The paper examines the ethical and legal challenges of making decisions for previously competent patients and the role of advance directives and legal representatives in light of the Oviedo Convention. The paper identifies gaps in the Convention that result in conflicting instructions in cases of a disagreement between the expressed prior wishes of a patient, and the legal representative. The authors also examine the legal and moral status of informally expressed prior wishes of patients unable to consent. (...) The authors argue that positivist legal reasoning is insufficient for a consistent interpretation of the relevant provisions of the Convention and argue that ethical argumentation is needed to provide guidance in such cases. Based on the ethical arguments, the authors propose a way of reconciling the apparent inconsistencies in the Oviedo Convention. They advance a culturally sensitive approach to the application of the Convention at the national level. This approach understands autonomy as a broader, relational consent and emphasizes the social and cultural embeddedness of the individual. Based on their approach, the authors argue that there exists a moral obligation to respect the prior wishes of the patient even in countries without advance directives. This paper explores the legal and ethical concept of human subject research in order to determine whether genetic research with already available biosamples and data falls within this concept. Although the ethical concept seems to have evolved to recognize research based on data as human research, from a supranational legal perspective this form of research is not considered human subject research. Thus human subject research regulations do not apply and therefore do not invoke the requirement of obtaining consent prior to (...) using an individual’s biosample or genetic data in research. Furthermore, it remains ambiguous in both the legal and ethical realm whether the use of biosamples or genetic data without additional links to the individual would invoke the same safeguards as research involving additional or specific identifiers. Seeing that research based on already available biosamples and genetic data is not governed by rules concerning human subject research, the second part of the paper analyses whether any consent requirements apply for the further use of already available bio‐samples or genetic data in research. Whereas further use of biosamples is subject to considerably lax consent requirements under Article 22 of the Oviedo Convention, under the General Data Protection Regulation further use of genetic data might not be subject to a prior consent requirement at all, unless it is stipulated in national laws. When it comes to clinical trials, however, sponsors will have the possibility under Article 28(2) of Regulation 536/2014 to obtain open consent for further use of data in any kind of future research. Misattributed paternity or ‘false’ paternity is when a man is wrongly thought, by himself and possibly by others, to be the biological father of a child. Nowadays, because of the progression of genetics and genomics the possibility of finding misattributed paternity during familial genetic testing has increased. In contrast to other medical information, which pertains primarily to individuals, information obtained by genetic testing and/or pedigree analysis necessarily has implications for other biologically related members in the family. Disclosing or not a (...) misattributed paternity has a number of different biological and social consequences for the people involved. Such an issue presents important ethical and deontological challenges. The debate centres on whether or not to inform the family and, particularly, whom in the family, about the possibility that misattributed paternity might be discovered incidentally, and whether or not it is the duty of the healthcare professional to disclose the results and to whom. In this paper, we consider the different perspectives and reported problems, and analyse their cultural, ethical and legal dimensions. We compare the position of HCPs from an Italian and British point of view, particularly their role in genetic counselling. We discuss whether the Oviedo Convention of the Council of Europe can be seen as a basis for enriching the debate. (shrink)

In this article the paradoxical role of legal science in legal practice is discussed. On the one hand, legal scientists do not agree on the criterions of the scientific character of legal science. On the other hand, even in the legal cases that are especially complicated it is possible to arrive at theoretically unquestionable decisions. The author of the article concludes that legal practice is based on fundamental theoretical insights; however, in legal practice these insights are used more intuitively than (...) reflectively. Therefore, the aim of the article is to rationally reconstruct these theoretical insights with reference to the ideas of modern schools of legal philosophy. For this purpose the ideas of the theory of natural law are discussed. It is concluded that in legal practice two provisions of natural law are applied: legal decisions ought to be reasonable and must include existential ends (basic values). The evolution of the legal positivism is discussed in the article and it is concluded that legal positivism offers the criterions of the scientific character of legal science by framing the procedural rules of the democratic process of lawmaking. These rules anticipate such conditions: consensus concerning decision making; equal participation of all members of legal discourse confirming normative decisions; the acceptability of consequences after the realisation of normative decisions; the possibility to reaffirm normative decisions, if necessary. The ideas of virtue jurisprudence are discussed and it is claimed that virtue jurisprudence as a criterion of the scientific character of law proposes such theoretical position: the decisions concerning human rights must supply the value system (hierarchy) and the virtues which are formed and justified in the long legal tradition. The article represents the use of these criterions of the scientific character of legal science by Jurgen Habermas to debate about legal prohibition of the improvement of the human genome by using modern technologies of genome engineering in the Convention of Human Rights and Biomedicine (Oviedo, 1997). Germline genome editing is often disapproved of at the international policy level because of its possible threats to human dignity. However, from a critical perspective the relationship between this emerging technology and human dignity is relatively understudied. We explore the main principles that are referred to when 'human dignity' is invoked in this context; namely, the link with eugenics, the idea of a common genetic heritage, the principle of equal birth and broader equality and justice concerns. Yet the concept is (...) also used in favour of germline genome editing as it might improve the overall well-being of future generations. We conclude that dignity concerns do not justify a complete ban on safe heritable genome editing but should inform the implementation of side constraints to ensure that the value judgements about human traits that are inherent in this practice do not result in a diminished basic respect for those people affected by them. Up to the present, there have not been any specific norms regarding medically assisted human reproduction in Romanian legislation. Due to this situation the general legislation regarding medical assistance, the Penal and Civil law and the provisions of the Code of Deontology of the Romanian College of Physicians are applied to the field of medically assisted human reproduction. By analysing the ethical and legal conflicts regarding medically assisted human reproduction in Romania, some characteristics cannot be set apart because they derive (...) from religious, cultural and socio-economic aspects. In this article the authors identify the development stages of medically assisted human reproduction in Romania, beginning from these characteristics and insisting upon the failure of the legal system in this specific field. The authors consider that the law regarding medically assisted human reproduction cannot be effective because it did not take into account the ethical and cultural aspects that might appear. Furthermore, in this framework of the legal process, no public debate involving the representatives of civil society was undertaken although the Council of Europe Oviedo Convention approved by our country according to law no. 17/2001 stipulated exactly this working method. Reviewing the last fifty years of interaction between religion and science in Catholicism in Southern Europe, common traits are clearly evident: a late awareness of the importance of this interaction and a theological reluctance to address science or to account for its progress. Early signs of the engagement between religion and science appear as a consequence of the work of the French anthropologist and theologian Teilhard de Chardin. In Italy and Spain in the last fifteen years, we see a substantive (...) growth in the rise of research centers and academic activities devoted to exploring the common ground between science, philosophy, and theology. However, despite all these efforts and the many positive signs, there remains a long way to go for theology to consider science as a true challenge and an inspiration and to integrate it into the theological curriculum. This August, I participated in the conference “Genome Editing: Biomedical and Ethical Perspectives,” hosted by the Center for the Study of Bioethics at the University of Belgrade and cosponsored by the Division of Medical Ethics of NYU Langone Health and The Hastings Center. The prime minister of Serbia, Ana Brnabić, spoke of the significance of bringing together an international community of bioethicists, acknowledging that ethical, social, and legal issues surrounding gene editing technologies transcend national boundaries. Europe's Oviedo Convention (...) prohibits human germline gene editing, and UNESCO's Universal Declaration on the Human Genome and Human Rights says that germline editing “could be contrary to human dignity,” an assault on humanity itself. Whether one agrees or not, engaging with the idea forces us to think about what it means to be part of the global human community and about the moral significance of the human genome to creating that community. The conference highlighted for me how challenging having international, much less global, conversations about bioethics can be. (shrink)

The article chronicles the different panels devoted tothe cognitive science of religion at the meeting of the Society for the Scientific Study of Religion (SSSR) in Tampa, Florida, in November 2007. The aim is to verify the state of this subdiscipline and to check how much this work-in-progress affects the present state of the dialogue between science and religion. Forty years after the end of the Second Vatican Council, contrasting opinions dispute the range of its reception and its real effects as the Catholic Church struggles in a changing world of secularization and pluralism. The present paper tries to throw new light on the historical significance of that event, mobilizing different methods and applying some new ‘hermeneutical lenses’. Four topics will serve for this task: the ‘neo‐Enlightened’ mood that affected a fair amount of its reception; the evolutive process of (...) variations and selections associated with it; the forms of ‘rationalization’ and ‘expansion’, which the Council promoted; and the theological challenge of discerning the ‘signs of the time’. In conclusion, the historical judgment on the Council should keep in mind the complexity of the entire process of modernization it assumed. (shrink)

New scientific approaches to religion have delivered a considerable number of theories aimed at explaining it, despite its cognitive and adaptive oddities. These efforts were built on available theoretical frameworks, including those from cognitive science, biology, and anthropology. Many voices have raised criticism against several aspects in the cognitive and evolutionist program, even if recognizing their legitimacy and the fruits collected to date. A pressing issue is whether the problem with the new scientific study of religion is related, to some (...) extent, to the use of outdated views on human evolution, mind, and behavior. If this is the case, then a deep revision concerning current models is required. The new direction proposed should account for more complex aspects of human nature following multilevel models, and a specific human feature—language—that could better explain religion as a meaning system. Understanding religion as a language might open an alternative path inside cognitive studies that is closer to how it is lived by believers. (shrink)

Supervised injectable opioid assisted treament prescribes injectable opioids to individuals for whom other forms of addiction treatment have been ineffective. In this article, we examine arguments that opioid-dependent people should be assumed incompetent to voluntarily consent to clinical research on siOAT unless proven otherwise. We agree that concerns about competence and voluntary consent deserve careful attention in this context. But we oppose framing the issue solely as a matter of the competence of opioid-dependent people and emphasize that it should be (...) considered in the context of inequities in access to siOAT as a medical treatment. Consequently, we suggest that bioethics literature on nonexploitation, which focuses on clinical research in low-income countries, is helpful due to locating ethical issues within systemic social conditions. Finally, we consider the implications of our argument for the ethics of clinical research on siOAT. (shrink)

Evolutionary studies have provided several explanations about how pain and suffering can be fitted into that framework, which tries to make sense of every biological and human feature in terms of evolution, survival, and fitness. These explanations point usually to how such apparently negative aspects become useful and contribute to an evolution that after all has delivered good outcomes. Such an approach might eventually render the theodicy question less sharp and critical for believers who are trying to cope with the (...) scandal of so great suffering in our world and history. Theologically we can welcome such new insights, less noticed in former tradition, but at the same time we need to be cautious before a development which could render less clear the message of Christian salvation. In any case, the new data and knowledge clearly invite to revise and reformulate the Christian salvific message, to better answer before the mystery of evil and suffering. (shrink)

Religion has been intensely studied in the last years inside an evolutionary frame, trying to discern to what extent it contributes to fitness or becomes an adaptive entity in its own. A similar heuristic can be tried regarding the opposite tendency: unbelief and atheism, since these cultural phenomena could help to better adapt to some social settings or become an adaptive socio-cultural niche on its own. The present paper examines some scenarios in which that question makes sense: the tradition of (...) sociology of religion, with its different strands, including recent studies on ‘non-religious’; the cognitive; and the philosophical-theological reflection. The proposed venues show to what extent the evolutionary model might reveal neglected aspects in the study of unbelief, and at the same time its limits or the open questions that such application raise. This is an introduction to the Symposium on “The New Scientific Study of Religion Moving On.” The introduction briefly indicates why the cognitive science of religion (CSR) needs re‐evaluation. It subsequently gives an overview of the contributions of the symposium's articles.

Fundamental Theology has undergone a slow evolution, as many other theological disciplines, since its inception in the aftermath of the Second Vatican Council. The lapsed time invites us to reflect about the current situation in this field and to what extent that theological section is pursuing its main objectives, especially for its teaching at different levels. After examining several issues that could have influenced that development, some suggestions for advancing the field and its teaching will also be given. Indeed, both (...) the internal and external contexts have changed quite a lot in the last 60 years, and this probably will influence a treaty that should be more contextually sensitive and very bound to developments in religious education. This volume answers the question: Why do we believe what we believe? It examines current research on the concept of beliefs, and the development in our understanding of the process of believing. It takes into account empirical findings in the field of neuroscience regarding the processes that underlie beliefs, and discusses the notion that beyond the interactive exploratory analysis of sensory information from the complex outside world, humans engage in an evaluative analysis by which they attribute personal meaning and relevance (...) to the probabilistic representations of objects and events. Beliefs exert a strong influence on behaviour, decision-making, and identifying and solving problems. Despite their importance, beliefs have until recently not been at the centre of scientific interest. In fact, "belief" is an ill-defined phenomenon. From a transdisciplinary perspective the actual approaches to understanding belief seem incompatible as they attempt to highlight such different topics as "belief - religion", "belief - spirituality", "belief - faith", "belief - knowledge", "belief - attitude", "belief - disbelief", "belief - illusion", and "believing - brain function". This situation contradicts the idea that belief is close to pathological phenomena and that it should be eliminated from scientific discussions. Rather, believing is fundamental for understanding the many problems of every-day life. In fact, the book shows that beliefs are relevant for politics, international affairs, economy, law, or religions also in modern societies. This book presents the increasing scientific interest in beliefs and believing, and reflects the change in focus from the content aspect of belief towards the fluid nature of believing. (shrink)

Cette contribution examine la pertinence de la Convention européenne des droits de l’homme pour les personnes en situation de handicap. Elle se penche sur les principes de la Convention tels que la dignité humaine, l’autonomie personnelle et l’égalité, qui sont particulièrement importants pour les personnes en situation de vulnérabilité. Le texte aborde ensuite les obligations négatives et positives de l’État à l’égard des personnes handicapées. En ce qui concerne les premières, le texte souligne la nécessité de procéder à (...) des évaluations individualisées dans le cadre des processus décisionnels et de trouver un équilibre entre les droits des personnes et les intérêts de l’État. En ce qui concerne les secondes, l’État est également tenu d’évaluer les besoins réels des personnes handicapées. Il doit fournir une aide suffisante, tout en pouvant prendre en compte des considérations financières légitimes. La Convention européenne est ensuite examinée dans sa relation avec la Convention des Nations Unies relative aux droits des personnes handicapées. La Cour européenne des droits de l’homme s’efforce généralement d’interpréter la Convention européenne en harmonie avec les autres traités internationaux. Si la Convention des Nations Unies a ainsi influencé certains développements dans la jurisprudence de la Cour, il existe également des cas où la Cour a estimé que la Convention européenne n’offrait pas le même niveau de protection que la Convention des Nations Unies. La relation entre les deux conventions reste dynamique, ce qui laisse penser qu’avec le temps, davantage de principes de la Convention des Nations Unies pourraient devenir partie intégrante de l’interprétation de la Convention européenne. In Moonshadows, the Cowherds, a team of ten scholars of Buddhist Studies, address the nature of conventional truth as it is understood in the Madhyamaka tradition deriving from Nagarjuna and Candrakarti. Moonshadows combines textual scholarship with philosophical analysis to elucidate the metaphysical, epistemological and ethical consequences of this doctrine.

“Meaning” and “religion” appear as deeply interlinked concepts in modern thought. Theology has often discovered religious faith as a “source of meaning” against a background of “meaninglessness”, as the XX century existentialist philosophies would remark. Beyond such an apologetic stance, some philosophies of religion have tried to better describe such a link: hermeneutics, phenomenology and even systems theory, may be accounted as main attempts to tackle this very complex framework, and to show how religion provides meaning, or is built trough (...) structures of meaning, or is a form of “meaning-construction”. Cognitive approach may add new perspectives to better explain this implication. Recent attempts combine scientific methods and philosophical analysis to show how meaning is built and works, and how religion provides a specific sort of meaning, distinct from other forms in which meaning displays itself: moral, aesthetic, or affective. Describing religion in terms of “meaning management” helps to better understand its specific role and function in the human mind, beyond the most reductivist programs, and offers a more balanced view on its cognitive dimensions. Different attempts to connect religion and meaning are reviewed in this paper in order to offer an alternative model to the new scientific study of religion. (shrink)

The UN Convention on the Rights of Persons with Disabilities (CRPD) was passed in 2006 and came into force in 2008. It sets out a number of core values, including dignity, individual autonomy, non-discrimination, participation and community inclusion. Although the CRPD has been recognised as an important step forward by many disabled people and their supporters and provides the foundation for building a good life, the author argues that it does not necessarily equate with it. The underpinning Western values (...) of choice, independence and control are important, but leave out groups of marginalised people for whom these goals may not be achievable. They also present challenges and dilemmas for those involved in supporting/caring roles. In this paper, the author reflects on the implications of the CRPD for the lives of people with learning disabilities, in particular those with profound needs and explores whether it provides a genuinely coherent framework for an inclusive society. Eschatological beliefs have matured alongside both biblical composition and Christian history. This evolution can be traced using cultural evolutionary studies. The process reflects attempts to adapt to new conditions and challenges—sometimes giving place to more focused views, but also sometimes to failures and dysfunctional forms or fruitless variations. It becomes a theological duty to assess this evolution better. The key element is the reception of these eschatological beliefs, to discern what expressions of them are more helpful in encouraging Christian fidelity, (...) coping with distress, and engaging with individual and societal challenges. In this article, we outline a research programme that links eschatology to anthropology, and that tries to analyse beliefs according to state‐of‐the‐art methods, such as evolutionary cultural studies and research on the believing process. The moral/conventional task has been widely used to study the emergence of moral understanding in children and to explore the deficits in moral understanding in clinical populations. Previous studies have indicated that moral transgressions, particularly those in which a victim is harmed, evoke a signature pattern of responses in the moral/conventional task: they are judged to be serious, generalizable and not authority dependent. Moreover, this signature pattern is held to be pan‐cultural and to emerge early in development. However, almost all (...) the evidence for these claims comes from studies using harmful transgressions of the sort that primary school children might commit in the schoolyard. In a study conducted on the Internet, we used a much wider range of harm transgressions, and found that they do not evoke the signature pattern of responses found in studies using only schoolyard transgressions. Paralleling other recent work, our study provides preliminary grounds for skepticism regarding many conclusions drawn from earlier research using the moral/conventional task. (shrink)

Theology and other human sciences present concerns against artificial intelligence (AI) that are often limited to ethical issues, as they appear as the most pressing problems and challenges derived from these new technologies. However, by reviewing the published literature, the article shows that theologians have ventured into broader areas, with a specific focus on the anthropological consequences of current technological advances. New developments and achievements in AI invite further exploration from a theological perspective, and they offer some opportunities and useful (...) applications for theologians. The article moves from the ethical territory toward the more neutral but highly engaging dialogue between science, technology, and religion, their interactions and mutual enrichment. Postmodernism may seem a particularly inappropriate term when used in conjunction with a region that is usually thought of as having only recently, and then unevenly, acceded to modernity. Yet in the last several years the concept has risen to the top of the agenda of cultural and political debate in Latin America. This collection explores the Latin American engagement with postmodernism, less to present a regional variant of the concept than to situate it in a transnational framework. Recognizing that (...) postmodernism in Latin America can only inaccurately be thought of as having traveled from an advanced capitalist "center" to arrive at a still dependent neocolonial "periphery," the contributors share the assumption that postmodernism is itself about the dynamics of interaction between local and metropolitan cultures in a global system in which the center-periphery model has begun to break down. These essays examine the ways in which postmodernism not only designates the effects of this transnationalism in Latin America, but also registers the cultural and political impact on an increasingly simultaneous global culture of a Latin America struggling with its own set of postcolonial contingencies, particularly the crisis of its political left, the dominance of neoliberal economic models, and the new challenges and possibilities opened by democratization. In view of the decline of apologetics as a theological genre and Benedict XVI's repeated invitation to a deeper engagement in a dialogue of faith and reason, we claim a return to this style in fundamental theology, starting from a review of the historical process leading to its abandonment, then its relevance for other theological areas, to those tasks that should not be disregarded. We suggest methods and directions for renewing its style and content, also in the academic curriculum. The (...) purpose is to give life to a model of fundamental theology that is capable of sustaining the objections and stimuli of its socio-cultural context and to prepare a more interdisciplinary method. The study of belief is expanding and involves a growing set of disciplines and research areas. These research programs attempt to shed light on the process of believing, understood as a central human cognitive function. Computational systems and, in particular, what we commonly understand as Artificial Intelligence (AI), can provide some insights on how beliefs work as either a linear process or as a complex system. However, the computational approach has undergone some scrutiny, in particular about the differences between what (...) is distinctively human and what can be inferred from AI systems. The present article investigates to what extent recent developments in AI provide new elements to the debate and clarify the process of belief acquisition, consolidation, and recalibration. The article analyses and debates current issues and topics of investigation such as: different models to understand belief, the exploration of belief in an automated reasoning environment, the case of religious beliefs, and future directions of research. Free will is a very hot issue in several theoretical settings, but less in theology, or at least not as much as use to be in former times, when the discussions on sinfulness, grace and freedom were igniting a long season of controversies, especially in the Reformation time. Even in ecumenical dialogue apparently free will does not play a great role, since the reached consensus seems quite peaceful and agreement dominates over discussion. However, some theological insights, especially Karl Rahner reflections, (...) are still worthy to consider and possibly theological anthropology should pay more attention to the current debate and its consequences for the way we understand human nature and its relationship with God. Nearly fifteen years after the Council of Europe first called for a pan‐European convention on issues in bioethics to harmonize disparate national regulations, in November 1996 the council's Committee of Ministers approved the Convention on Human Rights and Biomedicine for formal adoption. The draft convention, released in July 1994, provoked strong public, professional, and governmental debate among European nations, particularly regarding provisions for biomedical research with subjects unable to give informed consent. En el artículo se plantea una primera aproximación a las motivaciones básicas del proyecto teórico que denomino "Hermenéutica Emergente". Se sugiere la importancia de mediar, inicialmente, aspectos antropológicos de la "moral de la emergencia" de Arturo Roig con la "hermenéutica analógica" de Mauricio Beuchot, en un diálogo filosófico Sur-Sur. Asimismo, se plantea el interés en entablar un diálogo filosófico Norte-Sur con el reciente "comunismo hermenéutico" de Gianni Vattimo. Un primer objetivo central de la "Hermenéutica Emergente" es contribuir a la renovación (...) de la teoría de la transculturación como clave conceptual central de una hermenéutica crítica latinoamericana. Un segundo objetivo central de la "Hermenéutica Emergente" es el abordaje del concepto de nación en el contexto de la modernidad periférica latinoamericana. El desarrollo de la exposición no se atiene linealmente a una presentación enumerativa de los objetivos referidos, sino que los pone en juego en un marco polémico con otros enfoques teóricos convergentes. The article presents a first approach to the basic motivations of theoretical project he called "Hermeneutics Emerging", and the importance of mediating initially anthropological aspects of "moral emergency" Arturo Roig with the "analog hermeneutics" of suggested by Mauricio Beuchot, a philosophical dialogue in South-South. Also, interest in engaging in philosophical North-South dialogue with the recent "hermeneutical communism" Gianni Vattimo arises. A first main objective is to contribute to the renewal of the theory of acculturation as a central conceptual hermeneutical key Latin American criticism. A second main objective of the "Emerging Hermeneutics" is the approach to the concept of nation in the context of Latin American peripheral modernity. The development of the exhibition is not linearly adheres to an enumerative presentation of the aforementioned objectives but puts into play in a controversial framework converging with other theoretical approaches. El propósito en el artículo es brindar un informe bibliográfico preliminar sobre el itinerario de la recepción de Hans Freyer en la Argentina, con el fin de arrojar luz sobre una figura del pensamiento alemán de la primera mitad del siglo XX que tuvo una repercusión soterrada en muchos intelectuales argentinos del periodo. Esa presencia se encuentra en gran parte oculta para la historia de las ideas argentinas, dada su problemática inscripción doctrinaria e ideológica en las políticas de la filosofía (...) y en las políticas de las ciencias sociales.The article offers a preliminary bibliographical report on the itinerary of the reception of Hans Freyer in Argentina. The objective is to shed light on a figure of the German thought of first half of the XX Century that influenced many Argentine intellectuals of the period. However that influential effect is hidden in the history of the Argentine ideas, given its problematic doctrinaire and ideological inscription in the politics of philosophy and social sciences. A question arises regarding theology and its functions when trying to cope with the coronavirus pandemic. Surely Christian faith – along with other religions – can play a role in helping to deal with this crisis, both for individuals and collectively. Theology connects with the effort religious faith and Churches perform and provides models and ideas to highlight the Christian sense of what is happening, that is, in reference to a saving God. Four keys, rooted in the Christian tradition, are (...) proposed that allow us to understand these difficult times in a meaningful way, that is, as revealing “signs of the times” for believers, assisting them in their struggle to cope with these challenging circumstances.
