This book considers the way that Cesare Beccaria's slim 1764 volume On Crimes and Punishments influenced policy developments worldwide and over decades, if not centuries, after its publication. For those who turn to Beccaria's work today, the encounter is shaped by that knowledge. Appreciative of his book's dual nature as historical document and repository of ideas, the contributions in this collection address different aspects of the criminal justice theory Beccaria offered his readers and face up to methodological questions raised by (...) meeting a historical text of this kind - unsystematic and by modern standards often under-argued - with modern scholarly conventions in mind. Contributions in the first part of the book engage with Beccaria's 'political theory of criminal justice' through the lenses of political and penal philosophy. How do we get from Beccaria's blending of social-contractarian foundations and proto-utilitarian policy analysis to the concrete set of criminal justice practices Beccaria presents as justified? This leads across to the second part where contributors approach Beccaria's ideas with present-day reforms and developments in mind. Many of his policy proposals and arguments remain significant from our contemporary perspective, their limitations and omissions proving as instructive for the contemporary scholar as their more prescient elements. The third part offers those looking at Beccaria's work today a glimpse into the practical difficulties facing the firebrand author turned public servant during his long career in the Habsburg-Lombardian administration. It puts his work into the broader context of pathways to criminal justice reform in northern Italy, Habsburgian Lombardy, and the Austro-Hungarian Empire in Beccaria's day. (shrink)

The present book addresses the background, rationale, general structure, and particular aims and arguments characterizing our third and last volume about "humor" and "cruelty". A guiding foray is provided into the vast expert literature that can be retrieved in the Western humanities and social sciences on these two terms. Pivotal thinkers and crucial notions are duly identified, highlighted, and examined. Apposite subsidiary references are also included, especially with regard to psychodynamics and clinical psychology, existentialism, feminism, liberalism, Marxism, and representative recent (...) studies in the philosophy of humor and its cognates. The stage is thus set for the exploration and assessment of the conflicts between humor and cruelty unfolding in Part 2 of Volume 3. Being the philosophical terminus of our entire research project, Volume 3 counterbalances, complements, and, occasionally, complexifies the numerous forms of mutual cooperation between humor and cruelty that the preceding Volume 2 had unearthed and discussed. This paper deals with what has been called "ars inveniendi" (’art of finding‘) in antiquity, medieval and early modern times. A survey of different techniques of finding tenable and relevant arguments is presented (among them, the Topical tradition, Status theory, Debate theory, Encyclopedic systems, Creativity techniques). Their advantages and disadvantages are critically compared. It is suggested that a mixture of strategies of finding arguments should be used. En sanningsteoretisk antirealist kan inte godta denna möjlighet utan accepterar en eller annan version av Dummetts vetbarhetsprincip: (K) Om ett påstående är sant, så måste det i princip vara möjligt att veta att det är sant. Det kan dock förefalla rimligt, även för en antirealist, att gå̊ med på̊ att det kan finnas sanningar som ingen faktiskt (...) vet (har vetat, eller kommer att veta) är sanna. Man kan därför tänka sig att en antirealist skulle acceptera principen (K) utan att därför gå med på den till synes starkare principen: (SK) Om ett påstående är sant, så måste det faktiskt finnas någon som vet att det är sant. Ett mycket omdiskuterat argument – som ytterst går tillbaka till Alonzo Church, men som först publicerades i en uppsats av Frederic Fitch i Journal of Symbolic Logic 1963 – tycks emellertid visa att principen (K) implicerar principen (SK). Anta nämligen att (K) är sann, medan (SK) inte är det. Men om (SK) är falsk, så finns det ett påstående som är sant men som ingen faktiskt vet är sant. Anta nu att p är ett sådant påstående. Ett annat är baserat på distinktionen mellan faktisk och potentiell kunskap och ett förkastande av den vanliga modallogiska formaliseringen av principen (K). Den senare typen av lösning betraktas både från ett realistiskt och ett icke-realistiskt perspektiv. Utifrån denna analys kommer jag fram till slutsatsen att vi, vare sig vi är realister eller antirealister rörande sanning, kan sluta oroa oss för vetbarhetsparadoxen och ändå uppskatta Church-Fitchs argument. Many have argued that it is impossible to determine criteria to identify good arguments. In this contribution, we argue that it is at least possible to identify features of objectively bad arguments. Going beyond Blair and Johnson’s ARS criteria, which state that reasons must be acceptable, relevant, and sufficient, we develop a list of eight criteria with instructions for how to apply them to assess arguments. We conclude by presenting data from two empirical studies that show how frequently students violate (...) these criteria in lab conditions and “in the wild.”. (shrink)

In “Ars Nova,” a short essay written in 1963, Blanchot defends the “new music” of Arnold Schönberg and his school against its critics and hails it as an exemplary contestation of culture conceived as an attempt to conceal the groundlessness of human existence. The fragmentary and dissonant nature of the “new music” has the power to unmask culture’s pretence of order, meaning and harmony. It embodies the potential of modernist art to unsettle all established conventions standing in the way of (...) an authentic, radical interrogation. Blanchot develops his argument by way of a discussion of Adorno’s theory of modernist music. The affinities and divergences revealed in Blanchot’s reading of Adorno’s work shed light on their respective understanding of the disruption enacted by the “new music.” A close analysis of Blanchot’s essay discloses the role of this confrontation with Adorno’s dialectical theory and points to the political and poetic ramifications of a complex and hitherto largely neglected category in Blanchot’s thinking about art: the diabolical. Our intuition is straightforward: yes, argumentation changes minds. It can’t be otherwise! But many cognitive and discursive habits seem to suggest otherwise. As the literature in the psychology of reasoning incessantly emphasizes, we hardly change our minds (and the minds of others) because a predisposed robust confirmation bias (or myside bias) is at work every time we argue, among other persistent cognitive illusions (Pohl, 2012), heuristics and biases (Santibáñez, 2023). To adequately answer the questions of why and how argumentation changes (...) minds, if at all, this paper frames the problem in an evolutionary perspective. My main thesis is that argumentative competence changes minds because its ultimate goal (Laland et al., 2011; Scott-Phillips, Dickins & West, 2011) is to construct the future to predict more accurately (Suddendorf, Redshaw & Bulley, 2022). This idea converges with some evolutionary analysis of other cognitive skills and cultural inventions. To explain my perspective, I use the distinction between ultimate and proximal goals of a trait, and the cultural background of argumentative competence plays a fundamental role within this distinction. Notre intuition est simple: oui, l’argumentation change les men-talités. Mais de nombreuses habitudes cognitives et discursives suggèrent le contraire. Comme le soulignent sans cesse les écrits sur la psychologie du raisonnement, nous ne changeons guère d’avis parce qu’un biais de con-firmation robuste (ou biais de-mon-côté) prédisposé est à l’oeuvre lorsque nous argumentons. Pour répondre adéquatement aux questions de pour-quoi, comment et si l’argumentation change les mentalités, je pose le prob-lème dans une perspective évolution-niste. Je soutiens que la compétence ar-gumentative change les mentalités parce que son but ultime est de con-struire l’avenir, de prédire avec plus de précision. Cela converge avec les anal-yses évolutionnistes d’autres compé-tences cognitives et inventions cul-turelles. The debate between the Better and the Worse Argument, between the old and the new education, in Aristophanes’ Clouds, is a scene full of caustic humour and exquisite irony. In this paper we will try to provide a detailed analysis of the linguistic features that characterize these two characters, in order to confront how two clearly opposite linguistic registers are outlined, in line with their confrontation of ideas. In general terms, the Better Argument exhibits a stronger conversational tone (...) than his adversary, a greater inclination to the use of asyndeton in his syntax, more vulgar and abusive terms, a virtual absence of both poetic and paratragic words and certain linguistic innovations and variants of a lesser literary quality. Ḥanafī jurist Burhān al-Dīn al-Nasafī is one of the most prominent names in the history of the ʿilm al-naẓar’ (Islamic Disputation Theory) particularly due to his seminal work entitled al-Fuṣūl. We have located a manuscript which we will call an Opponent-al-Fuṣūl written by a Shāfiʿī scholar. This manuscript is titled al-Risāla fī qawāʿid ʿilm al-naẓar and it highlights the importance of al-Nasafī’s al-Fuṣūl. The scribe of the manuscript attributes this Opponent-al-Fuṣūl to the famous logician Najm al-Dīn al-Kātibī. Although no mention (...) of such a book belonging to al-Kātibī has been discovered thus far, in this article we will try to demonstrate that the book does indeed belong to him. In addition, we will undertake a comparison of both works, al-Fuṣūl and the Opponent-al-Fuṣūl, with a particular focus on the concepts of talāzum (implication), tanāfī (incompatibility) and dawarān (concomitance). One of the main controversies of the Logic Schools of the 12th century centered on the question: What follows from the impossible? In this paper arguments for two diametrically opposed positions are examined. The author of the ‘Avranches Text’ who probably belonged to the school of the Parvipontani defended the view that from an impossible proposition everything follows (‘Ex impossibili quodlibet’). In particular he developed a proof to show that by means of so-called ‘disjunctive syllogism’ any arbitrary proposition B can (...) be logically derived from a pair of contradictory propositions A and Not-A. The author of the Ars Meliduna instead argued that nothing follows from an impossible proposition (‘ex falso nihil sequitur’). This view is supported by various counterexamples which aimed to show that the admission of impossible premises would give rise to inconsistent conclusions. Upon closer analysis these inconsistencies do not, however, have the formal structure of a real contradiction like A and Not-A, but rather the structure of two rivalling conditionals like ‘If B then A’ and ‘If B then Not-A’. Hence these counterexamples rather have to be considered as refutations of the basic principles of ‘connexive logic’. (shrink)

The post-classical genre of the “protocols for dialectical inquiry and disputation” has its more proximate origins in the famed Risāla of Shams al-Dīn al-Samarqandī. The greater part of his conceptions and methodology, however, consists in a streamlining and universalizing of the more strictly juristic dialectic of his teacher Burhān al-Dīn al-Nasafī ; and this in turn draws on the highly logicized dialectic of Rukn al-Dīn al-ʿAmīdī and his teacher Raḍī al-Dīn al-Nīsābūrī. At the heart of methods in this lineage, and (...) carried forward by al-Samarqandī into the universal ādāb al-baḥth, are three truth-preserving logical relationships critical to the truth-seeking enterprise of dialectic: entailment, mutual negation or exclusion, and causal concomitance. The practical elaboration of these relations reveals a logic in action—a premodern dialogical logic for living disputation praxis. In fact, so critical were these to the dialectical enterprise that al-Samarqandī devoted a specialized treatise entirely to summarizing their defining features and rules, aptly naming it the ʿAyn al-Naẓar, or “Wellspring of Rational Investigation.” In this article, and drawing upon a recently published digital critical edition, I will present an analytical outline of these core logical relations as presented in the ʿAyn al-Naẓar. Then I will address a number of points of interest in this text, grouped under six themes: the potential for cross-disciplinary advancement; notions in discursive development; significant or uniquely contributive formulations; peculiarities of content; signs of an evolving, universalist agenda; and evidence that the ʿAyn al-Naẓar was designed as an aide-mémoire for the active disputant. It not only contains a definite statement on continuing growth and development of the arts but also discusses the effect this may produce when one considers such progress. 2 The latter aspect is found again in very few other texts, but our text is unique for its application of the concept of progress to the ars grammatica. For these reasons the passage in Charisius deserves a discussion of its own. It is not easily read because of its textual condition and its style, and this may well be the main reason why those who have studied it have until now (with one exception) 3 overlooked the underlying idea of progress. 4Charisius’ grammar is a huge collection of earlier material, which he has compiled and ordered after the plan of the Schulgrammatik. Ancient authors liked to turn their prefaces into rhetorical showpieces, and our author has done so to a high degree. Instead of simply saying, “the arts have no limits,” he introduces an a fortiori argument: if nature, though finite, is so wide as not to allot to us her farthest boundary, 9 the more is this true for the arts. No argument is given for the idea that nature is finite. 10 At any rate, our author is more interested in the status of nature’s usual complement, the arts. At first—and this would be in line with his a fortiori argument—he seems to accept as feasible the idea that at some time the arts will be complete and finished, and he explains that this point of perfection has not yet been reached because of human weakness: we humans are too weak to make the arts perfect. This is so either because the work to be done is of extreme difficulty, 11 or because we are already satisfied by having founded an art and are disinclined to continue our job. The reader is left with the choice between these two possibilities as the author proceeds to a more basic explanation. Now he opts for the idea that in principle the arts are incomplete and remain so: every artisan always adds something to his art, adds, as it were, extensions to the building that his art forms; 12 consequently the arts will never be finished. Although Sibawayh dealt with it in a scattered manner under different headings there have been different views on na't (adjective), which is gene-rally included in the tawabi group in Arabic syntax, and there have been debates around these views. Na't, which is categorized as a proper adjective and qualifies the meaning of man'ut (mawsuf), has different characteristics from the sentence elements that indicate the subject. Nahiv scholars have mostly divided na't into two parts: real and causal na't, and they have (...) formulated certain rules for these two parts in accordance with the structure of the Arabic language. Since na't and man'ut are accepted as nouns, the i'rab of na't is subject to men'ut. However, some examples in the Qur'an and some expressions used by the Arabs caused objections to the i'rab of na't being the same as men'ut. It is observed that these objected examples are the cases where men'ut is known and the exceptional cases of madih, zam and jarri jivar. It is also obligatory for the na't to conform to the man'ut in terms of ma'rifiyyah, nekiriyyah, custom and gender. While Sibawayh (d. 180/796) considered it qabh (ugly) for non-propositional words to be na't, scholars such as Ibn Hisham (d. 218/833), Ibn al-Ḥajib (d. 646/1249), and Abd ar-Rahman Jami (d. 898/1492) accepted that na't could be either propositional or non-propositional and cited many examples of na't in the case of non-propositional words. Scholars such as Ibn Jinni (d. 392/1002) and Ibn al-Hajib gave an explanation of the causative na't without naming it, scholars such as Ebu’l-Bekā al-Ukbari (d. 616/1219) analyzed the subject under the title of causative adjective or causative na't, and Halid b. Abdullah al-Azhari discussed it under the title of al-wasf al-majazi. The subject of our study is to examine the handling of na't, which is one of the sentence elements in the Arabic language, in the works written on the field, its parts, the dimension that affects the meaning and the controversial aspects. The aim of the research is to examine the rules that Sibawayh deals with in his al-Kitâb on na'ta and the objections of later Arab linguists to these rules, and to contribute to the field by revealing different views on the subject. When dealing with manuscripts transmitting otherwise unknown ancient texts and without asubscriptio, the work of a philologist and literary critic becomes both more difficult and more engrossing. Definitive proof is impossible; at the end there can only be a hypothesis. When dealing with a unique grammatical text, such a hypothesis becomes even more delicate because of the standardization of ancient grammar. But it can happen that, behind crystallized theoretical argumentation and apparently canonical formulas, interstices can be explored that lead to (...) unforeseen possibilities, more exciting—and even more suitable—than those that have already emerged. Metaphors are emotionally engaging, influenc-ing the evaluation of arguments. The paper empirically in-vestigates whether metaphors in the premise can lead the evaluator to judge an ad hominem argument as sound when the arguer instead committed a fallacy. The results show that ad hominem arguments with conventional and positive metaphors are more persuasive compared to those with novel and negative metaphors. Arguments with conventional metaphors are also perceived as more am-biguous, but less convincing, and emotionally appealing. Additionally, participants believe in (...) the conclusion more when the premise contains a positive rather than a nega-tive metaphor, which instead helps the evaluator detect the fallacy. Résumé: Les métaphores sont émotionnellement engag-eantes et ainsi influencent l’évaluation des arguments. L'article étudie empiriquement si les métaphores em-ployées dans la prémisse peuvent amener l'évaluateur à juger un argument ad hominem comme solide bien que ce sophisme soit commis. Les résultats montrent que les ar-guments ad hominem utilisant des métaphores conven-tionnelles et positives sont plus convaincants que ceux utilisant des métaphores nouvelles et négatives. Les argu-ments utilisant des métaphores conventionnelles sont également perçus comme plus ambigus, mais moins con-vaincants et émotionnellement attrayants. De plus, les participants croient davantage à la conclusion lorsque la prémisse contient une métaphore positive plutôt que néga-tive, ce qui aide plutôt l'évaluateur à détecter le sophisme. (shrink)

The problems that arise from the presence of self-attacking ar- guments and odd-length cycles of attack within argumentation frameworks are widely recognized in the literature on defeasible argumentation. This paper introduces two simple semantics to capture different intuitions about what kinds of arguments should become justified in such scenarios. These semantics are modeled upon two extensions of argumentation frameworks, which we call sustainable and tolerant. Each one is constructed on the common ground of the powerful concept of admissibility introduced by (...) Dung in [10]. The novelty of this approach consists in viewing the admissibility of a subset of arguments as relative to potentially challenging subsets of arguments. Both sustainable and tolerant semantics are more credulous than preferred semantics (i.e. they justify at least the same arguments, and possibly more). Given certain sufficient conditions they coincide among them as well as with other semantics introduced by Dung. (shrink)

Newly accessible source material calls for a revision of our picture of the more technical transmission of sceptical epistemologies in the intellectual landscape of early Islam. Abū al‐Qāsim al‐Balkhīʼs (ninth/tenth century) Book of Doctrines shows that naẓar as the basic argumentative method of kalām is defined by the encounter with a broad spectrum of sceptical strategies. By the beginning of the tenth century, Greek traditions were amalgamated in a complex way with other intellectual traditions, most notably dualist ontologies. This situation (...) has shaped the evolution of kalām methodology decisively. Based on extensive paraphrases in Ibn al‐Malāḥimī (twelfth century) going back to Nawbakhtī (tenth century), it can be seen that arguments of the Greek sceptical tradition were accessible in Arabic in the early tenth century. The scarcity of coherent information on sceptical approaches before that time rather has to do with the problem that in general few sources of this earlier formative period of Islamic theology are preserved. Early Muʿtazilī treatises from this period are superseded by Ashʿarī texts in the later transmission. Sceptical approaches, being systematically involved in the very formation of early Muʿtazilī theology, are particularly invisible due to this process. (shrink)

A complex network of reciprocal relations connect arguments and stories. Arguments can occur in stories and stories can be parts of arguments. Further, stories can themselves be arguments. Whether a text or exchange serves as an argument partly depe nds on how we read it, i.e., on the story we tell about it and how well we argue for that story, but the circle is not as vicious as it appears. Metaphors are emotionally engaging, influenc-ing the evaluation of arguments. The paper empirically in-vestigates whether metaphors in the premise can lead the evaluator to judge an ad hominem argument as sound when the arguer instead committed a fallacy. The results show that ad hominem arguments with conventional and positive metaphors are more persuasive compared to those with novel and negative metaphors. Arguments with conventional metaphors are also perceived as more am-biguous, but less convincing, and emotionally appealing. Additionally, participants believe in (...) the conclusion more when the premise contains a positive rather than a nega-tive metaphor, which instead helps the evaluator detect the fallacy. Résumé: Les métaphores sont émotionnellement engag-eantes et ainsi influencent l’évaluation des arguments. L'article étudie empiriquement si les métaphores em-ployées dans la prémisse peuvent amener l'évaluateur à juger un argument ad hominem comme solide bien que ce sophisme soit commis. Les résultats montrent que les ar-guments ad hominem utilisant des métaphores conven-tionnelles et positives sont plus convaincants que ceux utilisant des métaphores nouvelles et négatives. Les argu-ments utilisant des métaphores conventionnelles sont également perçus comme plus ambigus, mais moins con-vaincants et émotionnellement attrayants. A shorthand symbolism for the relational mapping of categories is introduced and developed on the basis of Nelson Goodman's structural methodology. Through a reconstruction of extensional isomorphism that Goodman introduces as a criterion for definitional accuracy, and a brief reminder of the argument structure behind his ‘new riddle of induction’, Goodman's radical ontological relativism is turned into a protological principle of what I call ‘domain constituting philosophy’. MSS is demonstrated with reference to Goodman's symbol theory, particularly his notion of (...) exemplification, as well as in a final structured comparison of Frege's ‘sense’ with Goodman's straightforward construction of ‘secondary extension’. The post-classical (or post-Avicennan, post-Rāzian) genre of the “protocols for dialectical inquiry and disputation” (ādāb al-baḥth wa-l-munāẓara) has its more proximate origins in the famed Risāla of Shams al-Dīn al-Samarqandī (d. 722/1322). The greater part of his conceptions and methodology, however, consists in a streamlining and universalizing of the more strictly juristic dialectic (jadal / khilāf) of his teacher Burhān al-Dīn al-Nasafī (d. 687/1288); and this in turn draws on the highly logicized dialectic of Rukn al-Dīn al-ʿAmīdī (d. 615/1218) and (...) his teacher Raḍī al-Dīn al-Nīsābūrī (d. 617/1220). At the heart of methods in this lineage, and carried forward by al-Samarqandī into the universal ādāb al-baḥth, are three truth-preserving logical relationships critical to the truth-seeking enterprise of dialectic: entailment (talāzum / mulāzama), mutual negation or exclusion (tanāfin / munāfā), and causal concomitance (dawarān). The practical elaboration of these relations reveals a logic in action—a premodern dialogical logic for living disputation praxis. In fact, so critical were these to the dialectical enterprise that al-Samarqandī devoted a specialized treatise entirely to summarizing their defining features and rules, aptly naming it the ʿAyn al-Naẓar, or “Wellspring of Rational Investigation.” In this article, and drawing upon a recently published digital critical edition, I will present an analytical outline of these core logical relations as presented in the ʿAyn al-Naẓar. Then I will address a number of points of interest in this text, grouped under six themes: the potential for cross-disciplinary advancement; notions in discursive development; significant or uniquely contributive formulations; peculiarities of content; signs of an evolving, universalist agenda; and evidence that the ʿAyn al-Naẓar was designed as an aide-mémoire for the active disputant. The paper deals with the expression "God is able to make a calf from a tree-trunk"—a very popular phrase in medieval treatises, especially in the context of God's omnipotence. Its attestations are thoroughly documented and considered, contexts discussed, and attributions examined. It is argued that the attribution to Anselm of Canterbury is false and late. It is claimed that the phrase goes back to a popular saying as attested by William of Conches, Peter Comestor, and ps.-Bonaventurian Ars concionandi. Thus, it (...) is a rare example of a rustic proverb used in scholastic debates as a standard scholarly argument. (shrink)

English abstract: This paper discusses the delicate relationship between traditional epistemology and the increasingly influential probabilistic (or ‘Bayesian’) approach to epistemology. The paper introduces some of the key ideas of probabilistic epistemology, including credences or degrees of belief, Bayes’ theorem, conditionalization, and the Dutch Book argument. The tension between traditional and probabilistic epistemology is brought out by considering the lottery and preface paradoxes as they relate to rational (binary) belief and credence respectively. It is then argued that this tension (...) can be alleviated by rejecting the requirement that rational (binary) beliefs must be consistent and closed under logical entailment. Instead, it is suggested that this logical requirement applies to a different type of binary propositional attitude, viz. acceptance. (shrink)

This social phenomenon consists in the collective use of shared cognitive patterns based upon dichotomous schemati-zation of knowledge, values, and affection. We discuss the formative role of CSD on a community’s collec-tive cognition, identity, and public discourse, as well as the challenges it raises to reasoned argumentation, and how different approaches to argumentation undertake to face this obstacle to (...) the reasonable debate of issues of public concern. The rhetorical view suggests that the goal of factual ar- gumentation in legal proceedings is to persuade the fact-finder about the facts under litigation. However, R does not capture our social expecta- tions: we want fact-finders to know the facts justifying their decisions, and persuasion does not necessarily lead to knowledge. I want to present an epistemic theory of argumenta- tion honoring our expectations. Un- der my account, factual argumenta- tion aims to transmit knowledge to the fact-finder.

This research is founded on the fundamental hypothesis that a holistic perspective and general understanding play a decisive role in shaping the terminology of any discipline and organizing its components and subfields within a coherent methodological framework. Possessing such a holistic perspective and understanding is a key factor in determining the creativity, innovative approaches, and depth of expertise of scholars, as well as their ability to guide the discipline in accurate and constructive directions. The study explores this hypothesis in the (...) context of Hadith sciences, specifically focusing on Hadith criticism and the evidentiary value of narrations. It de-monstrates that Hadith scholars adopted a holistic view by considering the impact of thematic chapters (bab) in their criticism of Hadiths and their judgments regarding authenticity or rejection. This approach is evident in the classification of Hadith compilations, where Hadiths are arranged ac-cording to thematic chapters. Subsequently, each narration, Hadith, or chain of transmission (isnād) is evaluated in light of the established princip-les and evidence specific to these chapters, including other supporting pro-ofs. Over time, these principles and evidences became well-defined within each chapter, serving as essential criteria for assessing subsequent narrati-ons and scholarly interpretations.The research is structured around five main axes:1.The concept of thematic babs and their relationship with Hadith, inc-luding an analysis of their historical application by muhaddithūn in classifi-cation and methodological development.2.The impact of singularity (tafarrud) within Hadith chapters and the criteria for its acceptance or rejection.3.The relationship between solitary (āhād) Hadiths and singularity, and the significance of thematic categorization in this context.4.The role of thematic babs in evaluating discrepancies among narra-tors (rāwīs) and determining preferences.5.The influence of thematic babs on judging Hadiths as munkar or unacceptable.The study concludes by affirming the strong and intrinsic connection between the thematic categorization of Hadiths and Hadith criticism, emp-hasizing that this relationship constitutes a fundamental element in the judgments of critics regarding Hadiths. Additionally, it confirms the impact of thematic classification on the evaluation of narrators and the grading of Hadiths.The research highlights that neglecting the thematic context of Hadiths when examining narrators and their narrations has led later scholars (mu-ta’akhkhirūn) to methodological errors, diverging from the approaches of master Hadith critics and well-established jurists. Therefore, particular at-tention must be given to the meticulous classification employed by Hadith scholars, especially the authors of the Kutub al-Sittah, whose precision in categorization reflects a profound understanding of Hadiths and their cor-rect interpretation. Finally, the study underscores that the pinnacle of matu-rity and excellence in Hadith classification is particularly evident in the ar-rangement of authentic compilations, with Imam al-Bukhārī (d. 256/870) standing as a leading figure. His methodological rigor in the organization of the Sahīh and the profound insights derived from his use of chapter hea-dings (bab titles) exemplify an unparalleled model in this domain. (shrink)

This dissertation is an analysis of the development of dialectic and argumentation theory in post-classical Islamic intellectual history. The central concerns of the thesis are; treatises on the theoretical understanding of the concept of dialectic and argumentation theory, and how, in practice, the concept of dialectic, as expressed in the Greek classical tradition, was received and used by five communities in the Islamic intellectual camp. It shows how dialectic as an argumentative discourse diffused into five communities (theologicians, poets, grammarians, philosophers (...) and jurists) and how these local dialectics that the individual communities developed fused into a single system to form a general argumentation theory (adab al-bahth) applicable to all fields. I evaluate a treatise by Shams al-Din Samarqandi (d.702/1302), the founder of this general theory, and the treatises that were written after him as a result of his work. I concentrate specifically on work by Adud al-Din al-Iji (d.756/1355), Sayyid Sharif al-Jurjani (d.816/1413), Taşköprüzâde (d.968/1561), Saçaklızâde (d.1150/1737) and Gelenbevî (d.1205/1791) and analyze how each writer (from Samarqandi to Gelenbevî) altered the shape of argumentative discourse and how later intellectuals in the post-classical Islamic world responded to that discourse bequeathed by their predecessors. What is striking about the period that this dissertation investigates (from 1300-1800) is the persistence of what could be called the linguistic turn in argumentation theory. After a centuries-long run, the jadal-based dialectic of the classical period was displaced by a new argumentation theory, which was dominantly linguistic in character. This linguistic turn in argumentation dates from the final quarter of the fourteenth century in Iji's impressively prescient work on 'ilm al-wad'. This idea, which finally surfaced in the post-classical period, that argumentation is about definition and that, therefore, defining is the business of language—even perhaps, that language is the only available medium for understanding and being understood—affected the way that argumentation theory was processed throughout most of the period in question. The argumentative discourse that started with Ibn al-Rawandi in the third/ninth century left a permanent imprint on Islamic intellectual history, which was then full of concepts, terminology and objectives from this discourse up until the late nineteenth century. From this perspective, Islamic intellectual history can be read as the tension between two languages: the "language of dialectic" (jadal) and the "language of demonstration" (burhan), each of which refer not only to a significant feature of that history, but also to a feature that could dramatically alter the interpretation of that history. Computers may help us to better understand (not just verify) arguments. In this article we defend this claim by showcasing the application of a new, computer-assisted interpretive method to an exemplary natural-language ar- gument with strong ties to metaphysics and religion: E. J. Lowe’s modern variant of St. Anselm’s ontological argument for the existence of God. Our new method, which we call computational hermeneutics, has been particularly conceived for use in interactive-automated proof assistants. It aims at shedding light on (...) the meanings of words and sentences by framing their inferential role in a given argument. By employing automated theorem reasoning technology within interactive proof assistants, we are able to drastically reduce (by several orders of magnitude) the time needed to test the logical validity of an argu- ment’s formalization. As a result, a new approach to logical analysis, inspired by Donald Davidson’s account of radical interpretation, has been enabled. In computational hermeneutics, the utilization of automated reasoning tools ef- fectively boosts our capacity to expose the assumptions we indirectly commit ourselves to every time we engage in rational argumentation and it fosters the explicitation and revision of our concepts and commitments. Nick Bostrom’s Simulation Argument (SA) has many intriguing theological implications. We work out some of them here. We show how the SA can be used to develop novel versions of the Cosmological and Design Arguments. We then develop some of the affinities between Bostrom's naturalistic theogony and more traditional theological topics. We look at the resurrection of the body and at theodicy. We conclude with some reflections on the relations between the SA and Neoplatonism (friendly) and between the SA (...) and theism (less friendly). (shrink)

This chapter begins with an examination of Michael Dummett's influential treatment of the issues, which couples an attempt to identify a common form exemplified by a large, if not exhaustive, range of R/AR disputes with important arguments against a realist position about meaning which ‐ if they are sound. It also examines Dummett's diagnosis of what is at stake in those disputes is correct ‐ promise to resolve the issue in the anti‐realist's favor, not only in the theory of meaning (...) itself, but across the board. The chapter surveys the principal negative arguments, advanced by Dummett and others, for semantic anti‐realism. It explains the arguments on R/AR disputes more generally, and reviews doubts about the adequacy of Dummett's general conception of their common form. It reviews other ways in which the anti‐realist case may be prosecuted. It concludes with a brief examination of the new perspective on R/AR disputes advocated in recent work by Wright. (shrink)

Tidslogik är en gren av logiken som handlar om temporala begrepp, satser, argument och system. Inom denna gren av logiken undersöker man t.ex. uttryck såsom "Det kommer alltid vara fallet att", "Det kommer någon gång i framtiden vara fallet att", "Det har alltid varit fallet att", "Det var någon gång i det förflutna fallet att". Logiska relationer mellan satser som innehåller temporala begrepp studeras och giltigheten hos argument som består av sådana satser analyseras. I tidigare arbeten har jag (...) diskuterat hur tidslogiken kan betraktas som en form av multimodal logik. I den här uppsatsen visar jag hur tidslogiken kan beskrivas som en bimodal logik, ett slags modallogik som endast innehåller två typer av temporala operatorer. Den semantik jag använder är baserad på monotemporala ramar. En monotemporal ram är en relationell struktur som endast innehåller en primitiv tillgänglighetsrelation, nämligen relationen tidigare än / senare än. Jag utvecklar ett antal så kallade semantiska tablåsystem och bevisar att dessa är sunda och fullständiga i relation till deras semantik. (shrink)

Och ett multimodalt system är ett modalt system (av teorem) som är baserat på ett multimodalt språk. Multimodal logik är en gren av modallogiken som handlar om multimodala språk, semantiska teorier och system. I den här uppsatsen visar jag hur tidslogiken kan betraktas som en del av den multimodala logiken. Jag utvecklar ett antal så kallade semantiska tablåsystem och bevisar att dessa är sunda och fullständiga i relation till deras semantik. (shrink)

We pro-pose and test a solution whereby some el-ements of the Comprehensive Assess-ment Procedure for Natural Argumenta-tion (CAPNA) are modified to allow for the evaluation of (...) auditory arguments. The results of this approach are illus-trated with the help of a number of au-thentic examples. Résumé: Cet article aborde le problème de la façon d'identifier et d'évaluer les ar-guments présentés sous une forme non verbale. De tels arguments peuvent uti-liser des images, des sons ou une com-binaison de ceux-ci dans une présenta-tion véritablement multimodale. The relationship between Ars and Natura undergoes a manifest evolution from Aristotle to the medieval period and the time of Walter Burley. While Aristotle views all the possible complementarities between natural things and artificial things with regard to their perfection, the medieval commentators from Doctor planus and perspicuus on define artificialia in natural philosophy increasingly as perfect figures in actuality, divisible and with infinitely arrangeable parts. In Burley's works in particular, the products of art are likened to geometrical figures within (...) the structure of the continuous, such as lines, points and surfaces, and used as arguments against Ockham in their dispute over the ontology of indivisibles. Realists persuaded by indispensability arguments af- firm the existence of numbers, genes, and quarks. Van Fraassen's empiricism remains agnostic with respect to all three. The point of agreement is that the posits of mathematics and the posits of biology and physics stand orfall together. The mathematical Platonist can take heart from this consensus; even if the existence of num- bers is still problematic, it seems no more problematic than the existence of genes or quarks. If the two positions just described (...) were the only ones possible, there could be no objection to this melding of numbers with genes and quarks. However, the position I call contrastive empiricism (Sober 1990a) stands opposed to both realism and to Van Fraassen's em- piricism. As it turns out, contrastive empiricism entails that coalesc- ing mathematics with empirical science is highly problematic. I believe that there is an important kernel of truth in abductive ar- guments for genes and quarks. But no counterpart argument exists for the case of numbers. Of course, the existence of this third way would be uninteresting, if contrastive empiricism were wholly implausible. However, I will argue that contrastive empiricism captures what makes sense in standard versions of realism and empiricism, while avoiding the excesses of each. This third way is a middle way; it cannot be dismissed out of hand. (shrink)
