Ableist attitudes and structures regarding disability are increasingly recognized across all sectors of healthcare delivery. After Dobbs, novel questions arose in the USA concerning how to protect reproductive autonomy while avoiding discrimination against and devaluation of disabled persons. As a case study, we examine the Louisiana’s Department of Public Health August 1st Emergency Declaration, “List of Conditions that shall deem an Unborn Child ‘Medically Futile.’” We raise a number of medical, ethical, and public health concerns that lead us to (...) argue the declaration should be rescinded. Since the U.S. Supreme Court's decision in Dobbs vs. Jackson Women's Health Organization, a growing web of state laws restricts access to abortion. Here we consider how, ethically, doctors should respond when terminating a pregnancy is clinically indicated but state law imposes restrictions on doing so. We offer a typology of cases in which the dilemma emerges and a brief sketch of the current state of legal prohibitions against providing such care. We examine the issue from the standpoints of (...) conscience, professional ethics, and civil disobedience and conclude that it is almost always morally permissible and praiseworthy to break the law and that, in a subset of cases, it is morally obligatory to do so. We further argue that health care institutions that employ or credential physicians to provide reproductive health care have an ethical duty to provide a basic suite of practical supports for them as they work to ethically resolve the dilemmas before them. In 1971, two years before Roe v. Wade affirmed federal protection for abortion, Judith Jarvis Thomson attempted to demonstrate the wrongs of forced gestation through analogy: you awake to find that the world's most esteemed violinist is wholly, physically dependent on you for life support. Here, the authors suggest that Thomson's intuition, that there is a relevant similarity between providing living kidney support and forced gestation, is realized in the contemporary practice of living organ donation. After detailing the robust analogy (...) between living kidney donation and gestation, we turn to current ethical guidelines incorporated in the United Network for Organ Sharing's requirements for legally authorized organ donation and transplantation. We conclude that if, as we—and Thomson—suggest, organ donation and gestation are relevantly similar, then the ethical framework supporting donation may aid in articulating ethical grounds that will be compelling in informing the legal grounds for a defense of abortion. Jackson Women’s Health Organization and the backlash towards reproductive justice that it represents warrant a global feminist response informed by broad theoretical and geopolitical lenses. We consider how a solidaristic, transnational feminist movement might learn from Latin American feminist movements that have been successful in uniting broad coalitions in the fight for reproductive justice as situated within far-reaching political goals. This article considers challenges facing the pro-life movement after Dobbs v. Jackson Women’s Health Organization (2022). It identifies four questions the movement must face: (1) whether to adopt a combative or conciliatory rhetorical stance; (2) how to prioritize new legislative goals; (3) how to define the limits of acceptable compromise; and (4) how to respond to Americans with ambivalent attitudes toward abortion. ABSTRACT:This essay explores how bioethics as a field, rather than as a collection of individual efforts by bioethicists working within it, can inform deliberation on matters of bioethical import that, for better or worse, are in the hands of civic processes. It is motivated by the repeal of a constitutional protection of abortion access in the Supreme Court Dobbs v. Jackson Women's Health Organization decision, which effectively returned abortion regulations to states rather than setting a baseline federal protection of (...) abortion access up to fetal viability. Given the outsized role of local legislators in shaping health-care policy through legislation, about abortion as well as other health topics, the author proposes foundational bioethical education for legislators and considers two potential models for such education: one that operates on a clinical ethics consultation model, and one that mirrors bioethical coursework taught in traditional academic settings but modified for a legislator audience. Although both models present notable challenges requiring further conceptualization and problem-solving, overcoming these hurdles would enable bioethics to provide a service to civic learning and placemaking that would complement advocacy or lobbying efforts by individual bioethicists. This letter responds to the article “Beneath the Sword of Damocles: Moral Obligations of Physicians in a Post-Dobbs Landscape,” by Anne Drapkin Lyerly, Ruth R. Faden, and Michelle M. Mello, in the May-June 2024 issue of the Hastings Center Report.

This special issue of the Journal of Medicine and Philosophy focuses on unintended intrauterine death (UID) and preterm delivery (both phenomena that are commonly—and unhelpfully—referred to as “miscarriage,” “spontaneous abortion,” and “early pregnancy loss”). In this essay, I do two things. First, I outline contributors’ arguments. Most contributors directly respond to “inconsistency arguments,” which purport to show that abortion opponents are unjustified in their comparative treatment of abortion and UID. Contributors to this issue show that such arguments often rely on (...) a grossly oversimplified picture of abortion opponents’ views. Furthermore, contributions in this issue weigh in on issues regarding UID with theoretical import and therapeutic implication beyond the inconsistency argument debate. These papers can be mined for principles that better inform us about anembryonic pregnancies (i.e., nonviable pregnancies in which a gestational sac exists but no embryonic pole can be seen via transvaginal ultrasound), UID-prevention research, the law concerning UID (especially post-Dobbs), policies for handling embryonic remains, and moral psychology as it relates to UID, emotion, and empathy. In each case, conceptual philosophical analysis might bring about therapeutic benefits for those affected by UID. Philosophers, therefore, are in position not only to provide clarity—careful analysis and discussion of UID and related phenomena—but are also in position to genuinely help people affected by UID. The Food and Drug Administration (FDA) recently issued its first approval of an oral contraceptive medication for access without a clinician’s prescription. One might expect this will lead to fewer people seeking to terminate unplanned pregnancies, including in states that imposed severe restrictions on abortion care following the Supreme Court’s reversal on abortion rights in Dobbs v. Jackson Women’s Health Organization. Despite the clear potential health benefits, increased accessibility of oral contraceptives offers no real solution to ongoing threats to (...) patients’ reproductive health and moral rights created by post-Dobbs abortion restrictions. To secure their patients’ reproductive health and well-being, clinicians must work to maximize the benefits of OTC oral contraceptives without relenting in their advocacy for safe and accessible abortion care. This paper offers a qualified defence of physician non-compliance with antiabortion legislation in the wake of the Supreme Court’s decision in Dobbs v. Jackson Women’s Health Organization. The paper examines two ethically troubling trends of post-Dobbs legislation: narrow and vague maternal health exemption clauses and mandatory reporting of miscarriages in jurisdictions where patients may criminal prosecution for medically induced abortions. It then examines and defends a professional obligation on the part of physicians to comply with the law. (...) This obligation, however, is defeasible. The paper then argues that physicians’ obligations to comply with the law is defeated when the law is illegitimate and following the law would constitute bad medical practice. Finally, it argues that the ethically troubling trends in post-Dobbs antiabortion legislation may meet these criteria. (shrink)

In this short essay, I report results from a representative national dataset from the Cooperative Institutional Research Program that shows that significantly more men than women intend to major in philosophy at the high‐school and pre‐university level. This lends credence to pre‐university effects hypotheses of women's underrepresentation in philosophy and successfully replicates a smaller analysis performed by Cheshire Calhoun at Colby College in 2009. I also defend my analysis against an objection that claims that intention to major is not a (...) good predictor of final major selection. Finally, I argue that this new analysis should lead to further investment in university‐level diversity programs. (shrink)

The works of Gersonides encompass science, philosophy, and biblical exegesis. The majority of the philosophical writings are constituted by supercommentaries on Averroes’s commentaries on Aristotle’s works, whereas his magnum opus, The Wars of the Lord, encompasses all three genres. This paper studies consumers’ reactions and resistance to being responsibilized for making climate-friendly food choices. While resistance to consumer responsibilization has been studied from an individual experiential perspective, we examine its collective characteristics. We do this by tracing the controversial marketing campaign of a Swedish poultry producer, encouraging consumers to “do something simple for the climate” by eating chicken rather than beef. In our analysis of social media comments and formal complaints to the consumer protection authority, we mobilize Foucault’s notion (...) of counter-conduct to analyse subtle forms of resistance to consumer responsibilization. We identified four interrelated yet distinct forms of consumer counter-conduct: _challenging truth claims, demanding ‘more,’ constructing ‘the misled consumer,’_ and _rejecting vilification._ By theorizing these counter-conducts, we demonstrate how consumers collectively contested both the means and ends of responsibilization—but not the underlying premise of individualized responsibility. Thus, our study helps to explain how consumers’ resistance reproduces, rather than undermines, responsibilization. (shrink)

The thesis investigates the philosophical dimension of providence as the manifestation of human perfection in the thought of Moses Maimonides and St. Thomas Aquinas. In contrast to most studies of providence, which question the possibility of affirming human freedom in the light of divine knowledge, the thesis examines the function of providence in human existence. I argue that principally the concept becomes intelligible only if God is understood as providens rather than praevidens, since, for both Maimonides and Aquinas, understanding the (...) ontological and noetic aspects comprising man's relation to providence is a prerequisite to apprehending the nature of divine knowledge. ;In addressing not only the Guide of the Perplexed and the Summa Theologiae but also biblical and philosophical commentaries, I both explore Maimonides' and Aquinas' philosophical hermeneutics and address the question of the consistency and coherence of their works. ;The thesis examines the full scope of the relations between providence and human perfection in order to demonstrate that the rational assent consequent upon intellectual pursuit is the condition for human perfection. Moreover, I attempt to demonstrate that although the first principle informing their metaphysics is a creator and provident God, neither Maimonides nor Aquinas base their accounts of human perfection upon unexamined assent to revelation. Rather, insisting upon the unity and universality of truth, both thinkers strive to establish truths known through revelation by means of demonstration, or of probable reasoning in subjects wherein the former methods' cannot be applied. ;In conclusion, I demonstrate why the recognition of the limitations of demonstrative reasoning is the condition for intellectual perfection, or active participation in providence, rather than a passive resignation to an unknowable providential order. In fact, I argue that participative activity--the manifestation of the proper understanding of providence--is an ethical activity characterized by excess and hence, that it is true imitatio Dei. The question is engaged here specifically from the perspective of a biblical scholar using a biblical text-the poem in Song 4:1–7 — to focus and source the discussion.

This paper provides an empirical and conceptual account on seeing machine learning models as part of a sociotechnical system to identify relevant vulnerabilities emerging in the context of use. As ML is increasingly adopted in socially sensitive and safety-critical domains, many ML applications end up not delivering on their promises, and contributing to new forms of algorithmic harm. There is still a lack of empirical insights as well as conceptual tools and frameworks to properly understand and design for the impact (...) of ML models in their sociotechnical context. In this paper, we follow a design science research approach to work towards such insights and tools. We center our study in the financial industry, where we first empirically map recently emerging MLOps practices to govern ML applications, and corroborate our insights with recent literature. We then perform an integrative literature research to identify a long list of vulnerabilities that emerge in the sociotechnical context of ML applications, and we theorize these along eight dimensions. We then perform semi-structured interviews in two real-world use cases and across a broad set of relevant actors and organizations, to validate the conceptual dimensions and identify challenges to address sociotechnical vulnerabilities in the design and governance of ML-based systems. The paper proposes a set of guidelines to proactively and integrally address both the dimensions of sociotechnical vulnerability, as well as the challenges identified in the empirical use case research, in the organization of MLOps practices. A cursory review of studies of Spinoza’s thought discloses that diverse and often opposed religious, philosophical, historical, even literary traditions have claimed and disclaimed his debt to them as well as theirs to him. A Jewish, Christian, pantheist, and atheist Spinoza vies with a rationalist and a mystic, a realist and a nominalist, an analytic and a continental, an historicist and an a-historical one. And this list is far from exhaustive of the dazzling array of further, nuanced debates and interpretations (...) within each tradition. The irony exhibited by the history of Spinoza scholarship is especially poignant insofar as the debates and controversies surrounding his thought are rather heated or affective, this in relation to a thinker who strove to control, circumscribe, and transform the passions by the intellect. Following Spinoza’s motto caute, I shall attempt to evade the fray by disclaiming the possibility of a definitive interpretation not only because it is premature, but also and especially because I believe that Spinoza’s writings deliberately resist direct appropriation and translation into philosophically “respectable” language. In addition, while it is possible to identify Spinoza’s very few, explicit successors, e.g., Schelling, Lessing, Hölderlin, Hegel, and Nietzsche, it is exceedingly difficult to limit the list of his predecessors for two main reasons: he is both reticent to name and misleading in naming his predecessors—the latter only in the sense that he is sooner ready to identify an adversarial position than to acknowledge debt to the same thinker in other respects; and Spinoza’s debt to his varied predecessors is neither consistent nor systematic, for his diverse discussions are informed by different considerations, positions, and thinkers, at times only in a negative way. In fact, one of the common problems characterizing contemporary Spinoza scholarship is the resolve to ignore or dismiss the significance of such “negative” influences. For these reasons alone, we should be wary of attempts to systematize Spinoza’s thought or to regard him as a system builder, despite such attempts by his late-eighteenth and nineteenth century disciples, especially Schelling and Hegel. But, in addition, in the Tractatus de Intellectus Emendatione, Spinoza cautions the reader to refrain from judgments concerning the truth or falsity of philosophical discussions on the basis of some paradoxical statements.
