The article emphasizes the importance of the Charter of Local Self-Government to the Lithuanian national legal system. Lithuania has ratified the Charter, not only acknowledged, but also committed to implement its provisions. The Charter consists of 13 items representing the essence of local self-government, which sets the content and is the principal purpose of local public. The principles should be not only a declaratory move into the national legal system, but also recognized as a state’s obligation to follow them. During the study noted that between the executive and local authorities are the differences of interpreting and dysfunctions implemented a few principles of the Charter: subsidiary and decentralization, local government financial autonomy and the freedom of formation executive local bodies. The secession issue appears to many contemporary thinkers to reveal a fatal flaw in the idea of national self-determination. The question is whether national minorities who come to want to be politically self determining should be allowed to separate from the parent state and form one of their own. Here the idea of national self-determination may lead us in one of two opposing directions. If the minority group in question regards itself as a separate nation, then the principle seems (...) to support its claims: if the Québécois or the Catalans come to think of themselves as having national identities distinct from those of the Canadians or the Spanish, and to seek political independence on that basis, then if we are committed to national self-determination we should support their claims. But we then face the challenge that once national identities begin to proliferate there is no feasible way of satisfying all such claims, given elementary facts of geography and population spread. One manifestation of argumentation is in critical discussions where people genuinely strive cooperatively to achieve critical decisions. Hence, argumentation can be recognized as the process of advancing, supporting, modifying, and criticizing claims so that appropriate decision makers may grant or deny adherence. This audience-centered definition holds the assumption that the participants must willingly engage in public debate and discussion, and their arguments must function to open a critical space and keep it open. This essay investigates `ideological pronouncement,' a kind of (...) rhetoric that undermines and limits the possibility of critical discussion among target audiences, as an enemy of sound argumentation. First, the essential characteristics of sound argumentation are explained. Next, the typical characteristics of ideological rhetoric are described. At the same time, the Cardinal Principles of the National Entity of Japan, a Japanese wartime moral education textbook, is examined as a paradigm case of ideological rhetoric. Third, three key pronouncements of the Cardinal Principles are outlined and discussed. Finally, implications from the critical discussion are drawn. (shrink)

One of the still unsolved problems in liberal anarchism is a definition of social constituency in positive terms. Partially, this had been solved by the advancements of liberal discourse ethics. These approaches, built on praxeology as a universal framework for social formation, are detached from the need of any previous or external authority or rule for the discursive partners. However, the relationship between action, personal identity, and liberty within the process of a community becoming solely generated from the praxeological a (...) priori remains largely disputed. In order to develop a testable constitutional model, this study revises how the “ontological turn” was introduced into liberal theories and redefines the concept of liberty. Liberty is usually understood as a moral goal or measurement for just actions, as the generative principle of all social existence - individual and interpersonal. For this purpose, the function of performative contradiction within the mechanism of interpersonal “encounter”, as part of the co-generative process of the individual becoming and social formation was explored through the production of a game-based narrative historiography grounded on 19th century life writings. This narrative historiography was developed in the context of Swiss history, with a “design-based” research approach, and resulted in a prototype for networked storytelling through which the transformative learning process could be visible and the negotiation of competing individual visions of the future could be re-enacted. This thesis demonstrates that by redefining the notion of nationhood and by treating nations and national minorities equally with respect to self-determination, it is possible to formulate basic principles of the international legal system, which would promote territorial integrity and stability of multinational states better than the existing system. I demonstrate that theories dealing with self-determination based solely on human rights or cases of secession address the problem with inadequate tools. I also show that minority-rights approaches do not accommodate self-determination (...) claims of national groups properly. ;I offer a new idea of nationhood as a political culture of self-determination with which people self-identify. It includes beliefs about co-nationals' mutual membership in a political community, which is perceived by them as having a self-determining power. Definitions of nationhood which use the notion of culture, but not political culture, are both too inclusive---they fail to distinguish between national and ethnic groups, and too exclusive---they overlook multicultural nations. ;Contested secession has received much attention in recent scholarship. Since, however, contested secession is based upon the disagreement of two or more national groups concerning their self-determination within particular boundaries, I consider secession within the scope of a systematic approach to the regulation of relations among national groups. I propose that international legal principles should be based upon the recognition of states and national groups as the two basic elements of the international system, and the equal recognition of nations as political cultures of self-determination. I interpret self-determination as a claim to equality within the boundaries a multinational state, and formulate a criterion of minimal justice for states. It requires that states respect equality of self-determination of national groups on their territory. National groups can secede from multinational states either by mutual agreement, or if their they are persistently denied a status with respect to self-determination equal to that of other national groups. This paper considers a guardianship model for the legal representation of future generations. According to this model, national and international courts should be given the competence to appoint guardians for future generations, if agents who care about the welfare of posterity apply for the creation of a guardianship in relation to a dispute that can be resolved by the application of law. This reform would grant guardians of future people legal standing or locus standi before courts, that is, the right (...) to bring an action before a court of law for adjudication. Although the guardianship model faces several difficult theoretical and practical problems pertaining to the representation of different near and distant future generations, it is argued that this model – and certain other legal norms intended to protect future basic needs – can be justified on the basis of the principle of liberty. The National Institute for Health and Care Excellence (NICE) is the UK’s primary healthcare priority-setting body, responsible for advising the National Health Service in England on which technologies to fund and which to reject. Until recently, the normative approach underlying this advice was described in a 2008 document entitled ‘Social value judgements: Principles for the development of NICE guidance’ (SVJ). In January 2020, however, NICE replaced SVJ with a new articulation of its guiding principles. Given the significant evolution of NICE’s (...) methods between 2008 and 2020, this study examines whether this new document (‘Principles’) offers a transparent account of NICE’s current normative approach. It finds that it does not, deriving much of its content directly from SVJ and failing to fully acknowledge or explain how and why NICE’s approach has since changed. In particular, Principles is found to offer a largely procedural account of NICE decision-making, despite evidence of the increasing reliance of NICE’s methods on substantive decision-rules and ‘modifiers’ that cannot be justified in purely procedural terms. Thus, while Principles tells NICE’s stakeholders much about how the organisation goes about the process of decision-making, it tells them little about the substantive grounds on which its decisions are now based. It is therefore argued that Principles does not offer a transparent account of NICE’s normative approach (either alone, or alongside other documents) and that, given NICE’s reliance on transparency as a requirement of procedural justice, NICE does not in this respect satisfy its own specification of a just decision-maker. The history of international relations is characterized by widespread injustice. What implications does this have for those living in the present? Should contemporary states pay reparations to the descendants of the victims of historic wrongdoing? Many writers have dismissed the moral urgency of rectificatory justice in a domestic context, as a result of their forward-looking accounts of distributive justice. Rectifying International Injustice argues that historical international injustice raises a series of distinct theoretical problems, as a result of the popularity of (...) backward-looking accounts of distributive justice in an international context. It lays out three morally relevant forms of connection with the past, based in ideas of benefit, entitlement and responsibility. Those living in the present may have obligations to pay compensation insofar as they are benefiting, and others are suffering, as a result of the effects of historic injustice. They may be in possession of property which does not rightly belong to them, but to which others have inherited entitlements. Finally, they may be members of political communities which bear collective responsibility for an ongoing failure to rectify historic injustice. Rectifying International Injustice considers each of these three linkages with the past in detail. It examines the complicated relationship between rectificatory justice and distributive justice, assesses the appropriateness of judging the past by contemporary moral standards, and argues that many of those who resist cosmopolitan demands for the global redistribution of resources have failed to appreciate the extent to which past wrongdoing undermines the legitimacy of contemporary resource holdings. The paper attempts to show that Vattel established a duty of sovereigns not to interfere in the internal affairs of other states. Although Vattel did not use the terms 'interference' or 'intervention' in any technical sense of the term, it seems justified to see him as an early proponent of what is called today the principle of non-intervention. This will be evidenced by reviewing how Vattel rejected some of the arguments put forward by previous theorists of just war who (...) defended the right of European states to intervene in states of the New World in order to punish gross violations of the law of nature and nations. Arguing that the laws of war ought to be applied in reciprocal manner, Vattel questioned the distinction between 'civilized' and 'barbarian' nations on which these previous theorists relied. For him, the true 'barbarians' were those nations who fought wars without even attempting to publicly justify their behaviour. (shrink)

Allen Buchanan proposes a methodological framework with which theorists may evaluate different theories of secession, including the National Self-Determination theory. An important claim he makes is, because the right to secede is inherently institutional, any adequate theory of secession must include, as an integral part, an analysis of institutional morality. Because the National Self-Determination theory blatantly lacks such an analysis, Buchanan concludes that this theory is inherently flawed. In this paper, I consider Buchanan’s framework and the responses from supporters of (...) national self-determination theory. I try to clarify the confusion shared by both parties. I conclude that, although Buchanan’s theory of institutional morality is sound, his critiques of the national self-determination theory fails. (shrink)

According to the ancient document, the 24 solar terms was one of seasonal divisions in a year. The regularly change of the four seasons play an important part in the national economic project. For a national economy depended on agriculture in East Asia of ancient times, the administration to pay no regard to the change of the season was directly connected to the fall of (...) the nation. And then the legislator must enact laws to reflect the change of the season. According to the 'Wolryeong (月令)' in 'Yeogi (禮記)', there is recoded national regulations to suit with the each twelve momth. The first month of spring is the prime of the year (February). The month shows sign of new livingthings. The ruler take order to protect the first breath of spring and ought to put a ban on the military training and labor mobilization. The reasons are to safeguard the new life and not to interrupt the preparation for farming. Confucian attach value to the nature within a human’s way of life. Therefore the norm of human do correlate closely with the principle of nature. The rule of Wuju (宇宙) was not a simple concept of the natural phenomenon and Cheon (天) was not the Almighty for himself. Cheon was just the existence of virtue and moral influence in the confidence of man. And Ji (地) was the Mother of all things. In this article the author, a Catholic priest, presents and interprets St. Thomas Aquinas’s delineation of the principle and discusses several classical applications, namely, to hysterectomy during pregnancy, ectopic pregnancy, and craniotomy. He explains the medical anatomy and physiology of the conjoined Maltese twins, Jodie and Mary, and then examines the arguments of four moralists on their separation. (...) In this article we critically examine the principle of equivalence of care in prison medicine. First, we provide an overview of how the principle of equivalence is utilized in various national and international guidelines on health care provision to prisoners. Second, we outline some of the problems associated with its applications, and argue that the principle of equivalence should go beyond equivalence to access and include equivalence of outcomes. However, because of the particular context of the prison (...) environment, third, we contend that the concept of “health” in equivalence of health outcomes needs conceptual clarity; otherwise, it fails to provide a threshold for healthy states among inmates. We accomplish this by examining common understandings of the concepts of health and disease. We conclude our article by showing why the conceptualization of diseases as clinical problems provides a helpful approach in the delivery of health care in prison. (shrink)

Background: Theoretically, the principle of justice is strong in healthcare priorities both nationally and internationally. Research, however, has indicated that questions can be raised as to how this principle is dealt with in clinical intensive care. Objective: The objective of this article is to examine how significant others may affect the principle of justice in the medical treatment and nursing care of intensive care patients. Method: Field observations and in-depth interviews with physicians and nurses in intensive care (...) units (ICU). Emphasis was placed on eliciting the underlying rationale for prioritisations in clinical intensive care with particular focus on clinicians’ considerations when limiting ICU treatment. Results: Significant others could induce an unintentional discrimination of ICU patients. Family members who were demanding received more time and attention for both the patient and themselves. Patients’ and families’ status and position and/or an interesting medical diagnosis seemed to govern the clinicians’ priorities of patients and families—consciously as well as unconsciously. The clinicians emphasised that patient information given through families was important. However, patients’ preferences and values conveyed to clinicians through their families were not always taken seriously. This even applied in cases with very serious prognoses and an explicit patient wish to forego life-prolonging treatment. Conclusion: The principle of justice was violated when qualified attention was given to significant others, and through this also to patients. Attention given to significant others was influenced by the healthcare workers’ professional and personal values, attitudes and interests. (shrink)

_The purpose_ of the article is to clarify the philosophical principle of the local in the context of modern political governance. _The theoretical basis_ of the research embraces scenario analysis, dialectical and existential approaches, as well as philosophical anthropology and philosophy of communication. Local communities are a specific reflection of the connection between a person and a place. The specifics of the formation of a special mode of being, which forms and reproduces relations of loyalty, mutual understanding, and a (...) common feeling in the locus, are established. _Originality._ The article for the first time focuses on the anthropological content of local existence, which is the matrix of civil culture and the prospects of its integration into the global cultural space. _Conclusions._ Local identity as an object of purposeful formation in the conditions of nation-building requires considering the philosophical provisions that were introduced in the anthropological discourse. At the current stage, Ukrainian civil culture strives to invent specific local meanings of political identity in the conditions of external aggression. Its main components will be consensus, mutual respect, integrity, and the will to unite in order to protect statehood. Interdisciplinary meanings of locality form subject-object relations within which modern political management should be carried out. Taking into account the ethnic, cultural, and socio-functional, and role aspects of locality promises to ensure effective decision-making and increase the well-being of modern local communities. The political context of locality is formed based on the interaction of local political actors and institutions. Their examination within the framework of the case studies approach allows for empirically substantiating the local priorities of political actions. It also indicates the specific functionality of local political and administrative structures. at the local level, the discussed source of locality is the question of the origin or authenticity of the local population. For political governance, this is one of the meaningful contexts for justifying local autonomy or even sovereignty. (shrink)

Since 2011, the focus of international negotiations under the UNFCCC has been on producing a new climate agreement to be adopted in 2015. This phase of negotiations is known as the Durban Platform for Enhanced Action. The goal has been to update the global effort on climate for long-term cooperation. In this period, various changes have been contemplated on the design of the architecture of the global climate effort. Whereas previously, the negotiation process consisted of setting mandated targets exclusively for (...) developed countries, the current setting requests of each country to pledge its contribution to the climate effort in the form of Intended Nationally Determined Contributions. The shift away from establishing negotiated targets for rich countries alone towards a universal system of participation through intended contributions raised persistent questions on how exactly the new agreement can ensure equitable terms. How to conceptualize equity within the 2015 climate agreement, and beyond, is the focus of this paper. The paper advances a framework on equity, which moves away from substantive moral conceptions of burden allocation toward refining principles of public reason specially designed for the negotiation process under the UNFCCC. The paper outlines the framework’s main features and discusses how it can serve a facilitating role for multilateral discussion on equity on a long-term basis capable of adapting to changing circumstances. Volunteering in Ukraine is becoming an increasingly popular phenomenon that occupies an important place in the life of society. Many people choose volunteering as a way to help people in difficult life circumstances, as well as to develop their own personality and engage in active civic participation. As a significant social phenomenon, volunteering has its own ideological foundations that define its core values and principles. Volunteering is based on the desire to help people and nature regardless of their status, nationality, (...) religion, or political beliefs. The purpose of the study. The current study examines the ideological foundations of volunteering in Ukraine in wartime and their significance for volunteering, to study the practical experience of volunteers in Ukraine in 2014-2023, and to examine the peculiarities of the legal regulation of volunteering in Ukraine in wartime. Methods. Achieving the goal and objectives of the study was made possible by using a set of interrelated modern general scientific and special methods and approaches. The systematic approach made it possible to study volunteering as a holistic set of elements in the totality of the connections between them. Through the use of the method of systematization, the author provides a review of the legal framework for volunteering, factor analysis is used to determine the factors influencing the relationship between the state and society in the field of volunteering, and system analysis is used to assess the state of relations between the state and society in Ukraine at this stage through its quantitative indicators.Results. According to the study “Volunteer Movement in Ukraine”, prepared by GfK Ukraine on behalf of the UN in Ukraine, Ukrainian citizens pay great attention to the volunteer movement in the development of social processes: 62% recognize the role of volunteers in the changes in the last year; 85% believe that the volunteer movement helps strengthen peace; 81% tend to consider the volunteer movement an essential component of civil society. Regarding the legal regulation of volunteer activities in Ukraine, the Law of Ukraine “On Volunteer Activity” of April 19, 2011, No. 3236-VI was adopted in April 2011. The Law of Ukraine of 15.08.2022 No. 2519-IX On Amendments to the Law of Ukraine “On Volunteer Activity” on Support of Volunteer Activity regulates social relations related to volunteer activity in Ukraine. Discussion. One of the key principles of volunteering in Ukraine is selflessness and the ability to work in extreme conditions. Volunteers often work in difficult and dangerous conditions that require a high level of professionalism and skills. For many volunteers, the Ukrainian revolution of 2013-2014 and the events in eastern Ukraine were turning points that forced them to change their attitude to their own lives and start helping others. Ukrainian volunteers are an example of community and state cooperation that contributes to ensuring security and helping victims. They have shown that volunteering can be an effective tool in the fight against war and its consequences. Many volunteer organizations provided free medical care, took on the responsibility of supplying the military with necessary items and military equipment, organized the evacuation of people from the war zone, and provided psychological support to the military and their families. Conclusions.Volunteering in Ukraine is not a new phenomenon, but the war with Russia has become a catalyst for its development. This is a great example of how crises can encourage people to act together and interact to achieve a common goal. Volunteerism in Ukraine demonstrates the importance of spiritual unity and cooperation in difficult times, and is one of the most striking examples of civil society in action. The ideological principles of volunteering in Ukraine include non-profitability, openness, spirituality, and humanism, transparency and openness, security, and cooperation with government agencies and the military. The volunteer movement in Ukraine, especially in times of war, is an important factor in ensuring security and helping victims. Involvement of different groups of the population in volunteer activities, as well as cooperation with state and international structures, are important to ensure the effectiveness and success of volunteer activities. This article engages with pragmatic sociology to understand an environmental dispute and its underlying moral issues in a direct-democratic and bottom-up setting. The non-establishment of a planned national park in the Swiss Alps serves as a case study to analyse principles of worth presented in national park negotiations. We point to the complex nature of conservation negotiations and argue that loosely defined ideas of the common good can lead to additional difficulties for a bottom-up project. In “The Contralife Argument and the Principle of Double Effect” (NCBQ, Spring 2011), Lawrence Masek tries to use the principle of double effect to show that natural family planning (NFP) is morally justified. This essay presents a summary explanation of the principle of double effect. It demonstrates that Masek wrongly applies the principle of double effect to NFP. It presents the teaching of the 1968 papal encyclical Humanae vitae with regard to NFP, and contends that to (...) apply the principle of double effect to the case of NFP is not only incorrect but also contrary to teaching of Humanae vitae. Because Masek implies that NFP involves the (justified) permission of evil, his article also counteracts the efforts of the Catholic Church to promote the practice of NFP. Prysukhin “The Principle of Subsidiarity: Lessons from the Social Teaching of the Catholic Church” analyzes the achievements of the Social Teaching of the Catholic Church, represented by the works of Leo XIII, Pius XI, Pius XII, John Paul II, revealing the meaningful characteristics of the concept of “the principle of subsidiarity”, its role and meaning in the system of Christian values. The principle of subsidiarity makes possible such relationships in social life, when the (...) community of higher order does not interfere in the internal life of the community of the lower order, taking over the proper functions of that function; for the common good it gives it when necessary support and assistance, thereby coordinating its interaction with other social structures. The principle of subsidiarity guides social practice to the promotion of the common good in the human community. The spread and application of the principle of subsidiarity opposes the danger of "nationalization" of society and the most terrible manifestations of collectivism, restricts the absoluteization of power, bureaucratization of state and socio-cultural structures, becoming one of the guarantors of respect for the rights and freedoms of citizens of their country. Some overlap with one another, some are advisory and lack legal force, others are legally binding in countries, and still others are directed at narrow topics within bioethics, such as HIV/AIDS and human genetics. As the latest document to enter the fray, the UNESCO Declaration has the widest scope of any previous document. The UNESCO draft declaration has some minor weaknesses, but on the whole, the strengths outweigh the weaknesses. One weakness is that some items in the draft are stated in a way that is too restrictive, thereby appearing to rule out legitimate activities. A strength of the Declaration is that it is relatively brief, yet at the same time contains sufficient detail to make it something more than a rehearsal of mere pieties. As the most recent of the numerous bioethics and human rights documents, the UNESCO draft draws on many of the earlier documents and also includes some of the most recent thinking about ethical norms and obligations. Perhaps its greatest strength lies not in details of the principles or their implementation, but rather in its stature as an international declaration issued by a United Nations organization. In the article, the organic principle of the Euroasian philosophy is studied. The organic principle acts as a basis of special style of thinking and a certain methodology of scientific knowledge here. The Euroasian methodology of studying of development of society allows establishing of the nature of communications between social processes and the phenomena of wildlife. In the article, the most important components of the Euroasian organic principle of thinking are shown: special terminology and possibilities of its (...) application for the description and forecasting of the social phenomena. Prerequisites of change of the style of thinking dominating in modern science are also noted. The author considers advantages of the organic principle of the Euroasian methodology in solution of national political, social-economic and cultural problems and in possible prospects of its use for formation of scientific methodology. The organic principle of thinking creates complex idea of reality, which can appear before us new, party unknown earlier. Lack of division of sensual experience and ‘pure reason‘, irrational and rational in organic thinking is unconditional advantage of organic approach. Organic principle presented by the Euroasian philosophical organization of the beginning of the twentieth century and continued by Lev Gumilev in the theory of ethnogenesis acts as alternative developed in the west of one-dimensional, mechanistic methodology. It can be told with confidence that owning all of variety of intellectual traditions is necessary for the modern humankind to become capable to realize global ecological threats and negative consequences of influence of culture in which ethics of individualism prevails. Normative political theorists have been growing more and more aware of the many difficult questions raised by the discretionary power inevitably left to public administrators. This article aims to advance a novel normative principle, called ‘principle of restraint’, regulating reform of established administrative agencies. I argue that the ability of public administrators to exercise their power in accordance with the requirements of public reason is protected by an attitude of restraint on the part of potential reformers. Specifically, they (...) should refrain from any reform of an administrative agency that involves a switch to a considerably more loosely interconnected system of values underlying the work of that agency. To illustrate the importance of the principle of restraint, I examine a case from British health policy, showing that a recent reform of the National Institute for Health and Care Excellence well exemplifies the serious problems brought by any violation of that principle. Background This article describes the issues encountered when designing a study to evaluate recruitment of minority ethnic groups into clinical cancer research in order to monitor adherence to the principles for good practice set out in the Department of Health, Research Governance Framework, England. Methods (i) A review of routine data sources to determine whether their usefulness as a source of data on prevalence of cancer in the population by ethnic category. (ii) A local case study at one hospital trust (...) to ascertain whether the ethnicity of cancer trial participants was representative of admitted cancer patients. Results (i) The lack of a comparator population makes it problematic to assess recruitment levels by ethnic group in clinical research. (ii) The odds of being in a trial were 30% lower for a member of a minority ethnic group compared to a white cancer patient after adjusting for disease, age and gender, OR 0.70 (0.53 to 0.94). These results differed for each ethnic group; Asian patients did not appear under-represented while Black and Chinese did so. However, there are important caveats to the findings based on the limited recording of ethnicity. Conclusions The lack of available data on the ethnicity of participants in clinical research and the prevalence of cancer in the population according to ethnicity makes it difficult to design a study to monitor representation of minority ethnic groups. This information is necessary to assess adherence to the Research Governance Framework principle that research evidence reflects the diversity of the population. (shrink)

Aiming to develop normative recommendations for preventing corporate irresponsibility (CiR), business and society scholars have adopted strategic approaches—exploring the causal links between corporate social responsibility (CSR) and profitability—and moral approaches—exploring the moral principles of CSR that guide managers. However, some business ethics scholars have recently argued that these studies are too simplistic as they disregard the systemic logics of broader institutional environments that generate ‘bad apples’ firms and managers. Drawing on literature that sheds light on the systemic origin of CiR (...) (i.e. the comparative institutionalist perspective and the critical management perspective), we conduct an in-depth case study on how Russian systems of institutional absences shape insensitive corporate environmental violence of a Russian extractive multinational corporation. In doing so, we develop a novel cultural approach to the analysis of CiR that advances knowledge about the systemic origin of CiR in two ways. First, this approach allows for identifying how the sources of CiR are located within firms’ home national systems of institutional absences, which shape systemic logics of CiR that make corporate violence less traceable by firms and broader society. Second, this approach allows for identifying how governments can sustain and perpetuate insensitive corporate violence through the deliberate and systemic absenting of national institutions that could pressure firms to be more socially and environmentally responsible, thus making negative consequences of corporate violence invisible to firms and broader society. We propose future research directions and suggest policy changes in Russia and other countries with similar systems of institutional absences. (shrink)

The principle of double effect is especially useful in end-of-life care, because many end-of-life treatment options inherently have both good and evil conse­quences. The principle of double effect can be used to make both practical and moral distinctions between the acts of euthanasia, (...) physician-assisted suicide, palliative sedation, and the withholding and withdrawal of life-sustaining treatment, which can be classified as either unjustified acts of killing or jus­tifiable acts of allowing to die. Throughout Europe, science and technology policy within the environmental field is currently in a process of transformation, which has been characterised by many observers as ecological modernisation. Emphasis is being given to preventive principles and so-called cleaner technologies in the quest for a more sustainable development. Each European country has, however, adapted the new doctrines and practices in distinctive ways. The main aim of the paper is to show how contemporary policies have been shaped by history, more specifically, by institutional (...) and cognitive traditions, and by national policy styles. By comparing 'ecological modernisation ' in Sweden and Denmark, we attempt to indicate how such national cultural differences affect the ways in which science and technology policies in the environmental field are formulated and implemented. Discrimination in the postmodern society can have many different causes and can affect people of different racial, ethnic, national or social backgrounds, such as communities of Asian or African descent, Roma people, indigenous peoples, Aboriginal people and people of different castes. Discrimination can also refer to people of different cultural, linguistic or religious backgrounds, people with disabilities or the elderly. Moreover, people can be discriminated because of their sexual orientation or preferences. Gender-based discrimination is also common, despite progress in many (...) countries. Women are also particularly prone to violent and abusive practices, and therefore often suffer from a double discrimination, both because of their race or origin and because of their gender, which is why feminist literature in recent years points to new acts or forms of discrimination against women. A major problem in the postmodern world is the discrimination that many people are subjected to, especially women and children, because they live in extreme poverty. These circumstances may force them to migrate and further contribute to a conceptual or social contamination, that may aggravate discriminatory tendencies in the societies where they migrate. The article aims to theoretically analyse the degree of functionality that the principle of non-discrimination based on gender, race, religion and sexual orientation has in the contemporary, postmodern, individualistic society. This chapter explains that the principle of personal good is a principle of separability in the dimension of people. Together with the coherence of good, it provides a basis for applying the separability theorem across the two dimensions of people and states of nature. This chapter starts by qualifying the principle of personal good in some ways, and explains the defence of the principle. One possible line of defence is metaphysical. It is to argue that suprapersonal (...) entities such as nations are simply aggregates of people, and therefore cannot possess a good of their own apart from the good of the people who make them up. The principle is intended to apply to probability‐relative goodness to the goodness of uncertain prospects. The chapter defends it as applied to outcomes, and then extends the argument to probability‐relative goodness. An argument is certainly needed to justify the principle of personal good for probability‐relative goodness. (shrink)

God presented each of us with the gift of human life, for which we each have a duty of stewardship. The complementary principles of totality and integrity provide moral guidance for decisions on whether specific acts are consistent with this obligation. Totality directs that anatomical completeness must not be sacrificed without proportional justification. Integrity focuses on maintaining basic human capacities and provides a hierarchical ordering of higher functions over lower functions for use in decision making. The decisions of secular American (...) courts rely heavily on statutory authority and case precedent. This essay explores whether the moral principle of totality and integrity is reflected in judicial opinions. The first part examines judicial decisions in cases in which the plaintiff’s desired outcome was consistent with the principle of totality and integrity. In the science of administrative and constitutional law, administration science and many other sciences, including political science, it is widely accepted that the basic, inherent feature of a municipality, deciding the essence of the territorial self-government unit as an entity of public administration, is the self-reliance it is entitled to. The self-reliance of territorial self-government units is even defined as a constitutional norm.In principle, self-reliance is perceived as a fundamental attribute of a decentralised public authority and constitutes one of (...) the fundamental systemic principles of the Republic of Poland. It was formulated expressis verbis in art. 165 par. 2 of the Constitution of the Republic of Poland, which states that the self-reliance of territorial self-government units is subject to judicial protection, meaning that TSGUs can defend themselves against illegal attempts, not grounded in the law to interfere in their self-reliance. This protection seems to encompass both the private-law and public-law spheres of territorial self-government activity.The essence and guarantees of territorial self-government units’ self-reliance also arise from other constitutional principles, including the aforementioned decentralisation principle, subsidiarity principle, separation of powers, supremacy of the nation and democratic state under rule of law.The goal of this article is to interpret the principle of municipal self-reliance in the context of constitutional principles of law, in the light of the Polish Constitution.
