Gadamer's book extends and codifies the main hermeneutical concepts of Bultmann, Heidegger, and their adherents, and can be considered a summa of what Robinson calls "The New Hermeneutic." By Robinson and other theologians, and by Continental literary critics, Wahrheit und Methode has been welcomed as a philosophical justification for "vital and relevant" interpretations that are unencumbered by a concern for the author's original intention. On this point "The New Hermeneutic" reveals its affinities with "The New Criticism" and the newer "Myth (...) Criticism." All three have impugned the author's prerogative to be the determiner of textual meaning. Gadamer, however, grounds his anti-intentionalism only partially in aesthetics and not at all in the collective unconscious but primarily in the radical historicism of Martin Heidegger. (shrink)

This book traces the historical lineages of Alvin Plantinga’s religious epistemology from Plato through Augustine and Calvin. It focuses upon this epistemology as a philosophical interpretation of what is generally taken to be a narrow theological doctrine. The author provides a textually based and closely reasoned introduction to the epistemological ideas of Plato, Augustine, Calvin, Plantinga, and several other writers and shows the continuity of a certain approach to the knowledge of God; it may be called the Platonic—Augustinian—Reformed approach.

We suggest that philosophical accounts of epistemic effects of diversity have given insufficient attention to the relationship between demographic diversity and information elaboration, the process whereby knowledge dispersed in a group is elicited and examined. We propose an analysis of IE that clarifies hypotheses proposed in the empirical literature and their relationship to philosophical accounts of diversity effects. Philosophical accounts have largely overlooked the possibility that demographic diversity may improve group performance by enhancing IE, and sometimes fail to explore the (...) relationship between diversity and IE altogether. We claim these omissions are significant from both a practical and theoretical perspective. Moreover, we explain how the overlooked explanations suggest that epistemic benefits of diversity can depend on epistemically unjust social dynamics. (shrink)

This essay compares two philosophical proposals concerning the relation between values and science, both of which reject the value-free ideal but nevertheless place restrictions on how values and science should interact. The first of these proposals relies on a distinction between the direct and indirect roles of values, while the second emphasizes instead a distinction between epistemic and nonepistemic values. We consider these two proposals in connection with a case study of disputed research on the topic of environmental justice and (...) argue that the second proposal has several advantages over the first. The argument from inductive risk attempts to show that practical and ethical costs of errors should influence standards of evidence for accepting scientific claims. A common objection charges that this argument presupposes a behavioral theory of acceptance that is inappropriate for science. I respond by showing that the argument from inductive risk is supported by a nonbehavioral theory of acceptance developed by Cohen, which defines acceptance in terms of premising. Moreover, I argue that theories designed to explain how acceptance can (...) be guided exclusively by epistemic values suffer from difficulties that do not afflict Cohen’s theory. (shrink)

A concept of diversity is an understanding of what makes a group diverse that may be applicable in a variety of contexts. We distinguish three diversity concepts, show that each can be found in discussions of diversity in science, and explain how they tend to be associated with distinct epistemic and ethical rationales. Yet philosophical literature on diversity among scientists has given little attention to distinct concepts of diversity. This is significant because the unappreciated existence of multiple diversity concepts can (...) generate unclarity about the meaning of “diversity,” lead to problematic inferences from empirical research, and obscure complex ethical-epistemic questions about how to define diversity in specific cases. We illustrate some ethical-epistemic implications of our proposal by reference to an example of deliberative mini-publics on human tissue biobanking. (shrink)

I argue for a conciliationist treatment of peer disagreement, on the grounds that the evidence that non-conciliatory theorists point to--the evidence that conciliatory-friendly independence principles would rule out--bears a troubling relation to accuracy. Namely, we can anticipate that trying to respond to it is a bad deal with respect to our expected accuracy. I consequently argue that we shouldn't try to respond to it. Instead we should ignore it, and be conciliationists.

The Reputation of Justice Oliver Wendell Holmes, Jr., one of the chief architects of twentieth century American law, has gone through a number of phases, changing from being altogether praiseworthy in the last years of his life and the first years after his death in 1935 to that of more sober evaluations. Writing at mid-century Henry Steele Commager offered the judgment that Holmes had had about him “much of the Olympian [and] something of the Mephistophelean.” The most useful account of (...) how the winds of change swept along Holmes' reputation is an article by G. Edward White, “The Rise and Fall of Justice Holmes,” which appeared in the University of Chicago Law Review in 1971. White examined the myth of Justice Holmes as it obtained from 1932 to 1940 and then proceeded to describe the demythologizing of Holmes from 1941 through 1949. (shrink)

Kevin Elliott and Dan McKaughan argue that, in some cases, nonepistemic values provide legitimate reasons for scientists to accept an epistemically inferior option, a claim that they support with two case studies. This essay argues that Elliott and McKaughan have not shown that their case studies are indeed ones in which an epistemically inferior option was accepted. Specifically, their interpretation of these cases depends on problematic premises that it is epistemically better to wait for a slower-but-more-reliable method than to accept (...) the result of a quicker-but-less-reliable one and that a more detailed model is epistemically preferable to a simpler one. In this paper we shall answer some questions in the set theory of L, the universe of all sets constructible from the reals. In order to do so, we shall assume ADL, the hypothesis that all 2-person games of perfect information on ω whose payoff set is in L are determined. This is by now standard practice. ZFC itself decides few questions in the set theory of L, and for reasons we cannot discuss here, ZFC + ADL yields the most (...) interesting “completion” of the ZFC-theory of L.ADL implies that L satisfies “every wellordered set of reals is countable”, so that the axiom of choice fails in L. Nevertheless, there is a natural inner model of L, namely HODL, which satisfies ZFC.. The superscript “L” indicates, here and below, that the notion in question is to be interpreted in L.) Supervised injectable opioid assisted treament prescribes injectable opioids to individuals for whom other forms of addiction treatment have been ineffective. In this article, we examine arguments that opioid-dependent people should be assumed incompetent to voluntarily consent to clinical research on siOAT unless proven otherwise. We agree that concerns about competence and voluntary consent deserve careful attention in this context. But we oppose framing the issue solely as a matter of the competence of opioid-dependent people and emphasize that it should be (...) considered in the context of inequities in access to siOAT as a medical treatment. Consequently, we suggest that bioethics literature on nonexploitation, which focuses on clinical research in low-income countries, is helpful due to locating ethical issues within systemic social conditions. Finally, we consider the implications of our argument for the ethics of clinical research on siOAT. (shrink)

The likelihood principle (LP) is a core issue in disagreements between Bayesian and frequentist statistical theories. Yet statements of the LP are often ambiguous, while arguments for why a Bayesian must accept it rely upon unexamined implicit premises. I distinguish two propositions associated with the LP, which I label LP1 and LP2. I maintain that there is a compelling Bayesian argument for LP1, based upon strict conditionalization, standard Bayesian decision theory, and a proposition I call the practical relevance principle. In (...) contrast, I argue that there is no similarly compelling argument for or against LP2. I suggest that these conclusions lead to a restrictedly pluralistic view of Bayesian confirmation measures. (shrink)

A significant number of inmates with mental illness reside within the New York State Department of Corrections (NYSDOCS). New York State has taken the initiative to provide mentally ill inmates with necessary services through a collaboration of the New York State Department of Correctional Services and the New York State Office of Mental Health (NYSOMH). The collaboration results in a mental health delivery system that provides many essential services to mentally ill inmates. This paper focuses on the organization of mental (...) health services within NYSDOCS, best practices, past and current litigation, and staff responsibilities. As the population of mentally ill inmates continues to grow, implications for the Human Services professions of OMH and DOCS needs to continue to address and provide adequate mental health care and resources for this special population. In 1966 the Brazilian physicist Klaus Tausk (b. 1927) circulated a preprint from the International Centre for Theoretical Physics in Trieste, Italy, criticizing Adriana Daneri, Angelo Loinger, and Giovanni Maria Prosperi`s theory of 1962 on the measurement problem in quantum mechanics. A heated controversy ensued between two opposing camps within the orthodox interpretation of quantum theory, represented by Leon Rosenfeld and Eugene P. Wigner. The controversy went well beyond the strictly scientific issues, however, reflecting philosophical and political commitments within the (...) context of the Cold War, the relationship between science in developed and Third World countries, the importance of social skills, and personal idiosyncrasies. The dilemma objection charges that ‘weak’ versions of the precautionary principle (PP) are vacuous while ‘strong’ ones are incoherent. I respond that the ‘weak’ versus ‘strong’ distinction is misleading and should be replaced with a contrast between PP as a meta-rule and PP proper. Meta versions of PP require that the decision-making procedures used for environmental policy not be susceptible to paralysis by scientific uncertainty. Such claims are substantive because they often recommend against basing environmental policy decisions on cost–benefit analysis. (...)
