The theory of document acts is an extension of the more traditional theory of speech acts advanced by Austin and Searle. It is designed to do justice to the ways in which documents can be used to bring about a variety of effects in virtue of the fact that, where speech is evanescent, documents are continuant entities. This means that documents can be preserved in such a way that they can be inspected and modified at successive points in time and (...) grouped together into enduring document complexes. We outline some components of a theory of document acts, and show how it can throw light on certain problems in Searle’s ontology of social reality. (shrink)

There are two important ways in which, when dealing with documents, we go beyond the boundaries of linear text. First, by incorporating diagrams into documents, and second, by creating complexes of intermeshed documents which may be extended in space and evolve and grow through time. The thesis of this paper is that such aggregations of documents are today indispensable to practically all complex human achievements from law and finance to orchestral performance and organized warfare. The aim of this study was to increase understanding of how individual patient care and the ethical principles prescribed for nursing care are implemented in nursing documentation. The method used was a metasynthesis of the results of 14 qualitative research reports. The results indicate that individualized patient care is not visible in nurses’ documentation of care. It seems that nurses describe their tasks more frequently than patients’ experiences of their care. The results also show that the structure of nursing documentation (...) and the forms or manner of recording presupposed by the organization may prevent individual recording of patient care. In order to obtain visibility for good patient-centred and ethical nursing care, an effort should be made to influence how the content of nursing care is documented and made an essential part of individual patient care. If the content of this documentation does not give an accurate picture of care, patients’ right to receive good nursing care may not be realized. (shrink)

The aim of this study was to describe how patients’ participation in the care they received was documented in their health care records during the last three months of their lives. Two hundred and twenty-nine deceased adult persons were randomly identified from 12 municipalities in a Swedish county and their records were selected from different health care units. Content analysis was used to analyse the text. Four categories of patient participation were described: refusing offered care and treatments; appealing for relief; (...) desire for everyday life; and making personal decisions. The most common way for these patients to be involved in their care at the end of their life was by refusal of the treatment and care offered. Characteristic of the different ways of participation were the diverse activities represented. The description of patients’ involvement in their life situation at this time indicated their dissociation from the health care offered more than consenting to it. (shrink)

Offering a comprehensive account of the documents in the corpora of the orators and in the manuscript tradition, Canevaro summarizes previous scholarship and delineates a new methodology for analyzing the documents.

State documents on the examination of religious life.

BackgroundDelirium is highly prevalent in the general hospital patient population, characterized by acute onset, fluctuating levels of consciousness, and global impairment of cognitive functioning. Mental capacity, its assessment and subsequent consent are therefore prominent within this cohort, yet under-explored.AimThis study of patients with delirium sought to determine the processes by which consent to medical treatment was attempted, how capacity was assessed, and any subsequent actions thereafter.MethodA retrospective documentation review of patients identified as having a delirium for the twelve months February (...) 2013 to January 2014 was undertaken. Inclusion and exclusion criteria were used; demographic and descriptive data collected. A total of n=1153 patients were identified with n=310 meeting inclusion criteria.ResultA random sample of one hundred patients were subsequently reviewed. One third of patients had documentation relating to consent, while four patients had documentation relating to capacity. Median delirium duration was three days, with treatment refusal occurring in twenty-two patients and “duty of care” being used as an apparent beneficent related treatment framework in twelve patients.ConclusionsWhile impaired decision-making was indicated, the review was unable to indicate what patient characteristics flag the need for capacity assessment. Memory, as is well known, makes up a large part of our identity (even though the criterion of this “identity” is controversial). Documents – understood as inscriptions – make up our external memory in a peculiar way: they constitute both a stable anchor and a reference-point for our personal transformations over time. There is, however, also an internal memory, residing in our brain. This is based in part on external documentation; but it is of course not exclusively tied thereto. Rather (...) it evolves dynamically over time, in part reflecting ethical debates which we carry on within ourselves and which is influenced also by emotional factors, for example as we try to erase memories that are unpleasant. If, for example, the internal memory of some offense against our person is erased, then the motivation to testify against those who offended against us no longer exists or is greatly reduced, and this is so even though the documents that record the offense remain. Our motivations here depend on the emotional factor in our memories; once this has been lost, even though the autobiographical, episodic memory still remains, then the value-significance of the event fades from our view, and with it the impulse to act. Emotions are in large part responsible for creating a bond with documents; they make it possible for our internal and external memories to have significance. There must be some degree of emotional resonance in inscriptions relating to events in the past, which arises out of our own experience of these events and from our memory of these experiences, for these inscriptions to have significance in our lives. Documents are thus fundamental. But for ourselves and for our social lives, they must be supplemented by internal memories. (shrink)

Many households experienced significant negative economic impacts from job or work opportunity loss during the COVID-19 pandemic, including loss of income, loss of employer-provided health insurance, possible housing insecurity, and increases in food insecurity. Results from a sample of 929 U.S. households show that 53% of households with children reported some indications of food insecurity in 2020. The food security score divergences between households with and without children are stark, with food insecurity being worse among households with children. Food insecurity (...) for households with children was exacerbated by pandemic-era disruptions; the societal costs of these food insecurity challenges are only beginning to be recognized. This analysis adds evidence to the notion of the uneven toll of the pandemic and documents explicit and disproportionate negative consequences for households with children. As new policies are debated and economic recovery continues, households with children who have fallen down the socioeconomic ladder should not be omitted. Much of the attention during the pandemic has been on older segments of the population more susceptible to COVID-19 and its complications, while younger children, who were less susceptible initially and/or less obviously impacted by the virus itself were discounted. Pandemic ramifications expand beyond morbidity and loss of life, and long-ranging implications, especially for households with children, should be recognized when recovery-era policies are enacted to ensure they are not left behind. In particular, as pandemic-era support programs, including school lunch programs, expire the tolls on children mount and may be underappreciated. (shrink)

A detailed analysis of all preserved documents on the German atomic bomb research during the ‘Third Reich’, however, reveals considerable mistakes by the authors due to incomplete analysis of documents, misinterpretations of scientific explanations and ignoring of physical facts. It is shown that until the end of the war the German physicists did not know that an atomic bomb can only be made with fast neutrons, except Heisenberg, who, however, discovered it rather late, did not communicate it clearly and did not study any bomb physics. The physically correct interpretation of the documents reveals that the German physicists worked unsuccessfully on a reactor, which would have been a prerequisite for a plutonium bomb. La Fontaine’s allegory of “montrer patte blanche / showing the white paw” – from his fable «The Wolf, the Goat, and the Kid – should help me trace the problem of documenting sex and/or gender. In the first decade of the 21st century, the legislative bodies of certain social democratic countries (e.g. Australia, New Zealand, Nepal, Germany) have made a change into the binary system of presenting sex or gender on official identification documents, by introducing a third possibility – that (...) of gender indeterminacy. Would it now be possible to issue an official Id without knowing the precise sex of the person? My questioning tackles this new practice, measuring it from the standpoint of social ontology. It presents the authoritative pronouncements of the Documents on a number of key issues, such as, Who has the legitimacy to rule? How shall the good ruler and his officials act to retain legitimacy? What is the (...) best form of government? How are punishments to be applied? How are taxes and tribute, domestic and foreign policy, to be administered? Regulatory impact assessment (RIA) is seen as a tool for increasing evidence-based policy making and as such it is being integrated into decision-making procedures on a wide range of issues. Based on systematic consultation, clear criteria for policy choice, and economic analysis of how costs and benefits impact on a wide range of affected parties, this tool operates by using scientific knowledge and technical analysis rather than political considerations. Scientific knowledge can be used to achieve instrumental learning (Radaelli, 2009, OECD), (...) policy change (Sabatier, 1999), to impact on decision making (Caplan, 1979; C.H.Weiss, 1999) but also to seek legitimacy from the policy environment (Edelman, 1985; Schrefler, 2010). This article suggests an analytical framework for analysing RIA documents with insight from knowledge utilization theories. We argue that in order to better understand the RIA itself, we need to look at institutional factors as well. The combination of institutional context variables and variables for RIA document content analysis which make up worldviews in this framework provide the basis for the document analysis and exploration of RIA in its context. Background Nursing documentation as a pivotal part of nursing care has many implications for patient care in terms of safety and ethics. Objectives To explore factors influencing nursing documentation from nurses’ perspectives in the Iranian nursing context. Methods This qualitative study was carried out using a qualitative content analysis of data collected from 2018 to 2019 in two urban areas of Iran. Semi-structured interviews (n = 15), observations, and reviews of patients’ medical files were used for data collection. Ethical considerations (...) This study was conducted in accordance with the ethical principles of research and regulations in terms of confidentiality of data, anonymity, and provision of informed consent. Findings The main theme of this study was “unsafe documentation.” Two categories, “types of errors in reporting” and “reasons of errors in reporting,” and 12 subcategories were developed indicating factors influencing nursing documentation in the Iranian nursing context. Conclusion In general, individual, organizational, and national factors affected nursing documentation in Iran. In this respect, hiring more nurses, application of reforms in the healthcare management structure, devising appropriate regulations regarding division of labor, constant education of healthcare staff, establishment of clinical governance, improvement of interpersonal relationships, development of hardware and software techniques for documentation, and provision of support should be done to improve the quality of nursing documentation. The above-mentioned suggestions can help nurses with a safe, ethical, lawful, and reliable documentation in nursing practice. (shrink)

In Documentality (2013), Maurizio Ferraris argues that documents are at the heart of social institutions. Taking this notion as a cue, this piece considers a key organisation in the resistance to state violence and Pinochet's dictatorship in Chile, the Vicaría de la Solidaridad, and focuses on the remarkable document where the desperate stories of people detained, disappeared and murdered following the coup in 1973 were recorded. This process of registration adopted an overtly rational, administrative response akin to the ‘bio-political’ (...) modes of governing life that Foucault described. As such, it was also built upon a refusal to allow the lives of a section of the population to be cast as without value. Moreover, it ‘deferred’ to a future, in which such documentation would be an invaluable record of injustice. Its legacy is not confined to legal forums, however; academic work and Nicolás Franco's artwork La Sábana (The Sheet, 2017) have also emerged. (shrink)

Accessing legislation via the Internet is more and more frequent. As a result, systems that allow consultation of law texts are becoming more and more powerful. This paper presents DARES, a generic system which can be adapted to any domain to handle documents production needs. It is based on an annotation engine which allows obtaining XML documents inputs as required by the system, and on an XML fragments recombining system. The latter operates using a fragment manipulation functions toolbox to generate (...) new documents. The so-called Istanbul Protocol, a Manual on the Effective Investigation and Documentation of Torture and other Cruel, Inhumane or Degrading Treatment or Punishment was adopted by the United Nations soon after its completion in 1999 and since then has become an acknowledged standard for documenting cases of alleged torture and other forms of severe maltreatment. In 2009 the “Forum for medicine and human rights” at the Medical Faculty at the University Erlangen-Nuremburg has provided the first German edition of this manual. (...) The article traces back the development of the protocol taking into account the general background as well as the factual occasion of its initiation. The main ethical and legal principles of the manual are introduced as well as the projects for implementing the rules provided in the protocol that have been carried out so far. From this the urgent need for implementation of the Istanbul Protocol guidelines also in Europe and in German-speaking countries and here not exclusively but especially within asylum procedures becomes clear. A group of Sogdian documents from the area of Khotan was recently acquired by Renmin University of China, Beijing. Four economic documents were edited in JAOS 130/4 ; the present article, comprising the edition of one complete letter and several fragments of letters, completes the publication of this collection, which adds to a growing body of evidence for the presence of Sogdian-speakers on the trade routes to the south of the Taklamakan desert.

Historically, recordkeeping has been an essential task for health professionals. Today, this mandatory task increasingly takes place as digital documentation. This study critically examines problem constructions in practical documents on digital documentation strategies in Danish municipal healthcare and how these problem constructions imply particular solutions. A document analysis based on the approach presented in Bacchi's “What's the problem represented to be?” was applied. Forty practical documents in the form of guidelines, strategies, and quality control documents were included. The analysis uncovered (...) three problem representations: lack of coherence between health services in a complex healthcare system, lack of assessable data for management and political prioritization, and inefficiency in the healthcare system. The proposed solution is a digitalized and standardized practice that transforms recordkeeping in the municipalities. However, municipal healthcare is at risk of being fragmented due to digital documentation's focus on the organizational management of health with task‐oriented practices supplied by an anonymous health professional. We find that digital documentation functions as an organizational micromanagement approach that assigns the health professional a subject position as an employee acting according to the organization's framework rather than the profession's normative framework. A desmaterialização de tipos documentais mostra-se uma realidade consolidada em tempos de informação digital. Com as inovações tecnológicas, mudanças culturais, comportamentais e todo um arcabouço conceitual e epistémico atrelado a essas inovações floresce e se desenvolve num curto espaço de tempo. (...) Revisita a noção de documento e neodocumentação, adotando-se a premissa Neodocumentalista a respeito do valor contextual que a materialidade do documento oferece. A pesquisa caracteriza-se como exploratória, bibliográfica, documental e telematizada e utiliza como corpus de pesquisa 112 álbuns sonoros da extinta gravadora pernambucana Rozenblit. Constata-se que a desmaterialização dos álbuns sonoros tem como característica principal o comprometimento da natureza ontológica do documento, da marca distintiva deste enquanto documento: a sua natureza informativa. In societies with a non-elementary degree of complexity, we find institutions, social roles, promises, marriages, corporations, enterprises, and the large variety of what we can label “social objects”. On the one hand, we commonly speak and think of such entities as if they existed on a par with entities such as tables and persons. On the other hand, there is a clear link between what people think and how people behave and the social domain. We argue that the widespread “reductionist” (...) approach in social ontology fails to account for both those aspects of social reality, and put forward a new approach. The main idea is that a particular kind of social objects, namely documents – and more generally records of social acts – are the ground of social reality. The fundamental difference from the reductionist approach is that the content of collective intentions will turn out to be not so important in accounting for the ontological variety of complex social realities such as ours. Implantable cardioverter defibrillators (ICDs) reduce mortality in selected patients at risk for life-threatening heart arrhythmias, and their use is increasingly common. However, these devices also confer risk for delivery of unexpected painful shocks during the dying process, thus reducing the quality of palliative care at the end of life. This scenario can be avoided by ICD deactivation in appropriate circumstances but patients will remain unaware of this option if not informed about it. It is not known how often end-of-life implications (...) are discussed with patients prior to ICD implantation, when focus is primarily on the short-term potential complications of the device placement procedure itself. We conducted a retrospective chart review to determine how often end-of-life implications were discussed with patients as part of the informed consent process. We evaluated consent forms and related other chart documentation for 91 patients (ranging from age 60 to 89 years) undergoing first-time ICD placement at a mid-western academic medical center from 2006-2008. Only one chart documented any discussion of end-of-life implications, in a case where the issue was raised by a patient who noted that quality of life was their main focus. Consent was provided by a health care surrogate in only four of the 91 cases. In conclusion, patients giving consent for ICD implantation may be uninformed about the device's potential future impact on end-of-life care, the dying process, and the option for device deactivation. Truly informed consent requires that both short- and long-term potential implications be reviewed with patients. (shrink)

This article explores what it calls the “documentarist” hypothesis: the belief that the subject matter of history, the past, is structurally absent and thus can be reached only by way of documents, testamentary traces of various sorts . The first part of the article works out the documentarist position through interpretations of creative works that embody it and of a variety of reflections on historiography—those of Michel de Certeau and Paul Ricoeur, as well as some “postmodern historiography.” It argues that (...) documentarism ultimately faces an insoluble problem: it presupposes the pastness of the past, yet it cannot give itself the latter by way of the documents to which it believes itself confined. Documentarism assumes as already at hand a historical-temporal horizon of past, present, and future, for which it itself cannot account. In the second part of the article, accordingly, I turn to the historiographical portion of Faulkner's The Bear to expose the operativity of this always already given temporality. Faulkner's tale gives us access to a more radical historicity than any upon which documentarists reckon; yet this historicity turns out to sit askew from the usual frameworks of history as we know them, especially those of periods and epochs. The tension in Faulkner's own work between periodizing and event-laden explanations, I conclude, points to questions that fall beyond history as currently conceived. (shrink)

This research aimed to identify the constituent elements of the musicographic document and whether they show signs of cultural memory and the composer's identity. This is a bibliographic and documentary research, using the indexical method. Data analysis and interpretation were based on a qualitative approach. The results indicated that the musicographic document brings together elements of the social structure, musical elements and technological elements capable of revealing the context of the production of the documentary item, as well as the traces (...) of memory and identity of the composer. Therefore, the study concludes that musical composition can be considered a significant cultural memory device. (shrink)

In this paper, we present a method for introducing law students to the writing of legal documents. The method uses a machine-readable representation of the legal knowledge to support document assembly and to help the students to understand how the assembly is performed. The knowledge base consists of enacted legislation, document templates, and assembly instructions. We propose a system called LEDAS (LEgal Document Assembly System) for the interactive assembly of legal documents. It guides users through the assembly process and provides (...) explanations of the interconnection between input data and claims stated in the document. The system acts as a platform for practicing drafting skills and has great potential as an education tool. It allows teachers to configure the system for the assembly of some particular type of legal document and then enables students to draft the documents by investigating which information is relevant for these documents and how the input data shape the final document. The generated legal document is complemented by a graphical representation of legal arguments expressed in the document. The system is based on existing legal standards to facilitate its introduction in the legal domain. Applicability of the system in the education of future lawyers is positively evaluated by the group of law students and their TA. (shrink)

In this article I defend two theses. The first is that the centrality of recording in the social world is manifested through the production of documents, a phenomenon which has been present since the earliest phases of society and which has undergone an exponential growth through the technological developments of the last decades. The second is that the centrality of documents leads to a view of normativity according to which human beings are primarily passive receptors of rules manifested through documents. (...) We are not intentional producers of values. The latter, as I shall suggest in my conclusion, should be viewed as being ‘socially dependent’ rather than ‘socially constructed’. (shrink)

A philosopher may develop ideas on his or her own or follow them in the works of others. Different kinds of documentary threads will develop. Historians of a subject may follow either kind. In the period of _Toward “Principia Mathematica”, 1905–08_, Russell engaged with developments in the writings of Poincaré, Haldane, Schiller and Berry, among others. What follows are remarks on supplementary documents (one being on-line) for a fuller study of logical and philosophical threads in the period.

The philosophers at the University of Padua during the late Middle Ages and Renaissance arc attracting much renewed interest. This study makes accessible again the logical philosophy of Girolamo Balduino, professor at Padua during the second quarter (...) of the sixteenth century. Like other thinkers of his period, 13alduino follows the logic of Aristotle, and looks for progress within the ancient and mediaeval tradition, not for radically new doctrines. He continues the traditional interpretation of Aristotle by Averroes, for whom logic is only an instrumental habitus, a tool or method of demonstration. About the final contribution of the school of Padua to the improvement of Aristotelian logic was the doctrine of regressive demonstration, where demonstration terminates in or discloses the definition. Zabarella's well-known teaching on this point seems to be derived entirely from Balduino. Contrary to the interpretation of Cassirer, followed by Randall, this regressive demonstration is not a universal method of inquiry and is not at all like, and not the historical source of, the new method of Galileo. Papuli's book is solidly based on the original Latin texts, in notes, which are of great value in view of the fact that Balduino's works have been out of print since 1573. Not all of Papuli's interpretations are beyond criticism (e.g., p. 296), but he has done a service in enabling us to reestablish contact with one of the last significant commentators on Aristotle's logic. Pp. 196+22 facsimile illustrations) Giulio Cesare Vanini (1585-1619) ranks with Giordano Bruno as a modern hero of freedom of philosophical expression. He was tortured and then burned at the stake in Toulouse at the age of thirty-four, because of the unorthodoxy of his views. For this reason, he has drawn more attention than is perhaps deserved on the basis of his rather mediocre writings, which are little more than a tissue of plagiarisms culled from Pomponazzi, Cardano, J. C. Scaliger, and others. In this volume, Emile Namer has collected the scattered documents dealing with Vanini's life and activities. This is a valuable service, for it should enable scholars to disentangle fact from fiction and reality from myth. There has been so much heated discussion regarding Vanini that it is now time that someone should attempt to establish the precise facts and to reevaluate Vanini's place in intellectual history. In the past, writings about him have been governed more often by emotion than by reason. Namer prints documents from Naples, London, Paris, Simancas, and Toulouse. Some of these have been printed before in various journal articles, but it is valuable to have them all together in a single volume. In addition, he prints relevant excerpts concerning--as one of them put it--le douzi~me apostre de Satan, including material from Mersenne, Garasse, and others. He also includes a series of facsimiles of sample pages from the documents which he prints. All in all Namer's work is competently 250 HISTORY OF PHILOSOPHY done, though perhaps a bit more annotation to put the documents in historical perspective would have been desirable. In any case this little volume must be one of the bases for any future serious biographical or interpretative studies dealing with Vanini. Moreover, it shouM also be useful for scholars dealing with more general questions of seventeenth-century intellectual, religious, and social history. Unfortunately, there is no index, nor bibliography of earlier literature on Vanini, and the Introduction is perhaps too brief to orient the reader who has little previous knowledge of Vanini. This paper explores how organizational members use documents to share their knowledge within and across work settings. I suggest that organizational studies of distributed knowledge sharing and information systems would greatly benefit from the linguistic analysis of communicative practices. Specifically, the paper highlights the notion of indexical centering as formulated by the linguistic anthropologist William Hanks and demonstrates its analytical power in studying documenting as a communicative practice. Drawing on a 15-month, multi-sited ethnographic study in several pediatric healthcare settings, the (...) paper focuses on how two doctors compose and use two medical histories found in two distinct medical information systems. The analysis suggests that the doctors use documents to index the temporal, spatial, and participatory dimensions of their knowledge sharing. They do so by indexing, on the one hand, the participants, times and places for their communicative practices and, on the other hand, the participants, times and places of their general care practices. The indexical analysis allows us to perceive documents, as more than mere vessels for knowledge transfer among organizational members, but as an integrated part of how people structure their work practices and situate their knowledge sharing in complex distributed organizational settings. We describe a deep generative model in which the lowest layer represents the word-count vector of a document and the top layer represents a learned binary code for that document. The top two layers of the generative model form an undirected associative memory and the remaining layers form a belief net with directed, top-down connections. We present efficient learning and inference procedures for this type of generative model and show that it allows more accurate and much faster retrieval than latent (...) semantic analysis. By using our method as a filter for a much slower method called TF-IDF we achieve higher accuracy than TF-IDF alone and save several orders of magnitude in retrieval time. By using short binary codes as addresses, we can perform retrieval on very large document sets in a time that is independent of the size of the document set using only one word of memory to describe each document. In the process, a constantly increasing mass of documents came to fuel two opposing representations of the history of the Church. These representations were supported by works of erudition in keeping with two different conceptions of history, which were also two theologies of the Church. The use of new sources became required, however, and led it to a particular way of writing history that would transcend confessional boundaries, while maintaining different positions. Taking these documents into account strengthened a critical current that gave rise to Mabillon and Le Nain de Tillemont, even though the positions continued to differ throughout 17th century. In this paper, we use motion tracking technology to document the birth of a brand new language: Nicaraguan Sign Language. Languages are dynamic entities that undergo change and growth through use, transmission, and learning, but the earliest stages of this process are generally difficult to observe as most languages have been used and passed down for many generations. Here, we observe a rare case of language emergence: the earliest stages of the new sign language in Nicaragua. By comparing the signing (...) of the oldest and youngest signers of Nicaraguan Sign Language, we can track how the language itself is changing. Using motion tracking technology, we document a decrease in the size of articulatory space of Nicaraguan Sign Language signers over time. The reduction in articulatory space in Nicaraguan Sign appears to be the joint product of several decades of use and repeated transmission of this new language. (shrink)

The selections in this anthology provide original sources for an understanding of the development of American thought and society. The central theme of the book deals with the impact of modern science and scientific method upon thinkers from the time of Edwards to that of Dewey. Some philosophers responded by trying to limit the scope of science in order to protect their threatened moral and religious beliefs. Others tried to use science and scientific method to restructure common sense, theology, metaphysics, (...) morals, and even society itself. This volume presents the many diverse reactions, including the transcendentalism of Emerson, the pragmatism of Charles Peirce and William James, and the naturalism of Santayana and Dewey. Because the philosophers of this period felt that contemporary cultural issues were as much the province of philosophy as abstract theoretical questions, several selections reflect the impact of science on other areas of civilization, including religion, morals, law, education, and politics.Although the anthology focuses on leading American philosophers from the eighteenth century to the mid-twentieth century, selections from Locke, Coleridge, and Spencer are also included because American thinkers have been profoundly influenced by their European masters and contemporaries.
