I present a recent historical case from cosmology—the story of inflationary cosmology—and on its basis argue that solving explanatory problems is a reliable method for making progress in science. In particular, I claim that the success of inflationary theory at solving its predecessor’s explanatory problems justified the theory epistemically, even in advance of the development of novel predictions from the theory and the later confirmation of those predictions.

Property Rights with Respect to Modern Money: A Libertarian Justification.Lennart B. Ackermans - 2020 - Journal of Social Ontology 6 (2):315-349.
The traditional Lockean justification of property rights has been argued to be no longer valid in a world in which much wealth does not derive from acquisitions of natural resources, and in which much property, such as money, is intangible. This means that libertarians need to reconsider whether and why property rights are justified for objects that fall outside of the scope of the Lockean justification. This paper gives a justification of property rights in relation to modern (...)

In at least some cases of justified perceptual belief, our perceptual experience itself, as opposed to beliefs about it, evidences and thereby justifies our belief. While the phenomenon is common, it is also mysterious. There are good reasons to think that perceptions cannot justify beliefs directly, and there is a significant challenge in explaining how they do. After explaining just how direct perceptual justification is mysterious, I considerMichael Huemers (Skepticism and the Veil of Perception, 2001) and Bill Brewers (Perception (...)

(1 other version)Fundamentals of Legal Argumentation: A Survey of Theories on the Justification of Judicial Decisions.Eveline T. Feteris - 1999 - Dordrecht, Netherland: Springer Verlag.
Aulis Aarnio addresses the question of how legal interpretations should be justified. Aarnio considers a justification to be rational only if the justification process has been conducted in a rational way, and if the final result of this process is acceptable to the legal community. According to Aarnio, a theory concerning the justification of legal interpretations should contain a procedural component specifying the conditions of rationality for legal discussions, and a substantial component specifying the material conditions of (...)

A framework is introduced consisting of five baselines of ethical justification for professional persuasive communications. The models provide a conceptual structure by which to identify and analyze the ethical reasoning, underlying justifications, motivations, and decision making in professional persuasive practices. Although the emphasis of this article is on defining the constructs, their ethical soundness as justification for persuasive practices and their usefulness in establishing direction and methodologies for research in persuasive also are addressed.

After arguing against a particular way of understanding the hypothesis (the communicative view), I will start from the justificatory view in philosophy of social cognition (Andrews 2012; Hutto 2004; Zawidzki 2013) to make the case for the idea that the primary function of belief and desire (...)

The present PhD thesis is concerned with the question whether good reasoning requires that the subject has some cognitive grip on the relation between premises and conclusion. One consideration in favor of such a requirement goes as follows: In order for my belief-formation to be an instance of reasoning, and not merely a causally related sequence of beliefs, the process must be guided by my endorsement of a rule of reasoning. Therefore I must have justified beliefs about the relation between (...)

Public justification in political liberalism is often conceptualized in light of Rawls’s view of its role in a hypothetical well-ordered society as an ideal or idealizing form of justification that applies a putatively reasonable conception of political justice to political matters. But Rawls implicates a different idea of public justification in his doctrine of general reflective equilibrium. The paper engages this second, more fundamental idea. Public justification in this second sense is actualist and fundamental. It is (...)

Justification by constitution and tiered constitutional design?Rosalind Dixon - 2024 - Philosophy and Social Criticism 50 (7):1051-1063.
Constitutions serve to legitimate the exercise of public power. Yet their scope is often subject to reasonable disagreement among citizens in a democracy. As Frank Michelman notes, this points to an understanding of democratic constitutions as a framework for contestation, rather than entrenched set of binding legal constraints. This understanding, however, arguably overlooks the difference between ordinary constitutional norms and those that protect the ‘democratic minimum core’. For the latter, there is far less scope for reasonable disagreement, and greater prudential (...)

This paper presents a justification counterpart for dyadic deontic logic, which is often argued to be better than Standard Deontic Logic at representing conditional and contrary-to-duty obligations, such as those exemplified by the notorious Chisholm’s puzzle. We consider the alethic-deontic system (E) and present the explicit version of this system (JE) by replacing the alethic Box-modality with proof terms and the dyadic deontic Circ-modality with justification terms. The explicit representation of strong factual detachment (SFD) is given and finally (...)

    Nietzsche’s Aesthetic Justification: A Minimal Interpretation.Hamidreza Mahboobi Arani - 2024 - Journal of Nietzsche Studies 55 (2):158-183.
This article aims to provide a minimal interpretation of the theme of aesthetic justification of life in Birth of Tragedy without relying on any substantial metaphysical claim about reality, presenting it rather as a practical and naturalistic response that is valuable and feasible regardless of one’s acceptance of Nietzsche’s metaphysical position, if he has any. According to this interpretation, the aesthetic justification of the Apolline and the Dionysiac metaphysical solace are originally instinctual remedies nature provides to address our (...)

Whether the justification at stake is ethical or juridical, all attempts to argue for the welfare principle in Kant’s metaphysics of morals are unsuccessful. This principle cannot be justified a priori in Kant’s context. However, it is not only possible but also necessary to argue for a certain degree of social welfare in politics as the practice of right; otherwise, Kant’s project of political practice, with enlightenment as its core concept, will inevitably fail. Enlightenment requires that the state be (...)

I briefly characterize globalization as the new context of contemporary theology in the first part, and go on in the second part to defend its relevance as a radical and total critique of life today in its nihilistic pursuit of creaturely arrogance, greed, and pleasure, and argue for the particular urgency of promoting the love and solidarity of Others beyond (...)

In A Priori Justification, Albert Casullo argues that extant attempts to explicate experiential justification—by stipulation, introspection, conceptual analysis, thought experimentation, and/or appeal to intuitions about hypothetical cases—are unsuccessful. He draws the following conclusion: “armchair methods” such as these are inadequate to the task. Instead, empirical methods should be used to investigate the distinction between experiential and non-experiential justification and to address questions concerning the nature, extent, and existence of the a priori. In this essay, I show that (...)

The “right intention” requirement, in the form of a requirement that the agent must have a justified true belief that the mind-independent conditions of the justification to use force are fulfilled, is not an additional criterion, but one that constrains the interpretation of the other criteria. Without it, the only possible interpretation of the mind-independent criteria is purely objectivist, that is, purely fact-relative. Pure objectivism condemns self-defense and just war theory to irrelevance since it cannot provide proper action guidance: (...)

This paper is to critically examines Pollock’s critical-link semantics with variable degrees of justification. Some possibly counterintuitive consequences of Pollock’s definition of degrees of justification are identified and a modified definition is proposed which avoids these consequences. Then the new solution is applied to the case of so-called presumptive defeat. A second contribution of the paper is to show how the modified semantics can be applied to the ASPIC+ framework: first the ASPIC+ framework is modified to allow for (...)

How should we proceed when searching for justified answers to normative questions? A prominent proposal is to use the method of reflective equilibrium (RE). Its basic Idea—that we should start from our existing judgments about relevant cases and bring them into equilibrium with systematic principles—is readily recited, but beyond that, conceptions of RE often stay sketchy. RE is seldom explicitly implemented, which makes it difficult to critically evaluate the method and to assess its potential. In my dissertation, I present the (...)
