This article offers a descriptive and analytic view of the different stages leading to the constitution of a corpus that is representative of the issues of climate and energy justice. Overall, the corpus contains over five million words and gathers reports, newsletters and web-pages dealing with the most equitable ways of moving to a low-carbon future in the aim of limiting climate change. It can be divided into six sub-corpora, according to types of discourse communities, and methods of constitution. (...) We begin by presenting the small Do It Yourself (DIY) corpora which were used as a starting point. Three discourse communities were selected to observe possible variation in their treatment of the issue: Non-Governmental Organisations (NGOs), United-Nation institutions, and the Renewable Energy Sector (RES). The sources are selected according to author, date, keywords in title. Using the concordance Antconc and WMatrix software we test the reliability of the corpora for their thematic content, terminology and lexical unit classification. Our first results enable us to confirm variation between the discourse communities. The discrepancy in sizes and the time-consuming nature of the initial DIY corpus constitution lead us to use BootCat to extend them, using keywords from the corpora as seeds to retrieve and download webpages. We thus contrast a more traditional approach to corpus building to web-as-corpus data gathering methods. We compare the results found in the BootCat corpora to test if they are as specific as those in the DIY corpora. This enables us to draw conclusions on the possible uses and advantages of relatively small corpora for the study of specialised discourse. (shrink)

Ever since language has been examined as a vehicle for action, scholars have been interested in its authorized use. Typically described under the rubric of `felicity conditions', the authorized use of language involves, among other conditions, the right or authority of a member to engage in, or deploy, some named action. This paper begins by examining how participants authorize the discourse of a co-interactant in one specialized setting: a live news broadcast. I argue that the successful exploitation by a (...) reporter of his/her right to authoritatively describe a scene all are witnessing rests in part on the displayed mutual orientation of his or her co-interactants to that right through the local, contingently achieved deployment of complex discursive practices. After exploring the special case of live news broadcasts, I link this study to other studies of mass media that have explored the link between discursive practices in news broadcasts and reportorial authority. Finally, I argue that the resources I have identified have a more general provenance than live news broadcasts, and reflect on the relation between these findings and recent discussions that explore the authorized use of language. To prevent domains from cyber-piracy, the WIPO offers private and confidential procedures tasked to address the legitimate use of a domain name. WIPO domain name arbitration consists of an alternative dispute resolution process in which one or more panelists make a binding decision over the legitimacy of a domain. This article investigates the structure of the discourse of this professional genre. Following Maley, this study focuses, first, on spotting the generic moves of WIPO domain name arbitration decisions. Second, the (...) analysis unveils patterns shaping WIPO domain name arbitration decisions, hence exploring how discursive features work within this specialized discourse. Third, it examines whether corpus data reveal that this type of professional discourse has entered into a process of standardization. The study is based on Bhatia’s multi-perspective four-space model of discourse. In a knowledge-based economy of the globalizing economic order, the role of regions is very significant in order to create and to disperse knowledge. Particularly, geographical clusters of firms in a single sub-national region may contribute to transmitting certain kinds of knowledge between and among firms. In addition, markets prefer to favor specialized firms with a coherent body of knowledge when knowledge creation and the use of new knowledge become increasingly important for maintaining and improving a firm’s competitiveness. Therefore, regional (...) policy makers may not interfere directly with markets and firms when the process of globalization pushes national economies into a world of learning and innovation. The reason is that the institutional framework for market exchange favors knowledge exchange in a globalizing economic system. This paper argues how East Asian science cities such as Tsukuba Science City in Japan, Daedeok Innopolis in South Korea, Hsinchu Science-based Industrial Park in Taiwan, and Zhongguancun Science Park in China have been developed in order to create technology innovation as well to contribute to national and regional economic growth. Moreover, it also focuses on their competitiveness and the further development strategy that aims to become global science cities. Sir Joshua Reynolds RA FRS FRSA (1723-1792) was an important and influential 18th century English painter, specialising in portraits and promoting the "Grand Style" in painting which depended on idealisation of the imperfect. Showing an early interest in art, Reynolds was apprenticed in 1740 to the fashionable portrait painter Thomas Hudson, with whom he remained until 1743. From 1749 to 1752, he spent over two years in Italy, where he studied the Old Masters and acquired a taste for the "Grand (...) Style." Unfortunately, whilst in Rome, Reynolds suffered a severe cold which left him partially deaf and, as a result, he began to carry a small ear trumpet with which he is often pictured. From 1753 until the end of his life he lived in London, his talents gaining recognition soon after his arrival in France. He was one of the founders and first President of the Royal Academy. George III appreciated his merits and knighted him in 1769. He was one of the earliest members of the Royal Society of Arts, helped found the Society of Artists, and, with Gainsborough, established the Royal Academy of Arts as a spin-off organisation. Since the revolution in philosophic method that began about a century ago, the focus of philosophic attention has been on language as used both in daily conversation and in specialized institutional activities such as science, law, and the arts. But language is an extremely complex and varied means of communication, and the study of it has been increasingly incorporated into such empirical disciplines as linguistics, psycho linguistics, and cognitive psychology. It is becoming less clear what aspects of language remain as (...) proper subjects of philosophical study, what are to be "kicked upstairs" (J. L. Austin's phrase) to the sciences. This work is a study of those logical features of language that remain central to philosophy after completion of kicking up. It conducts this study by describing similarities and differences between signs at differing levels, starting with natural events as primitive signs in the environments of their interpreters, and proceeding to pre linguistic signaling systems, elementary forms of language, and finally to the forms of specialized discourse used within social institutions. The investiga tion of comparative features requires isolating basic mental capacities that are present in the most primitive forms of organisms capable of sign interpretation. The problem then becomes one of tracing the emergence from these capacities of such categories as substance, attribute or quality, and quantity that we apply to natural languages. The study of sign levels is thus the construction of a genealogy of logical categories marking the develop ment of natural languages. (shrink)

Considering the overwhelming amount of media products that we are subjected to in the 21stcentury and the way in which those inevitably influence our perception of reality, this research pays specific attention to the role of the media in the construction and enhancement of stereotypes in everyday life, via the language or, more specifically, specialized languages. In particular, this paper aims to investigate an American legal TV series in order to analyze the way in which legal English is used in (...) dialogues. The major research questions are: to what extent such a kind of specialized discourse may be really understood by the greater audience? How does legal drama participate in the shaping of stereotypes relating to the legal environment in the country where it is produced, and cross-culturally, bearing in mind the prominence of “made in the USA” products in the television programming across the world? Ultimately, in the light of the previous questions, should the growing field of research in audiovisual translation extend its investigation into the area of legal English? Taking into consideration the seminal work of Pedersen and Diaz Cintas in the field of Audiovisual Translation, the study will examine the subtitling techniques employed for this atypical genre. Through the analysis of a corpus comprising several dialogues from a collection of episodes of the legal show Reckless, the paper will mostly focus on gender representations and their most common linguistically enhanced stereotypes. This book offers an analysis of the ways a linked set of ethico-political concepts - responsibility, rights, freedom, equality, and justice - might be re-thought, in view of the linguistic deconstruction of their underlying principle, the individual human subject. In a series of readings of contemporary thinkers and their philosophical antecedents the author argues that an encounter with the difficulties of reading language, precisely what resists the immediate comprehension or mastery of a subject, enables in turn a new thought of (...) rights and responsibility. The book is driven by a sense that literary and theoretical questions, and the ideas or concepts they appeal to or provoke, play a critical role in the way we think about and experience politics. Cooperative discourse procedures produce consensual siting proposals for NIMBY-projects-but only if these proposals do not affect the final siting decision. Then, the members of the discourse commissions stay independent and face few incentives to pursue consequentialist interests. However, the more influential discourse procedures become, the stronger the interest groups’ incentives are to take advantage of them. Thus, cooperative discourses turn into competitive, interest-centred procedures whose outcome is rejected by the less influential groups. The evolution of discourse (...) procedures into functionally specialized parliaments or even into FOCJ (Functional, Overlapping, Competing Jurisdictions) seems worth pursuing. (shrink)

In the critical assessment of the rise of what Jameson has termed the modern centred subject … the lived experience of individual consciousness as a monadic and autonomous centre of activity, significant attention has been devoted to the impact of the institutions of the late eighteenth century ‘bourgeois cultural revolution’ such as the family and the school. Less consideration has been given in this history of regulated subjectivity to the emergence within key centres of cultural production of the discourse (...) of maternity and its lasting consequences for the understanding and representation of the mother–child bond as a matrix of both affectional relations and infant development. The late eighteenth century reconfiguration of the family as, in Jameson's words a private space within the nascent public sphere of bourgeois society intensified the ‘separation of the spheres’ begun in the early modern period and further formalised the zoning of the domestic experience as the defining site of emotional specialisation and individual growth. In the culture of early romanticism, this differentiation of domestic roles elevated children as the primary objects of a new regime of intergenerational care, replacing disciplinary control with intimate nurture and valorising a particular construction of motherhood as the ethical base of domestic piety and social stability beyond even the semantic reach of reason. Understanding the cultural processes by which this important ideological shift reshaped the paradigm of parent–child relations in industrial society – radiating beyond the realm of the family into the wider systems of childcare and education – enables us better to discern its continuing influence on perceptions of family life and motherhood today and to critically evaluate its potential contribution to changing conceptions of the place of the family in contemporary democratic society. March 2020 has become a moment of change in communication mode and quality. Previously, the media paid attention to the current affairs, however, never earlier the journalistic discourse has been so influentially affected by the ongoing phenomenon as in the case of COVID-19. Almost overnight the new terminological phenomena with specific legal or medical reference were introduced into everyday language mainly via mass media and become an important part of a pandemic related narration. The strong influence on the shape (...) of the mentioned linguistic changes has mainly the adoption of new legal regulations due to the unexpected outbreak of the pandemic. The aim of the following paper is to investigate how COVID-19 pandemic affected the specialisation of the journalistic discourse and how different domains are being influenced by new terminology and in other way round, how for example law and medicine influence new “COVID language”. In order to take the interdisciplinary nature of the issue into account, the degree of hybridity of the selected texts will be examined by means of selected material analysis. The methodology applied in the paper uses an empirical approach and comparative analysis. The material used for the analysis comes from the selected Polish quality and boulevard press. The paper concerns the linguistic influence of the “invisible enemy” on the language presented in press. The main findings reveal the intense use of neologisms, borrowings, and it shows that the discourse was changed linguistically thanks to Student’s t-test. (shrink)

Scientific knowledge is no longer transmitted solely through a one-way channel of communication from scientific communities to `lay' readers through the knowledge transmission `chain'. Communication between the two communities has now been extended into media and everyday social discourse where it crops up in news debates about issues such as public health and food safety. In this process, scientific academic discourse has lost much of its original form. This article examines part of the current research at the Centre (...) de recherche sur les discours ordinaires et spécialisés. It provides evidence of new discursive forms adopted by science in media and social discourse, such as the emergence of enunciative standpoints, the redefinition of the role of the journalist as mediator between science and the general public, the use of specific forms of intertextuality and the interweaving of scientific elements in general social discussions. This research on new data implies renewed definitions of certain concepts used in linguistic descriptions: discursive meaning and signification, interdiscursive memory bank, etc. These recent forms of discourse have brought about a change in the status of science so that science has now become an object of debate in the public arena — a sign of its crucial social role. I will suggest, in this article, a possible explanation of the fact that legal language appears incoherent to the general public. I will present one legal text (an indictment), explaining why it appears incoherent to legal laypersons. I will argue that the traits making this particular text appear incoherent are, first, that a specialized legal meaning is conveyed implicitly and, second, that there are no key-words that could direct laypersons to the knowledge making this meaning obvious to legalists. I will (...) conclude that any legal text having these traits is likely to appear incoherent to the general public and suggest that the traits making my example appear incoherent might be rather common among the various texts of the various legal systems. On this suggestion there is no need to assume any causal relation between lawyers’ social interests and the apparent incoherence of legal language as it entails that this incoherence is inevitable. (I will argue that it is a result of the facts that legal language is ordinary language used, in the ordinary way, in the special context of the legal discourse.). (shrink)

Autism has been widely covered by the medias, and studies analyzing this discourse have pointed out frequent and repetitive distortions of the biomedical knowledge. We conducted a systematic analysis of conceptions of autism in the french specialized social workers press between 1989 and 2014, and compared these results to a recent study on Attention Deficit Hyperactivity Disorder (ADHD) in the same field. Analysis of discourse about autism, and more generally on mental and psychosocial disorders in the specialized social (...) workers press shows that social factors highly involved in these pathologies are never presented, as they are widely argued in the international literature, and can be subject to specific socio-educational policies and practices. Most ways of autism presented to french social workers belong to the therapeutic sphere, and reveal a growing medicalization of social work, allowing us to question the practice and training issues. The purpose of the study is to determine the key strategies of philosophical criticism of Heidegger’s Black Notebooks, whose achievement is realized in the following tasks: 1) to identify the body of texts that represent the discourse of philosophical criticism of Heidegger notes; 2) to reveal the typological features of the different strategies of interpreting Black Notebooks; 3) to reconstruct a thematic horizon of Heidegger studies, opened up by discussion on published notes. The methodology combines elements of discourse (...) analysis with traditional methods of historical and philosophical criticism. Scientific novelty is expressed in the following: 1) philosophical discourse of the Notebooks’ reception includes texts of narrowly specialized character, as well as reflections of key philosophers 2) basic strategies in philosophical critique of Black Notebooks convey the overall structure of the discourse of interpretation of Heidegger’s legacy, distributed between apologetics and ideological criticism; 3) Black Notebooks have exacerbated the problem of architectonics of Gesammtausgabe and formed the textual basis for the study of "silence" period in philosophical life of Heidegger. Conclusions. The discourse of philosophical critique of Heidegger’s notes proves evidence for ideological charge of philosophizing and justifies socially oriented approaches of historical and philosophical studies examining philosophizing as a special cultural practice, not as a form of sublime creativity. Apel, Emeritus Pro­fessor at Frank­furt, and close colleague of Habermas, characterizes his viewpoint as a “transcen­dental pragmatism” in which a Kantian concern for (...) question regarding “the conditions for the possi­bility of some­thing,” (p.10) mixes with deontological discourse-ethics, semeiotic themes from Peirce, an ap­proach to fallibilism, the demand for “final justifica­tions” (Letzt­begründung) and German her­meneutics. In view of the “den­sity and concentration” of Apel’s texts, which often have a “deterrent effect” upon those not already at home with “the phil­osophical language game,” it is the announced aim of this book to provide a work of translation and clarification of Apel’s special­ized efforts --in effect an orientation to Apel’s work. The book divides into an Introduction, 8 chapters and a summary conclusion --with Habermas’ appreciation, “A Master Builder with Hermeneutic Feeling --The Way of Philosopher Karl-Otto Apel,” bringing up the rear. There is also a bibliography of primary and secondary sources and a short table outlining highlights of Apel’s career. Exploration of INTERSUBJECTIVITY is continued. Different kinds of if are differentiated and signs for its presence and effects are shown. The difference between it, subjectivity and objectivity are explored. Intersubjectivity is crucial and universal for general everyday discourse in all cultures, sub-cultures, institutions, communities and socio-cultural practices such as religion, sport, etc or the so-called Manifest Image. It is essential for specialized areas, for example religion, sport and disciplines such as the humanities, arts, sciences, philosophy and all institutions. It (...) is a necessity for both cultural, social, interpersonal as well as intra-personal existence, emotions, attitudes, values and norms. But, it is not limited to human existence, life-worlds, realities and worlds, but also required for animals and all organisms. Object Oriented Ontology would emphasize that is it not merely something anthropocentric and restricted to human existence and consciousness (and anthropocentric interpretations of and projections on other objects, non-human creatures and all organisms, as well as all objects.. In the case of the latter one would probably replace the notion of intersubjectivity with terms such as energy and other ways of action and interaction for example intra- and inter-atoms.) Surge en este contexto la pregunta por la posibilidad de diálogo entre profesionales que permita comprender, nombrar y desplegar articulaciones discursivas tan complejas como los fenómenos a los que refieren. En este marco, explicitar (...) y discutir los lugares epistemológicos desde los cuáles se funda la intervención social permitiría construir contrapuntos y acuerdos procedimentales para la conjunción de miradas diferentes que facilite el desarrollo de intervenciones sociales más efectivas. El propósito de este trabajo es analizar esta cuestión desde la perspectiva de la ética discursiva y proponer algunos requisitos para el diálogo interdisciplinar en este campo.The contemporary social intervention is carried out in contexts characterized by an increasing complexity. Many people take part in this process, one of them, several professionals, who with their own knowledge produce a specialized comprehension about the social phenomena which their actions are aimed. It is necessary to make clear the epistemological approach supported by each professional, in order to make counterpoints and discursive rules which allow understanding their languages and dialoguing in order to face the social intervention with a more complex comprehension. McDonough University of the South e-mail: cmcdonou@sewanee.edu Basil Lanneau Gildersleeve, the eminent classicist who founded this journal, is remembered primarily as an authority on matters of grammar and philology; he was in addition something of a poet, although of limited ability, who specialized in sonnets.1 In the archives (...) of the University of the South in Sewanee, Tennessee, I recently found a number of sonnets written by Gildersleeve, all of them apparently from late in his long life.2 As these may be of interest to the readership of this journal, AJP's current editor has graciously allowed these nugae of her distinguished predecessor to be reprinted here.What follows below are seven sonnets written when Gildersleeve was evidently in or nearly in his nineties,3 all of which were copied in longhand by his niece, Mrs. Leon D. (Eleanor) Kirby, a longtime Sewanee resident.4 When and why Mrs. Kirby made these transcriptions is uncertain, [End Page 293] although her reasons appear to have been personal.5 She was not a practiced amanuensis (see below n. 14), and the text of the sonnets is largely as she copied them out, with only minor corrections.6 Because these require in places a little explication, I have supplied a brief commentary as well. From the appearance of his name fairly littering the footnotes, readers will ascertain that Professor Ward Briggs has been tremendously helpful to me in putting together this "Brief Mention."It was in one of his own late "Brief Mentions," in fact, that Gildersleeve outlined his theory that "the modern sonnet [is] an analogon on a large scale" to the elegiac distich (AJP 41.2 [1920]: 200 = Miller 1930, 402). As he continues, "The octave... represents the hexameter, the sextet, the pentameter, and the likeness to the latter is heightened by the use of terza rima."7 He ends his remarks on the matter thus: The Greeks kept prose and poetry steadily apart... but the elegiac distich was open to all; and I may claim Hellenic authority for introducing my sonnets into the company of grave grammarians. The presence of discourse relations can be marked explicitly with lexical items such as specialized and underspecified connectives or left implicit. It is now well established that the presence of specialized connective facilitates the processing of these relations. The question is to gauge how different degrees of explicitness affect the processing of discourse relations. This study investigates this question with respect to two relations, which are fundamental to our cognition and which are closely tied: causal relations and temporal (...) relations. We carried out a self-paced reading experiment, in which we sought to compare the cost of inferring the presence of causal vs. temporal relations in the absence vs. presence of a connective indicating a given relation in French. For the explicit marking, two types of connectives were tested – one specialized for each relation (doncfor causality andpuisfor temporality) and one underspecified (etin its temporal and causal readings). Overall, our results confirm the facilitator role of discourse connectives: we find that explicit discourse relations are processed faster than implicit ones. The specific (rather than underspecified) connective facilitates processing for temporal relations but not for causal relations; and temporal relations were read equally fast as causal relations. The uncertainty concerning the genre of the Ḥorvat ʿUza ostracon 1 is problematized through the lens of linguistic anthropology. Although a denotative approach to the linguistic forms in this Hebrew ostracon is well attested, less attention has been paid to the indexical meaning of specific stylistic features and their semi- otic register implications. Several linguistic-ideological concepts are drawn upon to examine how the act of inscription and specialized linguistic forms align the discursive genre of the ostracon with prophecy. Humans have used arguments for defending or refuting statements long before the creation of logic as a specialized discipline. This can be interpreted as the fact that an intuitive notion of “logical consequence” or a psychic disposition to articulate reasoning according to this pattern is present in common sense, and logic simply aims at describing and codifying the features of this spontaneous capacity of human reason. It is well known, however, that several arguments easily accepted by common sense are actually (...) “logical fallacies”, and this indicates that logic is not just a descriptive, but also a prescriptive or normative enterprise, in which the notion of logical consequence is defined in a precise way and then certain rules are established in order to maintain the discourse in keeping with this notion. Yet in the justification of the correctness and adequacy of these rules commonsense reasoning must necessarily be used, and in such a way its foundational role is recognized. Moreover, it remains also true that several branches and forms of logic have been elaborated precisely in order to reflect the structural features of correct argument used in different fields of human reasoning and yet insufficiently mirrored by the most familiar logical formalisms. Scientific research has revealed that animals occupy a complex world, replete with desires and emotions. Waldau suggests that although humans hold a power advantage over animals, "[d]ifferences in abilities, and even hierarchy, to the extent they exist, do not automatically imply the propriety of dominance, let alone tyranny" (p.39).To develop his argument, Waldau writes about three higher-order mammals that merit consideration: the great apes, elephants, and cetaceans (whales and dolphins). Each of these groups of animals display complex abilities and have, in proportion to the size of their bodies, large brains. Genetically, chimpanzees and humans share 98.4% identical DNA. Chimpanzees can develop high language functioning and use [End Page 293] tools, subverting the assumptions that these two capabilities are uniquely human. In regard to elephants, Waldau writes that "[b]oth Aristotle and Pliny designated elephants as the animals closest to humans in intelligence" (p. 79). Similarly, Waldau summarizes recent research on cetaceans' ability to protect one another through echolocation and a highly intricate communication system based on touch and soundings. The ArgumentThe impressive growth of the Swiss electricity supply industry in the late nineteenth cestury has usually been explained by Switzerland's abundant waterpower resouces, its well-equipped financial markets, and the mechanical skills of its Swiss workers and engineers. This article does not aim to deny the importance of these factors. Rather it seeks to explain how they developed synergetic effects and how they were knit together. The argument is put forward in three steps: First, I show the importance of the (...) new technology's discursive integration, arguing that the development of specialized electric discourse led to a social shaping of technology that was highly compatible with generalized cultural patterns of late nineteenth-century Swiss society. The expressive dispositions and instituted means of expression that constitiute the elextric discourse were constantly pursuing and achieving effective resonances in other discursive fields. This allowed for a solid integration of the electrotechnical discourse in late nineteenth-century Swiss society.Second, I argue that electrotechnology was modeled in such a way that it became coupled with existing technological practices, such as the national mapping endeavor, the urban gas and water supply, the sewer system, and the telegraphic networks. It is noteworthy that making electrotechnology compatible with other technological practices led not only to similar patterns in the design and management of both the old and the new technologies but also to operated with the existing water supply station.Using the example of the electrification of Zurich, I then, in a third step, combine the two elements – discursive accommodation and practical assimilation – to demonstrate their effects on the selection and construction of technology. The article's somewhat complex argumentative strategy allows for a differentiated interpretation of the phenomenon and shows the importance of taking into consideration the sociocultural dimension of economic growth that had its roots in the diffusion of a new technology. The article presents and discusses an ongoing fellowship project entitled ‘Space for Interference’, conducted under the Norwegian Programme for Research Fellowships in the Arts. Two concrete site-specific art projects produced under Space for Interference serve as a point of departure for an investigation into methods of interference and the forms of address that artists use when intervening in other specialized fields in society. The institutions that provide the site for an art project have different social functions. We ask what may (...) be their motivation for allowing artists access to their physical environments, apparatuses, procedures, systems and discourses. The fact that the artists’ projects in these contexts function as a means of self-observation for the institutions seems obvious. Nevertheless, we seek to investigate the various economic and political factors that allow these institutions to include potentially critical activities, which aim to modify or transgress their systems, and thereby displaying how they are malleable and mobile bodies. One assertion we make is that by doing so the involved institutions prove to be modern, self-critical and flexible, thus complying with political requirements to adapt to the rapidly changing environments of the information and communication age. The perspective from systems theory in the Luhmannian tradition has proved useful since it shows how the issues of art may also be the problems of science, business, politics and the law in the complex and decentered social universe of today. The issues of contingency, insecurity, paradox and autoreflexivity, surplus meanings and the complexity and decentering of the subject are at the heart of contemporary art. Systems theory provides a way to link such practices theoretically with scientific discourse and with the advanced problem solving and criticality of other social domains, like politics, business and the media industries. At a minimum, a fiduciary is one who is entrusted to act for the benefit of others. But as the essays in this volume indicate, fiduciary relationships can be conceived or argued to be thicker and/or more robust. In addition to a relation of trust and action on behalf of another, fiduciary relationships are often thought to include some or all of the following additions: asymmetries of power, knowledge, skill or ability; discretion or reasonable judgment on the part of the (...) fiduciary; loyalty of the fiduciary to the interests of the trustor, or potential beneficiary; and the ethical obligation to act in good faith, with due care, or with professional or special knowledge in advancing the interests of the trustor. Due to the vulnerability of dependents, their trust in fiduciaries, and ethical obligations of trustees to act beneficently, fiduciary relationships lie at the heart of much ethical reflection, discourse and argumentation. This is especially so for professional fields in which fiduciaries have special knowledge and skill, and consequently special powers. Yet, apart from the specialized sub-disciplines of business ethics, legal ethics and medical ethics, fiduciary roles and relationships have not received much scrutiny and discussion in philosophy. In our view, this deficiency is best remedied by treating fiduciary ethics as a more general sub-field within ethics and deserving of attention in its own right. (shrink)

Leveraging the staggered introduction of specialized bankruptcy courts across China as an exogenous shock, this study examines the impact of specialized bankruptcy courts on corporate ESG performance. Using listed firms in China from 2015 to 2021, we find that the introduction of specialized bankruptcy courts leads to an increase in corporate ESG performance. Our main results remain robust after considering endogeneity concerns and TWFE bias. The underlying mechanism is that these courts strengthen creditor protection, thereby enhancing access to bank loans (...) for local firms. Moreover, this effect is more pronounced in firms with limited access to bank financing and in cities with more efficient legal and financial environments. Collectively, our study contributes a novel perspective to the discourse in law and finance, underscoring the broader implications of judicial reforms on corporate ethical behavior. (shrink)

Giorgio Agamben’s discourse on Franciscan monasticism is generally received in accordance with his presentation of it: as a genealogy or archaeology of the way in which the Franciscans were the first to embody an exemplary form of life. This paper offers a different view, arguing that Agamben’s account of the Franciscans is actually an allegory whose underlying structure and meaning is supplied by Heideggerian metaphysics. One of the striking features of Agamben’s discourse is that it treats actual historical (...) events as allegorical symbols or ‘paradigms’ of a hidden metaphysical reality whose decipherment both clarifies the past and reveals the future. It is shown that this exemplary way of viewing historical events is embedded in a specialized spiritual exercise. Here, allegorical writing and reading act as practices of self-transformation that promise exalted insight into the hidden meaning of historical ‘paradigms’ regardless of historical scholarship. The topic of developing professionalism dominated the content of many academic medicine publications and conference agendas during the past decade. Calls to address the development of professionalism among medical students and residents have come from professional societies, accrediting agencies, and a host of educators in the biomedical sciences. The language of the professionalism movement is now a given among those in academic medicine. We raise serious concerns about the professionalism discourse and how the specialized language of academic medicine disciplines (...) has defined, organized, contained, and made seemingly immutable a group of attitudes, values, and behaviors subsumed under the label of "professionalism." In particular, we argue that the professionalism discourse needs to pay more attention to the academic environment in which students are educated, that it should articulate specific positive behaviors, that the theory of professionalism must be constructed from a dialogue with those we are educating, and that this theoretical and practical discourse must aim at a deeper understanding of social justice and the role of medicine within a just society. The first chapter discusses the association of the English word ‘or’ in reasoning. “Or” is descended from the Anglo-Saxon word meaning second, a form which survives in such expressions as “every other day.” If logical theory had not introduced the vocabulary of disjunction, we could not formulate the question. The truth-functional character of ‘or’ and ‘and’, if they have such a character in their natural language habitat, is a character that is derived as a consequence of their playing a certain (...) role in discourse, one best described as punctuation, or in a specialized sense of the word adverbial. In many cases, the transformation of a sentence embedding an or-list to an equivalent or joined pair of sentences cannot plausibly be called disjunctive distribution. ‘Or’-words derive from additive rather than from subtractive ancestors. Context: There is a growing recognition in consciousness science of the need for rigorous methods for obtaining accurate and detailed phenomenological reports of lived experience, i.e., descriptions of experience provided by the subject living them in the “first-person.” Problem: At the moment although introspection and debriefing interviews are sometimes used to guide the design of scientific studies of the mind, explicit description and evaluation of these methods and their results rarely appear in formal scientific discourse. Method: The recent publication (...) of an edited book of papers dedicated to the exploration of first-and second-person methods, Ten Years of Viewing from Within: The Legacy of Francisco Varela, serves as a starting point for a discussion of how these methods could be integrated into the growing discipline of consciousness science. We complement a brief review of the book with a critical analysis of the major pilot studies in Varela’s neurophenomenology, a research program that was explicitly devised to integrate disciplined experiential methods with the latest advances in neuroscience. Results: The book is a valuable resource for those who are interested in impressive recent advances in first- and second-person methods, as applied to the phenomenology of lived experience. However, our review of the neurophenomenology literature concludes that there is as yet no convincing example of these specialized techniques being used in combination with standard behavioral and neuroscientific approaches in consciousness science to produce results that could not have also been achieved by simpler methods of introspective reporting. Implications: The end of behaviorism and the acceptance of verbal reports of conscious experience have already enabled the beginning of a science of consciousness. It can only be of benefit if new first- and second-person methods become well-known across disciplines. Constructivist content: Constructivism has long been interested in the role of the observer in the constitution of our sense of reality, so these developments in the science of consciousness may open new avenues of constructivist research. More specifically, one of the ways in which the insights from first- and second-person methods are being validated is by recursively applying the methods to themselves; a practical application of an epistemological move that will be familiar to constructivists from the second-order cybernetics tradition. I wish to correlate Bernard Lonergan’s functional specialty Communications with Mikhail Bakhtin’s notion of novelistic discourse with the goal of teasing out how the Bakhtinian notion of discourse furthers on-going reflection on inculturation. Theology as a highly differentiated and specialized reflection on religion bears fruit in the final stage (Communications) of theological reflection. This fruit – inculturation – can be explained using different constructs. This paper privileges the Bakhtinian construct in that it addresses “the life and behavior of (...) discourse in a contradictory and multi-languaged world” in ways that Lonergan’s differentiated and specialized reflection on theology accounts for multiplicity of cultural traditions in an ever-changing world church. Ernest Nagel once remarked that it is fortunately not necessary to be clear about scientific philosophy and methodology in order to practice good science. He went on to say, "Even eminent scientists can make unholy spectacles of themselves when they don the mantle of philosophy and attempt to discuss the broad implications of their specialized labors." Feynman's recent venture into the philosophy of science is, unfortunately, a lucid illustration of the validity of Nagel's observations. The book is a rather literal (...) transcription of seven semi-popular lectures delivered by Feynman at Cornell in November of 1964. Feynman is a wonderful iconoclast, a legendary virtuoso of the bongo drums and—by the way—a Nobel laureate and one of the great theoretical physicists. But this is all the more reason to expect something a little more intellectually solid than is offered in this volume. It was obviously Feynman's intent to discuss some compelling problems which lie on the borderline of physics and philosophy with an intelligent lay audience. But few will be enlightened by Feynman's clever, if uninformative, discourse about such issues as the relation of mathematics to physics, symmetry and conservation laws, and probability and uncertainty. Feynman's finest hour undoubtedly comes in the lecture on quantum mechanics, in which some aspects of the wave-particle duality are presented. But the value of much of the rest of the book is severely qualified by the author's penchant for imprecise and confusing statements and, in some cases, outright mystery-mongering. This is a great pity because theoretical physics, especially in the hands of Richard Feynman, is a source of ideas which are most worth discussing.—H. P. K. (shrink)

This article explores how we use social media to construe identities and align with others into communities of shared values. The focus is on how ‘users of language perform their identities within uses of language’: How do personae using the microblogging service Twitter perform relational identities as they enact discourse fellowships? Addressing this question means understanding how personae enter into ambient affiliation. Such affiliation is ambient in the sense that social media users may not be interacting directly, but instead (...) participating in mass performances of hashtagging or contributing to iterations of Internet memes. This article will consider three key bonds using both a 100 million-word corpus of posts and a smaller specialized corpus collected by capturing the entire Twitter stream of a particular user. Clarke proposes a conception of philosophy that provides an alternative to the reductions of materialism and the search for normative principles. Philosophy's proper role is to describe similarities and differences among differing levels of language, specifically the familiar level of discourse within an ordinary language shared by all and the specialized discourses of social institutions such as science, law, and the arts. By constructing a logical framework in which these comparisons and contrasts can be made, philosophy performs the indispensable (...) role of promoting the integration of disparate elements of our culture. Odera Oruka’s Sage philosophy project, his definition of philosophy, the method of interviewing sages, and the differentiation between folk and philosophic sages, have been discussed and criticised at length. Unfortunately, less known is Odera Oruka’s work on Ethics. This is especially regrettable, as his philosophical work had two main objectives:· The liberation of philosophy in Africa from ethnological and racist prejudices (Sage philosophy).· The reconstruction of the dimension of sagacity in philosophy which got lost in technical and analytic language during (...) the last decades. Philosophy becamea kind of expert knowledge with specialized terminology, thereby losing its holistic outlook and practical relevance.For Odera Oruka, who situates himself in the Socratic tradition of philosophy, philosophy is not a science in the ivory tower, but has to contribute to the bettermentof the life of the people - it has to be made practical. Philosophers have to deploy the results of their thinking to the well-being of their communities. This is what he considers, following Socrates, the sagacious dimension of philosophy.The aim of the present article is to highlight the ethical dimension of Odera Oruka's work, and to show the inseparable relationship of the Sage Philosophy project and his works on ethics, with a special focus on his concept of global justice. In France, the notion of “métier” continues to represent a major reference point in current discussions on work issues, both in theory and in public discourse. The “métier” encapsulates the set of specialized technical knowledge, bodily and mental skills, accepted interpersonal conventions and modes of behaviour, which characterize what could be called in English an “occupational culture”, the specific professional knowledge, culture and ethos of an occupation. The article analyses the psychological and cultural instances that make up a “métier” (...) from the point of view of the working individual, distinguishing between a personal, an interpersonal, a transper-sonal and an impersonal dimension of the working activity. The article then argues that the relationship between work and health relies upon a work organization that allows these four instances to be constantly readjusted at the individual level and at the level of the work collective. Pretpostavka teksta jest da se problematika identiteta promišlja kroz konfliktan suodnos dominantno i marginalno pozicioniranih društvenih aktera. Kontekstualizirano unutar ovakve dualne distribucije moći, aplikativni dio teksta tematizira temu proučavanja problematike identiteta u dva različita društvena diskursa . Pritom, film se promatra kao medij popularne kulture, dok bitan segment znanstveno-teorijskog pristupa temi (...) koji omogućuje raspravu pripada domeni kulturne kritike.Inicijalno zadirući u sferu estetskog, tekst započinje primjerima iz teorije prakse. Tiče se inkorporiranosti filmskih sadržaja u osobne identifikacijske procese svakodnevnog života. Praktična pretpostavka jest: budući da se relevantnost kinematografije u velikoj mjeri očituje u dostupnosti plasiranih sadržaja, sam film se tako predstavlja kao privatni i kolektivni itinerar kulturnih znanja i putokaz življenom iskustvu.Teorijski se pak dio priče odnosi na prenošenje znanja specijaliziranim kodovima koje potvrđuje činjenicu disciplinarnog zatvaranja kao identifikacijskog procesa. Ukoliko pretpostavimo da je inicijalna tendencija prepoznavanja, uspostave i upisivanja identiteta u matricu svakodnevice oblik kritičkog djelovanja, utoliko se s pravom možemo pitati postoji li nešto što možemo zvati paradoksom uspostavljanja identiteta? I ukoliko postoji, sabotira li zapravo taj paradoks vlastitu inicijalnu tendenciju, a ta je, ponovimo to – djelovanje? Zaključak sugerira dijalektički i interdisciplinarni pristup problematici čiji su cilj etički i politički korektnije politike predstavljanja. Preciznije, umjesto danas razvidnih i dominirajućih perpetuiranih reprezentiranja manipuliranog znanja, ovaj rad nastoji otvoriti mogućnosti za samoartikulacije i samoprezentiranja različitih identifikacijskih pozicija.It is procurable to postulate that identity as such, even if tentatively fixed, is being beheld as an unstable, socially conditioned category, marked and recognized depending on the distribution of power and current discourse relations. The assumption of this text is the politics and the problematic of identity viewed through the conflict nature of the dominantly and marginally positioned relation of social actors. Contextualized throughout this binary distribution of power, the applicable part of this text introduces the subject of identity studies and the problematic it beholds within identity itself in two different social discourses . In this perspective, the film is seen as the media of popular culture, while the important part of scientifically-theoretical access to the subject which allows debate, is in the domain of cultural critique.Interfering initially in the domain of esthetics, the text begins with examples in theory of practice. It concerns embeddedness of the film epitome into personal identification processes of everyday life. The practical assumption is: given the fact the relevancy of cinematography is broadly shown in the availability of the placed substance, the film itself is presented as a private and a collective itinerary of cultural knowledge and a signpost for lived experience.The theoretical part of the story relates to the transfer of knowledge using specialized codes while confirming the fact of disciplinal closure as well as the identification process. If we were to assume that the initial tendency of recognition, establishment and inscription of identity into the matrix of everyday life is indeed a form of critical action, than it is right to ask if there is a thing that could be called the paradox of establishing identity. And, if there is indeed such a thing, is this paradox actually sabotaging its own initial tendency – that being – acting? Conclusion suggests dialectical and interdisciplinary approach to the problematic which aims to the more correct politics of representation, both in ethical and political sense. More precisely, this text tries to open the possibilities of self-articulation and self-representation of different identification positions instead of nowadays apparent and dominate representations of manipulated knowledge. Starting from the assumption that Discourse Analysis can shed light on hidden instances of social demand through the analysis of discourse in different social contexts, the present paper focuses on healthcare, in particular on the social demands concerning health that emerge in forums where health problems are discussed. A corpus of texts produced in the context of non-specialized discussion groups has been analyzed, both from a quantitative and a qualitative perspective. Various discourse features have been examined — (...) from strategies of self-presentation and other-addressing to the selection of specialized lexicon and terminologies, from levels of formality to the interplay of description and narrative. The analysis has revealed the presence of two different ‘scenographies’, that can be named ‘social’ and ‘private’, respectively. The former is characterized by the exchange of information, while the latter gives voice to the need for a different relationship between patients and doctors. In this perspective, it is suggested that the person as a whole should be the main concern of doctors, thus leading to a renewal of discourse in the medical sector. (shrink)
