Recent scholarship on the philosophy of time in pre-Qin Daoist thought has not yet produced a thorough examination of dao’s relationship to time. This essay resolves this omission through a systematic study of the concept heng 恒 in pre-Qin Daoist literature. While principally expressing the ‘constancy’ of dao, heng also significantly presupposes dao’s ability to change. This change is characterized in the texts as a cyclical movement of ‘return’ and identified with the universe’s circular metanarrative of generation and reintegration. The (...) essay turns to examine pre-Qin Daoist literature’s use of primal wu 無 metaphors to describe dao. It concludes that they present dao as undifferentiated infinitude, liberating dao as heng from the tense structure of past-present-future that divides life in time. These metaphors further associate the movement of dao with the flow of time, reformulating time’s relentless ever-greater advancement into an endless cycle of creative transformation. (shrink)

I. Three Basic rights. This book is about the moral minimum--about the lower limits on tolerable human conduct, individual and institutional.

The American regulatory model of corporate governance rests on the theory of self-regulation as␣the most effective and efficient means to achieve corporate self-restraint in the marketplace. However, that model fails to achieve regular compliance with baseline ethical and legal behaviors as evidenced by a century of repeated corporate debacles, the most recent being Enron, WorldCom, and Refco. Seemingly impervious to its domestic failure, Congress imprinted the same self-regulation paradigm on legislation restraining global business behavior, the Foreign Corrupt Practices Act. (...) This anti-bribery initiative prohibits unethical and illegal payments made to foreign public officials in an effort to eradicate bribery as a rational-choice global market entry strategy. However, this paper illustrates, using newly complied statistics from 1977 to 2008, that the FCPA has not had a dramatic impact on U.S. global corporate behavior despite its recent high profile coverage and the tough regulatory rhetoric about corporate compliance. The paper also extends the prior Cragg and Woof FCPA efficiency study and provides current empirical evidence to resolve several unanswered questions raised by that earlier study. (shrink)

Previous studies have offered a rationale for engaging students in small-group student talk for the planning of L2 individual writing. To further investigate whether such talk effectively promotes the quality of argument in the context of Chinese tertiary EFL learners’ argumentative writing and whether such effects could be retained, the current study adopted a quasi-experimental design with a pretest, a posttest, and a delayed posttest in two intact EFL classes. The performance of the intervention group and the comparison group were (...) scrutinized to examine the effects of the intervention. The analytic scores on six components of the writing task and the holistic writing scores cumulated of all these components were measured to see the immediate and sustained effects. Significant changes of the holistic scores in both the immediate posttest and the delayed posttest indicated that such small-group student talk enabled students in the treatment class to achieve better performance in the overall quality of argumentation compared with those in the comparison class. Statistical analyses revealed immediate and sustained effects of small-group student talk on the quality of counterargument claim, counterargument data, and rebuttal claim. Counterargument claim was the only element in which students in both classes made significant improvement, but the treatment class demonstrated a larger effect size. No discernible differences were found either between or within the treatment class and the comparison class with respect to the quality of claim, data, and rebuttal data across tests. Possible explanations concerning the findings and limitations of the study were discussed. (shrink)

Analyses made for the purpose of this paper were performed on the basis of available secondary data possessed by the World Bank for the period of 2000-2012. The research methodology (...) involved the use of the techniques of linear regression and correlation analysis. The first task was to determine whether there is an impact of foreign direct investment on the overall economic development of these countries. Where such influence occurred, it was necessary to define its level in comparison to the influence of other variables. The results of the analysis in this paper suggest that inflow of foreign direct investment does not affect to a significant extent the economic development of selected countries in the Western Balkans. In The Law of Peoples Rawls claims that liberal well-ordered societies (LWOSs) should regard certain non-liberal societies, decent hierarchical societies (DHSs), as equal members of a just international order, a ‘Society of Peoples.’ Rawls maintains, however, that while the ‘basic structures’ (the main political and economic institutions) of LWOSs are fair systems of social cooperation, the basic structures of DHSs are only ‘decent’ systems of social cooperation. I explain why the basic structures of DHSs cannot be fair systems of social (...) cooperation. In doing so, I refute a recent defense of DHSs advanced by Samuel Freeman. I then argue that because the basic structures of DHSs cannot be fair systems of social cooperation, Rawls is not justified in holding that LWOSs should refrain always from offering economic incentives to DHSs in order to encourage them to liberalize their political institutions. The ultimate aim of the foreign policies of LWOSs should be a world in which liberal democratic rights are respected by all societies. (shrink)

Recent studies :98–144, 2002; Weismann, J Bus Ethics 88:615–66, 2009) revealed that in the first 28 years of its existence, the Foreign Corrupt Practices Act was not enforced by the federal government. The Weismann study further concluded that the FCPA, designed by Congress as a self-regulatory model of corporate governance, failed to achieve the regulatory goal of deterring global bribery by U.S. companies. The current article addresses the reasons that the FCPA remains an ineffective measure to control bribery as (...) a global market entry strategy despite the highly publicized 2006 Department of Justice initiative to increase prosecutions and tighten enforcement efforts. The failure arises out of both the increased use of informal dispositions of case prosecutions,, which has made “getting caught” merely an increased “cost of doing business” and the failure to close the regulatory gaps in the statute that permit violators to slip through the enforcement net. The article updates and compiles the case prosecution data for every reported case prosecuted between 1977 and 2011. That data are then compared to the results of a 2010 integrity risk survey performed by Deloitte Financial Advisory Services and Forbes which reveal a widely held global business perception that compliance and integrity risks appear to be rising sharply and that the FCPA is ineffective in deterring bribery and corruption in foreign markets. The article aims to serve as a predictive tool for policy makers and business professionals in assessing risk in the global markets, particularly as commerce intensifies in the BRIC countries, notable for bribery and corruption. Foreigners go home! This is a reverberating chorus at the heart of the migration crisis everywhere in the world. This call manifests itself in the recurring xenophobic or Afrophobic attacks directed at foreign nationals in South Africa. This article reflects on the most recent xenophobic attacks directed at foreign nationals during the anti-immigration march, held on 24 February 2017, in the City of Tshwane. This article states that calls for foreigners to go home and the xenophobic or Afrophobic (...) violent attacks that accompanied them were a direct attack on ubuntu. It was an attack that rendered ubuntu ‘homeless’ and reflected the direct opposite of what an African community generally stands for. It was also an attack directed towards the migrant God; hence, the article proposes a re-imagination of the theology of ubuntu and the agency of faith communities as an antidote to the recurring calls for foreigners to go home. The disclosure of corporate environmental performance is an increasingly important element of a firm’s ethical behavior. We analyze how the legal origin of foreign institutional investors affects a firm’s voluntary greenhouse gas emissions disclosure. Using a large sample of firms from 36 countries, we show that foreign institutional ownership from civil law countries improves the scope and quality of a firm’s greenhouse gas emissions reporting. This relation is robust to addressing endogeneity and selection biases. The effect is more (...) pronounced in firms from non-climate-sensitized countries, for which the gap between firms’ environmental standards and investors’ environmental targets is potentially larger, and in less international firms. Firms with a higher level of voluntary greenhouse gas emissions disclosure also exhibit higher valuations. (shrink)

Human rights have been the principal ethical ingredients of ‘ethical foreign policy’. Some human rights promulgated in UN and other Declarations are more aspirational than achievable; others are of variable importance. So we need to look behind the Declarations to see which human rights claims should be taken most seriously. I shall argue that we take rights seriously only if we take the counterpart obligations seriously, and can take obligations seriously only if we connect them to the capabilities of (...) the agents and agencies who will have to discharge them. A realistic view of those agents and agencies cannot be based on the assumption that the relevant agents are all of them states, since this line of thought collapses where states are weak or failing. A realistic account of agency, or of obligations, a fortiori of rights has to take certain types of non-state actors and their obligations seriously. (shrink)

This article discusses the category of foreigner in the context of academia. In the first part I explore this category and its philosophical significance. A quick look at the literature reveals that this category needs more attention in analyses of dimensions of privilege and disadvantage. Foreignness has peculiarities that demarcate it from other categories of identity, and it intersects with them in complicated ways. Devoting more attention to it would enable addressing issues affecting foreigners in academia that go commonly unnoticed. (...) In the second part of the article I argue that current efforts to make academia a more inclusive environment should address the disadvantages that many foreign academics face. I focus on two senses of foreigner: working and living in a country that is not your country of origin, and being a nonnative speaker of the language in which you work. (shrink)

Many have argued that moral judgment is driven by one of two types of processes. Rationalists argue that reasoned processes are the source of moral judgments, whereas sentimentalists argue that emotional processes are. We provide evidence that both positions are mistaken; there are multiple mental processes involved in moral judgment, and it is possible to manipulate which process is engaged when considering moral dilemmas by presenting them in a non-native language. The Foreign-Language Effect is the activation of systematic reasoning (...) processes by thinking in a foreign language. We demonstrate that the FLE extends to moral judgment. This indicates that different types of processes can lead to the formation of differing moral judgments. One implication of the FLE is that it raises the possibility that moral judgments can be made more systematic, and that the type of processing used to form them might be relevant to normative and applied ethics. War in Ukraine and the Russian annexation of Crimea are the events that changed the US policy towards Russia. The events in Ukraine forced the United States to take a closer look at Eastern and Central Europe. The United States’ policy during the Ukrainian crisis has been limited to sanctions and strong statements so far because in Ukraine there is an asymmetry of interests. Ukraine is much more important to Russia than to the United States. The United States may be (...) willing to support the democratic and western aspiration of Ukrainians but will not risk a major conflict with Russia over it. However the crisis in Ukraine is not only about Ukraine or Russia. It is also about US credibility around the world. Both friends and foes are watching closely the American reaction to the situation. That is why the United States has increased its military presence in those NATO countries that share borders with Russia. (shrink)

On account of xenophobia, which seems to be a worldwide phenomenon, this article examines the issue of the ‘foreigner in our midst’ and approaches the problem from an Old Testament perspective. Firstly an overview is given on the concepts of ethnicity and group identity, and then two opposing groups of texts are briefly analysed: those that convey an exclusivist attitude and those that are more open and inclusive in their outlook. Consequently, the contexts in which these texts originated are examined. (...) It appears that both groups, the exclusivists and the inclusivists, share the same religious convictions, namely the worship of YHWH, the God of Israel. The article concludes by urging caution when using the Bible in order to address complex social and political issues in contemporary societies. (shrink)

As for the bankruptcy judgment, its argument is absolute, when the judgment of bankruptcy is issued, the debtor is not considered bankrupt in view of the creditor only who requested the bankruptcy month, but it is also considered bankrupt for everyone and other creditors, even if they are not a party to the bankruptcy lawsuit, and the bankruptcy judgment deals with the entire liability of the merchant, as the bankruptcy month is considered as a general limitation of the trader's funds, whether they are related to his trade or not, and also includes existing (present) funds and future funds. It is possible to exist later as the goal here is to carry out a collective liquidation of the bankrupt's money. However, the bank tries to stand on its feet before carrying out any bankruptcy declaration procedure through the guardianship system or banking reorganization means in order to try to avoid the bank entering into more dangerous procedures of bankruptcy and liquidation and try to avoid declaring bankruptcy. This article explores the extent to which the decision to invade Iraq in 2003 coheres with the normative precepts of liberalism as an international political theory. Beginning with a Lockean liberal theory of the state, this article first examines the evolution of international liberalism in order to identify the fundamental normative postulates of liberal theory as it pertains to international relations, especially regarding the use of military force. The article then advances two interrelated arguments: First, that the underpinnings of the (...) decision to invade Iraq embodied in the Bush Doctrine draw heavily from the liberal tradition, though still depart from it in important ways. Second, that the Bush Doctrine as manifested in the Iraq war reflects in many ways the liberal thinking that prevailed during the interwar years and is therefore susceptible to a similar charge of ‘utopianism’ that was leveled against interwar liberalism by E. H. Carr in his Twenty Years' Crisis. (shrink)

The paper aims at describing the representation of the image of Moscow as an integral part of the image of Russia, formed in the consciousness of the end-users of Chinese Russian textbooks. To achieve this goal, the following tasks have been set and achieved: to select texts and illustrations centered on Moscow; to identify the components of the image of Moscow in the materials under consideration and to pinpoint the dominant aspect of the image; to determine the strategies of representing (...) Moscow; to characterize the influence of the image of Moscow on the image of Russia as a whole. The methods employed in the study combine the elements of comparative analysis and content analysis of the material, description and induction. The research has demonstrated that, when selecting and presenting the teaching materials, the authors of the textbooks relied upon the strategy of linguocultural progression and holistic approach. The textbooks demonstrate a multifaceted image of Moscow. The findings of the study show that the analyzed textbooks provide the students with rich linguocultural information about Moscow, covering such aspects as history and culture, gastronomic tradition and holidays, education, transport, and trade. The studied materials use the constructive strategies of Moscow’s image presentation: the strategy of well-balanced presentation of the Russian culture and the Chinese culture; the strategy of the inclusion of phenomena of Russian culture into the world cultural heritage; the strategy of combination of the traditional and the modern in the description of Moscow. Overall, it can be argued that the textbooks under consideration project a positive image of Moscow, whose dominant component is the cultural aspect. The uniqueness of Moscow portrayed in the textbooks fosters Chinese students‘ interest in Russian culture and contributes to improving the perception of Moscow and Russia as a whole. (shrink)

This research uses an experimental approach to investigate the relationship between market orientation of a company and its level of success in international business. The aim of the study was to develop and use a market orientation scale that is appropriate to the sector. It was discovered that there are four hidden traits that drive market orientation. These include customers, rivals, departmental response, and overall customer satisfaction. According to the results, orientation toward one's customers is more essential than any of (...) the other traits, while orientation toward one's competitors has an inverted U-shaped connection with performance. The performance of the firm was not found to correlate in any way with the responsiveness of its departments. With the help of the comprehensive conceptualization, managers are able to develop specific kinds of orientations that are essential for higher levels of performance. (shrink)
