Can liberal ideals clean up dirty politicians or politics? This article doubts they can. It disputes that a ‘clean’ liberal person might inhabit the dirty clothes of the real politician, or that a clean depoliticized liberal constitution can constrain real-world dirty politics. Nevertheless, the need for a democratic prince to wear clean liberal gloves offers a necessary and effective political restraint. It also means that citizens share the hypocrisy and dirt of those who serve them (...) — for we legitimize the dirtiness of politics by requiring politicians to seem cleaner than we know they ever can be in reality. Accordingly, in this book I examine the philosophical, motivational, and practical challenges of education theory, policy, and practice in the twenty-first century. This book explores the common thread holding together seemingly diverse tendencies in attacks on liberalism. The author argues that ambivalence about the self and about desire as an expression of the self fosters the intense animosity we observe directed toward the liberal ideal. Ambivalence arises because the self is viewed as the locus of a destructive form of desire, one that must be controlled and repressed. The author argues that speaking of ambivalence toward the self is another way of (...) speaking of ambivalence toward freedom, an ambivalence expressed in the impulse toward coercion that plays such a powerful role in the attack on liberalism. The article deals with the question whether an unconditional basic income (UBI) is part of an ideal liberal-egalitarian welfare regime. Analyzing UBI from an ideal-theoretical perspective requires a comparison of the justice performance of ideal welfare regimes instead of comparing isolated institutional designs. This holistic perspective allows for a more systematic consideration of issues like institutional complementarity. I compare three potential ideal welfare regimes from a liberal-egalitarian perspective of justice: An ideal social democratic regime, a mixed regime containing (...) a moderate UBI and a maximal UBI regime where UBI replaces most of the welfare state. These regimes are evaluated with respect to three aspects of justice performance: the scope and neutrality of opportunities provided, institutional complementarities with a dynamic, globalized economy and the policy feedback effects on the political stability of liberal-egalitarian political coalitions. Latin American religious political thought includes colonial Spanish and Portuguese ideologies that preceded independence but have survived into the post-independence era, authoritarian ideologies supportive of military governments in the twentieth century, and progressive liberation theologies. In this article, I present a distinct tradition: a version of classical liberal thought. This tradition is skeptical of big government, opposed to caste systems, supportive of a high degree of federalism, uneasy with militarism, and supportive of democratic institutions while affirming religious social norms. Liberal Socialism exposes false ideas of justice behind neo-liberal capitalism and combines Rawls's ideas on justice and Marx's views on capitalism to make a plausible case for the alternative social ideal of liberal socialism. A fixed social structure gives equal weight to all competing claims for rights, liberties, and shares of the burdens and benefits of social cooperation, while allowing a democratic majority vote for liberal socialism.

In The Law of Peoples Rawls claims that liberal well-ordered societies (LWOSs) should regard certain non-liberal societies, decent hierarchical societies (DHSs), as equal members of a just international order, a ‘Society of Peoples.’ Rawls maintains, however, that while the ‘basic structures’ (the main political and economic institutions) of LWOSs are fair systems of social cooperation, the basic structures of DHSs are only ‘decent’ systems of social cooperation. I explain why the basic structures of DHSs cannot be fair systems (...) of social cooperation. In doing so, I refute a recent defense of DHSs advanced by Samuel Freeman. I then argue that because the basic structures of DHSs cannot be fair systems of social cooperation, Rawls is not justified in holding that LWOSs should refrain always from offering economic incentives to DHSs in order to encourage them to liberalize their political institutions. The ultimate aim of the foreign policies of LWOSs should be a world in which liberal democratic rights are respected by all societies. (shrink)

Examines four objections stemming from the clash of theory and intuition. The nature of state governance in consolidated liberal democracies has important implications for the ideal theory debate. The states of these societies are polycentric. Decision-making power within them is disaggregated across multiple sites. This rules out one major justification for ideal theory. On this influential view, the ideal furnishes a blueprint of the morally perfect society that we should strive to realise. This justification is not viable in consolidated liberal democracies because their states lack an Archimedean point from (...) which the institutional structure as a whole can be designed to accord with the true ideal – whichever it might be. Higher education has often been accused of its anti-social character, represented by the metaphor of the ‘ivory tower’. However, the idea of the pursuit of knowledge per se, which is associated with the ivory tower, has not been widely recognized as a public ideal of higher education. In this study, by drawing on the 20th-century British educational philosopher Paul H. Hirst’s theory of liberal education, I revisit and re-evaluate the Newmanian idea of pursuit of knowledge as an end itself (...) as a public ideal for higher education. I argue that the public criteria provided by discipline-rooted knowledge are among the criteria that are most able to define and legitimise higher education. These public criteria are compatible with the distinctive nature of higher education, which is essentially aimed at adult citizens and linked to research as the creation of knowledge, and can even serve to legitimise the cognitive structure of the society. I hold that we should be critical of those who justify imposing liberal democratic ideals on underdeveloped nations by simply suggesting that they promote equality and justice. In the West, entrenched disparities have shaped liberal ideals in ways that make inequality and injustice look natural and normal. Indeed, gender, class, and racial oppression have existed (...) right alongside liberal democratic ideals. If liberal ideals can be molded to make inequality and injustice look natural and normal in the West, then these same ideals can justify economic interactions, technology transfers, military cooperation, and mutual benefit agreements that sustain global inequality and injustice. Part of John Andrew Rice’s legacy, besides being a founder of Black Mountain College, is his vision of what a small liberal arts college curriculum should be. This vision helps shed light on some possible avenues by which to answer the following important questions: What implications do John Dewey’s progressive educational ideas have for experimenting with curricular design at small colleges? Does the college teacher’s struggle for improvement or growth depend on her having a belief that there is an (...) ideal liberal arts college curriculum? Probably the best known of such ready-made curricula is the Great Books Program, which employs a list of classic primary-source texts as the entry point into highly engaged dialogue, scholarship and learning guided by a teacher or tutor. In order to answer these questions, the paper turns to the historical debate between John Dewey and Robert Maynard Hutchins over the relative merits of progressive educational ideals and the Great Books approach. Most who have commented on this debate emphasize the differences between Dewey and Hutchins’ views.[ii] While Dewey emphasized learning through practical problem solving, in a dynamic mix of subject matter and method, Hutchins stressed exposure to and discussion of at least one-hundred primary texts in the Western canon, from Plato and Aristotle to Emerson and J.S. Mill. Hutchins resisted what he saw as the progressive educator’s push to transform the proper end of educating the whole person into training her for a particular vocation. In response, Dewey criticized Hutchins’ insistence that there existed a “hierarchy of truths” and that higher learning should remain aloof to the concerns of everyday life. Few commentators, however, mention the significant areas of agreement between the pedagogical approaches of Dewey and Hutchins, as well as other Great Books scholars. Since Rice praised the ideas of at least one Great Books proponent (Stringfellow Barr of St. John’s College), a more positive reconstruction of the Dewey-Hutchins exchange helps us to see how Dewey’s ideas informed Rice’s vision for the experimental college at Black Mountain—or so I argue.[iii]. In "Constitutional Goods" Alan Brudner presents novel conception of justice that will inform the content of the ideal liberal constitution. The content of this novel conception of justice is constituted by what Brudner describes as an inclusive conception of liberalism, and its justification is grounded on an account of public reason that is presented in opposition to that of John Rawls. I argue that we should reject both the content and justification of Brudner's conception ofjustice. Brudner is unable to (...) construct an inclusive conception of liberalism from elements of libertarianism, egalitarianism, and communitarianism, and his account of public reason lacks the properties of fairness and reciprocity that differentiate a reasonable agreement from a modus vivendi. This paper therefore defends a Rawlsian political conception ofjustice and justification from Brudner's criticisms and proposed alternatives. (shrink)

At the heart of Kant’s legal-political philosophy lies a liberal, republican ideal of justice understood in terms of private independence (non-domination) and subjection to public laws securing freedom for all citizens as equals. Given this basic commitment of Kant’s, it is puzzling to many that he does not consider democracy a minimal condition on a legitimate state. In addition, many find Kant ideas of reform or improvement of the historical states we have inherited vague and confusing. The aim of (...) this paper is to untangle both puzzles by exploring Kant’s idea of self-governance. I argue that Kant’s idea of self-governance gives us a very good starting point for thinking about how to leave room for a variety of political systems—different ideals—that have grown out of and responding to different contingent historical and cultural circumstances. It also helps us identify those areas where we want to take extra care to build in safeguards to secure stability and to take sufficiently seriously humankind’s truly nasty sides. (shrink)

A liberal state based on propositions about the desirability of individual autonomy is bound to be committed to educational programmes which are incompatible with the beliefs and values of parents from non- liberal religious and cultural minorities. One response to this has been support for public funding of those separate schools which offer an education culturally congruent with the values of parents in non- liberal communities. To resolve the potential threat to liberal individualist ideals a (...) condition of support for individual autonomy is usually attached to liberal acceptance of this solution. This condition is in conflict with the motivation which underpins the setting up of such schools. Despite the growing literature on this debate surprisingly little attention has been given to the work of Isaiah Berlin. This article draws on Berlin's version of liberalism developed within the context of a commitment to value pluralism in order to seek clarification of this liberal dilemma. (shrink)

I analyse the 2014 policy to promote 'British values' in schools from the perspective of the two main positions in contemporary liberal theory, comprehensive liberalism and political liberalism. I highlight in what ways comprehensive and political liberal defences of the policy are unsatisfactory, before briefly sketching a possible alternative position – ‘thin comprehensive liberalism’ – and discussing its potential for justifying a substantive education in liberal values. Its distinctive characteristics, which make this subject one that is scarcely vulnerable to circumstances and assume the possibility to evaluate ends and preferences, limit the awareness of phenomena of colonization of the world of life. Only by modifying such idealization through deep self-reflection shall these colonizing phenomena be overcome. Many liberals have argued that a cosmopolitan perspective on global justice follows from the basic liberal principles of justice. Yet, increasingly, it is also said that intrinsic to liberalism is a doctrine of nationalism. This raises a potential problem for the liberal defense of cosmopolitan justice as it is commonly believed that nationalism and cosmopolitanism are conflicting ideals. If this is correct, there appears to be a serious tension within liberal philosophy itself, between its cosmopolitan aspiration (...) on the one hand, and its nationalist agenda on the other. I argue, however, that this alleged conflict between liberal nationalism and cosmopolitan liberalism disappears once we get clear on the scope and goals of cosmopolitan justice and the parameters of liberal nationalism. This is a detailed, sophisticated and comprehensive treatment of autonomy. Moreover it argues for a quite different conception of autonomy from that found in the philosophical literature. Professor Berofsky claims that the idea of autonomy originating in the self is a seductive but ultimately illusory one. The only serious way of approaching the subject is to pay due attention to psychology, and to view autonomy as the liberation from the disabling effects of physiological and psychological afflictions. Liberation philosophy was born from radical, socialist roots. Yet recent developments by major figures in the tradition, including Enrique Dussel, would appear to position the movement unhelpfully closer to liberalism. The present article argues that this is a misconception, and that Liberation philosophy rather suggests a new ideal for conceptions of political justice, one that also helpfully avoids a number of common objections that dog traditional socialist proposals. Objectives: Evidence based patient choice seems based on a strong liberal individualist interpretation of patient autonomy; however, not all patients are in favour of such an interpretation. The authors wished to assess whether ideals of autonomy in clinical practice are more in accordance with alternative concepts of autonomy from the ethics literature. This paper describes the development of a questionnaire to assess such concepts of autonomy.Methods: A questionnaire, based on six moral concepts from the ethics literature, was sent (...) to aneurysm patients and their surgeons. The structure of the questionnaire was assessed by factor analysis, and item reduction was based on reliability.Results: Ninety six patients and 58 surgeons participated. The questionnaire consisted of four scales. Two of the scales reflected the paternalistic and consumerist poles of the liberal individualist model, one scale reflected concepts of Socratic autonomy and of procedural independence, and the fourth scale reflected ideals of risk disclosure.Discussion: The Ideal Patient Autonomy Scale is a 14 item normative instrument. It is clearly distinct from the generally used psychological preference questionnaires that assess preferences for physician-patient roles. (shrink)

The idea that the exercise of state power should be limited so as to permit free choice in matters of personal conduct has been central to liberalism ever since John Stuart Mill defended the harm principle. However, this surface agreement conceals deeper disagreements. One disputed matter relates to the nature of the tolerant state: is it a state that refrains from improving our moral character by coercive means is it a state that takes no interest whatsoever in the moral character (...) of our lives? A second matter relates to the philosophical justification of tolerance. Should it be justified by relying on distinctively liberal values, such as personal autonomy and self-determination? Or is a less controversial justification available — one that can be endorsed by non-liberals as well as liberals? This article explores these issues. It examines the views of Ronald Dworkin, John Rawls and Joseph Raz, arguing that Rawls?s version of liberalism provides both the best conception and the best justification of the liberal ideal of tolerance. This article contributes to the debate concerning the identification of politically relevant cases of corruption in a democracy by sketching the basic traits of an original liberal theory of institutional corruption. We define this form of corruption as a deviation with respect to the role entrusted to people occupying certain institutional positions, which are crucial for the implementation of public rules, for private gain. In order to illustrate the damages that corrupt behaviour makes to liberal democratic institutions, we (...) discuss the case of health care professionals’ abuse of their right to conscientious objection to abortion services. We show that the conscience clause can be instrumentally abused to sabotage democratically established public rules and thus exert undue private influence on their implementation. In this sense, from a liberal democratic perspective, institutional corruption is problematic because it is disruptive of such fundamental liberal ideals as the impartiality of public institutions and citizens’ political equality. In a well-known essay, Thomas Pogge argues that Kant’s political philosophy is not comprehensive in Rawls’ sense, since it is independent of his moral philosophy. However, Pogge understands Kant’s comprehensive liberalism as the view that his moral philosophy entails his political philosophy. I question whether this is the best way to understand comprehensive liberalism, in Kant or in general. I argue that Kant’s comprehensive moral philosophy is not an independent argument for the moral truth of liberal ideals, but (...) a liberal way of justifying an independent commitment to politically liberal values, given that we all have values that are not political. This chapter sets out the liberal ideals of justice and legitimacy that form the basis of the conception of upbringing defended in later chapters. It begins with a summary of Rawls’s conception of political morality, then discusses the different dimensions of liberal autonomy and summarizes Rawls’s case for anti-perfectionist justice. Section 3 considers certain objections to Rawls’s political liberalism and against Rawls, asserting the view that autonomy should be treated as valuable in non-political lives. Section 4 sets (...) out a conception of advantage with which to judge the demands of justice, drawing on Rawls’s account of the interests of citizens and Dworkin’s hypothetical insurance scheme. In 2005, Charles Mills published “‘Ideal Theory’ as Ideology” in Hypatia: a withering critique of much of contemporary political philosophy and ethics. For Mills such work in philosophy failed to attend to the realities of social life and politics, and in remaining silent on actual issues of domination and oppression served an ideological role in supporting the interests of white bourgeois men. Around the time that Charles Mills launched his broadside against ideal theory, trans theorists had been fighting their own (...) battle against the abstraction of theory from the realities of trans lives and oppression. Vivian Namaste (2000) and Jay Prosser (1998) argued that contemporary gender theory failed to justice to the actuality of trans life, retreating instead to understanding trans life through literary archetypes and idealized radical figures. In this chapter I’ll compare Mills’ critique of ideal theory with the transfeminist critique of 1990s gender theory, arguing that they share much in common. Centrally, both critiques share an underlying commitment to theory needing to be grounded in the actuality of oppression and power relations. This common thread, I suggest, must continue to guide transfeminist thought and action: contra Marquis Bey (2022) transfeminist thought and praxis must continue to be about trans lives, about the oppression of trans women, and about ways of actually achieving liberation from our current dire position.
