Scott Hershovitz’s Law is a Moral Practice develops a bold, novel, and comprehensive account of law: the moral practice picture. Its central thesis is that legal relations (rights, duties, powers, etc.) are moral. They are real, full-fledged normative relations, connected to genuine reasons for action, and endowed with robust normativity. Nothing less than ordinary moral relations. The account is compounded with a deflationary view of theories in general jurisprudence and of the debates about them. In this vein, Hershovitz recommends that (...) we move away from theorising about law (understood as a set of legal norms), and focus on the nature of legal relations instead. In this paper, I pursue two interrelated objectives. First, I address Hershovitz’s main arguments for the view that legal relations are moral. Second, I take issue with the asymmetry between the deflationary and inflationary stances he advocates for legal norms and relations, respectively, arguing that this different treatment is unwarranted, because the deflationary stance is, and because this very combination of attitudes is unstable. Properly understood, questions about the nature and determination of legal norms and relations can’t but be seen as complementary aspects of a unified legal metaphysics. (shrink)

Deflationism about truth is the claim that the concept of truth is completely explicated by the disquotational view of truth, where the latter is the specification of a device of semantic ascent that avoids the semantical paradoxes. Over the last twenty years, the plausibility of deflationism has been intensely debated by philosophers of language. A number of writers have argued that even though deflationism is a coherent view, it is false. Some maintain that this is because a (...) complete account of truth must reduce truth to purely physical concepts but that the disquotational view of truth provides no such reduction. Every deflationist semantic theory has its inflationist correlate: this is the semantic theory the deflationist theory is designed to deflate. This chapter presents Radical Inflationism and Radical Deflationism as stipulatively defined theories, without regard to who might subscribe to them, or to one or another of their parts. Radical Deflationism is based on a view worked out over a number of important publications by Hartry Field. In other words, radical inflationist is on board with (...) the view Hartry Field had when he wrote 'Tarski's theory of truth', that our notions of reference and truth are correspondence notions that stand in need of physicalistic explications. This is that Radical Deflationism's claim that the only reason we need a notion of truth is as a device of disquotation is hostage to the theory's ability to meet what we will presently see is its greatest challenge. Just as Quine and others have argued for a deflationism about the property of truth, Sinan Dogramaci has argued for a deflationism about rationality. Specifically, Dogramaci claims that we have no reason to think that the basic, deductive, epistemic rules we call “rational” have any sort of “unifying property.” A “unifying property” is a property that is necessary, sufficient, and explanatorily illuminating. My goal in this paper is to undermine Dogramaci’s argument for this radical position. I do (...) this by first outlining Dogramaci’s distinctive view on the function of our epistemically evaluative terms. This view, called epistemic communism, has it that the function of terms like “rational” is to support the coordination of our community on a single set of epistemic rules. I offer a reconstruction of Dogramaci’s argument from epistemic communism to deflationism about rationality. I next raise an objection to Dogramaci’s argument: different sets of epistemic rules do not equally support the coordinative function. Dogramaci has a response to this objection, but I argue that this response is less than satisfactory. I illustrate that this response is unsatisfactory by employing work by David Enoch and Joshua Schechter. After pushing my objection to Dogramaci’s argument, I develop, on Dogramaci’s behalf, an objection to my non-deflationary attempt to undermine his argument. In the final section of the paper, I reply to this objection offered on Dogramaci’s behalf and conclude that whether we are epistemic communists or not, we need not accept deflationism. (shrink)

The purpose of this paper is to present a thought experiment and argument that spells trouble for “radical” deflationism concerning meaning and truth such as that advocated by the staunch nominalist Hartry Field. The thought experiment does not sit well with any view that limits a truth predicate to sentences understood by a given speaker or to sentences in (or translatable into) a given language, unless that language is universal. The scenario in question concerns sentences that are not (...) understood but are known to be logical consequences of known and understood sentences. Ultimately, the issue turns on the notion of logical consequence that is available to various versions of deflationism. (shrink)

Restrictionism is a response to the Liar and other paradoxes concerning truth. Restrictionists—as I will call proponents of the strategy—respond to these paradoxes by giving up instances of the schema -/- <p> is true iff p. -/- My aim is to show that the current unpopularity of restrictionism is undeserved. I will argue that, whilst cautious versions of the strategy may face serious problems, a radical and previously overlooked version of restrictionism provides a strong and defensible response to the (...) paradoxes. This paper is a critique of the radical enactivism of Daniel Hutto, Erik Myin, and their collaborators, insofar as their approach pertains to the hard problem of consciousness. I argue that their valiant attempt to discard the hard problem is ultimately unsuccessful. More specifically, I argue that the hard problem of consciousness is best construed as a transcendental challenge and that no phenomeno-physical identity theory, and no “logic of identity”, successfully eliminate this challenge. Finally, I argue that the theoretical (...) stance adopted by Hutto, Myin, and their colleagues is inherently unstable in that it inadvertently blends strong deflationary currents with an implicit commitment to substantive metaphysical revisionism. Since deflationism and revisionism are discordant partners their forced union results in a position whose overall coherence is compromised. Such disequilibrium, I believe, is a general characteristic of radical enactivist approaches to consciousness, of which the position discussed on the present occasion is one prominent representative. The age-old question “What is truth?” is not an unambiguous one. There are at least two different meanings. In one sense, it is a semantic question about the meaning of the word “truth” and/or a metaphysical question about the nature of the property of truth, that is, how truth can be defined in terms of other notions, if it is definable at all. In another sense, it is an epistemological question about the criterion or test of truth, that is, how (...) we can recognize or accept (empirical) propositions as true. Ayer, in Language, Truth and Logic (LTL) and some other articles, tried to convince us that when we attempt to elucidate a theory of truth, we are only engaging in the epistemological project of finding the criterion of truth. This anti-semantical and anti-metaphysical view is based on Ayer’s (radical) deflationism about truth. In this chapter, I will argue that since Ayer did not accept that the criterion of truth is intimately related to the concept of truth, he can be seen as a deflationist about the nature of truth and as an advocate of a certain (Schlickian) kind of correspondence conception about the criterion of truth. His position would not be tenable if he had maintained what some of his contemporaries accepted, namely that there is a close connection between the two truth-theoretical tasks: the definitional and the criterial one. The aim of this article is to discuss the nature of disagreement in scientific ontologies in the light of case studies from biology and cognitive science. I argue that disagreements in scientific ontologies are usually not about purely factual issues but involve both verbal and normative aspects. Furthermore, I try to show that this partly non-factual character of disagreement in scientific ontologies does not lead to a radical deflationism but is compatible with a “normative ontological realism.” Finally, I (...) argue that the case studies from the empirical sciences challenge contemporary metaontological accounts that insist on exactly one true way of “carving nature at its joints.”. In this critical introduction to contemporary philosophical issues in the theory of truth Pascal Engel provides clear and authoritative exposition of recent and current ideas while providing original perspectives that advances discussion of the key issues. This book begins with a presentation of the classical conceptions of truth - the correspondence theory, the coherence theory and verificationist and pragmatist accounts - before examining so-called minimalist and deflationist conceptions that deny truth can be anything more than a thin concept holding no (...) metaphysical weight. The debates between those who favour substantive conceptions of the classical kind and those who advocate minimalist and deflationist conceptions are explored. Engel argues that, although the minimalist conception of truth is basically right, it does not follow that truth can be eliminated from our philosophical thinking as some upholders of radical deflationist views have claimed. Questions about truth and realism are examined and the author shows how the realism/anti-realism debate remains a genuine, meaningful issue for a theory of truth and has not been undermined by deflationist views. Even if a metaphysical substantive theory of truth has little chance to succeed, Engel concludes, truth can keep a central role within our thinking, as a norm or guiding value of our rational inquiries and practices, in the philosophy of knowledge and in ethics. T-biconditionals have often been regarded as insufficient as axioms for truth. This verdict is based on Tarski’s observation that the typed T-sentences suffer from deductive weakness. As indicated by McGee, the situation might change radically if we consider type-free disquotational theories of truth. However, finding a well-motivated set of untyped T-biconditionals that is consistent and recursively enumerable has proven to be very difficult. Moreover, some authors ) have argued that any solution to the semantic paradoxes necessarily involves ‘inflationary’ means, thus (...) spelling doom to deflationist and minimalist truth theories in particular. The situation is indeed worrisome as formal theories of minimalist truth are missing so far. This makes it very hard to properly evaluate the tenets of minimalism. In the present article, we will show how to find safe instances of the T-schema just by relying on syntactic features of the sentences of our language—in particular, we will explore Quine’s idea of stratification. Based on that, we will introduce some disquotational truth theories that are deductively very strong. (shrink)

This article argues for an anti-deflationist view of scientific representation. Our discussion begins with an analysis of the recent Callender–Cohen deflationary view on scientific representation. We then argue that there are at least two radically different ways in which a thing can be represented: one is purely symbolic, and therefore conventional, and the other is epistemic. The failure to recognize that scientific models are epistemic vehicles rather than symbolic ones has led to the mistaken view that whatever distinguishes scientific models (...) from other representational vehicles must merely be a matter of pragmatics. It is then argued that even though epistemic vehicles also contain conventional elements, they do their job of demonstration in spite of such elements. (shrink)

In this paper I sketch a novel interpretationist account of linguistic content that has important consequences for thinking about intentionality. I solve the challenge presented by a foundational indeterminacy of reference argument to the effect that the meaning of linguistic expressions is radically indeterminate. Happily, my solution doesn’t require positing natural properties as “reference magnets”. Non-deflationist rivals to interpretationist metasemantics include various kinds of causal theories such as Fodor-style asymmetric-dependence accounts and Millikan-style teleosemantics. These accounts face their own indeterminacy challenges (...) that have yet to be solved, as well as similar indeterminacy of reference challenges at the level of individual words. Moreover, they must contend with our apparent reference to things that we are not plausibly causally acquainted with. If indeterminacy of reference arguments can be answered and we can avoid dubious use of natural properties, an interpretationist account like my own will be the strongest contender.. (shrink)

This chapter reviews Davidson's main work on truth. It focuses on the connections between truth, meaning, and interpretation that form the core of Davidson's views, and on the relations of his views to traditional theories of truth. It highlights several key ideas that comprise Davidson's approach to truth: Tarski's work on truth is fundamental to understanding the concept, as is the relation of truth to meaning, and we fail to understand that connection adequately unless we take into account the constraints (...) of radical interpretation. Furthermore, in understanding those connections, we see that truth is not a redundant or trivial concept, but equally, it is not a locus for metaphysical commitments. (shrink)

Global expressivism is the radical view that we should never think of any of our language and thought as representing the world. While interesting, global expressivism has not yet been clearly formulated, and its defenders often use unexplained terms of art to characterise their view. I fix this problem by carefully and clearly exploring the different ways in which we can interpret globalism. I reject almost all of them either because they are implausible or because they are bad interpretations (...) of actual globalist views. I then argue that the most promising version of globalism, which we can find in the work of Huw Price, turns out to be completely compatible with the view of so-called ‘local’ expressivists. The debate between globalists and localists is therefore empty: the real interest in this topic lies not in this debate but in whether globalism is true and if so what follows from it. (shrink)

Characteristic of metaphysics are general questions of existence, such as ‘Are there numbers?’ This kind of question is the target of Carnap's argument for deflationism, to the effect that general existential questions, if taken at face value, are meaningless. This paper considers deflationism in a theological context, and argues that the question ‘Does God exist?’ can appropriately be grouped with the ‘metaphysical’ questions attacked by Carnap. Deflationism thus has the surprising consequence that the correct approach to theism (...) is that of radical theology. The paper attempts to show why Carnap's argument fails, and why, nevertheless, enough remains of it for us to conclude that God cannot be outside time and space. (shrink)

In this paper, we propose and justify the cross‐linguistic study of the concept of truth through empirical studies of truth predicates, with results of such studies. We first conceptually explore the possibility of cross‐linguistic disagreement about truth purely due to linguistic norms governing truth predicates, which may imply a kind of pluralism about the concept of truth. We then consider the conditions under which we would be justified in inferring this sort of pluralism from the fact of such cross‐linguistic disagreement. (...) Next, we report results of three studies on the use of English “is true” and Japanese two truth predicates, as well as “is correct” and its Japanese counterpart. We then report another set of studies using a different vignette, where the radical cross‐linguistic difference observed in earlier studies disappeared. These data together suggest that the moral‐political factor in the truth‐bearer (utterance) strongly affects the uses of Japanese truth predicates but not those of English. Finally, we will discuss the implications of the studies and results reported here, and the empirical possibility of what we call lexical alethic pluralism, for debates over relativism, theories of meaning, and the deflationary and inflationary theories of truth. Xunzi's 荀子 essay, "A Discussion of Rituals" is the earliest attempt in early China to theorize at length about the nature and importance of rituals. This essay is crucial to understanding the importance of ritual in Xunzi's philosophy of self-cultivation, of which there is no shortage of analysis.1 Most of this analysis centers on the notion of ritual in general, but Xunzi's essay also reveals his reaction to several criticisms to specific ritual practices, especially mourning rituals and ancestral sacrifices, that (...) can be found in the Mozi 墨子 and the Zhuangzi 莊子.2 In response to these challenges, Xunzi not only develops a theory of ritual, but also begins to sketch a method of ritual performance that... This paper is an analysis of the term ming in the Inner Chapters of the Zhuangzi. I show that though ming does involve the realization of the fundamental unity of opposites, the realization of this unity does not force the Zhuangzi to endorse a 'radical relativist' stance on morality, since the perspective of the Sage through ming is shown to be a privileged perspective. Overall, the Zhuangzi does not endorse any normative stance on morality. Rather, it endorses a way (...) of life that will ensure one's own personal survival and the survival of this fundamental unity of opposites. The stories of the useless tree in Chapter 4, the skillful cook in Chapter 3, and the death of Hundun in Chapter 7 serve as examples for my interpretation. (shrink)

Li 禮 (translated variously as “ritual”, “etiquette”, or “propriety”) plays a central role in early Confucianism, but its complexity is not always fully understood. At first glance, it may seem as if li behaviors are merely attempts to promote conservative practices from the idealized Chinese past. However, by examining the nature and function of li, as described the Analects (Lunyu 論語) and the Xunzi 荀子 (two key texts in the early Confucian tradition), it becomes overwhelmingly apparent that li is a (...) much more complicated phenomenon. Li actually plays key roles within the interconnected fields of Confucian ethics, religion, and politics and often adds aesthetic elements to these areas of thought. Abstract:Open neural tube defects or myelomeningoceles are a common congenital condition caused by failure of closure of the neural tube early in gestation, leading to a number of neurologic sequelae including paralysis, hindbrain herniation, hydrocephalus and neurogenic bowel and bladder dysfunction. Traditionally, the condition was treated by closure of the defect postnatally but a recently completed randomized controlled trial of prenatal versus postnatal closure demonstrated improved neurologic outcomes in the prenatal closure group. Fetal surgery, or more precisely maternal-fetal surgery, raises (...) a number of ethical issues that we address including who the patient is, informed consent, surgical innovation and equipoise as well maternal assumption of risk. As the procedure becomes more widely adopted into practice, we suggest close monitoring of new fetal surgery centers, in order to ensure that the positive results of the trial are maintained without increased risk to both the mother and fetus. Background The rapidly growing quantity of health data presents researchers with ample opportunity for innovation. At the same time, exploitation of the value of Big Data poses various ethical challenges that must be addressed in order to fulfil the requirements of responsible research and innovation (Gerke et al. 2020 ; Howe III and Elenberg 2020 ). Data sovereignty and its principles of self-determination and informed consent are central goals in this endeavor. However, their consistent implementation has enormous consequences for the (...) collection and processing of data in practice, especially given the complexity and growth of data in healthcare, which implies that artificial intelligence (AI) will increasingly be applied in the field due to its potential to unlock relevant, but previously hidden, information from the growing number of data (Jiang et al. 2017 ). Consequently, there is a need for ethically sound guidelines to help determine how data sovereignty and informed consent can be implemented in clinical research. Methods Using the method of a narrative literature review combined with a design thinking approach, this paper aims to contribute to the literature by answering the following research question: What are the practical requirements for the thorough implementation of data sovereignty and informed consent in healthcare? Results We show that privacy-preserving technologies, human-centered usability and interaction design, explainable and trustworthy AI, user acceptance and trust, patient involvement, and effective legislation are key requirements for data sovereignty and self-determination in clinical research. We outline the implications for the development of IT solutions in the German healthcare system. (shrink)

The aim of this paper is to demonstrate the hermeneutical method of Theodoret of Cyrus, who was one of the most important Biblical commentators and an influential theologian of the School of Antioch. This paper attempts to point out the fact that in the person of the Blessed Theodoret we find the first attempt of synthesis between the Antioch and Alexandria hermeneutical schools. In his hermeneutical work Theodoret attempted to overcome the contradictions existing up to that point and to follow (...) a middle way, without discarding neither the literal nor the spiritual-allegorical interpretation. It could be argued that Theodoret rejected the extreme hermeneutical trends of both the Alexandrian and Antioch inspirations; he developed his unique methods and tactics, which were rooted in the previous patristic tradition of the Church Fathers. Eine der grundlegenden menschlichen Bestimmungen ist die, dass der Mensch ein sich bildendes Wesen ist. Den Grund dafür findet die philosophische Tradition in seiner geistigen Seele. Für Humboldt und seine Universität beispielsweise, ist die Seele der Grund dieses Prozesses. Die zeitgenössische Bildungsphilosophie, namentlich die Pädagogik und die ihr verwandten Wissenschaften, vermeiden jedoch die Rede über die Seele hinsichtlich der Erziehung und besonders hinsichtlich der Bildung. Dies führt bereits zur zentralen These des Artikels, welche wie folgt zusammengefasst werden kann: Bildung kann (...) und darf nicht auf die Rezeption von Wissen und Fähigkeiten bzw. Fertigkeiten im Sinne bloßer Qualifizierung reduziert werden, sondern muss zu ihren tiefsten Grundlagen zurückkehren, welche sich gleichzeitig als grundlegende Bestimmungen bzw. Perspektiven der Bildung überhaupt darstellen: Mit der Öffnung zur Ganzheit der Welt kommt die Seele innerhalb der Bildung bei sich selbst an. Hiermit aber führt sich die Bildung nicht ausschließlich auf die theoretisch-spekulative Art der Annahme und der „Prozessierung“ des Wissens zurück oder zielt ausschließlich auf den moralisch-sittlichen Aspekt; vielmehr wird darauf verwiesen, dass der Mensch in seiner Gesamtheit und Eigenart in ihren Mittelpunkt gestellt wird. Die zentrale These des Aufsatzes wird durch vier tragende Kapitel entfaltet: Im ersten, welches zudem als Ausgangspunkt gilt, wird die griechisch-platonische Denktradition im Hinblick auf die Bildung erörtet, indem dabei die Zwei entscheidenden Begriffe, imago und imitatio, hervorgehoben werden. Im zweiten beziehen wir uns auf zwei – unserer Ansicht nach – Schlüsseltheoretiker, W. v. Humboldt und G. F. W. Hegel, die, jeder auf seine Weise, die „Seele“ der Bildung durch die Begriffe der Universalität in Form der Losreißung vom Partikularen und der Freiheit in Form der Einsamkeit oder Losreißung von der Menge beobachten. Die vorgestellten Darstellungen heben auf keinen Fall eines der wichtigen Merkmale der Bildung auf, die Ausbildung, die im dritten Kapitel erörtert wird, wobei man zur Kenntnis geben möchte, dass sie, wenn sie authentisch sein soll, auch die „Ankunft der Seele bei sich selbst“ berücksichtigen muss. Die abschließenden Ausführungen im vierten Kapitel schildern die Situation derzeitiger Bildung, beispielsweise das Abgleiten in den Funktionalismus und in die reine Praxis sowie das Ausbleiben jeglicher Idee davon, was im Endeffekt die Folge der „Vertreibung des Geistes aus der Bildung“ ist. U drugom dijelu članka »Neki od problemskih aspekata ‘Projekta svjetski etos’« autor pokušava istaknuti daljnje kritičke momente samog Projekta. K ovim kritičkim točkama pripadaju, između ostalog, Küngov pojednostavljeni pogled na pojedine etos-tradicije, nadalje tu su političke implikacije Projekta te na kraju upitna mogućnost praktične primjene temeljnih teza projekta uopće. Pojedine su etos-tradicije prema našem mišljenju mnogo složenije nego li to autor Hans Küng vidi. Njegovu tezu da moralne norme pojedinih religija ukazuju prvotno na ono što on označava pod pojmom ‘Humanum’, (...) smatramo isto tako neodrživom. Također se pojavljuju problemi kada se radi o političkim implikacijama Projekta: tezu – religije igraju odlučujuću ulogu u stvaranju jednog globalnog, političkog mira – smatramo također neodrživom, upravo zbog toga jer sama politika prije religije ovdje igra puno važniju ulogu. Sve ovo upućuje na to da Projekt stupa na svoje granice upravo tamo gdje se radi o praktičnoj primjeni njegovih glavnih teza.Im zweiten Teil des Aufsatzes „Einige von den problematischen Aspekten des ,Projekts Weltethos’” wird der Versuch unternommen, die weitere problematische Aspekte des Projekts Weltethos hervorheben. Zu diesen weiteren kritischen Punkten gehören unter anderem vereinfachte Sicht der einzelnen Ethos- Traditionen, auch weiter politischen Implikationen des Projekts und am Ende die fragwürdige Möglichkeit der praktischen Anwendbarkeit der zentralen Thesen des Projekts überhaupt. Die einzelne Ethos- Traditionen sind unserer Meinung nach viel komplexer als es Autor Hans Küng sieht. Seine These, dass die moralischen Normen der einzelnen Religionen auf ein Humanum hinweisen, halten wir für unhaltbar. Ebenso ergeben sich die Probleme, wenn es um die politischen Fragen geht: die These – Religionen spielen ausschlaggebende Rolle bei der Schaffung eines globalpolitischen Friedens, finden wir auch als unhaltbar, gerade deswegen, weil selbst Politik vor der Religion hier viel wichtigere Rolle spielt. All das weist darauf hin, dass das Projekt auf seine Grenzen stoßt besonders dort wo es um die praktischen Anwendbarkeiten seiner wichtigen Thesen geht. (shrink)

The Mencius contains several negative remarks about the Mohists and their doctrine of ‘universal love’ (jian’ai). However, little attention has been paid to whether Mencius’ descriptions of Mohism were accurate. Fortunately, there is a surviving record of the beliefs of Mozi in the text that bears his name. In this essay, I analyze this text and descriptions of Mohism from other early Chinese texts, and compare them to the criticisms of Mohism in the Mencius. Ultimately, I show that the image (...) of the Mohists as ones who promoted a doctrine that contradicted filial piety was inaccurate, and obscured the complexities of filial piety in the Warring States period.
