In Between Facts and Norms Jürgen Habermas works out the legal and political implications of his Theory of Communicative Action, bringing to fruition the project announced with his publication of The Structural Transformation of the Public Sphere in 1962. This new work is a major contribution to recent debates on the rule of law and the possibilities of democracy in postindustrial societies, but it is much more.The introduction by William Rehg succinctly captures the special nature of the work, noting (...) that it offers a sweeping, sociologically informed conceptualization of law and basic rights, a normative account of the rule of law and the constitutional state, an attempt to bridge normative and empirical approaches to democracy, and an account of the social context required for democracy. Finally, the work frames and caps these arguments with a bold proposal for a new paradigm of law that goes beyond the dichotomies that have afflicted modern political theory from its inception and that still underlie current controversies between so- called liberals and civic republicans.The book includes a postscript written in 1994, which restates the argument in light of its initial reception, and two appendixes, which cover key developments that preceded the book.Habermas himself was actively involved in the translation, adapting the text as necessary to make it more accessible to English-speaking readers. It is well known that the probabilistic relation of confirmation is not transitive in that even if E confirms H1 and H1 confirms H2, E may not confirm H2. In this paper we distinguish four senses of confirmation and examine additional conditions under which confirmation in different senses becomes transitive. We conduct this examination both in the general case where H1 confirms H2 and in the special case where H1 also logically entails H2. Based on these analyses, we argue that (...) the Screening-Off Condition is the most important condition for transitivity in confirmation because of its generality and ease of application. We illustrate our point with the example of Moore’s “proof” of the existence of a material world, where H1 logically entails H2, the Screening-Off Condition holds, and confirmation in all four senses turns out to be transitive. The Perceptual Hypothesis is that we sometimes see, and thereby have non-inferential knowledge of, others' mental features. The Perceptual Hypothesis opposes Inferentialism, which is the view that our knowledge of others' mental features is always inferential. The claim that some mental features are embodied is the claim that some mental features are realised by states or processes that extend beyond the brain. The view I discuss here is that the Perceptual Hypothesis is plausible if, but only if, the mental features (...) it claims we see are suitably embodied. Call this Embodied Perception Theory. I argue that Embodied Perception Theory is false. It doesn't follow that the Perceptual Hypothesis is implausible. The considerations which serve to undermine Embodied Perception Theory serve equally to undermine the motivations for assuming that others' mental lives are always imperceptible. (shrink)

Divine Nature and Human Language is a collection of twelve essays in philosophical theology by William P. Alston, one of the leading figures in the current renaissance in the philosophy of religion. Using the equipment of contemporary analytical philosophy, Alston explores, partly refashions, and defends a largely traditional conception of God and His work in the world a conception that finds its origins in medieval philosophical theology. These essays fall into two groups: those concerned with theological language and those (...) that deal with the nature, status, and activity of God. In Part 1, Alston develops a conceptual scheme for discussing the topic of theological language. He also argues that there is a core of literal talk about God and even a core of predicates univocally applicable to God and creatures. Furthermore, he shows that God can be referred to directly as well as descriptively. In Parts II and III, the author sketches out a middle way between a classical conception of God exemplified by Aquinas and the more recent “process” or “panentheist” conception exemplified by Hartshorne. Alston argues that such a God can act so as to have real effects in the world and can enter into genuine dialogue and otherwise interact with human beings. In addition, he defends the idea that God provides a foundation for morality. The first collection of Alston's ground breaking work in the philosophy of religion, Divine Nature and Human Language will be welcomed by scholars and students of the philosophy of religion, metaphysics, theology, and religious studies. The background of these remarks is that in 1967, in ‘’Constructive reasoning” [27], I sketched an argument that finitist arithmetic coincides with primitive recursive arithmetic, P RA; and in 1981, in “Finitism” [28], I expanded on the argument. But some recent discussions and some of the more recent literature on the subject lead me to think that a few further remarks would be useful.

This article highlights sympathies between Wang Yangming's notion of zhenzhi (real knowing) and Stanley Cavell's concept of acknowledgment. I begin by noting a problem in interpreting Wang on the unity of knowing and acting, which leads to considering how our suffering pain figures in our “real knowing” of another's pain. I then turn to Cavell's description of a related problem in modern skepticism, where Cavell argues that knowing another's pain requires acknowledging it. Cavell's concept of acknowledgment answers to Wang's insistence (...) that knowing and acting are one, and corrects Antonio Cua's very different appropriation of “acknowledgment” to explain Wang's doctrine. William Rothman argues that the driving force of Hitchcock's work was his struggle to reconcile the dark vision of his favorite Oscar Wilde quote, "Each man kills the thing he loves," with the quintessentially American philosophy, articulated in Emerson's writings, that gave classical Hollywood movies of the New Deal era their extraordinary combination of popularity and artistic seriousness. A Hitchcock thriller could be a comedy of remarriage or a melodrama of an unknown woman, both Emersonian genres, except for the (...) murderous villain and godlike author, Hitchcock, who pulls the villain's strings -- and ours. Because Hitchcock believed that the camera has a murderous aspect, the question "What if anything justifies killing?," which every Hitchcock film engages, was for him a disturbing question about his own art. Tracing the trajectory of Hitchcock's career, Rothman discerns a progression in the films' meditations on murder and artistic creation. This progression culminates in _Marnie _(1964), Hitchcock's most controversial film, in which Hitchcock overcame his ambivalence and fully embraced the Emersonian worldview he had always also resisted. Reading key Emerson passages with the degree of attention he accords to Hitchcock sequences, Rothman discovers surprising affinities between Hitchcock's way of thinking cinematically and the philosophical way of thinking Emerson's essays exemplify. He finds that the terms in which Emerson thought about reality, about our "flux of moods," about what it is within us that never changes, about freedom, about America, about reading, about writing, and about thinking are remarkably pertinent to our experience of films and to thinking and writing about them. He also reflects on the implications of this discovery, not only for Hitchcock scholarship but also for film criticism in general. (shrink)

The German Stranger provides a guide to Leo Strauss that situates his thought in the context of National Socialism; by destroying any middle ground between 'Athens' and 'Jerusalem, ' Strauss undermined modernity's secular bulwark against political theology. Once National Socialism is understood as an atheistic religion re-enacted by post-Revelation 'philosophers, ' the German avatar of Plato's Athenian Stranger can be recognized as its principal theoreticia.

Emilsen, William W On the cusp of the Second Vatican Council the distinguished American Lutheran historical theologian, Jaroslav Pelikan, then at the University of Chicago, published a groundbreaking volume titled The Riddle of Roman Catholicism. In this book Pelikan gave a sympathetic yet critical examination of the evolution of Roman Catholicism, its distinctive beliefs and, most importantly, he offered a discussion of the theological issues Protestants face in their conversations with Roman Catholics on Christian unity. The Riddle of Roman (...) Catholicism met an obvious need. It was quickly reprinted by Abingdon Press in the United States and published by Hodder and Stoughton in Great Britain the following year. It was also widely acclaimed in both the Protestant and Catholic presses. The Christian Century magazine, representing the voice of mainstream Protestantism in America, published excerpts from the book claiming that it 'sets the stage for realistic discussion of Christendom's sad divisions'. The Presbyterian theologian and ecumenist from Princeton, John A. Mackay, reviewed it in Theology Today as an 'outstanding book', 'the most significant to appear on Roman Catholicism in many years'. Daniel Walther, professor of church history at the Seventh-day Theological Seminary at Andrews University in Michigan extolled Pelikan's book as 'a significant omen of the new Protestant approach', one that attempted 'to end the "hot war" between the confessions'. Catholic scholars, too, were receptive. Bonaventure Schepers's review in the Thomist, for example, thanked Pelikan for his 'courage and honesty' and invited the journal's readers 'to rejoice with us at the appearance of his important work'. Gustave Wiegel's lengthy review in the Jesuit review, America, named it as 'probably the most important' of the many interesting Protestant studies of Roman Catholicism at the time. Although Pelikan was still a relatively young scholar at the time, The Riddle of Roman Catholicism established him as a serious thinker on the topic of Christian unity. (shrink)

Neste artigo, pretendo discutir o problema da vida em Schopenhauer a partir da perspectiva de sua metafísica da natureza, que implica uma concepção teleológica da evolução das formas de manifestação da vontade segundo uma hierarquia de seus graus de objetivação. Meu ponto de partida é a fórmula schopenhaueriana mediante a qual o autor apresenta sua concepção básica acerca da essência de todo fenômeno: a “vontade de vida”. Investigarei se e em que medida a noção de vida que encontramos em sua (...) filosofia da natureza, a partir do conceito de “força vital”, o compromete ou ao menos o aproxima de uma posição que podemos chamar de vitalista, e isso com base na distinção entre três sentidos e graus de abrangência que podemos atribuir a uma tal posição: desde uma posição menos onerosa do ponto de vista metafísico e mais moderada no que diz respeito às suas pretensões, a uma posição mais radical, estrita, universalista e metafisicamente mais robusta. O trabalho que se segue é a primeira parte de um estudo sobre o problema da vida e da força vital em Schopenhauer, que será continuado numa segunda parte. (shrink)

Abstract As there are food gluttons, so there are energy gluttons. One difference is that energy gluttons are typically oblivious to how much energy they consume and the source of that energy. Their energy gluttony is a side effect of insatiable desire for material goods, which themselves are often associated with social status. Nonetheless, steps taken to deal with energy gluttony parallel those taken with food gluttony. Typically these fall into three categories: educational, political, and technological. I will examine a (...) fourth, however, best characterized as philosophical. I will show how, by following the advice of the ancient Stoics and training ourselves to care less what others think of us, we can help overcome our desire for social status, resulting in a reduction in our desire for material things and a significant reduction in our personal energy bill. The pessimistic conclusion, however, is that most people are probably unwilling to undergo the self-analysis and self-transformation that this philosophical approach requires. (shrink)
