Many authors have taken up the challenge of formulating physicalism as a supervenience thesis. These endeavors have met with varying response, but it seems that the general consensus still remains that a supervenience thesis that is both sufficient and necessary for physicalism has yet to be developed. Terence Horgan1 and Jaegwon Kim2 have most famously argued that supervenience theses are not sufficiently strong for physicalism. Nonetheless, several recent articles suggest that there are philosophers who still hold out hope for some (...) type of supervenience of the mental upon the physical being, if not both sufficient and necessary, at least necessary for physicalism.3 In this paper, I will 1) investigate some of the motivation for finding a supervenience thesis that characterizes physicalism, 2) briefly review the types of supervenience theses that have been proposed as necessary (or necessary and sufficient) for physicalism, and 3) investigate in some detail the recent supervenience thesis proposed by Frank Jackson and expounded upon by Gene Witmer. Muhammed’in Medine’ye hicret ettikten sonra, şehirde yaşayan farklı din, kültür ve ırktan insanlar arasında birlik, barış ve adaletin sağlanması için kabul edilen bir vesikadır. Anayasa, devletin işleyişini ve yetki dağılımını (...) düzenlemektedir. Medine Vesikası’nda, şehir devletinin idari, yargısal ve askeri işleyişine dair kurallar yer almaktadır. Medine Vesikası’nda, şehir devletinin üyelerinin can, mal, din, vicdan gibi temel haklarına saygı gösterilmesi istenmiştir. Ayrıca farklı din ve kültürlere mensup insanların kendi geleneklerine göre yaşamalarına izin verilmiştir. Medine Vesikası’nda da şehir devletinin üyelerinin birbirleriyle ve Peygamber ile karşılıklı olarak bazı haklarını devrettikleri görülmektedir. Medine Vesikası’nın tarihte bilinen ilk yazılı Anayasa olduğu dahi ileri sürülmektedir. Bu çalışmada Anayasa hukuku bağlamında Medine Vesikası’nın Anayasal niteliği ele alınacaktır. (shrink)

Hilâfet/imâmet meselesi, Hz. Peygamberin vefatının akabinde Müslümanlar arasında ortaya çıkan en önemli meselelerden biridir. Bu konu, özellikle Şîa’yla birlikte siyasi alandan itikâdî alana taşınmıştır. Sünnî âlimler de muhtemelen Şiî âlimlerin etkisiyle onu kelâmî konular arasına dâhil etmişler ve kitaplarında ona yer vermişlerdir. Semerkant bölgesi Hanefî-Mâtürîdî âlimlerinden Ebû Şekûr es-Sâlimî de (ö. 460/1068’den sonra) bu âlimlerden biridir. Ebû Şekûr’un hayatı hakkında Hanefî biyografi kitaplarında pek bilgi yoktur. Günümüze ulaşan et-Temhîd fî beyâni’t-tev ḥ îd adlı eserinde verdiği bazı bilgilerden hareketle Ebû Şekûr’un (...) yaklaşık olarak V. (XI.) asrın ilk yarısında doğduğu tahmin edilmektedir. O, bu eserinde genel olarak, akıl, Allah’ın varlığı, birliği, isim ve sıfatları, rüyetullâh, vahiy, i‘cazu’l-Kur’ân, kelâm-ı lafzî-kelâm-ı mânevi, nübüvvet, mucize, kerâmet, ma‘rifet, iman, imanın şartları, hilâfet ve imâmet, Ehl-i Sünnet, Ehl-i Bid‘at ve fırkaları gibi konuları ele alır. Biz makalemizde, başlığından da anlaşılacağı üzere Ebû’l-Mu‘în en-Nesefî’nin çağdaşı olan Ebû Şekûr es-Sâlimî’nin hilâfete ilişkin görüşlerini, et-Temhîd fî beyâni’t-tev ḥ îd adlı eseri çerçevesinde ortaya koymaya çalışacağız. Amacımız, V. (XI.) asırda Mâverâünnehir bölgesinde hilâfet ile ilgili gündemde olan ve tartışılan konulara bir nebze de olsa ışık tutmaktır. Bu bağlamda yazarın sahâbenin faziletleri ve efdaliyet sırasına ilişkin görüşlerine de işaret edilecektir. In this study, we try to look at Ludwig Wittgenstein's philosophy holistically rather than the early and late periods in the literature. For this, we focus on the concept of imponderable evidence, which we think captures Wittgenstein's conception of reality. This concept provides the link between Tractarian ideas, which are ponderable, and post-Tractarian ideas, which are imponderable. In his Tractatus, Wittgenstein analysed reality via the distinction between what can be said and what can be shown. In the same work, he (...) concludes the Tractarian project by stating that he has said what can be said, but the real work to be done is what can be shown. Based on Wittgenstein's ideas after the Tractatus, our study focuses on what can be shown, that is, the imponderable. The aim of our study is to show that Wittgenstein's conception of imponderable reality is objective, contrary to the perception in analytic philosophy. The concept of imponderable reality is grounded in the idea of incorporating the subjective nature of meaning into philosophical discourse in an objective manner. To include the subjective nature of meaning in philosophical discourse, Wittgenstein set certain rules and criteria in his post-Tractatus works. Thus, based on these rules and criteria, he proposes a conception of objectivity that is imponderable but self-evident. (shrink)

Bu makalede Marmara Denizi’nin Kuzeybatısında yer alan Rodosçuk/Tekirdağ kazasında yaşayan halkın beslenme kültürü ele alınmıştır. Hangi ürünlerin yaygın olarak tüketildiğini belirlemek için başvurulan temel kaynak narh defterleridir. Bilindiği üzere narh, mal ve hizmet fiyatlarının esnaf örgütlerinin görüşü alınarak devlet tarafından belirlenen üst sınırını ifade etmektedir. Piyasada bulunan malların listelerini barındırdığı için ayrı bir önem taşıyan narh defterleri ilgili kazaya ait şer’iyye sicillerinde yer almaktadır. 1638-1730 yıllarına ait narh listelerinde bulunan ürünler türlerine göre sınıflandırılarak başlıklar halinde değerlendirilmiştir. Bu araştırmada ayrıca narh (...) defterlerine yansıdığı kadarıyla Rodosçuk piyasasında bulunan yiyecek maddelerinin çeşitliliği, yakınlığı nedeniyle özellikle İstanbul’da ve Saray’da tüketilen ürünlerle karşılaştırılarak zaman içinde meydan gelen değişimler belirlenmiş ve incelenen dönemin başından sonuna kadar önemli bir dönüşümün yaşanmadığı ortaya çıkmıştır. Edmund Waldstein, and Sohrab Ahmari provoke anxiety or glee in readers' minds will depend on where they stand on integralism, the brand of Catholic traditionalism that all three have (...) sought to promote through various websites and publications. Presenting themselves as the authentic interpreters of magisterial teachings on church–state relations, the integralists have challenged the long-standing attempt (especially in North America) to combine the Catholic faith with a commitment to political liberalism, natural rights, religious liberty, and state neutrality toward religion. For the integralists, attempting such a combination succeeds only in distorting the Catholic faith and causes us to forget what the Church taught before the Second Vatican Council, which still obliges the assent of Catholics, they claim, and is desperately needed to stand against the onward march of secularism. [End Page 966]Although Thaddeus Kozinski, former professor at Wyoming Catholic College, may not be one of the more well-known integralists, his latest book presents an interesting iteration of Catholic traditionalism that displays both what is valuable and what is most worrying about contemporary traditionalism. Kozinski's previous book was a closely argued critique of John Rawls and Jacques Maritain using the thought of Alasdair MacIntyre. It built up a cumulative case for the impossibility of resolving the political problem of religious pluralism without moving beyond philosophy by making a decision to reject or accept the political importance of the Catholic Church and its teachings.1 Although the author's preference for some sort of confessional state was already clear in that book, he preferred not to defend it, but rather to argue that it is impossible to be agnostic or neutral toward the ideal of church–state union. Now he goes on the offensive, presenting in the twenty brief chapters of Modernity as Apocalypse his "sundry attempts over the past decade to grapple with the question of modernity" (14). More precisely, he is grappling with the questions of what defines modernity, how we arrived at where we are, and what Christians should do while living in it, particularly in the fields of education and politics.The two chapters that form the first part (entitled "Modernity") use Charles Taylor's A Secular Age to argue that modernity's increasingly pluralistic and secular culture creates "an entirely new incapacity to experience the reality of a particular worldview in a naïve way, that is, without the consciousness of there being other viable options" (37). Yet the problem also reveals a blessing. "Encountering reality through the lens of other perennial traditions can serve to expose that false dichotomy in our minds that leads us to interpret other views as nothing more than full-fledged errors and our own personal lenses as nothing less than the whole truth" (21). Anyone who has read what passes for commentary on websites such as Church Militant or Rorate Caeli will find that statement surprising and refreshing.The second part ("Logos") contains four chapters that lucidly discuss contemporary disagreements in ethics between Kantians and virtue-ethicists, between new natural lawyers and MacIntyreans. Chapter 4 makes an effective and moving argument to read Plato "as a precursor to Faith, and a guide along the way home" (50). There are some brief but suggestive remarks drawing on Benedict XVI's Caritas in Veritate in [End Page 967] chapter 6 to argue that an ethics of gift can enable us to express the moral teachings of the New Testament in terms that are potentially convincing to a broader audience. "Metanoia" is the title of the third part, dedicated to education. Chapters 7–8 and 10 give not very original and yet timely arguments for the importance of the liberal arts, the need for Catholic universities to be institutions that can foster, rather than deform, the practice of philosophy, and the need for pedagogy to be rooted in the transmission of a community's tradition.2However, one cannot help but be startled when... Bu çalışma, çalışanlarda işkoliklikle benlik saygısı ilişkisinde algılanan örgütsel desteğin aracılık rolünü tespit etmek amacıyla yapılmıştır. Araştırma verilerini elde etmek için, Çorum ilinde bir kamu hastanesinde görev yapan 200 çalışana anket form uygulaması gerçekleştirilmiştir. Anket formunda demografik sorular dahil olmak üzere, hastane çalışanlarında işkoliklik, algılanan örgütsel destek ve benlik saygısını ölçmeye yönelik, ülkemizdeki çalışmalarda yaygın kullanılan geçerlilik ve güvenirlik analizleri yapılmış üç ayrı ölçek kullanılmıştır. Elde edilen veriler SPSS programında belirli analizlere tabi tutulmuştur. This article argues that the chorus of elders in Sophocles' Oedipus Coloneus is far from ineffectual, as some scholars assume choruses of elders generally are, but exceptionally authoritative in its role as a chorus. The exceptional authority of the Elders of Colonus derives from their old age, wherefrom their sympathy for Oedipus obtains, and from the fact that they are Athenian and thus have the capacity to enact their sympathy for Oedipus by granting him special rights of residency as an (...) heroic protector of Athens. Detailed analysis of this particular chorus's speech, song, and action is helpful not only to our understanding of Oedipus Coloneus but also, more broadly, to our understanding of the ongoing, if not increasing, importance that the chorus will have maintained in ancient Greek tragedy. Mezheplerin teşekkül etmeye başladığı ilk dönemlerden itibaren istihsanın bir istidlal yöntemi olup olmadığı tartışılagelmiştir. Bu tartışmaların temelinde kavramsallaşma sürecini henüz tamamlamamış olan istihsan teriminin çağrıştırdığı keyfiliğin/sübjektivitenin etkisi çok fazladır. Bu yüzden istihsanı bir yöntem olarak benimseyenler, ağır ithamlara maruz kalmışlardır. İstihsanı benimseyenlerin başında Hanefî hukukçular gelmektedir. Öyle ki istihsan yöntemi Hanefî mezhebiyle anılır hale gelmiştir. Bununla birlikte mezhebin önde gelen temsilcilerinden biri olan ve kıyas metodunu kullanmasıyla ön plana çıkan Züfer b. Hüzeyl’in istihsana yaklaşımıyla ilgili iki farklı yaklaşım tespitedilmiştir. Yaptığımız (...) araştırma ve inceleme neticesinde her iki tespitinde isabetli olmadığını; Züfer b. Hüzeyl’inkıyas yapmadaki becerisinin yanı sıra istihsana müracaatta sonuna kadar kıyas taraftarı olduğunu; ancak kıyasın meselelere çözüm üretmede yetersiz kaldığı ya da doğru sonuç vermediği durumlarda ise ızdırârın da bir gereği olarak meseleyi hükümsüz bırakmama adına istihsana müracaat ettiği görülmektedir. Sonuç olarak Züfer b. Hüzeyl’in genel hatlarıyla Hanefî usulüne bağlı kalmakla birlikte istihsanı bir istidlâl yöntemi olarak kullanma hususunda çerçeveyi oldukça daralttığını; kıyasa başvurma konusunda ise sınırları mümkün olduğunca geniş tuttuğunu söylemek mümkündür. İctihad hürriyeti ve hukûkî zenginlik açısından oldukça önemli olan Hanefi mezhebindeki mezhep içi ihtilaflar, hukûkî istikrar ve emniyeti tehdit etme potansiyeli taşımakta ve ayrıca ihtilaflı meselelerde hüküm veya fetva verecek fakihlerin işini zorlaştırmaktadır. Bu nedenle mezhep içerisindeki ihtilaflı meselelerde râcih görüşü tespit etmek, diğer bir ifadeyle mezhep içi tercih, zorunlu bir ihtiyaçtır. Mezhep içi tercih, “muayyen bir mesele ile ilgili mezhepteki muhtelif kavil veya rivayetlerden daha ağır basanı, üstün olanı belirlemek” şeklinde tarif edilebilir. Tarihi süreçte bu ihtiyacı karşılamak için muhtasar ve fetva kitapları gibi farklı telif türleri; esahh-ı akvâl ve maʻrûzât gibi farklı uygulamalar ortaya çıkmıştır. Bu ihtiyacı gidermeyi hedefleyen uygulamalardan biri de Osmanlı Devleti’nin son dönemindeki kanunlaştırmalardır. Fıkha dayalı kanunlaştırmanın ilk örneği olan Mecelle-i Ahkâm-ı Adliyye ile mezhep içi tercih arasındaki ilişki ve bu bağlamda Mecelle hazırlanırken, mezhep içi tercihte nasıl bir usûl izlendiği; râcih görüşe ne oranda uyulduğu; Mecelleʼde yer alan râcih görüşe aykırı kanun maddeleri ve bunların gerekçeleri; ihtilaflı bütün konularda düzenleneme yapılıp yapılmadığı ve râcih görüşleri belirleme ihtiyacının ne kadar giderildiği, incelenmesi gereken konulardır. Mecelle-i Ahkâm-ı Adliyye gibi bir kanun metnine ihtiyaç duyulmasının temel nedenlerinden birisi, Hanefî mezhebinde mezhep içi ihtilafların çokluğudur. Buna bağlı olarak Mecelleʼnin hedefi râcih görüşler içeren oluşan bir kanun hazırlamaktır. Mecelle’nin esbâb-ı mûcibeleri mezhep içi tercih açısından incelendiğinde, esbâb-ı mûcibelerin iki temel işlevi olduğu görülür. Bunlardan ilki, kanunun büyük oranda mezhepteki râcih görüşlere uygun olarak hazırlandığını vurgulamaktır. Öyle ki, Mecelle’nin ilk on kitabının esbâb-ı mûcibelerinde bu husus mutlaka ifade edilmektedir. Esbâb-ı mûcibelerin diğer işlevi ise niçin bazı maddelerde râcih görüşe riayet edilmediğini gerekçelendirmektir. Esbâb-ı mûcibelerde on iki maddenin râcih olmayan görüş doğrultusunda hazırlandığı belirtilmektedir. Mecelleʼnin 1851 maddeden oluştuğu göz önünde tutulduğunda Mecelleʼnin muhtevasında râcih görüşlerin ne kadar etkili olduğu daha iyi anlaşılacaktır. Esasen devrin özelliği de bunu zorunlu kılmaktadır. Zira Kitâbüʼl-Havâlenin 692. maddesinde Züferʼin râcih olmayan görüşünün tercih edilmesi, başta Şeyhülislam Hasan Fehmi Efendi olmak üzere bazı çevrelerin tepkisine neden olmuş ve bu sebeple Ahmet Cevdet Paşa Divân-ı Ahkâm-ı Adliyye nâzırlığından ve Mecelle Komisyonu başkanlığından azledilmiştir. Râcih görüşe aykırı maddelerin esbâb-ı mûcibeleri incelendiğinde, bu yöndeki tercihlerde maslahat ve örfün belirleyici olduğu görülmektedir. Ayrıca bazı fakihlerin tercihlerinin de bir tercih sebebi olarak zikredildiği görülmektedir. Hanefi kaynaklarda en sık karşılaşılan tercih sebebi naslara uygunluktur. Buna karşın Mecelleʼde sefîhin hacri konusu dışında, naslara uygunluğun bir tercih sebebi olarak işletilmemesi dikkat çekicidir. Mecelle Komisyonunun bazı tercihlerine diğer kurumlarca müdahale edilmiştir. Komisyonca hazırlanan kitaplar hem Meclis-i Vükelâ hem de Meşîhat tarafından incelenmiş ve bu esnada bazı tashihlere konu olmuştur. İşte râcih olmayan görüş esas alınarak hazırlanan iki maddeye Meclis-i Vükelâ tarafından müdahale edilmiştir. Bunların birincisi hakk-ı mürur ve hakk-ı şirbin müstakil olarak satımının cevazını savunan Belh Meşâyihinin görüşü doğrultusunda yazılan 216. madde, ikincisi ise ecîr-i müşterekin tazmin sorumluluğunu düzenleyen 611. maddedir. Mecelle’nin ilk ve en hacimli kitabı olan Kitâbüʼl-Büyûʻun muhtevası mezhep içi tercih açısından incelendiğinde, ihtilaflı konularda genelde mezhepteki râcih görüşün esas alındığı görülmektedir. Kitâbüʼl-Büyûʻun esbâb-ı mûcibesinde, dört meselenin râcih olmayan görüş esas alınarak hazırlandığı ifade edilmekte ve bu tercihler örf ve maslahatla gerekçelendirilmektedir. Ancak Kitâbüʼl-Büyûʻdaki râcih görüşe aykırı maddeler bunlarla sınırlı değildir. Bizim araştırmamıza göre bunlara ilaveten üç madde daha râcih olmayan görüş tercih edilerek hazırlanmıştır. Bunlar beyʻ biʼl-vefânın menkullerde cevazına dair 118. madde, gabn-i fâhişin tanımı hakkındaki 165. madde ve şart muhayyerliğinin hükmü ile ilgili 309. maddedir. Bu üç madde, Mecelleʼdeki râcih görüşe aykırı düzenlemelerin sadece esbâb-ı mûcibelerde açıklananlardan ibaret olmadığını göstermektedir ve bu durum Mecelle hazırlanırken izlenen usûle aykırıdır. Hanefi mezhebindeki bazı ihtilaflı meselelerde hangi görüşün râcih olduğu konusunda tercih ehli fakihler ihtilaf etmişlerdir. Bu meselelerde Mecelleʼde düzenleme yapılırken nasıl bir yol izlendiği açıklanmamıştır. Bu meseleler incelendiğinde çoğunluk tarafından tercih edilme, kolaylığı temin etme ve bazı fakihler tarafından tercih edilme gibi hususların etkili olduğu söylenebilir. Mecelleʼdeki tercihler sadece şerʻî hükümler arasında gerçekleşmemiştir. Buna ilaveten tanımlar ve tanımlarda yer alan kayıtlar da tercihe konu olmuştur. Bu kapsamda Kitâbüʼl-Büyûʻdaki beyʻ akdi, mevkûf akid ve gabn-i fâhişin tanımına ilişkin tercihler örnek olarak zikredilebilir. Hanefi mezhebin içerisindeki ihtilaflı bazı meseleler Mecelleʼde düzenlenmemiştir. İhtilaflı meselelerin çokluğu ve dolayısıyla bütün bunları kapsayan bir kanun hazırlamanın zorluğu dikkate alındığında bu durum doğaldır. Ayrıca bu meselelerden bazıları sık gerçekleşmediği ve lüzumlu görülmediği için Mecelleʼde düzenlenmemiş olabilir. Ancak düzenleme yapılmayan ihtilaflı meselelerin tamamını bu sebeplerle izah etmek mümkün değildir. Zira yasal düzenleme yapılmayan ihtilaflı meselelerin bazıları temel, görece önemli meselelerdir ve muhtasarlarda yer almaktadır. Bu durum Mecelle hazırlanırken, ihtilaflı bazı meselelerde tercih yapmak yerine bu meselelere ilişkin düzenleme yapmama metodunun benimsendiğini göstermektedir. İhtilaftan ârî bir kanun metni oluşturmanın bir yolu olarak da bu usûlün benimsendiği söylenebilir. Böylece bu meselelerde râcih görüşü tespit etme işi hâkimlere bırakılmıştır. Bu durum Mecelleʼnin hedefi olan râcih görüşleri tespit etme ihtiyacını gidermeye uygunluk arz etmemektedir. Ancak bu durum bütün meseleleri kuşatan bir kanun yapmanın güçlüğünün bir sonucudur. Despite their strong transnational links and support in the second half of the 1990s, Turkish NGOs have not yet had a “tremendous” impact on domestic political and social change. But new points of contact have been established in the public sphere between governmental agencies and the IHV and IHD, with both sides engaged in an argumentative process, which may, in the long run, lead to the subscriptive phase of “human rights talk” and deed. The general tenor of this essay may (...) lend itself to suggesting two prerequisites for establishing such a sustainable human rights regime in this geography: the first is “capacity building”, the other is grounding this regime in an accurate perception of the structures of power, domestic and international, so as to “integrate” the human rights bundle into all aspects of life, at all levels, within all traditions and institutions by empowering the community into the language of human rights. Most of all, integration of human rights into a liberal democratic order requires coming to terms with the past.Capacity building can be defined in different terms: in the words of Mary Robinson, the UN High Commissioner for Human Rights, it is “facing-up to the bullies.” It is a cliché that the legalistic entrenchment of human rights is sufficient guarantee against their violation. It is almost unrealistic to expect a system to volunteer to set up a human rights regime that will limit and cripple the power it wields. So, what to do? Mary Robinson suggests a “national plan,” as, opposed to fragmented political notions, building a sustainable model with strong bricks and mortar. As Robinson notes, “even where there are plans, plans without effective strategies for implementation are empty vessels.” We could add more: in contexts like Turkey where “special circumstances” provide the pretext for legitimating an anti-human rights discourse, Mary Robinson's national plan's chances of success depend on building a strong survival capacity for any civilian government that works to bring, itself, the urban middle classes, civil society and the military into the realities embedded in human rights. This paper attempts to account for the contrastive discourse connective (tam) tersine (‘on the contrary’) in Turkish discourse. We suggest that this connective evokes a discourse structure which has at least three parts: the material in the prior linguistic context, its refutation, and then rectification in the clause where the connective is hosted. Since negation is obligatory in the discourse context for refutation, we include a discussion of negation and we conclude that the obligatory negative clauses are instances of descriptive (...) negation rather than metalinguistic negation. We show that linguistic and cognitive contexts interact in producing and interpreting the discourse adverbial connective under discussion and the discourse structure in which it is used. It is claimed that (tam) tersine serves to bring closer the cognitive context of the intended audience to that of the writer’s while minimizing any potential discrepancies in the audience’s and the writer’s cognitive context. We argue that this discourse connective and the discourse it evokes are used in the argumentative mode. (shrink)

The phenomenological ontologies of Sartre and Merleau-Ponty have often been discussed in comparison to one another. Often, a Merleau-Pontian critique of Sartre, based on subjectivity, has been given. In doing so, both Sartre’s and Merleau-Ponty’s views on freedom, facticity, the body, and the Other has been discussed in great detail. Despite all of this, however, not much emphasis has been given to their understanding of negativity in its relation to the construction of Self as the Being-in-the-world of human-reality. Accordingly, this (...) article will focus on the relationship between subjectivity and negativity in Sartre and Merleau-Ponty with a specific emphasis on Merleau-Ponty’s critique of Sartre’s philosophy of negation. First, the article will expand on Sartre’s philosophy of negation and explain how he conceives the experience of nothingness as the foundation of subjectivity. Later, it will develop a Merleau-Pontian critique of Sartrean philosophy of negation (a) by claiming that Sartrean negativity degenerates into pure and absolute positive of the Cartesian duality, and most importantly, (b) by showing how Merleau-Ponty constructs a new dialectical ontology of Self, based on the world-as-me; a being that is seen as flesh. Medical malpractice has attracted the attention of people and the media all over the world. In Turkey, malpractice cases are tried according to both criminal and civil law. Nurses and midwives in Turkey fulfill important duties in the distribution of health services. The aim of this study was to reveal the legal procedures followed in malpractice allegations and malpractice lawsuits in which nurses and midwives were named as defendants. We reviewed 59 nursing and midwifery lawsuits reported to the Higher Health (...) Council between 1993 and 1998. Health professionals were held liable in 59% of the lawsuits. Midwives had the highest percentage of malpractice liability (52%), followed by physicians (29%) and nurses (19%). To reduce potential liability, nurse education should be improved, a nursing malpractice law should be enacted, and instructions for nursing procedures should be formulated. (shrink)

A path scheme for a game is composed of a path, i.e., a sequence of coalitions that is formed during the coalition formation process and a scheme, i.e., a payoff vector for each coalition in the path. A path scheme is called population monotonic if a player’s payoff does not decrease as the path coalition grows. In this study, we focus on Shapley path schemes of simple games in which for every path coalition the Shapley value of the associated subgame (...) provides the allocation at hand. Obviously, each Shapley path scheme of a game is population monotonic if and only if the Shapley allocation scheme of the game is population monotonic in the sense of Sprumont (Games Econ Behav 2:378–394, 1990). We prove that a simple game allows for population monotonic Shapley path schemes if and only if the game is balanced. Moreover, the Shapley path scheme of a specific path is population monotonic if and only if the first winning coalition that is formed along the path contains every minimal winning coalition. We also show that each Shapley path scheme of a simple game is population monotonic if and only if the set of veto players of the game is a winning coalition. Extensions of these results to other efficient probabilistic values are discussed. (shrink)

In order to prepare bioethics and clinical ethics courses for clinicians in Turkey, we needed to know the attitudes of physicians when placed in ethically difficult care situations. We presented four cases to 207 physicians who are members of the Physicians’ Association in Kocaeli, Turkey. Depending on the decisions they made in each case, we determined whether they were aware of the ethical aspects of the cases and the principles they chose as a basis for their decisions. We aimed to (...) gain information about their ethical tendencies and moral sensitivity. A small number of physicians stated that they would ‘show respect for a patient’s living will’ in the first case, but more stated that they would ‘let the patient refuse the treatment’ in the second. In the third case, where medical confidentiality was the significant ethical issue, most of the physicians said that they would act in order to maintain confidentiality. For the last case, more than half the physicians chose to ‘tell the truth’ to the patient. The paternalism shown in the doctors’ decisions on the first two cases was no longer observed in those made for the last two cases. We concluded that the physicians who participated in our study have low sensitivity to living wills (or advance directives) and patients refusing treatment. However, when issues of medical confidentiality and truth-telling are concerned, they take care to protect the autonomy of the individual and are relatively more aware of the ethical aspects of these cases. I start with a detailed but partial analysis of a case regarding grade inflation. The case is inspired by the discussion in Crumbley et al. (2010) and its elaboration in Roberts (2016). I supplement the case description by introducing certain facts that are not in the original discussion. The subsequent analysis is based on this enriched case description. I then raise a number of objections against my analysis. An important metaethical, methodological question emerges while responding to these objections. To what (...) extent are characterizations of moral situations and their descriptions independent from moral commitments? Is there a neutral concept of moral relevance? I argue that we do not have a theory-neutral concept of moral relevance, and that case descriptions essentially presuppose moral commitments. From my moral perspective, as this perspective is reflected in the enriched case description I utilize, the original case description of grade inflation already involves utilizing the wrong moral perspective or theory. The aim of the present study is to evaluate Sonja Foss’s Rhetorical Schema for the Evaluation of Visual Imagery as well as reflect upon several points for further consideration; and finally suggest a renewed triadic approach as a method for analyzing art-relevant visual imagery. The triadic approach to be discussed assumes three correlative layers: the intellectual knowledge, function of the artistic content as the visual representational component, and aesthetics as modality. This study will include the analysis of a print advertisement (...) that used an artwork as its content of visual rhetoric, and this will inform further discussions on the proposed approach. The contribution of this renewed triadic approached to the field of visual rhetoric has the advantage of expanding and possibly improving rhetorical analysis methods of visual imagery. (shrink)

The institutional model as delineated by classical Public Administration has limited utility for public administration in the developing countries. There are unlikely to be any uniform structural remedies foradministrative defects in those countries. Similar relationships do not have similar consequences in different contexts. An increased awareness along these lines led to the emergence of Development Administration- an effort to relate structures to goals - and Comparative Public Administration - analysis of administrative structures in their own societal contexts. The basic argument (...) of the present articles is that despite our increased sophistication on these matters the relevance in Development Administration cannot be obtained if one relies only on theoretical knowledge. It is noted that in Development Administration thinking must descend from the heights of systematic theory to the open country of praxis. (shrink)

The importance of “brand dilution” is changing with the rise in internet-mediated consumer power and increasing consumer involvement in the brand identity and message creation processes. In light of recent legal rulings, this study re-conceptualizes brand dilution as a matter of counter-posed brand meanings and associations in digital markets. Anti-branding dilution cases from both a blurring and a tarnishment dilution basis are examined through consumer interviews. The results show that consumer anti-branding has less potential for brand dilution, and more potential (...) for brand identity collusion. By addressing both legal and marketing views of the meaning systems associated with the dilution versus collusion perspectives, this study provides an approach for understanding anti-branding dilution discussions and a way to develop better functioning branding exchange systems for digital markets. Consequently, possible changes in future branding ownership issues for digital markets are envisioned. (shrink)
