이 글의 목적은 『의례』에서 빈번하게 행해진 祭를 고찰하기 위해 祭儀節의 구체적인 형상에 주안점을 두고, 제지내는 의절이 제를 의미하는 형상으로 해명하고, 이 과정에서 祭와 祭禮의 차이를 명료하게 드러내는 데 있다. 『의례』 17편 가운데 12편에서 수많은 제가 의절에서 제례와 구별되지 않았던 점에 주목한 것이다. 연구를 위해 『주례』의 九祭를 통해 주소가의 해석을 참고하고, 『역전』에서 본뜸의 형상론과 춘추시대의 子産(정나라 大夫)의 사상에서 드러나는 法象論에 기댄다. 따라서 이 연구는 제 의절을 해명하려는 시론적 고찰이다.BR 祭가 祭祀혹은 祭禮를 포함하는 원형으로 쓰이거나 민속적인 고수레로도 널리 해석되는데 굳이 이들을 구분하지 (...) 않았던 까닭은 무엇일까? 제지내는 儀節을 고려하지 않았기 때문이다. 振祭·隋祭·擩祭등의 이름에서 드러나 듯 흔드는 형상, 제기 사이에 떨어뜨려 놓는 형상, 소금과 젓갈에 묻히고 적시는 형상이 곧 제지냄이다. 의절의 의미가 그 형상에 부여된 것으로 보기 때문이다. 희생을 들어 올린 것이 공경을 의미하고 일상에서 음식을 섭취하는 과정과 음식을 다루는 과정을 제 의절로 삼았는데 注疏家는 이를 음식과 음식을 처음 만든 이에게 보본반시하는 마음으로 말한다. 그런데 제 의절은 제지내는 형상이기에 제의 의미는 형상에서 발견되어야 한다. 이 과정에서 제지내는 주체가 몸소 제 의절에 동참해야 비로소 제지냄이 성립되는 것을 보이고자 한다. In the seventeenth century, missionaries in China translated a vast array of Chinese works, including classics, official histories, and legal documents. Their translations have been analysed through several perspectives, yet their use of Chinese dictionaries has been largely overlooked. In the context of the Rites Controversy, between the Jesuits on one side and the Dominican and Franciscan friars on the other, precise references to authoritative Chinese dictionaries were made to corroborate their interpretation of Chinese rituals as either religious or (...) secular. This article first describes why and how missionaries started from the early beginning of the mission in the 1580s to write their own bilingual dictionaries based on existing Western and Chinese dictionaries. Then, it considers how the same dictionaries became an important reference when the Rites Controversy erupted in the 1630s. Based on manuscript and printed documents written until 1670, three Chinese characters which became the focus of competing interpretations are discussed: miao as temple versus hall, ji as sacrifice versus offering, and sheng as prophet versus wise man. Besides the problem of biased translations on both sides, we shall show that there was a more fundamental reason which prevented the missionaries from settling their controversy using dictionaries. For almost 700 years shoguns ruled Japan. These "gentleman warriors" developed a dedicated system of honor and strict guidlelines of behavior that Taira Shigesuke first brought together in his 16th century book—Bushido Shoshinshu. Present to a modern audience in clear, easy-to-read English, this new translation captures the majesty of the higher principles as well as the usefulness of the daily advice. From principles such as "a samurai should keep foremost in his mind the fact that he must die" to rules (...) regarding duty, personal obligation and even money management, this book sets out the guidelines that defined Japan's "way of the warrior." Honor and obligation are emphasised above all to the reader, who is taught that a samurai is expected to be indifferenet to pain, unquestioningly loyal, and an expert in his training. (shrink)

The formation of the character of Sun Wukong has remained one of the most controversial issues in the field of Xiyou ji studies. While acknowledging that different strands might have fed into the image of Sun Wukong in the sixteenth- century novel Xiyou ji, this paper calls attention to complex and sometimes contradictory representations of Sun Wukong’s sexuality and explores the mechanism of displacement that subtly operates in the novel and reveals itself through such representations. It further demonstrates the dual (...) function performed by the displacement of Sun Wukong’s sexuality: on the one hand, it connects Sun Wukong to the image of the lustful ape in the white ape tradition; on the other hand, such displacement allows him to utilize and transcend his desire by experiencing the process of awakening to kong 空 by means of se 色 on his path to enlightenment. Therefore, a reexamination of Sun Wukong through the lens of sexuality helps draw together these two seemingly separate aspects and reveals a narrative in which Sun Wukong’s sexual desire not only encodes his hidden past associated with the white ape tradition but also generates significant meaning in light of the Buddhist context, that is, the notion that erotic encounters and fulfillment of sexual desire can be integrated into the Buddhist journey to enlightenment. When it comes to books on samurai philosphy, Hagakure is iconic to contemporary readers. But Budōshoshinshū, which was also written by a respected samurai during the Edo period, was equally influential at the time. Both works address the warrior's role in times of peace and emphasize the importance of living selflessly. Written by Daidōji Yūzan (1639-1730), a Confucian scholoar who descended from a long line of prominent warriors, Budōshoshinshū comprises 56 pithy instructive essays for young samurai on how to live (...) morally, with professional integrity and a higher purpose; to carry on the true chivalrous tradition of bushido. The Code of the Samurai is a four-hundred-year-old explication of the rules and expectations embodied in Bushido, the Japanese way of the warrior. Bushido has played a major role in shaping the behavior of modern Japanese government, corporations, society.

A conceptual model articulating the nature of customer expectations and satisfaction over services was proposed with emotional factors. Five propositions about consumer emotional service expectations as a primary antecedent toward confirmation, perceived quality, and satisfaction were provided. As moderators, two dimensions of consumer detection of emotional labor (i.e., detecting deep acting and surface acting) were imposed on each of the relationships. Evidence demonstrated the roles of emotional service expectation in service confirmation and satisfaction. The moderating effects of consumer detection of (...) employees’ emotional strategies were limited to the relationship between emotional service expectation and confirmation; its relationship was weakened by detections of surface acting while other relationships were not moderated by detections of deep nor surface acting. The Iowa Gambling Task (IGT) simulates uncertain gains and losses in real life situations and thus is a good measure of uncertain decision making. The role of working memory (WM) in IGT performance still remains unclear. The present study aimed to examine the effect of WM on IGT performance. Three groups of participants matched on gender ratio were randomly assigned to no WM load, low WM load, and high WM load conditions. Initially the three groups did not show significant difference (...) in WM capacity. They finished a modified version of IGT and then their implicit learning effect and explicit cognition on IGT were assessed. Results indicated a linear increasing trend of IGT performance among high WM load, low WM load and no WM load groups; participants in the no WM load and low WM load groups revealed implicit learning effect, while participants in the high WM load group did not; all participants showed explicit cognition on IGT to the same level. These results suggested that participants in the high WM load group showed good explicit cognition to IGT but showed poor performance. This pattern is similar to frontal patients. By introducing the theory of social co-governance into the field of e-commerce intellectual property protection, this paper builds an evolutionary game model among the government, e-commerce platforms, and rights holders, and studies the conditions under the stakeholders form a stable equilibrium state under different constraints. Combined with numerical simulation, the influence of individual factors and factor combinations on the system stability is analyzed. Results shows that: Strictly controlling the action costs and response costs of all parties can enhance their willingness (...) to actively deal with infringement issues; reasonable adjustment of the reward and punishment measures of government supervisory agencies can produce sufficient reverse shock and positive guidance to platform and operators; penalties should be imposed on government supervisory agencies that are not sufficiently supervised; strengthen the construction of the social environment for intellectual property protection, improve the social benefits of actively responding to infringement issues, and increase the sense of acquisition by the government, platforms and rights holders. In this article, I critique the commonly accepted distinction between commercial and altruistic surrogacy arrangements. The moral legitimacy of surrogacy, I claim, does not hinge on whether it is paid (‘commercial’) or unpaid (‘altruistic’); rather, it is best determined by appraisal of virtue-abiding conditions constitutive of the surrogacy arrangement. I begin my article by problematising the prevailing commercial/altruistic distinction; next, I demonstrate that an assessment of the virtue-abiding or non-virtue-abiding features of a surrogacy is crucial to navigating questions about the (...) moral legitimacy of surrogacy; in the final part, I reject other moral heuristics that might be proposed as alternatives to the commercial/altruistic dichotomy, and reiterate that a virtue-ethical framework is the most suitable way forward. Mere inability, which refers to what persons are naturally unable to do, is traditionally thought to be distinct from unfreedom, which is a social type of constraint. The advent of biomedical enhancement, however, challenges the idea that there is a clear division between mere inability and unfreedom. This is because bioenhancement makes it possible for some people’s mere inabilities to become matters of unfreedom. In this paper, I discuss several ways that this might occur: first, bioenhancement can exacerbate social pressures (...) to enhance one’s abilities; second, people may face discrimination for not enhancing; third, the new abilities made possible due to bioenhancement may be accompanied by new inabilities for the enhanced and unenhanced; and finally, shifting values around abilities and inabilities due to bioenhancement may reinforce a pre-existing ableism about human abilities. As such, we must give careful consideration to these potential unfreedom-generating outcomes when it comes to our moral evaluations of bioenhancement. (shrink)

This study investigated the possible mediation of career distress in the relationship between major incongruence and occupational engagement and whether this mediation depends on the degree of outcome expectation. Moderated mediation analysis was tested on a sample of 346 Korean undergraduate students. The results indicated that career distress mediated the relationship between major incongruence and occupational engagement. Moreover, the negative indirect effect of major incongruence on occupational engagement through career distress weakened as the level of outcome expectation increased. The significant (...) mediation effect of career distress is meaningful given the evidence on the role of emotion in career adaptation. In addition, the significant moderation effect of cognitive evaluation and belief in the mediating relationship on career problem, career emotion, and career behavior is meaningful in that it provides insights in cognitive intervention that could be effective in career counseling. Contemporary Chinese society has witnessed ongoing complex institutional and cultural reconfiguration, driven by the transition from the socialist planned economy to marketization and later its deep engagement in globalization and neoliberalism. In this reshaping of Chinese society, tradition and modernity, the resurgence of patriarchal Confucian tradition, the socialist version of modernity, the capitalist version of modernity, and the socialist heritage intermingle, and all seem to define a mosaic temporality.Facing the increasing uncertainties of the market, family members in post-reform China have (...) to stick together as an economic safety net, emotional harbor and spiritual fortress. Chinese parents heavily invest in their children and continue to support them in their adulthood; whereas, the youth is under great obligation to providing old age care for their parents; and parents may regard this heavily-invested offspring as their private product. This resurgent but modified familialism, is not an exact replication of traditional familialism, but is definitely different from the family modes featured by individualism in Western contexts. Mosaic familialism is characterized by a sequential symbiosis between parents and children facing financial constraints and unforeseeable uncertainties with a lack of a social safety net. At the same time, patriarchal Confucianism is rejuvenated to a certain degree, women’s traditional wife and mother role is once again stressed, if not glorified; and the neoliberal discourse articulating personal choice and responsibility, but not individual right, stands by seamlessly. Parents and children, husband and wife are dependent on each other in the intimate family, following a clearly gendered pattern. (shrink)

Natalie Stoljar posits that those who have internalized oppressive norms lack normative competence, which requires true beliefs and critical reflection. A lack of normative competence makes agents nonautonomous, according to Stoljar. This framework is thereby meant to address what she calls the “feminist intuition”—the intuition that oppressive norms are incompatible with autonomy. On my view, however, Stoljar’s normative competence account of autonomy is subject to a worrying problem. Her account misattributes nonautonomy to those who perpetrate the oppression, making those who (...) are oppressed and those who oppress count as equally nonautonomous. I argue that this is implausible and demonstrate in this paper that we can establish an asymmetry of autonomy between those who oppress others and those who are made the target of oppression. An episiotomy is ‘an intrapartum procedure that involves an incision to enlarge the vaginal orifice,’1 and is primarily justified as a way to prevent higher degrees of perineal trauma or to facilitate a faster birth in cases of suspected fetal distress. Yet the effectiveness of episiotomies is controversial, and many professional bodies recommend against the routine use of episiotomies. In any case, unconsented episiotomies are alarmingly common, and some care providers in obstetric settings often fail to see consent as necessary (...) in context. In their article, ‘The ethics of consent during labour and birth: episiotomies,’ van der Pijl et al reiterate that consent is necessary for episiotomies. They specify, further, that the antenatal period is crucial for exchanging information, establishing trust between the birthing subject and provider, and exploring the birthing subject’s—rather than the care provider’s—values and preferences regarding episiotomies. They recommend an individualised approach, which would enable birthing subjects to choose how and when they want to give consent. I applaud van der Pijl et al on their practicable recommendations regarding consent for episiotomies. This is certainly a step in the right direction where respect for birthing subjects’ bodily autonomy and integrity is concerned. Still, we must be reminded that consent alone is not coextensive with autonomy. The conditions for securing informed consent in healthcare does not guarantee that one’s decision is truly reflective of their values. Should involuntarily childless people have the sameopportunities to access parenthood as those who are not involuntarily childless? In the context of assisted reproductive technologies, affirmative answers to this question are often cashed out in terms of positive rights, including rights to third-party reproduction. In this paper, wecritically explore the scope and extent to which any such right would hold up morally. Ultimately, we argue for a departure away from positive parental rights. A tic disorder (TD) is a neurodevelopmental disorder characterized by tics, which are repetitive movements and/or vocalizations that occur due to aberrant sensory gating. Its pathophysiology involves dysfunction in multiple parts of the cortico-striato-thalamo-cortical circuits. Spontaneous brain activity during the resting state can be used to evaluate the baseline brain state, and it is associated with various aspects of behavior and cognitive processes. Theta–gamma coupling (TGC) is an emerging technique for examining how neural networks process information through interactions. However, the (...) resting-state TGC of patients with TD and its correlation with cognitive function have not yet been studied. We investigated the resting-state TGC of 13 patients with TD and compared it with that of 13 age-matched healthy children. The participants underwent resting-state electroencephalography with their eyes closed. At the global level, patients with TD showed a significantly lower resting-state TGC than healthy children. Resting-state TGC with the eyes closed was significantly negatively correlated with the attention quotient calculated for omission errors in a selective visual attention test. These findings indicate that the resting-state brain network, which is important for the attentional processing of visual information, is dysfunctional in patients with TD. Additionally, these findings support the view that TGC reflects information processing and signal interactions at the global level. Patients with TD may have difficulty gating irrelevant sensory information in the resting state while their eyes are closed. (shrink)

BackgroundThe Life Extension Medical Decision law enacted on February 4, 2018 in South Korea was the first to consider the suspension of futile life-sustaining treatment, and its enactment caused a big controversy in Korean society. However, no study has evaluated whether the actual implementation of life-sustaining treatment has decreased after the enforcement of this law. This study aimed to compare the provision of patient consent before and after the enforcement of this law among cancer patients who visited a tertiary university (...) hospital's emergency room to understand the effects of this law on the clinical care of cancer patients.MethodsThis retrospective single cohort study included advanced cancer patients aged over 19 years who visited the emergency room of a tertiary university hospital. The two study periods were as follows: from February 2017 to January 2018 (before) and from May 2018 to April 2019 (after). The primary outcome was the length of hospital stay. The consent rates to perform cardiopulmonary resuscitation (CPR), intubation, continuous renal replacement therapy (CRRT), and intensive care unit (ICU) admission were the secondary outcomes.ResultsThe length of hospital stay decreased after the law was enforced from 4 to 2 days (p = 0.001). The rates of direct transfers to secondary hospitals and nursing hospitals increased from 8.2 to 21.2% (p = 0.001) and from 1.0 to 9.7%, respectively (p < 0.001). The consent rate for admission to the ICU decreased from 6.7 to 2.3% (p = 0.032). For CPR and CRRT, the consent rates decreased from 1.0 to 0.0% and from 13.9 to 8.8%, respectively, but the differences were not significant (p = 0.226 and p = 0.109, respectively).ConclusionAfter the enforcement of the Life Extension Medical Decision law, the length of stay in the tertiary university hospital decreased in patients who established their life-sustaining treatment plans in the emergency room. Ascribing autonomous status to agents is a valuable practice. As such, we ought to care about how we engage in practices of autonomy ascription. However, disagreement between first-personal experiences of an agent's autonomy and third-personal determinations of their autonomy presents challenges of ethical and epistemic concern. My view is that insights from a dialogical rather than nondialogical account of autonomy give us the resources to combat the challenges associated with autonomy ascription. I draw on Andrea Westlund's account of dialogical autonomy—on (...) which autonomy requires a dialogical disposition to hold oneself answerable to external critical perspectives—to make my case. This article studies the effects of social institutions on organizational corruption at the societal level by focusing on the possible interactions between the institutional pillars that have been identified in past research. Based on these three institutional aspects or pillars, this article tests the interactive effects of social institutions among societies throughout the world. The results suggest that the three institutional pillars have significant interactive effects on organizational corruption at the societal level. Recently, teacher emotions have become the focus of research in teacher education. Teacher emotions not only affect teachers themselves but also have an impact on their students. However, pre-service teachers’ emotions have been neglected. This study is based on a qualitative analysis of online emotional diaries related to emotional experience expression by 120 Chinese pre-service teachers before, during, and after teaching practice. The results in this study show three characteristics of pre-service teachers’ emotional experiences: the overall positive emotions are higher (...) than negative emotions; “caring” and “nervous” are the most typical emotions and variability in emotional experience across gender and internship schools. Then, it is surprising that pre-service teachers’ emotional trajectories are complex and dynamic, positive emotions are decreasing, and negative emotions increase as time goes by. Finally, from the perspective of emotional experience sources, organizational factors affect the emotional experience, personal factors, and background factors. (shrink)

Individualistic traditions of autonomy have long been critiqued by feminists for their atomistic and asocial presentation of human agents. Relational approaches to autonomy were developed as an alternative to these views. Relational accounts generally capture a more socially informed picture of human agents, and aim to differentiate between social phenomena that are conducive to our agency versus those that pose a hindrance to our agency. In this article, I explore the various relational conceptualizations of autonomy profferred to date. I critically (...) review some of the ongoing internal disputes within the relational autonomy literature, and conclude the article by taking stock of the value of relational autonomy despite these unresolved debates. In this article, I argue that various epistemic challenges associated with eating disorders (EDs) can negatively affect the care of already marginalized patient groups with various EDs. I will first outline deficiencies in our understanding of EDs—in research, healthcare settings, and beyond. I will then illustrate with examples cases where discriminatory misconceptions about what EDs are, the presentation and treatment of EDs, and who gets EDs, instantiate obstacles for the treatment of various ED patient groups.

BackgroundFatigue is an important factor for the safety of ships. In order to alleviate fatigue of the seafarers, the STCW Convention has made many regulations on the working time of seafarers. At present, if a crew member takes only one day off at home before returning to work on the ship, the working time on the ship must be re-calculated again. If the time spent at home is not sufficient to allow the crew to recover, the regulations of only stipulating (...) the working time, not stipulating the home vacation time, cannot guarantee the crew’s fatigue been well controlled. The aim of present study is to explore the relationship between vacation schedule and fatigue of the seafarers.MethodsIn present study, a simplified stress scale developed by the Ministry of Labor of Japan has been used as a measurement tool. The method of stratified sampling was adopted. Data collection mainly came from domestic ocean-going seafarers. Analysis was conducted using the Cross analysis and hierarchical multiple regression analysis methods.ResultsWe found that there was no difference between crew members of different positions in terms of average vacation time and on-board service time. The length of last vacation time and this service time for seafarers of different positions showed obvious differences. The rank has a significant effect on the length of the last vacation and the length of this service time. Also, the results showed that there was a significant negative correlation between the duration of vacation and overall fatigue, while there was a significant positive correlation between the length of service time on board and overall fatigue.ConclusionThe results indicated that a reasonable vacation schedule was crucial for the relief of the seafarers’ fatigue, and also played a positive role in the state of working on the ship again. In the future, full ectogestation – in which artificial placenta technology would be used to carry out the entirety of gestation – could be an alternative to human pregnancy. This article analyzes some underexplored objections to ectogestation which relate to the possibility for new and continuing forms of social oppression. In particular, we examine whether ectogestation could be linked to an unwarranted de-valuing of certain aspects of female reproductive embodiment, or exacerbate objectionable kinds of scrutiny over the reproductive choices of (...) gestating persons. Without discounting the potential benefits of full ectogestation, we conclude that the socially oppressive potential of ectogestation, on top of other concerns, warrants further critical ethical reflection.
