The nazi-diplomacy, with secrecy as a keystone, permitted some of the most important Belgian politicians and businessmen to meet the.nazi-leaders without being disapproved by public opinion or even parliament. This resulted in a «practical» way to improve political and above all economical relations between Belgium and nazi-Germany. This essay claims that a rupture between two languages permeates human rights discourse in contemporary Anglo-American legal thought. Human rights law is no exception. The one language is written in the sense that a signifying relation inscribed by institutional authors represents concepts. Theories of law have shared such a preoccupation with concepts. Legal rules, doctrines, principles, rights and duties exemplify legal concepts. One is mindful of the dominant tradition of Anglo-American conceptual jurisprudence in this regard. Words have been thought to (...) copy ready-made concepts. Acts of intellectualisation and the accompanying analytic technique have excluded a consideration of a very different sense of legal language. The second sense of a language concentrates upon unwritten acts of meaning which lack a discrete and assignable author. This essay aims to unconceal the importance of an unauthored language. Drawing from Edmund Husserl’s early writings, particularly his Logical Investigations, I shall argue that an unwritten language embodies the written language with acts of meaning. An act of meaning confers one’s experiential body into the content of a concept signified in a written language. In order to understand the importance of such pre-legal acts of meaning in human rights laws, I begin by outlining how universal human rights have been signified as universal by virtue of their content-independence. I then raise the problem of the exclusion of social-cultural phenomena as elements of human rights laws. The clue to this exclusionary character of human rights law rests in the analytic leap from an unwritten to a written legal language. The essay then addresses the effort to link legality with the social world: namely, the effort of grounding legality in a social convention. I examine how a social convention itself is conceptualized, leaving the remainder of acts of meaning. This failure of social conventions to access social-cultural phenomena encourages me to turn to acts of meaning as such acts were understood by Edmund Husserl in his earlier works. Meaning-constituting acts exist prior to intuitions and prior to social conventions. This priority exists analytically as well as phenomenologically. In order to exemplify this prior character of acts of meaning, I retrieve Antigone’s experiential knowledge in Sophocles’ Antigone. Antigone’s unwritten laws are characterized by an absence of mediating concepts. I then identify several elements of an act of meaning in an unwritten language: the experiential body as the source of the acts of meaning, praeiudicia (prejudgements), collective memories, the act character of meaning, and the act of interpretation of social behaviour. My final section raises the prospect of whether human rights can be considered universal if acts of meaning are that important in the identity of a law. (shrink)

There is a lack of research about the political strategies used by firms in emerging countries, mainly because the literature often assumes that Western-oriented corporate political activity has universal application. Drawing on resource-dependency logics, we explore why and how firms orchestrate CPA in the institutionally challenging context of Nigeria. Our findings show that firms deploy four context-fitting but ethically suspect political strategies: affective, financial, pseudo-attribution and kinship strategies. We leverage this understanding to contribute to CPA in emerging countries by arguing (...) that corporate political strategies are shaped by the reciprocity and duality of dependency relationships between firms and politicians, and also by advancing that these strategies reflect institutional weaknesses and unique industry-level opportunities. Importantly, we shed light on the muttered dark side of CPA. We develop a CPA framework and discuss the research, practical and policy implications of our findings. (shrink)

Inspired by my reading of the conclusions of Plato’s Cratylus, in which I suggest that Socrates endorses the claim that speaker’s intentions determine meaning of their utterances, this thesis investigates a modern parallel. Drawing on observations that people who produce an utterances that do not accord with the conventions of their linguistic community can often nevertheless communicate successfully, Donald Davidson concludes that it is the legitimate intentions of speakers to be interpreted in a particular way that determine the meanings (...) of their utterances. This thesis investigates how we might interpret the non-standard utterances of another from the perspective of Davidson’s anticonventionalist picture of language. It proceeds by investigating the possible roles for radical interpretation and triangulation in explaining successful day-to-day communication, where non-standard language use abounds, and argues that - even from a Davidsonian perspective - a full account of the linguistic skills and knowledge that a language user requires to interpret utterances must ultimately appeal at least to regularities word use and expressions, if not full-blown conventions. _ Convention_ was immediately recognized as a major contribution to the subject and its significance has remained undiminished since its first publication in 1969. Lewis analyzes social conventions as regularities in the resolution of recurring coordination problems-situations characterized by interdependent decision processes in which common interests are at stake. Conventions are contrasted with other kinds of regularity, and conventions governing systems of communication are given special attention.

In one of his finest papers, Peter Winch establishes a distinction between norms and conventions and suggests that the latter is unable to account for many human institutions and practices. He argues that an empirical alternative must be conceivable in order for a norm to be considered as a convention and adds that many of the most central norms in different meaningful ways of life do not fulfil this condition. It is too bad because the reviewer’s job would be exceedingly easy, and very pleasant. By any measure this book has a strikingly fine cover. Its image is drawn from John Byam Liston Shaw’s depiction of Queen Mary and Princess Elizabeth entering London in 1553. This paper discusses six formalization techniques, of varying strengths, for extending a formal system based on traditional mathematical logic. The purpose of these formalization techniques is to simulate the introduction of new syntactic constructs, along with associated semantics for them. We show that certain techniques (among the six) subsume others. To illustrate sharpness, we also consider a selection of constructs and show which techniques can and cannot be used to introduce them. We expound an economic explanation of the nature, causes, and effects of moral conventions. We show, first, that systems of moral rules lead to Pareto-efficiency; second, that the efficiency they induce may be interpreted as the outcome of an exchange of courtesies; third, and finally, that moral exchange takes place whenever the costs of transaction are sufficiently low. We also explain various phenomena, including the diversity of moral rules in time and space. From Joan Lindsay and cinematic master Peter Weir to Ted Kotcheff and Warwick Thornton, over past decades authors, screenwriters and filmmakers have produced films that depict the vast Australian landscape—simply referred to as terra nullius during colonial times by settlers literally confronting a continent vastly different from anything they were culturally and geographically accustomed to—as mysterious, impenetrable and ominous. Just like the dark cold of Scandinavia lends itself perfectly to contemporary Nordic Noir, the Australian New Wave or Australian Film Revival (...) of the 1970s and 1980s saw the release of films that encapsulated the eeriness of this largely rugged, arid and windswept continent, which opens up possibilities for anything to happen within those very, limitless, territories. This article analyses Weir’s Picnic at Hanging Rock (1975), Kotcheff’s horror flick par excellence Wake in Fright (1971); "the best and most terrifying film about Australia in existence" and with a TV-series remake in 2017, and Thornton’s more recent portrayal of Aboriginal misery and poverty Samson and Delilah (2009) set against a hostile urban backdrop, from a Foucauldian perspective. In its theoretical framework it also draws primarily on Freud. Heterotopia is used as a term to refer to strange, bewildering spaces that are disturbing and undecipherable—also described as “an unimaginable space, representable only in language, and as a kind of semimythical real site” (as articulated in Knight, 2017, 141). Foucault’s concept is applied in a cinematic context and used in conjunction with Freud’s notion of the uncanny as a feeling of uneasiness; or, as has been explained in his seminal text “The Uncanny” (1919), “that class of the terrifying that leads back to something long known to us, once very familiar.” We argue that these eerie, fear-induced screened narratives represent a nation whose weather-beaten, freedom-loving yet at heart anxiety-ridden people are most definitely a product of their environment. The aim of this paper is to clarify what kind of normativity characterizes a convention. First, we argue that conventions have normative consequences because they always involve a form of trust and reliance. We contend that it is by reference to a moral principle impinging on these aspects (i.e. the principle of Reliability) that interpersonal obligations and rights originate from conventional regularities. Second, we argue that the system of mutual expectations presupposed by conventions is a source of agreements. (...) Agreements stemming from conventions are “tacit” in the sense that they are implicated by what agents do (or forbear from doing) and without that any communication between them is necessary. To justify this conclusion, we assume that: (1) there is a salient interpretation, in some contexts, of everyone’s silence as confirmatory of the others’ expectations (an epistemic assumption), and (2) the participating agents share a value of not being motivated by hostile attitudes (a motivational assumption). By clarifying the relation between conventions and agreements, the peculiar normativity of conventions is analyzed. (shrink)

Conventions are regularities in social behaviour of the past that enable us to coordinate our actions. Some conventions are lawlike: they are expected to be observed always or nearly always. However, in order to coordinate our actions, it may suffice that a precedent has occurred often enough, and sometimes even a single precedent will do. So, in general, conventions merely enable us to solve our coordination problems; lawlike conventions are a special case. Grammatical conventions are (...) often lawlike; sense conventions are typically enabling. In order to resolve the indeterminacies that sense conventions give rise to, interlocutors must rely on the common ground. In this and other ways, common ground is a prerequisite for convention‐based communication. (shrink)

This short paper has the character of a critical notice of Una Stojnić’s book Context and Coherence: The Logic and Grammar of Prominence (Stojnić 2021). It is mainly concerned with Stojnić’s strong claim that linguistic phenomena related to prominence and coherence, in particular the interpretation of pronouns, are governed by linguistic conventions and are not pragmatic in nature. On these matters, my views are opposite to Stojnić’s.

Donald Davidson denied convention any interesting role in the philosophical theory of meaning: Conventions are neither necessary nor sufficient to account for communication by language. This anticonventionalism is part of Davidson's more general individualism about meaning. According to Davidson, notions such as that of a shared language, shared practices of use, and the attendant notions of standard meaning and linguistic mistake, are as uninteresting to the philosophical theory of meaning as that of convention. The chapter starts with a sketch (...) of the meaning theoretical background for Davidson's anticonventionalism, arguing that Davidson ultimately motivates both anti‐conventionalism and individualism by the social or public nature of language. After quickly taking up Davidson's arguments against attempts to conventionally link semantics to nonsemantic purposes, the chapter then focuses on his attack on the idea that literal meaning is conventional meaning and the surrounding discussion. This book criticizes the methodology of the recent semantics-pragmatics debate in the theory of language and proposes an alternative. It applies this methodology to argue for a traditional view against a group of “contextualists” and “pragmatists”, including Sperber and Wilson, Bach, Carston, Recanati, Neale, and many others. The author disagrees with these theorists who hold that the meaning of the sentence in an utterance never, or hardly ever, yields its literal truth-conditional content, even after disambiguation and reference fixing; it needs (...) to be pragmatically supplemented in context. The standard methodology of this debate is to consult intuitions. The book argues that theories should be tested against linguistic usage. Theoretical distinctions, however intuitive, need to be scientifically motivated. Also we should not be guided by Grice’s “Modified Occam’s Razor”, Ruhl’s “Monosemantic Bias”, or other such strategies for “meaning denialism”. From this novel perspective, the striking examples of context relativity that motivate contextualists and pragmatists typically exemplify semantic rather than pragmatic properties. In particular, polysemous phenomena should typically be treated as semantic ambiguity. The author argues that conventions have been overlooked, that there’s no extensive “semantic underdetermination” and that the new theoretical framework of “truth-conditional pragmatics” is a mistake.
