In her recent `Facts about incoherence as non-evidential epistemic reasons‘ Eva Schmidt defends the claim that not all epistemic reasons are provided by evidence. Schmidt presents three cases describing agents with incoherent beliefs and argues that, in each case, the fact that an agent’s beliefs are incoherent provides her with a non-evidential epistemic reason to suspend judgment on the issue that her beliefs are about. While I find the suggestion that facts about incoherence can play positive roles in our (...) cognitive lives intriguing, I have three reservations about Schmidt’s view: the first concerns her conceptual framework—I think it is less neutral than it appears to be—the second concerns the view’s behavior in certain kinds of scenarios involving higher-order evidence, and the third has to do with some implausible consequences of the view. I also hint at an alternative account of the positive role of facts about incoherence. (shrink)

Recent work in artificial intelligence has increasingly turned to argumentation as a rich, interdisciplinary area of research that can provide new methods related to evidence and reasoning in the area of law. Douglas Walton provides an introduction to basic concepts, tools and methods in argumentation theory and artificial intelligence as applied to the analysis and evaluation of witness testimony. He shows how witness testimony is by its nature inherently fallible and sometimes subject to disastrous failures. At the same time (...) such testimony can provide evidence that is not only necessary but inherently reasonable for logically guiding legal experts to accept or reject a claim. Walton shows how to overcome the traditional disdain for witness testimony as a type of evidence shown by logical positivists, and the views of trial sceptics who doubt that trial rules deal with witness testimony in a way that yields a rational decision-making process. This paper adds evidence structure to standard models of belief, in the form of families of sets of worlds. We show how these more fine-grained models support natural actions of “evidence management”, ranging from update with external new information to internal rearrangement. We show how this perspective leads to new richer languages for existing neighborhood semantics for modal logic. Our main results are relative completeness theorems for the resulting dynamic logic of evidence.

Nurses in Ghana believe that training, practise, practitioner and policy reforms are required for total nursing profession reform to be effective. Their views for role reformation in the nursing profession, which is currently needed, are not only academic but also clinically relevant in the pursuit of health equity and quality nursing care. We explored and described nurses’ views on their roles in the profession using data collected from 24 professional nurses in three regional hospitals in Ghana. Using an inductive descriptive (...) qualitative design, data were gathered and analysed using a qualitative content analysis to describe the views of the nurses. Four major themes, namely practise reforms, practitioner reforms, training reforms and policy reforms have emerged in relation to role reformation in the nursing profession. Three strategic areas, practitioner attitudes, new training modalities and policy realignment, must be reviewed and remodelled for better positioning of the nursing profession before its entire role reformation. Diversity of evidence is widely claimed to be crucial for evidence amalgamation to have distinctive epistemic merits. Bayesian epistemologists capture this idea in the variety-of-evidence thesis: ceteris paribus, the strength of confirmation of a hypothesis by an evidential set increases with the diversity of the evidential elements in that set. Yet, formal exploration of this thesis has shown that it fails to be generally true. This article demonstrates that the thesis fails in even more circumstances than recent (...) results would lead us to expect. Most importantly, it can fail whatever the chance that the evidential sources are unreliable. Our results hold for two types of degrees of variety: reliability independence and testable aspect independence. We conclude that the variety-of-evidence thesis can, at best, be interpreted as an exception-prone rule of thumb. (shrink)

The regulatory properties of the neurospecific, type I adenylyl cyclase and its distribution within brain have suggested that this enzyme may be important for neuroplasticity. To address this issue, the murine, Ca2+ -stimulated adenylyl cyclase (type I), was inactivated by targeted mutagenesis. Ca2+ -stimulated adenylyl cyclase activity was reduced 40% to 60% in the hippocampus, neocortex, and cerebellum. Long term potentiation in the CA1 region of the hippocampus from mutants was perturbed relative to controls. Both the initial slope and maxim (...) um extent of changes in synaptic response were reduced. Although mutant mice learned to find a hidden platform normally in the Morris water task, they did not display a preference for the region where the platform had been when it was removed. The behavioral phenotype of these mice is very similar to that exhibited by mice which have been surgically lesioned in the hippocampus. These results indicate that disruption of the gene for the type I adenylyl cyclase produces changes in spatial memory and indicate that the cAMP signal transduction pathway may play an important role for synaptic plasticity. Firms located in communities in which people are, on average, more trusting enjoy some benefits in terms of the power of CEO contracts. We present two pieces of empirical evidence to support this claim: (1) higher average trust in a county is associated with “flatter” executive contracts and (2) when an exogenous shock occurs (such as a scandal involving an important social institution), both trust and contracting move in similar directions. We obtain the first result in a panel specification (...) and the second in a “difference-in-difference” specification that uses the revelation of sex scandals involving the Catholic Church across different U.S. localities. This paper examines the association between corporate philanthropy and tunneling by controlling shareholders. Using a unique dataset from China, the paper finds evidence that firms donating more are less likely to tunnel. The negative association between philanthropy and tunneling is stronger when firms are faced with more severe agency conflicts, as indicated by lower largest shareholding, fewer growth opportunities, lower state ownership, and weaker product market competition. The results suggest that companies engaging in philanthropy have incentives to enhance their (...) reputations and improve their relationships with stakeholders. (shrink)

Johnson -Laird has argued that spatial reasoning is based on the construction and manipulation of mental models in memory. The present article addresses the question of whether reasoning about time relations is constrained by the same factors as reasoning about spatial relations. An experiment is reported that explored the similarities and the differences in the performance of subjects in comparable spatial and temporal reasoning tasks. The results indicated that, in both the temporal and the spatial content domains, the data were (...) in agreement with the view that subjects solved problems by constructing models in memory rather than with a logical rule conceptualisation of reasoning. An analysis of the premise-reading times on the basis of premise-linking order provided support for an on-line process of mental models construction, and offered an explanation for the finding that spatial problems that did require an inference of transitivity were easier than problems that did not. No essential differences in processing and performance were observed across the two content domains, although in the time domain the correctness data were in agreement with both the mental models theory and the logical rules view. The results are discussed with respect to the mental models theory and the structural characteristics of the problems. (shrink)

Starting with Jaakko Hintikka’s seminal work, epistemic logic has now grown up to a huge academic industry. When we look back to its history, however, there is a practical paradox. While Hintikka’s original purpose was to facilitate epistemological discussion, most subsequent work of epistemic logic has been done outside of philosophy, and has been ignored by most mainstream epistemologists. At the current point, one might naturally wonder, does epistemic logic still have something to do with epistemology? Along with Hintikka and (...) a growing number of formal epistemologists, we believe the answer is “yes”. Contemporary epistemology has largely focused on the goal of providing an analysis of knowledge and an answer to skepticism. To avoid skepticism, many epistemologists prefer to define knowledge in terms of evidence and relevant alternatives. A typical saying is that “in order to know that p, one only needs evidence to eliminate all relevant alternatives, rather than all alternatives”. We see such a project as perfectly congenial to the spirit of Hintikka’s epistemic logic. In this paper, we propose an epistemic logic to deal with evidence and relevant alternatives explicitly, and extend EREL to its dynamic version to investigate how different notions of knowledge behavior with the decrease and increase of relevant alternatives. To illustrate its philosophical application, we provide a new formalization of the so called factivity problem of epistemic contextualism. Newton da Costa and Steven French have argued that the concept of partial truth plays an important role in our understanding of significant aspects of scientific practice: from the status of scientific theories through the understanding of inconsistency in science to the nature of induction. Despite increasing recognition of the ways in which ethical and social values play a role in science (Kitcher 2001; Longino 1990, 2002), scientists are often still reluctant to acknowledge or discuss ethical and social values at stake in their research. Even when research is closely connected to developing public policy, it is generally held that it should be empirical data, and not the values of scientists, that inform policy. According to this view, scientists need not, and should not, endorse non-epistemic (...) values related to their research, as doing so may bias their assessment of what the evidence is. In this article we explore the role evidence ought to play in complementary and alternative medicine. First, we consider the claim that evidence in the form of randomized controlled trials cannot be obtained for CAMs. Second, we consider various claims to the effect that there are ways of obtaining evidence that do not make use of RCTs. We argue that there is no good reason why CAM should be exempted from the general requirement that treatments undergo evaluation (...) by RCT. Third, we consider two implications for health care policy. First, many activities in conventional medicine have never been rigorously evaluated and are widely in use nonetheless. We argue that this fails to provide a reason for exempting CAM from a demand for evidence. Second, CAM use may be compared to a choice of lifestyle, and this has a significant impact on which requirements of evidence can reasonably be imposed. (shrink)

This paper is intended as an extension to some of the recent discussion in the philosophical literature on the nature of experimental evidence. In particular I examine the role of empirical evidence attained through the use of deductions from phenomena. This approach to theory construction has been widely used throughout the history of science both by Newton and Einstein as well as Clerk Maxwell. I discuss a particular formulation of maxwell's electrodynamics, one he claims was deduced from experimental (...) facts. However, the deduction is problematic in that it is not immediately clear that one of the crucial parameters of the theory, the displacement current, can be given an empirical foundation. In outlining Maxwell's argument and his attempts to arrive on an empirically based account of the electromagnetic field equations I draw attention to the philosophical implications of the constraints on theory that arise in this particular case of deduction from phenomena. Public health communication makes extensive use of a linguistic formulation that will be called the “no evidence” statement. This is a written or spoken statement of the form “There is no evidence that P” where P stands for a proposition that typically describes a human health risk. Danger lurks in these expressions for the hearer or reader who is not logically perspicacious, as arguments that use them are only warranted under certain conditions. The extent to which members of (...) the public are able to determine what those conditions are will be considered by examining data obtained from 879 subjects. The role of “no evidence” statements as cognitive heuristics in public health reasoning is considered. (shrink)

Research has begun to suggest that cognitive ability contributes to emotional processes and responses. The present study sought novel evidence for this hypothesis by examining the relationship between individual differences in the capacity for inhibitory control and responses to a common emotion-induction procedure involving autobiographical memories. Participants first completed a stop-signal task to measure inhibitory control and then underwent an anger, anxiety, or neutral emotion induction. Performance on the stop-signal task predicted emotional responses such that participants with poorer inhibitory (...) control reported larger increases in anger following the anger induction and larger increases in anxiety across emotion induction conditions, relative to better inhibitors. These results suggest that individual differences in cognitive ability may influence the intensity of emotional states induced by common laboratory methods of emotion induction. (shrink)

This article is a response to McLeod and Baylis (2007) who speculate on the dangers of requesting fresh ‘spare’ embryos from IVF patients for human embryonic stem cell (hESC) research, particularly when those embryos are good enough to be transferred back to the woman. They argue that these embryos should be frozen instead. We explore what is meant by ‘spare’ embryos. We then provide empirical evidence, from a study of embryo donation and of embryo donors' views, to substantiate some (...) of their speculations about the problems associated with requesting fresh embryos. However, we also question whether such problems are resolved by embryo freezing, since further empirical evidence suggests that this raises other social and ethical problems for patients. There is little evidence that the request for embryos for research, in itself, causes patients distress. We suggest, however, that no requests for fresh embryos should be made in the first cycle of IVF treatment. Deferring the request to a later cycle ensures that potential donors are better informed (by experience and reflection) about the possible destinations of their embryos and about the definition of ‘spare embryos’. Both this article, and that by McLeod and Baylis, emphasize the need to consider the views and experiences of embryo donors when evaluating the ethics of embryo donation for hESC research. (shrink)

In ‘Evil is Still Evidence: Comments on Almeida’ Robert Bass presents three objections to the central argument (ENE) in my ‘Evil is Not Evidence’. The first objection is that ENE is invalid. According to the second objection, it is a consequence of ENE that there can be no evidence for or against a posteriori necessities. The third objection is that, contrary to ENE, the likelihood of certain necessary identities varies with the evidence we have for them. (...) In this reply I explain why ENE has exactly none of the implications described by Bass. I argue in the concluding section that there is a modal solution to the epistemological problems presented by ENE. (shrink)

Methodological strategies for the identification and synthesis of ‘evidence’ to support decision‐making in relation to complex healthcare systems and practices This paper addresses the limitations of current methods supporting ‘evidence‐based health‐care’ in relation to complex aspects of care, including those questions that are best supported by descriptive or non‐empirical evidence. The paper identifies some new methods, which may be useful in aiding the synthesis of data in these areas. The methods detailed are broadly divided into those that (...) facilitate the identification of evidence and those that enable the interpretation of the data retrieved. To illustrate some of the issues involved, reference is made to a multimethod review recently completed by the authors, which aimed to identify factors that promote continuity in the transition from child to adult health and social care. It is argued that as healthcare organisations are becoming increasingly preoccupied with the evidence base of practice, such methods may help ensure that aspects of care and approaches that are outside the dominant pharmaco‐medical domain maintain a prominent position on the healthcare agenda while remaining open to external scrutiny. Healthcare professionals who use such approaches need to know their relative utility and benefits to inform clinical decisions, so as to ensure that best practice is observed. (shrink)

It is widely assumed that it is the anti-realist who stakes his case on evidence from the history of science. I argue that realists have failed to recognize the need to collect evidence from the history of science to support their methodological claims, and anti-realists do not rely on evidence from the history of science to the extent that many suggest.

Critics frequently argue that nudges are more covert, less transparent, and more difficult to monitor than traditional regulatory tools. Edward Glaeser, for example, argues that “[p]ublic monitoring of soft paternalism is much more difficult than public monitoring of hard paternalism”. As one of the leading proponents of soft paternalism, Cass Sunstein, acknowledges, while “[m]andates and commands are highly visible”, soft paternalism, “and some nudges in particular[,] may be invisible”. In response to this challenge, proponents of nudging argue that invisibility for (...) any given individual in a particular choice environment is compatible with “careful public scrutiny” of the nudge. This paper offers the first of its kind experimental evidence that tests whether nudges are, in fact, compatible with “careful public scrutiny”. Using three sets of experiments, the paper argues that, even when entirely visible, nudges attract less scrutiny than their “hard law” counterparts. (shrink)

In this paper I argue for a version of the Total Evidence view according to which the rational response to disagreement depends upon one's total evidence. I argue that perceptual evidence of a certain kind is significantly weightier than many other types of evidence, including testimonial. Furthermore, what is generally called "The Uniqueness Thesis" is actually a conflation of two distinct principles that I dub "Evidential Uniqueness" and "Rationality Uniqueness." The former principle is likely true but (...) the latter almost certainly false. Seeing why the Rationality Uniqueness fails opens the door to seeing how mutual reasonable disagreement is possible even among those who share the same evidence. (shrink)

Fairness-related decision making is an important issue in the field of decision making. Traditional theories emphasize the roles of inequity aversion and reciprocity, whereas recent research increasingly shows that emotion plays a critical role in this type of decision making. In this review, we summarize the influences of three types of emotions (i.e., the integral emotion experienced at the time of decision making, the incidental emotion aroused by a task-unrelated dispositional or situational source, and the interaction of emotion and cognition) (...) on fairness-related decision making. Specifically, we first introduce three dominant theories that describe how emotion may influence fairness-related decision making (i.e., the wounded pride/spite model, affect infusion model, and dual-process model). Next, we collect behavioral and neural evidence for and against these theories. Finally, we propose that future research on fairness-related decision making should focus on inducing incidental social emotion, avoiding irrelevant emotion when regulating, exploring the individual differences in emotional dispositions, and strengthening the ecological validity of the paradigm. This Article analyzes the interaction between the burden of proof and evidentiary discovery rules. Both sets of rules can affect incentives for prospective injurers to invest in evidence technology. This interaction becomes acutely important in the private international law setting, where jurisdictions are split on the question whether the burden of proof should be treated as a substantive or procedural matter. When a tort occurs in Europe, but the case is litigated in American courts, treating the burden of proof (...) as a procedural matter preserves the complementarity of incentives created by the burden of proof and evidentiary rules. Conversely, treating the burden of proof as a substantive matter creates a mismatch in incentives created by the burden of proof and evidentiary rules. (shrink)
