Robert F. Williams, despite being a central historical figure and noted theorist of the Black radical tradition, is ignored as a subject of philosophical relevance and political theory. His challenges to the racist segregationist regime of the South influenced generations of thinkers and revolutionaries. However he is erased from the annals of thought for his use of armed resistance. This paper discusses some ethically relevant aspects of William Nordhaus’s contribution to climate change policy evaluation. Nordhaus's approach can shed light on one—but only one—dimension of the climate change problem. His boldest claims notwithstanding, there is nothing particularly "optimal" about the temperature increases associated with his most famous modeling choices.

The model of clinical ethics consultation (CEC) defended in the ASBH Core Competencies report has gained significant traction among scholars and healthcare providers. On this model, the aim of CEC is to facilitate deliberative reflection and thereby resolve conflicts and clarify value uncertainty by invoking and pursuing a process of consensus building. It is central to the model that the facilitated consensus falls within a range of allowable options, defined by societal values: prevailing legal requirements, widely endorsed organizational policies, and (...) professional standards of practice and codes of conduct. Moreover, the model stipulates that ethics consultants must refrain from giving substantive recommendations regarding how parties to a moral disagreement in the clinic should evaluate their options. We argue that this model of CEC is incomplete, because it wrongly assumes that what counts as the proper set of allowable options among which the parties are to deliberate will itself always be clearly discernible. We illustrate this problem with a recent case on which one of us consulted—a neonate born with trisomy 18 (T18). We try to show that law, policy, and standards of practice reveal no clear answer to the question posed by the case: namely, whether forgoing gastrostomy tube feedings for a baby with T18 is allowable. We suggest there may be other kinds of cases in which it may simply be unsettled whether a given choice falls within the set of allowable options within which consensus is to be facilitated. What should an ethicist do when confronting such unsettled cases? We agree with the facilitation model that an ethicist should remain neutral among the allowable options, when it is clear what the allowable options are. But, in unsettled cases, the role of a consultant should be expanded to include a process of moral inquiry into what the allowable options should be. We end by raising the issue of whether this means an ethicist should share his or her own conclusions or views about the allowability of a given clinical option. (shrink)

A significant number of inmates with mental illness reside within the New York State Department of Corrections (NYSDOCS). New York State has taken the initiative to provide mentally ill inmates with necessary services through a collaboration of the New York State Department of Correctional Services and the New York State Office of Mental Health (NYSOMH). The collaboration results in a mental health delivery system that provides many essential services to mentally ill inmates. This paper focuses on the organization of mental (...) health services within NYSDOCS, best practices, past and current litigation, and staff responsibilities. As the population of mentally ill inmates continues to grow, implications for the Human Services professions of OMH and DOCS needs to continue to address and provide adequate mental health care and resources for this special population. There are many branches of philosophy called “the philosophy of X,” where X = disciplines ranging from history to physics. The philosophy of artificial intelligence has a long history, and there are many courses and texts with that title. Surprisingly, the philosophy of computer science is not nearly as well-developed. This article proposes topics that might constitute the philosophy of computer science and describes a course covering those topics, along with suggested readings and assignments.

Increasingly, medical students are required to face up to ethical issues in their training and practice. At the same time, there is growing interest in philosophy courses in the ethical issues raised by medical practice. This textbook, designed primarily for students of medicine, develops the issues to a philosophical level complex enough to be satisfying to students of philosophy as well as MA students on applied ethics courses. The author advocates an approach to medical ethics which breaks out of the (...) straitjacket of the narrow choice between utilitarian or deontological theory, and contains a valuable discussion of practical wisdom. I argue that George Nakhnikian's analysis of the logic of cogito propositions (roughly, Descartes's 'cogito' and 'sum') is incomplete. The incompleteness is rectified by showing that disjunctions of cogito propositions with contingent, non-cogito propositions satisfy conditions of incorrigibility, self-certifyingness, and pragmatic consistency; hence, they belong to the class of propositions with whose help a complete characterization of cogito propositions is made possible.

This article offers proposed guidelines intended to protect the public interest in relationship to the advocated social responsibilities of successful entrepreneurs. The author argues that the most effective approach, then, is not preaching about obligations but, rather, establishing financial incentives for doing well by doing good. One example is the U.S. patent system. Another is a redesigned tax system that uses imposts to make socially damaging activities expensive, while reducing the financial burden on virtuous behavior.

Rolston (1988) argues that in order to act ethically in the environment, moral agents must assume that their actions are potentially harmful, and then strive to prove otherwise before implementing that action. In order to determine whether or not an action in the environment is harmful requires the tools of applied epistemology in order to act in accord with Rolston’s ethical prescription. This link between ethics and epistemology demands a closer look at the relationship between confirmation theory, particularly notions of (...) plausibility, in the philosophy of science and environmental ethics. In the movieRegarding Henry, the main character, Henry Turner, is a lawyer who suffers brain damage as a result of being shot during a robbery. Before being wounded, the Old Henry Turner had been a successful lawyer, admired as a fierce competitor and well-known for his killer instinct. As a result of the injury to his brain, the New Henry Turner loses the personality traits that had made the Old Henry such a formidable adversary.

The difficulties encountered by attempts to treat identity as a relation between an object and itself are well-known: "...the sentence 'The morning star is...the morning star' is analytic and a truism, while...'The morning star is the evening star' is synthetic and represents a 'valuable extension of our knowledge'... But if {the morning star} and {the evening star} are the same object, and identity is taken as a relation holding between this object and itself, then it is impossible to explain how (...) the two sentences can differ in cognitive content... ". Russell's solution to these difficulties rejects the identification of logical with grammatical form, in effect denying that such sentences assert relations between the morning star and itself. The logical representations which the Russellian proposes, contain quantifiers, predicate letters, and individual variables, but no expressions standing for particulars. The Fregean solution, while admitting logical representations whose nominal expressions stand for particulars, insists that the meaning of such expressions is different from their reference. Frege-Russell analyses thus both deny that the morning star is involved qua particular in the meaning of the sentences in question. ;Rather than replace the morning star as ontological subject of these sentences, I suggest that their difference in meaning arises from the kind of particular that the identity-relation relates--a particular which, unlike its Frege-Russell counterpart, is two-sided and multi-faceted. Such a particular requires an ambiguous singular term. In Chapter 1, I utilize such a term to provide a surfacist account of belief-context ambiguity requiring neither differences in relative scope nor distinctions between sense and reference. In Chapter 2, I go on to provide an account of negative existentials, necessity- and identity-statements which resolves philosophical problems that Russell-Frege analyses only avoid. To solve these problems, I show that it is necessary to reject two canons of philosophical logic, the Law of Identity and the Indiscernibility of Identicals. (shrink)

My interest is to examine the nature of mind in relation to value, for I suspect that the neglect by the psychologist of the true status of value has deterred his work in two respects: first, that it has prevented a genuine theory of mind's being arrived at, and secondly that it has prevented him in his clinical work from achieving for the individual the fuller expression of mind or self that makes for satisfaction or happiness.

Late in 1990, the Center for the Study of Ethics in the Professions at Illinois Institute of Technology (lIT) received a grant of more than $200,000 from the National Science Foundation to try a campus-wide approach to integrating professional ethics into its technical curriculum.! Enough has now been accomplished to draw some tentative conclusions. I am the grant's principal investigator. In this paper, I shall describe what we at lIT did, what we learned, and what others, especially philosophers, can learn (...) from us. This article presents evidence supporting the claim that ethical reasoning is a skill that can be taught and assessed. We propose a working definition of ethical reasoning as 1) the ability to identify, analyze, and weigh moral aspects of a particular situation, and 2) to make decisions that are informed and warranted by the moral investigation. The evidence consists of a description of an ethical reasoning education program—Ethical Reasoning in Action —designed to increase ethical reasoning skills in a variety of (...) situations and areas of life. ERiA is housed at a public, major comprehensive U.S. university—James Madison University—and assessment of the program focuses on interventions delivered prior to and during orientation for incoming first-year students. Findings indicate that the interventions measurably enhance the ability of undergraduate students to reason ethically. ERiA’s competency-targeted program and positive student learning outcomes offers a promising model for higher education ethics programs seeking to connect classroom learning in ethics to decision-making in everyday life. The article begins with a review of the structural differences between act consequentialist theories and human rights theories, as illustrated by Amartya Sen's paradox of the Paretian liberal and Robert Nozick's utilitarianism of rights. It discusses attempts to resolve those structural differences by moving to a second-order or indirect consequentialism, illustrated by J.S. Mill and Derek Parfit. It presents consequentialist (though not utilitarian) interpretations of the contractualist theories of Jürgen Habermas and the early John Rawls (Theory of Justice) and of (...) the capability theories of Sen and Martha Nussbaum. It also discusses two roles that well-being or a surrogate for well-being typically plays in theories of human rights: (a) well-being plays a role in the justification of at least some exceptions to human rights principles; and (b) some human rights seem to be best understood as rights to some level of well-being or expected well-being (or of a surrogate for one of them). It reviews two consequentialist challenges to the moral adequacy of non-consequentialist accounts of human rights, one based on a duty to relieve suffering and the other generated by Parfit's Non-Identity Problem, and concludes with a contrast between two ways of looking at the history of the development and implementation of human rights conventions and laws. I argue that several recent criticisms Lopez Frias has made against my conventionalist version of broad internalism fail to hit their mark. I further argue that the author's use of Habermas's account of discourse ethics to make his criticisms also misfires because Habermas expressly warned against using his account to resolve normative conflicts that arise from the often conflicting ways different communities order their ethical lives, to include their athletic lives. My main aim in responding to Lopez Frias was to (...) bring critical attention to the normative difficulties that result when we cannot agree on how sport should be done because we cannot agree on what is/are the purpose of sport. This reexamination of documents purporting to show that Henry of Ghent served on a commission of 16 theologians that compiled the 219 articles condemned in 1277 produces a different picture. It shows that Henry did not serve on a special commission appointed by bishop Tempier but was present at a meeting of all masters, who condemned the articles. It also shows that Tempier did not bypass masters in the faculty of theology, but had them vote on the articles.

In an adaptive clinical trial , key trial characteristics may be altered during the course of the trial according to predefined rules in response to information that accumulates within the trial itself. In addition to having distinguishing scientific features, adaptive trials also may involve ethical considerations that differ from more traditional randomized trials. Better understanding of clinical trial experts’ views about the ethical aspects of adaptive designs could assist those planning ACTs. This article deals with a mosaic from ancient Zeugma on the Euphrates found in 2002 and recently published with interpretive commentary. Its subject is the story of Theonoe and Leukippe preserved only in Hyginus and nowhere in Greek. Despite this, the authors argue that the myth, in its unique form, can for over one thousand years be connected with romance, mime, pantomime, tragedy and derives ultimately from early Cretan rituals of transvestism. Its immediate inspiration however is imperial pantomime along with (...) the transvestism notorious in that genre, as can be argued from the layout of the mosaic and the iconography of Theonoe, our first clear picture of a pantomime. But the main thrust of the article, especially in appendix B, is to demonstrate that the Hyginus story must now be considered to represent the plot of a lost tragedy, which derived many of its elements from late Euripides, but in its over-enthusiasic use of these represents a post-Euripidean artificially complex plot-type, for which hitherto we had limited evidence. In fact, some believe that Internet surveying and electronic data collection may revolutionize many disciplines by allowing for easier data collection, larger samples, and therefore more representative data. However, others are skeptical of its usability as well as its practical value.
