This study tests an integrative model of corporate political action, the filter model, based on the behavioral theory of the firm. The filter model posits that external political, economic, and industry environments are mediated by organizational structures and resources to affect a firm’s political actions. The authors rate the filter model’s predictive power against that of an economic-based direct-effects model by examining the efforts of about 1,100 U.S.-domiciled manufacturing firms to influence trade policy. In contrast to the recent rise to economic importance of offshore finance centres (OFCs), the topic of taxation has so far created little interest among scholars of corporate social responsibility (CSR). This paper makes two contributions to addressing this lacuna. Applying a range of influential normative theories of ethics, it first offers an ethical evaluation of tax havens. Second, the paper examines what use large firms that are headquartered in two OFCs—Bermuda and the Cayman Islands—make of formal CSR tools. The (...) emerging duplicity in tax havenbased companies professing social responsibility highlights once more the political nature of CSR, where at least some firms and/or industries can successfully limit government power to enact regulation as well as shape the discourse around CSR. Pour des raisons pratiques autant qu’idéologiques, les États socialistes ont souhaité la pleine participation des femmes au travail, qui supposait leur libération des tâches ménagères dévoreuses de temps. Ils ont, pour la plupart, passé un contrat social implicite avec leurs populations féminines : les femmes à l’usine et au champ, en échange d’une réduction des tâches domestiques, soit à travers leur socialisation, soit par la fourniture de produits finis allégeant le travail. L’article entend montrer que la Chine rurale fut une (...) exception à ce modèle. Alors que la participation des femmes rurales au travail augmentait fortement, le rationnement de marchandises peu abondantes et une politique empêchant les paysans de disposer d’argent liquide faisaient que les textiles et autres produits industriels sont restés hors de portée de la majorité des ruraux. En conséquence, des millions de femmes rurales ont continué, au prix d’un travail manuel laborieux, à vêtir et nourrir leurs familles, à un moment où triplait leur participation aux travaux des champs. L’objet de l’article est de discuter de méthodes d’observation et d’interprétation des arbitrages résidentiels de salariés face à la flexibilité de leur emploi. Après avoir montré les limites de l’investigation quantitative sur cette question, la réflexion s’appuiera sur les résultats d’une enquête qualitative auprès de salariés confrontés, en 2000, à la fermeture de leur usine et à sa délocalisation à 200 km de leur domicile. Dans ce type de situations, ce n’est pas la seule mobilité résidentielle suscitée par l’emploi (...) qu’il s’agit d’étudier mais bien les arbitrages entre, à la fois, mobilité et non-mobilité. Cette posture rend ainsi possible l’identification du caractère multidimensionnel de ces choix : les logiques professionnelles n’expliquent pas tout, les logiques familiales et résidentielles jouent un rôle important dans le refus de déménager ou l’aménagement d’un système de double résidence. Cette approche permet d’appréhender en quoi ces décisions reproduisent, voire aggravent les inégalités sociales, tout en incluant les possibilités de stratégies résidentielles et spatiales.Based on the results from a qualitative enquiry of employees faced with the closure of their industrial plant, in 2000, and its further relocation 200 km away, this paper provides an approach to residential choices in a context of professional uncertainty and economic constraints. In this type of situations, it is not only residential mobility which is at stake but also the choice between mobility and non-mobility. This method also enables the analysis of the multidimensional characteristic of these choices : professional considerations alone do not explain everything, family life and residential considerations play a role in choosing « residential anchoring » or dual residence. Cet article se fonde sur un retour d’expérience auprès d’un nouveau-né présentant une maladie invalidante, lors de ses séjours en service de néonatologie au CHU d’Amiens puis de son hospitalisation à domicile. L’équipe de soins psychiques périnataux accompagne la famille dans le cadre d’une application thérapeutique de l’observation du nourrisson selon la méthode Esther Bick. Initié à l’hôpital et se continuant au domicile, ce travail a porté sur la restauration de la fonction parentale, celle-ci permettant la construction d’une (...) peau psychique relationnelle et le déploiement d’une qualité relationnelle étonnante et particulièrement vivante. Envisager sa toute fin de vie chez soi implique souvent la mise en place d’organisations de soins coordonnés telles que les hospitalisations à domicile ( had ) ainsi que l’implication des conjoints. Le couple s’est imposé comme un thème central dans la recherche doctorale des auteurs sur le chez-soi en situation de fin de vie au domicile, inscrite dans le champ de la psychologie clinique psychanalytique. L’analyse thématique de treize entretiens a mis en lumière combien le couple, comme (...) entité structurante des habitus et des identités, demeure un territoire investi pour le malade et son conjoint. Cette ultime crise liée à la fin de vie conduit à de multiples mouvements pulsionnels paradoxaux témoignant de réajustements entre les époux. La nature et la pluralité des liens entre ces derniers invitent à penser le couple comme un espace topologique, comme un lieu psychique et relationnel qu’il importe de préserver face à la mort inéluctable. Cet article expose l’intérêt d’un déplacement à domicile, DAD, réalisable en périnatalité, à distinguer des VAD déjà proposées dans certains services institutionnels. Au cours d’une psychothérapie avec un psychologue libéral, durant la grossesse ou après l’accouchement, un DAD peut être proposé à la mère (ou future mère). Lorsque certaines difficultés somatiques apparaissent durant la grossesse qui font écho à une histoire personnelle compliquée, le DAD rend possible la psycho-thérapie. Celle-ci limitera les angoisses de la mère, la libérant en partie (...) pour rencontrer plus sereinement son bébé à la naissance. Un DAD après la naissance sera utile dans les situations où des problématiques de ruptures de lien, de maltraitance ou autres violences dans l’histoire de la mère peuvent être réactivées avec l’arrivée de l’enfant. Le DAD est bref, transitoire. Il s’inscrit et prend sens dans un travail psychothérapeutique en cours et nécessite une alliance thérapeutique solide. Une différenciation entre le cadre et le dispositif permettra au psychologue de rester stable dans sa place et ainsi d’assurer une fonction enveloppante. Il peut devenir un « amplificateur d’attachement » favorable au soutien du processus d’attachement entre la mère et son bébé qui se met en place à cette période. (shrink)

The transmission of a product or idea from one culture or point of origin to another and the maintenance of control outside the new locality has been referred to as the distribution and maintenance of “nothing.” This perspective has been used to describe the global marketplace and the influence of large multinational corporations on the politics and cultures of host countries. This paper uses this concept, but within a much smaller context. Using the sensitizing concept of a “disjoint constitution,” we (...) interviewed health inspectors and apple cider producers in Michigan to determine if the implementation of the Hazard Analysis and Critical Control Points (HACCP) program designed to ensure food safety was characterized by a power differential that would favor the inspectors. In addition, a larger survey of processors and an internet survey of apple cider consumers was conducted to supplement this data. It was found that HACCP had characteristics of both “nothing” and “something” and that better communication is needed between these groups to move it further along toward the something end of the continuum. The modern way of life is highly dependent upon the production of goods by industrial organizations that are in turn dependent upon their workers for their ongoing operations. Even though more than a century has passed since the dawn of the industrial revolution, many dangerous aspects of work, both physical and mental, remain in the workplace today. Using Buddhist philosophical principles, this paper suggests that although many sources of the problem reside within the larger society, the industrial engineer is still (...) a key factor in bettering work and providing a workplace suitable for their fellow workers. Drawing on these insights, we present a number of work design guidelines that industrial engineers who abide by Buddhist principles could practice to help overcome some of the many sufferings produced by modern work. Globally active companies are involved in the discursive construction of moral legitimacy. Establishing normative conformance is problematic given the plurality of norms and values worldwide, and is particularly difficult for companies operating in morally controversial industries. In this paper, we investigate how organizations publicly legitimize the trade of human tissue for private profit when this practice runs counter to deep-seated and widespread moral beliefs. To do so, we use inductive, qualitative methods to analyze the website discourse of three types of (...) organizations that trade in human tissue and are associated with different degrees of moral controversy with respect to tissue procurement and use. Our analysis reveals an object-oriented approach to moral legitimizing centered on the human tissue as a morally disputed good. We find that the website discourse translates human tissue into technology, constructs normative meaning around a dominant instrumental value associated with human-tissue-as-technology, and reproduces and stabilizes this meaning by six discursive mechanisms that amplify and anchor it. Moreover, the use of amplifying and anchoring discourse was greater in organizations associated with greater controversy. The results are consistent with an object-oriented sociality. (shrink)

Over the past century, animal agriculture in the United States has transformed from a system of small, family farms to a largely industrialized model—often known as ‘industrial farm animal production’ (IFAP). This model has successfully produced a large supply of cheap meat, eggs and dairy products, but at significant costs to animal welfare, the environment, the risk of zoonotic disease, the economic and social health of rural communities, and overall food abundance. Over the past 40 years, numerous critiques of IFAP (...) have been published, for both academic and non-academic audiences, mostly focusing on our obligations to animals. Here we offer a comprehensive critique of IFAP, focusing not only on our obligations to animals, but also important environmental, social, economic, and public health concerns. Our cumulative argument proceeds in five steps: (1) we briefly review the structure and key characteristics of IFAP; (2) we review the adverse effects of IFAP; (3) we review the historical development and positive rationale for IFAP; (4) we summarize previous moral critiques of IFAP, as well as defenses of it; and (5) we offer a moral critique of IFAP based on the common morality, and in particular on a principle of nonmaleficence, which we take to be the least controversial argument. Controversial industry sectors, such as alcohol, gambling, and tobacco, though long-established, suffer organizational legitimacy problems. The authors consider various strategies used to seek organizational legitimacy in the U.K. casino gambling market. The findings are based on a detailed, multistakeholder case study pertaining to a failed bid for a regional supercasino. They suggest four generic strategies for seeking organizational legitimacy in this highly complex context: construing, earning, bargaining, and capturing, as well as pathways that combine these strategies. The case analysis and (...) proposed bidimensional model of generic legitimacy-seeking strategies contribute to limited literature on organizational legitimacy in controversial industry sectors. Conventional wisdom and many published histories of “Green Chemistry” describe its start as being a result of governmental and/or regulatory actions at the US Environmental Protection Agency during the early 1990’s. But there were many Real World industrial examples of environmentally friendly commercial processes in the oil and commodity chemicals industries for decades prior to the 1990s. Some early examples of commercial “Green Chemistry” are briefly described in this article. The Boots/Hoechst Celanese Ibuprofen process was one of the earliest multiple-award-winning (...) examples of industrial “Green Chemistry” in the fine chemical/pharmaceutical industry. The author, who conceived the BHC Ibuprofen synthetic strategy in 1984, reveals and documents that the BHC Ibuprofen process was not primarily a result of governmental or regulatory mandates, or environmentalist or political motivations. The BHC ibuprofen process, and probably many other early industrial “green” inventions, evolved from, and their development and commercialization motivated and guided by, a long prior industrial culture of both scientific and technical evolution. The invention and commercialization of these early industrial commercialized processes, and the BHC Ibuprofen process were also guided by both competitive and economic market needs, personal human motivations, and a low waste culture of “Quality” and “Continuous Improvement” that the commodity chemical industry internally promoted in the 1980’s. The author comments on some perceptions of the status of Green Chemistry now, and directions it should consider going in the future. The author recommends that young Green Chemists and/or Green Engineers reconsider “Quality” approaches in order to genuinely lead Society toward a Greener future. (shrink)

Over the last 20+ years, multinational corporations have been confronted with accusations of abuse of market power and unfair and unethical business conduct especially as it relates to their overseas operations and supply chain management. These accusations include, among others, worker exploitation in terms of unfairly low wages, excessive work hours, and unsafe work environment; pollution and contamination of air, ground water and land resources; and, undermining the ability of natural government to protect the well-being of their citizens. MNCs have (...) responded to these accusations by creating voluntary codes of conduct which commit them to specific standards for addressing these issues. These codes are created at both the industry-wide and the individual company level. Unfortunately, these codes have generated little credibility and public trust because their compliance claims cannot be independently verified, and they lack transparency and full public disclosure. In this article, we present a case study of the voluntary code of conduct by Mattel, Inc., the world’s largest toy company. The code, called the Global Manufacturing Principles, confronts the general criticism leveled against voluntary codes of conduct by creating detailed standards of compliance, independent external monitoring of the company’s compliance with its code of conduct, and making full, and uncensored public disclosure of the audit findings and company’s response in terms of remedial action. We present a detailed account of how Mattel’s voluntary code of conduct was created, implemented, and ultimately abandoned over 9 years. We provide an evaluative analysis of the company’s GMP compliance throughout its life span, which suggests a bell-shaped curve, where early top management commitments were met with pockets of resistance from operational groups, who were concerned about balancing GMP compliance efforts with traditional performance criteria. The early stage response from Mattel’s top management was quick and supported with the requisite resources. As a result, the compliance process accelerated, becoming increasingly more robust and effective. The success of code compliance and increased transparency in public disclosure energized field managers with a sense of professional satisfaction and publicly recognized accomplishments. The decline in GMP compliance was equally steep. When all the easily attainable targets had been reached at the company-operated plants, addressing vendor plants’ compliance presented a new set of challenges, which taxed corporate resources and management commitment. It would seem that value-based and ethics-oriented considerations, i.e., doing the right thing for the right reason, were no longer the driving force for Mattel’s management. Mattel did not see any economic benefit from its proactive stance, when competitors did not seem to suffer adverse consequences for not following suit. The final contributing factor to the code’s abandonment was a widely publicized series of product recalls which absorbed top management’s attention. (shrink)

Background: Medical tourism, thought of as patients seeking non-emergency medical care outside of their home countries, is a growing industry worldwide. Canadians are amongst those engaging in medical tourism, and many are helped in the process of accessing care abroad by medical tourism brokers - agents who specialize in making international medical care arrangements for patients. As a key source of information for these patients, brokers are likely to play an important role in communicating the risks and benefits of undergoing (...) surgery or other procedures abroad to their clientele. This raises important ethical concerns regarding processes such as informed consent and the liability of brokers in the event that complications arise from procedures. The purpose of this article is to examine the language, information, and online marketing of Canadian medical tourism brokers' websites in light of such ethical concerns. Methods: An exhaustive online search using multiple search engines and keywords was performed to compile a comprehensive directory of English-language Canadian medical tourism brokerage websites. These websites were examined using thematic content analysis, which included identifying informational themes, generating frequency counts of these themes, and comparing trends in these counts to the established literature. Results: Seventeen websites were identified for inclusion in this study. It was found that Canadian medical tourism broker websites varied widely in scope, content, professionalism and depth of information. Three themes emerged from the thematic content analysis: training and accreditation, risk communication, and business dimensions. Third party accreditation bodies of debatable regulatory value were regularly mentioned on the reviewed websites, and discussion of surgical risk was absent on 47% of the websites reviewed, with limited discussion of risk on the remaining ones. Terminology describing brokers' roles was somewhat inconsistent across the websites. Finally, brokers' roles in follow up care, their prices, and the speed of surgery were the most commonly included business dimensions on the reviewed websites. Conclusion: Canadian medical tourism brokers currently lack a common standard of care and accreditation, and are widely lacking in providing adequate risk communication for potential medical tourists. This has implications for the informed consent and consequent safety of Canadian medical tourists. (shrink)

A longitudinal survey of business graduates over a four-year period revealed stability over time in their assessments of proposals to improve business ethics except for significantly greater disapproval of government regulation. A comparison of graduates and executives indicate both favor developing general ethical business principles, business ethics courses, and codes of ethics, while disapproving government regulation and participation by religious leaders in ethical norms for business. The mean rankings by business graduates over time of factors influencing ethical conduct show significant (...) declines in school-university training and significant increases for religious training and industry practices. Graduates and executives rank family training as the most important influence and school-university training as least important. The authors conclude that a more careful consideration be given to matching reform proposals and influence factors, and to increasing the depth of change efforts in individual business ethics. Basic human rights are supposed to protect people from abuse and harm. They are the means whereby we protect our humanity. One would expect, therefore, that basic human rights would be valid and sacred in any context, including industrial relations. However, the complexity of the employee–employer relationship obscures this issue, and it is not clear whether such rights can be protected or whether they are valid in the context of industrial relations. Since rights are relational, they are preconditioned on the (...) special nature of the relationship between employee and employer. Hence, the specific meaning that these rights have in industrial relations cannot be grounded in the notion of human rights as such, but rather depends on the special relationships between employers and employees. Though much legislation has been passed to regulate the relationship between employees and employers, the issues surrounding this relationship remain one of the most debated topics in business ethics. Our paper focuses specifically on the right to equal pay and the right to privacy. With respect to the right to property, the paper examines whether there is a conflict between general human rights and the fundamental right of employers to their property. The Israeli legislature has responded to this conflict by enacting ‘protective laws’ that legally outline and mandate certain human rights. Under these laws, employees are prevented and prohibited from waiving the rights granted to them by law, even if employed in private industries. Despite this legislative effort, market forces are at times stronger, and consequently some basic rights are not fully applied or implemented. (shrink)

Aristotle addresses these issues in two famous documents of the controversy that pitted supporters of the theory of Forms against its opponents within Plato’s Academy : his lost work, quoted by Alexander of Aphrodisias by the title of Peri Ideon, and the lengthy thrust against Ideas that can be read, with some minor variations, in books A, chapter 9, (...) and M, chapter 4, of his Metaphysics. As we only have fragments of the first, the second being laconic and little more than a summary, there has been much speculation about the exact number and nature of the arguments for and against the Forms. Since the pioneering works of Léon Robin, Paul Wilpert et Harold Cherniss, one problem in particular has attracted the attention of specialists : what arguments does Aristotle accuse of either producing Ideas on relatives for one or of dragging in the « Third Man » for another ? Why does he consider these arguments to be more rigorous than the others ? If we are not dealing with the same arguments, how can these be more or better argued than those mentioned by Aristotle in the same breath, namely the arguments Plato’s followers took from the sciences, the one over many and the thought about things that have perished ? Through detailed analysis of texts from the Corpus Aristotelicum and Alexander’s commentary on Aristotle’s Metaphysics, Rationes ex machina develops a new interpretation of the controversial file of the akribesteroi tôn logôn as well as a micrological solution to the puzzle that has come to be a sort of compulsory figure of the exegesis of the Aristotelian criticism of « Plato’s Ideas ». In February 2019, the German federal government announced its new “National Industry Strategy 2030.” Many economies—including the United Kingdom (2017), European Union (2017), and Saudi Arabia (2018)—have announced national industrial strategies addressing the competitive threat of the People’s Republic of China’s 2015 “Made in China 2025” 5-year economic plan to become a global leader in 10 advanced technology manufacturing sectors. The use of the 20th-century term “industrial policy” heralds back to public policy antecedents of what is now evolving globally in (...) the 21st century as national “industrial strategy,” a concept explored in this article. Unlike traditional 20th-century efforts at industrial policy (which focused on public policy efforts to maintain domestic primacy of declining, older industries), national industrial strategy recognizes (and generally accepts) the international global economy as a foundation of competition. Most importantly, national industrial strategy focuses on technologically emerging industries as well as the national government working collaborative in a partnership with these emerging industries to meet future growth challenges and opportunities.
