The German text of Cohen’s Spinoza on State & Religion, Judaism & Christianity (Spinoza über Staat und Religion, Judentum und Christentum) first appeared in 1915 in the Jahrbuch für jüdische Geschichte und Literatur. Two years before, in the winter of 1913, Cohen taught a class and a seminar on Spinoza’s Theological-Political Treatise at the Hochschule für die Wissenschaft des Judentums. This was Cohen’s first semester at the Hochschule, after retiring from more than thirty years of teaching at (...) the University of Marburg. Cohen’s fame at the time was at its zenith, and his move to the Hochschule was a cause for celebration and excitement. According to the testimony of some students who attended the Tractatus Theologico-Politicus seminar, Cohen left no place for any expression of dissent (regrettably, the academy frequently encourages such authoritarian behavior). The text of Spinoza on State, which was the product of this seminar, still bears the marks of this “didactic” attitude. It is bombastic and feebly argued. Thus, in one moment of emotional crescendo in the text, we can literally hear Cohen shout: When Spinoza, with merciless severity, makes his own nation the object of contempt – at the time that Rembrandt lived on the same street and immortalized the ideal type of the Jew - no voices rises in protest against this humanly incomprehensible betrayal. Such patriotic rhetoric is quite typical of Cohen’s Spinoza on State, as the work reads more like a series of rants against the devil incarnated (“the demonic spirit of Spinoza”) in the figure of the traitor from Amsterdam than like a sustained and serious philosophical polemic. From time to time, one can observe hints of critical arguments, but hardly any are fleshed out. The text is also replete with rudimentary factual and interpretative errors. Thus, when Cohen argues that Spinoza traces his pantheism to Jewish sources, Cohen erroneously cites Spinoza’s reference in E2p7s to “some of the Hebrews [quidam Hebraeorum]” who argued for the identity of Sekhel, Maskil, and Muskal (the Intellect, the Intellecting Subject, and the Intellected Object) – a Maimonidean doctrine that has nothing to do with pantheism – while the text Cohen clearly had in mind was Spinoza’s claim, in Letter 73, that the traditions (traditionibus) of the “ancient Hebrews [antiquis Hebraeis]” agree with Spinoza’s claim that “all things are in God.” Similarly, and on the very same page, Cohen ascribes to Spinoza the claim that “the God of the Old Testament is only a body,” a claim which is nowhere to be found in Spinoza’s works, and which can be inferred from Spinoza’s text only through a patent fallacy. If I may add one last example, consider the following passage from Cohen’s Spinoza on State: [For Spinoza] divine law is grounded in our mind. Yet this does not mean that our mind bears responsibility for producing and obeying the law. Instead, it means that, by definition, the human mind and God are identical, inasmuch as He exists in the human mind. Hardly any claim in this brief passage is correct. Yet, what is most striking is Cohen’s derivation of the identity of God and the human mind from the claim that God exists in the human mind. If I exist in North America, this obviously does not imply that I am identical to North America (there are, for example, a couple of North American porcupines and alligators that are distinct from me). What rule of inference Cohen sought to employ in this argument, and how this impressive inference of the identity of God and the human mind is supposed to square with Cohen’s view of Spinoza as a pantheist – i.e., as considering the physical nature to be divine – is beyond my grasp. Instead of tracking down the dozens of crude errors and fallacies in Cohen’s text, I would like to concentrate here on one crucial issue: Cohen’s critique of Spinoza’s pantheism. By doing this, I will have to pass silently over a couple of surprising agreements between the two figures, such as the (false) claim that all of the prophets of the Hebrew Bible taught the same universal and simple morality. My discussion of pantheism will be divided into two sections. In the first, I will examine Cohen’s understanding of Spinoza’s pantheism. In the second, I will briefly examine the historical validity of Cohen’s claim that pantheism is a Christian doctrine, diametrically opposed to Judaism. (shrink)

Addressing the alleged "great secrets" contained in Scripture, Spinoza wrote in the Theological Political Treatise : "I have also read, and for that matter, known personally, certain Kabbalistic triflers. I've never been able to be sufficiently amazed by their madness". Were these words Spinoza's only reference to the Kabbalah, we would hardly have any reason to believe that his attitude toward the Kabbalistic literature was anything but dismissive. However, in a 1675 letter to Henry Oldenburg, Spinoza stressed that he shared (...) the view that "all things are in God" with certain ancient traditions of the Hebrews, "corrupted as they have been in many ways"... Spinoza’s interpretation of the election of the Hebrews in the third chapter of the Theological Political Treatise enraged quite a few Jewish readers of the nineteenth and twentieth centuries. The rise of nationalism, and the demand of loyalty to one’s own genos brought about a certain style of patriotic writing aimed at Spinoza’s “betrayal.” In a series of lectures on the eve of the Great War, Hermann Cohen portrayed Spinoza as a person of “demonic spirt” and as “the great (...) enemy who emerged from our midst.” In a stream of words more akin to shouting than to analytic discourse, Cohen protested against what he took to be the universal complacency regarding Spinoza’s treachery: “When Spinoza, with merciless severity, makes his own nation the object of contempt – at the time that Rembrandt lived on the same street and immortalized the ideal type of the Jew - no voice rises in protest against this humanly incomprehensible betrayal.” Cohen was right in identifying in Spinoza an absence of ethnic patriotism. I, for one, find this absence a virtue rather than a vice, and in this chapter I will argue, inter alia, that in rejecting ethnic normativity Spinoza was consistent with a dominant strand of rabbinic thought. What precisely was so offensive in Spinoza’s words in chapter three of the TTP? A common reading of this chapter suggests that Spinoza presents the election of the Hebrews as merely political and not spiritual in nature, thus downgrading the importance of the election. This reading is not absolutely groundless, but it is highly imprecise, for as we shall shortly see, for Spinoza, God’s (genuine) election of the Hebrews indicates the political weakness of their state, rather than its strength. Apart from pointing out this important corrective, I will also attempt in this essay to evaluate Spinoza’s critique of the election of the Hebrews, the result of which might lead us to some highly unexpected conclusions. In the first section of this chapter I present an outline of Spinoza’s interpretation of the connection between the Hebrews’ belief in being chosen, and the xenophobic nature of their ancient state. In the second section, I discuss Spinoza’s interpretation of the election of the Hebrews in chapter three of the TTP, and show that on Spinoza’s sardonic reading it was nothing but luck which allowed the Hebrew state to survive for a rather long time in spite of its poor political constitution. The third and final part provides a defense of Spinoza’s critique of the notion of chosenness. I will argue, first, that chosenness has never been granted the status of theological doctrine or principle of faith within rabbinic Judaism. I will then point out the significant religious problems with the notion of chosenness, suggesting however two exceptions in which belief in chosenness might still be defensible. I will conclude this section with a discussion of rabbinic views on the conversion of minors, arguing that according to the mainstream rabbinic view, being a Jew is a merit only on the condition that a person is pious, a view which is not far from Spinoza’s own claims in the third chapter of the TTP. Major Philosophers of Jewish Prayer in the Twentieth Century addresses the troubling questions posed by the modern Jewish worshiper, including such obstacles to prayer as the inability to concentrate on the words and meanings of formal liturgy, the paucity of emotional involvement, the lack of theological conviction, the anthropomorphic and particularly the masculine emphasis of prayer nomenclature, and other matters. In Mindblindness, Simon Baron-Cohen presents a model of the evolution and development of "mindreading." He argues that we mindread all the time, effortlessly, automatically, and mostly unconsciously. It is the natural way in which we interpret, predict, and participate in social behavior and communication. We ascribe mental states to people: states such as thoughts, desires, knowledge, and intentions. Building on many years of research, Baron-Cohen concludes that children with autism, suffer from "mindblindness" as a result of a selective (...) impairment in mindreading. For these children, the world is essentially devoid of mental things. Baron-Cohen develops a theory that draws on data from comparative psychology, from developmental, and from neuropsychology. He argues that specific neurocognitive mechanisms have evolved that allow us to mindread, to make sense of actions, to interpret gazes as meaningful, and to decode "the language of the eyes." Israel’s conduct in the Occupied Territories in recent decades has been profoundly affected by three theologies: the messianic-kabalistic theology of Rabbi Abraham Yitzhak Ha-Cohen Kook and his son Rabbi Zvi Yehuda Ha-Cohen Kook; the messianic-Hasidic-kabalistic-racist theology of Rabbi Yitzhak Ginsburg; the violent, racist theology of Rabbi Meir Kahane. In the spirit of the three theologies, Israeli politics of the past four and a half decades has set the continuous possession of Judea and Samaria, and the deepening (...) and expansion of the settlement project therein, as the supreme goal of Zionism, Jewish nationalism. Moreover, the three theologies dictated much of the settlement policies of the government. Additionally, the three theologies have dictated much of the daily practices to which the Palestinian residents of the Territories have been subjected. All of this means that soldiers who are required to serve in the Occupied Territories, to die in them, and to kill Palestinians in the course of their military service therein, have been subjected to a politics motivated, to a substantial extent, by a religious culture premised on religious theologies. If such soldiers wish to refuse to abide by the orders given them to serve in the Occupied Territories, they can resort to the two traditional doctrines recgnized by liberal jurisprudence: the doctrine of civil disobedience and the doctrine of conscientous objection (Often there is an overlapp between the two defences). I argue that in addition to these two traditional doctrines, secular soldiers who are asked to serve in the Occupied Territories may resort to a doctrine I call “culture-based refusal.”. (shrink)

Beneficence and respect for autonomy are two of the most fundamental moral duties in general and in bioethics in particular. Beyond the usual questions of how to resolve conflicts between these duties in particular cases, there are more general questions about the possible forms of the interactions between them. Only recognition of the full spectrum of possible interactions will ensure optimal moral deliberation when duties potentially conflict. This paper has two simultaneous objectives. The first is to suggest a typological scheme (...) of all possible modes of interaction; these will be classified under the “discrete,” “semi-discrete,” and “non-discrete” categories, according to whether the meaning and/or forms of expression of each duty are treated as independent from or rather as constrained by the other. The second objective is to show that all logical possibilities of interaction indeed have real expressions in medical ethics, to provide clear illustrations of each, and in particular to stress those that have usually escaped recognition. “Medical Tourism” is the travel of residents of one country to another country for treatment. In this article I focus on travel abroad to purchase organs for transplant, what I will call “Transplant Tourism.” With the exception of Iran, organ sale is illegal across the globe, but many destination countries have thriving black markets, either due to their willful failure to police the practice or more good faith lack of resources to detect it. I focus on the sale of kidneys, (...) the most common subject of transplant tourism, though much of what I say could be applied to other organs as well. Part I briefly reviews some data on sellers, recipients, and brokers. Part II discusses the bioethical issues posed by the trade, and Part III focuses on potential regulation to deal with these issues. (shrink)

In my paper ‘A Logic for Evidential Support’ (this Journal, 17 (1966), 21 ff.) the argument on page 25 is illustrated by wrong and misleading examples.1 The argument proceeds by considering statements logically equivalent to a universal hypothesis U1 that are formed by generalising analogously not about the individual elements of U1's domain of discourse, but about pairs, trios, or n-membered classes of these elements, where the domain of U1 has at least n elements. But the generalisations must be understood (...) distributively : not collectively, as the examples in the original version suggested. Such an equivalent for ‘All ravens are black’ will not be ‘All pairs of ravens are pairs of black things’, but ‘All pairs are pairs of things each of which is a raven only if black’. Similarly, instead of ‘If the pair a, b is a pair of ravens it is a pair of black things’ on page 26,1 should have written ‘The pair a, b is a pair of things each of which is a raven only if black’. If these alterations are made, the argument is unobjectionable, and the qualification about truth-functional conditionals, on page 25, is no longer required. This book examines Aristotle's metaphysics and his account of nature, stressing the ways in which his desire to explain observed natural processes shaped his philosophical thought. It departs radically from a tradition of interpretation, in which Aristotle is understood to have approached problems with a set of abstract principles in hand, principles derived from critical reflection on the views of his predecessors. A central example of the book interprets Aristotle's essentialism as deriving from an examination of the kinds of unity (...) that various sorts of things have: elemental motion, alteration, transformation and the growth of organisms. An important conclusion of this argument is that an essence may, under certain circumstances, lack some of its essential attributes. This is a major re-evaluation of Aristotle's metaphysics that will interest philosophers, classicists and historians of science. (shrink)

One of the most important concepts in Simone de Beauvoir’s existentialist and phenomenological ethics is the concept of freedom. In this article, I would like to argue that Beauvoir’s concept of freedom is problematic in being strongly constrained by its essentially active character. This constraint contradicts some of Beauvoir’s major ideas, such as the one that considers the body as a situation, as a source of activity and of freedom in itself, as well as the idea of eroticism as one (...) of the most important expressions of authenticity. I will show that Beauvoir’s concept of freedom can appear to be less constrained by the necessity to be inherently active if we look at it through the ‘crack’ provided by her conception of the erotic body as already embodying freedom. Using this ‘crack’, I will attempt to shed new light on the aspects of Beauvoir’s idea of the erotic that are productive for her conceptions of ethics and of freedom. (shrink)

Argumentation is an important research area in the field of AI. There is a substantial amount of work on different aspects of Dung’s abstract Argumentation Framework (AF). Two relevant aspects considered separately so far are: i) extending the framework to account for recursive attacks and supports, and ii) considering dynamics, i.e., AFs evolving over time. In this paper, we jointly deal with these two aspects. We focus on High-Order Argumentation Frameworks with Necessities (HOAFNs) which allow for attack and support relations (...) (interpreted as necessity) not only between arguments but also targeting attacks and supports at any level. We propose an approach for the incremental evaluation of the credulous acceptance problem in HOAFNs, by “incrementally” computing an extension (a set of accepted arguments, attacks and supports), if it exists, containing a given goal element in an updated HOAFN. In particular, we are interested in monitoring the credulous acceptance of a given argument, attack or support (goal) in an evolving HOAFN. Thus, our approach assumes to have a HOAFN Δ, a goal \rho occurring in Δ, an extension E for Δ containing \rho, and an update u establishing some changes in the original HOAFN, and uses the extension for first checking whether the update is relevant; for relevant updates, an extension of the updated HOAFN containing the goal is computed by translating the problem to the AF domain and leveraging on AF solvers. We provide formal results for our incremental approach and empirically show that it outperforms the evaluation from scratch of the credulous acceptance problem for an updated HOAFN. (shrink)

A model that suggests reconsolidation of traumatic memories as a mechanism of change in therapy is important, but problematic to generalize to disorders other than post-traumatic and acute-stress disorder. We suggest that a more plausible mechanism of change in psychotherapy is acquisition of adaptive emotion regulation strategies.

The essay opens with some background information about the period in which J.S. Mill wrote. The discussion revolves around the concept of blasphemy which Mill considered to be highly problematic. Tagging unpopular views as ‘blasphemous’ amounted to abuse of governmental powers and infringed on the basic liberties of the out-of-favour speakers. The discussion on blasphemy sets the scene to the understanding of Mill's concerns, his priorities and consequently his emphasis on the widest possible liberty of expression. Section 2 presents the (...) Millian principles that are pertinent to his philosophy of free speech: liberty and truth. Section 3 analyzes Mill's very limited boundaries to freedom of expression, asserting that the consequentialist reasoning had led Mill to ignore present tangible harm. It is argued that democracy is required to develop protective mechanisms against harm-facilitating speech. (shrink)

The problem of perception is the problem of explaining how perceptual knowledge is possible. The skeptic has a simple solution: it is not possible. I analyze the weaknesses of one type of skeptical reasoning by making explicit a dynamic epistemic principle from dynamic epistemic logic that is implicitly used in debating the problem, with the aim of offering a novel diagnosis to this skeptical argument. I argue that prominent modest foundationalist responses to perceptual skepticism can be understood as rejecting the (...) dynamic assumption made by the skeptic, that there are independent reasons to doubt the truth of such a principle in the context of skeptical reasoning, and that making the dynamic principle explicit allows for a better understanding of at least one objection to modest foundationalism. This chapter argues that although there are certain limits on how religious bodies and their members should attempt to insert their beliefs into public policy matters, religiously based arguments should, as a matter of principle, be allowed to enter into public debate. This is the case even when many participants in these debates do not accept the premises on which the arguments of religious believers are constructed. The first part of the chapter considers the stances that various religious bodies and (...) commentators have taken publicly regarding embryonic stem cell research and the ways in which they have justified their views in the course of public discussion. It then examines why critics of religious bodies object to the introduction of religious views into public policy debates and offer several responses to these critics, using the responses of religious bodies and thinkers to embryonic stem cell research as examples. Finally, the chapter sets out an alternative view that offers a system for allowing religious bodies to present their views in the public sphere, provided that they follow certain practices that allow fair and open debate. Objectives Potentially life-shortening medical end-of-life practices ) remain subject to conceptual vagueness. This study evaluates how physicians label these practices by examining which of their own practices they label as euthanasia or sedation.Methods We conducted a large stratified random sample of death certificates from 2007 . The physicians named on the death certificate were approached by means of a postal questionnaire asking about ELDs made in each case and asked to choose the most appropriate label to describe the ELD. Response (...) rate was 58.4%.Results In the vast majority of practices labelled as euthanasia, the self-reported actions of the physicians corresponded with the definition in the Belgian euthanasia legislation; practices labelled as palliative or terminal sedation lack clear correspondence with definitions of sedation as presented in existing guidelines. In these cases, an explicit life-shortening intention by means of drug administration was present in 21.6%, life shortening was estimated at more than 24 h in 51% and an explicit patient request was absent in 79.7%.Discussion Our results suggest that, unlike euthanasia, the concept of palliative or terminal sedation covers a broad range of practices in the minds of physicians. This ambiguity can be a barrier to appropriate sedation practice and indicates a need for better knowledge of the practice of palliative sedation by physicians. (shrink)

Research shows that the physician’s personal attributes and social characteristics have a strong association with their end-of-life decision making. Despite efforts to increase patient, family and surrogate input into EOL decision making, research shows the physician’s input to be dominant. Our research finds that physician’s social values, independent of religiosity, have a significant association with physician’s tendency to withhold or withdraw life sustaining, EOL treatments. It is suggested that physicians employ personal social values in their EOL medical coping, because they (...) have to cope with existential dilemmas posed by the mystery of death, and left unresolved by medical decision making mechanisms such as advanced directives and hospital ethics committees. In earlier work we proposed an account of information grounded in counterfactual conditionals rather than probabilities, and argued that it might serve philosophical needs that more familiar probabilistic alternatives do not. Demir [2008] and Scarantino [2008] criticize the counterfactual approach by contending that its alleged advantages are illusory and that it fails to secure attractive desiderata. In this paper we defend the counterfactual account from these criticisms, and suggest that it remains a useful account of information.

Recently various gedankenexperiments have been formulated which argue that the assumption that “elements of reality” are Lorentz invariant cannot be reconciled with standard quantum mechanics. Two of these gedankenexperiments were subsequently analyzed using the notion of pre- and postselected quantum systems, and it was claimed that elements of reality can be made Lorentz invariant if the “product rule” of standard quantum mechanics is abandoned. In this paper we show that the apparent violations of the product rule in these gedankenexperiments are (...) not as significant as they appeared to be in the previous analysis. We conclude that the problems with Lorentz invariance which arise in these gedankenexperiments are essentially unrelated to the product rule violations. (shrink)

into treatment decisions is viewed as pernicious by some who claim that these presuppose the Nazi position that those who are ‘devoid of value’ must be exterminated. ‘Quality of life’ judgments are said to deny the equal value of human beings and to assume that some lives are not ‘worthy to be lived’. It is argued that the analogy misconstrues the senses of ‘value’ and ‘quality’ employed by Naziism and a ‘quality of life’ position. This leads the analogizers incorrectly to (...) claim that both views assimilate the value of human beings to the value of their condition. A ‘quality of life’ position is grounded in recognition of the logical priority of the value of human beings as self-reflective evaluators and agents, which is a matter of kind, not degree. The ‘quality of life’ is explicated in terms of the standards of well-being of individuals, which are derived from their basic human needs and their individual priorities and goals. The use of ‘quality of life’ judgments is morally required to ensure that considerations of justice and individual autonomy govern treatment decisions. This volume is dedicated to Mario Bunge in honor of his sixtieth birthday. Mario Bunge is a philosopher of great repute, whose enormous output includes dozens of books in several languages, which will culminate with his Treatise on Basic Philosophy projected in seven volumes, four of which have already appeared [Reidel, I 974ff. ]. He is known for his works on research methods, the foundations of physics, biology, the social sciences, the diverse applications of mathematical methods and of systems analysis, (...) and more. Bunge stands for exact philosophy, classical liberal social philosophy, rationalism and enlightenment. He is brave, even relentless, in his attacks on subjectivism, mentalism, and spiritualism, as well as on positivism, mechanism, and dialectics. He believes in logic and clarity, in science and open-mindedness - not as the philosopher's equivalent to the poli tician's rhetoric of motherhood and apple pie, but as a matter of everyday practice, as qualities to cultivate daily in our pursuit of the life worth living. Bunge's philosophy often has the quality of Columbus's egg, and he is prone to come to swift and decisive conclusions on the basis of argu ments which seem to him valid; he will not be perturbed by the fact that most of the advanced thinkers in the field hold different views.
