Traditionally, physicians and parents made decisions about children’s health care based on western practices. More recently, with legal and ethical development of informed consent and recognition for decision making, children are becoming active participants in their care. The extent to which this is happening is however blurred by lack of clarity about what children — of diverse levels of cognitive development — are capable of understanding. Moreover, when there are multiple surrogate decision makers, parental and professional conflict can arise concerning (...) children’s ‘best interest’. Giving children a voice and offering choice promotes their dignity and quality of life. Nevertheless, it also presents with many challenges. Case studies using pseudonyms and changed situational identities are used in this article to illuminate the complexity of ethical challenges facing nurses in end-of-life care with children and families. Concern for human vulnerability seems to be at the heart of bioethical inquiry, but the concept of vulnerability is under-theorized in the bioethical literature. The aim of this article is to show why bioethics needs an adequately theorized and nuanced conception of vulnerability. We first review approaches to vulnerability in research ethics and public health ethics, and show that the bioethical literature associates vulnerability with risk of harm and exploitation, and limited capacity for autonomy. We identify some of the challenges (...) emerging from this literature: in particular, how to reconcile universal human vulnerability with a context-sensitive analysis of specific kinds and sources of vulnerability; and how to reconcile obligations to protect vulnerable persons with obligations to respect autonomy. We then briefly survey some of the theoretical resources available within the philosophical literature to address these challenges, and to assist in understanding the conceptual connections between vulnerability and related concepts such as harm, exploitation, needs, and autonomy. We also sketch out a taxonomy of sources and kinds of vulnerability. Finally, we consider the implications for policy evaluation of making vulnerability an explicit and central focus of bioethics. Our investigation is in the form of a broad survey motivating a research agenda rather than a detailed analysis. (shrink)

This article addresses four hypotheses: (a) that corporate social responsibility (CSR) in Asia is not homogeneous but varies among countries, (b) that the variation is explained by stages of development, (c) that globalization enhances the adoption of CSR in Asia, and (d) that national business systems structure the profile of multinational corporations’ CSR. These hypotheses are investigated through analysis of Web site reporting of 50 companies in seven Asian countries: India, Indonesia, Malaysia, the Philippines, South Korea, Singapore, and Thailand. The (...) article concludes that CSR does vary considerably among Asian countries but that this variation is not explained by development but by factors in the respective national business systems. It also concludes that multinational companies are more likely to adopt CSR than those operating solely in their home country but that the profile of their CSR tends to reflect the profile of the country of operation rather than the country of origin. Biomedical innovation and translation are increasingly emphasizing research using “big data.” The hope is that big data methods will both speed up research and make its results more applicable to “real-world” patients and health services. While big data research has been embraced by scientists, politicians, industry, and the public, numerous ethical, organizational, and technical/methodological concerns have also been raised. With respect to technical and methodological concerns, there is a view that these will be resolved through sophisticated information technologies, predictive algorithms, (...) and data analysis techniques. While such advances will likely go some way towards resolving technical and methodological issues, we believe that the epistemological issues raised by big data research have important ethical implications and raise questions about the very possibility of big data research achieving its goals. Taking its cue from sign languages, this paper pulls together a range of studies to support the proposal that the recruitment and composition of body actions counts as evidence for linguistic properties. Adopting the view that compositionality is the foundational organizing property of language, we find first that actions of the hands, face, head, and torso in sign languages directly reflect linguistic components, as well as certain aspects of compositional organization among them that are common to all languages, signed and (...) spoken. Work on emerging sign languages strengthens the approach by showing that the gradual recruitment of bodily articulators for linguistic functions directly maps the way in which a new language increases in complexity over time. While compositional communication is almost exclusively restricted to humans, it is not restricted to language. In the spontaneous, intense emotional displays of athletes, different emotional states are correlated with actions of particular face and body features and feature groupings, indicating a much more ancient compositional foundation for language. In an Appendix to his Analyses Concerning Passive and Active Synthesis dating from the early 1920s, Husserl makes the startling assertion that, unlike the mundane ego, the transcendental ego is immortal. The present paper argues that this claim is an ineluctable consequence of Husserl’s relentless pursuit of the ever deeper levels of time-constituting consciousness and, at the same time, of his increasing reliance on Leibniz’s model of monads as the true unifiers of all things, including minds. There are many structural (...) and substantive parallels between Leibniz’s monadic scheme and Husserl’s later views on the primal ego, and these points of convergence are laid out step by step in this paper. For both theorists, the monad is a self-contained system of being, one “without windows”; a monad’s experiences unfold in harmonious concatenations; a monad is a mirror of its proximate environs and comprises multiple perspectives; the unconscious is a repository of potential activation; and, most importantly of all, a monad knows no birth and death and hence is immortal. In his very last years, Husserl proposed a third ego level, below (or beyond) the mundane ego and transcendental ego - the primal ego. It is neither psychical nor physical; it permits the transcendental ego to carry out its constitutive activities, including the mundane ego’s birth and death in time; it is always in a process of becoming, and so it can never be in a state of only “having-been”, that is, dead: and hence the primal ego’s enduring cannot itself ever come to an end. When nurses have active and untreated addictions, patient safety may be compromised and nurse-health endangered. Genuine responses are required to fulfil nurses' moral obligations to their patients as well as to their nurse-colleagues. Guided by core elements of relational ethics, the influences of nursing organizational responses along with the practice environment in shaping the situation are contemplated. This approach identifies the importance of consistency with nursing values, acknowledges nurses interdependence, and addresses the role of nursing organization as moral agent. In his reflections on his adolescent theft of a neighbor’s pears, Augustine first claims that he did it just because it was wicked. But he then worries that there is something unacceptable in that claim. Some readers have found in this account Augustine’s rejection of the principle that all voluntary action is done for the sake of some perceived good. I argue that Augustine intends his case to call the principle into question, but that he does not ultimately reject it. (...) His careful and resourceful analysis of the motivations of his theft adds subtlety to his own understanding of voluntary action and allows hirn to introduce an important component of his general account of sin, namely, that it essentially involves prideful self-assertion in imitation of God. On one hand, Chinese consumers are well known for conspicuous consumption and the adoption of luxury products and named brands. On the other hand, they also have a bad reputation for buying counterfeit products. Their simultaneous preferences for two contrasting types of product present a paradox that has not been addressed in the literature. This study attempts to present an explanation of this paradox by examining the effects of traditional Chinese cultural values and consumer values on consumers’ deontological judgment of (...) pirated CDs and the amount of social benefits they perceive they gain from them. We interviewed 300 Hong Kong Chinese consumers, and found that face consciousness increased materialism and risk aversion, thereby producing a favorable deontological judgment of pirated CDs. Face consciousness also has a direct effect on the amount of social benefits perceived in pirated CDs. Both favorable deontological judgment and perceived social benefits contributed to a strong intention to buy pirated CDs. The results are discussed in a cultural perspective. (shrink)

In the WebSurf task, humans forage for videos paying costs in terms of wait times on a time-limited task. A variant of the task in which demands during the wait time were manipulated revealed the role of attention in susceptibility to sunk costs. Consistent with parallel tasks in rodents, previous studies have found that humans preferred shorter delays, but waited longer for more preferred videos, suggesting that they were treating the delays economically. In an Amazon Mechanical Turk sample, we replicated (...) these predicted economic behaviors for a majority of participants. In the lab, participants showed susceptibility to sunk costs in this task, basing their decisions in part on time they have already waited, which we also observed in the subset of the mTurk sample that behaved economically. In another version of the task, we added an attention check to the wait phase of the delay. While that attention check further increased the proportion of subjects with predicted economic behaviors, it also removed the susceptibility to sunk costs. These findings have important implications for understanding how cognitive processes, such as the deployment of attention, are key to driving re-evaluation and susceptibility to sunk costs. (shrink)

Various analytical tools originally developed for theories of mechanistic explanation have recently been imported into the ongoing debate on the hypothesis of extended cognition. One such tool that appears particularly relevant to that debate is Craver’s mutual manipulability account of constitution, most of all because it promises to settle the debate on experimental grounds. This paper investigates whether it is possible to deliver on that promise. We first find that, far from grounding an experimental evaluation of HEC, MM is conceptually (...) incompatible with both internalist and externalist accounts of cognition. Next, we propose a suitable modification of MM, MM*, but it turns out that MM* presupposes rather than produces clarity on the extension of cognition. Moreover, subject to MM* the inference to constitution is radically empirically underdetermined. Finally, we argue that our results can be generalized and conclude that, for principled reasons, it is impossible to experimentally determine whether cognitive processes have extracerebral constituents. Determining the extension of cognition is an inherently pragmatic matter. (shrink)

The Trafficking Victims’ Protection Act of 2000 has been presented as an important tool in combatingthe exploitation and abuse of undocumented workers, especially those forced into prostitution. Through a close reading of the legislation and the debates surrounding its passage, this article argues that the law makes strategic use of anxieties over sexuality, gender, and immigration to further curtail migration. The law does so through the use of misleading statistics creating a moral panic around “sexual slavery,” through the creation of (...) a gendered distinction between “innocent victims” and “guilty migrants,” and through the demand that aid to victims be tied to their willingness to assist in the prosecution of traffickers. As a result, the legislation is less a departure from, than of a piece with, other recent antisex and antiimmigrant policies. (shrink)

There is growing interest in the role of new urban agriculture models to increase local food production capacity in cities of the Global North. Urban rooftop greenhouses and hydroponics are examples of such models receiving increasing attention as a technological approach to year-round local food production in cities. Yet, little research has addressed the unintended consequences of new modes of urban farming and food distribution, such as increased competition with existing peri-urban and rural farmers. We examine how small-scale farmers perceive (...) and have responded to a recently established rooftop greenhouse and online marketplace enterprise in Montréal, Canada. Drawing on interviews with key informants and small-scale farmers, we find that peri-urban and rural producers have been affected in three key ways that represent tensions, adaptations, and synergies arising from this new urban agriculture and food distribution enterprise. First, many farmers are concerned about increased competition and value conflation with the ideals of community supported agriculture and organic farming. Second, some farmers have adapted by developing novel marketing strategies and working with local bridge organizations to collectively market their produce to urban consumers. Third, a few farmers have decided to wholesale their produce to this new enterprise, allowing them to specialize production and avoid marketing their produce directly to urban consumers. Our study suggests that the emergence of a new form of alternative food network in Montréal has created both positive and negative disruptions for existing small-scale producers. Advocates for the expansion of new urban food production and distribution models should therefore give greater consideration to the effects on other actors in the local food system. (shrink)

This book makes a novel contribution to our understanding of Romance SE constructions by combining both diachronic and synchronic theoretical perspectives along with a range of empirical data from different languages and dialects. The collection, divided into four sections, proposes that SE constructions may be divided into one class that is the result of grammaticalization of a reflexive pronoun up the syntactic tree, from Voice and above, and another class that has resulted from the reanalysis of reflexive and anticausative morphemes (...) as an argument expletive or verbal morpheme generated in positions from Voice and below. The contributions, while varied in both empirical content and theoretical approach, all serve to highlight different aspects of the overarching idea that SE constructions have evolved from these two distinct grammaticalization paths. The book appeals to researchers and academics in the field and closes with a unified approach to various SE constructions that makes important use of its status as a verbal morpheme. In addition to aligning a novel string of empirical contributions under a new theoretical umbrella, a clear research direction emerges from this volume based on the morphosyntactic nature of SE itself: Is it a clitic, an agreement morpheme, or a verbal morpheme? It’s a commonplace that Federal Reserve chairman Ben Bernanke draws his policies from Milton Friedman and Anna Schwartz’s A Monetary History of the United States. With that in mind, this article establishes five points. First, contrary to conventional wisdom, Friedman and Schwartz merely insinuate their claim the Fed caused the Depression in MH. Second, their criticisms of Fed policy during the Depression, which turn on its refusal to adopt open market purchases, repudiate Friedman’s famed libertarianism and market fundamentalism. Third, Friedman (...) and Schwartz don’t refute the practical objections of bankers who opposed OMPs in the 1930s. Consequently, Bernanke’s policies for addressing the financial crisis risk doing precisely what Friedman’s targets warned against—encouraging financial speculation without addressing problems of unemployment. Fourth, Friedman and Schwartz’s prescriptions entail a neoliberal, not a libertarian, state, one governed by technocrats and answerable to financial markets. Finally, what accounts for and unifies Friedman’s contradictions is the beneficiary—finance. (shrink)

Before asking what U.S. bioethics might learn from a more comprehensive and more nuanced understanding of Islamic religion, history, and culture, a prior question is, how should bioethics think about religion? Two sets of commonly held assumptions impede further progress and insight. The first involves what “religion” means and how one should study it. The second is a prominent philosophical view of the role of religion in a diverse, democratic society. To move beyond these assumptions, it helps to view religion (...) as lived experience as well as a body of doctrine and to see that religious differences and controversies should be welcomed in the public square of a diverse democratic society rather than merely tolerated. Over the last decade, scandals within the UK Financial Service sector have impacted their legitimacy and raised questions whether a compliance culture exists or not. Several institutional changes at the regulatory and normative levels have targeted stakeholders’ concerns regarding compliance culture and led to changes in the legitimation process. This paper attempts to address a gap in the literature by asking the following question: How is the UK financial institutions’ compliance culture shaped by the institutional environment and changing legitimacy claims? (...) Towards achieving this objective, the paper draws on the institutional theory and pays attention to the various configurations of the legitimacy notion :451–478; 2017). The paper utilises a longitudinal interpretive design and undertakes a qualitative content analysis of fines issued by the UK regulator and the communicated response of violating firms as well as non-sanctioned firms. Our findings indicate that there is a cyclical ‘evolutionary compliance’ rather than the more widely recognised state of ‘compliance culture’. This culture is fuelled by interchangeable isomorphic forces where the majority of violating firms are seen to issue similar responses to the regulators sanction to maintain their reputation and legitimacy in the market. Notably, legitimacy is now defined within an interactive process between the regulator and firms rather than being static and achieved by ticking the box. (shrink)

Proclaimed the “greenest television programme in the world,” the award-winning soap opera Coronation Street is seen as an industry success story. This paper explores how the integration of carbon literacy training led to a widespread transformational change of practice within Coronation Street. Using the theoretical lens of Communities of Practice, this study examines the nature of social learning and the enablers and barriers to change within the organization. Specifically, how boundary spanning practices, objects and people led to the transformation on (...) both a personal and group level. Based on a qualitative analysis of 22 interviews with Heads of Departments and other staff, the paper argues that CLT is a boundary practice which has evolved into a boundary spanning CoP. The importance of infrastructures supporting boundary objects and practices is highlighted as reinforcers of the CLT, both as a boundary object and a community, with the “ultimate” boundary spanning object being the show. A significant enabler in social learning and change in practice is the creation of discursive and creative space, both within CoP and across the boundaries. Findings also highlight the role of “self” in the process of social learning and organizational change. Distinct patterns emerged in the relationship between self-identity, social learning and change across a range of boundary objects, practices and communities both in the CLT and CoP. This suggests that in a diverse social learning setting such as CLT there are different transformational catalysts within the CoP and these identities can influence how knowledge is translated into practice. RationaleSurrogates of critically ill patients often have inaccurate expectations about prognosis. Yet there is little research on how intensive care unit clinicians should discuss prognosis, and existing expert opinion-based recommendations give only general guidance that has not been validated with surrogate decision makers.ObjectiveTo determine the perspectives of key stakeholders regarding how prognostic information should be conveyed in critical illness.MethodsThis was a multicenter study at three academic medical centers in California, Pennsylvania, and Washington. One hundred eighteen key stakeholders completed in-depth semistructured (...) interviews. Participants included 47 surrogates of adult patients with acute respiratory distress syndrome; 45 clinicians working in study ICUs, including physicians, nurses, social workers, and spiritual care providers; and 26 experts in health communication, decision science, ethics, family-centered care, geriatrics, healthcare disparities, palliative care, psychology, psychiatry, and critical care.Measurements and main resultsThere was broad support among surrogates for existing expert recommendations, including truthful prognostic disclosure, emotional support, tailoring the disclosure strategy to each family's needs, and checking for understanding. In addition, stakeholders offered suggestions that add specificity to existing recommendations, including: In addition to conveying prognostic estimates, clinicians should help families "see the prognosis for themselves" by showing families radiographic images and explaining the clinical significance of physical manifestations of severe disease at the bedside. Many physicians did not support using numeric estimates to convey prognosis to families, whereas many surrogates, clinicians from other disciplines, and experts believed numbers could be helpful. Clinicians should conceptualize prognostic communication as an iterative process that begins with a preliminary mention of the possibility of death early in the ICU stay and becomes more detailed as the clinical situation develops. Although prognostic information should be initially disclosed by physicians, other members of the multidisciplinary team-nurses, social workers, and spiritual care providers-should be given explicit role responsibilities to reinforce physicians' prognostications and help families process a poor prognosis emotionally.ConclusionsFamily members, clinicians, and experts identified specific communication behaviors that clinicians should use to discuss prognosis in the critical care setting. These findings extend existing opinion-based recommendations and should guide interventions to improve communication about prognosis in ICUs. (shrink)

The ultimate causes of sex differences in human aggressive behavior can lie mainly in evolved, inherited mechanisms that differ by sex or mainly in the differing placement of women and men in the social structure. The present commentary contrasts Campbell's evolutionary interpretation of aggression sex differences with a social structural interpretation that encompasses a wider range of phenomena.

In several avenues of contemporary research, much attention is devoted to the contrast between the real authority of institution and their formal power, in the analysis of institutional funtionings; also in the study of the relationships between institutions on the one hand, rules, principles or norms on the other hand. Such a contrast appears to be based on familiar observations: the capacity of institutions to get their preferred outcomes is sometimes loosely connected with the hierarchical prerogatives of the considered institutions. (...) More particularly, current studies of the „migration authority” bring out possible shitts in real authority while there is no changein the formal structure of power. This article will partly consist in the explanation of recent results of common reaserch in project „Delicom”, in which a formal treatment of the distinction has been put foward. This approach will be set against the background of recent contributions in political science or economics. Some concerns raised by gender violence have been taken up by churches and individuals within them over the last ten years or so, but now the World Council of Churches has set up a project to work specifically on Overcoming Violence Against Women. The project has a three-fold task aimed at enabling constructive engagement with the issue of gender violence: to support and encourage the churches' to develop a network of concerned theologians; to establish an accessible resource base. The prevalence (...) of violence against women in all parts of society, including churches and Christian communities, raises theological questions. Some areas of language, doctrine and the interpretation of Scripture need to be examined and perhaps reconsidered, to provide theologies consistent with churches as communities of safety, respect and justice for women. This article examines changes in the conception of political power after Michel Focault. It suggests that while Focault has politicized certain practices and knowledge fields that were previously insulated from inquiry into the interests shaping them, such politicization need not be conflated with political life tout court. It argues that Foucault's formulations of power, and especially of government and governmentality, have made this distinction extremely difficult. However, rather than giving up the distinction on the one hand, or rejecting Foucault's problematization (...) of it on the other, political theory after Foucault is faced with the task of delineating it anew. This article examines how organizational context shapes the way gender is socially constructed in two non-Judeo-Christian religious organizations in the United States, one Theravada Buddhist organization founded by immigrants and one started by converts. People at the two organizations disagree with each other about what Theravada Buddhism teaches about women in teaching and leadership positions but agree that outside of these positions, women and men are equally able to gain access to and practice the tradition. Despite these understandings, women and (...) men have distinct gender roles and responsibilities at each organization that are in tension with what the leaders and attendees understand the tradition to teach. The extent to which teachers and attendees recognize these tensions and the ways they respond to them are explored, and their implications for each organization and for studies of gender and religious organizations are discussed. Women in the business school are beginning to assume characteristics that will prove both ineffective and detrimental in the workplace. This paper seeks to present a framework for understanding these changes as well as their implications. We present several testable hypotheses as well as suggestions for easing the tensions felt by women in business settings.
