Political Constructivism is concerned with the justification of principles of political justice in the face of pluralism. Contemporary accounts of multiculturalism, pluralism and diversity have challenged the capacity of political theory to impartially justify principles of justice beyond the boundaries of particular communities. In this original account, Peri Roberts argues that political constructivism defends a conception of objective and universal principles that set normative limits to justifiable political practice. _Political Constructivism_ explores this understanding (...) in two ways. Firstly, by engaging with constructivist thinkers such as John Rawls and Onora O’Neill in order to lay out a basic understanding of what constructivism is. Secondly, the author goes on to defend a particular account of political constructivism that justifies a universal primary constructivism alongside the many secondary constructions in which we live our everyday lives. In doing so he outlines an understanding of principled pluralism which accepts diversity whilst at the same time recognising its limits. Political constructivism is associated with John Rawls more than any other contemporary philosopher. This chapter suggests that Rawls's political constructivism is better understood as a general method of justification which runs throughout his work as a whole, including his early work and A Theory of Justice. The chapter develops the general characterization of Rawls's political constructivism. Its main elements are taken in turn and developed with special attention to the two places where Rawls discusses (...) the topic in depth – his Dewey Lectures on Kantian Constructivism in Moral Theory and its substantially revised version called “Political Constructivism” (PL, Lecture III). My project in the dissertation is to develop a constructivist account of the normative structure of political or civil obligations. The first part of the dissertation focuses on Kant's moral and political constructivism respectively. In chapter two I argue that Kant's account of the normativity of moral obligations is rooted in the idea of moral community which is an objective end that is built into the structure of our practical reasoning. Moral obligations are justified for Kant because (...) they reflect our rational agency and, in particular, the interest we have in promoting a moral community. ;In chapter three I focus on what Kant's idea of the problem of politics: the construction of a society that can successfully and universally administer justice while promoting the interest each citizen has in living in realizing their full capacities as autonomous human beings. I argue that Kant is unable to show that civil obligation---the duties we have qua citizens---are normative in the right sort of way. Kant's account of civil or juridical obligations fails to show that these obligations are normative as moral laws---that they are justified and reason-giving in virtue of their connection to our political consciousness. ;In chapters four through six I present a fully developed account of how political constructivism uses the features of practical reason to evaluate and assemble our ordinary political consciousness---fundamental ideas of free and open society---into a conception of justice, and the normativity of civil obligations---how they are justified and in what sense they are reason-giving for persons qua citizens. ;I lay out Rawls's argument that justice as fairness is a freestanding view by working out exactly how the view is put together without appeal to any particular comprehensive doctrine. In Political Liberalism, J. Rawls describes a meta-ethical procedure — political constructivism — whereby political theorists formulate political principles by assembling and reworking ideas from the public political culture. To many of his moral realist and moral constructivist critics, Rawls's procedure is simply a recent version of the “popular moral philosophy” that Kant excoriates in the Groundwork for the Metaphysics of Morals. I defend the idea of political constructivism on philosophical and (...) class='Hi'>political grounds. I argue that political constructivism is the best available methodology for self-legislating, socially embedded and fallible human beings; then I show that political constructivism may produce principles that could garner the principled assent of Euro-American Muslims such as Taha Jabir Al-Alwani. Contemporary liberal political justification is often accused of preaching to the converted: liberal principles are acceptable only to people already committed to liberal values. Catriona McKinnon addresses this important criticism by arguing that self-respect and its social conditions should be placed at the heart of the liberal approach to justification. A commitment to self-respect delivers a commitment to the liberal values of toleration and public reason, but self-respect itself is not an exclusively liberal value.

Abstract: In this article the author develops the view, held by some, that political constructivism is best interpreted as a pragmatic enterprise aiming to solve political problems. He argues that this interpretation's structure of justification is best conceived in terms of two separate investigations—one develops a normative solution to a particular political problem by working up into a coherent whole certain moral conceptions of persons and society; and the other is an empirically based analysis of the (...) political problem. The author argues that the empirically based analysis can generate criteria for assessing whether the normative theory successfully works out a solution, thereby developing a functionalist structure of justification. He further argues that this interpretation overcomes a longstanding criticism of constructivism, namely, that the use of substantive moral concepts in the hypothetical choice procedure biases the defense of principles in a particular direction and therefore begs important philosophical questions. In this paper, I take up Habermas’s recent writing on Rawls in Inclusion of the Other and focus on an example that Habermas discusses there, the Catholic stance on abortion. He brings in this example to question how such views could be rationally negotiated, under Rawls’s views of political liberalism, prior to arriving at an overlapping consensus. Habermas argues that Rawls must affirm the truth of moral constructivism in order to resolve the question of which conceptions of the (...) good make a valid claim on us. Though I have criticisms of how both Rawls and Habermas cast the issue of abortion, I argue that through properly understanding the role of the political ideal of citizenship in Rawls’s conception of political liberalism, we can find resources to contend with the problem Habermas finds here. I defend the capacity of political constructivism to resolve this issue without affirming the truth of moral constructivism. (shrink)

Maya Zehfuss critiques constructivist theories of international relations (currently considered to be at the cutting edge of the discipline) and finds them wanting and even politically dangerous. Zehfuss uses Germany's first shift toward using its military abroad after the end of the Cold War to illustrate why constructivism does not work and how it leads to particular analytical outcomes and forecloses others. Consecutive constructivism is a moral and political theory which mitigates structural injustice by securing individuals' perception of private morality--that is, inventing procedural devices to make people enhance their moral consciousness--and, at the same time, encourages people to voluntarily concern themselves with procedural justice and public morality. The crucial reason for this position is that a detouring method of not directly dealing with the problem of justice but rather discussing the problem of morals is required to avoid the lucid (...) criticisms of statists that the sovereign ruling states with authority or the world government does not exist. This book suggests a new approach to the problem of global justice, termed here consecutive constructivism. It provides a way of coping with procedural justice at the global level, while also alleviating the problem of structural injustice insofar as it exacerbates procedural injustice. Acknowledging the fact that the discussion of global justice is difficult in a world constituted of lots of sovereign states, it sketches out a political theory which begins with the problem of morals and then consecutively moves on to the matter of justice. The result is a novel normative theory narrowing the gap between Neo-Westphalian and Post-Westphalian traditions. (shrink)

This work presents an approach to the study of comparative politics that builds on the assumption that political actors and institutions operate within constructed communities of meaning, which in turn interface with other such communities.

There are at least two politically salient senses of “representation”—acting-for-others and portraying-something-as-something. The difference is not just semantic but also logical: relations of representative agency are dyadic (x represents y), while portrayals are triadic (x represents y as z). I exploit this insight to disambiguate constructivism and to improve our theoretical vocabulary for analyzing political representation. I amend Saward’s claims-based approach on three points, introducing the “characterization” to correctly identify the elements of representational claims; explaining the “referent” in (...) pragmatic, not metaphysical terms; and differentiating multiple forms of representational activity. This enables me to clarify how the represented can be both prior to representation and constituted by it, and to recover Pitkin’s idea that representatives ought to be “responsive” to the represented. These points are pertinent to debates about the role of representatives, the nature of representative democracy, and the dynamics of revolutionary movements. (shrink)

This paper is a defence of the view that, contrary to a recent trend in the literature, there is a distinctively political kind of normativity. Four steps are taken to establish that conclusion. First, I introduce a constructivist methodology for practical philosophy, one that is focused on the problem-solving nature of normative concepts. Second, I propose to understand the political as constituted by political problems, that is, by problems that concern members of a collective as members of (...) that collective. Third, I claim that there is a kind of collective obligations, which I call political collective obligations, that do not provide direct and clear action guidance to those subject to them, but that are rather best conceived of as thin obligations. Such thin obligations stemming from properly conceived political problems constitute a distinctive kind of normativity, the normativity of politics. Because political collective obligations typically lack action guidance, what they mandate is that each obliged agent contribute their share to what they normatively regard as the best collective solution to the political problem. The paper concludes with some considerations about the so-called inefficacy problem in light of the previously established conclusions. (shrink)

In The Law of Peoples, John Rawls develops a theory of global justice whose scope and ambitions are quite modest. Far from justifying a global resource distribution principle modeled on the difference principle, Rawls’s theory does not argue for significant redistribution among peoples. This paper focuses on Rawls’s claim that the character and scope of his account of global justice are determined by the constructivist method that he employs to extend political liberalism’s project from the domestic to the global (...) sphere. The principles of an acceptable law of peoples, he argues, are simply those principles that would be selected by rational representatives of peoples from the standpoint of a suitably characterized fair choice position. This paper argues that Rawls’s constructivist method in fact provides support for an account of global justice of greater scope and ambition than Rawls’s Law of Peoples. (shrink)

More precisely, it seeks to answer Robert Garner’s objection to the idea that Rawlsian constructivism is an interesting framework to develop animal political theory. I sustain, specifically, that his critiques are based on an inadequate understanding of constructivism and its relationship to contractual arguments. Arguably, the most important theoretical innovation are the so-called ‘constructivist’ approaches to political representation. These approaches play a central role in Creating Political Presence: The New Politics of Democratic Representation and The Constructivist Turn in Political Representation, two impressive volumes that take stock of the state of the art in representation theory. Critical constructivism adds a dimension of collective action to postphenomenology. This paper explains the intervention of collective subjects into technological design. That intervention presupposes communication between lay and expert actors which is made possible by the dependence of technical disciplines on the lifeworld. Understanding the public processes of intervention requires a notion of multiple types of rationality and a social account of technological design.

Constructivism in ethics is the view that insofar as there are normative truths, for example, truths about what we ought to do, they are in some sense determined by an idealized process of rational deliberation, choice, or agreement. As a “first-order moral account”--an account of which moral principles are correct-- constructivism is the view that the moral principles we ought to accept or follow are the ones that agents would agree to or endorse were they to engage in (...) a hypothetical or idealized process of rational deliberation. As a “metaethical account” – an account of whether there are any normative truths and, if so, what they are like – constructivism holds that there are normative truths. These truths are not fixed by facts that are independent of the practical standpoint, however characterized; rather, they are constituted by what agents would agree to under some specified conditions of choice. In working to provide a more precise definition of constructivism in metaethics, the focus of this entry, one faces two main difficulties. The first difficulty is that constructivism comes in several varieties, each of which claims a different niche within metaethics, and some claim no space at all. The second difficulty concerns where to place constructivism on the metaethical map in relation to realism and anti-realism. These are terms of art, and it is highly contested which views count as realist and which as antirealist. These two difficulties will be addressed in what follows by focusing on the distinctive questions that constructivist theories are designed to answer. Section §1 defines the scope of constructivism in ethics, in contrast to constructivism in political theory. Sections §§2-5 illustrate the main varieties of metaethical constructivism, which are designed to account for the nature of normative truths and practical reasons. Section §6 presents the main varieties of constructivist accounts of the justification of moral judgments of right and wrong. Since the appearance of Hayden White's seminal work Metahistoryin 1973, constructivist thought has been a key force within theory of history and has at times even provided inspiration for historians more generally. Despite the radical theoretical shift marked by constructivism and elaborated in detail by its proponents, confusion regarding many of its practical and ethical consequences persists, however, and its position on truth and meaning is routinely misconstrued. To remedy this situation, The Work of Historyseeks to mediate between constructivist (...) theory and history practitioners' intuitions about the nature of their work, especially as these relate to the so-called fact-fiction debate and to the literary challenges involved in the production of historical accounts. In doing so, the book also offers much-needed insight into debates about our experiential relations with the past, the political use of history and the role of facts in the contestation of power. Moving beyond the post-political framing of the climate change debate, scholars have tried to show that scientific practice is based on politically significant forms of social construction. While sympathizing with this attempt, this paper questions their use of the term ‘political’. Drawing on post-foundational political theory and focusing on the example of climate denialism, it argues that the relation between science and the political constitutes a double bind: while upholding an original distinction between science and the (...) political is untenable, representing science in political terms is impossible, because of the specific way the scientific field is symbolically instituted. By the late 1920s in Europe new art directions were regarded as already completed phenomena, a part of “avant-garde tradition.” Such views were expressed by Jean Arp and El Lissitzky’s in their book Kuntismen, and by Amédée Ozenfant’s in Art. Bilan des arts modernes en France. Similar opinions were also voiced by Jan Brzękowski, a Polish poet and critic, who regarded this time as a period of “establishing certain values” rather than new breakthroughs. In this article I discuss Brzękowski’s strategies (...) as a spokesman of modern art, an intermediary between the Parisian artworld and Polish avant-garde, an author connected with constructivism, and also with surrealist circles in Paris. My main focus is his magazine “Sztuka Współczesna – L’Art Contemporain” and his series of articles “Mileages,” in which he summarizes the developments of modern art. Conscious of the “wearing up” of avant-garde ideas and critical about seeking “novelty” for its own sake, Brzękowski tried to establish a progressive position based on the idea of formal discipline and creative construction. While rejecting a mimetic conception of art, he argued for abstract artistic form that would be “anchored to the bottom of life,” thus emphasizing the interplay of abstract and figurative elements and their dialectic. This article focuses on the general theoretical issue of realism versus constructivism in politics, with a case of the present-day Russia as the main and most telling example. We present four assertions that we are going to defend. First, we claim that in the sphere of international relations, political realism of the offensive type, after decades of more tempered USA–USSR relations, is again challenging its opponent: political constructivism. Second, political realism is winning in the sphere (...) of domestic politics and policy in the leading countries as well. Third, we touch upon theoretical issues and discuss the ontological nature of political realism in comparison with political constructivism and the kindred of the latter with normativism, legalism, constitutionalism and liberalism. Political constructivism as a concept is underestimated and rarely used. Our article explicates the concept of political constructivism, which is a novel contribution to political theory and political philosophy. Fourth, we show that political constructivism, being the most advanced achievement of political civilization compared to archaic realism, has not lost the game so far and should be upheld in its battle with the remnants of the wild political past. Sliding back to political realism would turn humankind into another degraded animal species instead of making it the pilot in continuing human progress. (shrink)

The term “constructivism” names a family of political, moral and metaethical views that, in general terms, regard some or all normative claims as valid in virtue of being outcomes of a “procedure of construction” in which actual or hypothetical agents react to, choose, or otherwise settle on principles of justice, moral rules, values, etc. Traditionally, moral validity or justifiability was thought to depend on God, the Forms, or some other independent moral order. Various procedures of a different, epistemological, (...) sort were then proposed to help us gain access to the moral facts, which were thought to exist independently of us (e.g., we might need to undergo physical and mental training of the sort described in Plato's Republic or learn how to reflect in a “calm, cool hour”). Constructivists, by contrast, think that there are certain procedures that are not designed to discover which normative claims are already valid. For them, the validity of some or all reasons, principles, values or other normative claims consist in being the result of a procedure of construction. For example, Rousseau (1997) held that states are legitimate just in case and because they would be agreed to by reasonable people who were concerned to advance their own basic interests in freedom, self-improvement, and happiness, while Locke (1998) argued that governments are legitimate just in case and because free and equal (male, property-owning) people in a state of equal freedom actually agreed to them so long as those governments remain within the confines of natural law. In his Democratic justice and the social contract, Weale presents a distinctive contingent practice-dependent model of ‘democratic justice’ that relies heavily on a condition of just social and political relations among equals. Several issues arise from this account. Under which conditions might such just social and political relations be realised? What ideal of equality is required for ‘democratic justice’? What are its implications for the political ideal of citizenship? This paper focuses on these questions as a way (...) to critically reconsider Weale’s model. After presenting Weale’s procedural constructivism, I distinguish his model from an institutional practicedependent model, one salient example of which is Rawls’s political constructivism. This distinction allows for a formulation of the social and political equality required for justice in each case. The contingent model assumes that an equality of ‘status’ will generate just social practices, yet it fails to recognise that an equality of ‘role’ is also important to ensure citizens’ compliance. The paper ultimately seeks to show that the contingent model is insufficient to ensure that just social practices will become stable. (shrink)

Context: It is beyond doubt that RC has received a great deal of attention in educational studies and learning theory. But overall, the current situation seems to be rather ambivalent in view of the blurring of the various strands in constructivist discourses and the different ways of distinguishing and foregrounding constructivist positions. Correspondingly, there is a wide range of claims, from the claim that (radical) constructivism represents a mainstream endeavor to attributions of its being outdated, self-refuting or irrelevant. Purpose: (...) The paper seeks to sound out the ambivalent situation of (radical) constructivism between “all” and “nothing” by examples of attributions of meaning to constructivist positions in academic everyday life and by challenging both prevalent criticisms of systemic-constructivist pedagogy and widespread broad classifications in learning theory. Method: The article critically reflects on (1) one-sentence “destructions” of constructivist positions, (2) Pongratz’s criticism of systemic-constructivist pedagogy, and (3) the threefold classification of the world of learning, i.e., behaviorism, cognitivism, and constructivism. Results: Both the current criticism of constructivism as a mainstream endeavor and evolutionary suggestions provided by the threefold classification are criticized. Although some constructivist concepts and distinctions are widely accepted today, often these achievements are not recognized as being rooted in constructivist discourses. Implications: As far as mainstreaming constructivism might be related to power politics, selling the “real thing,” and joining the ranks of truth-oriented Isms, it would not appear to be a desirable endeavor for those who rely on viability, circular foundations, relativist philosophy, and relationalist approaches. Nevertheless, clarifications of power relations and the interplay between constructivist analyses of politics and the politics of constructivism might contribute to overcoming the diffuse popularity of constructivist thought towards a better understanding of constructivist contributions to solution oriented, meaningful ways of dealing with urgent problems. Onora O’Neill has contributed enormously to moral philosophy (broadly speaking, including both ethics and political philosophy) by identifying Kant’s unique and powerful form of normative constructivism. Frederick Neuhouser has contributed similarly by showing that all of Hegel’s standards of moral rationality aim to insure the complete development of three distinct, complementary forms of personal, moral and social freedom. However, Neuhouser’s study does not examine Hegel’s justificatory methods and principles. The present article aims to reinforce and extend Neuhouser’s findings (...) by explicating Hegel’s basic principles for justifying practical norms. Surprisingly, Hegel’s basic principles of normative justification are rooted in Kant’s constructivism, as explicated by O’Neill. Hegel’s adaptation and development of Kant’s constructivism results in a powerful form of constructivism about moral principles which merits contemporary interest because it is more powerful and more objectivist than familiar contemporary forms of constructivism. The dissertation defends that the often-assumed link between constructivism and universalism builds on non-constructivist, perfectionist grounds. To this end, I argue that an exemplary form of universalist constructivism – i.e., O’Neill’s Kantian constructivism – can defend its universalist commitments against an influential particularist form of constructivism – i.e., political liberalism as advanced by Rawls, Macedo, and Larmore – only if it invokes a perfectionist view of the good. (En route, I show why political liberalism (...) is a form of particularism and reconstruct the role of its conception of public justification, its implied contextualism about justified belief, its conceptions of toleration, neutrality, good reasons, and legitimacy, and, not least, its justification-constitutive conception of reasonableness.) Contrary to what is often assumed, then, at the level of a vindication of the very project of a universalist constructivism, universalist constructivists should construe perfectionists not as their opponents, but as partial, though uneasy, allies. Most agree that when it comes to so-called 'first-order' normative ethics and political philosophy, constructivist views are a powerful family of positions. When it comes to metaethics, however, there is serious disagreement about what, if anything, constructivism has to contribute. In this paper I argue that constructivist views in ethics include not just a family of substantive normative positions, but also a distinct and highly attractive metaethical view. I argue that the widely accepted 'proceduralist characterization' of constructivism (...) in ethics is inadequate, and I propose what I call the 'practical standpoint characterization' in its place. I then offer a general taxonomy of constructivist positions in ethics. Since constructivism's standing as a family of substantive normative positions is relatively uncontested, I devote the remainder of the paper to addressing skeptics' worries about the distinctiveness of constructivism understood as a metaethical view. I compare and contrast constructivism with three other standard metaethical positions with which it is often confused or mistakenly thought to be compatible: realism; naturalist reductions in terms of an ideal response; and expressivism. In discussing the contrast with expressivism, I explain the sense in which, according to the constructivist, the distinction between substantive normative ethics and metaethics breaks down. I conclude by distinguishing between two importantly different debates about the mind-dependence of value. I argue that a failure to make this distinction is part of what explains why the possibility of constructivism as a metaethical view is often overlooked. (shrink)

This book proposes a new institutional constructivist model, for social scientific and legal enquiries, based on the interrelations within the social and political world and the application of change in EU laws and politics. Much of the research conducted in social sciences and law examines the diverse activities of individuals and collectivities and the role of institutions in the social and political world. Although there exist many vantage points from which one can gain entry into understanding how agents (...) in the world act, interact, shape and bear the world, socio-legal scientific epistemology has found monism and dualism to be convincing models. This book argues that current models do not capture the complexity of our micro-worlds, macro-worlds and meso-worlds. Nor can they account for the forms and patterns of socio-legal change. Mind, time and change are brought together in an attempt to contribute to socio-legal epistemology and to enhance its toolkit. (shrink)

The article offers an account of the constructivist methodology in ethics and political philosophy as 1) deriving from an agnostic moral ontology and 2) proposing intersubjective justifiability as the criterion of justification for normative principles. It then asks whether constructivism, conceived in this way, can respond to the challenge of “content skepticism about practical reason”, namely whether it can provide sufficiently precise normative guidance whilst remaining faithful to its methodological commitment. The paper critically examines to alternative way of (...) meeting this challenge, namely John Rawls's original position and O'Neill's Kantian constructivism, analyses what is problematic about both, and endorses a third, possibly intermediate model. Constructivism holds that justification does not rely on any antecedent moral or political values outside of the procedure of agreement. Representation holds that the reasons for the choice in the model must be rationally explicable to real agents outside the model. Stability holds that the principles chosen in the procedure should be stable upon reflection, especially in the face of diversity in a pluralistic society. Choice (...) procedures that involve at least two-stages with different information, as Rawls’s theory does, will be path-dependent and not meet the condition of representation since it will not be globally coherent. Attempts to solve this problem without eliminating the segmentation of choice in the procedure will run afoul of constructivism or stability. This problem is instructive because it highlights how public reason theories must evolve in the face of increased concerns about diversity. (shrink)

In the title of his 1980 Dewey Lectures, John Rawls announced that his theory of justice as fairness could be described as an example of “Kantian Constructivism in Moral Theory” (KC). Rawls flirted around 1980 with a strong commitment to Kantian autonomy, only to abandon it as unnecessary to the justification of his theory of justice. The chapter argues that this supposed opposition is based on a serious misunderstanding of Rawls's intellectual trajectory, and especially of the way he understands (...) the Kantian elements of his theory. It shows that, against the assumptions of the familiar debates, Rawls in and after KC, consistently held that the practical aims of constructivism and the philosophical goal of a fully rational justification are not in any sort of tension. Rawls's claims in Political Liberalism and after, and especially his distinction between his political and Kant's moral constructivism, in no way undermine this argument. (shrink)

Many normative theorists want to contribute to making the world a better place. In recent years, it has been suggested that to realise this ambition one must start with an adequate description of real-life practices. To determine what should be done, however, one must also fundamentally criticise existing moral beliefs. The method of reflective equilibrium offers a way of doing both. Yet, its practical usefulness has been doubted and it has been largely ignored in the recent practical turn of normative (...) theorising. This paper offers a complementary methodology to the method of reflective equilibrium, referred to as Rawlsian constructivism, which brings forth its practical merits. With the support of Rawlsian constructivism, the method of reflective equilibrium becomes a tool for public reasoning about practical problems which aims to facilitate shared solutions. The process of reflective scrutiny is used, not in the search of moral truth, but rather to highlight what stands in the way of solutions to problems agents face in different domains of social life. The practical value lies in scrutinising reasons for action that are taken for granted, explicating new rationales for action and highlighting neglected points of agreement. The paper exemplifies this approach with a process of justifying individual obligations to combat climate change. Normative theorists who share the practical agenda have correctly noted the importance of bottom-up investigations of subject domains. This paper argues that the next step should be to utilise this version of the method of reflective equilibrium to explore the potential for morally progressive solutions to these problems. (shrink)

This paper characterises concisely a key issue about rational justification which highlights an important achievement of Kant’s constructivist method for identifying and justifying basic norms: uniquely, it resolves the Pyrrhonian Dilemma of the Criterion. Kant’s constructivist method is both sound and significant because it is based on core principles of rational justification as such. Explicating this basis of Kant’s constructivism affords an illuminating and defensible explication of four key aspects of the autonomy of rational judgment, including our positive moral (...) freedom; it shows how Kant’s constructivism is fundamentally social and it shows how Kant’s constructivism can readily accommodate historical factors which bear on the appropriateness and legitimacy of social and political institutions. All of these advantages are available without recourse to Kant’s transcendental idealism, and all of them respond to common complaints about or alleged objections to Kant’s practical philosophy. This article challenges the assumption underlying most education reforms that constructivism is politically neutral and intrinsically democratic. It makes this argument by examining the curriculum reform in Spain during the 1980s and 1990s in light of the neoliberal politics that the country was experiencing at that time. This study employs the poststructuralist analytical lens of governmentality developed by Foucauldian scholars. Accordingly, it claims that, the psychological version of constructivism adopted by the official curriculum reform failed to deliver promises (...) for democracy because it was crafted within the same neoliberal political rationality that redefined the terms of government in the late 1980s, a redefinition that decontextualized the learner from his/her social context and adopted the logic of the market. G. A. Cohen and J. Raz object that Constructivism is incoherent because it crucially deploys unconstructed elements in the structure of justification. This paper offers a response on behalf of constructivism, by reassessing the role of such unconstructed elements. First, it argues that a shared conception of rational agency works as a starting point for the justification, but it does not play a foundational role. Second, it accounts for the unconstructed norms that constrains the activity of construction as (...) constitutive norms. Finally, on this basis, it draws a contrast between constructivist and foundational methods of ethics, such as deontology and teleology. (shrink)

The paper advances a non-orthodox reading of political liberalism’s view of political legitimacy, the view of public political justification that comes with it, and the idea of the reasonable at the heart of these views. Political liberalism entails that full discursive standing should be accorded only to people who are reasonable in a substantive sense. As the paper argues, this renders political liberalism dogmatic and exclusivist at the level of arguments for or against normative theories (...) of justice. Against that background, the paper considers aspects of a more plausible, deeper and more inclusive idea of public political justification that builds on a thinner, potentially cosmopolitan idea of the reasonable. The paper considers what content such an idea may have, and identifies a method of inclusive abstraction through which it may be enriched in content to render it fruitful for the purposes of a justification of principles of political justice. But the move toward more depth and inclusiveness faces constructivism with two challenges. First, inclusivism about the scope of political justification might not be able to avoid dogmatism unless it invokes perfectionist considerations. And second, the authority and appeal of a fruitfully rich idea of the reasonable depends on whether the addressees of political justification already value wide acceptability. (shrink)

In spite of the iron curtain looming large between western academics and their (often politically persecuted and institutionally detached) colleagues in the eastern bloc, some intellectual developments bear striking similarities. This paper analyses one of them: the conception of human rights by Ladislav Hejdánek as opposed to Kantian constructivism, which was developed in the “west” by John Rawls and others. Both Rawls and Hejdánek, who was one of the philosophical heavyweights of Czech dissent, are moved by very similar concerns: (...) the need to ground objective values without falling into utilitarianism or some (other) form of naïve ethical objectivism. They view political values as constructed and yet objective, not given but still sound. Given the immense difference in their professional position and philosophical style, this indicates a truly interesting case of a unity of concern bridging the east and the west, even under very unfavorable political conditions. Constructivism is a theory that believes moral judgments are not real things but they are constructed by practical reason in a rational procedure for resolving practical problems in front of us. Christine Korsgaard, a contemporary American philosopher, is a Kantian constructivist, whose theory I consider in this paper. She is a radical constructivist and disagrees with moral realism and denies moral truths even as abstract facts. According to Korsgaard moral judgments are constructed by rational agents. She believes moral and (...) political principles are generally solutions to human practical problems. She justifies the normativity of moral obligations from this point that they are constructed by agent for resolving his problems. Introduction One of the traditional problems in moral philosophy is the nature and entity of moral truths and judgments. Do humans themselves make and construct them or are they facts and truths in the world which humans just discover? Are moral truths and values subjective or objective? Subjectivism and objectivism have been two old rivals in this question. But some philosophers have proposed a new theory between them that is called Constructivism. According to this theory, moral truths are not real and objective, but are constructed by human practical reason. In this view, an action is morally right when there is a sufficient reason to perform it. In this paper I will discuss Korsgaard’s constructivism. 1. Definition of Constructivism Constructivism is a theory about the justification of moral principles. It is the view that moral principles are the ones agents would agree with or endorse if they were to engage in a hypothetical or idealized process of rational deliberation.
