Both volumes present wonderfully rich material and invaluable resources for the study of Christian ethics. Charles Curran and James Keenan are two of the foremost Catholic ethicists in the United States today. Keenan’s case is to be applauded for convening the 2010 conference in Trento, which brought together some six hundred Roman Catholic ethicists from around the world. His book, which assembles that conference’s thirty-one plenary addresses, does justice to this tremendous feat. Curran, for his part, has produced a text that focuses acutely on the Church in the United States and will benefit ethicists for years to come.Keenan uses the introduction to Catholic Theological Ethics Past, Present, and Future to provide an overview of the Trento conference and its attendees and proceedings. Keenan expertly identifies a common theme among the 240 diverse papers at the conference, noting that ethicists “always begin with the premise that there is a deficit in our location, and, therefore, we need to work together to find a way to remedy it” (6). What follows in the remainder of the book boldly moves toward remedies for many of the world’s ills. A few of these essays deserve particular mention.The conference and the collection of essays share the basic organizational principle of looking to the past, the present, and the future of Catholic theological ethics. Unsurprisingly, the Council of Trent played a foundational role in understanding the “past” of Catholic moral theology. Laurenti Magesa [End Page 216] (Kenya) explains that the African experience of the Council of Trent has remained largely unchanged since the conclusion of that council: “The Catholic Church in Africa is essentially a Tridentine church” (57). This essay makes clear that in Africa, the dominant voices are Western males. The missing voices, then, are given attention by Antônio Moser (Brazil), Anne Nasimiyu-Wasike (Kenya), and Bryan Massingale (United States). Massingale’s essay was most impressive, addressing the role of racism in our culture and concluding that Catholic ethicists “need to lament, mourn, and grieve our history” (121). This, he claims, is both a fruitful way to act in the present and a hopeful way to look toward the future.In focusing on the present, the strongest subsection of the book attended to political ethics. Here David Kaulemu’s (Zimbabwe) essay, “Catholic Social Teaching at a Crossroad,” has the potential to open the eyes of any reader. He writes, “It is frustrating and discouraging to the lay faithful to be inspired by Catholic social teaching and yet receive no recognition or support by ‘official’ church structures” (177). This highlights a serious problem to which all Catholic ethicists must attend. As for the future, Julie Hanlon Rubio (United States) points to a tripartite vision for marriage in the twenty-first century that sets high standards not only within the marital unit itself but also for the impact of the spouses on the larger society. Julie Clague (Scotland) presents a wonderful essay on the burgeoning relationship between moral theology and gender.Among the wealth of positive features of this collection is the great geographical diversity of the authors. This affirms that Catholic theological ethics is very healthy throughout the entire world and that on each continent there are voices of women and men willing to contribute fresh ideas to the discipline. He has not only spent a lifetime teaching and serving (...) in a part of the world where the encounter between Christianity and other faiths has been particularly pressing (India), but he has also previously reflected intensively and published widely on this topic. Even more impressive, however, is the fact that the scholarship that emerges in this volume reflects Dupuis as a faithful Catholic Christian, both in the sense of paying sincere heed to the wide range of the Roman Church's official teachings on this and related topics (he taught for years at the Gregorian University in Rome and edited, with Josef Neuner, the massive The Christian Faith in the Doctrinal Documents of the Catholic Church 1 ) and in the sense of thinking along with others in the universal community of faithful Christians. This is an imposing book (first German edition, 1970), not only in length, but in breadth of presentation. Kiing, in the introduction, outlines the philosophical, theological and cultural milieus out of which Hegel's (...) class='Hi'>theology and philosophy emerged. In the next 400 pages (seven chapters), Kiing thoroughly articulates the historical development of Hegel's theological and philosophical thought as expressed in his successive writings, specifically examining and evaluating the christological elements. Kiing's final chapter interprets Hegel's Christology in light of recent biblical historical/critical methodology, by way of a prolegomenon to a future Christology. The book concludes with five integral historical/theological excursus which take up specific questions that arise out of this Hegelian enterprise, for example: "Does God suffer?," "The Dialectic of the Attributes of God," "Immutability of God?". In the preface to this English edition, Kiing states that the purpose of this work is to "provide theologians with an introduction to Hegel's theological and christological thought.... [It will be] a many-leveled 'invitation' into Hegel's life and 'thought, with particular reference to his religious world, and then into his theology and Christology " (p. ix). "Moreover,.this book is an introduction to Hegel's thought by way of 'prolegomena to a future Christology '. In ·these pages we endeavour to return... a provisional reply that will take us some way in the right direction" (p. x). Why did Kiing look to Hegel for the clue to a future Christology? His thesis is that "the biblical message concerning a God who is by no means separated from the world but rather operates within it, and who is by no means stuck immovable and immutable in an unhistorical and suprahistorical realm but rather performs living acts in hi&tory can be better understood [along the lines of Hegelian thought] than in terms of the metaphysics of either classical Greece or the middle ages" (p. xii). Any student of historical or philosophical theology/christology will be captivated by Kiing's treatment of.the development of Hegel's ilhought. Kiing notes that Hegel, beginning with his student days at Tiihingen, was influenced by three strong cultural and intellectual currents: the Enlightenment as it specifically culminated in the thought of Kant, the French Revolution, and the rise of the Romantic movement. Kiing shows that, while the young Hegel was acquainted with the Bible, and even,though he already displayed an interest in the role of religion (folk religion) as formative of society, nowhere was he "seized in a lively and inward fashion by the Christian faith, by the figure of Christ himself" (p. 54). To rthe contrary, Hegel's early experience of Christianity was lifeless and joyless. During his subsequent time in Bern, Hegel's evaluation of Jesus un· derwent a transformation. Hegel became fascinated with Greek religion, not because it was true, but because it embodied the culture and spirit of the people. Developing this train of thought, he stated that "The supreme end of man is morality, and his religious bent is pre· eminent among his aptitudes for promoting that end" (p. 69). Especially after the French Catholic reappraisal (...) of Origen's theology in the twentieth century, the once-dominant interpretation of Origen as a Platonist dressed in Christian garb no longer holds sway among most scholars. As Mark Therrien notes, however, traces of a "metaphysical reductionist" interpretation of Origen, propounded most notably by Adolf [End Page 295] von Harnack, still influences Origenian scholarship (89). In addition, he turns to the early church fathers to contend that, prior to Constantine, “without exception, the church strongly condemned the taking of human life in any form whatsoever”—thus rejecting abortion and infanticide, the blood sport of the Roman games, suicide, and killing in war (120). This was because the New Testament witness to Jesus and his death on the cross required early Christians to view “the means as just as important, if not more important, than the ends” (xiii).Arner supplements this deontological argument for Christian pacifism, which he learned from John Howard Yoder, with a brief consideration of the virtue of patience cultivated in the early churches, reflecting the influence of Stanley Hauerwas on his thought. This “cardinal virtue” connoting “longsuffering, forbearance, patient endurance”—as found in Jesus’s teaching in the Sermon on the Mount (Mt 5:38–48)—enabled early Christians to practice non-violent resistance “deferring personal revenge in favor of God’s vindicating justice” (98). If Christians were to adopt this same consistently pro-life ethic today, argues Arner, it would “lead to greater healing and peace in our blood-soaked world” (121). Almost all of the contributors to this volume—including biblical scholars, theologians, ethicists, pastors, activists, and others—criticize the ideology of Christian Zionism and its support of a theology of dispensationalism that, in their view, distorts the scriptures and fosters violence rather than reconciliation between the Israelis and the Palestinians. In his own presentation titled “What Can Pentecostals and Charismatics Do for Peace with Justice in Israel and Palestine?,” Alexander—who describes himself as a former “one-sided” Christian Zionist who later discovered the writings of Yoder and Hauerwas—appeals to Jesus’s teaching in the Sermon on the Mount and urges Pentecostals to create church communities “that cultivate persons of character and conviction, who through habits, practices, and action live out the core of our faith” (69). Barth himself rejected the term, just as (we might guess) Calvin or Chemnitz would have!'ejected any claim that their great dogmatic projects were the proper basis for a new orthodoxy in the sixteenth century. Both Calvin and Chemnitz stood for right teaching, for ortho-doxy, but neither would have presented their own views-no matter how correct they believed their exegesis and interpretation to be-as a final ground for the establishment of future theological formulations. Both in the Reformation aind in the twentieth century, it has been the next generation, the generation of the students of the great teaicher, that has moved definitely from the system of the teaicher to the establishment of a new orthodoxy. And in all fairness to the Protestant orthodox of the late sixteenth and seventeenth centuries, we must l'ecognize that they neither exalted the theology of the Reformation to the status of a new orthodoxy (ovcer against the faith of the church throughout the centuries) nor identified any single theological system, whether that of Calvin or that of Chemnitz or of a later, more fully "orthodox" and "scholastic" thinker like Polanus or Gerhard, as an exhaustive statement of theological Ol1thodoxy for the chmch.2 In the writings of Torrance, we encounter this second-generation sense of orthodoxy but, I believe, without the caution characteristic of the Protestant orthodox of the seventeenth century. In the following essay, I propose to examine the origin and the subsequent trajectory of Torrance's views on Barth's relationship to the tradition, with attention to his view of Barth's patristic roots and of Barth's position over against the western theological mind. It is known that scholastic theology became very speculative and rational reducing spirituality to popular piety and its devotions. Modern theologians have rediscovered the existential dimension of theology, once that, being the science of revelation, it seeks a rational language coherent with the Christian experience of God. Theology joins faith and reason – the experience of faith, nonetheless, comes before the rational reflection, which, in last instance, is in benefit of the experience in order to illuminate it and make it more faithful to the fundamental experience of revelation in Jesus Christ, found in the Scriptures. In this sense, spirituality emerges as an intrinsic aspect to theology. Theology, if it is to remain faithful to its mission, expresses itself existentially as sapientia fidei (the wisdom of faith). This article treats, therefore, of the evident relationship, many times forgotten, between theology (rational discourse) and spirituality (Christian experience of God) showing that theology only fulfills its role in service to the Church if it leads the believer to an experience of the undivided mystery of God in the person of Jesus Christ. David Hollenbach’s introduction explains how the book brings together Christian (mostly Catholic) theologians, human rights activists, humanitarian practitioners, and legal scholars to help us focus on a class of persons referred to as “forced migrants” or “persons needing protection.” These individuals are neither classical “convention refugees” (according to international law definitions) nor are they simply “migrant workers” (in the classical sense) since their basic human rights to security and subsistence cannot [End Page 230] be adequately guaranteed in their home country or region. They do not emigrate merely in search of a higher standard of living; rather, forced migrants enter and settle in foreign lands seeking some sort of “protection” similar to that afforded to “conventional” refugees. More concretely, the book focuses on persons on the move—individuals fleeing violence and the extreme poverty rampant in regions devastated by ecological degradation and natural disasters.Extending the logic of the 1952 Refugee Convention and adapting it to the realities of today, one can argue convincingly that the international community has a duty to protect such persons when their states of origin are structurally unable or unwilling to afford protection (as argued in Susan Martin’s essay). However, paternalistic approaches that diminish rather than augment the agency of local governments and migrants are to be avoided (as maintained in M. Brinton Lykes’ essay). The book helps us reflect on what can be done to guarantee the basic rights of forced migrants not only at the level of international law and institutions but also through domestic and regional policymaking spurred and inspired by both Christian and secular global-humanitarian values. Such values are eminently compatible when applied to this particular issue (see Silvano Tomasi’s contribution). Agbonkhianmeghe Orobator’s essay—which offers insightful reflections (albeit rather general ones) from Christian ethics, ecclesiology, and biblical theology—likewise points to the need for a truly interdisciplinary approach to the issue. The other authors help the book achieve precisely this. Theological ethics finds its own distinctive place and voice in dialogue with a range of perspectives: legal and political sciences and case studies (Frank Brennan, Daniel Kanstroom); philosophical approaches (Arash Abizadeh); and sociological research on particular migrant populations (M. Brinton Lykes, Maryanne Loughry). The book includes essays that integrate case studies, technical reflections, useful summaries of theological principles and doctrines (J. Bryan Hehir, Mary M. DeLorey, and Tomasi), and philosophical stances (Abizadeh, Thomas G. Weiss), and present practical and legal proposals (see Martin’s essay). A stimulating read for scholars and for the general public, the volume provides good training material for faith-based activists and practitioners.The argumentation strategy in many of the essays in Driven from Home is to appeal to the reader’s sense of solidarity with the needy or suffering neighbor. It promotes the virtues of hospitable citizenship and hospitable disciple-ship while carefully trying to convince national and international policymakers to reinforce and expand the international protection regime. Emboldened by the 2005 “Responsibility to Protect” breakthrough at the United Nations, the authors seek to remain acceptable to a wide audience in an atmosphere of resurgent nationalism, nativism, and protectionism. ELLISON Minneapolis: Fortress Press, 2012. 176 pp. (...) $18.00Intended for “the general educated Catholic population” (xiii), Sexual Ethics: A Theological Introduction (SE) is a masterfully abridged version of the authors’ award-winning 2008 book, The Sexual Person: Toward a Renewed Catholic Anthropology (TSP). Nearly all of the text of Sexual Ethics is common to both volumes, much of it edited for a broader audience. Omitted in Sexual Ethics are about seventy pages presenting contemporary debates between the methods and anthropologies of traditionalists and revisionists (most of TSP chapters 2 and 3). New in Sexual Ethics are “Questions for Reflection” at the end of each chapter and a brief discussion of “conscience” (xxv–xxvi).In both books, the authors offer a “historically conscious and revisionist approach” to Catholic sexual morality (SE, 221). Beginning with “two magisterial principles” in “Catholic moral, sexual tradition”—procreation and the confines of marriage—the authors note different theological bases for these principles—nature and reason, respectively (xiii–xiv)—and propose a significant shift in focus from the “‘nature’ of the act” to “the meaning of the act for the human person” (xvii). Chapter 1, which could stand on its own, provides a helpful, “brief history” of “sexual morality in the Catholic tradition,” undergirding the authors’ historical (in contrast with a classicist) approach. In chapter 2, the theological crux of the argument, Todd Salzman and Michael Lawler proceed to explore methodological developments and tensions in magisterial teaching, choosing “the principle of the human person adequately considered,” theologically articulated in Gaudium et spes, as the basis for their proposal of a “unitive sexual anthropology” (47). This holistic anthropological approach to the sexual person attempts to shift the magisterium’s “focus on acts and absolute norms” in sexual ethics to a method more akin to its social ethics, focusing on general principles, interrelationships, and the common good (59). Central to their [End Page 226] argument is a reworking of the concept of complementarity purged “of every suggestion of either gender or sexual inequality” (63). The remainder of the book illustrates “how these principles apply in real, concrete, particular human relationships” (87).To critique the argument of Sexual Ethics necessarily implicates The Sexual Person, which is beyond the scope of this review. Nevertheless, it is reasonable to ask whether the same argument presented as a “renewed Catholic anthropology” (in TSP) for professional theologians functions equally well as a “theological introduction” to sexual ethics (in SE) for a lay (nonscholarly) audience. Chapter 6, “Artificial Reproductive Technologies,” is the most successful in this regard, exploring a range of ethical concerns (e.g., means versus ends, burden of proof, presumptions against, appropriate cautions, and consideration of the common good) to arrive at a qualified expansion of magisterial teaching, which becomes a guide to personal discernment. Other topics in Sexual Ethics include marriage and contraception (chapter 3), cohabitation and premarital sexuality (chapter 4), and homosexuality (chapter 5).Overall, Sexual Ethics functions better as an introduction to Catholic sexual teaching and moral anthropology than as an introduction to sexual ethics. For example, reworking the concept of “complementarity”—despite the authors’ inclination “to abandon both the word and the idea” (63)—may be necessary for reconstructing Catholic tradition, but is not necessarily the most helpful starting point for sexual ethics. Sexual Ethics will be challenging for readers lacking theological training and will be of most interest to those already committed to and invested in magisterial teaching. My recommendation would be to use The Sexual Person as a teacher’s guide when assigning Sexual Ethics. God is dead; but given the way people are, there may still for millennia be caves in which they show his shadow. – And we – we must still defeat his shadow as well!” – Friedrich Nietzsche[1] INTRODUCTION Friedrich Nietzsche famously declared that “God is dead!”[2] but lamented that his contemporaries remained living in the (...) shadow of God. For Nietzsche, the morality of his time was still based in the Christian tradition, even though faith in God was waning. Bioethics lives under a similar shadow: the shadow of Enlightenment Era-rationalism. Bioethics curricula focus on principles derived from Kantian deontology and utilitarianism. The allure of maintaining a moral framework that provides a rational method that can be handily applied to any situation remains strong. The principlist approach advanced by Tom Beauchamp and James Childress is taught to nearly all medical students in the United States,[3] and is essentially the canonical ethical framework of bioethics. In this model, the principle of autonomy is Kantian in nature, and the principles of beneficence and non-maleficence are utilitarian in nature.[4] Moreover, the presented framework is an approach that, when applied rationally to any healthcare scenario, will yield an outcome “considered moral.”[5] This reflects a faulty conception of philosophy that plagues much of bioethics, wherein the only contribution of philosophy pertinent to bioethics is moral philosophy elucidated by European thinkers in the Enlightenment Era. The landscape of moral philosophy has evolved significantly from the 18th century. However, the bioethical world has not kept up with the philosophical world, remaining instead in the shadow of antiquated moral thinking. Also lacking in bioethics are other disciplines of philosophy, such as philosophy of language, existentialism, and aesthetics, which are often given no consideration at all. The inclusion of both modern moral philosophy and other philosophical fields is necessary if bioethics is to survive its transition into modernity. l. The Shadow of Enlightenment Enlightenment Era philosophers such as Immanuel Kant argued that one need only employ reason to obtain knowledge; emotion bore no relevance when determining ethical behavior. Kant’s moral theories thus privileged a duty to act according to moral imperatives over feelings. Other Enlightenment Era philosophers such as John Locke developed systems that attempted to quantify human goods and human ills. This quantification potentially reduces human welfare and suffering to utility. Today, in the world of philosophy, such a “neutral analysis,” as Cora Diamond noted, is “dead or moribund.”[6] Bernard Williams remarked that such moral philosophy is “empty and boring,”[7] and G. E. M. Anscombe stated that it “no longer generally survives.”[8] And yet, just as the atheists in Nietzsche’s world dwelt in the moral code of a dead God, bioethicists still pursue a unified moral system that takes an input, applies some moral rules, and generates a moral outcome, like the four principles approach that Beauchamp and Childress laid out.[9] Some detractors of principlism take issue with their approach for not being unified enough and want to replace it with a procedural framework that is even more systematic and complicated. They argue that the resulting moral framework would be a “comprehensive decision procedure for arriving at answers”[10] that retains the “impartiality that is an essential part of morality.”[11] The shadow of rationalist morality has caused bioethical decision making to become detached and rigid when bioethics should concern itself with the humans whose lives it affects. A rational, divorced-from-emotion way of thinking ultimately fails to yield satisfactory results when decisions are made by and for emotional beings. Dr. Paul Farmer, among others, championed the idea that bioethics should be de-philosophized, as philosophy, cold and calculated, fails to adequately respond to the realities of those worst off.[12] Instead, Dr. Farmer emphasized the inclusion of the social sciences, like sociology and anthropology, in bioethics. Undoubtedly, Dr. Farmer was on the right track; bioethics should certainly engage directly with the people whom its decisions involve. If the narrow band of moral philosophy currently found in bioethics – that of stringent rationalism – were all that philosophy had to offer, I, too, would advocate for a de-philosophization. Ludwig Wittgenstein notes that to attempt to capture the complexity of moral thinking in a manner that employs reason alone and casts aside emotion is a “hopeless task,” like reconstructing a sharp image “from a blurred one.”[13] Unfortunately, bioethics is mired in the remnants of this hopeless task. To Dr. Farmer, the dominant moral framework was too restrictive and was unresponsive to the social and humanitarian needs of those whom bioethics is meant to help. As such, he wished to free bioethics from the shadow of a morality derived from rationalist thinkers. ll. Beyond Rationalism Like Nietzsche, who tried to resolve Europe’s post-religion vacuum by providing his society with a new way to live, Dr. Farmer wanted to replace the rationalist philosophy upon which bioethics was built with a “resocialization” of the field.[14] I agree with Dr. Farmer’s call for resocialization, as well as his denouncement of philosophy as it exists in bioethics. Evaluating risks and benefits along a predetermined array of moral principles is far too rigid and impersonal to guide what are often the most important decisions one will make. For Dr. Farmer, the most needed change was restoring the social element of bioethics. However, in advocating for this resocialization, Dr. Farmer casts philosophy as the antithesis of social science, noting that “few would regard philosophy … as a socializing discipline.”[15] I disagree. Rationalist moral philosophy may be lacking in socializing force, but there are other fields of philosophy that are responsive to our social reality. Rather than de-philosophizing bioethics, it makes more sense to replace the antisocial philosophies predominant in bioethics with prosocial philosophies better suited to it. Of course, the contribution of philosophy to bioethics is more than moral theories from the Enlightenment Era. There are more recent philosophical contributions from outside the field of moral philosophy that have roused bioethical interest. Jennifer Blumenthal-Barby, et al., argue for philosophy’s continued place in bioethics, citing Derek Parfit’s “non-identity problem,” which altered the landscape of reproductive ethics, and David Chalmers’ contributions to philosophy of consciousness, which have implications for the moral status of brain organoids.[16] Still, these are narrow applications of philosophy to highly specialized areas of bioethics, which not all bioethicists are inclined to delve into. Philosophy in bioethics should not be confined to niche applications in specialist fields but should influence all bioethical thought. Fortunately, there remains untapped a wealth of philosophical disciplines that pertains to exactly this. Philosophy of language investigates the nature of meaning and understanding in communication, which is a necessary social action. Successfully deciphering and conveying moral values in discourse is a bioethicist’s bread and butter, as is resolving disagreements and reaching agreements. Indeed, it is often the case that miscommunication lies at the root of an impasse between a doctor and a patient. An understanding of the nature of the disagreement would help resolve the conflict, as different types of disagreements require different interventions for resolution. For instance, a “substantive disagreement,”[17] in which two parties use the same terms in the same ways and have a fundamental disagreement on which outcome is more desirable, can be resolved only if one party yields to the other. On the other hand, a “merely verbal dispute,”[18] in which two parties use the same terms to represent entirely different concepts and values, requires standardization of terminological usage for its resolution. As such, no one can overstate the moral importance of successful communication in bioethics, and an exploration of language itself would prove invaluable to a bioethicist’s training. Existentialism is another subset of philosophy that acknowledges the social nature of human existence, noting that one’s being in the universe is concomitant with the existence of others sharing the same universe.[19] Thus, there is the recognition that whatever existence is, it is not complete without the existence of others. With this as a starting point, existentialists examined how to live meaningfully with others in this world. Since ethics crucially involves others, it is no surprise that existentialists pondered how to live moral lives. Existentialist conceptions of morality did not revolve around acting in accordance with a set of rules, but rather, recognized individual freedom in choosing how to act and emphasized acting authentically. In this vein, bioethicists should commit to doing what is right rather than committing to applying a set of principles. Existentialism, while part of the broader bioethics literature, is less common throughout bioethics curricula and deserves more prominence. Martin Heidegger, for instance, emphasized the difference between two types of thinking: “calculative thinking” and “meditative thinking.” Heidegger characterizes calculative thinking as a computation, wherein from some given starting conditions “definite results”[20] are determined, and contrasts this with meditative thinking, which he describes as “thinking which contemplates the meaning which reigns in everything that is.”[21] Heidegger was critical of the pervasiveness of calculative thinking, seeing it as the “ground of thoughtlessness,”[22] in which we only relate to the world in a meaningless, mechanical way. This is the emphasized type of thinking in rationalist conceptions of morality popular in bioethics; from a set of starting conditions, a series of rules are applied, and a moral outcome is calculated. Such a technique, however, discounts the personal meaning individuals place on the aspects of their lives relevant to their decision making, as well as the meaning in committing to doing what is right. Under calculative thinking, such a commitment is reduced to rote rule-following. A turn to meditative thinking would ensure that bioethical decisions comport with living meaningful lives. Even aesthetics, a discipline devoted to examining beauty and taste,[23] has a place in bioethics. Just as the viewing of a painting, the listening of a song, or the reading of a book elicits an effective response, hearing a patient’s story leaves an emotional imprint. The recounting of a traumatic moment imparts sadness, and a joyous occasion begets joy in the listener as well. As acknowledged in the field of everyday aesthetics, these aesthetic experiences often spur us to act:[24] The unsightly appearance of a polluted riverbank drives us to remove the trash; the presence of sorrow in one’s life drives us to ameliorate it. To be mindful of aesthetic experiences and allow them to affect us emotionally is paramount to the motivation of a bioethicist to serve the patient, not out of an obligation to a job description, but out of a desire to truly avail the patient of their anguish. For example, the new field of narrative medicine utilizes critical reading and literary techniques to train clinicians and bioethicists in emotional understanding and listening skills that stress the social aspects of medicine beyond rational analysis and decision making. CONCLUSION Dr. Farmer is absolutely correct; bioethics is in dire need of resocialization. It should not be the case that the justification for a moral action is essentially that “the rules say so,” or that simply by teaching such rules to medical students, the very act of making bioethical decisions that diverge from those determined by principles can be seen as an act of “bad faith … hubris or, worse, malpractice.”[25] As bioethicists are coming to realize, the rationalist philosophical traditions that bioethics was founded upon are past their expiry, and the time for change is now. Indeed, as Dr. Farmer urges, “socializing disciplines” like anthropology, history, political economy, and sociology are necessary to humanize the field of bioethics.[26] So too, however, can philosophy be a socializing discipline, if we know where to look. Bioethics should evolve. Its new goal should be to focus on meaningful human relationships, and to phase out rigid, impersonal modes of moral thinking. The limited sampling of unsatisfying moral theories from hundreds of years ago leaves many bioethics students cold, and it is easy to see why bioethicists are ready to part ways with philosophy. I believe this is a move in the wrong direction; there is a place for philosophy in the future of bioethics. Just as bioethics needs a resocialization, it is also needs of a re-philosophization. These enrichments complement one another. There is more to bioethics than mechanically determining the right course of action in a healthcare setting. Bioethics engages with the most ancient of philosophical questions: questions of what makes human existence meaningful, what makes us who we are, how we want to relate to others, how and why we feel, what our place in the world is, how we can communicate what we think, and why our moral intuitions are so compelling. SeitzIn the context of Buddhist-Christian dialogue in Thailand, the life and writings of Fr. Edmond Pezet (1923–2008) are remarkable. He lived among the poor and in a Buddhist monastery, and he also experienced the eremitic life in the forest. According to the Indian Zen master Ama Samy, “Pezet gained an intimate experience and knowledge of Buddhism (...) by living with Thai monks.” Here I introduce a recent Society of the Auxiliaries of the Mission (SAM)1 work that offers a biography and some writings of Edmond Pezet, Edmond Pezet, a Priest among Buddhist Monks in Thailand.2This publication is a collection of various writings of Edmond Pezet: correspondence and nine articles published in various magazines in French, Thai, and English. It has been edited by Henri Huysegoms, a Zen practitioner in Japan for the last forty-five years, and Pierre Liesse, an activist who worked for a couple of years in Thailand. These authors have been impressed by two characteristics of Pezet. First, because he was born in a very poor family in rural France, Pezet identified himself with poor people working hard to earn their living. Second, he was a very committed scholar who successfully learned to speak English, Thai, Lao, Sanskrit, and Pali.Edmond Pezet did his military service in Vietnam, where he was the helpless wit was the helpless witness of torture committed by his regiment fellows on Vietminh suspects. This led him to return there in the future as a missionary, to compensate for the harm he saw caused to the Vietnamese people. Back in France, he completed his study of theology. In 1947, his father was crushed by a truck in front of his eyes. He managed to combine his study and work on the land to provide for his family’s needs. He served as a priest in the diocese of Cahors (France) for a few years. Afterwards, he joined SAM in Belgium.At the end of 1956, he was sent in the northeastern part of Thailand. Faithful to the objectives of SAM, he wanted to serve the local bishop unconditionally, but he quickly noticed a painful reality. Christians and clergy alike followed “a religion, with a dreamlike heaven, rose-water-scented, as its goal, and, in order to get there without fail, certain ‘tricks,’ recipes, ceremonies and representations accompanied by a goodly number of rags and trimmings, where one cannot very easily see the connection between the two things.”3 He wrote that he was stunned to see the way religion was taught to catechumens. They were asked to assimilate, by memorizing [End Page 195] questions and answers, dogmatic assertions expressed with words borrowed from Sanskrit that nobody understood. This inadequate education went hand in hand with a lack of knowledge of Buddhism, sometimes accompanied by scorn. “The Christians were deliberately uprooted from the spiritual richness and religious experience of their race … especially the clergy! (kept apart from their people from the age of 10 to 27). They were taught to administer on the model of the French parish priest of last century.”4His Thai bishop, to whom he opened his heart, did not see any problem in that situation and advised him to get used to it, but for Pezet it soon became unbearable. In 1970, Pezet’s life took a decisive turn. He went to Bangkok. There, he learned Sanskrit and Buddhism at the university level, and for three years lived in the house of a Buddhist monk, helping him to write introductions to Buddhism for foreigners. It made him discover a world of spiritual wealth he had not suspected.What he learned was not a new doctrine presented as absolute truth, because Buddhism does not present its core teaching that way, but a “doctrine” that is expressed exclusively in existential values, something not to be taught, but experienced. Buddhism, he discovered, does not deal with transcendence, because it does not engage in speculative discussion. They both provide an excellent overview for undergraduate students as well as anyone interested in the field of medical morality.Health Care Ethics is especially helpful for those entering the field of ethics in general and the more particular realm of medical morality. User-friendly, [End Page 211] the book is accessible to beginners while also being relevant to those already well-versed in medical ethics. The book provides case studies culled from the experiences of the authors throughout their careers in the practice of medical ethics. Perhaps even more useful, however, are the other exercises in which readers are given the opportunity to actively engage the text in order to discover and more fully articulate their own moral stance. Although Health Care Ethics approaches the topic from a theological perspective, using scriptural passages as well as broader religious themes and contexts, the book is accessible to those outside of the religious arena as well.The first three chapters lay the framework for general theological and ethical inquiry while the later chapters discuss more specific topics in applied health care ethics. The opening chapters by Michael Panicola are thought-provoking, especially since they encourage readers to participate in exercises to determine how they would respond to particular scenarios in their personal decision making. For example, after laying out the classic ethical theories, readers are asked to take a “quiz” by responding to multiple-choice questions to determine how they would respond to various ethical situations. The exercise demonstrates that moral discernment that relies on one ethical theory alone or one single approach to ethics is too narrow and confining for authentic dialogue in ethics. Another exercise calls upon readers to examine their fundamental bases for personal decision making by asking them to create a list of what they think are the ten things that constitute human flourishing and then narrow that list down to the top two. In addition to being engaging, these exercises help readers establish their personal moral stance by asking them to appropriate foundational norms in the process of moral discernment to the case studies throughout the book. They also help readers apply these norms to the specific topics in health care ethics presented in the later chapters.The authors of Health Care Ethics clearly identify human flourishing as the center and goal for all ethical inquiry. Demonstrating that “human flourishing” has different connotations for different people, they also argue that certain norms can be agreed upon to establish a framework for all conversations regarding moral decision making in health care. They especially emphasize a concern for the optimization of human flourishing in final chapters of the text. Chapters 4–12 provide detailed examinations of current topics in medical ethics. Each chapter includes case studies that raise questions concerning social ethics as well as health care morality, employing sources from law, sociology, philosophy, and theology. Why do professional philosophers spend so much time on Descartes and so little time on Pierre Bayle, when Bayle was clearly the better philosopher? I hope that the real (...) answer is not that Bayle wrote too much that is too hard to survey and synthesize, whereas Descartes wrote short works that are easy to teach to undergraduates. Of course, part of any answer will turn on what is meant by "the better philosopher," and [End Page 146] we will return to this issue. If the two books reviewed here get the attention they deserve, Bayle may begin to get more of the attention he deserves.Bayle is well-known for his attacks on Pierre Jurieu, but less well-known are his fights with the 'rationalist' theologian-philosophers Jean LeClerc, Jacques Bernard, and Isaac Jaquelot. They reveal that Bayle was not the automatic supporter of "Enlightenment" of later legend. Stefano Brogi explores these attacks in three of Bayle's last works, the Continuation of the Diverse Thoughts on the Comet (1705; very different from the Diverse Thoughts on the Comet of 1683), Response to Questions of a Provincial (1704-1707), and Conversations between Maxime and Thémiste (1707). Regrettably, none of these—nor any of the works of LeClerc, Bernard, and Jaquelot—have been translated. Greater attention to Descartes may derive from the excellent translations of his work, contrasted with the absence of translations of much of Bayle.Brogi begins with Bayle's reconstruction of "Pyrrho's theology." Faith, in Bayle's hands, is almost completely non-cognitive, accepting the Scripture without understanding it. Rationality, to Bayle, is a second Penelope, unraveling all that it makes. Then Brogi explores what Bayle could have meant by praising Simonides, the ancient Greek who, asked to define God, always asked for more time. He also reviews Bayle's views on euhemerism and the theory of impostorship, and cannot believe Bayle's pretended unawareness of some of the implications of his arguments.The third section, "Ethics against religion," tackles the paradox that Bayle fiercely attacked reason and the argument from consensus for the existence of God, but then invoked reason and consensus as proof of moral claims. In ethics, Bayle's skepticism evaporates. That leads to the further paradox that his rigorous moral evaluation of religion leads to atheism. The ostensible argument is that pagan religions have such immoral gods that it is better not to believe in them; the implication is that the same goes for Judeo-Christianity.It all comes together in Brogi's discussion of "Theology without morality." In his controversies with LeClerc about Origenism (universal salvation) and evil, Bayle brings out the dubious moral consequences of both Origenism and Augustinianism. There is no rational way of saving God's goodness. Then Bayle simply declares his faith in revelation. LeClerc thinks this is bad faith, but he ends up relying on blind faith. Jaquelot argues that God's glory requires the world as it is, but when Bayle asks what glory could come from human suffering, Jaquelot also takes refuge in the inscrutability of God. If anyone thinks these were insignificant controversies, remember that they provoked Leibniz's Theodicy (1710). Austin Farrar once pronounced, exignorantia, that Bayle was "hopelessly confused" ("Introduction," Routledge edition of Leibniz's Theodicy, 1951; now Open Court edition, 35), but Leibniz knew better.Gianluca Mori's book ranges far more widely than Brogi's. It is the best all-around book on Bayle's philosophy in twenty years. Mori begins with a chapter on interpretation, pointing out that everything that Leo Strauss said about encoded language can be found in Bayle. Using Bayle's own claims about such artifices to interpret his work, he explores the writer's ironies, dissimulation, self-censorship, and implied meanings. However, following on from the idea that artistic value is (...) broader than aesthetic value, the last 15 years has seen an explosion of interest in exploring possible inter‐relations between the appreciative and ethical character of works as art. Consideration of these issues has a distinguished philosophical history but as the Compass survey article suggests (‘Art, Morality and Ethics: On the (Im)Moral Character of Art Works and Inter‐Relations to Artistic Value.’Philosophy Compass 1.2 (2006): 129–43), it is only very recently that figures in the field have returned to it to develop more precisely what they take the relationships to be and why. Consensus is, unsurprisingly, lacking. The reinvigoration of the issues has led sophisticated formalists or autonomists to mount a more considered defence of the idea that aesthetic and literary values are indeed conceptually distinct from the justification or otherwise of the moral perspective or views endorsed in a work (Topic I). The challenges presented by such a defence are many but amongst them are appeals to critical practice (Lamarque and Olsen), scepticism about whether or not art really can give us bona fide knowledge (Stolnitz) and the recognition that truth often seems to be far removed from what it is we value in our appreciation of works (Lamarque). One way to motivate consideration of the relevance of a work’s moral character to its artistic value concerns the phenomena of imaginative resistance. At least sometimes it would seem that, as Hume originally suggested, we either cannot or will not enter imaginatively into the perspective solicited by a work due to its morally problematic character (Topic II). In some cases, it would seem that as a matter of psychological fact, we cannot do so since it is impossible for us to imagine how it could be that a certain attitude or action is morally permissible or good (Walton). The question then is whether or not this is a function of morality in particular or constraints on imaginative possibility more generally and what else is involved. At other times, the phenomena seem to be driven by a moral reluctance to allow ourselves to enter into the dramatic perspective involved (Moran) or evaluation of the attitude expressed (Stokes). Nonetheless, it is far from obvious that this is so of all the attitudes or responses we judge to be morally problematic. After all, it looks like we can and indeed often do suspend or background particular cognitive and moral commitments in engaging with all sorts of works (Nichols and Weinberg). If the moral character of a work interacts with how we appreciate and evaluate them, then the pressing question is this: is there any systematic account of the relationship available to us? One way is to consider the relationship between our emotional responses to works and their moral character (Topic III). After all, art works often solicit various emotional responses from us to follow the work and make use of moral concepts in so doing (Carroll). Indeed, whether or not a work merits the sought for emotional responses often seems to be internally related to ethical considerations (Gaut). Yet, it is not obvious that we should apply our moral concepts or respond emotionally in our imaginative engagement with works as art as we should in real life (Kieran, Jacobson). A different route is via the thought that art can convey knowledge (Topic IV). There might be particular kinds of moral knowledge art distinctively suited to conveying (Nussbaum) or it may just be that art does so particularly effectively (Carroll, Gaut, Kieran). Either way where this can be tied to the artistic means and appreciation of a work it would seem that to cultivate moral understanding contributes to the value of a work and to betray misunderstanding is a defect. Without denying the relevance of the moral character of a work some authors have wanted to claim that sometimes the immoral aspect of a work can contribute to rather than lessen its artistic value (Topic V). One route is to claim that there is no systematic theoretical account of the relationship available and what the right thing to say is depends on the particular case involved (Jacobson). Another involves the claim that this is so when the defect connects up in an appropriate way to one of the values of art. Thus, it has been claimed, only where a work reveals something which adds to intelligibility, knowledge or understanding in virtue of its morally problematic aspect can this be so (Kieran). The latter position looks like it could in principle be held whilst nonetheless maintaining that the typical or standard relationship is as the moralists would have it. Yet perhaps allowing valence change for such reasons is less a mark of principled explanation and more a function of downright inconsistency or incoherence (Harold). ABSTRACTAlthough scholars increasingly recognize the debts of twentieth-century Roman Catholic theologians to Søren Kierkegaard, no one has yet traced this influence to Joseph Ratzinger. As is frequently observed, Ratzinger’s most famous book, Introduction to Christianity, opens with a meditation on a Kierkegaardian parable from Either/or. We argue that Ratzinger’s use of Kierkegaard extends well beyond this opening image, to some central moments in his articulation of the idea of God, Christology, and theological anthropology. Upon closer inspection, we argue, Ratzinger’s use (...) of these arguments is owing to the fact that his diagnosis of the ills of contemporary society and the orientation of contemporary Christian theology is the same as that of Kierkegaard, despite their seemingly different contexts. Identifying the Kierkegaardian influence on Introduction to Christianity helps draw our attention to the necessarily ‘introductory’ character of Christianity, which otherwise risks being lost. She contends that a comparative study of religious ethics—in which (...) students explore the ethical decisions they face every day within the context of a range of religious traditions—will draw them into exploring not only their own moral sensibilities but also those religious traditions. I submit that her textbook accomplishes exactly that.No stranger to textbooks in religious ethics, Christine Gudorf has presented us with a well-organized book. The initial chapter is fairly traditional in its approach to the question of ethical method. She rehearses the same threefold pattern found in most textbooks centering on rules, ends, and virtues. Gudorf does much more with rule-based ethics than with teleological ethics, giving the impression that religious ethics is fundamentally rule-based. While this may be true to some degree, there has been far more attention given to teleology in religious ethics than she acknowledges. Her emphasis on connecting theological and religious frameworks to social analysis is helpful and reflects the orientation of many who teach undergraduates in this area. A weakness of the book is that some chapters connect the religious traditions with ethical issues more directly than others. While I tend to be in agreement with much of Gudorf’s own perspective, I sensed at times that she could have made more direct connections between ethical issues and particular religious tradition’s ethical teachings. I might also note that at points the social analysis was a bit long—especially in discussing the history of certain ideas—which might be boring for some undergraduates.Gudorf covers topics that have more experiential relevance for undergraduates than is usually found in social ethics textbooks. This is a good thing because it enables her to cover issues that have the most interest for undergraduates. By drawing on what they are interested in, this textbook is able to lead them into an analysis of the structural components of these issues (rather than zoning out, as undergraduates are prone to do). For the most part, the chapters treat each issue evenly, although the chapter on clothing is a bit short. While there [End Page 236] might be some topics I would like to see added, no text can adequately address everything.The author has a great deal of expertise with case studies, and for the most part the case studies she includes are helpful primarily because their narrative structure and length lend themselves to more sustained and nuanced discussion. The discussion questions, film suggestions, and web resources at the end of each chapter are helpful pedagogical aids. The addition of a glossary is important, but I am glad that she explains most of the terms in the chapters (most students do not take the time to review the glossary).Undergraduates will be able to understand the material Gudorf covers in this book because it connects well with the issues they face on a daily basis. In bringing in her own perspective and experiences as she deliberates about ethical issues—I especially like the discussion of what to do with the homeless on street corners—Gudorf makes this book a bit more distinctive and personal than some other textbooks that attempt to be more “objective.” In all likelihood, I will use this book in my comparative religious ethics class. In lieu of an abstract, here is a brief excerpt of the content:What Christian Liberation Theology and Buddhism Need to Learn from Each OtherJohn MakranskyBoth Christian liberation theologians and engaged Buddhists seek to empower the deepest personhood of people by liberating them from conditions of suffering that hide their deeper identity and impede their fuller potential.1 Christian and Buddhist liberation theologies differ in what they identify as the main conditions of suffering, and in the epistemologies they (...) use to disclose those suffering conditions and to address them. Through their differences, I argue, each tradition points out an epistemological weakness in the other that would otherwise have remained unnoticed and, by exposing it, helps correct it.In terms of Christian liberation epistemology, even taking into account the historical situation that liberation theologians speak from, one weakness is a tendency to construct and reify a duality between those who are preferred by God and those who are not, a duality that makes it difficult, practically speaking, actually to love each person unconditionally in the way that Jesus taught. This is exacerbated by insufficient attention to layers of suffering in people that drive their unjust actions against others. I draw on Buddhist epistemology to uncover these problems by critically analyzing some of the language of a few liberation theologians.On the other hand, Buddhist epistemology lacks the concept of a God who chose to incarnate uniquely among the most marginalized and rejected, and the related Christian concept of social sin. This focus of liberation theology can sharpen Buddhist attention on “nonpersons” in our midst and to the social forces behind their marginalization and suffering. Christian liberation theology thus informs and helps reframe Buddhist understandings of compassion and its cultivation, and stimulates new insights into current social implications of ancient Buddhist teachings of karma, interdependence, and bodhisattva practice.This essay begins with Buddhist ideas, but it is not a religious studies analysis of them concerned with their diverse developments through history. According to the theory and practice of this tradition, all of our experiences of self, others, and world possess two essential qualities: emptiness and cognizance. The mind’s cognizance is the knowing, aware quality within each experience. The mind’s emptiness is the basic space in and through all experiences that permits everything we experience to be as impermanent as it is. Emptiness is also described as the basic space of dependent arising that permits each thing to arise in dependence upon, and as an expression of, other things. Emptiness is thus also the lack of any isolated, autonomous being in anything we experience. The essence of enlightenment dawns when the mind’s cognizant quality recognizes the emptiness of all experiences, the basic space of dependent arising in and through all things. Emptiness then becomes the space of freedom for our cognizance, much more fully, to express its latent capacities of loving connection, compassion, and wisdom. These are qualities of a Buddha’s enlightenment.2 Please note, therefore, that the term “emptiness” should not be misunderstood to imply that we do not exist. Indeed, to have insight into the emptiness of our being is to have insight into our deep interdependence with others, permitting our fuller humanity to manifest: our underlying capacity for much greater love, care, discernment, courage, and creative responsiveness to the world. By bringing that vision into conversation with their respective disciplines, such scholars have gone a long way toward addressing one of the most common complaints about Catholic social teaching: that its proposals are too general and abstract. Two recent books, both working at the intersection of theology and economics, are a case in point.The Moral Dynamics of Economic Life, edited by Daniel Finn, synthesizes a conversation held in Rome in 2010 under the aegis of the Institute of Advanced Catholic Studies and the Pontifical Council for Justice and Peace. Theologians, philosophers, public policy experts, lawyers, businesspeople, and Church leaders gathered to discuss the significance of Benedict XVI’s social encyclical, Caritas in veritate, for the US context. Rather than simply reprinting the papers they discussed, the participants’ contributions were split up and reorganized along thematic lines. There are eleven chapters—on topics like reciprocity, development, and polarization in US political discourse—each composed of a series of two- to four-page essays from different scholars. It is a creative and surprisingly effective structure. No single argument is developed at any length, of course. But the essays, punchy and provocative, accomplish far more than one would think possible in so short a space. Taken together, they define the contours of a much richer conversation than a series of independent papers could have done. [End Page 205]James Bailey’s Rethinking Poverty provides a more sustained argument. Working within the moral framework provided by Catholic social teaching, Bailey argues that US public policy regarding poverty needs to focus less on income relief and more on asset ownership and development. He lays out his basic case for the “asset paradigm” in chapter 1. In the current system, asset-building assistance is provided almost exclusively to the nonpoor rather than to the poor since it is mediated primarily through the federal income tax—which the poor do not pay. Income assistance to the poor, though crucial in the short term, does nothing to address the root causes of endemic poverty in the United States. In fact, the regressive structure of asset-building assistance has itself played an important role in perpetuating and exacerbating the wealth gap in this country. In the next two chapters, Bailey lays out two complementary moral frameworks that support a policy shift toward an asset paradigm: Catholic social teaching and the “capabilities approach” developed by Martha Nussbaum and Amartya Sen. In the fourth chapter, Bailey surveys the history of racialized asset discrimination in US policy, demonstrating that the denial of asset-based assistance has been instrumental in creating enduring wealth disparities between white and black communities. In the fifth chapter, Bailey concludes by suggesting that an older, neglected American policy tradition did privilege an assets-based approach to poverty relief, and that tradition continues to be a viable option.Both books succeed, in my judgment, in rendering the principles and priorities of Catholic social teaching more concrete. (...) After I had driven to the ordination Mass and then to the lunch reception with the newly minted priest, I encountered Father Cessario who noticed my apparently stunned demeanor. In response to his inquiry about my well-being, I explained only that I was struck by the morning's events: "On the ride to the Cathedral Kevin was not a priest. But on the ride to the reception, he was." Put simply, sin requires a divine solution. People need redemption. Confessors do not stand as attorneys seeking the minimal punishment for their penitent defendants. There is no guiltless sin. Rather, the sacramental realist recognizes that sin carries its own consequence. The unfortunate state of original sin means fallen man stands in need of satisfaction. Christ's sacrificial love through his Passion and death enables the restoration and perfection of the imago Dei.The theme of Christian satisfaction relies upon the realism that grace does not merely cover over sin, but instead really heals and elevates the human person. Man requires—and in Christ can receive through the sacraments of the Church—divinely accomplished restoration.4 Pope Leo XIII, initiator of the Thomist revival of the late nineteenth century, observed: "Nothing is [End Page 1078] more useful than to look upon the world as it really is."5 In the words of Pope Paul VI: "Only the truth has grace." Rather, the moral realist who observes St. Thomas's teaching, especially with the help of his authentic interpreters, comes to see that bad acts never perfect persons. The liberal enlightenment as well as the more radical left have both traditionally opposed religion as a reactionary force in politics, a view culminating in an identification of the politics of religion as fundamentalist theocracy. But recently a number of thinkers—Agamben, Badiou, Tabues and in particular Simon Critchley—have begun to explore a more productive engagement of the religious and the political in which religion features as a possible or even necessary form of human emancipation. The papers in this collection, deriving (...) from a workshop held on and with Simon Critchley at the University of Texas at San Antonio in February 2010, take up the ways in which religion’s encounter with politics transforms not only politics but also religion itself, molding it into various religions of politics, including not just heretical religious metaphysics, but also what Critchley describes as non-metaphysical religion, the faith of the faithless. Continuing analysis and assessment of liberation theory, and Segundo's recent effort in particular, is warranted for at least three reasons. First, Jesus of Nazareth and particularly its first volume, Faith and Ideologies, clarifies Segundo's constructive project. The volume reasserts much that is already familiar to Segundo's past readers : a deconstructive hermeneutic; the elaboration of the concepts of faith and ideology; and an interpretation of the relationship of faith to praxis, efficacy, and liberation. But it also breaks new and creative ground as it begins to construct the foundations of a moral epistemology and teleology, a more fully developed theory of value appropriation, and an anthropology grounded in transcendental-existentialist and process categories. One can only appreciate the scope and implications of Segundo's thought in a critical analysis of this recent work. Second, Segundo's ·effort calls for further discussion because of its inevitable influence on the development of other constructive and critical Christian theologies. The visions of " geotheology,'' "world Catholicism," and a "liberating theology" advanced by Latin and North American Catholics are no longer the preoccupations of a peripheral minority but reflect the aspirations of conservative, moderate, and progressive voices in the Christian church. Relatively few works have brought these two individuals together in comparative analysis. McBride (visiting lecturer at Candler Divinity School), seeks to do that; it brings together a wide array of scholars in the fields of ethics, theology, pastoral ministry, political theory, African American studies, and feminist theology.As McBride points out in her introduction, the “significant differences in their historic, sociopolitical contexts” can present challenges in comparing the work of these two men and in seeking to contemporize them (8). However, the thought and life of both martyrs “demand[s] action”; in other words, the “thought” of both Bonhoeffer and King remains incomplete without “courageous, constructive, redemptive social engagement” (3). It is in this spirit that the book unfolds.The book is divided into four parts. The first four chapters compose part 1 (titled “Critical Distance”), which takes a broader look at the legacies, key concepts, and limitations or critiques of the thought of Bonhoeffer and King. For example, the second chapter by Stephen R. Haynes (“King and Bonhoeffer as Protestant Saints”) reminds us of the perils of the larger-than-life legacies of both these individuals. When noteworthy persons become personalities or cultural heroes, key aspects of their legacies can be minimized or overlooked. This is particularly important in contemporary American settings where politicians and commentators tend to reduce the legacies of both Bonhoeffer and King to fit their own political agendas.Part 2 pays specific attention to the influence of Bonhoeffer and King on matters related to social justice, such as poverty, racism, and violence. Among the notable contributions in this section is the chapter by Craig J. Slane that deals with the “unexpected turn toward violence” (112) for Bonhoeffer during his involvement in the plot to assassinate Hitler during World War II. Part 3 looks at the ways in which the lives and teaching (and especially preaching, in King’s life in particular) of Bonhoeffer and King are instruments of social redemption. In addition to noting the influence of Niebuhr’s emphasis on social sin and social redemption on King’s preaching and leadership, it points out that both Bonhoeffer and King were deeply influenced by the economic and social upheavals of their time; their preaching, teaching, and writing sought to address, in concrete ways, the racial, economic, and political realities of their contexts. In part 4, “Peacemaking,” four authors highlight the contributions King and Bonhoeffer have made to peacemaking and the influence these contributions continue to have. They discuss both men’s commitment to nonviolence and pacifism and the particular challenges this commitment created for them (especially for Bonhoeffer, given his participation in a plot to overthrow Hitler).The essays in this book do not present these two martyrs as unblemished. 2012 will mark 60 years since the death of Walter Williamson Bryden. This reprint of his bold 1940 publication, featuring a new introduction by Dr John A. Vissers, Principal of Knox College, Toronto, celebrate the work of this eminent Presbyterian theologian. Best known for bringing Karl Barth to Canada, W.W. Bryden predicted the decline of Idealism and liberal theology in Protestantism at the start of the twentieth-century. When that crisis hit the Canadian Protestant Churches he was ready with this (...) book. The Christian's Knowledge of God is a re-examination of Reformation teachings with particular focus on the revelation of God, by God through Christ. Bryden challenges his readers to question their blind acceptance of Christian doctrine and to reconsider what it means to have knowledge of the Divine and with it "the power to confront the world, no longer as those seeking, but as those having found God". Although the book concludes "Tempora mutantur, nos et mutamur in illis", we have not changed so much with the times as to make this book less relevant today than it was when first published. GREGORY JONES Loyola College Baltimore, Maryland WITH THE PUBLICATION in 1986 of The Fragilty of Goodness, Martha Nussbaum established herelf as a central figure on the intellectual stage.1 The book is elegantly written and eloquently argued, one of those rare books whose depth of insight is coupled with an ease of expression. Equally at home in the (...) scholarship of both classical antiquity and contemporary philosophy, The Fragility of Goodness stimulated conversations and arguments among a wide range of scholars. At the same time, however, there were hints that Nussbaum's philosophical insights and classical acumen did not extend to a knowledge of Christian texts, much less a willingness to engage with them. For example, in a note to the Introduction of the book, Nussbaum observes : When we do not try to see [the Greeks] through the lens of Christian beliefs we can not only see them more truly; we can also see how true they are to us-that is, to a continuous historical tradition of human ethical experience that has not been either displaced or altered by the supremacy of Christian (and Kantian) teaching. That this is the case becomes more explicit in her recent book Love's Knowledge, a collection of essays about the relationship between philosophy and literature.2 Here it becomes clear that Nussbaum's project attempts to retrieve an Aristotelian ethics that would displace not only Kantian or Utilitarian ethics but also Christian ethics. But whereas Nussbaum explicitly criticizes Kantian and Utilitarian positions on both methodological and substantive grounds, she evades engagement with Christian thought. In order to understand how and why this is the case, it is necessary first to explicate in greater detail her Aristotelian position as it develops in The Fragility of Goodness and then Love's Knowledge. In The Fragility of Goodness Nussbaum addresses three central issues : ( 1) the role in " the human good life " of activities and relationships that are, in their nature, especially vulnerable to reversal; (2) the relationship among such components as friendship, love, and political activity in a good life; and (3) the relationship between self-sufficiency and the more ungovernable parts of the human being's internal makeup (see FG, pp. 6-7). Nussbaum proceeds to explore these issues through analyses of diverse Greek tragedies as well as some of the central texts of both Plato and Aristotle. Her approach, she indicates in that book, is Aristotelian; she thinks that Aristotle's central question, "How should a human being live?", should be the central question that frames any ethical inquiry-as opposed, say, to the questions put by Kant or Mill that focus on what one should do. It was a collaborative effort between the ENBCS and the Katholieke Universiteit Leuven. The 2011 ENBCS conference had focused on whether hope was a relevant concept for Buddhists and Christians. The choice of history as a theme complemented this. It also resonated with a research concern of both KU Leuven and the Network.Five key themes were chosen for examination: the traditional Christian and Buddhist conceptions of history; Jesus and the Buddha: fact and fiction; Buddhist and Christian historiography; dangerous memory in Christianity and Buddhism; and permitting historical consciousness in Buddhism and Christianity. Each was approached from a Buddhist and a Christian perspective. An opening lecture addressed the theme “Modern Historical Consciousness and the Challenge to Religion.” In addition, eighteen research papers on Buddhist-Christian relations were given in parallel sessions on Friday evening and Saturday morning. These covered topics as various as the writings of Edmund Pezet (Pierre Gillet), Paul Knitter’s understanding of Buddhist-Christian double belonging (Achim Riggert), Keiji Nishitani and the death of God (Jonatan Navarro Estrada), the encounter of Zen Buddhism and Christianity in the works of D. T. Suzuki (Mariusz Rucki), Buddhist-Christian encounters by Han Yong Woon (Seung Chul Kim), and “Liberating the Conflict from ‘History’ in Sri Lanka” (Jude Lal Fernando).Perry Schmidt-Leukel (Münster, Germany), in the opening lecture, discussed [End Page 189] seven challenges that modern historical consciousness was posing to religion: the challenge of falsification (when historical evidence, for example, showed some doctrines cherished by believers were not taught by the founder), the challenge of uncertainty or methodological doubt, the challenge of methodological naturalism (should a natural explanation be considered more probable than a supernatural one?), the challenge of the distance between past and present, the challenge of change (religions are not static), the challenge of demystification, and the challenge of relativity (the writing of history is perspectival, conditioned by context). He stressed that it would be a blessing to religion if these challenges were faced and, throughout the conference, encouraged other speakers to face them.The first theme was tackled by Mark Blum (Berkeley, USA) from a Buddhist perspective and Jan-Olav Henriksen (Norwegian School of Theology) from a Christian perspective. In a magisterial historical and geographical survey of the Buddhist tradition, Blum first noted that no one had unearthed a traditional notion of Buddhist history in the early texts. The theme of decline and reformation had been taken from Indian cosmology, but with a Buddhist twist and the conviction that it was pointless to talk about beginnings. And in the growth of the Mahāyāna tradition, a dehistoricization of the Buddha had occurred in the belief that the Buddha’s dharma-body was his only “real” body.Henriksen argued that Christian salvation history had its origin in the narrative of the Fall, an event for which there was no historical evidence, and developed into a history of God’s call (election) to all people that they should be brought together in community. It was a history that was linked with the divine logos, a force that Christian theology has seen as deeply interwoven into creation from the beginning of time and that was made human in Jesus.Terrence Merrigan (KU Leuven, Belgium), giving a Christian perspective on the second theme, distinguished three quests or attempts to reach the historical Jesus. The first, from 1774 to 1906, sought to uncover the Jesus that had been obscured by dogma. It imploded with the realization that separating “core” from “myth” was impossible, and conditioned a reactive “no-quest” in the first half of the twentieth century. Dean is not unaware of the dangers. Sources of Catholic Teaching is a compendium of recent "official" statements by Roman Catholic ecclesiastical bodies on issues concern· ing medical ethics. Arranged alphabetically according to topics, this col- 546 BOOK REVIEWS lection of statements from the papacy, the Roman Congregations, and the conferences of Catholic bishops could prove to he a very helpful reference tool. It contains a brief introduction which seeks to explain the role of these statements in the Catholic moral theology and Catholic medical ethics, a table of contents of the statements included, and then the statements themselves. In most instances it does not contain the entire document or statement hut only excerpts therefrom. There are some weaknesses in this work. First, these statements are not self-explanatory; they are in need of interpretation and explanation in many instances. But the authors present only the bald text and do not offer any explanatory comments. They apparently presume that these statements are pellucid to the reader, hut this is an unwarranted pre· sumption. For example, clarifying comments should have been added to the statement from the Declaration on Euthanasia because the allocution of Pius XII about giving lethal doses of analgesia is not entirely clear. A second difficulty with this work is the brief and somewhat insubstantial introduction on conscience and the role these statements should play in the formation of conscience. This sort of work invites a substantial and extended commentary on the nature of moral judgments, the relationship of conscience to the natural law, and the authority of these statements. The authors note that not all of the official statements issued by various organs of the Church are of equal authority, hut they do not try to identify the specific authoritative status of the various statements they include in their work. The reader is thus left to his or her own devices to determine, for example, the relative weight of statements of the administrative hoard of the NCCB versus statements of state episcopal conferences. A still further problem is that some of the statements are of virtually no significant authority for Catholics. Igreja Católica.Two main aspects guide the reflection on liberation theology: one addresses the past and discusses the emergence and development of such theology, and the other points out the future and the possible challenges to be faced. In the process of formation of liberation theology three main issues are analyzed: liberation, praxis, and the poor. On each of these issues, we emphasize the aspect of liberation theology itself. Liberation emerges within the economic and political context and is then understood in the field of anthropology and theology, from a dialectical reading of reality. Praxis shifted the emphasis from doctrinal theology to ask what issues are raised by the faith and practice of Christians, the church and the people, and how theology reflects on such issues. The understanding of the notion of poor and poverty is no longer linked to the lack of goods but comprehended in the context of the exploitation of human beings by dominant system. The sounds of the two bands clashed with (...) each other within the hearing of young Charles, violating all the usual rules of musical composition but creating a new, intriguing experience as he held them both in his hearing at the same time. Years later the memory of such experiences flowed into the mature music of his Fourth Symphony and other works.Some years ago I was chatting with Paul Knitter at a reception at a Catholic Theological Society of America convention when Catherine Cornille approached us with her usual energy and enthusiasm and asked us whether we would each like to contribute to her projected series of Christian commentaries on sacred non-Christian texts. In some ways the challenge of this project resembles that of the young Charles Ives—if we are already listening to one marching band, how do we hear another marching band that comes within our hearing, flowing into our awareness at the same time? In some regards the sounds directly clash, creating unimagined dissonances; the rhythms bounce against each other, breaking the rules of regularity; but out of the flux there may emerge a new aesthetic whole greater than the sum of its parts.As I reflected on Catherine’s invitation, the text that kept coming to mind was the Dhammapada, because I had cherished and appreciated this text for many years. The thought of writing a book-length commentary on the Dhammapada excited me. Later, Peter Feldmeier offered to join me, and so the project became a joint venture, with Peter offering a new translation and explanations of the Buddhist context and myself offering a Christian response. This essay is a reflection on my contribution to the process of writing a Christian commentary on the Dhammapada; portions are taken from the introduction and epilogue of that work.1 [End Page 181]Biblical Wisdom and the DhammapadaMuch of the challenge of comparative theology is deciding which aspects of the respective traditions to compare. I had long worked on the ancient Jewish wisdom tradition and its later reverberations in Christian theology, and so this was my starting point on the Christian side. To use the imagery of Ives’s experience, this was my original marching band. Like a marching band, the biblical wisdom tradition is not static, not a set of fixed positions, but always on the move. The wisdom teachers of the Old Testament engaged in conversations with the sages of Mesopotamia and Egypt; Solomon famously entertained the Queen of Sheba and they discussed wisdom together. The book of Proverbs includes an adaptation of the Egyptian Wisdom of Amenemope. Later, when the Greek philosophical tradition marched within range of hearing, heirs of the Jewish wisdom tradition such as Philo of Alexandria incorporated Hellenistic philosophies as well. We can also see this in the Wisdom of Solomon. Hellenistic Jewish wisdom writings were the matrix from which much of early Christian theology emerged. So my original marching band was already a blend of other bands.In form, the Dhammapada is a collection of wisdom sayings similar to the biblical book of Proverbs. There is no narrative. There are themes that recur again and again, and each chapter has a traditional title. Shakyamuni Buddha did not claim to be a prophet. He did not base his teaching on any special revelation from God, but rather on his own insight into the causes of suffering and the path to the end of suffering. Some sayings specifically address monastic life; others address all human beings.For Christians to ponder the wisdom of the Dhammapada is to enter into an age-old conversation concerning wisdom that spans centuries and continents and includes many different dimensions. BurfordMeaningful dialogue among Buddhists and Christians on any topic—theological or otherwise—requires the participation of open-minded and mutually respectful Buddhists and Christians. It is just such Christians and Buddhists who founded the Society for Buddhist-Christian Studies (SBCS), and it is this society's ongoing commitment to a balance of Buddhists and Christians, as well as (...) other forms of diversity, in our programs and projects that has kept this dialogue lively. In this supportive context, Christians have done some excellent work in developing their religious thinking by reflecting on Buddhism, as have Buddhists by engaging with Christian theology. Nevertheless, a certain asymmetry has at times emerged in our dialogical endeavors, particularly when it comes to theological issues: it seems there might be more Christians interested in Buddhist thought than Buddhists interested in Christian theology.Asymmetry of InterestThis asymmetry became clear to me when I contributed to two books Rita M. Gross and Terry C. Muck put together in 2000 and 2003. In the introduction to the first of these books, Buddhists Talk about Jesus, Christians Talk about the Buddha, Gross notes that the Christian authors who contributed to this volume attest to a far greater positive impact of the Buddha and Buddhism on their Christian lives than the Buddhists attribute to Jesus or Christianity. 1 Gross offers two possible explanations for this asymmetry. First, she says Christians may feel free to admire the Buddha without facing any resulting pressure from Buddhists to convert to Buddhism, whereas Buddhists who might be drawn to Jesus could expect to be the targets of Christian proselytization. Related to this first explanation, Gross also implies, if I read her correctly, that these Christians' guilty feelings about Christianity's history of missionizing and proselytization [End Page 147] might lead them to emphasize their appreciation of a non-Christian religion—a sentiment the Buddhists, understandably, would not be inclined to reciprocate. Second, Gross points out that Buddhist claims about the Buddha leave room for Christians to admire the Buddha without compromising their Christian views and commitments, a point I also make in my Buddhist response to the Christians' essays in this book. 2 Gross goes on to note that parallel Christian claims about Jesus leave no such leeway for the Buddhists. She says, "Christians do claim that Jesus is the incarnation of a deity who creates and redeems the world and such claims run counter to essential Buddhist ideas about how the world works." 3 In other words, Christians can venture into Buddhism's teachings about the Buddha (what we might properly call "Buddhology") without compromising their Christian theology, but Christian doctrine about Jesus (i.e., Christology) prevents Buddhists from gaining anything meaningful from this area of Christian theology without forfeiting their Buddhist worldview.The contrast is even more noticeable between the Buddhist and Christian halves of the second book, Christians Talk about Buddhist Meditation, Buddhists Talk about Christian Prayer. In their contributions to this book Christians describe how they have adopted Buddhist meditations as components of their Christian spiritual paths, and Buddhists write about how some Buddhist practices can be seen as resembling what Christians call "prayer." In the conclusion of this book, Gross suggests that this difference occurs because these Christians are incorporating a specific type of meditation (concentration) associated with Buddhism, practice of which does not require that the Christians take Buddhist teachings about the nature of reality seriously. But Christian prayer and other forms of Christian contemplation or meditation "all seem to have as a prerequisite a Christian view of the world." 4In both of these examples of Buddhist-Christian dialogue, it seems that the Christians involved can, and do, happily use Buddhism as a resource for their Christian theology and spiritual practices. But these Buddhists hold back and seem precluded from benefitting similarly from the dialogue. Mark Heim (bio)René Girard has frequently contended that the core of his best known theories is already contained in the Bible, that in the end he is "only a kind of exegete" (Girard and Treguer 1994, 196). To those who object that the Bible had to wait two thousand years to be read as he reads it, he (...) protests that this is a gross exaggeration: "three quarters of what I say can be found in Saint Augustine" (196). In the introduction to I See Satan Fall like Lightning, Girard puts it like this:The Passion accounts reveal a phenomenon that unbeknownst to us generates all human cultures and still warps our human vision in favor of all sorts of exclusions and scapegoating. If this analysis is true, the explanatory power of Jesus's death is much greater than we realize, and Paul's exalted idea of the cross as the source of all knowledge is anthropologically sound.(2001, 3)In other words, Girard's insight comes only in the train of revelation. The revelation in the biblical sources was not perfectly grasped in the religious traditions that flowed from them, and was frequently betrayed through the construction of sacrificial theologies. But Girard insists that its power was in significant measure perceived and effective from the beginning. His view of the meaning of the passion cannot be correct if he is the first one to see it. So it is no minor matter to ask whether in fact early Christians saw the connection of the cross with scapegoating that is so central for Girard.One point that appears to tell against Girard's case is the absence of images of the cross and crucifixion in the first four Christian centuries. A brutal realism about this specific event is the keystone of Girard's understanding of the passion narratives. The fact that the sight is literally hidden from view throughout this formative Christian period hardly appears consistent with his claims.There is a notable early Christian work of art, the so-called Brescia Casket (see fig. 1), that sheds some important light on the general question of the [End Page 183] representation of the passion and, even more dramatically, upon its interpretation in Girardian terms. The casket indicates that the widespread use of Old Testament types as representations of Christ, and specifically as representations of his passion, may partly explain the absence of literal depiction of the crucifixion. And the particular types involved fit extremely well with Girard's outlook. Ivory, late fourth century.Christ's passion and death were described in stark terms in the gospels and recounted explicitly from the beginning in the church's liturgy, teaching, and preaching. On this plane, there is no question of the centrality of the cross. Yet no literal depictions of the crucifixion survive in art from the first four Christian centuries. There is no entirely satisfactory explanation of why the cross would figure so centrally in Christian faith and worship, but be visually absent. Representations of Jesus in early Christian art most often display a healer, wonderworker, or teacher. In fact, the early centuries offer an odd inversion in creed and art. Early creeds focus on Jesus's beginnings and endings, "skipping right from 'born of the Virgin Mary' to 'suffered under Pontius Pilate,' with no mention of Jesus's life and work, while the art appears to take an opposite tack" (Jensen 2000, 131–32). Perhaps the frequent Christian use [End Page 184] of images of anchors and ship's masts, or of the chi-rho sign, served as their image of the cross. Perhaps the reality the scriptures described was too gruesome to easily picture, too readily ridiculed by outsiders, or too awesome and mysterious to present directly. The differences between thirteenth-century and Renaissance humanism complicate the problem, but a more accurate and sensitive understanding of Aquinas's thought is by no means impossible. It is high time that Protestants put the old division behind them, high time they reclaim this part of their heritage-and they can rightly claim Aquinas as part of their heritage, since he did live and work (...) in the context of a still undivided Christendom. He is one of the teachers we can ill afford to do without as we attempt to meet the challenges of our own day (p. 174).' Whether Professor Vos achieves this objective can only be judged by those to whom the work is primarily addressed. Many of the misperceptions pointed out can be traced to misuse of St. Thomas's works in the era when he was the mandated author for Roman Catholic studies in philosophy and theology. Those who value the genuine thought of St. Thomas and regret the continuation of these misrepresentations by so-called Catholic traditionalists will welcome the contribution made by this book. Recent years have seen the proliferation among American Protestants of a seemingly odd genre: group dogmatics. For whatever reason, the present generation of' systematic theologians has not produced a dogmatics or systematic theology text that the theology teachers of' America seem to be happy with. So, a variety of' groups have banded together to divide all theology into so many parts,and as a team produce a usable theology text. The best known of' these group texts is Christian Theology: An Introduction to its Traditions and Tasks, edited by Peter G. Hodgson and Robert H. King (Philadelphia: Fortress Press, 1982), but there have also been Methodist and Conservative Evangelical versions. Christian Dogmatics is the latest example of' the genre, and an ambitious one. While the authors are all teachers at American Lutheran seminaries, their audience is the entire Christian Church. Their goal is to produce a " complete dogmatics " which will serve as " a textbook in theological instruction and a resource for those who practice the arts of ministry." (!,xvii-xviii). The volumes are organized in twelve loci, where a locus is " a point at which the historic teachings and theological investigations of BOOK REVIEWS 153 the church are brought into focus" (I, xix) : Prolegomena to Christian Dogmatics (Braaten, 78 pp.), The Triune God (Jenson, 114 pp.), The Knowledge of God (Sponheim, 76 pp.), The Creation (Hefner, 94 pp.), Sin and Evil (Sponheim, 104 pp.), The Person of Jesus Christ (Braaten, 104 pp.), The Work of Christ (Forde, 100 pp.), The Holy Spirit (Jenson, 78 pp.), The Church (Hefner, 70 pp.), The Means of Grace (Schwarz and Jenson, 142 pp.), Christian Life (Forde, 80 pp), and Eschatology (Schwarz, 116 pp.). Each locus consists of 4 to 7 chapters, each chapter beginning with a few summarizing sentences. The authors sometimes organize the loci "systematically" (e.g., the knowledge of God is organized according to questions that parallel Aristotle's four causes); more often the author's combine the systematic and the historical, moving through Seriptures and tradition and modernity as well as providing a conceptual frame for their topic. A lengthy index of names and subjects in volume two (II,591-621) helps the reader track the overlap between these loci. A variety of threads tie the disparate contributions together. The six authors share a common outlook on contemporary theology, which might be called a theological version of "the radical middle." Decisive for this outlook is the conviction that there is a doctrinal core to the faith which it is the central task of dogmatics to explicate (I,5). Although the problems and conceptualities of the modern world are addressed throughout the text, they are not allowed to set the interpretative agenda. Historicamente, primeiro se constatou a existência do corpo e (...) da alma para depois se ocupar do tipo de relação que há entre ambos os princípios. Do ponto de vista histórico, houve um primado e uma supremacia da alma sobre o corpo. Entre ambos os princípios metafísicos, ora vigorava uma unidade acidental (provisória e dualista), ora uma unidade substancial (permanente e recíproca). Atualmente, a reflexão teológica defende uma unidade mútua e recíproca entre o corpo e a alma, de modo que cada princípio está ordenado para o outro. O ser humano é uma unitotalidade psicofísica e anímico-corpórea. Atualmente, há autores filósofos (X. Zubiri, M. Bunge) e teológos (J. Moltmann, Flick-Alszechy), que defendem como alternativa ao hilemorfismo aristótelico-tomista, novas formas de compreender a relação entre o corpo/matéria e alma/espírito. Cérebro.The scope of this paper is to present how occurred in historical level, and occurs in the contemporary world, the relation between body and soul in the context of Christian anthropology. Historically, in a first moment, it was identified the existence of the body and the soul, and afterwards, the type of relation between these two ontological principles. From a historical point of view, there was a primacy and supremacy of the soul over the body. Between these principles, sometimes prevailed an accidental unity (provisional and dualistic), sometimes a substantial unity (permanent and reciprocal). Nowadays, the theological reflection defends a mutual and reciprocal unity between body and soul, so that each principle is ordained one to the other. Human being is a psychophysical “unit-totality” constituted of body and soul. Currently, there are philosophers (X. Zubiri, M. Bunge) and theologians (J. Moltmann, Flick-Alszeghy), who defend, as alternative to the Aristotelian-Thomistic hylemorphism, new forms of understanding the relation between body/matter and soul/spirit. Yet, the legal doctrines of consent and informed consent differ in their applications. In patient care, the judicial doctrines of consent and informed (...) consent are disclosure doctrines based on the obligation of physicians to inform their patients of the following types of information: the nature of the procedure the physician is recommending in the patent’s care (P), the alternatives to the physician‐recommendation (A), and the risks of procedure and its alternatives (R). In addition, the physician must provide truthful answers to the patient’s questions (Q) to the best of the physician’s abilities. In research on humans, the onus of disclosure by study sponsors and principal investigators is much greater than in patient care precisely because the purpose of research is not patient care. The purpose of research is the identification and development of new generalizable knowledge. Thus, participation in a research study or trial may not benefit the study volunteer at all. In addition, the participant may carry a heavy risk burden in relationship to any testing of a newly designed drug or device as part of their experiences in the research study. Presently, despite the risks borne by the research study participant, the raw data collected from volunteers in research trials are treated by courts as if they were the private property of the study sponsor rather than generally owed to the public as would be expected by an effort like research participation aimed at contributing to the development of generalizable knowledge. This paper reviews the obligations that study sponsors owe to their study participants based on the very definition of research as a systematic activity whose purpose is to develop generalizable knowledge to help all humans. Counterpoint Arguments The following are counterpoint arguments that need to be appreciated to more fully understand the concepts that impact the thesis that ‘raw data’ should be open to the public to allow the opportunity of checking of the results of its associated scientific paper and for further analysis. De‐Identified (Anonymized) Raw Data A current approach to identifying (anonymizinig) raw data is based on the Health Insurance Portability and Accountability Act (HIPAA) of 1996 (P.L.104‐191). HIPAA was enacted by the U.S. Congress in 1996 to keep a person’s medical information private. In a research study, a person’s private medical information can become research data. HIPAA’s Privacy Rule allows a covered entity to de‐identify data by removing all 18 elements that could be used to identify the individual or the individual’s relatives, employers, or household members; these elements are enumerated in the Privacy Rule. The covered entity must also have no actual knowledge that the remaining information could be used alone or in combination with other information to identify the individual who is the subject of the information. Under this method, the identifiers that must be removed are the following: 1 Names. 2 All geographic subdivisions smaller than a state, including street address, city, county, precinct, ZIP Code, and their equivalent geographical codes, except for the initial three digits of a ZIP Code if, according to the current publicly available data from the Bureau of the Census: 2a. The geographic unit formed by combining all ZIP Codes with the same three initial digits contains more than 20,000 people. 2b. The initial three digits of a ZIP Code for all such geographic units containing 20,000 or fewer people are changed to 000. 3 All elements of dates (except year) for dates directly related to an individual, including birth date, admission date, discharge date, and date of death, and all ages over 89 and all elements of dates (including year) indicative of such age, except that such ages and elements may be aggregated into a single category of age 90 or older. 4 Telephone numbers. 5 Facsimile numbers. 6 Electronic mail addresses. 7 Social security numbers. 8 Medical record numbers. 9 Health plan beneficiary numbers. 10 Account numbers. 11 Certificate/license numbers. 12 Vehicle identifiers and serial numbers, including license plate numbers. 13 Device identifiers and serial numbers. 14 Web universal resource locators (URLs). 15 Internet protocol (IP) address numbers. 16 Biometric identifiers, including fingerprints and voiceprints. 17 Full‐face photographic images and any comparable images. 18 Any other unique identifying number, characteristic, or code, unless otherwise permitted by the Privacy Rule for re‐identification. Even though ‘raw data’ can be de‐identified (anonymized) so that there is no way to trace back the data to the study participant from which it was drawn, there are still questions whether the ‘de‐identified raw data’ can be given to other researchers or made public without the original study participant’s approval. It may be the case that this approval could be done at the start of any research study where the individual considering study participation would be counseled on what the process of de‐identification consists of and would be asked whether the participant would allow use of the data by other researchers or made available to the public in a de‐identified state. However, there may be questions of the study participants as to whether the data are truly de‐identified and untraceable back to the study participant since the participant would not be able to see the process actually being carried out in detail in all relevant circumstances. Using Raw Data in Context Simply being in possession of raw data is never enough to build on that data from a research perspective. Researchers need to understand the context of the scientific research study in which the data were collected. This research context includes (but is not limited to): (i) the scientific hypothesis of the research study, (ii) the inclusion and exclusion criteria selected by the research designers of the study to determine which study participants were included and which were excluded from the study, (iii) the methods used to collect the data and possibilities of errors in the data collection processes, and (iv) answers to questions regarding whether any data were excluded from the study data and why these data were excluded. Ownership Rights Over Data There are ownership rights over data. Ownership rights include court decision making related to the question which parties are to be considered as the owners of the data. Possible owners here include (but are not limited to) (i) the study sponsor whose only role was to fund that study, (ii) the principal investigator(s) who developed the scientific hypothesis, and (iii) individual study participants through special contracts made by individual participants who negotiate such contracts with study sponsors and principal investigators to share in the ownership of data. Examples of such data are participant sources of unique gene lines or unique cell lines to be used in future research. Objections to Data Sharing Finally, individual researchers may simply object to sharing data. A researcher’s arguments here may be simply stating that he or she has a right to fully analyze the data since the collection of the data was the researchers’ idea in the first place. These researchers may argue that they have the right to mine the data as fully as they can before deciding to make the data open to the public for others to analyze.
