who have completed the Perceived Stress Scale 10, the World Health Organization Quality of Life-BREF, the Godin-Shephard Leisure-Time Physical (...) Activity Questionnaire, the modified Nature Exposure Scale, and complementary questions related to the lockdown period from April 19 to May 11, 2020. Multiple regression models were constructed to evaluate the relationship of nature exposure and physical exercise with overall stress perception and psychological health in France and Germany when considering a broad range of covariates.Results: Exposure to nature during the lockdown, amount of physical activity ηp2 = 0.014, p < 0.001), and psychological health were greater in German compared with French participants. Godin Index and Nature Exposure Scale total score were both inversely correlated to stress perception and positively correlated to psychological health. The stress and psychological health regression models explained 10% of the results' variance. Physical activity was a significant for both models. Nature Exposure Scale total score was a significant predictor only for psychological health. When including all significant covariates, the regression models explained 30.7% for the perceived stress and 42.1% for the psychological health total overall variance.Conclusion: Physical activity and nature exposure are significant predictors of psychological health. Even though both variables are associated with stress perception, only physical activity is a significant predictor of stress perception. Our results suggest that physical activity and nature exposure were key factors to go through the lockdown period in France and Germany. (shrink)

In this brief commentary, we present a critical reflection on trait emotional intelligence (EI) theory and research as covered in a recent narrative review (Petrides et al., 2016). We consider (a) whether synthesising research findings that use different conceptualisations of EI is desirable, (b) if the measurement of trait EI might become more diverse, (c) whether trait EI research in interpersonal settings requires additional analytical thought, and (d) how researchers might go about objectively conceptualising trait EI. In Liberalism's Religion, I analyse the specific conception of religion that liberalism relies upon. I argue that the concept of religion should be disaggregated into its normatively salient features. When deciding whether to avert undue impingements on religious observances, or to avoid any untoward support of such observances, liberal states should not deal with ‘religion’ as such but, rather, with relevant dimensions of religious phenomena. States should avoid religious entanglement when ‘religion’ is epistemically inaccessible, socially divisive and/or comprehensive in scope. (...) In turn, states should show special deference to religious observances insofar as they exhibit what I call integrity – whether personal or collective. The upshot of this interpretive strategy is that liberal law need not recognise religion as such. As a result, there are gaps between the liberal construal of disaggregated religion and the lived experience of religion as a uniquely integrated experience. Are these gaps morally regrettable? The study of the reception of Rawls in Europe provides some insights into the persistence or erosion of national and European traditions of political thought since the 1970s. It notably allows us to test the relevance of the divide between `analytical' and `Continental' philosophy, and to measure the impact on political thought of the `liberal' turn of the 1980s. Reception should be seen not a process of absorption but as one of dialogue. Recent decades have seen a dramatic transformation in the mode of governing, with government increasingly outsourced to a network of private actors, spanning education, prisons, regulation, arbitration, the military, and access to healthcare and welfare. Chiara Cordelli’s The Privatized State probes the ethical and philosophical questions raised by this transformation, and develops a distinctive account of the wrong of privatization: that a privatized government cannot be a legitimate government. In so doing, Cordelli engages and advances not only pressing questions about (...) privatization, but also broader questions about public administration, political representation, democratic authority, and neorepublicanism. This symposium brings together scholars for a wide-ranging discussion of this transformation in governance and the deep and challenging questions it raises. (shrink)

This is a reply to four critics of my book Liberalism’s Religion: Jonathan Quong, Alan Patten, David Miller and Jeremy Waldron, whose essays have been published in a Special Issue of Criminal Law and Philosophy.

One of the greatest challenges for Latin America and the Caribbean, the most biologically and culturally diverse region in the world, is to halt the loss of species caused by habitat destruction and land degradation. Up to now, setting aside protected natural areas is con­sidered the most effective alternative to conserve biodiversity. Protected areas, however, are under increasing assault by agricultural, silvicultural, and industrial development that surround and isolate them, reducing their habitat quality at the landscape scale. Among the different (...) types of protected areas that have been proposed, biosphere reserves stand out for their attempt to compatibilize social development and conservation. Their management is the most amenable to integration of natural and human disturbance, inclusion of traditional management techniques, and participation by social and economic sectors in the administration. Biosphere reserves have proliferated all over the world, and today there are 531 of them located in 105 countries, where they protect vast ecological and cultural diversity. Even though the design of biosphere reserves is based on the landscape concept, it has yet to take into account ecosystem scales, possible long-term effects of disturbances, and better integrate and give higher consideration to the knowledge and experience of numerous ethnic groups that live within them. However, doing so requires a transformation of the function of the core, buffer, and transition areas. The current design of biosphere reserves is centripetal because the main function of the buffer zone is to protect biodiversity in the core. We pro­pose a centrifugal model, where biodiversity of the core spreads freely toward the area of greater human influence with the buffer zone functioning as a connector. This connectivity can promote land-use practices that are in alignment with both ecosystems functioning and biodiversity conservation in natural, semi-natural, urban and industrial landscapes. Although Newman’s Essay on Development has been studied both in itself and as a milestone in his spiritual journey, scant attention has been given to a detailed analysis of his “notes” for doctrinal development. The following study examines the second note of development—“continuity of principles”—in order to ascertain both Newman’s understanding of “principles” and the way these principles can have continuity.

The contributors to this Special Issue all suggest that Christianity is compatible with political liberalism. In this paper, I first illuminate the grounds of this compatibility. I then focus on one distinctive—yet unexplored—premise of the compatibility argument. This is the thought that religious and secular reasons are essentially on a par, in terms of their contribution to public reasoning. I critically examine Christopher Eberle’s claim that, as their epistemological status is equivalent, both secular and religious reasons may play a decisive (...) role in justifying coercion-related state policies, including in contexts of war. In Why Tolerate Religion?, Brian Leiter argues against the special legal status of religion, claiming that religion should not be the only ground for exemptions to the law and that this form of protection should be, in principle, available for the claims of secular conscience as well. However, in the last chapter of his book, he objects to a universal regime of exemptions for both religious and secular claims of conscience, highlighting the practical and moral flaws associated with it. We (...) believe that Leiter identifies a genuine and important contemporary legal and philosophical problem. We find much to admire in his reasoning. However, we raise questions about two claims that are crucial for his argument. The first claim is that it is not religion as such, but conscience that deserves toleration and respect. The second claim is that respect for religion and conscience demands ‘principled toleration’ but does not entail stronger policies of legal exemptions. Against the first claim, we argue that Leiter does not successfully distinguish religious belief from secular conscience and morality; and he does not explain why secular conscience deserves respect. Against the second claim, we argue that the most promising theories of legal exemptions are not classical theories of liberal toleration. (shrink)

In this introduction, we provide a brief overview of the debate on religion in political philosophy. We present the main arguments defended by Cécile Laborde in Liberalism’s Religion and explain how these arguments contribute to the debate.

Cécile Laborde's important book, Liberalism's Religion, attempts to develop an ethic governing political officials that requires that they only use, and be responsive to, accessible reasons. Laborde's accessibility requirement articulates her unique approach to the role of religion in liberal politics. This article challenges Laborde's accessibility ethic on three grounds: (1) the ethic suffers from a lack of idealisation, (2) there is little reason to prevent inaccessible reasons from defeating coercion, and her ecumenical approach to exemptions recognises (...) this in effect, and (3), the question of whether the accessibility ethic is true is partly empirical, but Laborde does not supply us with an adequate empirical argument. Cécile Laborde has argued that the freedom we think of as ‘freedom of religion’ should be understood as a bundle of separate and relatively independent freedoms. I criticise that approach by pointing out that it is insufficiently sensitive to facts about the sorts of entities that liberal states are. I argue that states have good reasons to mould phenomena such as religion into easily governable monoliths. If this is a problem from the normative point of view, it is not (...) due to descriptively inadequate accounts of religion, but a problem with a lack of realism about the sort of institutions states are. My conclusion is a three-way disjunction: either one must reckon with liberal states’ historically determined limitations in the management of changing social phenomena, or one should direct one’s frustration at the marriage of liberalism and the state, or the very existence of states is normatively problematic. Being robustly committed to state neutrality which does not permit the promotion of liberal-perfectionist ideals and denying that there is anything normatively relevant or ‘special’ about religion leaves liberal-egalitarians embroiled in a paradox. If religion is not special, how and why do liberal states afford it differential treatment (in comparison with non-religious analogues like secular doctrines or deeply-held beliefs of individual conscience)? This paper explores liberal-egalitarian strategies for resolving this paradox with predominant reference to the disaggregation strategy advanced by Cécile (...) Laborde. After discussing the novelty and advantages of disaggregation relative to other liberal-egalitarian strategies, the paper distinguishes between the coverage and the basis in justification of differential treatment to argue that disaggregation does not ultimately succeed in solving the latter. Despite this, reflecting on the clarifications achieved through disaggregation and the deeper issues of justification and justice emerging therefrom, the paper concludes by proposing the need to consider a lateral solution to the paradox and speculating on what this might look like. Cécile Laborde’s disaggregation strategy, which is convincingly applied to religion, liberal neutrality, and freedom of association, should be extended to discrimination, in order to more systematically determine whether, when, and why indirect religious discrimination is unfair. Moreover, while Laborde’s distinction between the ‘Disproportionate Burden scenario’ and the ‘Majority Bias scenario’ is a powerful alternative to the discrimination-focused account of the justifiability of religious exemptions, the epistemic status of that distinction is not immediately clear. A case can be made (...) that Disproportionate Burden and Majority Bias do not map onto different types of minority exemption claims. They are perspectives or analytical frames that may jointly and usefully be applied to most instances of such claims. (shrink)

Cécile Laborde proposes a liberal egalitarian view for a liberal state to adopt in its fair treatment of religious citizens. She suggests a method where state neutrality is applied restrictively and religion is “disaggregated” across standard liberal rights. Without recourse to a legal-political category religion, she responds to the problem of religious accommodation by using main elements of a particular liberal right(s) to account for the dimension of religion that an issue of justice makes salient. In reply to the (...) problem of state neutrality, she proposes that a liberal state can be non-neutral in its treatment of religious claims as long as religion is not a marker for social division, does not impose its comprehensive ethics, and provides publicly accessible reasons. I argue that adopting Laborde’s approach has conceptual and pragmatic advantages as a political strategy (modus vivendi) in resolving justice claims. However, its content-neutral and procedural framework partially meets the requirements of justice of religious citizens because of its egalitarian motivation. In adopting a minimal political conception of religion defined by elements of other liberal rights, the liberal state employs a narrow understanding of religion as a “collection” of beliefs and practices. This can result in religious citizens exercising partial or even distorted expressions of their religious identities. I suggest a conceptual refinement in Laborde’s theory if it aims at attracting endorsement from religious citizens as a reasonable conception of justice. I will survey some alternative frameworks and ideas (e.g. Raz value-based approach, Riordan’s capacity for truth argument) and build on their strengths. I propose vocation as a useful concept for a liberal state to employ in appropriately understanding and assessing religious commitment. My modest proposal presents a liberal understanding of religion-state relationship other than those framed in the themes of neutrality, toleration, exclusion, or limitation of practices. (shrink)

In Liberalism's Religion, Cécile Laborde claims that public reason has to be broadened. She rejects the criterion of shareability and advocates for the criterion of accessibility. Such a broadening seems to break with an orthodox political liberalism. This paper seeks to highlight the reasons why Laborde prefers the criterion of accessibility to its rivals. My claim is that, far from leading Laborde out from the liberal side, her views show that she understands the liberals better than they (...) understand themselves. Ultimately, I make a few suggestions on how to better structure the political debate once public reason has been broadened. (shrink)

Most debates surrounding the teaching of creationism in the science classroom have been addressed under a standard frame: whether creationism is science or religion. As creationism suggests supernatural causation, it has been understood as beyond the purview of science, and therefore as religion. This argument for methodological naturalism has been increasingly challenged by philosophers of science as a demarcation criterion. The disaggregation approach introduced by Cecile Laborde provides an alternative framework to address this debate. It suggests that the problem (...) with creationism lies in its epistemic inaccessibility, as it is a theory with weak explanatory capacity that has been superseded by Darwinian evolution. Thus, the exclusion of creationism from the science classroom is not grounded in its religious character, but rather in a set of epistemic shortcomings, which are shared by other fully secular pseudoscientific theories. In the same way that religion is not special as a legal-political category under Laborde’s analysis, creationism in the curriculum should not be treated as special either. (shrink)

This review article assesses the usefulness of two substantial recent books on religion by liberal political philosophers, Cécile Laborde and Aurélia Bardon (eds), Religion in Liberal Political Philosophy, and Cécile Laborde, Liberalism’s Religion. It opens by situating these books against the landscape of UK-based work on the place of public religion in liberal democracy by both liberal political philosophers and Christian political theologians. Noting the relative paucity—by comparison with those from North America—of contributions on the theme from both (...) quarters, it welcomes these books as providing important clarifications for political theologians of how many of the precise tensions between religion and liberal democracy might be better understood and how debate between the two disciplines might thereby be enhanced. Is it possible for a liberal society to have an established church? After outlining the conditions for liberal establishment, I take from David Hume a secular argument in its favour that points to the moderating effect of establishment on religious discourse and practice. I examine the claim that state support for religion violates liberal equality, and argue that, with respect to state-provided public goods generally, what matters is that the whole package should be of roughly equal benefit to each citizen; (...) it is not required that every citizen should value each distinct good. I claim that religious establishment can have valuable effects for both believers and non-believers, and thereby count as a public good. I then examine the charge that establishment always conveys a message of disparagement to those outside the favoured church, making them into second-class citizens, as both Martha Nussbaum and Cécile Laborde have claimed. Understood as a claim about the experience of minority groups, however, it is unsupported by empirical evidence. Understood as an interpretative claim about the meaning of establishment, it fails to distinguish between privileging an institution and privileging the people attached to it. Finally, I point out that religious minorities may favour an established church as a shield against the pervasive secularism of most modern liberal societies. (shrink)

They added, "Since each of us was several, that became quite a crowd." These notes, addressed to Deleuze by Guattari in preparation for Anti-Oedipus, and annotated by Deleuze, substantiate their claim, finally bringing out the factory behind the theatre. They reveal Guattari as an inventive, highly analytical, mathematically-minded "conceptor," arguably one of the most prolific and enigmatic figures in philosophy and sociopolitical theory today. The Anti-Oedipus Papers are supplemented by substantial journal entries in which Guattari describes his turbulent relationship with his analyst and teacher Jacques Lacan, his apprehensions about the publication of Anti-Oedipus and accounts of his personal and professional life as a private analyst and codirector with Jean Oury of the experimental clinic Laborde.
