Background: The management of challenging behaviours in inpatient with intellectual disability and/or autism spectrum disorders can lead to an escalation of control measures. In these complex situations where patients have an intellectual disability/autism spectrum disorder accompanied by a psychiatric comorbidity, the experiences of caregivers related to the crisis management have rarely been studied. Purpose: This study examined the moral experiences of caregivers related to challenging behaviours’ management and alternatives to control measures. Research design: Using Charles Taylor’s hermeneutic framework, a 2-month (...) focused ethnography with a participatory approach was used. Participants and research context: Sixteen caregivers were interviewed in a Canadian mental health setting for adults with intellectual disability/autism spectrum disorder and psychiatric comorbidity. Ethical considerations: The research was conducted in compliance with the Declaration of Helsinki and local Research Ethics Board approval. Written informed consent was collected systematically from participants. Findings: By accounting for caregivers’ moral experiences, this study sheds light on a neglected dimension of the care relationship: the vulnerability of the caregiver. We highlight the main barriers and facilitators to alternatives to control measures. First, a caregiver’s vulnerability was characterised by the overall impact of challenging behaviours and the moral distress associated with the use of control measures and exclusion mechanisms of intellectual disability/autism spectrum disorder patients. Second, a strong ambiguity between care and control measures and a lack of inclusive approaches were identified as the two main barriers to challenging behaviour management. Third, the involvement, both professional and personal, of caregivers was deemed necessary to implement alternatives to control measures. Discussion: A conflict of values opposes two conceptions of autonomy: a rational autonomy, which is counterproductive to the reduction of control measures, versus a relational autonomy based on shared vulnerability. Conclusion: The recognition of caregiver’s vulnerability is a benchmark to create alternative approaches, which defuse the logic of control and promote an ethics of care within which caregivers’ self-concern can be understood as fostering mutual respect. An agent whose preferences violate the Independence Axiom or for some other reason are not representable by an expected utility function, can avoid 'dynamic inconsistency' either by foresight ('sophisticated choice') or by subsequent adjustment of preferences to the chosen plan of action ('resolute choice'). Contrary to McClennen and Machina, among others, it is argued these two seemingly conflicting approaches to 'dynamic rationality' need not be incompatible. 'Wise choice' reconciles foresight with a possibility of preference adjustment by rejecting the two (...) assumptions that create the conflict: Separability of Preferences in the case of sophisticated choice and Reduction to Normal form in the case of resolute choice.. In this article, I will argue in favor of both the ethical and epistemological utility of explanations in artificial intelligence -based medical technology. I will build on the notion of “explicability” due to Floridi, which considers both the intelligibility and accountability of AI systems to be important for truly delivering AI-powered services that strengthen autonomy, beneficence, and fairness. I maintain that explicable algorithms do, in fact, strengthen these ethical principles in medicine, e.g., in terms of direct patient–physician contact, as (...) well as on a longer-term epistemological level by facilitating scientific progress that is informed through practice. With this article, I will therefore attempt to counter arguments against demands for explicable AI in medicine that are based on a notion of “whatever heals is right.” I will elucidate my elaboration on the positive aspects of explicable AI in medicine as well as by pointing out risks of non-explicable AI. One of the reasons for adopting hyperbolic discounting is to explain preference reversals. Another is that this value structure suggests an elegant theory of the will. I examine the capacity of the theory to solve Newcomb's problem. In addition, I compare Ainslie's account with other procedural theories of choice that seem at least equally capable of accommodating reversals of preference.

Various U.S. laws, such as the Clean Air Act and the Food Quality Protection Act, require additional protections for susceptible subpopulations who face greater environmental health risks. The main ethical rationale for providing these protections is to ensure that environmental health risks are distributed fairly. In this article, we (1) consider how several influential theories of justice deal with issues related to the distribution of environmental health risks; (2) show that these theories often fail to provide specific guidance concerning policy (...) choices; and (3) argue that an approach to public decision making known as accountability for reasonableness can complement theories of justice in establishing acceptable environmental health risks for the general population and susceptible subpopulations. Since accountability for reasonableness focuses on the fairness of the decision-making process, not the outcome, it does not guarantee that susceptible subpopulations will receive a maximum level of protection, regardless of costs or other morally relevant considerations. Beliefs come in different strengths. What are the norms that govern these strengths of belief? Let an agent's belief function at a particular time be the function that assigns, to each of the propositions about which she has an opinion, the strength of her belief in that proposition at that time. Traditionally, philosophers have claimed that an agent's belief function at any time ought to be a probability function (Probabilism), and that she ought to update her belief function upon obtaining (...) new evidence by conditionalizing on that evidence (Conditionalization). Until recently, the central arguments for these claims have been pragmatic. But these putative justifications fail to identify what is epistemically irrational about violating Probabilism or Conditionalization. A new approach, which I will call epistemic utility theory, attempts to remedy this. It treats beliefs as epistemic acts; and it appeals to the notion of an epistemic utility function, which measures of how epistemically valuable a particular belief function is for a particular way the world might be. It then formulates fundamental epistemic norms that are analogous to the fundamental practical norms that underlie decision theory. I survey the results obtained so far in this young research project, and present a sustained critique of certain assumptions that have been made by a number of philosophers working in this area. It says that happiness is the only thing desirable as an end. One of the fundamental components of the concept of economic rationality is that preference orderings are “complete,” i.e., that all alternative actions an economic agent can take are comparable. The idea that all actions can be ranked may be called the single utility assumption. The attractiveness of this assumption is considerable. It would be hard to fathom what choice among alternatives means if the available alternatives cannot be ranked by the chooser in some way. In addition, the efficiency criterion (...) makes sense only if one can infer that an individual's choice reflects the best, in expected welfare terms, among all choices that individual could have made. The possibility that a rearrangement of resources could make someone “better off” without making others “worse off” can be understood only if the post-rearrangement world is comparable with the pre-rearrange-ment world. This article considers Bentham's response to the criticism of utilitarianism that it allows for and may even require the sacrifice of some members of society in order to increase overall happiness. It begins with the contrast between the principle of utility and the contrasting principle of sympathy and antipathy to show that Bentham regarded the main achievement of his principle as overcoming the subjectivity he found in all other philosophical theories. This subjectivism, especially prevalent in theories of rights, might (...) well lead to the sacrifice of the individual. The principle of utility was presented as an ‘objective’ theory that avoided the difficulties of other moral and political theories. The article also considers the importance of universally applicable ends, such as security and equality, as part of the principle of utility, and especially Bentham's view of maximizing pleasure as being a distributive rather than an aggregative idea. The article concludes by criticizing H. L. A. Hart's interpretation of the role of equality and rights in Bentham and John Stuart Mill, and argues that Mill's doctrine of moral rights builds on foundations originally established by Bentham, foundations which would preclude the sacrifice of individuals. This paper interrogates the concept of luck in cancer diagnosis. I argue that while it might have some utility for individuals, at the clinical and research level, the concept impedes important prevention efforts and misdirects sources of blame in a cancer diagnosis. Such use, in fact, has the possibility of harming already vulnerable efforts at ameliorating social determinants of health and should therefore be eliminated from research and clinical contexts.

In some applications to human beings, the precautionary principle seems to raise specific ethical concerns. For instance, it has been used by a business owner in a court of justice to justify his refusal to hire applicants with a certain geographical origin for safety reasons. Or in public management, the precautionary principle has been used to exclude men who have sexual relations with men from donating blood on the basis of a higher HIV prevalence in this group. Does not the (...) precautionary principle here amount to justifying a form of discrimination? To help analyze what is at stake from a decision-theoretic viewpoint and to consider the possibility of ethical catastrophes, we offer a lexical utility model of the precautionary principle, which generalizes a previous model by Bartha and DesRoches (Synthese 199:8701–8740, 2021), Steel and Bartha (Risk Anal https://doi.org/10.1111/risa.13892, 2022). Traditional expected utility theory also comes out as a special case of the model. Our proposal opens new perspectives for considering ethical dilemmas within a precautionary approach. It is intended to serve as a guiding tool for management teams in socially responsible companies, public institutions, and government agencies. (shrink)

Climate change, rising energy costs, and other dilemmas raise the prospect for major change in energy-ecology-society relations. Two prominent proposals for change include: a nuclear power renaissance; and mega-scale renewable energy development. Both suggest that modern society will receive a rising stream of less CO2-rich kilowatt-hours, so that increased energy consumption and economic growth can continue. The article doubts these CO2 claims and finds both options lead to deepening unsustainability and environmental injustice. A third approach is proposed. A new institutional (...) and community strategy called a Sustainability Energy Utility. The SEU looks to reduce energy use and seeks to support remaining energy needs by community-scale renewables. To accomplish deep energy change, the authors show how an SEU can move society from an energy commodity to energy commons regime. Commonwealth economy and community trusts are key means to significant change: a future commons is offered as the more appropriate strategy. (shrink)

In my dissertation, I analyze, interpret, and defend John Stuart Mill's proof of the principle of utility in the fourth chapter of his Utilitarianism. My purpose is not to glorify utilitarianism, in a full sweep, as the best normative ethical theory, or even to vindicate, on a more specific level, Mill's universalistic ethical hedonism as the best form of utilitarianism. I am concerned only with Mill's utilitarianism, and primarily with his proof of the principle of utility. My overarching (...) purpose guiding the entire work is to show that Mill proceeds intelligibly and systematically in pursuing a well-defined project in the fourth chapter of Utilitarianism, and that he successfully defends what he sets out to establish in his proof of the principle of utility. To this end, I devote the bulk of my efforts to studying and responding to traditionally popular and persistently enduring objections to the proof that are handed down from one generation to the next in the philosophical community as a standard companion to Utilitarianism. The primary objections to which I respond at length are the charges that Mill commits the naturalistic fallacy, the fallacy of equivocation, and the fallacy of composition in his proof. Secondary literature on the subject consists of journal articles and book chapters that treat one or another but not all of these problems. My research has convinced me that, although these commentaries are generally quite good, they are mutually incompatible, and they are neither severally nor jointly sufficient to produce the kind of comprehensive defense that would do justice to Mill's proof of the principle of utility. This kind of comprehensive defense is what I intend to contribute to secondary literature on the subject. Specifically, my ultimate contribution to secondary literature is an interpretation of Mill's proof of the principle of utility in its entirety, absolved of the three fallacies commonly attributed to the proof, yet faithful to the text at all points. In this paper, I investigate the betting behavior of a decision-maker who can influence the likelihood of the events upon which she is betting. In decision theory, this is best known as a situation of moral hazard. Focusing on a particularly simple case, I sketch the first systematic analysis of moral hazard in the canonical Savage framework. From the results of this analysis, I draw two philosophical conclusions. First, from an observational and a descriptive point of view, there need to (...) be no incompatibility between moral hazard and the Savage framework. This qualifies the incompatibility view, that is ubiquitous in decision theory. Second, in general, moral hazard is not sufficient to overcome the challenges posed by state-dependent utility to the behavioral identification of beliefs. This qualifies the sufficiency view, that is influential in decision theory. These two philosophical conclusions are the main contributions of my paper. (shrink)

Ellsberg (The Quarterly Journal of Economics 75, 643–669 (1961); Risk, Ambiguity and Decision, Garland Publishing (2001)) argued that uncertainty is not reducible to risk. At the center of Ellsberg’s argument lies a thought experiment that has come to be known as the three-color example. It has been observed that a significant number of sophisticated decision makers violate the requirements of subjective expected utility theory when they are confronted with Ellsberg’s three-color example. More generally, such decision makers are in conflict (...) with either the ordering assumption or the independence assumption of subjective expected utility theory. While a clear majority of the theoretical responses to these violations have advocated maintaining ordering while relaxing independence, a persistent minority has advocated abandoning the ordering assumption. The purpose of this paper is to consider a similar dilemma that exists within the context of multiattribute models, where it arises by considering indeterminacy in the weighting of attributes rather than indeterminacy in the determination of probabilities as in Ellsberg’s example. This article extends the Humean example of evolutionary stakeholder theory introduced in Kline and McDermott (2019). In that article, it was established that the Cost of Service Regulation (COSR) rules created by regulatory commissions, courts, and legislation was an example of evolutionary stakeholder theory. Ultimately, the Supreme Court decision in the Hope Natural Gas case established that it was not the method, but the result reach that was important. If the result reach balanced the interests of stakeholders then the outcome (...) was just and reasonable. Kline and McDermott (2019) also established that the COSR process was rather robust in terms of stakeholder participation. The purpose of this article is to extend the analysis to examine one of the most turbulent periods in COSR's history: the Post‐OPEC oil crisis of the 1970s–1980s. The effects of this period called into question the efficacy of the COSR process and led, as evolutionary stakeholder theory predicts, to a series of engagements by stakeholders to modify the rules of the process to achieve a better balance in the publics' interest. While adjudicatory in nature, the COSR process enabled cooperative solutions to redress the imbalances created by the OPEC oil shocks, improvements in information gathering, processing and decision‐making were all products of the evolutionary stakeholder process that regulators engaged in with stakeholders. This paper aims to study Bentham’s utility and its meaning of moral education. To compute pleasures and pains in Bentham is not a simple calculation. As seen in this paper, his concern of pleasures and pains is toward the community based on the pursuit of happiness by a private individual. For the greatest happiness, he does not have to have the excessive interest in the community, because of the simple feature that the community consists of private individuals and each (...) action in their lives is under the nature of the production of pleasure and of the avoidance of pain. The key to complete Bentham’s plan in IPML is to get the conception of the art of ethics. In Bentham, ethics is the art of directing men’s actions to produce the greatest happiness. Important in his definition is that he distinguishes it into two sections: private and legislation. He recognizes private sections that do not have to be intervened by legislation. A private individual has to control a motive and actions of self-regarding in the course of expressing his duty to himself for his neighbors. The action of the individual is not necessary to be the same of legislation, while the art of legislation is always to control happiness in the results of their performances. That is the art of ethics. More important, subsequently, is the art of moral education. In Bentham, the moral part of education is to cultivate a lot of affections. In fact, he emphasizes the importance of considering a motive as the springs of actions in calculating pleasures and pains. In his view, different actions have the same motive, so that the greatest happiness can be controlled from the beginning of the actions. Therefore, the art of moral education is to deal with a motive in terms of its expected pleasures and pains, in the process of performing an individual’s duty to himself, that is, of expressing his duty toward his neighbors. This paper would utilize his scheme of the art of moral education by drawing a questionnaire in the areas of moral sensitivity, judgement, motivation and practice. (shrink)

In the present paper we study the framework of additive utility theory, obtaining new results derived from a concurrence of algebraic and topological techniques. Such techniques lean on the concept of a connected topological totally ordered semigroup. We achieve a general result concerning the existence of continuous and additive utility functions on completely preordered sets endowed with a binary operation ``+'', not necessarily being commutative or associative. In the final part of the paper we get some applications to (...) expected utility theory, and a representation theorem for a class of complete preorders on a quite general family of real mixture spaces.
