In the world of philosophy of science, the dominant theory of confirmation is Bayesian. In the wider philosophical world, the idea of inference to the best explanation exerts a considerable influence. Here we place the two worlds in collision, using Bayesian confirmation theory to argue that explanatoriness is evidentially irrelevant.

In terms of validity in Kripke frames, a modal formula expresses a universal monadic second-order condition. Those modal formulae which are equivalent to first-order conditions are called \emph{elementary}. Modal formulae which have a certain persistence property which implies their validity in all canonical frames of modal logics axiomatized with them, and therefore their completeness, are called \emph{canonical}. This is a survey of a recent and ongoing study of the class of elementary and canonical modal formulae. We summarize main ideas and (...) results, and outline further research perspectives. (shrink)

In this study, W. J. Waluchow argues that debates between defenders and critics of constitutional bills of rights presuppose that constitutions are more or less rigid entities. Within such a conception, constitutions aspire to establish stable, fixed points of agreement and pre-commitment, which defenders consider to be possible and desirable, while critics deem impossible and undesirable. Drawing on reflections about the nature of law, constitutions, the common law, and what it is to be a democratic representative, Waluchow urges a different (...) theory of bills of rights that is flexible and adaptable. Adopting such a theory enables one not only to answer to critics' most serious challenges, but also to appreciate the role that a bill of rights, interpreted and enforced by unelected judges, can sensibly play in a constitutional democracy. The paper develops a conceptual framework for understanding the work of ethical remembrance in the classroom. Using David Hansen’s recent example of using Sebald’s novels in his classroom to do the work or remembrance, the paper argues that the effect of Sebald’s novels is best understood using Walter Benjamin’s figure of the angel of history. That figure indicates a view of history that goes beyond the progression of everyday time, to one called remembrance. The paper suggests that the work of (...) mourning effects such remembrance, but simultaneously points to hope through the emergence of weak messianic power. (shrink)

Even lawyers who obey the law often seem to act unethically--interfering with the discovery of truth, subverting justice, and inflicting harm on innocent people. Standard arguments within legal ethics attempt to show why it is permissible to do something as a lawyer that it would be wrong to do as an ordinary person. But in the view of most critics these arguments fail to turn wrongs into rights. Even many lawyers think legal ethics is flawed because it does not accurately (...) describe the considerable moral value of their work. In Lawyers and Fidelity to Law, Bradley Wendel introduces a new conception of legal ethics that addresses the concerns of lawyers and their critics alike.Wendel proposes an ethics grounded on the political value of law as a collective achievement that settles intractable conflicts, allowing people who disagree profoundly to live together in a peaceful, stable society. Lawyers must be loyal and competent client representatives, Wendel argues, but these obligations must always be exercised within the law that constitutes their own roles and confers rights and duties upon their clients. Lawyers act unethically when they treat the law as an inconvenient obstacle to be worked around and when they twist and distort it to help their clients do what they are not legally entitled to do. A remarkable event occurred at the December 3, 2004, meeting of the U. S. President’s Council on Bioethics. Council member William Hurlbut, a physician and Consulting Professor in the Program in Human Biology at Stanford University, formally unveiled a proposal that he claimed would solve the ethical problems surrounding the extraction of stem cells from human embryos. The proposal would involve the creation of genetically defective embryos that “never rise to the level of integrated organismal existence essential to be designated (...) human life with potential,” and therefore could be used as morally acceptable sources of stem cells for research and therapy. The aim of this essay is to show that Hurlbut’s proposal does not solve the ethical problems associated with human embryonic stem cell research. Two major reasons are presented. First, the proposal, which involves modification of a somatic cell nucleus, suffers from an ethical problem that is common to all types of human genetic engineering: since the procedure is not foolproof, there will be failures. In the case of the procedure Hurlbut proposes, some normal (albeit cloned) embryos will be produced. Second, the embryo engineered in the manner described is, at least in the early stages of its development, fully human despite its genetic defect. This essay also will show how a reasonable person might mistakenly view the proposal as legitimate if he or she makes the error of conflating genetic determinism with Aristotelian teleology. Finally, it will argue that ethical clarity can be achieved by seeing the embryo as a holistic entity possessing emergent properties that cannot simply be spelled out by genes. (shrink)

Military and defense-related procurement has been an important source of technology development across a broad spectrum of industries that account for an important share of United States industrial production. In this book, the author focuses on six general-purpose technologies: interchangeable parts and mass production; military and commercial aircraft; nuclear energy and electric power; computers and semiconductors; the INTERNET; and the space industries. In each of these industries, technology development would have occurred more slowly, and in some case much more slowly (...) or not at all, in the absence of military and defense-related procurement. The book addresses three questions that have significant implications for the future growth of the United States economy. One is whether changes in the structure of the United States economy and of the defense-industrial base preclude military and defense-related procurement from playing the role in the development of advanced technology in the future, comparable to the role it has played in the past. A second question is whether public support for commercially oriented research and development will become an important source of new general-purpose technologies. A third and more disturbing question is whether a major war, or the threat of major war, will be necessary to mobilize the scientific, technical, and financial resources necessary to induce the development of new general-purpose technologies. When the history of United States technology development in the next half century is written, it will focus on incremental rather than revolutionary changes in both military and commercial technology. It will also be written within the context of slower productivity growth than of the relatively high rates that prevailed in the United States in the 1950s and 1960s or during the information technology bubble that began in the early 1990s. These will impose severe constraints on the capacity of the United States to sustain a global-class military posture and a position of leadership in the global economy. (shrink)

This book presents a history of the volitional theory of causation—the philosophical proposal that volition, or will, of the same or broadly the same stamp as that which we experience in our own deliberate and voluntary doings, should be taken as the basis for all causality. Few today know much about the volitional theory of causation, and even fewer have given it any serious attention. But if current opinion regards this suggestion as an unusual one, of minor importance, the historical (...) record shows otherwise, revealing that it is a theory which has been proposed and developed again and again throughout the modern era. Its obscurity is only a recent phenomenon. Starting at the beginning of the Early Modern period and progressing right up modern times, the historical discussion takes in both supporters and critics, as well as both famous and less well-known figures, to tell the story of a long-running debate which contemporary history of philosophy has forgotten. The view that properties have their causal powers essentially, which I will here call property essentialism, has advocates in Chris Swoyer,[1] Sydney Shoemaker [2], Alan Chalmers [3], Brian Ellis [4] and Caroline Lierse [5], among a few other authors in recent literature. I am partial to this view as well and I will shortly explain the grounds I find compelling in favor of it. However, we will also see that the essentialist view of properties and laws does not adequately do (...) quite so much as might be hoped. Property essentialism has the straightforward result that at least causal laws are metaphysically necessary. A natural view of such laws is that they are analyses of the essential nature of basic properties in terms of their essential causal powers. Brian Ellis proposes that conservation laws and other laws that may not be exactly causal are best thought of as characterizing the essential properties of worlds. But this further essentialist thesis is not directly relevant to the issues I want to address here. (shrink)

Computational functionalism [5] fails to understand the embodied and situated nature of behaviour by taking steady state functions as theoretical primitives, and by interpreting cognitive behaviour from a language-like, observer dependant framework without a naturalized normativity. Evolutionary functionalism [28, 27], on the other hand, by grounding functional normativity on historical processes fails to give an account of normative functionality based on the present causal mechanism producing behaviour. We propose an alternative autonomous dynamical framework where functionality is defined as contribution to (...) self-maintenance [15, 10, 35] and normativity as satisfaction of closure criteria. We develop this framework by a set of formal definitions in the framework of dynamical system theory and propose the hypothesis of an homeostatic-plasticity [31, 40] based general purpose value system as an internalized normative mechanism that selects between internal state trajectories to produce adaptive functionality under different environmental conditions. To test the hypothesis we develop a simulation model where lower level specifications of a control arquitecture (an homeostatic plastic DRNN) give rise (through a simulated evolutionary process) to adaptive behaviour in a foraging task where food sources can be poisonous or profitable. Analysis of the evolved agent show that plastic changes occur when the agent produces salient adaptive interactions, those plastic changes determining the adaptive strategy. The embodied and interactive adaptive functionality is dynamically analysed, illustrating the autonomous dynamical framework. (shrink)
