The chapter begins with the idea that fostering emotions that acknowledge one's role, whether direct or indirect, in causing harm to the environment can encourage eco-friendly behavior. In Western environmental discussions, guilt is often emphasized, whereas Eastern perspectives lean towards shame when addressing responsibility for environmental damage. While guilt discourse is prevalent, ecoshame remains unexplored in the context of environmental ethics. Hence, the chapter draws on Chinese texts to offer an exploration into the potential of this affect to promote responsible (...) environmental actions. Classical philosophical Daoism as it is expressed in the Dao-De-Jing and the Zhuang-Zi is often interpreted as lacking a capacity for critique and resistance. Since these capacities are taken to be central components of Enlightenment reason and action, it would follow that Daoism is incompatible with Enlightenment. This interpretation is being refuted by way of developing a constructive dialogue between the enlightenment traditions of critical theory and recent philosophy of action from a Daoist perspective. Daoism's normative naturalism does neither rest (...) on a primitivist call for a return to the past, nor does it suggest future-directed activism. By way of reconstructing its descriptive, explanatory and emancipatory dimensions, it is shown that Daoism constitutes an alternative form of critical theory. In contrast to future-directed purposive action or blind rule-following, Daoism's key normative concept of "wu-wei" emphasizes effortless non-calculative responsiveness in the present. Drawing on recent insights in the philosophy of action, a reconstruction of wu-wei allows to conceive of a promising form of emancipatory agency. (shrink)

Fabian Heubel is intellectually situated in both Frankfurt and Taipei. He also embarks on regular excursions to Paris and Beijing. Due to this rare combination of influences, he has managed to square a philosophical circle that comprises Critical Theory in the Frankfurt-School tradition, contemporary French philosophy as well as classical and modern Chinese philosophy in the PRC and Taiwan. Heubel's approach reflects the experience of being existentially immersed in Chinese language as well as academic life at his academic home, the (...) Hegel’s conception of a universal history of reason is usually interpreted as a Eurocentric project that is dismissive of the genuine contributions by other cultures. In contrast to this assumption, his views concerning Chinese philosophical traditions evolved significantly in his late Lectures on the Philosophy of Religion. Hegel increasingly acknowledges a unique contribution of Confucianism and especially Daoism. While Confucianism is depicted as a natural religion of magic in which the emperor governs as the supreme magician, Daoism revolts against the (...) emperor’s nepotism and turns to the Dao to elaborate a speculative philosophy of reason. The paper argues that the search for a rational form of mysticism is the basis for increasingly valuing the Chinese contributions to a conception of reason that incorporates mystical elements. El presente artículo examina los discursos histórico-geográficos sobre América transmitidos en China por misioneros jesuitas entre los siglos XVI y XVIII. Este busca demostrar el modo en que misioneros y sus colaboradores chinos crearon, cuidadosa y estratégicamente, sus informaciones sobre el continente con el fin de apoyar su agenda política y misional. El texto comienza con una descripción general de las estrategias de la misión en China y su relación con la producción geográfica sino-jesuita, para luego ejemplificar a través de (...) un análisis de los contenidos sobre la geografía, etnografía y el “descubrimiento” del continente, la conexión de estas informaciones con los planes de la misión. El artículo concluye que las representaciones sobre la geografía, gentes e historia de América reflejan tres intereses interrelacionados: atraer la atención de los literatos chinos; resaltar el alto desarrollo de la civilización europea; y comunicar mensajes religiosos. The materialist approach of One-Dimensional Man emerges in a later work in which Marcuse connects the notion of “new sensibility” to a “complex intermediary function of the intellect.” Revolutionary praxis “is not simply negation but contradiction,” and thus Marcuse’s “new idea of reason” constructs a liberating rationality upon a technological one. One guiding principle has been used throughout in the preparation of this bibliography: to provide readers with a guide which, though not exhaustive, does provide a good starting point for the serious study of the philosophy of Gabriel Marcel. Those works which contain comprehensive bibliographies to a certain date are listed as such. Roger Troisfontaines' De l'existence à l'être, (...) for example, contains an exhaustive bibliography of Marcel's works to the date of its publication and this fact is noted in the entry below. It is always best to read a philosopher in his original language. For the convenience of the English‐speaking reader however, the more important works of Gabriel Marcel are listed in the translation whenever possible. This Element addresses three questions about Kant's guarantee thesis by examining the 'first addendum' of his Philosophical Sketch: how the guarantor powers interrelate, how there can be a guarantee without undermining freedom and why there is a guarantee in the first place. Kant's conception of an interplay of human and divine rational agency encompassing nature is crucial: on moral grounds, we are warranted to believe the 'world author' knew that if he were to bring about the world, the 'supreme' good (...) would come about too. It is part of a global trend today that new relationships are being forged between religion and society, between spirituality and materiality, giving rise to announcements that we live in a ‘postsecular’ or ‘desecularized’ world. Taking up two educational movements, the mindfulness movement in the West and the revival of Confucian education in China, this paper examines what and how postsecular orientations and sensibilities penetrate educational discourses and practices in different cultural contexts. We compare the two movements to reveal a (...) new quality of hybrid modernization in that they react, in different ways, to certain pathologies that are identified as consequences of secular modernity. Burnout syndrome, the sense of a spiritual void, but also the loss of a spiritual and cultural identity are being perceived as correlating to a one-sided push towards a modernity that emphasizes secular rationalization over mindfulness and Westernization over cultural particularity. The two case studies mark a critical insight on the present condition and limits of secularism and highlights the ongoing negotiations of values and modes of self-cultivation in schools. In an increasingly pluralistic world, the entanglement of the secular, spiritual, religious and wisdom traditions provides the opportunity to rethink education as a creative realm and an impossible possibility to re-engage the minds and lives of those in the hybrid pedagogical time. This essay offers a comparative analysis of the notion of trust in Hegel and Confucius. It shows that Hegel’s two senses of trust depend upon his theory of recognition and recognitive struggle. The competitive thrust of Hegel’s account of trust, it argues, introduces a series of problems that cannot be adequately resolved within his theory, since it presupposes the kinds of trusting relations—self-, intersubjective- and world-trust—that it purports to explain. This essay then turns to the Confucian notions of xin 心 (...) and li 理 to address the problems in the Hegelian account. It concludes by outlining the Confucian account’s salience for critical social theory. (shrink)

This article contributes to the analysis of refusal to license cases as abuse of a dominant position pursuant Article 82 EC from an economic perspective. In the Microsoft case, the European Commission introduced an "Incentives Balance Test" to assess whether the refusal to give access to interface information can be justified by arguing that this information is protected by Intellectual Property Rights (IPRs): The Commission argued that if the overall innovative effects evoked by a compulsory license are significantly higher than (...) without this access, the IPR owner is obliged to license. This should be assessed through balancing the different incentives to innovate between the dominant firm and its competitors. In the paper we pursue two objectives: Firstly, we analyze to what extent the decision of the Court of First Instance, which confirmed the decision of the Commission, helps to clarify the criteria in refusal to license cases; in fact, it is disappointing in this regard. Secondly, we demonstrate that the basic idea of the Incentives Balance Test can be interpreted as a test whether the specific IPRs of the dominant firm can be defended from the perspective of the economics of IPRs. This implies that Article 82 allows competition law to correct economically not optimal IPRs through a specific economic analysis. This is followed by a broad overview on theoretical and empirical insights from economics of IPRs, innovation economics and competition and network economics that can help to develop a more general and sophisticated Innovation Effects Test that can be applied in Article 82 refusal to license cases. This paper is the most complete presentation of my views on deterministic causation. It develops the deterministic theory in perfect parallel to my theory of probabilistic causation and thus unites the two aspects. It also argues that the theory presented is superior to all regularity and all counterfactual theories of causation.

Solche Jahresverzeichnisse waren immer nach dem gleichen Prinzip angelegt: Der Benutzer der "Ephemeris historica" fand in der Regel auf jeder Seite des Kalenders für diesen Tag erinnerungswürdige biblische oder historische Ereignisse im Druck aufgeführt, der frei (...) gebliebene Raum lud zum Einfügen eigener Beobachtungen ein. Die in dieser Weise als Merkbüchlein verwendete "Ephemeris" mutierte so unter medialen Gesichtspunkten zu einem Mischtext zwischen Druck und Handschrift. It is often assumed that Aristotle, Boethius, Chrysippus, and other ancient logicians advocated a connexive conception of implication according to which no proposition entails, or is entailed by, its own negation. Thus Aristotle claimed that the proposition ‘if B is not great, B itself is great […] is impossible’. Similarly, Boethius maintained that two implications of the type ‘If p then r’ and ‘If p then not-r’ are incompatible. Furthermore, Chrysippus proclaimed a conditional to be ‘sound when the contradictory of (...) its consequent is incompatible with its antecedent’, a view which, in the opinion of S. McCall, entails the aforementioned theses of Aristotle and Boethius. Now a critical examination of the historical sources shows that the ancient logicians most likely meant their theses as applicable only to ‘normal’ conditionals with antecedents which are not self-contradictory. The corresponding restrictions of Aristotle’s and Boethius’ theses to such self-consistent antecedents, however, turn out to be theorems of ordinary modal logic and thus don’t give rise to any non-classical system of genuinely connexive logic,. Through the work of philosophers like Sellars, Davidson and McDowell, the question of how the mind is related to the world has gained new importance in contemporary analytic philosophy. This book demonstrates that Husserl's phenomenological analyses of the structure of consciousness can provide fruitful insights for developing an original approach to these questions.
