Using an interpreter in qualitative interviews: does it threaten validity?There is an extensive literature on the problem of translating scales for use across cultures, but very little is published on the problems of conducting qualitative interviews in another language with assistance of an interpreter. The aim of this paper is to describe and discuss threats to validity that arise when conducting qualitative interviews using an interpreter. Ten female student nurses in two cities in Lithuania were interviewed about (...) how they perceived their educational program. All interviews were conducted in English with an interpreter. When using an interpreter to conduct interviews, potential threats to validity arise at various points in the interview process. A threat arises when the researcher, whose first language is Swedish, addresses a question in English to the interpreter, another during the translation by the interpreter from English to Lithuanian, and again when the interpreter translates the interviewee’s Lithuanian responses to English. In the last situation, the researcher may not know whether the interpreter has summarized and/or modified the responses. To mitigate these problems, the interpreter should not only have the required linguistic abilities, but also be trained in the research field. The researcher has to be aware of these threats to validity and make efforts to meet and limit their effects. (shrink)

The Legal Knowledge Engineering is a new topic of investigationof Artificial Intelligence. This paper discusses some relevant problems relatedto this new area in a summarized way. In this paper, we consider the approximationbased on logic. It is considered a paraconsistent annotated deontic logic.Based on this logic, it is established a new proposal that is called Paraconsistent Legal Knowledge Engineering. For this proposal, it it is suggested ameta-interpreter to support the deontic operators as well as inconsistency —entitled on this paper Paralog D that can be used as a base to handle withthe issues discussed. And it makes me want to take her by the hand and just walk right out of there, me holding her left hand, the Deaf interpreter holding her right hand, the three of us skipping through the waiting room and out the door of (...) the audiology department, away from [End Page 148] her parents who don't know how to sign—who want to "cure" her of being Deaf—away from the hospital and all the doctors with their pathological views of Deaf people.But we can't do that. We must wait here in the waiting room until her name is called. And then we'll go inside for the meeting to discuss the elective cochlear implant surgery that she has not elected to have—her parents are electing it, because, understandably, they want her to be able to hear. And yet she's Deaf. But they didn't sign up for having a Deaf child. In fact, they were probably devastated when the audiologist told them: Your child is profoundly deaf.Lower case d deaf: people who have a hearing loss. Upper case D Deaf: people who have a hearing loss and for whom sign language—and its attendant culture—represents their primary experience and allegiance; people who mostly attend Deaf schools, mostly marry other Deaf people, mostly hang out with Deaf friends and Deaf family, attend Deaf events and Deaf sporting competitions and Deaf theater and Deaf parties and barbeques and Deaf conferences and conventions, and are active in Deaf civic organizations and Deaf politics.Ninety percent of Deaf people are born to parents who hear, who, for the most part, don't know any Deaf people, don't know how to sign, and want nothing more than for their child to be "normal," to be hearing, like them. So when the audiologist tells them about the option of an invasive surgery whereby they can implant an electrode in the cochlea of the inner ear and give the child a possibility of greater access to sound, the parents jump at the chance, the hope, of somehow making their Deaf child hearing.But what about the other ten percent, the Deaf children who are born to Deaf parents? Well, that's an entirely different story: When the audiologist tells a Deaf couple that their child is profoundly deaf, those parents will often celebrate the news, smile a big knowing Deaf smile and give each other a big Deaf hug and high-five, and maybe even give the benighted audiologist a hug and a high-five too, for being the bearer of great tidings. Because healthy Deaf babies are good, the more, the better.As for the ninety percent of Deaf children who are born to hearing parents, growing up to be a happy, healthy, linguistically, and culturally Deaf adult is not something they are able to learn from their parents. It's something that takes place horizontally instead of vertically (i.e., from other Deaf people). It's not unlike the experience of gay children, trans children, or transracially adopted children (e.g., children of color with white adoptive parents) who often don't learn to embrace their identities until they reach adulthood and meet others who are like them. But if there were a way to implant gay children to make them straight, or to implant trans children to make them cis, or to implant children of color to make them white, there would rightly be a public outcry condemning the practice as unethical and immoral. And yet the vast majority of Deaf infants and Deaf children worldwide are being implanted in the name of medicine, in an attempt to make them hearing, an attempt to eradicate Deaf people for their own good because some people don't value the way they are different. Les procès pour viol sont rares dans les archives judiciaires de l’Ancien Régime européen. Ils ont néanmoins été étudiés suivant des approches quantitatives qui ont mis en évidence le profil des plaignantes et des inculpés (milieu social, âge, état matrimonial) ainsi que la typologie des scénarios de la violence sexuelle (lieu, temporalité, gestes). Cet état de la recherche s’intéresse plutôt aux approches qualitatives de ces sources et plus particulièrement aux méthodes développées pour lire et interpréter les récits judiciaires rapportés par (...) les professionnels de la justice. Un premier type de travaux s’est attaché à replacer le récit judiciaire dans le cours de la procédure criminelle afin de reconstituer ses conditions d’élaboration et d’en spécifier la nature exacte. Ce faisant, ils ont cherché à évaluer la manière dont les justices d’Ancien Régime, inquisitoires ou accusatoires, prenaient en compte le récit des victimes. Un second type de travaux a cherché à interpréter la parole des parties en présence en mettant en évidence les stratégies, les non-dits, les silences : il s’agit alors de s’intéresser aux représentations et aux imaginaires de la sexualité et du genre, telles qu’ils s’expriment à travers l’expérience de la violence. Philosophers of language and linguists tend to think of the interpreter as an essentially non-creative participant in the communicative process. There’s no room, in traditional theories, for the view that correctness of interpretation depends in some essential way on the interpreter. As a result, there’s no room for the possibility that while P is the correct interpretation of an utterance, u, for one interpreter, P* is the correct interpretation of that utterance for another interpreter. Recently, a (...) number of theorists have, for separate reasons, argued in favour of a radically different view of communication – a view in which the interpreter and her context play what should be thought of as a content-creating role. According to such views, natural languages contain what I’ll call interpretation sensitive terms: terms the correct interpretation of which varies across interpreters (or, more generally, contexts of interpretation).3 An interpretation sensitive sentence can have one content relative to one interpreter and another content relative to another interpreter. This paper is a development and (partial) defence of the view that interpretation sensitivity is ubiquitous in natural language. I call the view that there are interpretation sensitive terms content relativism. Before starting the discussion of content relativism, it is worth pointing out that recent attempts to develop semantically motivated versions of truth relativism should be seen as part of this trend of giving the interpreter a more active role. The Task of the Interpreter offers a new approach to what it means to interpret a text, and reconciles the possibility of multiple interpretations with the need to consider the author’s intention. Vandevelde argues that interpretation is both an act and an event: It is an act in that interpreters, through the statements they make, implicitly commit themselves to justifying their positions, if prompted. It is an event in that interpreters are situated in a cultural and historical framework and (...) come to a text with questions, concerns, and methods of which they are not fully conscious. These two aspects make interpretation a negotiation of meaning. The Task of the Interpreter provides an interdisciplinary investigation of textual interpretation including biblical hermeneutics, translation, and literary fictions. Language-related right in the legal proceedings is mostly associated with access to interpreting. Literature on the bilingual courtroom primarily centres on the role of interpreters in the intercultural communication. This paper, drawing on discourse analysis of a case study in a Chinese criminal court, investigates the atypical role played by an interpreter when she ceases to be an active participant in the bilingual interaction. It discusses how language ideology underlying the judicial practice could transform the role of the (...) class='Hi'>interpreter and convert the bilingual arterial into a monolingual one. Situating the analysis in the wider social and legal context of Chinese criminal justice system, this paper attempts to explain and interpret the judicial behaviour to keep the interpreter silent and the impact on the language rights enjoyed by the minority-language-speaking defendants. Discourse-based interpreting research has determined that interpreters are participants within interaction. Grice established that conversation participants conform to a cooperative principle. With respect to interpreting, what is the cooperative principle? How do sign language interpreters and deaf people work together to negotiate meaning in interpretation? The aim of this article is to present a case study of a deaf presenter and two sign language interpreters and evidence of their strategies for cooperation in interpreter-mediated monologic talk. Drawing on a framework (...) of interactional sociolinguistics, naturalistic data from a seminar presentation was analysed, focusing on the use of pauses, nods and eye contact as contextualization cues in the interpreter-mediated event. It was found that these three participants used these cues deliberately and strategically for signalling comprehension, marking episodes, clarification and controlling the pace of the presentation; drawing on their frames of reference. Thus, the data suggest that the cooperative principle of interpreting involves the establishment of particular cues for communication. (shrink)

Brentano began and ended his career by studying Aristotle. His first and last books are dedicated to this philosopher and represent the most part of what he managed to publish in life. Therefore, his efforts as an interpreter of Aristotle should not be relativized. In these pages, I intend to expose Brentano’s position regarding the method of study of Aristotle, which also will provide a good overview of his way to understand the thinking of the Greek philosopher.
