Can epistemic luck be captured by modal conditions such as safety from error? This paper answers ‘no’. First, an old problem is cast in a new light: it is argued that the trivial satisfaction associated with necessary truths and accidentally robust propositions is a symptom of a more general disease. Namely, epistemic luck but not safety from error is hyperintensional. Second, it is argued that as a consequence the standard solution to deal with this worry, namely the invocation of content (...) variation, fails. Third, it is considered whether the condition can serve some restricted theoretical role; the hypothesis is rejected. Finally, it is tentatively suggested that epistemic luck’s hyperintensionality derives from its being an explanatory notion, and an analogy is drawn with failures of probabilstic conceptions of explanation in the philosophy of science. This book is the first to offer a detailed analysis of Aristotelian and Kantian ethics together, in a way that remains faithful to the texts and responsive to debates in contemporary ethics. Recent moral philosophy has seen a revival of interest in the concept of virtue, and with it a reassessment of the role of virtue in the work of Aristotle and Kant. This book brings that re-assessment to a new level of sophistication. Nancy Sherman argues that Kant preserves a (...) notion of virtue in his moral theory that bears recognisable traces of the Aristotelian and Stoic traditions, and that his complex anthropology of morals brings him into surprising alliance with Aristotle. That is, could there be a property P that is instanti-ated at worlds w1 and w2, and is perfectly natural at w1 but not at w2? Here, we offer an original argument for the non-world-relativity of perfect naturalness. In the mid twentieth century, logical positivists and many other philosophers endorsed a simple equation: something was necessary just in case it was analytic just in case it was a priori. Kripke’s examples of a posteriori necessary truths showed that the simple equation is false. But while positivist-style inferentialist approaches to logic and mathematics remain popular, there is no inferentialist account of necessity a posteriori. I give such an account. This sounds like an anti-Kripkean project, but it is not. (...) Some of Kripke’s remarks even suggest this kind of approach. This inferentialist approach reinstates neither the simple equation nor pure conventionalism about necessity a posteriori. But it does lead to something near enough, a type of impure conventionalism. In recent years, metaphysically heavyweight approaches to modality have been popular, while other approaches have lagged behind. The inferentialist, impure conventionalist theory of necessity I describe aims to provide a metaphysically lightweight option in modal metaphysics. (shrink)

On Anselmian theism, God is, amongst other things, a necessary being. On genuine modal realism, possible worlds are maximal mereological sums of spatiotemporally connected individuals. I argue in this paper that AT and GMR are either incompatible or their conjunction leads to—amongst other things—modal collapse. Specifically, I argue: regardless of whether God is concrete or abstract, His necessary existence either is inconsistent with AT-GMR or it leads to, amongst other things, modal collapse for AT-GMR. I conclude the paper by contending (...) that, if I am correct, the ATist will have an argument against the truth of GMR, and the GMRist will have an argument against the truth of AT. (shrink)

Against the widely affirmed dictum, “all existential statements can be denied without self-contradiction,” this essay argues for some existential statements being necessarily true semantically and thus for transcendental metaphysics in the strict sense. Having briefly reviewed how Ronald Dworkin, Karl-Otto Apel, and Thomas Nagel each affirm the dictum in question and, thereby, imply the possible truth of the statement, “nothing exists,” the essay seeks to show how the statement, “‘nothing exists’ is possibly true”, is pragmatically self-refuting. Against the implications of (...) subjectivity as such, that statement implies the impossibility of knowing any existential statement; that is, knowing what exists or, indeed, whether anything exists is forever denied to us. The dictum is, therefore, itself impossible, and the essay concludes with the assertion that transcendental metaphysics should be neoclassical. (shrink)

The central concern of this paper is to explore the efforts of Schiller's post-Kantian idealism and Marcuse's critical theory to develop a new conception of free human experience. That conception is built on the notion of play. Play is said to combine the human capacities for physical pleasure and reason, capacities which the modern world has dualized. Analysis of their respective accounts of play reveals its ambivalent form in the work of both philosophers. Play supports the ideal of ‘freedom from (...) necessity’, understood as a release from all external constraint. But it also appears to serve as a model for ‘freedom as a higher necessity’. In the case of Schiller, the ambivalence encompasses idle play and an obligation to make ourselves worthy of freedom. For Marcuse, play represents a kind of libidinal idleness while also underpinning a non-alienated conception of labour. (shrink)

Shepherd defends an account of the universe founded on two causal principles: that effects necessarily have causes, and that like causes have like effects. Folding mind into the class of natural phenomena governed by these principles, Shepherd naturalizes the mind, but in doing so she sets herself the challenge of explaining how, within a deterministic universe, agents can be necessary causes of their own actions. With special attention to Shepherd’s resistance to materialism and to any reduction of the mental, the (...) paper argues that we can read Shepherd as leveraging her original theory of causation to develop a distinctive compatibilist view of the psychology of intention, one that makes agents the necessary causal sources of their own actions. Blum (Philosophical Investigations 46, 2023, 264) argues that Tarski's T‐schema and the thesis of the necessity of identity are mutually inconsistent. It is argued that his argument fails.

In the Critique of Judgment Kant argues that we may assume a certain ‘common inner sense’ on pain of skepticism. I present an interpretation of this argument, which holds that its skeptical threat involves the threat of a regress for judgment, that it argues for a principle underlying both empirical cognition and judgments of beauty, and that no ‘everything is beautiful problem’ results. This principle is essentially ‘epistemologically normative’ rather than moral, although in the end the moral raises its head. (...) David Gauthier tries to defend morality by showing that rational agents would choose to adopt a fundamental choice disposition that permits them to cooperate in prisoner's dilemmas. In this paper, I argue that Gauthier, rather than trying to work out a prudential justification for his favored choice disposition, should opt for a transcendental justification. I argue that the disposition in question is the product of socialization, not rational choice. However, only agents who are socialized in such a way that they (...) acquire a disposition of this type could acquire the capacity to use language. Given the internal connection between language and thought, this means that no agent endowed with such a disposition could rationally choose to adopt another. Thus rational reflection by moral agents upon their own fundamental choice disposition will have no tendency to destabilize it. (shrink)

The issues of just what laws of nature are and what makes statements law-like have been more discussed than advanced. After exploring the general area and uncovering some difficulties which, I suspect, make the case even knottier than generally imagined, I argue that certain resources available only to the theist---in particular, counterfactuals of God’s freedom---may provide the materials needed for constructing solutions.

ABSTRACTThe Centre for Social Ontology working group project has been exploring the concept of a Morphogenic Society since 2013. The project is now drawing to a close. One of the arising issues from the project has been whether such a society can be and is liable to be one of human flourishing. In this short paper, I explore one possible aspect of the concept of a Morphogenic Society.1 A Morphogenic Society may involve issues of ‘contingent necessity’. This issue considers the ethics of a healthcare provider intervening into a patient’s genitalia, whether by means of cutting or surgery or by ‘mere’ touching/examination. Authors argue that the permissibility of such actions in the absence of a relevant medical emergency does not primarily turn on third-party judgments of expected levels of physical harm versus benefit, or on related notions such as extensiveness or invasiveness; rather, it turns on the patient’s own consent. To bolster this argument, attention is drawn to (...) the status of the genitals as ‘intimate’ anatomy—a status that is not fully erased by being in a medical context. In this editorial, we draw on the work of Talia Mae Bettcher on ‘intimate agency’ to explore why unconsented interventions into the genitalia may constitute a distinctive sort of personal violation compared to unconsented contact with various other parts of the human body. In their feature article, Marit van der Pijl and colleagues1 argue it is unethical for healthcare providers to perform unconsented episiotomies on persons in labour. In particular, they suggest that, outside of certain rare emergencies in which, for example, the person giving birth is incapacitated1 and the procedure cannot be delayed until consent becomes possible without introducing a significant risk of serious harm (call these ‘medically necessary’2 procedures), ‘presumed consent’ is the incorrect standard to apply. Instead, they stress that, especially when a proposed intervention involves a person’s genital, sexual or reproductive organs, the need to obtain their explicit consent in advance of proceeding must be honoured. As the authors note, the broader social significance of our genitalia—widely regarded as ‘private’ anatomy—is not erased by being in a medical context (see also 2–4). What is this discipline called history of philosophy? What standards are relevant to its assessment? There aren’t single, straightforward answers to these quest.

An issue in current animal welfare ethics is the use of animals in medical education. At stake is the conflict of pain and suffering of the animals vs. the benefit to the students. The educator's role is to balance these two concepts. If the animals do suffer, this has to be justified by clearly establishing the necessity of their use. Neither this justification nor the methods for making the decision are clear. What makes the rule of law so special that it is to conscientiously punish the â oebadâ doers and reward the â oegoodâ onesâ "such that, where there is the rule of law, peace and order are to be expected, so that â oethe rule of law is better than the rule of any individualâ? Take the case of international law, as an illustration. While different international courts have been busy going after the killers of innocent victims in Rwanda and (...) Liberia, they have turned a blind eye to the major powers which have killedâ "on a much larger and more brutal scale, by comparisonâ "innocent civilians in Iraq and Afghanistan, just to cite two current examples. Contrary to the conventional wisdom conveniently held by many in human history, the rule of law has its other side which has not yet been systematically understood, such that the rule of law is neither possible nor desirable to the extent that the defenders of legal institutions in human history would like us to believe. Lest any misunderstanding hastily occur, this is not to imply that the rule of law is absolutely useless, or that the literature in jurisprudence (and other related fields like political philosophy, ethics, law and economics, and the sociology of law) should be dismissed because of its scholarly irrelevance. Of course, neither of these two extreme views is reasonable either. Instead, this book provides an alternative (better) way to understand the nature of law, in relation to its necessity and contingency in the context of justiceâ "while learning from different approaches in the literature but without favoring any one of them (nor integrating them, since they are not necessarily compatible with each other). In the process, this book offers a new theory to transcend the existing approaches in the literature in a new directionâ "in that, in the end, there is no justice without injustice and that it will be transcended too. This seminal project, if successful, will fundamentally change the way that we think about the nature of law, from the combined perspectives of the mind, nature, society, and culture, with enormous implications for the human future and what I originally called its â oepost-humanâ fate. Philosophers traditionally interpret Kant as a retributivist, but modern interpreters, with reference to Kant’s theory of justice and problematic passages, instead propose penal theories that mix retributive and deterrent features. Although these mixed penal theories are substantively compelling and capture the Kantian spirit, their dual aspects lead to a justificatory conflict that generates an apparent dilemma. To resolve this dilemma and clear the ground for these mixed theories, I will outline and reinterpret Kant’s penal theory by situating it in his (...) broader moral and political philosophy. This move grounds the followability requirement, which is necessary to resolve the dilemma. (shrink)

Two related claims have lately garnered currency: dispositional essentialism—the view that some or all properties, or some or all fundamental properties, are essentially dispositional; and the claim that laws of nature (or again, many or the fundamental ones) are metaphysically necessary. I have argued elsewhere (On the metaphysical contingency of laws of nature, Oxford University Press, Oxford, 2002) that the laws of nature do not have a mind-independent metaphysical necessity, but recent developments on dispositions have given these ideas a (...) new vibrancy and made them the topic of more focused discussion. So I would like to revisit this, arguing that the new work, as interesting and important as it is to our understanding of fundamental properties, powers and dispositions, should not change our minds about metaphysical necessity. One should still think necessity is conceptually or conventionally grounded. I do not argue that laws of nature are not necessary, nor that properties do not have dispositional essences, but only that if these are the case, then, like other de re or empirical necessities, they have no metaphysical weight and are based in our rules or decisions about how to talk about the world. We may have excellent reasons to talk and think in this way—but these reasons do not include, require or provide evidence of mind-independent metaphysical necessity or essences. (shrink)

Bell introduces local beables in contrast to quantum mechanical observables. The present article emphasizes the importance and necessity of introducing local beables in quantum mechanics from the ontological and epistemological points of view. We argue that suggesting beables in the ontology of quantum mechanics is necessary to give an adequate account of its testability.

A triviality result for what Lewis called “the Desire by Necessity Thesis” and Broome : 265–267, 1991) called “the Desire as Expectation Thesis” is presented. The result shows that this thesis and three other reasonable conditions can be jointly satisfied only in trivial cases. Some meta-ethical implications of the result are discussed. The discussion also highlights several issues regarding Lewis ’ original triviality result for “the Desire as Belief Thesis” that have not been properly understood in the literature.

It is generally not recognized that Whewell's conception of necessary truth evolved only gradually; his early statements are misleading. For this reason, and because of certain peculiarities in his expository style over his publishing history, he is commonly thought to have used the term "necessary" in the sense of "absolutely necessary". I argue that, on the contrary, the term is essentially relational in his mature view. This conclusion leads, in turn, to a re-interpretation of his doctrine of "fundamental ideas". Here (...) I argue that the crux of his position is that cognitive principles which are initially regulative become, through invention, repeated employment, and stipulative definition, constitutive ones. Open peer commentary on the article “Going Beyond Theory: Constructivism and Empirical Phenomenology” by Urban Kordeš. Upshot: I discuss three of the target article’s topics that I find either problematic or important. First, I discuss a potentially dangerous consequence of claiming that empirical phenomenology necessarily calls for a constructivist foundation. Second, I consider the threat to intersubjective validation and the related problem that the author does not specify what technique one should use for training and collecting data in research on (...) experience.
