Scientific policy advice is usually perceived as a formalized advisory process within political institutions. Politics has benefited from this arrangement because the science-based rationalization of policy has contributed to its legitimacy. However, in Western democratic societies, scientific expertise that is routinely mobilized to legitimate political positions has increasingly lost its power due to controversial expertise in the public sphere in particular within the mass media. As a consequence of the medialization of science, political decision makers are increasingly confronted (...) with mass-mediated expertise. Empirical results of a qualitative survey among decision makers in the German political and administrative system, presented in this article, support the hypothesis that mass-mediated expertise has a significant impact on policy processes. Five functions of media coverage on science-based issues for policy making were identified. Mass-mediated expertise has therefore altered the established relations between scientific policy advisors and political decision makers and can be seen as informal policy advice complementing institutionalized advisory arrangements. The economic distinction between technological and market information offers a useful guide to the relationship between information and policy. The two types create different problems for markets and require different emphases in public policy, focusing on either the production or the distribution of information. The interaction of the two types creates familiar policy problems such as underinvestment in information, adverse selection and moral hazard. Copyright law in recent years has undergone a process of privatization. While weakening the enforceability of conventional legislation (copyright rules), cyberspace facilitates alternative types of regulation such as contracts and technical self-help measures. Regulation by the code is significantly different from traditional types of public ordering (copyright law) and private ordering (contracts). Norms that technically regulate the use of information are not merely self-made they are also self-enforced. Furthermore, the law was recruited to uphold the superiority of such technical (...) self-help measures. The recently adopted U.S. Digital Millenium Copyright Act (DMCA) 1998 prohibits the development and use of technologies designed to circumvent copyright management systems. The underlying assumption of this legislation is that in Cyberspace, the target of regulation should become the technologies that affect users'' behavior rather than the behaviors themselves. Public participation is increasingly an aspect of policy development in many areas, and the governance of biomedical research is no exception. There are good reasons for this: biomedical research relies on public funding; it relies on biological samples and information from large numbers of patients and healthy individuals; and the outcomes of biomedical research are dramatically and irrevocably changing our society. There is thus arguably a democratic imperative for including public values in strategic decisions about the governance of (...) biomedical research. However, it is not immediately clear how this might best be achieved. While different approaches have been proposed and trialled, we focus here on the use of public deliberation as a mechanism to develop input for policy on biomedical research. We begin by explaining the rationale for conducting public deliberation in biomedical research. We focus, in particular, on the ELS (ethical, legal, social) aspects of human tissue biobanking. The last few years have seen the development of methods for conducting public deliberation on these issues in several jurisdictions, for the purpose of incorporating lay public voices in biobanking policy. We explain the theoretical foundation underlying the notion of deliberation, and outline the main lessons and capacities that have been developed in the area of conducting public deliberation on biobanks. We next provide an analysis of the theoretical and practical challenges that we feel still need to be addressed for the use of public deliberation to guide ethical norms and governance of biomedical research. We examine the issues of: (i) linking the outcomes of deliberation to tangible action; (ii) the mandate under which a deliberation is conducted; (iii) the relative weight that should be accorded to a public deliberative forum vs other relevant voices; (iv) evaluating the quality of deliberation; and (5) the problem of scalability of minipublics. The complex health and social circumstances of living-at-risk, frequent users of emergency departments (aREDFUs) in the health jurisdictions of high-income countries, and the related, significant challenges posed for emergency departments and the health care providers working within them, are identified and explored in the paper. Ethical analyses of a set of relevant domains are performed, i.e., individual and relational autonomy considerations, relevant social construction and personal responsibility conceptions, patient welfare principles (beneficence, nonmaleficence, continuity of care), harm reduction methodologies and their (...) applications, health equity, and justice considerations of the distributive, formal and social types. The outcomes of these analyses demonstrate that there are ethically compelling reasons for emergency departments to adopt an ethics-informed, policy-based approach to the longitudinal care and management of living-at-risk, frequent users of emergency departments. From a formal justice perspective, the development and uses of such an approach are justified by a demonstrable relevant difference between living-at-risk, frequent users of emergency departments and other persons and groups of patients who visit emergency departments. We propose an example of such a policy-based approach. Examples of possible, pragmatic applications of this approach, which help ensure that aREDFUs who present to the ED are managed in a fair and optimally consistent manner, are provided for the consideration of an urban emergency department’s policymaking working group. Readers of previous installments of this column will recall that I have been discussing both the general relationship between information practices and moral virtues and some specific questions about the effects of information technology, such as the "expert system," upon our ability to lead virtuous lives and have morally satisfying work. In this column, I want to take a practical turn by articulating some of the ethical considerations which might motivate workplace information policy.

This paper explores the complex institutional processes that comprise the global governance of cyberinfrastructure and examines the impact of these elite regime formation processes on developing countries and transnational civil society organizations. Based on a concurrent, mixed-methods study of the United Nations-sponsored World Summit on the Information Society (WSIS), we find that policy-actors from developing countries and civil society organizations have been less effective than other actors in influencing these processes. Finally, we recommend future research on the use (...) of ICTs to strengthen the effective participation of developing countries and transnational civil society organizations in these processes. The post-Westphalian Nation State developed by becoming more and more an Information Society. However, in so doing, it progressively made itself less and less the main information agent, because one of the main forces that made the Nation State possible and then predominant, as a historical driving force in human politics, namely Information and Communication Technologies (ICTs), is also what is now making it less central, in the social, political and economic life of humanity across the world. ICTs enable and promote the agile, temporary and timely aggregation, disaggregation and re-aggregation of distributed groups around shared interests across old, rigid boundaries represented by social classes, political parties, ethnicity, language barriers, physical and geographical barriers, and so forth. Similar novelties call for a serious exercise in conceptual re-engineering. This paper argues for the need to understand how the new informational multiagent systems may be designed in such a way as to take full advantage of the socio-political progress made so far, while being able to deal successfully with the new global challenges (from the environment to the financial markets) that are undermining the legacy of that very progress. BackgroundFor many decades, the debate on children’s competence to give informed consent in medical settings concentrated on ethical and legal aspects, with little empirical underpinnings. Recently, data from empirical research became available to advance the discussion. It was shown that children’s competence to consent to clinical research could be accurately assessed by the modified MacArthur Competence Assessment Tool for Clinical Research. Age limits for children to be deemed competent to decide on research participation have been studied: generally children of 11.2 (...) years and above were decision-making competent, while children of 9.6 years and younger were not. Age was pointed out to be the key determining factor in children’s competence. In this article we reflect on policy implications of these findings, considering legal, ethical, developmental and clinical perspectives.DiscussionAlthough assessment of children’s competence has a normative character, ethics, law and clinical practice can benefit from research data. The findings may help to do justice to the capacities children possess and challenges they may face when deciding about treatment and research options. We discuss advantages and drawbacks of standardized competence assessment in children on a case-by-case basis compared to application of a fixed age limit, and conclude that a selective implementation of case-by-case competence assessment in specific populations is preferable. We recommend the implementation of age limits based on empirical evidence. Furthermore, we elaborate on a suitable model for informed consent involving children and parents that would do justice to developmental aspects of children and the specific characteristics of the parent-child dyad.SummaryPrevious research outcomes showed that children’s medical decision-making capacities could be operationalized into a standardized assessment instrument. Recommendations for policies include a dual consent procedure, including both child as well as parents, for children from the age of 12 until they reach majority. For children between 10 and 12 years of age, and in case of children older than 12 years in special research populations of mentally compromised patients, we suggest a case-by-case assessment of children’s competence to consent. Since such a dual consent procedure is fundamentally different from a procedure of parental permission and child assent, and would imply a considerable shift regarding some current legislations, practical implications are elaborated. This essay explores how evidence-based policy can be developed for sport-related concussion (SRC), focusing particularly on the role and influence of the Consensus Statements of the Concussion in Sport Group (CiSG). Three credible policy purposes are suggested: (i) to mitigate acute health impacts of concussion events in sport; (ii) to reduce or eliminate the identified causes of SRC (direct blows to the head, neck, or body); and (iii) to improve long-term brain health outcomes for athletes. Eight of ten (...) systematic reviews commissioned for the most recent Consensus Statement, and ten of its thirteen headings, address the first purpose. The primary influence of the CiSG Consensus Statements has been to improve SRC acute response practice and protocols in professional/elite sport, which has always been their primary policy purpose, although evidence of improvement is more limited in child/adolescent and recreational sport. But a primary focus on mitigating acute health impacts has crowded out other credible policy purposes of concern to stakeholder groups with whom evidence-based policy for SRC must be co-produced. No recommendations are made to improve long-term brain outcomes for athletes because concerns about imperfections in evidence are cited to question the link between such outcomes and SRC. Modifications to reduce or eliminate purposive blows to the head, neck, or body that are permitted as a structural part of the way some sports are played are given very limited attention, even when discussing prevention, where they are just one approach considered alongside protective equipment, neuromuscular strengthening, and concussion management strategies. The essay concludes that the CiSG should shift the primary policy purpose of its Consensus Statements to address the identified causes of SRC: purposive blows to the head, neck, or body. Reducing or removing causes of SRC both better safeguards children/adolescents and renders debates about the link between SRC and long-term brain health outcomes superfluous. (shrink)

Scientists know that human activities, primarily fossil fuel combustion, are causing Earth’s temperature to increase. Yet in 2021, only 60% of the US population understood that human activities are the primary cause of global warming. We experimentally test whether information about the human causes of global warming influences Americans’ beliefs and concerns about global warming and support for climate policies. We find that communicating information about the human-causes of global warming increases public understanding that global warming is human-caused. (...) This information, both alone and with additional information about climate impacts and policy solutions, also increases public concern about global warming and support for climate policies, although the effects on climate concern and policy support are smaller. Importantly, the treatment effects are consistent across political party, with no backlash effects among Republicans. This suggests that when informed about climate change causes, impacts and solutions, most Americans can update their own climate change beliefs, risk perceptions, and policy support. (shrink)

We are never illness or disease, but, rather, always their sum in the world of day-to-day experience. Disease and illness are not closed systems, but mutually constitutive and continuously interacting worlds. In the patient’s case it is always experience as well. Pain, sickness and death help make that particular experienced identity unavoidable, and at some level ultimately inaccessible to medicine’s changing understanding of disease and tools for managing it. Many countries find their information and digital policies still dominated by traditional stakeholders, particularly the content industry, major telecom companies, and marketing groups, yet Canada has experienced a notable shift in perspective with a strong and influential public interest voice. This shift toward public interest and participation in the development of Canadian information and digital policies has led to legislation, regulation, and policy outcomes that once seemed highly unlikely. This Article seeks to better understand the changing role (...) of the public in Canadian information and digital policymaking by framing the developments as an ongoing policy development process featuring a series of closely linked changes and responses. The emergence of public participation on information and digital policy issues occurred across a spectrum of issues, yet the traits were strikingly similar: grassroots efforts reliant on social media and the Internet to capture media and public attention and focus it on consumer perspectives, minimal interest from government and regulators; and initial dismissal giving way to hostility from incumbent stakeholders. The Article identifies some of the reasons behind the shift, including the growing importance of information and digital policies, the impact of digital advocacy tools, and the shifting policy pyramid in which users have now largely leapfrogged corporate interests as policy influencers. While the shift does not mean the public interest wins on every issue, it does suggest an important change in influence with long-term ramifications for the development of information and digital policy in Canada that others may seek to emulate. This paper aims to show the historical contingency of policy entrepreneurship in science by analyzing the case of brain research in South Korea during the last decade of the 20th century. This decade saw an increasing emphasis placed upon the development of information technology and its use for societal changes. The rise of the “Information Society” in Korea was an important context for shaping the field of brain research as an amalgam of multiple disciplines which led to (...) the passage of the Brain Research Promotion Act; the first law in the world enacted to promote brain research. This paper, through focusing on in what context someone takes up an entrepreneurial role, shows how the concept of interdisciplinarity has been shaped by, and how it has influenced the development of brain research and its related policy measures in Korea. It ultimately reveals the contingent and transient aspect of a policy entrepreneur and his effect on building a new field. (shrink)

Dutch municipalities are confronted with an increased number of prescribed environmental tasks and also with a growing demand, both from the central government and environmental pressure groups, to undertake environmental activities on their own initiative. This development over-taxed the information management of most municipalities. The recent decrease in public confidence in the measles, mumps and rubella vaccine has important implications for individuals and public health. This article presents moral arguments relating to conflicts between individual autonomy and collective responsibilities in vaccination decisions with a view to informing and advising health professionals and improving the effectiveness of education policies in avoiding resurgence of endemic measles. Lower population immunity, due to falling uptake, is hastening the need for greater public awareness of the consequences for the population. (...) Vaccination refusals go hand in hand with responsibilities owed to future generations and society in not knowingly contributing to preventable harms. Issues such as parents’ rights are considered and balanced against: collective responsibilities for public health; permissibility of ‘free-riding’; conflicting duties of health professionals; and possible enforcement of vaccination. It is suggested that the arguments may form a persuasive tool for the practice of health professionals involved in informing and supporting parents’ vaccination decisions. (shrink)

The modern practice of organ donation after cardiocirculatory death (DCD) emerged in the 1990s as a response to the alarmingly wide gap between the number of transplantable organs available through organ donation after neurological death and the urgent organ transplantation needs of persons in end-organ failure. Background: Despite potential benefits of the return of research results to research participants, the TriCouncil Policy Statement , which reflects Canadian regulatory ethical requirements, does not require this. The policies of Canadian research ethics boards are unknown.Objectives: To examine the policies of Canadian university based REBs regarding returning results to research participants, and to ascertain if the presence/absence of a policy may be influenced by REB member composition.Design: Email survey of the coordinators of Canadian university based REBs to (...) determine the presence/absence of a policy on return of research results to research participants both during an ongoing study and at conclusion. REB coordinators were asked to return a copy of the policy or guidelines and to describe the member composition of their REB.Findings: Of 50 REBs that were contacted 34 responded and 22 met the inclusion criteria. Two had a policy that governed the return of research results while on a study, and seven following the completion of a study. Presence of an ethicist or a lawyer on the REB did not influence the presence/absence of such policies. No REBs had specific guidelines describing how participants should be informed of results.Conclusions: Most REBs did not require researchers to disclose study results to research participants either during or following a study. Thus this study identifies an ethical shortcoming in the conduct of human research in Canada. It has also demonstrated that there are no clear recommendations by REBs to facilitate the return of results to participants following research projects. (shrink)

PurposeThe purpose of this paper is to explicate the influence of US national security approach on the Thai Government's national security, the criticisms on the US and Thai intelligence communities and ethical debates on national databases, including the introduction of the concepts of “spiritual computing” and Buddhism to the ethical aspect of intelligence databases.Design/methodology/approachThe methodology of this paper is based on the interpretative approach which includes literature survey and interviews of the intelligence community in Thailand. The relevant literature survey consists (...) of the literature on US intelligence databases for Homeland Security, criticisms of the IC, the ethical debate on national databases in the USA, the Thai National Security Council, ethical debates on the Internal Security Act and Computer Crime Act, Buddhism and “spiritual computing.”FindingsThe findings reflect that the US model of national security has significant influence on the Thai intelligence approach and application of IT for national security while both intelligence communities have similar intelligence problems and have raised ethical debates on violations of human rights.Research limitations/implicationsThe research limitations include the nature of the topic which is a closed subject under legal restrictions in Thailand so that the sources of official information could not be disclosed nor elaborated in details; and literature on this topic has not been widely available except unclassified information which limits a more in‐depth investigation and analysis.Originality/valueThe value of this paper lies in being the first attempt to throw light on a “forbidden” subject in Thailand by discussing the US experiences against the Thai case study. The application of “spiritual computing” and Buddhist precepts to the context of national security and intelligence databases could be a starting point for developing a “happier” and “successful” IC and possibly open a new approach to national security. This article has called past studies into question as they relate to describing and explaining the impact of information on policy-making. More specifically, it attempts to empirically investigate the causality of the factors involved in the impact of information on governmental decision-making. Based on an integrated conceptual framework for when and how information helps to make policy decisions, a path model (or a covariance structure model without latent variables) is built and tested against the data (...) in two areas of mental health policy (i.e., service provision and financing). Findings of the study demonstrate that how and when information influences governmental decision-making is directly and indirectly affected by a variety of factors and their linkages, not dominated by one set of factors (e.g., trustworthiness of information source or format of reports) defined by a single perspective (e.g., the organizational interest or the communications perspective). The most important paths in the model are those between factors related to information (e.g., the amount of information received or its use) and the impact of information on policy-making. Interestingly, these factors also play a major role in linking other variables (e.g., demographics or decision makers’ distrust of information) to the impact of information on policy-making. Furthermore, the general pattern of the findings indicates that policy areas make a difference in accounting for the impact of information on policy-making. Overall, the single most important lesson is that past perspectives are not alternative or competing tools for understanding the phenomena, and, thus, the theoretical and/or empirical task of explaining when and why information affects policy-making is equivalent to explaining why a certain set of factors is not appropriate or appropriate for a particular context and to identifying such a context. Governments are increasingly making use of field experiments to evaluate policy interventions in the spheres of education, public health and welfare. However, the research ethics literature is largely focused on the clinical context, leaving investigators, institutional review boards and government agencies with few resources to draw on to address the ethical questions they face regarding such experiments. In this article, we aim to help address this problem, investigating the conditions under which informed consent is required for ethical policy (...) research conducted or authorized by government. We argue that investigators need not secure participants' informed consent when conducting government policy experiments if: the government institution conducting or authorizing the experiment possesses a right to rule over the spheres of policy targeted by the research; and data collection does not involve the violation of participants' autonomy rights. The technical advances that have enabled the development of "the cloud" have resulted in an exponential increase in the speed of information dissemination. Policy makers, sponsors of IT infrastructure and users of information and communication technologies, while being aware of the benefits of "the Cloud" as a mechanism to facilitate more efficient access to information, do not always appreciate that these developments may not always have the positive outcomes intended. University courses such as those in Social (...) Informatics have managed to keep pace with this rapid evolution of information and communication technologies and their societal impacts, but within the secondary education sector this has not always been possible, potentially creating a knowledge gap for tomorrow's policy makers. Prescription opioid policies too often reflect over a century's worth of moralizing about the nature of opioid use disorder, the value of pain, and the meaning of suffering. The social and legal penalties to prescribers run in one direction—avoid overprescribing, however defined, at all costs. The lack of shared definitions is problematic for formulating and evaluating opioid policy. For example, the variant definitions of “misuse,” “abuse,” and “addiction” complicate estimates of morbidity. There are also no widely accepted definitions of (...) misprescribing and overprescribing. I offer here a modest attempt at the categorization of misprescribing: inadvertent overprescribing, corrupt overprescribing, qualitative overprescribing, quantitative overprescribing, multiclass overprescribing, and underprescribing. Algorithmic technologies and artificial intelligence are centred on data and generate new business models, known as the data-driven economy. In the European Union context, the development of such new business is accompanied by a regulatory and political framework. An important aspect of this regulatory framework regards the legal conditions that enable the data collection, availability, sharing, use and reuse. Within the larger context, this article analyses the development of the European Union regulatory framework governing the availability, sharing and reuse of (...) public sector data, also referred to as Public Sector Information policy. Anchored in the analytical tools provided by Discursive Institutionalism and Critical Data Studies and after studying the evolution of this policy over 25 years, this article argues that economic considerations have been overwhelmingly decisive in the European Union Public Sector Information policy and much less attention has been paid to fundamental rights and democracy issues. It also shows how European Union Public Sector Information policy contributes to the data infrastructure, enabling a thriving data-driven economy. In doing so, this article argues that the possible problematic effects of this new data-driven economy are not only affordances of the technology itself but are also the result of political and regulatory choices. More globally, the article stresses the need for policymakers to inscribe each of the policies and regulations affecting the digital transformation in the framework of fundamental rights and democracy. In this article the perspective shifts to the “upstream” end of the agricultural knowledge and information system (AKIS). Because knowledge policy and strategic decision-making are not the prerogative of the public sector, organizations such as cooperative unions and multinational companies are included. After considering the influence of the changing environment on the nature of the AKIS, the role of knowledge management and policy in the emerging knowledge and information market is examined. Special attention is given to (...) public and private R&D. The article then looks where information technology (IT) fits in and what considerations determine strategic investment in IT projects and sustained services. SARS-CoV-2 vaccines are indispensable allies in the fight against COVID-19. Behavioral and cognitive scientists have argued for taking advantage of insights from their fields of investigations in shaping anti-COVID policies. B&C scientists extensively discussed the methodological and practical issues that arise in translating B&C research results into policy interventions aimed to boost vaccination, Nevertheless, the same cannot be said for the ethical aspects. In the present work, we discuss the ethics of nudging vaccination in light of the “alien control” (...) objection, a kind of control whereby an agent has the power to influence the choice of another agent, and the latter cannot control such power. We proceed as follows. We begin by presenting several cases of mandatory policies avaiable to policymakers to boost the vaccine rate. Next, we point out that insights from B&C sciences can inform mandatory policies and open up ways to enhance them. In section 3, we focus on untraditional policy tools, viz. nudges. In the second part of the article, we introduce the debate on the ethics of nudges, focusing on the “alien control” objection and its relevance for the citizens’ freedom and autonomy. We therefore discuss the original point of the paper. We argue that, referring to nudging vaccination, a somehow neglected ethical issue posed by nudges emerges. Our point is that nudges do not exert exclusively an influence over a targeted behavior. Indeed, nudges impose as well a political influence by which citizens are treated as means to succeed in achieving a peculiar, and potentially controversial, political aim. We argue that, due to what we propose to call the “political multi-justifiability" of nudges, their political influence cannot be detected by citizens. This leads to the threat of alien control. In the last section, we draw some tentative conclusions, suggest a possible solution and its practical advantages. (shrink)

The opaque use of data collection methods on the WWW has given rise to privacy concerns among Internet users. Privacy policies on websites may ease these concerns, if they communicate clearly and unequivocally when, how and for what purpose data are collected, used or shared. This paper examines privacy policies from a linguistic angle to determine whether the language of these documents is adequate for communicating data-handling practices in a manner that enables informed consent on the part of the user. (...) The findings highlight that corporate privacy policies obfuscate, enhance and mitigate unethical data handling practices and use persuasive appeals to increase companies’ trustworthiness. The communicative strategies identified provide starting points for redesigning existing privacy statements with a view to communicating data handling practices in a more transparent and responsible manner, laying the groundwork for informed consent. This is a brief letter outlining speculative ideas for semantic web reasoning about information assurance. Much work has been done on the development of semantic web applications for reasoning about information assurance. This study explores the relationship between perceptions of catastrophic events and beliefs about climate change. Using data from the 2023 Life in Transition Survey, the study finds that contrary to conventional wisdom, more accurate knowledge about past catastrophes is associated with lower concern about climate change. The paper proposes that heightened threat sensitivity may underlie both the tendency to overestimate disaster impacts and increased concern about climate change. The findings challenge the assumption that a more informed citizenry necessarily leads to (...) better climate policy decisions. Instead, they suggest that psychological factors, like anxiety and risk perception, play crucial roles in shaping climate attitudes. Illuminating these dynamics can help societies to foster a more nuanced and constructive public dialogue about the urgent challenges facing our planet and our species. (shrink)
