This article examines the possibility of establishing a Department of Peace (DOP) as a Department of the Government of Canada. The topic has been introduced in Parliament twice, as Bill C-447 in 2009 and as Bill C-373 in 2011, without any further actions beyond the formal First Reading. The introduction of the bills could only happen on the basis of significant support among Canadians. At present efforts to introduce the DOP continue, although in somewhat muted form. Based largely on oral (...) interviews, this article assesses the potential for establishing a DOP in the context of the Canadian peace tradition as well as global developments. It concludes that a DOP has great potential to move the peace agenda forward but that, in view of the priorities of the current government and the general mood in Canadian society, it is not realistic to expect a DOP to be implemented at present. From recent work on Ingarden it is apparent that values are central to his philosophy, even in the context of his realist ontology. In this evaluation of Ingarden’s work we consider his principal philosophical notions (i.e. his realist ontology, his aesthetics, his reflections on language, and his consideration of values) in the light of what Nietzsche referred to in his own philosophy as the “reevaluation” or the “inversion” of all values. It is argued that two of Ingarden’s most fundamental values (...) are the notion of communication and the aesthetic dimension of thought. (shrink)

This article presents Nietzsche's notion of the Übermensch (le surhomme in French) as a development of romanticism conceived of as a quest to reveal the sentiment that defines or characterizes each individual as an individual. This approach reveals the affinities between Nietzsche and Schopenhauer, notably with respect to Schopenhauer's notion of Will that Nietzsche transforms into that of the Will to power, thereby underscoring what can be considered as Nietzsche's individualism. We argue that as a romantic notion, the notion of (...) Übermensch fashions an ideal of what life could be but overlooks the importance of otherness and the role that otherness plays in defining the individual. Going beyond Nietzsche implies that the Übermensch, as a logical construct neglects the desire to please that constitutes an important part of an individual's relation with otherness. (shrink)

While belief in gods was almost universal in the ancient world, Thales of Miletus introduced the notion that observed phenomena could be explained in natural terms without invoking imagined spirits. Leucippus and Democritus, and later Epicurus and Lucretius, proposed that everything was composed of particulate atoms in an otherwise empty void. Any gods that existed played no role in the human world. The universe was infinite, eternal, uncreated, and included many worlds besides our own. These ideas conflicted with the other (...) philosophical schools of the time and were suppressed by the Church during the Dark Ages. Atomism reappeared during the Renaissance and became a crucial ingredient in the scientific revolution that followed. The atomic picture of matter has now been solidly confirmed. Furthermore, the notion of an infinite, eternal, and uncreated ‘multiverse’ is strongly suggested by modern cosmology. (shrink)

The story is frequently told about how with the publication of De Revolutionibus Orbium Coelestium (On the Revolutions of the Celestial Spheres) in 1543 Nicolaus Copernicus (d. 1543) looked beyond the vanity of human self-centeredness and perceived that Earth was just one of several planets revolving around the sun. In doing so, he triggered the modern scientific revolution as people began to look at themselves and their place in the universe in a more objective light.

Taking a Harder Line “The New Atheism” is the name that was attached, often pejoratively, to the series of six bestselling books by five authors that appeared in the period 2004-2008.[i] Since then many have joined the movement, with an upsurge in books, freethinker organizations, and an exponential expansion of the blogosphere spreading the word on atheism to thousands. The message of new atheism is that it is time to take a far less accommodating attitude toward religion, including moderate religion, (...) than had been exhibited in previous years by atheist authors and, in particular, non-believing scientists. Science, in the United States, is locked in a battle with conservative Christians over the teaching of evolution and creationism in the schools. While 87 percent of scientists accept evolution by unguided, purely natural processes, only 32 percent of the public does.[ii] Belief in unguided evolution among mainline Protestants and Catholics is about the same as among the general public, while only 10 percent of Evangelicals and 19 percent of Fundamentalist Protestants acknowledge this view. This article empirically analyzes how victims’ remains were recovered, identified, repatriated, and retained after the World Trade Center terrorist attacks of September 11, 2001. It does so by asking the question whose body is it. This question brings to the fore issues related to personhood and ownership: how are anonymous and unrecognizable bodily remains given back an identity; and who has ownership of or custody over identified and unidentified human remains? It is in this respect that the article engages with (...) technoscientific and legal, or “technolegal,” trajectories of human remains in the wake of the WTC tragedy. By using the metaphor of “materialization,” it becomes possible to trace how remains are forensically identified and implicated in legal regimes. “Technolegal materialization” as a concept and methodological sensitivity contributes to the current “actor-network theory” -inspired legal scholarship, which tends to focus on legal practices in courtrooms but not those beyond them. In this article, 9/11 victims’ remains are followed from “Ground Zero” to the forensic laboratory and beyond and articulates five instances of technolegal materialization of bodily remains and their past and contemporary existences. According to Husserl, time represents the general characteristic of all inner experiences (Erlebnisse) of consciousness and the internal time-consciousness is, together with intentionality, one of the two general structures of the pure transcendental consciousness. The problem of the consitution of the objectivity of the knowledge of the world pressuposes as a first level of inquiry exactly the consciousness of time and the detachment of the specific structures of this consciousness. However, the problem of the constitution of time cannot be exhausted (...) throughout a descriptive analysis of the immanent level of consciousness for it asks for a diving to a pre-imanent (pre-subjective) level and requires some procedures which rather belong to what we could call constructive phenomenology. The central point which I am arguing for in this study is that the premise from which Husserl starts in his analysis dedicated to the constitution of time is from the beginning problematic and debatable: that is, consciousness as such would represent the origin of time and that one could reach this origin by following the line of a descriptive analysis. The present contribution has the purpose of evidencing both the originality of Şora’s understanding of time (and its importance for the question of authenticity, empathy and intersubjectivity), and the possibility of a dialogue with Husserl’s understanding of the consciousness of internal time. One of the most important aspects of my paper is the endeavour to bring to light the underlying structure of temporality at work in Mihai Şora’s philosophy. The two forms of temporality present in Şora’s thought – the temporality (...) “of the Moment” and that “of the instances of countable time” – open up the possibility of a phenomenological understanding of time. Some specific terms which Şora uses to describe the two forms of temporality – like the “vertical plunge”, “openness”, “disclosure”, “the gift of Encounter”, “the horizontal walk”, etc. – seem, at least at first, to belong to a poetic language, full of metaphors, a language which doesn’t seem to have much in common with the rigors of a philosophical language, but they nevertheless reveal some fundamental characteristics of the two forms of temporality. The possibility of understanding and interpreting these forms of temporality as structures belonging to the consciousness of time, in a broad sense (which correspond to the fabric of the real word, according to Şora’s ontological model), is another interesting question which will be debated in the present study. In his fifth Logical Investigation, Husserl intensely scrutinizes three possible significations of the concept of consciousness. In these analyses, he also strives to clearly delineate between two types of consciousness: psychological and phenomenological. The goal of this paper is to show that the way in which the (psychical) act is conceived and defined, according to the Husserlian approach, as a lived, intentional experience plays an essential role in clarifying the distinction between the empirical-psychological level of consciousness (where the act as (...) a lived experience manifests itself) and its eidetic or ideal level (wherein any type of objectivity is constituted as such). Moreover, I shall try to argue that the notion of act conceived in this manner had influenced and decisively determined the development of the entire Husserlian phenomenology and theory of knowledge exactly because it explains how knowledge in general is constituted from an objective point of view. Another highly relevant distinction that needs to be dealt with in this context is the difference that Husserl establishes between the descriptive and intentional contents of the act. I shall try to show that this distinction presupposes in fact a previous conceptual determination of the noema (undertaken jointly with the analysis of the noetical components of consciousness at this level), and that the way in which the relationship between these two strands of consciousness is described determines further and in a fundamental manner the development of the idea of intentionality itself. In international commodity transactions, intermediary certifiers of quantity and quality play a crucial role. Sometimes they err, and when they do, the aggrieved party can pursue remedies against the counterparty or against the intermediary, either in contract or tort. The remedy against the intermediary has depended, at least in part, on whether the plaintiff was in privity. Even absent privity, the aggrieved party could possibly recover in tort. So held Cardozo in the leading New York case Glanzer v. Shepard. Section (...) I of this paper reviews the Glanzer litigation, with special emphasis on how the court suppressed many of the significant facts. Section II then turns to restitution by the principals. Section III explores the courts’ general hostility to intermediaries’ attempts to limit their liability by contract, and Section IV considers the judiciary’s sporadic efforts to place extra-contractual limits on intermediaries’ liability.
