The paper discusses Sosa’s view of intuitional knowledge and raises the question of the nature of reflective justification of intuitional beliefs. It is assumed, in agreement with Sosa, that pieces of belief of good researchers are typically reflectively justified, in addition to being immediately, first-level justified. Sosa has convincingly argued that reflective justification typically mobilizes and indeed should mobilize capacities distinct from the original capacity that has produced the belief-candidate for being justified, in order to assess (...) the reliability of the original capacity. It has to go beyond justifiers that are of the same-kind as first-level immediate ones, in order to enlarge the circle of justification, and is, therefore, holistic and coherentist. But if this holds, it seems that reflective justifi cation of armchair beliefs, presumably produced by intuition and some reasoning, should revert to empirical considerations testifying to the reliability of intuition and reasoning. Therefore, it typically combines, in an articulated way, a posteriori elements contributing to the thinker’s reflective trust in her armchair capacities. In short, the paper argues that Sosa’s own view of second-order justification goes better with a more aposteriorist view, if it does not even force such a view. (shrink)

Carson Strong has recently argued that wide reflective equilibrium (WRE) is an unacceptable method of justification in bioethics. In its place, Strong recommends a methodology in which certain foundational moral judgments play a central role in the justification of moral beliefs, and coherence plays a limited justificatory role in that the rest of our judgments are made to cohere with these foundational judgments. In this paper, I argue that Strong’s chief criticisms of WRE are unsuccessful and that (...) his proposed alternative is in fact just another version of WRE. In the course of doing so, I specify which theses are central to WRE and which are not, and thus, provide a response to an additional objection, advanced by Peter Singer, that WRE is vacuous. I conclude by arguing that there may be better prospects for advancing the debate regarding methodology in bioethics if we focus on restricted epistemic and methodological theses rather than broad approaches, such as WRE, that come in many different varieties. This open access book provides the first explicit case study for an application of the method of reflective equilibrium (RE), using it to develop and defend a precautionary principle. It thereby makes an important and original contribution to questions of philosophical method and methodology. The book shows step-by-step how RE is applied, and develops a methodological framework which will be useful for everyone who wishes to use reflective equilibrium. With respect to precautionary principles, the book demonstrates how a (...) rights-based precautionary principle can be constructed and defended. The case study succeeds in demonstrating that RE can be successfully applied and puts real constraints on the justification process. This is all the more remarkable as the case study was designed as an open-ended process, without presupposing any specific results. This book will be highly relevant both to people interested in philosophical methodology and epistemology, as well as to researchers who are interested in using philosophical methods and tools and applying them to practical problems. This work, written from a neo-Pyrrhonian perspective, is an examination of contemporary theories of knowledge and justification. It takes ideas primarily found in Sextus Empiricus's Outlines of Pyrrhonism, restates them in a modern idiom, and then asks whether any contemporary theory of knowledge meets the challenges they raise. The first part, entitled "Gettier and the Problem of Knowledge," attempts to rescue our ordinary concept of knowledge from those philosophers who have assigned burdens to it that it cannot bear. Properly (...) understood, Fogelin shows that the concept of knowledge is unproblematic. The second part of this study, called "Agrippa and the Problem of Justification," examines Agrippa's contribution to Pyrrhonism, a systematic reduction of its procedures which came to be known as the "Five Modes Leading to the Suspension of Belief." These modes present a completely general procedure for refuting any claim a dogmatist might make. Though largely unnoticed, there is, according to Fogelin, an uncanny resemblance between problems posed by Agrippa's "Five Modes" and those that contemporary epistemologists address under the heading of a theory of justification. Fogelin examines the strongest contemporary theories of justification--in both foundationalist and anti-foundationalist forms. The conclusion is that recent philosophical writings on justification have made no significant progress in responding to the Pyrrhonian problems these writings have addressed. (shrink)

In A Theory of Justice (1971), John Rawls introduces the concept of “reflective equilibrium.” Although there are innumerable references to and discussions of this concept in the literature, there is, to the present author's knowledge, no discussion of the most important question: Why reflective equilibrium? In particular, the question arises: Is the method of reflective equilibrium applicable to the choice of this method itself? Rawls's drawing of parallels between Kant's moral theory and his own suggests that his (...) concept of “reflective equilibrium” is on a par with Kant's concept of “transcendental deduction.” Treating these two approaches to justification as paradigmatic, I consider their respective merits in meeting the reflexive challenge, i.e., in offering a justification for choice of mode of justification. My enquiry into this topic comprises three parts. In this first part, I raise the issue of the reflexivity of justification and question whether the reflexive challenge can be met within the framework of A Theory of Justice. (shrink)

How should we proceed when searching for justified answers to normative questions? A prominent proposal is to use the method of reflective equilibrium (RE). Its basic Idea—that we should start from our existing judgments about relevant cases and bring them into equilibrium with systematic principles—is readily recited, but beyond that, conceptions of RE often stay sketchy. RE is seldom explicitly implemented, which makes it difficult to critically evaluate the method and to assess its potential. In my dissertation, I present (...) the first explicit and detailed case study for an application of RE, using it to develop and defend a precautionary principle. -/- The dissertation is divided in two parts, a theoretical and an applied part. In part I, I introduce and operationalize a specific conception of RE. I first describe the central elements of RE by drawing on the most elaborate and fleshed-out conceptions of RE that can be found in the literature. Then, I survey and analyze previous applications of RE in order to both learn from them and identify desiderata for my own case study. Based on a small-scale, exploratory case study, the method is further concretized and operationalized for the implementation in my main case study on the justification of a precautionary principle. -/- In part II, this operationalization is tested in a complex case study that aims at justifying a precautionary principle which is applicable to problems arising from global climate change. In order to be able to select relevant commitments about central problems concerning precautionary principles (PPs), I start with a literature survey. The survey gives an overview on existing proposals for PPs, on which grounds they are defended, and the main objections against them. On this basis, I develop and describe the initial setup for the case study, which is conducted in three main steps and allows to examine different aspects of a RE-application. Thereby, I show that RE can be applied successfully to real problems. I go on to discuss a number of points that are not given sufficient attention in the RE literature so far. With respect to precautionary principles, I show how the commonly discussed principles fail to do justice to ethical considerations, and argue that the application of such principles should instead be triggered by threats of rights violations. This text assumes that reflection on the environment requires consideration of the role of technology and that reflection on technology cannot responsibly omit considering the environment. Furthermore, reflection on the environment-as-encountered and technology-as-encountered and the correlative types of encountering cannot stop before facing the problems of justifying action and valuing as well as cognition. This book is a collection of essays on various problems arising in connection with John Rawls's theory of justice. Its focus is the method of wide reflective equilibrium. The first half of the book begins with Daniels's well-known essay "Wide Reflective Equilibrium and Theory Acceptance in Ethics" and ends with an excellent discussion of the role of reflective equilibrium in Rawls's Political Liberalism. The essays in the second part discuss justice in health care. They are of interest (...) in their own right, and also as illustrating Daniels's view that for those practicing the method of reflective equilibrium, applied moral philosophy is integral to the process of moral theorizing. Daniels says that the essays do not constitute a systematic treatment of wide reflective equilibrium. Healthcare priority-setting institutions have good reason to want to demonstrate that their decisions are morally justified—and those who contribute to and use the health service have good reason to hope for the same. However, finding a moral basis on which to evaluate healthcare priority-setting is difficult. Substantive approaches are vulnerable to reasonable disagreement about the appropriate grounds for allocating resources, while procedural approaches may be indeterminate and insufficient to ensure a just distribution. In this paper, we set out a complementary, (...) coherence-based approach to the evaluation of healthcare priority-setting. Drawing on Rawls, we argue that an institutional priority-setter’s claim to moral justification can be assessed, in part, based on the extent to which its many normative commitments are mutually supportive and free from dissonance; that is, on the ability to establish narrow reflective equilibrium across the normative content of a priority-setter’s policy and practice. While we do not suggest that the establishment of such equilibrium is sufficient for moral justification, we argue that failure to do so might—like the proverbial canary in the coalmine—act as a generalised warning that something is awry. We offer a theoretical argument in support of this view and briefly outline a practical method for systematically examining coherence across priority-setting policy and practice. (shrink)

The paper addresses the possibility of providing a meta-justification of what appears to be crucial epistemic desiderata involved in the method of reflective equilibrium. I argue that although the method of reflective equilibrium appears to be widely in use in moral theorising, the prospects of providing a meta-justification of crucial epistemic desiderata are rather bleak. Nor is the requirement that a meta-justification be provided obviously misguided. Smithies presents an account of justification that ties it to an idealized view of reflection. I argue that no such account can work. More than this, I argue that the kind of idealization which Smithies offers loses contact with the very phenomenon of reflection which he intends to illuminate. I also discuss how Smithies's view bears on the internalism/externalism controversy.

Justification as Ignorance offers an original account of epistemic justification as both non-factive and luminous, vindicating core internalist intuitions without construing justification as an internal condition knowable by reflection alone. Sven Rosenkranz conceives of justification, in its doxastic and propositional varieties, as a kind of epistemic possibility of knowing and of being in a position to know. His account contrasts with recent alternative views that characterize justification in terms of the metaphysical possibility of knowing. Instead, (...) he develops a suitable non-normal multi-modal epistemic logic for knowledge and being in a position to know that respects the finding that these notions create hyperintensional contexts. He also defends his conception of justification against well-known anti-luminosity arguments, shows that the account allows for fruitful applications and principled solutions to the lottery and preface paradoxes, and provides a metaphysics of justification and its varying degrees of strength that is compatible with core assumptions of the knowledge-first approach and disjunctivist conceptions of mental states. This is not a work of historical scholarship, but a provocative attempt to apply ancient Pyrrhonism and the later Wittgenstein to the problems of contemporary analytic epistemology.

Coherentism is the only proper account of justification of empirical knowledge. The final representation of Lawrence Bonjour’s coherentist conception of justification includes such theses as: (a) Justification is a function of coherence and depends on the fact that the system of beliefs is not only coherent at the moment, but remains coherent over a sufficiently long period of time, facing continuous input to its content due to the influence of reality. It is this stability that gives reason (...) to believe that the coherence of the system most likely leads to the truth of beliefs; (b) The system contains a large number of different kinds of cognitively spontaneous beliefs that play the role of those with which all other beliefs of the system must cohere, as well as a sufficient number of law-like statements ascribing to these kinds (including those kinds of introspective and memory beliefs that are necessary in order to recognize other cognitively spontaneous beliefs) a high degree of reliability within the system regarding accompanying assumptions, causal explanations of their genesis, previous experiences in assessment situations, etc; (c) A necessary condition for justification is that the person must be able to cognitively grasp, explicitly or implicitly, at least the approximate content of the belief system and its coherence. This Presumption justifies the only thing that connects our belief system and reality – cognitively spontaneous beliefs. The most controversial element of the conception (d), meta-justification (the demonstration that the standards of coherentist justification are truth-conducting) is a priori in nature and does not require additional justification, since it itself is a consequence of the chosen metaphysical constraints, primarily of internalism. However, there is a persistent disagreement about what the principle entails, exactly. It exists in a multitude of formulations and has potentially conflicting ideas associated with it. This paper is a review of Robert J. Fogelin's Pyrrhonian Reflections on Knowledge and Justification.

This chapter is guided by the hypothesis that the point and purpose of using the concept of justification in epistemic evaluation is tied to its role in the practice of critical reflection. In section one, I propose an analysis of justification as the epistemic property in virtue of which a belief has the potential to survive ideal critical reflection. In section two, I use this analysis in arguing for a form of access internalism on which one has (...) class='Hi'>justification to believe a proposition if and only if one has higher-order justification to believe that one has justification to believe that proposition. In section three, I distinguish between propositional and doxastic versions of access internalism and argue that the propositional version avoids familiar objections to the doxastic version. In section four, I argue that the propositional version of access internalism also explains and vindicates internalist intuitions about cases. For more than half a century, RE has been very popular, as well as controversial, among philosophers of many persuasions. The distinguished philosopher Louis Loeb examines the epistemological framework of Scottish philosopher David Hume, as employed in his celebrated work A Treatise of Human Nature. Loeb's project is to advance an integrated interpretation of Hume's accounts of belief and justification. His thesis is that Hume, in his Treatise, has a "stability-based" theory of justification which posits that his belief is justified if it is the result of a belief producing mechanism that engenders stable beliefs. But Loeb argues that (...) the striking corollary to this theory is that no belief generating mechanism is fully stable - or fully justified - for a fully reflective person. This carefully argued and original interpretation of Hume makes sense of seemingly contradictory ideas and will provoke serious discussion among Hume scholars. (shrink)

SummaryI offer reflections on the doctrine of justification by faith alone in the light of the many challenges of globalization. I briefly characterize globalization as the new context of contemporary theology in the first part, and go on in the second part to defend its relevance as a radical and total critique of life today in its nihilistic pursuit of creaturely arrogance, greed, and pleasure, and argue for the particular urgency of promoting the love and solidarity of Others beyond (...) the conventional boundaries of identity in a world increasingly suffering from unreconciled pluralism of all sorts, ethnic, religious, cultural, and economic. In the third, longest part I offer a new perspective on the soterioriological significance of „good works“ on the basis of a new relationship between creator and creature, a concrete anthropology of action as mediation between subjectivity and objectivity, and the irreducible involvement of the free and responsible subject in the very believing relationship to God. I try to reinstate „good works“ as the human way, as a free and responsible being, of „participating“ in God’s own redemptive work, not as „cooperating with“ divine grace or as „contributing to“ God’s redeeming work, or as „causing“ one’s own redemption. In his book, On Reflection, Hilary Kornblith criticizes what he regards as a chronic tendency in philosophy towards inflating the significance of reflection in ways that manifest a combination of philosophical naiveté and scientific ignorance about how reflection actually works. In these comments, I respond to Kornblith's challenge by sketching an account of the philosophical significance of reflection in the theory of epistemic justification.

In moral epistemology, the method of reflective equilibrium is often characterized in terms of intuitions or understood as a method for justifying intuitions. An analysis of reflective equilibrium and current theories of moral intuitions reveals that this picture is problematic. Reflective equilibrium cannot be adequately characterized in terms of intuitions. Although the method presupposes that we have initially credible commitments, it does not presuppose that they are intuitions. Nonetheless, intuitions can enter the process of developing a (...) class='Hi'>reflective equilibrium and, if the process is successful, be justified. Since the method of reflective equilibrium does not essentially involve intuitions, it does not constitute a form of intuitionism in any substantial sense. It may be classified as intuitionist only in the minimal sense of not reducing justification to a matter of inference relations alone. (shrink)

How can we figure out what’s right or wrong, if moral truths are neither self-evident nor something we can perceive? Very roughly, the method of reflective equilibrium (RE) says that we should begin moral inquiry from what we already confidently think, seeking to find a a match between our initial convictions and general principles that are well-supported by background theories, mutually adjusting both until we reach a coherent outlook in which our beliefs are in harmony (the equilibrium part) and (...) we know why and how they support each other (the reflective part). It has been central to the self-understanding of normative ethics and other branches of philosophy in the last half a century. In this chapter, we examine the history of the idea of RE and introduce a schema for generating 256 variants. We explain why RE is subject to serious objections insofar as it purports to yield epistemic justification in virtue of achieving coherence. However, we also develop a new argument to the effect that RE is the best feasible method for us to achieve moral understanding and the ability to justify our judgments to others. It may thus be crucial for responsible moral inquiry, even if coherence among considered judgments and principles is neither sufficient nor necessary for justified moral belief. (shrink)

The paper is concerned with the epistemological status of testimony and the question of what may confer justification on true testimonial beliefs and enable us to call such beliefs knowledge. In particular, it addresses certain anti-reductionist arguments in the epistemology of testimony and their incompatibility with the grammatical categories of egophoricity (conjunct/disjunct marking) and evidentiality (information source marking) present in the architecture of natural languages. First, the tradition of epistemological individualism and its rationale are discussed, as well as certain (...) attempts within this tradition to include testimony-based beliefs in the body of legitimate and rational beliefs. The next section is concerned with the anti-reductionist approach to testimonial beliefs and some arguments supporting ‘the credulity principle’ grounded in Thomas Reid's philosophy of common sense. The last two sections show how the anti-reductionist argumentation is threatened with an insoluble dilemma when considered in the context of languages with the grammatical categories of egophoricity (conjunct/disjunct marking) and evidentiality (information source marking). Special attention is paid to the justificatory role of egophoric and evidential marking; how these grammatical categories may influence the process of belief formation, and consequently, how this bears upon the nature of justification for testimonial beliefs. The final conclusion of the paper is that the anti-reductionist claim concerning the directness and non-inferential nature of testimonial knowledge is bound to meet objections grounded in the structure of many natural languages. This leads to a paradox: in discussion with reductionism, anti-reductionists do seek support for their arguments in common sense beliefs reflected in everyday language, and, on the other hand, their claims are incompatible with the linguistic data found in a number of natural languages. A belief is reflectively lucky if it is a matter of luck that the belief is true, given what a subject is aware of on reflection alone. Various epistemologists have argued that any adequate theory of knowledge should eliminate reflective luck, but doing so has proven difficult. This article distinguishes between two kinds of reflective luck arguments in the literature: local arguments and global arguments. It argues that local arguments are best interpreted as demanding, not that one be (...) reflectively aware of the reliability of the sources of one’s beliefs, but that one’s beliefs be attributable to one as one’s own. The article then argues that global arguments make illegitimate demands, because they require that we be ultimately answerable for our beliefs. In the end, the article argues that epistemologists should shift their focus away from reflective luck and toward the conditions under which beliefs are attributable to cognitive agents. (shrink)

Justificatory defenses apply to actions that are generally wrong and illegal—mainly since they harm people—when they are justified—usually since they prevent harm to others. A strict conception of justification limits justificatory defenses to actions that reflect all pertinent principles in the optimal manner. A more relaxed conception of justification applies to actions that do not reflect all pertinent principles optimally due to mistake but are not too far from this optimum. In the paper, I consider whether justificatory defenses (...) should reflect the strict conception of justification or a more relaxed conception of justification. This question is important since often the relevant actions are not strictly justified, while the alternative of an excuse is frequently irrelevant or does not provide an appropriate solution. Reflection on this question raises the following dilemma: On the one hand, the strict interpretation seems too harsh, especially with regard to legal liability. On the other hand, it is difficult to explain the basis for a more relaxed conception of justification. I conclude, first, that justification—and accordingly wrongfulness—is a matter of degree and that the strictly justified action is merely the peak of a continuum, and, second, that a practical reaction is in place only with regard to actions whose wrongness is above a minimal threshold. Among epistemologists, it is not uncommon to relate various forms of epistemic luck to the vexed debate between internalists and externalists. But there are many internalism/externalism debates in epistemology, and it is not always clear how these debates relate to each other. In the present paper I investigate the relation between epistemic luck and prominent internalist and externalist accounts of epistemic justification. I argue that the dichotomy between internalist and externalist concepts of justification can be characterized in terms (...) of epistemic luck. Whereas externalist theories of justification are incompatible with veritic luck but not with reflective luck, the converse is true for internalist theories of justification. These results are found to explain and cohere with some recent findings from elsewhere in epistemology, and support a surprising picture of justification, on which internalism and externalism are complementary rather than contradictory positions. The use of Scripture for deliberation and justification in making moral judgments is a crucial and neglected function of the Bible in Christian ethics.

The Enlightenment heritage has meant that we have tended to conceive of tradition as inevitably opposed to reason, and that the exten sion of one as a major constitutive element in social affairs, implies the retraction of the other. However, this paper attempts to conceive the relationship between tradition and reason in a more articulated context, suggesting that this dichotomy between reason and tradition may itself be what Hans-Georg Gadamer calls an 'Enlightenment prejudice'. By drawing on the work of thinkers (...) within a broad hermeneutic tradition, this paper attempts to articulate an alternative means of thinking about the relation ship between reason and tradition, which suggests that it is only when we adopt a particular Enlightenment perspective that we are hermeneutically confined to confirming Enlightenment presuppositions that there is such a dichotomy between reason and tradition. According to Phenomenal Conservatism (PC), if a subject S has an appearance that P, in the absence of defeaters, S has justification for believing P by virtue of her appearance's inherent justifying power. McCain and Moretti (2021) have argued that PC is affected by the problem of reflective awareness: if S becomes reflectively aware of an appearance, the appearance loses its inherent justifying power. This limits the explanatory power of PC and reduces its antisceptical bite. This is particularly important when patients are approaching death so that they may address their material and spiritual wishes—among other needs—as they prepare for death. Justification for this position is drawn from the Maqasid Al-Shariah-based Islamic bioethics approach, from which it is possible to argue that the harm of withholding diagnoses and prognoses from patients who are imminently dying outweighs the potential benefits.
