Der Begriff »Race«, aus den universitären Kulturwissenschaften stammend, will unbewusste Rassifizierungsprozesse beschreiben, die wir unweigerlich vornähmen und denen wir zugleich ausgesetzt seien. Der vorliegende Beitrag will diesen Begriff für Psychoanalyse und Psychotherapie fruchtbar machen. Zwei Fallvignetten illustrieren, welche Fallstricke für Psychoanalytiker und Patienten bereit lägen, wenn »Race« in Übertragung und Gegenübertragung verleugnet werden müsse. Tauchen negativ konnotierte »racial« Phantasien auf, könne die Angst, rassistisch zu denken oder zu agieren, zum Stillstand und sogar Scheitern einer Behandlung führen. Da rassifizierte Projektionen nach (...) Ansicht der Autorin unvermeidbar seien, sieht sie die Entstehung des Gefühls einer »racial Melancholia« als Möglichkeit, dem drohenden Stillstand entgegenzuwirken. (shrink)

Dieser Beitrag untersucht, was es heißt, verwundet zu leben. Was auf den ersten Blick als eine mehr als gewöhnliche und kaum spektakuläre Frage erscheinen mag, wird nach Untersuchung der dominanten Phantasmen der Unverletzlichkeit als eine Grundfrage der historischen Anthropologie erkennbar: Wie entsteht und wandelt sich der tägliche Umgang mit eigener Verletzlichkeit und Verwundung im Menschenbild? Welche Wunden des Gewöhnlichen werden in den meisten Lebens- und Arbeitsumgebungen im Allgemeinen ignoriert und ausgeblendet? Worin bestehen die Idiosynkrasien eines empfindsamen Leibes, eines sensorisches Corpus? (...) Und in welchem Zusammenhang stehen die Begehren eines bestimmten Menschen zu seinen Wunden? Eine Körperanthropologie der Wunden bezieht die Verletzungen eines Menschen im Laufe seines Lebens als integraler Teil eines Menschenbildes mit ein. (shrink)

The Draft Common Frame of Reference is just published. Now the creation of the final Common Frame of Reference is one of the most important issues in the field of European Private Law. The volume discusses the key question as to what extent the CFR can and should reflect existing EC Contract Law, and to what extent the DCFR has already incorporated the acquis communautaire. The contributions to this volume try to provide answers to this question by analyzing different controversial (...) areas such as the conclusion and content of the contract, non-performance, remedies, damages and the relation to International Private Law. Aumann and Serrano :810–836, 2008) introduce the axiom of duality, which ensures that risk measures respect comparative risk aversion. This paper characterizes all dual risk measures by a simple equivalent condition. This equivalence provides a decomposition result and a construction method, which is used to analyze concrete dual measures. Moreover, this paper aims to extend this characterization to the most general setting. Compared with Aumann and Serrano, it, therefore, relaxes the axiom of positive homogeneity, and allows for risk-neutral and risk-seeking (...) agents, as well as for all integrable gambles. (shrink)

In October 2008 the European Commission published its Proposal for a Consumer Rights Directive which puts forward far-reaching changes to the core of consumer contract law: Four current directives are to be replaced by a new, overarching piece of legislation and in doing so full harmonisation for the most part is to take the place of the minimum standard presently in force in the EU. Although a welcome initiative, the extent and possible effects of the Proposal have certainly brought a (...) number of issues to the fore. In January 2009, legal experts from universities, practice and the civil service met to address the points raised by the Proposal and the question of the extent to which it can indeed contribute to the modernisation and harmonisation of European consumer contract law. The papers presented at this conference analysed, criticised and suggested improvements for the Proposal and are published in this volume. (shrink)

To Shoot Photographs of Tutankhamun – The Making of an Exhibition Star. In the 1970s, the exhibition “Treasures of Tutankhamun” toured the world. It still ranks today amongst the most popular museum exhibitions of all time. This article explores photography used in the catalogue of this blockbuster exhibition in the USA and West Germany; it describes how the pictures of Tutankhamun's objects, which were made by a team from the Metropolitan Museum in New York, introduced a significantly new and different (...) approach to catalogue photography. Until the 1960s, Ancient Egyptian artefacts had been documented by means of bare frontal or profile images in black and white; their close‐grained, accurately shaded quality allowed the objects to be investigated independently of the viewer's location. The high gloss colour images of the 1970s, however, instead sought to lend the objects something a photograph could not normally achieve: a palpable presence. They captured sensational traces, creating star items that one “just had to see for oneself”. In other words, the article presents how catalogue photos were able to participate in the creation of star objects and therefore also contributed to the exhibition's enormous success. The historical background behind the rise of this sensational photography in the 1960s and 1970s will be discussed and framed theoretically. In showing how photography played an important role in transforming the objects taken from Tutankhamen's tomb, it argues that mobilising museum objects through media can induce (semiotic and material) transformations of objects.
