How do people respond to others' accidental behaviors? Reward and punishment for accidents might be depend on the actor's intentions, or instead on the unintended outcomes she brings about. Yet, existing paradigms in experimental economics do not include the possibility of accidental monetary allocations. We explore the balance of outcomes and intentions in a two-player economic game where monetary allocations are made with a "trembling hand": that is, intentions and outcomes are sometimes mismatched. Player 1 allocates $10 between herself and (...) Player 2 by rolling one of three dice. One die has a high probability of a selfish outcome, another has a high probability of a fair outcome, and the third has a high probability of a generous outcome. Based on Player 1's choice of die, Player 2 can infer her intentions. However, any of the three die can yield any of the three possible outcomes. Player 2 is given the opportunity to respond to Player 1's allocation by adding to or subtracting from Player 1's payoff. We find that Player 2's responses are influenced substantially by the accidental outcome of Player 1's roll of the die. Comparison to control conditions suggests that in contexts where the allocation is at least partially under the control of Player 1, Player 2 will punish Player 1 accountable for unintentional negative outcomes. In addition, Player 2's responses are influenced by Player 1's intention. However, Player 2 tends to modulate his responses substantially more for selfish intentions than for generous intentions. This novel economic game provides new insight into the psychological mechanisms underlying social preferences for fairness and retribution. (shrink)

Knowledge excludes luck. According to the received view, this intuition reveals that knowing is essentially modal in character. This paper demurs. Either knowledge does not exclude luck, or the entailment reveals nothing about its conceptual character. It is argued that knowledge excludesaccidentality, and that this notion is not modal but causal‐explanatory. There are three central tasks. The first is to explicate the concept of accident. The second is to argue that the concepts of luck and accident are “intensionally distinct,” which (...) is to say that no member of the intension of either holds on both. The third is to argue that an anti‐accident requirement on knowledge is preferable to an anti‐luck analogue on abductive grounds. (shrink)

According to genuine modal realism, some things (including numbers and properties) lack distinct counterparts in different worlds. So how can they possess any of their properties contingently? Egan (2004) argues that to explain such accidental property possession, the genuine modal realist must depart from Lewis and identify properties with functions, rather than with sets of possibilia. We disagree. The genuine modal realist already has the resources to handle Egan's proposed counterexamples. Foreknowledge arguments attempt to show that infallible and exhaustive foreknowledge is incompatible with creaturely freedom. One particularly powerful foreknowledge argument employs the concept of accidental necessity. But an opponent of this argument might challenge it precisely because it employs the concept of accidental necessity. Indeed, Merricks (Philos Rev 118:29–57, 2009, Philos Rev 120:567–586, 2011a) and Zagzebski (Faith Philos 19(4):503–519, 2002, Stanford Encyclopedia of Philosophy, 2011) have each written favorably of such a response. In this paper, I aim to show that (...) responding to the accidental necessity version of the foreknowledge argument by disputing the concept of accidental necessity, including doing so in the ways these authors do, does not constitute a successful response to the foreknowledge argument. This is because there is an only slightly modified but still well-motivated version of the foreknowledge argument which employs the notion of uncausability rather than accidental necessity; and this argument is not threatened by objections to the concept of accidental necessity, including those objections offered by Zagzebski and Merricks. As recent literature on the foreknowledge argument has emphasized, when a response to a foreknowledge argument fails to threaten an only slightly modified but still well-motivated version of that argument, the response in question is not successful. So the responses to the accidental necessity version of the foreknowledge argument I have mentioned are not successful. Moreover, those working on foreknowledge arguments more generally should take seriously the uncausability version of the foreknowledge argument articulated here, as it may well be that still more responses to the foreknowledge argument will not threaten it, either. It is usually assumed that the appearance of accidental degeneracy in the energy levels of a given Hamiltonian is due to a symmetry group. By considering the elementary problem of a rotator with spin-orbit coupling, when the strength of the latter is equal to the inverse of the moment of inertia, we find that this assumption does not explain the degeneracy of all the levels of the Hamiltonian. Thus the relation between accidental degeneracies and symmetry group merits further probing.

I examine a passage from Heidegger’s 1922 overview of a proposed book on Aristotle wherein he addresses the importance of Aristotle’s treatment of accidental (sumbebēkos) causes in the Physics II.4-6. My analysis shows that this passage plays a key role within the account of Aristotle’s ontology presented in the overview insofar as it allows Heidegger to open up a new way of reading Aristotle, one that both diagnoses and pushes through the inheritance of being understood as technē in order to (...) retrieve originary insights about the movement of factical human life, world, and care. Rather than subordinate tuchē and automaton (chance) to the four ‘real’ causes they would remain merely incidental to or derivative of, Heidegger asks that we recognize the priority of praxis, whose archē unfolds as care toward and within a world of accidents. In this paper, we present what we call the argument from accidental truth, according to which some instances of deflationist schemata, even those carefully reformulated and adjusted by Field and Horwich to accommodate the truth of utterances, are falsified due to accidental truths. Since the folk concept of truth allows for accidental truths, the deflationary theory of truth will face a serious problem. In particular, it follows that the deflationist schema fails to capture the proper extension of truth by precluding (...) accidental truths of utterances. Even though the argument uses the contextualist cases, this conclusion does not require so much as the truth of contextualism, but only two assumptions, the existence of context-relative non-literal contents of utterances (or speech acts), and the existence of accidental truths, both of which are widely accepted by folks and theorists. We will also consider various responses to the argument, including the revisionary deflationist position, all of which we argue are unsatisfactory or committed to a highly implausible view. (shrink)

This is an examination of Aristotle's notion of an "accidental being" -- something intermediate between a substance and a property. An accidental being (sometimes called "accidental compound" or "kooky object") is an ephemeral object, typically the compound of a substance and a property, that exists for only as long as its components are united. I set out the role that accidental beings play in Aristotle's solutions to several philosophical problems. I also investigate the similarity between these beings and the individual (...) non-substances of Aristotle's Categories. Finally, I propose that accidental beings can be assimilated into a more contemporary conceptual scheme as events -- the states or conditions that substances are in or undergo. (shrink)

My goal in this paper is to show that two theses that are widely adopted among Kantian ethicists are irreconcilable. The paper is divided into four sections. In the first, I briefly sketch the contours of my own positive view of Kantian ethics, concentrating on the issues relevant to the two theses to be discussed: I argue that agents can perform actions from but not in conformity with duty, and I argue that agents intentionally can perform actions they take to (...) be contrary to duty. In the second, I focus on Barbara Herman’s non-acci­dental rightness condition from “On the Value of Acting from Duty.” In the third, I focus on Christine Korsgaard’s guise of the objectively good from “Formula of Humanity.” In the fourth, I explain why the positions developed by Herman and Korsgaard are irreconcilable and I make a suggestion about how to move forward. IntroductionIn highly developed countries, as many as 16 percent of children are physically abused each year. Traumatic brain injury (TBI) is the most common injury in non-accidental trauma (NAT) and is responsible for 80 percent of fatal NAT cases, with most deaths occurring in children younger than three years old. Cases of abusers who refuse withdrawal of life-sustaining medical treatment (LSMT) to avoid criminal charges have previously been reported. Therefore, we hypothesized that NAT is associated with a lower risk for (...) withdrawal LSMT in pediatric TBI.MethodsThe pediatric Trauma Quality Improvement Program database was analyzed (2014 to 2016) for patients aged 16 and younger with TBI and Glasgow Coma Scale (GCS) of 8 and lower on admission. Patients with a head Abbreviated Injury Scale (AIS) of 2 or less or who died within 48 hours were excluded. A multivariable logistic regression model was used for analysis.ResultsOf 2,209 TBI patients, 92 (4.2 percent) had withdrawal of LSMT. Compared to those without withdrawal of LMST, those with LMST had statistically similar median age (three years of age versus seven years, p = 0.07) and a higher rate of NAT (33.7 percent versus 13.5 percent, p < 0.001). The most common specified perpetrator was a father/stepfather/ male partner (70 percent). After adjusting for covariates, factors associated with higher risk for withdrawal of LSMT included age of less than three years (OR 2.38, CI 1.34-4.23, p < 0.05) and NAT (OR 1.86, CI 1.02-3.41, p < 0.05).ConclusionNAT is associated with increased risk for withdrawal of LSMT in pediatric TBI. Age of less than three years is similarly associated with a higher risk for withdrawal of LSMT. Future research in this population is needed to determine what other factors predict withdrawal of LSMT and what resources, such as social workers and/or ethics consults, are utilized. (shrink)

In the Anthropocene, the fact that human activity is enmeshed with the existence and actions of every kind of other being is inescapable. As a result, the planetary ecological crisis has brought forth an urgent need to rethink understandings of human action. One response holds that the transformations necessary to tackle today’s crises will emerge from the distinctive capacity of human beings to transcend their environment. Another school of thought calls for seeing action as composite, produced by distributed networks of (...) human and nonhuman agents. Yet the first of these is open to charges of human exceptionalism, while the second, according to its critics, lacks effective political traction. Martin Crowley argues that a new conception of political agency is necessary to break this impasse. Engaging with thinkers such as Bruno Latour, Bernard Stiegler, and Catherine Malabou, Crowley proposes an original account of agency as both distributed and decisive. Challenging the prevailing view of agency as exclusively human, he explores how a politics that incorporates nonhuman agency can intervene in the real world, examining timely issues such as climate-related migration and digital-algorithmic politics. A major intervention into ongoing debates in posthumanism, political ecology, and political theory, Accidental Agents reshapes our understanding of political agency in and for a more-than-human world. The distinction between the essential and the accidental characteristics of a thing should be understood not in modal terms (the received view) nor in definitional terms (Fine’s recent proposal) but as follows: an essential characteristic of a thing is one that is not explained by any other of that thing’s characteristics, and an accidental characteristic of a thing is one that is so explained. Various versions of this proposal can be formulated.

In this paper I argue that the disagreement between modern moral philosophers and (some) virtue ethicists about whether motive affects rightness is a result of conceptual disagreement, and that when they develop a theory of ‘right action,’ the two parties respond to two very different questions. Whereas virtue ethicists tend to use ‘right’ as interchangeable with ‘good’ or ‘virtuous’ and as implying moral praise, modern moral philosophers use it as roughly equivalent to ‘in accordance with moral obligation.’ One implication of (...) this is that the possibility of an act being right by accident does not pose a problem for consequentialism or deontology. A further implication is that it reveals a shortcoming in virtue ethics, namely that it does not—yet needs to—present an account of moral obligation. (shrink)

I offer a new analysis of Aristotle's concept of an accidental cause. Using passages fromMetaphysics Δ and Ε, as well as Physics II, I argue that accidental causes are causally inert. After defending this reading against some objections, I draw some conclusions about Aristotle's basic understanding of causation.

This book is a survey of the range of apparently miraculous accidents of nature that have enabled the universe to evolve its familiar structures (atoms, stars, galaxies, and life itself) concludes with an investigation of the so-called anthropic principle.

Why are de se mental states essential? What exactly is their de se-ness needed to do? I argue that it is needed to fend off accidentalness. If certain beliefs – for example, nociceptive, proprioceptive or introspective beliefs – were not de se, then any truth they achieved would be too accidental for the subject to count as knowing. If certain intentions – intentions that are in play whenever we intentionally do anything – were not de se, then any satisfaction they (...) achieved would be too accidental for the subject to count as intentionally acting. How states hook on to their referent is relevant in a systematic but underexplored way to whether they non-accidentally achieve their aim – truth in the case of beliefs, satisfaction in the case of intentions. In the relevant cases, the way of hooking on to a referent needed to avoid being accidental is the way a de se state hooks on to its referent. (shrink)

In mid-twentieth-century Mexican philosophy, there was a peculiar nationalist existentialist project focused on the cultural conditions of agency. This article revisits some of those ideas, including the idea that there is an important but underappreciated experience of one's relationship to norms and social meanings. This experience—something called accidentality—casts new light on various forms of social subordination and socially scaffolded agency, including cultural alienation, biculturality, and double consciousness.

Transferred malice, or transferred intent, is the criminal doctrine that states that if D tries to kill A, and accidentally kills B, the intent to kill transfers from A to B, and so D is guilty of murdering B. This is widely viewed as a useful legal fiction. One of the finest essays on this topic was written by our honorand, Douglas N. Husak. Husak views both the potential usefulness of, and his preferred alternative to, transferred malice through the lens (...) of sentencing – how much hard treatment the offender will receive. In this essay, I take a step back and ask in what ways transferred malice might be useful. I find its potential usefulness is not restricted to sentencing, but thinking about other ways in which it might be useful actually brings other potential drawbacks into focus – in particular, I argue, transferred malice mislabels the crimes the offender committed, and does so in a way that erases one of the victims from the moral description of the crime. In this article I formulate a skeptical argument against the possibility of adhering to the divine will in a non-accidental way. In particular, my focus in the article is on a widely embraced modal condition of accidentality, according to which non-accidentality has to do with a person manifesting dispositions that result in a given outcome in a modally robust way. The skeptical argument arises from two observations: first, various authors in the epistemology of religion have argued that it is often (...) not possible to reason reliably about religious matters, and second, non-accidentally adhering to a given norm is often associated with reasoning about the requirements of the norm in question in a reliable way. In addition to pointing out the existence of the argument, I outline strategies in which religious thinkers could reasonably challenge it by denying that reliable reasoning about the requirements of divine will is necessary for adhering to it in a non-accidental manner. Hence, I argue that the possibility of non-accidental adherence to the divine will does not depend solely on whether it is possible to reliably reason about what it requires one to do. (shrink)

This article focuses on emergency medical care in black urban populations, suggesting that the classification of a "community" within clinical trial language is problematic. The article references a cultural history of black Americans with pre-hospital emergency medical treatment as relevant to contemporary emergency medicine paradigms. Part I explores a relationship between "autonomy" and "community." The idea of community emerges as a displacement for the ethical principle of autonomy precisely at the moment that institutionalized medicine focuses on diversity. Part II examines (...) a clinical trial for the blood substitute PolyHeme® (Northfield Laboratories, Inc., Evanston, IL). It illustrates the ways in which bias in research paradigms and Institutional Review Board decisions attach to the notion and utility of the language of "community." The conclusion's contemporary anecdote makes apparent the vitality of the issues of prehospital emergency medical care and the ways in which decisions and practices fall too easily into a narrative of culturally biased treatment. Nowadays the traditional quest for certainty seems not only futile but pointless. Resisting skepticism no longer seems to require meeting the Cartesian demand for an unshakable foundation for knowledge. True beliefs can be less than maximally justified and still be justified enough to qualify as knowledge, even though some beliefs that are justified to the same extent are false. Yet a few philosophers suggest that there is a special sort of justification that only true beliefs can have. Call it 'full (...) justification' or simply 'warrant.' One such philosopher is Trenton Merricks. He takes warrant to be "that, whatever precisely it is, which together with truth makes the difference between knowledge and mere true belief," and argues that only true beliefs can have it.1 In his view, then, warrant makes the difference between knowledge and mere belief. Interestingly, Merricks does not concern himself with the nature of this remarkable property. He prefers a "formal characterization" of warrant as the "gap filler" between knowledge and mere true belief. Whatever warrant is exactly, a warranted belief cannot be true accidentally, for then the belief would not qualify as knowledge. (shrink)

Denner I ART'S ABILITY TO INFECT another with an emotion, the concept that has come to be probably the most readily identified catchphrase in What Is Art? (though it crops up in his earlier writings on art), derives from L. N. Tolstoy's dynamic identity claim about art: we know an artist has (...) created a genuine work of art when he "hands on to others feelings he has lived through, and that others are infected by these feelings and also experience them." 1 "What is art?" is then a taxonomical question, and, according to Tolstoy, art is identifiable from non-art not by some set of external characteristics—the way, say, Aristotle categorized animals in his natural history—rather art is recognizable by its function, by what it does. In this sense art is like a tool: A given thing is art because it performs a certain task, much as one might claim a screwdriver is anything that sets and removes screws, regardless of its external characteristics. Tolstoy, in fact, repeatedly refers to art as "orudie," "a tool," or even "a weapon."It is worth noting from the outset that this metaphor of contagiousness is one of sublimated violence. For its passive "perceiver" (Tolstoy's characteristic term for the consumer of art), art amounts to irresistible, surreptitious emotional manipulation by an external entity. Tolstoy is ever attentive to the underlying meanings of the words he chooses, and I think he means to emphasize the latent, etymological meaning of the zarazit', to infect, the root of which is razit', to strike, a military term that likely resonated with Tolstoy, a war veteran. 2 Etymological arguments aside, Tolstoy makes explicit the psychological violation that goes hand-in-hand [End Page 284] with the experience of a work of art in a diary entry from a period of work on an earlier variant of What Is Art?: "One must hone the artistic work so that it penetrates. To hone a work means to make it perfect artistically, in which case it will pierce through the indifference...." 3 In an earlier version of the essay, Tolstoy offers "hypnotism" as a synonym for infection (p. 53).With its ability to "penetrate" through indifference and colonize, willy-nilly, the other, art accomplishes directly and immediately what no amount of rational argument could accomplish: "Art is differentiated from the activity of rational activity, which demands preparation and a certain sequence of knowledge (so that one cannot learn trigonometry before knowing geometry), by the fact that it acts on people independently of their state of development and education, that the charm of a picture, of sounds, or of forms, infects any man whatever his plane of development" (p. 178).The effect of art does not depend on some graduated, sequential process as it does for rational activity: art's infectiousness is immediate and irresistible. Operational definitions of biological altruism in terms of actual fitness exchanges will not work because they include accidental acts as altruistic and exclude altruistic acts that have gone awry. I argue that the definition of biological altruism should contain an analogue of the role intention plays in psychological altruism. I consider two possibilities for this analogue, selected effect functions and the proximate causes and effects of behavior. I argue that the selected-effect function account will not work because it confuses the (...) explanation of some altruistic behavior with the definition of all of it and the information needed to justify a selected effect account of function is too often inaccessible. Close attention to the proximate explanations of a behavior is all that is needed to determine if an act is biologically altruistic, returning biological altruism to descriptive ethology, where it belongs. Following in the hylomorphic tradition of Aristotle, Thomas Aquinas holds that all material substances are composed of matter and form. Like Aristotle, Aquinas also recognizes two different types of forms that material substances can be said to possess: substantial forms and accidental forms. Of which form or forms, then, are material substances composed? This paper explores two competing models of Aquinas’s ontology of material substances, which diverge on precisely this issue. According to what the author refers to as the “Standard (...) Model,” Aquinas’s view is that a material substance is composed of prime matter and substantial form. According to the “Expanded Model,” Aquinas’s view is that a material substance is composed of prime matter, substantial form, and all of its accidental forms. After outlining the main claims of each of the two competing models and considering two arguments in favor of the Standard Model, the author offers two arguments in favor of the Expanded Model. He argues that, given the way in which Aquinas argues for God’s simplicity in question three of the Prima pars, and the way in which he consistently describes the difference between an essence and a suppositum, or individual substance, throughout his works, there is good reason to believe that Aquinas thinks that the accidental forms of a material substance are included among its metaphysical parts. A series of experiments was performed in which subjects indicated whether two four-dot patterns were the same, although possibly viewed from different directions, or different, paired at random. Analyses of responses times and error rates suggest that the subjects' performance in this affine matching task is based on non-accidental properties such as convexity, parallelism, collinearity, and proximity, rather than on real affine invariants such as the ratio of triangular areas.

The Proper Functionist account of warrant – like many otherexternalist accounts – is vulnerable to certain Gettier-style counterexamples involving accidentally true beliefs. In this paper, I briefly survey the development of the account, noting the way it was altered in response to such counterexamples. I then argue that Alvin Plantinga's latest amendment to the account is flawed insofar as it rules out cases of true beliefs which do intuitively strike us as knowledge, and that a conjecture recently put forward by (...) Thomas Crisp is also defective. I conclude by presenting my own suggestion as to how the account can be made less vulnerable to counterexamples involving accidentally true beliefs. Although I stay within the confines of Proper Functionism here, I think that my proposal (modulo a few details) could be attached to other externalist accounts of warrant as well. -/- . (shrink)

In this paper, I present a novel argument for scepticism about moral responsibility. Unlike traditional arguments, this argument doesn’t depend on contingent empirical claims about the truth or falsity of causal determinism. Rather, it is argued that the conceptual conditions of responsibility are jointly incompatible. In short, when an agent is responsible for an action, it must be true both that the action was non-accidental, and that it was open to the agent not to perform that action.
