“Spy and Scholar.” “Party Functionary and Social Scientist.” The association of the professions or callings is surely intriguing because seemingly incongruous. In an age in which the two primary meanings of intelligence have been blurred in the persons and activities of certain individuals, however, the incongruity has been submerged in intrigue. But whereas the persons and activities of scholars and social scientists are not the stuff of myth, those of spies and party functionaries have attained mythic proportions. Richard Sorge (...) was not posthumously made a “Hero of the Soviet Union” by the Presidium of the Supreme Soviet of the USSR on November 5,1964 because he was a “scholar” and “social scientist”. The aim of this article is to bring to the attention of the international nursing community the discrepancy between a pervasive ‘caring’ nursing discourse and a most unethical nursing practice in the United States. In this article, we present a duality: the conflict in American prisons between nursing ethics and the killing machinery. The US penal system is a setting in which trained healthcare personnel practice the extermination of life. We look upon the sanitization ofdeathworkas an application of healthcare professionals’ (...) skills and knowledge and their appropriation by the state to serve its ends. A review of the states’ death penalty statutes shows that healthcare workers are involved in the capital punishment process and shielded by American laws (and to a certain extent by professional boards through their inaction). We also argue that the law's language often masks that involvement; and explain how states further that duplicity behind legal formalisms. In considering the important role healthcare providers, namely nurses and physicians, play in administering death to the condemned, we assert that nurses and physicians are part of the states’ penal machinery in America. Nurses and physicians (as carriers of scientific knowledge, and also as agents of care) are intrinsic to the American killing enterprise. Healthcare professionals who take part in execution protocols are state functionaries who approach the condemned body as angels of death: they constitute an extension of the state which exercises its sovereign power over captive prisoners. This article explains how we ordinary subjects of a state who are neither political leaders nor functionaries are responsible for outcomes that are properly attributed to that state and that took place during our adult lifetime. Its focus is on the connection we forge to those outcomes via our obedience alone. If our responsibility as subjects is justified, it would apply under all regime types including oppressive and authoritarian ones. The argument is that this responsibility can only be justified within (...) a minimal account of agency and a bare-bones account of responsibility. Thus, while we incur a burden of responsibility for the state via our obedience alone, that burden does not suffice to either blame us or extract remedies from us for state injustices. For us obedient subjects, however, it is important that we be cognizant of this burden as it marks the most minimal agency we exercise in the state. (shrink)

According to Palazzo and Scherer, the changing role of business corporations in society requires that we take new measures to integrate these organizations into society-wide processes of democratic governance. We argue that their model of integration has a fundamental problem. Instead of treating business corporations as agents that must be held accountable to the democratic reasoning of affected parties, it treats corporations as agents who can hold others accountable. In our terminology, it treats business corporations as “supervising authorities” rather than (...) “functionaries.” The result is that Palazzo and Scherer’s model does not actually address the democratic deficit that it is meant to solve. In order to fix the problem, we advocate removing business corporations from any policymaking role in political CSR and limiting participation to political NGOs and other groups that meet the standards we set out for a politically representative organization (PRO). The Covid-19 pandemic is a tragedy for those who have been hard hit worldwide. At the same time, it is also a test of concepts and practices of what good care is and requires, and how quality of care can be accounted for. In this paper, we present our Care-Ethical Model of Quality Enquiry (CEMQUE) and apply it to the case of residential care for older people in the Netherlands during the Covid-19 pandemic. Instead of thinking about care in healthcare (...) and social welfare as a set of separate care acts, we think about care as a complex practice of relational caring, crossed by other practices. Instead of thinking about professional caregivers as functionaries obeying external rules, we think about them as practically wise professionals. Instead of thinking about developing external quality criteria and systems, we think about cultivating (self-)reflective quality awareness. Instead of abstracting from societal forces that make care possible but also limit it, we acknowledge them and find ways to deal with them. Based on these critical insights, the CEMQUE model can be helpful to describe, interrogate, evaluate, and improve existing care practices. It has four entries: (i) the care receiver considered from their humanness, (ii) the caregiver considered from their solicitude, (iii) the care facility considered from its habitability and (iv) the societal, institutional and scholarly context considered from the perspective of the good life, justice and decency. The crux is enabling all these different entries with all their different aspects to be taken into account. In Corona times this turns out to be more crucial than ever. (shrink)

Philosophy & Social Criticism, Volume 48, Issue 2, Page 245-267, February 2022. The ancient Cynic Diogenes was the first to declare ‘I am a citizen of the world ’ and the other Cynics followed him. In The Courage of the Truth, Michel Foucault analyses the Cynic mode of parrhēsia and living in truth, however, his text expands the cosmopolitical amplitude of Cynics since the Cynics’ true life contains an inherent cosmopolitan logic. Identifying the core of the Cynic true life in (...) the care for the self that leads to the care for the others within the horizon of the possibility of another life and another world, Foucault shows how the Cynic establishes ‘an intense bond with the whole of humankind’, cares ‘for all mankind’ and for the whole world as a ‘functionary of humanity’ and, as ‘the scout of humanity’, the Cynic prefigures the future and exercises the ‘government of the universe’. This article argues that Foucault’s account on Cynics maps the very first moments of becoming cosmopolitan and offers an insightful perspective on the process of achieving a cosmopolitan subjectivity, a process displayed by different expressions of cosmopolitanism, and especially the ‘insurgent cosmopolitanism’ from the bottom up. For the young philosopher and short-time revolutionary functionary Arnold Metzger, the First World War was of key importance for his idea of a moral conversion which he regarded as the most urgent task of the German Revolution of 1918. According to him, the youth returning from the trenches was united by the collective experience of pain: pain caused by the traumatizing violence of the war and the collapse of old beliefs. Yet for Metzger, this pain also implied a positive (...) element: by providing the evidence of the falsity of the moral norms and guiding values of the Second Reich, the catastrophe would provide a common moral ground for the construction of the new. The paper elaborates this idea of the “pathic foundation” of the new Germany by discussing Metzger’s philosophical writings and political actions. (shrink)

This essay analyses the career of the German chemist and government functionary Caspar Georg Carl Reinwardt (1773–1854) through the layered lens of governance and management. By conceptualizing governance as the historical result of the interaction between locally situated accumulation and management projects and the ‘metropolitan’ assessment of their value, it uses Reinwardt’s experiences to shed fresh light on the idiosyncrasies through which Europe and Southeast Asia were linked in the early nineteenth century. The discussion of three closely related episodes (...) (the management of the botanical garden at Buitenzorg, the complexity of inquiries in the field and the failure of Reinwardt’s publication projects) exemplifies this point. Taken together, the essay problematizes simple center-periphery relationships by demonstrating that such global connections be understood through a comparison between ‘metropolitan’ and ‘colonial’ science. Rather it demonstrates the insights drawn from employing a framework that unites narratives of ‘imperial’ and ‘metropolitan’ histories of accumulation, and brings them under one analytical umbrella. This essay will discuss the hegemonic role that texts have come to play in the historiography of subcontinental mathematical traditions. It will argue that texts need to be studied as records of practices of people's working lives, grounded in social hierarchies. We will take particular mathematical texts to show how different occupational registers have come to shape practices that defy the binaries of concrete and abstract, high and low mathematics or the pure and applied conundrum. Measuring, counting and accounting practices (...) as part of the routine work of practitioners performing their caste occupations then provide us with a spectrum of the computational activities that controlled and regulated the lives of people in the past. In the process the act of computing itself gained certain political values such as cunning and manipulation, identified with professions of village accountant and merchant, for example. Drawn from my earlier work on these records, I discuss the occupational role of the accountant as a political functionary who assessed and authenticated the measurements of land and produce in the village, making values of the labor performed by others, and creating avenues for his own proficiency as a mathematical practitioner. The peace concluded between Athens and Persia at the close of the Persian Wars , and usually known as the Peace of Callias, has been the subject of a new investigation by Wade-Gery, which is clearly destined to serve as the basis of further discussion of its problems. In the present article I shall confine myself to one point of special interest arising out of a novel clause which Wade-Gery reads into the treaty and formulates, exempli gratia, as follows: ‘In (...) the area west of Sardis inhabited by Greeks, the King shall send no functionaries nor exercise any authority: his sole right shall be a yearly tribute of a fixed amount based on the survey of Artaphernes in 493.’. Corporations despite their status as legally fictitious persons are not such, and to confound them with real persons in even the minimal legal sense is to negate much of the force of the concept of rights when applied to the society. When corporations have rights individual rights become meaningless. While corporations may need some form of protection to make them financially feasible investments, they need not be given the full protection of rights which are assigned to the individual. A much (...) attenuated version of corporate rights is warranted. I would argue against Werhane's notion of a corporation possessing “secondary rights” which can be asserted only after the claims of individual rights have been met. Ibid., p. 62.One solution to the problems raised in this essay would be to ascribe rights to individuals only. This could occur without interfering with the financial independence of the corporation by a simple legal prescription that individuals within a corporation be held responsible for their activities and that the corporation p e r se not be blamed for individual actions. This is consistent with the judgments against the Nazi war criminals who were denied the defense of justifying their actions on the basis of following orders. Responsibility for those actions which are the result of the workings of the “invisible hand” cannot be ascribed to any individual or group of individuals. Donaldson is helpful on this point in recommending an “office of social responsibility” be created as part of the corporation to monitor those actions which otherwise escape scrutiny. Donaldson, Corporations and Morality, p. 207.A more radical solution is to restructure the corporation in such a way as to introduce the element of democracy in the workplace. Opponents would argue that such a practice would diminish the profit-making potential of the corporation by limiting the discretion of the corporate officers in making decisions. Similar arguments have been advanced against the democratic state. Yet democratic states have proven to be viable institutions capable of effective action and demonstrably more survivable than the authoritarian regimes which are the analogs of the corporation.Given the current hierarchical structure of the corporation and its ability to dissolve in the face of questions of responsibility, individual accountability is the only viable solution. This requires that members of the corporation not find cover behind the “invisible hand.” This in turn necessitates the granting of a greater degree of discretionary power to corporate functionaries at all levels. We cannot be responsible for a state of affairs over which we have no effective control. The courts would make the ultimate decision as to the assignation of responsibility in particular cases of corporate crime, with the stipulation that the ascription be to an individual and not “the corporation.” By making corporate officers individually responsible for their actions a much more effective deterrent to corporate crimes would be created. Corporations can easily afford most of the fines that are imposed on them, and corporations cannot be put in prison.The view of the corporation advanced here puts it in a legal and moral position greatly inferior to that of the individual as well as the state. Consequently, corporate needs and welfare must remain a tertiary concern. The rights of the individual must figure primarily, and the welfare of the state as preserver of those rights secondarily, in social policy decisions. The libertarian vision of the corporation is therefore a misguided result of the conflation of the corporation and the individual in the legal and moral realms. Corporations and individuals are ontologically distinct entities and must be recognized as such. The failure to do so has enabled corporations to abrogate individual rights with legal and moral impunity. Such a situation is inconsistent with the demands of a rights-based democracy. (shrink)

This article offers a new interpretation of the theme of servile ‘crime and punishment’ in the Cena Trimalchionis. Focussing on scenes that directly involve the dinner host, it argues that the domestic justice system that they flesh out adds nuance to the satirical bite of the episode. An initial overview of the instances of ‘crime and punishment’ involving enslaved characters demonstrates how these scenes parade not just Trimalchio's wealth but his masterly power overreaching that of private domini. While previous scholarship (...) understood Trimalchio's questionable chastisements as indicative of this parvenu's pretensions, this article shows that they cumulatively develop an image of a jumbled execution of justice—brought to life through the presence of state functionaries, judicial infrastructures and penalties normally executed by the state. The climax of this image is hidden in plain sight, in a hitherto underappreciated scene involving purple wool (54.3–5), discussion of which proves in conclusion that the instances of servile ‘crime and punishment’ craftily build a subplot that plays on the freedman's imperial authority. The imperial matrix already recognized in several dimensions of the Cena in earlier scholarship unmistakably characterizes Trimalchio's domestic jurisdiction too; arbitrary and unfair, it offers biting comment on the state of Roman justice during the Principate with the progressive channelling of justice through the sole authority of the emperor. In sum, the servile ‘crime and punishment’ theme works as a fierce attack on the imperial government, encouraging broader reconsideration of the target of Petronius’ satirical pen. (shrink)

Translations into a modern Western language can hardly by expected to give a correct idea of the contents of the most important dharma idea in Indian culture. « Law, moral and religious duties, rule, norm, truth etc. etc. » are, like « element, category » only aspects of a concept for which our languages have no word because it is foreign to our „ philosophy” and „Weltanschauung”. The term obviously derives from the root dharor dhr-which is also the basis of (...) verb forms expressing such ideas as « to hold, bear, preserve, maintain ; to remain in a certain condition, to continue existing, to be faithful to its nature etc. ». In the Rgveda the subject of the verb often is a divine power and the object one or more of those highly important entities in the universe which are fixed, supported, maintained, preserved, and the continuance and maintenance of which is of the utmost consequence to human life, physically, economically, socially and psychologically. It expresses the notion of stability. The substantive dharman, the Rgvedic predecessor of dharma, belongs to a group of ancient nouns ending in -men- denoting ideas of religious or „weltanschauliches” interest . In the ancient Indian texts these words stand for intuitively felt, associatively combined, emotionally determined vague ideas which in the course of time were deepened and adopted more precise and specialized meanings. The semantic relation between the noun and the above verb is often perfectly evident. The noun generally speaking expresses the idea of « a stabilizing, supporting, preserving power, a power of maintenance and stability, a faithfulness to nature or condition, to inherent qualities, to truth and reality ; the innate principle of anything in virtue of which it continues existing, is or remains what it is etc. ». The opinion pronounced by some authorities that the term originally was merely ritualistic should not be adhered to ; the ritualists knew it, of course, and applied it to those entities and phenomena in which they were interested. So did the specialists in social relations who applied the same term with the same general sense to the rules of conduct, the moral, social, and religious duties of the members of the classes in society, of the sexes and high functionaries such as the king. A thorough examination of the relevant texts however shows that it always was the same almost untranslatable central idea which was expressed by dharma, whether it related to cosmic powers or entities or to human beings. It is no correct method to suppose the term to have evolved semantically in the chronological order of the texts in which the different aspects of the general idea attracted the attention of the authors. After a discussion of the implications of dharma in the dharmajvzstras or so-called lawbooks and its intimate relations to the karman theory, some observations are made on the Purvamimamsa which, dealing with the exegesis of the Veda, made a special study of dharma, because it was considered a necessity to discover how the Vedic texts enjoin man to behave under the ever varying circumstances of mundane existence, in short to know what is the scheme of right living. The great diversity of „meanings” occurring in Pali and Sanskrit Buddhism are likewise really one and not essentially different from the above. Dharma on the one hand expresses the idea of law and norm in nature, society and human existence, the idea that under definite conditions definite consequences are, or are not, to follow. On the other hand it stands, here also, for the innate principle of anything in virtue of which it is what it is and is used in its above „social” sense. Because dharma also is the « prescribed course of action for anything which may follow a natural or normal process » it could also denote the doctrine professed by Buddha and other teachers, which was the very reason and justification for their existence. Because Buddha's doctrine was, in the eyes of his followers, truth, dharma is also equivalent to this term. In some respects the ancient Vedic « Daseinsmächte » or power-substances which were, to a certain extent, regarded as fundamental realities may be considered identical with the « realities » called dhammas in the Pali canon. Here dharma is an irreductible reality or existence which whilst existing in virtue of a fundamental law has definite results or effects. In the fully developed Mahayana philosophy the term under discussion implies that every element is a separate power or entity ; that there is no substance without its qualities, because no dharma is inherent in another dharma ; that dharmas are without duration ; that they co-operate in virtue of the basic law of the pratityasamutpada which determines the mundane process. From the philosophical point of view Buddhism is therefore a dharma-theory based on the pratityasamutpada. In modern Hinduism dharma may always be said to be a living force.. Some poets, philosophers and politicians attempted to adapt it to the exigencies of modern times : B. Ch. Chatter jee, R. Tagore, A. Ghose, S. Radhakrishnan and others. According to Radhakrishnan dharma is « to exist in accordance with the truth of things or in harmony with that truth that supports, controls and encompasses the universe » . To follow one's dharma means to be faithful to one's innate character, because dharma is truth's embodiment in life. (shrink)

In 1977 a German literary scholar, Astrid Lange-Kirchheim, published an article announcing an astonishing discovery: credible evidence exists to suggest that Kafka's famous disturbing short story, `In the Penal Colony', published in 1919 but first written in 1914, echoes and reworks, in several of its key images and turns of phrase, elements of an essay published in 1910 in the German literary magazine, Die neue Rundschau, bearing the title `Der Beamte' (`The Civil Servant', or `The Official' or `The Functionary') (...) by Alfred Weber, younger brother of Max Weber. Most Kafka scholars today accept Lange-Kirchheim's findings and recognize the importance of `Der Beamte' as at least one crucial reference point for Kafka's writing. Yet little wider awareness of the connection seems to exist among historians of sociology and other scholars of the history of the human sciences. This article comprises a summary of Lange-Kirchheim's analysis together with a complete annotated translation of `Der Beamte' by Alfred Weber in English. (shrink)

Religious martyrdom has grabbed centre stage in recent times. This has been due mainly to the activities of Muslim jihadists and other disaffected religious zealots who choose ‘martyrdom’ as a form of protest and a means of inflicting injury on their perceived enemies. Much work has been done on the Islamic fundamentalists, who epitomize contemporary martyrdom. Indeed, for the untutored, religious martyrdom appears to be limited to this group. In contrast to such an outlook, this paper seeks to establish the (...) Christian equivalent of contemporary Islamic martyrs. It attempts a broad characterization of different types of martyrdom, taking into account the martyrs of the past and our everyday use of the term ‘martyr’. It also explores different perspectives of the morality of martyrdom, especially the more popular self-martyrdom of contemporary times. It identifies self criminalization by religious functionaries as a form of ‘martyrdom’, especially given the perception of the members of the congregation and the influence that such self-criminalization has on society. It posits the immorality of self criminalization, especially given the high esteem in which society holds religious functionaries, and argues for the de-radicalization of religion. (shrink)

The Taktikon Escorialense, a list of functions compiled in the time of John I Tzimiskes, is an important source for studying the reform of the military organisation and state apparatus of Byzantium during the 10th century. Records of this reform, however, can also be found in other, literary and sigillographic sources, so its beginnings, principal stages and characteristics, and how the organisation of the provinces evolved in the 11th century, were reconstructed independently from the TE by Ahrweiler. Like many other (...) sources of this kind, the TE has particular characteristics that lead one to ask in what measure this list of functions really reflected the transformation of the state apparatus in the 10th century. The conclusion may be drawn that this taktikon was an unfinished list of Byzantine functions and honorary titles, and, as indicated by data from other sources (first of all, sigillographic ones), it testifies only to a temporary phase in the reform carried out in Byzantium in the course of the 10th century. There are certain illogical elements in the TE, in the sequence of mentioning the functionaries; some data about the creation of new appointments mentioned in other sources, were omitted from this list of functions, etc. Despite the said shortcomings, though, the TE makes it possible to pose fresh questions, and reactivates some earlier ones connected with the problem of the transformation of the Byzantine central and provincial system, especially in the domain of the Empire's military organisation. A business corporation capable of evolving, termed a learning corporation, has a conscious quality. It is the systemic version of a rigid structure-preserving corporation that would be expected eventually to run into problems and end up as a failure. The conscious corporation analogy can be used to simulate the sequence of processes that occur during Upasana, a Vedic technique of meditation. In this essay, it will be argued that the Vedic view of consciousness is parallel to the postulate that successful (...) business corporations have a conscious quality, and if the Upasana process sequence is considered as a competence model, in the Chomsky-ian sense for corporate consciousness, the executive functionary in a successful corporation is effectively a practitioner of Upasana. Gianrinaldo Carli was a central figure in the origin of the Milanese Enlightenment of the late eighteenth century. Carli's political career as well as his works connected him both to the mid-century reforms by Pompeo Neri and to the times of Beccaria and the Verri brothers—the heyday of Lombard intellectual life in Europe. Not originally from Lombardy, but from the Venetian periphery, Carli became an erudite scholar of witchcraft and magic and an influential functionary of the Habsburg administration in (...) Milan. He remains most famous for his works on money and his contributions to the journal Il Caffè. Most of his later political writings, which were widely circulated in Italy following the American Revolution, originated in debates with Pietro Verri over the nature of Natural Law, of the Social Contract, and the relationship between patriotism and cosmopolitanism. They illustrate key aspects of Lombard political culture of the 1780s: a culture that was critical of Rousseau, trustful of the reformist experience and supportive of Enlightened Absolutism. Within this context, Carli's works have traditionally been difficult to place. (shrink)

This article questions the role of the author in the photographical image. Undoubtedly, the invention of photography has changed our attitude towards ourselves, towards the world. The impact of photography on one’s life is growing with the development of technology, mainly the photo-technology. One cannot but trust technological tools more than oneself, because any technological device nowadays is considered to be smarter, faster, and more precise than any human being. The technology plays a special role in photography, and that is (...) why the author’s position as the creator of the image is being challenged. Hence, there is also a much wider problem, the impact of technology on a person. Therefore, the purpose of this article is to show that photography as a kind of visual art is not directly a product of human creative activity. Nevertheless, as a technical product, it tends to anonymity when the question of authorship is simply decreasing. Although each image, as a human creation, has its author, in the photography the author becomes the background. We agree with Flusser that it is worthwhile to distinguish between the functionary and the photographer as candidates for the role of the author in the photographic process; but in the process of contemplating the photographs, the name of the author of the photographical image, regardless of his or her claims, is ignored, because the photography, retaining the function of objective documentation, captures any events without any interest. It is also completely dependent on technology; claiming not only for the mediation but also for the "authorship", it introduces the mode of anonymity and accidental fixation of events. The image is deprived of subjective features and the need to have an author. One can say that in any case the photographer falls into the "shadow" created by the device. The author "dies", giving the life to the photography, and dissolves in the technicality of the image. (shrink)

Corporate Social Responsibility is a label covering managerial checks and institutional balances introduced against the background of ethical values. Values are clearly formulated and organizational processes are designed with the inclusion of stakeholders and their voice in mind. In case of the post-communist societies designers of CRS cope with an additional level of complexity. Original sin of market reforms after the political fall of the communist regimes is the corrupt take-over of markets and democracies. Social institutions of capitalist markets and (...) democratic states have been subverted and invaded by the unpurged networks of the post-communist power elites. They privatized the wealth of state enterprises becoming new owners of economic resources and they drifted towards the top functions in state institutions becoming post-communist power brokers. Their long-term monopoly of the media left them in command of the mainstream PR communications long after their absolute political power was gone. Democratic institutions, and the right to free speech are daily challenged by influential image and market competition. They cannot be taken for granted. Some democratic institutions are undermined by subversive networks of the corrupt mafias often formed by ex-functionaries of the communist party and her secret services. Their tacit power is explicitly legitimized by media-clusters of cultural representatives of the communist ex-power elites exploiting leftist bias of media mainstreams. (shrink)

Contemporary education now appears to be dominated by the continual drive for improvement measured against the assessment of what students have learned. It is our contention that a foundational relation with assessment organises contemporary education. Here we draw on a 'way of thinking' that is deconstructive in its intent. Such thinking makes clear the vicious circularity of the argument for improvement, wherein assessment valorised in discourses of improvement provides not only a rationalisation for improvement via assessment, but also the very (...) means of achieving such possibilities via targets grounded in limited specifications of assessment. On reading Heidegger's 'question concerning technology' we sought to reconsider the vicious circle of improvement in relation to Being. We claim that the means-ends driven technology of assessment, rather than being at our disposal and under our control, only serves to reveals the Real to us in accordance with the restricting principle of reason. The principle of reason, we argue, grounds 'Enframing' that ranks and orders the very beings of education as objects to produce an objective 'world as picture', rather than opening the possibility of their identity as belongings with a movement of difference. So, 'improvement' becomes normative and binding for institutions and practices on grounds of the principle of assessment, and renders agents of education as functionaries of 'Enframing'. (shrink)

This book offers a comprehensive moral theory of privatization in war. It examines the kind of wars that private actors might wage separate from the state and the kind of wars that private actors might wage as functionaries of the state. The first type of war serves to probe the _ad bellum_ question of whether private actors can justifiably authorize war, while the second type of war serves to probe the _in bello_ question of whether private actors can justifiably participate (...) in war. The cases that drive the analysis are drawn from the rich and complicated history of private military action, stretching back centuries to the Italian city-states whose mercenaries were reviled by Machiavelli. The book also takes up the hypothetical examples conjured by philosophers—the private protective agencies of Robert Nozick’s _Anarchy, State, and Utopia_, for example, and the private armies of Thomas More’s _Utopia_. The aim of this book is to propose a theory of privatization that retains currency not only in assessing current military engagements, but past and future ones as well. In doing so, it also raises a set of important questions about the very enterprise of war. This study attempts an exposition of different perceptions of obligation to medical treatment that have emerged from the Islamic theological understanding and how they contribute to diversity of options and flexibility in clinical practice. Particularly, an attempt is made to formulate an Islamic perspective on ordinary and extraordinary means of medical treatment. This distinction is of practical significance in clinical practice, and its right understanding is also important to public funded healthcare authorities, guardians of the patients, health and life insurance (...) institutions, and employers who provide health care coverage to their employees. Not only these parties, but also lawyers and justice administration functionaries such as public prosecutors and judges are in need of understanding this distinction to deal with relevant litigations. The distinction could be made regarding terminally ill patients and non-terminally ill patients separately. The essential factors that matter in making the distinction between ordinary and extraordinary means of treatment are: (1) patient capacity (2) expert advice, and (3) nature of medication. Regarding terminally ill patients, medical treatment can become extraordinary because of (1) patient capacity and (2) nature of medication. In both these case the deciding condition applies: the expert advice taken from a group of physicians. In regards to non- terminally ill patients, extraordinary medical treatment includes three cases: (1) treatment that is known to be useless and futile, (2) treatment that endangers the life or cause more harm than what it removes, and (3) useful treatment, but the patient is unable to bear the cost. Vilém Flusser is one of the first scholars to address the systems of technical media, as well as the biotechnological manipulation of the living world, in relation to the issue of programmability. In this regard Flusser questioned the position of the actor, the operator or perhaps the creator in these systems. If the functionary and the apparatus merge into a unit and apparatus has its program, what is the role the artist if he or she is not just anyone (...) who is exhausting the options offered by the program? In the paper the functionary of the apparatus of the camera and the “creator” in the field of biotechnics are compared in order to establish the similarities in both “creative” practices of an photographer and of a biotechnological artist, as well as discuss the similarities with other artistic practices discussed by Flusser. The apparatus functions as “intelligent machine” thus it has certain power. The subject involved in the game of the apparatus is subjected to its structure. The question is, how to establish the critical stance, how to act against the apparatus. This transposes the notion of an artist as a supposed creator to the notion of an artist as the one who resists the structures of power. (shrink)

Coming from anarchist circles and revolutionary-syndicalist trade unions, Simone Weil initially saw herself as a Marxist and an anarchist, before increasingly becoming their early and extremely pointed critic. From 1933 on, she distanced herself more and more from the syndicalist movement in terms of content, and at the same time she was increasingly skeptical of its politics. She saw in the syndicalists, socialists, and communists no more accurate knowledge of society than in the conservatives or fascists. Moreover, she came to (...) realize that they did not have the necessary means of action to carry out a revolution. In the assertion of the "historical mission of the working class," she saw a phrase that served the functionaries but only further humiliated and betrayed the working class. In this respect, even Marxism was for Weil still the intellectual expression of the bourgeoisie, because even a change in property relations would not have eliminated the oppression of the working class. Until the end of her life, she held that instead a radical change in labor relations was necessary to end the oppression of the working class and its social misery. The article attempts to situate Simone Weil's early disillusionment with syndicalism, socialism, Marxism and Stalinism, as well as her recognition of what was widely labelled totalitarianism in Western societies at the latest after the Second World War, in her writings. The Confessio Belgica and the three offices: Article 30 inflexible? The Confessio Belgica or Dutch Confession of Faith from 1561, one of the Three Formulas of Unity in the Dutch Reformed tradition, confesses in article 30 that the government of the church, as an institution of the Christian faith, should be spiritual and conducted by chosen consistories. These consistories should consist of ministers, elders and deacons. The norm or constant of three offices was excepted by churches in this tradition, but (...) more recently it’s necessity and efficiency became questioned in some of these circles. Historically the three offices served the Reformed churches well. The acceptance of the three offices is based on the Confessio Belgica as a confession, but also on the biblical principle that Christ is the head of the church and its highest Prophet, eternal King and only Priest. The church grows spiritually out of Christ and his Spirit as their head. In this process, the church also uses the offices of minister, elder and deacon as instruments. These offices correspond with the offices of Christ as their Prophet, King and Priest. A study of the Confessio Belgica article 30 leads to the belief that it does not exclude changes in the task of the three offices nor opposes the addition of extra offices or the help of additional functionaries. Contribution: This article contributes theologically to the debate in the Dutch [ Netherlands ] Reformed churches on the offices in church. It tries to clarify all the thinking regarding the impact of the reformed Three Formulas of Unity, and especially the Dutch Confession of Faith article 30 on the work or service of the church and norms or principles to achieve an acceptable functioning of the offices in church. Student support services are the cardinal features of the Open and Distance Learning (ODL) System. In India, the Indira Gandhi National Open University (IGNOU), 13 state open universities and over 200 Distance Education Institutes (DEIs) attached to conventional universities and private/autonomous institutes offering programmes through the distance mode ( MHRD, 2013 ) have all created adequate provisions for learner support services and the systems, rules, regulations and norms have been put in place. However, it is significant that a learner in (...) the ODL system remains away from the teacher and the peer group. Thus, the learner feels isolated ( Das & Ghosh, 2011a ) and needs the empathy of all the functionaries concerned. It has been our experience at IGNOU that more often than not the functionaries fail to realize the value of a learner and the learner fails to understand the value attributed to him by the ODL system. Without such realization the rules and regulations lose their significance. Hence, inculcation of values is of paramount importance in the functioning of the ODL system. In this article we have discussed about ‘inculcation of values’ among the ‘learners’ as well as the ‘functionaries’ for developing ‘best practices’ in learner support services in the ODL system. SummaryIn 1865, Spanish Jesuits founded the Manila Observatory, the earliest of the Far East centres devoted to typhoon and earthquake studies. Also on Philippine soil and under the direction of the Jesuits, in 1884 the Madrid government inaugurated the first Meteorological Service in the Spanish Kingdom, and most probably in the Far East. Nevertheless, these achievements not only went practically unnoticed in the historiography of science, but neither does the process of geophysical dissemination that unfolded fit in with the two (...) types of transmitter of knowledge identified by historians in the missionary diffusion of the exact sciences in colonial contexts. Rather than regarding science as merely a stimulus to their functionary and missionary tasks, Spanish Jesuits used their overseas posting to produce and publish original research –– a feature that would place them within the typology of the ‘seeker’ rather than the ‘functionary’ (in stark contrast to what the standard typology sustains). This paper also analyses examples of synergies between science, education and trade, which denotes, inter alia, the existence of a broad and solid educational structure in the Manila Mission that sustained the strength of research enterprise. Dictatorships destroy intellectual freedom, yet universities need it. How, then, can universities function under dictatorships? Are they more a support or a danger for the system? In this volume, leading experts from five countries explore the many dimensions of accommodation and conflict, control and independence, as well as subservience and resistance that characterized the relationship of universities to dictatorial regimes in communist and fascist states during the twentieth century: Nazi Germany, Mussolini’s Italy, Francoist Spain, Maoist China, the Soviet Union, and (...) the Soviet bloc countries of Czechoslovakia, East Germany, Hungary, and Poland. Comparisons across these cases reveal that the higher-education policies of modern dictatorships were characterized by a basic conflict of aims. On the one hand, universities were supposed to propagate reigning ideology and serve as training grounds for a dependable elite. Consequently, university autonomy was restricted, research used for political legitimation, personnel policies subjected to political calculus, and many undesired scholars simply put out on the street. On the other hand, modern dictatorships needed well-educated scientists, physicians, teachers, and engineers for the implementation of their political, economic, and military agendas. Communist and fascist leaders thus confronted the basic question of whether universities should be seen primarily as producers of ideology and functionaries loyal to the party line or as places where indispensable knowledge was made available. Dictatorships that opted to subject universities to rigorous political control reduced their scholarly productivity. But if the institutes of higher learning were left with too much autonomy, there was a danger that they would go astray politically. It is not necessary to have a keen ear in order to find out that the steps we take towards the future sound hollow. But it is necessary to have concentrated hearing if one wishes to find out which type of vacuity resonates with our progress. There are several types of vacuity, and ours must be compared to others, if the aim (...) is to understand it. The incomparable is incomprehensible. If we affirm that our situation is incomparable, we give up the effort to grasp it. The comparison that imposes itself is to the vacuity of the Baroque. There are innumerable traces in the present that evoke the Baroque. We bear the mark of the same somber rationalism (logics, informatics, cybernetics), and of the same magic and fanatic irrationalism (mass media, phantastic ideologies). But there is a decisive difference. Humanity advanced over a stage during the Baroque. All of its gestures, even the most sincere, were marked by theatricality. The vacuity that resonated under its feet was of the void under the stage. Baroque man represented. 1 For example he represented faith in waging religious wars. Baroque vacuity was the consequence of a medieval loss of faith in dogmas . Our vacuity is different. We do not represent anything. Our world is not a stage. We are not actors, and if we act, it is not to represent a drama, but to divert the audience's attention and our own from the subjects that really matter. We act like criminals that try to hide their tracks. We pretend. Our progress is a farce. The vacuity under our feet is not Baroque. We have not lost our faith in dogmas: we have lost faith in ourselves . We are as counter-reformists as was the Baroque (we want to cover up the recent revolution with warm cloths), but for different reasons. Although comparable with the Baroque, in certain aspects, our situation is in fact incomparable to any other. That is because an incomparable, unheard of, never before seen event happened recently, which emptied the ground we tread. Auschwitz . Other posterior events; Hiroshima, the Gulags, are nothing but variations of the first. Therefore every attempt to grasp the present leads to the following questions: how was Auschwitz possible? How can we live after this? Such questions relate not only to the ones directly or indirectly responsible, and not only to those who were directly or indirectly hit by it: they relate to everyone who takes part in our culture. Because what is so incomparable, unheard of, never before seen and therefore incomprehensible in Auschwitz, is that it was there that Western culture revealed one of its inherent virtualities. Auschwitz is a characteristic realization of our culture. It is neither the product of a particular Western ideology, nor of specific “advanced” industrial techniques. It springs directly from the depths of culture and of its concepts and values. The possibility to realize Auschwitzes is implicit within our culture from the very start: the Western “project” already harbored it, although as a remote possibility. Auschwitz lies within the initial program of the West, which progressively realizes all of its virtualities as history unfolds. That is why the question that Auschwitz poses before us is not: how did it happen? It serves no purpose to “explain” Auschwitz. The fundamental question is: how was it possible? Because what is being questioned is not the extermination camp, but the West. Thus one other question: how to live within a culture henceforth unmasked? Everything that happened afterwards resonates with such a question, with such vacuity. Every economic, social, political, technical, scientific, artistic, philosophic event is corroded by such an undigested question. The distance that separates us from the event does not mitigate the abyss, it erodes it even deeper. Because the distance progressively dissolves the aura of the horror that envelops the event, and it progressively opens up a vision of the scene. It progressively reveals that there all of our categories, all of our “models”, suffered an irreparable shipwreck. Auschwitz was a revolutionary event, in the sense that it overthrew our culture. Insofar as we seek ways to cover up such revolution with trips to the moon or with genetic manipulations, we are counter-revolutionaries: we are inverting the course of history in order to cover up the past. The unspoken in Auschwitz is not the mass murder, it is not the crime . It is the ultimate reification of people into amorphous objects, into ashes. The Western tendency towards objectification was finally realized and it was done so in the shape of an apparatus . The SS were functionaries of an extermination apparatus, and their victims functioned in function of their own annihilation. The extermination camp's program, once it started functioning, developed in an automatic fashion, autonomous from the decisions of the initial programmers, even if, as it effectively did, it contributed to the defeat of the programmers. The SS and the Jews functioned one in function of the other like cogwheels. The models for such functionality were provided by the highest of Western values: the SS behaved like “heroes” and the Jews like “martyrs”. This is an apparatus that functions at a borderline situation: objective even beyond death. What has just been said is intolerable. We cannot accept it and so we mobilize arguments against it. Good arguments. The SS behaved like criminals: they removed the gold teeth from the cadavers. The Jews behaved like victims: they rose up in the Warsaw ghetto. Such arguments are true, but they do not reach the nucleus, the “ eidos ” of the phenomenon: they do not grasp it. Although there was “normal” behavior: (theft, murder, revolt, heroism), there was also “abnormal” behavior: functionality during a borderline situation. And this is what counts. There, for the first time in the history of humanity, an apparatus was put into operation that was programmed with the most advanced techniques available, which realized the objectification of man, together with the functional collaboration of man. The previous horrors committed by Western society against other societies and against itself (and there are many) were crimes . They were violations of Western models of behavior: anti-Christian, anti-human, irrational. So that it is possible to condemn them and continue to be Western, even if the horror is so colossal, such as the enslavement of Africans. However, it is not possible to condemn Auschwitz and continue to adhere consciously to the West. Auschwitz is not a violation of Western models of behavior, it is, on the contrary, the result of the application of such models. Our culture allowed its mystifying mask to fall and must be rejected in toto if we admit that the purpose of every culture is to allow for the convivial existence of men that recognize each other mutually as subjects. However: it is not possible to reject one's own culture. It is the ground we tread . Those who seek to reject their own culture (as Nietzsche did in rejecting Judeo-Christianity), fall victim to madness. Those who reject their culture's models, are incapable of grasping the world in which they live. Cultural models are traps to catch the world. Those who seek to substitute their own models for other's (for example by shouting “Hare Krishna”) will find that such exotic models have already been caught by the very models to be substituted. There is no exit: we are condemned to use our models and to serve such models, even after they have been unmasked, if we wish to continue living. The only alternative would be to commit suicide. That is: we must continue our economic, political, scientific, artistic, philosophic activities despite Auschwitz. We must continue progressing despite everything . That is why there are those who recommend that we should seek to forget what happened, that we should repress the event. They sustain that enough has already been said and written about the subject and that it is time to “overcome” it. But such an ostrich strategy reveals itself disastrous. Because the result is that Auschwitz transfers itself from Poland of the 1940s to the post-industrial society of the future. What characterizes the extermination camp is precisely that it is not an event that can be “overcome”, because it is the first realization of an inherent virtuality within the Western project, which will repeat itself in other formats unless we become totally conscious of it. The advantage (if this is an appropriate term) that Auschwitz offers us, is to give us a concrete example of the West’s tendency towards the apparatus. For the first time in our history it is possible for us to experience concretely the utopia inherent in our culture. For the first time in our history we have the experience that utopia, no matter in what form, towards which we progress, is the extermination camp. Everywhere we can observe, as of now, the emergence of variations on the theme “Auschwitz”. Everywhere apparatus spring, just like mushrooms after a Nazi rain, from the ground that has become rotten. Certainly: such new apparatus are not externally similar to the Nazi extermination camps. Their labels are different, as are the ideologies that pretend to inspire them. Even the apparatus that admittedly envision extermination, such as the Gulags, the ones of a future nuclear war, or the ones that functioned in Vietnam, claim to be different from Auschwitz. Others claim to be “friends of mankind”, such as the scientific, technical and administrative apparatus. But such labels and such ideologies are deceptive and serve only to cover up the essence of apparatus. They are all just like Auschwitz, black boxes that function with complex inner-workings in order to realize a program. They all function according to an inertia that is inherent to them and such functionality escapes , from a certain point, the control of their initial programmers. In a final analysis such apparatuses function, all of them, towards the annihilation of all their functionaries, including their programmers. Exactly because they objectify and dehumanize man. Thus Western culture reveals itself as a project that seeks to transform itself into an apparatus. What characterizes the West is its capacity for an objectifying transcendence. Such transcendence allows for the transformation of all phenomena, including the human phenomenon, into an object of knowledge and manipulation. The space for such transcendence opened up thanks to Judeo-Christianity and resulted, in the course of our history, in science, technique and recently, in Auschwitz. The ultimate objectification of the Jews into ashes is the ultimate victory of the spirit of the West. It is social technique taken to the extreme. Certainly: the transformation of men into ashes is primitive, incipient social technique that progressively refines itself. It will be followed by less brutal objectifications, such as the robotization of society. But it does not matter which form it will assume: it will always be an objectifying manipulation of mankind. Although the apparatus of the immediate future are not necessarily incineration ovens, all will be, and not only the nuclear ones, apparatus for the annihilation of man. The Western program contains several virtualities, not only apparatus. Numerous virtualities have not yet been realized. In this sense the “history of the West” has not ended yet, the Western game continues. But all not-yet realized virtualities are infected by apparatus. That is why it has become currently impossible to engage ourselves in the “ progress of culture .” As it would be to engage ourselves in our own annihilation. We have lost our faith in our culture, in the ground we tread. That is: we have lost faith in ourselves. It is this hollow vibration that follows our steps towards the future. What remains is for us to analyze the event “Auschwitz” in all its details in order to discover the fundamental project that realized itself there for the first time, so that we may nurture the hope to project ourselves out of that project. Out of the history of the West. This is the “post- historical” climate in which we are condemned to live from hereon. NOTES 1. This volume investigates for the first time whether and to what extent religious knowledge - e.g., "sacred" narratives, customary practices, legal rules, family traditions, festival observances - was accessible to and known by ordinary people beyond religious functionaries. This book is the first collaborative interdisciplinary study of this important subject area with chapters written by international experts on ancient Mesopotamia, the Hebrew Bible, Qumran literature, rabbinic literature, and early Christianity including apocrypha and monastic traditions.

In his text, `Information strategies', written at the cusp of the emergence of digital photography in 1985, German artist and photography critic Andreas Müller-Pohle predicted that soon `it will be possible to generate and regenerate literally every conceivable - or inconceivable - picture through a computer terminal'. This realization coincided with Müller-Pohle's critique of conventional photography, which he dubbed `photographism' drawing on the philosopher Vilém Flusser's work. For Flusser, photographers are functionaries of an apparatus based on automation, programmed to produce (...) of pictures that correspond to certain general conventions and reconstructing the world as technical information. According to Flusser, the bulk of photography is `redundant', exhausting itself stylistically and enslaved to apparatuses and programs. This paper revisits the ideas of Flusser and Müller-Pohle in light of developments in digital photography that throw new light on the idea of image saturation and redundant photography. In particular, I address cultures of online photo sharing in light of the actions enabled by the metadata contained within common digital file formats. I propose that the very excess of digital photographic images coincides with the reinvention of the embattled authorial image into an evolving collaboration between the photographer and the database. In the current era of post-liberalization, privatization, and globalization (LPG), questions relating to business ethics and corporate social responsibility (CSR) have surfaced, affecting Indian economy, society, and polity. The main aim of this study is to understand the emergence of the new market in India. Not only has the structure and functioning of the market changed since the advent of globalization, but new norms, regulations, and actors have come into play. In a way, a completely new situation has occurred, characterized (...) by an altogether new work culture. As an off-shoot of globalization there is emergence of a new middle class, but there is hardly any cognition among common customers and functionaries of the shopping malls about business ethics and CSR. There is no transparency regarding functioning of the malls. Pricing and profit-making are kept as secrets by the top management. Functionaries are working as cogs in the machine and, due to this, alienation of the staff from their creative-selves needs to be studied. This present study focuses on the understanding of business ethics and corporate social responsibility as guiding principles and practices in business transactions. The great majority of the Chinese population depended on religious ritual, which often incorporated materia medica, for its health care. Of the therapeutic rituals available, those of popular religion—popular in the sense of participation by all social strata—were most accessible. Its priests were usually neighbors, farmers or craftsmen who performed their liturgical duties as they were needed, often qualified by their ability to be possessed by spirits. Here too the government shaped popular religion, partly by registering temples whose deities its (...) functionaries judged morally orthodox and effective, and in part by periodically persecuting those it did not register. People at every level of society believed that the gods were a bureaucracy, which supervised the operations of sky and earth. Laymen measured the efficacy of individual deities by their ability to meet people’s needs, the curing of ailments prominent among them. The gods enforced conventional morality, rewarding what the community valued and preventing or punishing what it feared. This chapter studies popular ritual therapies, examines their role in curing medical disorders, and explains why and how many medical authors adapted them. (shrink)

It is our intention in this article to reconsider a text written shortly before his death by the founder of our Society, Pierre Delattre. In it he apparently proposed that the biological meanings of the word function were derived from the mathematical use of the word, a particularization.We claim, on the contrary, that it is the mathematical use of function that comes from its sociological and biological meanings. For this we go back to the etymology of the word. Function comes (...) from the Latin verbfungi (in the first person,fungor). Fungor (a deponent verb form) already has a factitive meaning, I am made to do, and it applies to a functionary, a civil servant engaged in some specific social (or political, or military) task. Hence such a meaning presupposes the existence of a social structure able to compel individuals to undertake a specific task of common interest. The Latin verb can also be applied to a tool, made to function in the interest of man. Thus the meaning offungi requires a preexisting social or biological organization. The function aims to correct the dysfunctions of the global system, whether political or biological. (shrink)

I want to address the political element in the pedagogical engagement. Too often the business of teaching is presented as somehow independent of political influence or implication. When ERO talked about ‘delivering the curriculum’, the terminology reflected a very neo-liberal view that the curriculum was something different from the process of teaching and that teachers should be regarded as functionaries putting out there something decided by others. In this paper I want to look at the political element of pedagogy, both (...) as a question of Foucault’s ‘conduct of conduct’, and as a process inseparable from the very political elements of sexism, racism, classism that pervade our society and are therefore inescapable in our classrooms. In considering the element or racism or ethnicism I will look at the ontologies we bring to our work, and how they might differ. Ultimately I will bring Levinas into the story, to help to consider how our teaching can be politically and ethically aware. (shrink)

According to several fourth-century Athenian sources, the Spartans were a boorish and uneducated people, who were either hostile toward the written word or simply illiterate. Building upon such Athenian claims of Spartan illiteracy, modern scholars have repeatedly portrayed Sparta as a backward state whose supposedly secretive and reactionary oligarchic political system led to an extremely low level of literacy on the part of the common Spartiate. This article reassesses both ancient and modern constructions of Spartan illiteracy and examines the ideological (...) underpinnings of Athenian attacks on the ostensibly unlettered Lacedaemonians. Beginning with a close analysis of the available archaeological and literary evidence on Spartan public applications of literacy, it argues that the written word played a central role in the operation of the Spartan state, which utilized a variety of documents and required routine acts of literacy on the part of Spartiate commanders and ocials. Both the broad eligibility for the ephorate and the Lacedaemonians' chronic oliganthropia demonstrate that not all of the important public functionaries whose duties customarily involved reading and writing were members of the Spartan elite. The fact that Spartan office-holders acquired their literacy skills from a compulsory and comprehensive system of public education, which promoted the creation of a collective identity, further argues in favor of a literacy that was more broadly based than previous scholars have concluded. The article then accounts for these representations of Spartan illiteracy by locating them in the context of the changing relationship between orality and literacy in fifth- and fourth-century Athens. It argues that as the written word played an increasingly important role in Athenian democratic practice and ideology, it began to performtwo interconnected functions: as a signicant component in Athenian self-denition and as a key indicator of cultural and political dierence between Athens and its Peloponnesian enemies. In the 1860s and 1870s, the feudal monarchy of the Tokugawa shogunate, which had ruled Japan for over two centuries, was overthrown, and the entire political order it had commanded was dismantled. This immense political transformation, comparable in its results to the great social revolutions of the seventeenth through nineteenth centuries in the West, was distinctive for lacking a major role for mass political mobilization. Since popular political action was decisive elsewhere for both providing the force for social revolutions to (...) defeat old regimes and for pushing revolutionary leaders to more radical policies, the Meiji Restoration’s combination of revolutionary outcomes with conservative personnel and means is puzzling. This article argues that previous accounts fail to explain why a group of relatively low-status samurai—administrative functionaries with some hereditary political privileges but in fact little secure power within the old regime—was able to overcome far more deeply entrenched political actors. To explain this, it is necessary to distinguish clearly between two political processes: the long-standing political relations of feudal monarchy and magnate lords and the unprecedented emergence of independent samurai political action and organizations cutting across domain boundaries. It was the interaction of these two processes that produced the overthrow of the Tokugawa and enabled the revolutionary outcomes that followed it. This article’s revised explanation of the Meiji Restoration clearly places it within the same theoretical parameters as the major revolutions of the seventeenth century and later. (shrink)

A theory of reasoned knowledge is presented by developing and demonstrating the methodology of a novel skeptical critique designed to extend the epistemological practice of belief justification to an epistemological practice of reason justification. Analyses of the reasoning found in the theorizations of certain seminal philosophers and leading scientists will reveal how the absence of the epistemic justification of reason defaults to the use of an unjustified form of reason that runs the play of an unrecognized and unchecked dialectic between (...) epistemology and science. An alternative form of reason will be logically outlined and tested against the formalized skeptical critique in order for the newly recognized dialectic to be checked over reason with provisional epistemic justification. Zeno’s paradox and Green’s and Sellars’ critique of givenness are employed as argument functionaries of the reasoned knowledge theory. (shrink)
