If a law contains vague terms, the question whether it applies to a particular case often lacks a clear answer. One of the fundamental pillars of the rule of law is legal certainty. The determinacy of the law enables people to use it as a guide and places judges in the position to decide impartially. Vagueness poses a threat to these ideals. In borderline (...) cases, the law seems to be indeterminate and thus incapable of serving its core rule of law value. -/- In the philosophy of language, vagueness has become one of the hottest topics of the last two decades. Linguists and philosophers have investigated what distinguishes "soritical " vagueness from other kinds of linguistic indeterminacy, such as ambiguity, generality, open texture, and family resemblance concepts. There is a vast literature that discusses the logical, semantic, pragmatic, and epistemic aspects of these phenomena. Legal theory has hitherto paid little attention to the differences between the various kinds of linguistic indeterminacy that are grouped under the heading of "vagueness ", let alone to the various theories that try to account for these phenomena. -/- The paper is an introduction to a book of the same title. Although blurred boundaries between the normal and the pathological are a recurrent theme in (...) many publications concerned with the classification of mental disorders, systematic approaches that take into account philosophical reflections on vagueness are rare. This book provides interdisciplinary discussions about vagueness in psychiatry by bringing together scholars from psychiatry, psychology, philosophy, history, and law. It draws together various lines of inquiry into the nature of gradations between mental health and disease and discusses the individual and societal consequences of dealing with blurred boundaries in medical practice, forensic psychiatry, and beyond. -/- Part I starts with an overview chapter that helps readers to navigate through the philosophy of vagueness and through the various debates surrounding demarcation problems in the classification and diagnosis of mental illness. Part II encompasses historical and recent philosophical positions on gradualist approaches to health and disease. Part III approaches the vagueness of present psychiatric classification systems, and the debates concerning their revisions by scrutinizing controversial categories, such as posttraumatic stress disorder, and the difficulties of day-to-day diagnostic and therapeutic practice. We investigate the problem of how nonnatural entities are represented by examining university students’ concepts of God, both professed theological beliefs and concepts used in comprehension of narratives. In three story processing tasks, subjects often used an anthropomorphic God concept that is inconsistent with stated theological beliefs; and drastically distorted the narratives without any awareness of doing so. By heightening subjects’ awareness of their theological beliefs, we were able to manipulate the degree of anthropomorphization. This tendency to anthropomorphize may be (...) generalizable to other agents. God (and possibly other agents) is unintentionally anthropomorphized in some contexts, perhaps as a means of representing poorly understood.. (shrink)

At the most general level I am interested in how we come to make sense of the world around us. Much of this research involves asking how intuitive explanations and understandings emerge in development and how they are related to notions of cause, mechanism and agency. These relations are linked to broader questions of what concepts are, how they change with development and increasing expertise and how they are structured in adults.

Heidegger’s later philosophy is marked by two conflicting claims about phenomenology. On the one hand, phenomenology and philosophy generally is tasked with “responding to the claim of what is to be thought” in a novel and unprecedented manner. On the other hand, Heidegger recognizes that there have been earlier attempts at thus doing justice to phenomena; in the ontological commitments of earlier thinkers, Heidegger finds accounts of the “things themselves,” each of which has different implications for what phenomenology should concern (...) itself with. Phenomenology, as Heidegger conceives it, should thus both incorporate the history of philosophy and exceed it, yet it is unclear how these ideas can be reconciled. This chapter calls this problem the “dilemma of the historicity of phenomenology” and identifies different versions of it in Heidegger’s works after 1935/6. (shrink)

One aspect of truth concerns knowing when to trust others when one’s own knowledge is inadequate. This is an ever more common problem in societies where technological and scientific change seems to be constantly accelerating. There is an increasing need to rely on the expertise of others and consequently to know when others are more likely to be offering an objective opinion as opposed to a biased one. Here, I argue that there are systematic and early emerging cognitive heuristics and (...) biases that profoundly influence our patterns of deference, our ways of assessing expertise, and our sense of when testimony is to be trusted. For the most part, the power and pervasiveness of these biases are ignored or greatly underappreciated. These biases and heuristics can both mislead and inform our understanding and use of others’ expertise; it is therefore critical that we acknowledge their presence and know how to work with them. In Concepts, Kinds, and Cognitive Development, Frank C. Keil provides a coherent account of how concepts and word meanings develop in children, adding to our understanding of the representational nature of concepts and word meanings at all ages. Keil argues that it is impossible to adequately understand the nature of conceptual representation without also considering the issue of learning. Weaving together issues in cognitive development, philosophy, and cognitive psychology, he reconciles numerous theories, backed by empirical evidence from nominal (...) kinds studies, natural-kinds studies, and studies of fundamental categorical distinctions. He shows that all this evidence, when put together, leads to a better understanding of semantic and conceptual development. The book opens with an analysis of the problems of modeling qualitative changes in conceptual development, investigating how concepts of natural kinds, nominal kinds, and artifacts evolve. The studies on nominal kinds document a powerful and unambiguous developmental pattern indicating a shift from a reliance on global tabulations of characteristic features to what appears to be a small set of defining ones. The studies on natural kinds document an analogous shift toward a core theory instead of simple definition. Both sets of studies are strongly supported by cross cultural data. While these patterns seem to suggest that the young child organizes concepts according to characteristic features, Keil argues that there is a framework of conceptual categories and causal beliefs that enables even very young children to understand kinds at a deeper, theoretically guided, level. The present studies investigated children’s and adults’ intuitive beliefs about the physical nature of essences. Adults and children (ranging in age from 6 to 10 years old) were asked to reason about two different ways of determining an unknown object’s category: taking a tiny internal sample from any part of the object (distributed view of essence), or taking a sample from one specific region (localized view of essence). Results from three studies indicated that adults strongly endorsed the distributed view, and (...) children showed a developmental shift from a localized to distributed view with increasing age. These results suggest that even children go beyond mere placeholder notions of essence, committing to conceptual frameworks of how essences might be physically instantiated. (shrink)

This paper discusses the notion of a thing in Heidegger. Its aim is to explain the systematic place of that notion in Heidegger’s thought in relation to his ontological discourse: as what is explained through different understandings of being, things allow for a simultaneous differentiation and discussion of the different epochs in the so-called history of being. Thus a henomenology of things and thingness serves as frame of reference for all explications of ‘what there is.’ If Heidegger is a realist, (...) it is not because he attributes reality to all that is, but rather because all explanations of being refer back to how things are discovered as meaningful. Arbib et al.'s comprehensive review of neural organization, over-relies on modernist concepts and restricts our understanding of brain and behavior. Reliance on terms like coding, transformation, and representation perpetuates a “black-box approach” to the study of the brain. Recognition is due to the authors for attempting to introduce postmodern concepts such as chaos and self-organization to the study of neural organization. However, confusion occurs in the implementation of “biologically rooted” schema theory in which schemas are viewed as computer programs. If folk science means individuals having well worked out mechanistic theories of the workings of the world, then it is not feasible. Laypeople’s explanatory understandings are remarkably coarse, full of gaps, and often full of inconsistencies. Even worse, most people overestimate their own understandings. Yet recent views suggest that formal scientists may not be so different. In spite of these limitations, science somehow works and its success offers hope for the feasibility of folk science as well. The success of science (...) arises from the ways in which scientists learn to leverage understandings in other minds and to outsource explanatory work through sophisticated methods of deference and simplification of complex systems. Three studies ask whether analogous processes might be present not only in laypeople but also in young children and thereby form a foundation for supplementing explanatory understandings almost from the start of our first attempts to make sense of the world. The assumption of domain specificity has been invaluable to the study of the emergence of biological thought in young children. Yet, domains of thought must be understood within a broader context that explains how those domains relate to the surrounding cultures, to different kinds of cognitive constraints, to framing effects, to abilities to evaluate knowledge and to the ways in which domain-specific knowledge in any individual mind is related to knowledge in other minds. Heidegger’s understanding of technology advances a conceptual critique of what he calls “the enframing” (Gestell), the epistemological and ontological presuppositions underlying technology. Reconstructing the central argument of Country Path Conversation (1945), the chapter focuses the positive contrast to “the enframing” Heidegger finds in the idea of Gelassenheit (“releasement”): releasement defines a form of life marked by an intellectual independence from technology achieved through a specific form of thinking. Drawing from Haugeland, section 1 establishes “enabling” as genuine sense of the German (...) verb lassen (to let); in contrast to the form of thinking determinative of technology, which Heidegger describes as imposing, the “released” and genuine form of human thinking is an enabling thinking. In sections 2 and 3, I reconstruct the reductio ad absurdum Heidegger uses to distance this form of thinking from forms of transcendental philosophy embracing (mediational) representationalism. In section 4, I highlight the (ontic) correlate of such thinking, namely the individual things (Dinge) manifest outside the horizon of understanding presupposed by technology. Not based on or anticipating any positive ontology, I argue that “enabling” thinking is ontologically non-committal. Section 5 contrasts this understanding of Gelassenheit with views advanced by Dreyfus, Rojcewicz, Belu, and Feenberg. (shrink)

I say " appears" because so often the debaters seem to be talking past each other, arguing about different things or misunderstanding each other in such basic ways that the debates can seem to an observer as incoherent. For these reasons there has been a powerful need for a systematic treatment of the different senses of nativism and empiricism that considers both their historical contexts and their current manifestations. Cowie's book offers such a treatment, one (...) that goes far beyond prior attempts. It is a remarkably clear and insightful exposition and critique of nativist views from earliest writings to the most current debates. It helps all of us understand better what others are talking about when they don't subscribe to our brand of nativism or empiricism. It also reveals just how much theoretical and empirical work needs to be done before we can get a clear handle what is really the truth about the innateness of language, mathematics, folks psychology, and many other potential domains. Yet, despite these powerful virtues, the book also falls short on some key issues that seem necessary to laying an agenda for future empirical or theoretical work on nativism. I will tend to focus in this essay on those missing links, while also repeatedly stating that this book represents a major leap forward in making sense of what it means to say that some aspect of the mind is innate. Als Theorie solcher Verletzlichkeit wird die politische Philosophie Judith Butlers herangezogen, methodisch orientiert sich die Untersuchung an Überlegungen der Bildhermeneutik Gottfried Boehms. So entwickelt der Beitrag den Gedanken einer präreflektiver normativer Verpflichtung, der in Richters Gemälde anschaulich wird. Zum Vergleich wird die Interpretation eines Gemäldes von Werner Scholz herangezogen (Antigone), die Hans-Georg Gadamer entwickelt hat.

In the recently published manuscript “The Argument against Need” (ca. 1963), Heidegger discusses the notion of being-in-itself (Ansichsein) with regard to entities that predate the existence of knowers. Section 1 introduces the problem of so-called “ancestral facts,” which Meillassoux and Boghossian have used to argue for a specific form of realism. Sections 2 identifies a specific understanding of time as the basis for their argument. Sections 3–4 show how Heidegger rejects this account of time. Section 5 describes the general form (...) of ontologies that deny entity independence (dependence ontology). Section 6 turns to Heidegger’s account of a resistance to ontological sense-making in what he calls “beingless” (seinlos) entities. Discussing work by Haugeland and Wrathall, I conclude in section 7 that Heidegger’s response to the “argument against need” is to reject the idea of unidirectional dependence in favor of a triadic interdependence between being, entities, and us. The division of cognitive labor is fundamental to all cultures. Adults have a strong sense of how knowledge is clustered in the world around them and use that sense to access additional information, defer to relevant experts, and ground their own incomplete understandings. One prominent way of clustering knowledge is by disciplines similar to those that comprise the natural and social sciences. Seven studies explored an emerging sense of these discipline‐based ways of clustering of knowledge. Even 5‐year‐olds could cluster knowledge (...) in a manner roughly corresponding to the departments of natural and social sciences in a university, doing so without any explicit awareness of those academic disciplines. But this awareness is fragile early on and competes with other ways of clustering knowledge. Over the next few years, children come to see discipline‐based clusters as having a privileged status, one that may be linked to increasingly sophisticated assumptions about essences for natural kinds. The article sketches two accounts of failure. On a broadly Aristotelian view, failure is conceived as the privation of success; on a view I call existential failure, failure and the capacity to begin anew are seen as explanatorily more basic than success. I distinguish three types of existential failure with regard to (i) individual existence, (ii) a cultural system, (iii) humanity as a whole. While the senses in which agents fail are different on each case, an underlying feature of failing (...) in its different instances is its indirect affirmation of human freedom. To be free is to be capable of failure. I conclude by contrasting these two accounts with the scenario of human extinction. Is it a failure if our species ceases to exist? Drawing on Hans Jonas, I argue that here the contrast between excess and failure returns in a different form. (shrink)

This book provides an overview of the recent free will debate and considers the consequences of neuroscientific research for the problem of freedom. In the process of surveying the field, the author develops an original position. He takes issue with the broad philosophical consensus that at least one kind of freedom is incompatible with the scientific worldview -- namely, the ability to make decisions one way or another exactly the same circumstances. The book argues that, on closer examination, this so-called (...) libertarian view of freedom (which we accept in our everyday lives) does not contradict any facts but only philosophical doctrines. Although we're unable to alter physical laws, nor are we 'first movers,' this isn't required for us to have acted otherwise under the same circumstances. (shrink)

Die fünf Kommentare zu unserem Beitrag zeigen, dass wir uns mit unserem tugendbezogenen Kriterium für Vortragseinladungen zwischen alle Stühle gesetzt haben. Birgit Recki hält unser Kriterium für zu eng: Es schließe Personen aus, die erkenntnisbefördernde Beiträge leisten. Eva von Redecker und Daniel Loick halten unser Kriterium für zu weit: Es lasse bestimmte Formen von Rassismus zu, die an der Universität keinen Platz haben sollten. Dieter Schönecker und Maria-Sibylla Lotter sind der Meinung, wir argumentierten an den tatsächlich strittigen Fällen vorbei.
