This review of Madhav Kkhosla’s book, India’s Founding Moment, sees his approach as one of “best lights” understandings, that is, an effort to identify and explain the conceptual underpinnings of India’s founding constitution in their best lights. Khosla emphasizes as key the ways in which the constitution’s requirements of full adult suffrage, its intense specificity of language, and its strongly centralized government form, all contribute conceptually to the creation of the democratic citizen of India—a citizen whose rights across the country (...) were secured by a common constitution and central government, whose knowledge of and ability to exercise rights were enhanced by the constitution’s codified approach, and a citizen whose capacities to participate in democratic processes would be developed by the exercise of democratic rights. The review focuses attention on choices about suffrage, comparing India’s with the less inclusionary founding impulses of the United States constitution. It explores nuances of how codification would and would not promote exercises of citizenship rights, noting the importance of adjudication in the construction of the “common knowledge” to which the founders aspired. And the review argues that today, as more illiberal, authoritarian regimes are on the rise, the book’s emphasis on the importance of ideas, words, and common knowledge in constructing liberal, democratic politics is of urgent contemporary importance. This comprehensively updated and expanded revision of the successful second edition continues to provide detailed coverage of the ever-growing range of research topics in vision. In Part I, the treatment of visual physiology has been extensively revised with an updated account of retinal processing, a new section explaining the principles of spatial and temporal filtering which underlie discussions in later chapters, and an up-to-date account of the primate visual pathway. Part II contains four largely new chapters which cover recent psychophysical (...) evidence and computational model of early vision: edge detection, perceptual grouping, depth perception, and motion perception. This paper examines the connection between politics and public space at a time when photography and the new media have put the classical distinction between the public and the private into question. My focus is on the body which, according to Hannah Arendt and the classical philosophers, is the most private thing there is. Drawing on the work of Weimar photojournalist Erich Salomon – who was among the first to infiltrate the spaces where political talks were held and decisions taken (...) – I argue for an understanding of the body as an aesthetic object and a site where public and private criss-cross and intersect. The body in photography leads me to the final part of the paper where I trace the figuring of the body in the texts of Plato, Aristotle and the Stoics, and argue that far from being a recent phenomenon, the aestheticisation of politics is already at work in the tradition that celebrates deliberation and the public use of reason. Ethical decision-making frameworks assist in identifying the issues at stake in a particular setting and thinking through, in a methodical manner, the ethical issues that require consideration as well as the values that need to be considered and promoted. Decisions made about the use, sharing, and re-use of big data are complex and laden with values. This paper sets out an Ethics Framework for Big Data in Health and Research developed by a working group convened by the Science, Health and (...) Policy-relevant Ethics in Singapore Initiative. It presents the aim and rationale for this framework supported by the underlying ethical concerns that relate to all health and research contexts. It also describes a set of substantive and procedural values that can be weighed up in addressing these concerns, and a step-by-step process for identifying, considering, and resolving the ethical issues arising from big data uses in health and research. This Framework is subsequently applied in the papers published in this Special Issue. These papers each address one of six domains where big data is currently employed: openness in big data and data repositories, precision medicine and big data, real-world data to generate evidence about healthcare interventions, AI-assisted decision-making in healthcare, public-private partnerships in healthcare and research, and cross-sectoral big data. There is a growing expectation, or even requirement, for researchers to deposit a variety of research data in data repositories as a condition of funding or publication. This expectation recognizes the enormous benefits of data collected and created for research purposes being made available for secondary uses, as open science gains increasing support. This is particularly so in the context of big data, especially where health data is involved. There are, however, also challenges relating to the collection, storage, and re-use (...) of research data. This paper gives a brief overview of the landscape of data sharing via data repositories and discusses some of the key ethical issues raised by the sharing of health-related research data, including expectations of privacy and confidentiality, the transparency of repository governance structures, access restrictions, as well as data ownership and the fair attribution of credit. To consider these issues and the values that are pertinent, the paper applies the deliberative balancing approach articulated in the Ethics Framework for Big Data in Health and Research to the domain of Openness in Big Data and Data Repositories. This paper recommends that experimental analysts of language development abandon for the purposes of experimental inquiry both the term "language" and the concept it designates. In support of this recommendation, the paper dis cusses the multiple meanings of "language," the proposal that "language" refers to behavior, the implicit acceptance by behavior analysts of psycholinguistic thought despite their ostensible rejection of it, and the nature of language as a subject matter. In addition, the nature of common-sense psychology, the domain of behavior (...) analysis, the formal nature of Chomskyan linguistics, and the rela tion between psychology and behavior analysis are discussed. The study draws on life history, literacy studies and ethnographic approaches to exploring social practices as a frame to explore the narratives of two UK adult literacy learners, who provide a description of the value or otherwise of their engagement with a transformative curriculum and pedagogical approach. Whilst one of the learners reveals his frustration at the lack of transformative opportunities in his learning programme, the other offers illustration of how transformative learning can be encouraged and how it can actually (...) transform the life of its beneficiaries. In essence, both case studies highlight some requirements of transformative learning. Bourdieu’s concepts of field, capitals and habitus are applied; the critical elements of these concepts essentially being tools for consciousness raising and increasing the flow of capitals, including linguistic capital, which challenge the notion of spoilt identities based on neoliberal individual accountability which fails to address the structures and hierarchies of power. In this manuscript, I analyze Slavoj Žižek’ s debate with the Canadian clinical psychologist Jordan Peterson. The terms “Venus envy” and “academic inferiority complex” are used based on classical psychoanalytic jargon. Jordan Peterson and Slavoj Žižek are interpreted as the representatives of the opposing ends of our contemporary academic postmodern spectrum. Žižek demonstrates the unchained M arxist, and Peterson embodies the persona of the capitalist educator. This collection of essays explores conceptions of toleration and tolerance in Asia and the West. It tests the assumption in contemporary Western political discourse and theory that toleration is a uniquely Western virtue and finds that many other traditions have comparable ideas and practices in grappling with religious and cultural diversity.

A key ethical issue arising in data linkage research relates to consent requirements. Patients’ consent preferences in the context of health research have been explored but their consent preferences regarding data linkage specifically have been under-explored. In addition, the views on data linkage are often those of patient groups. As a result, little is known about lay people’s views and their preferences about consent requirements in the context of data linkage. International research guidance has shifted towards an increasingly proactive inclusion of children and adolescents in health research in recognition of the need for more evidence-based treatment. Strong calls have been made for the active involvement of children and adolescents in developing research proposals and policies, including in decision-making about research participation. Much evidence and debate on this topic has focused on high-income settings, while the greatest health burdens and research gaps occur in low-middle income countries, highlighting the need to take (...) account of voices from more diverse contexts. Between January and March 2014, 56 community representatives and secondary school students were involved in eight group discussions to explore views on the acceptability of involving children and adolescents in research, and how these groups should be involved in decision-making about their own participation. Discussions were voice-recorded and transcriptions analyzed using Framework Analysis, combining deductive and inductive approaches. Across these discussions, the idea of involving children and adolescents in decision-making about research participation was strongly supported given similar levels of responsibility carried in everyday life; existing capacity that should be recognized; the opportunity for learning involved; varying levels of parental control; and generational shifts towards greater understanding of science for adolescents than their parents. Joint decision-making processes were supported for older children and adolescents, with parental control influenced by perceptions of the risks involved in participation. Moves towards more active involvement of children and adolescents in planning studies and in making decisions about their participation are supported by these findings from Kenya. Important emerging considerations include the need to take account of the nature of proposed studies and prevailing attitudes and understanding of research in identifying children’s and adolescents’ roles. More research is needed to expand diversity and develop approaches to joint assent and consent processes that would fairly represent children’s and adolescents’ wishes and interests, towards their long term benefit. The COVID-19 pandemic has both exposed and created deep rifts in society. It has thrust us into deep ethical thinking to help justify the difficult decisions many will be called upon to make and to protect from decisions that lack ethical underpinnings. This paper aims to highlight ethical issues in six different areas of life highlighting the enormity of the task we are faced with globally. In the context of COVID-19, we consider health inequity, dilemmas in triage and allocation of (...) scarce resources, ethical issues associated with research, ethical considerations relating to tracing apps, and exit strategies such as immunity passports and COVID-19 vaccines. Finally, we consider environmental issues in light of COVID-19. The paper also offers some ethical reflection on these areas as many parts of the world contemplate the recovery phase. (shrink)

In this paper I raise three questions regarding the status and function of Absolute Knowing in Hegel’s Phenomenology of Spirit. First, can Hegel’s Absolute Knowing be understood as an epiphany? Secondly, how does epiphany make sense of the teleological elements that activate and mobilise the movement towards Absolute Knowing? And thirdly, how does such an interpretation shift the focus from a closed reading of Hegel’s text – that views Absolute Knowing as consummately realised – to an open reading that keeps (...) the Absolute within its purview, but also seeks to foreground its aporias? I pursue these questions through an examination of the key constituents of knowledge: the subject of knowledge, its object, and the process through which knowledge is attained. (shrink)

ABSTRACT: This paper presents an argument about the location of psychological structure. It argues that psychological structure can be found in the domain of acts. The paper begins by arguing that all natural domains have concrete and abstract tiers. The concrete tier consists of concrete particulars that exist in time and space, and the abstract tier consists of classes, elements and relations that underlie the concrete tier. Having described the general nature of natural domains, the paper argues that acts are (...) the concrete particulars of interest to psychology and further, that the classes, elements and relations of the abstract tier constitute behavior's structure. Rudimentary knowledge of psychological structure is available ahead of systematic inquiry, and it connects well with the more advanced knowledge given in the operant paradigm. The paper concludes that this connection gives behavior analysts a way to run their argument from the concrete particulars of daily experience step-by-step through the successive levels of abstraction represented in the operant paradigm. Certain English writers of the seventeenth and early eighteenth centuries, whom scholars often associate with classical republicanism, were not, in fact, hostile to liberalism. Indeed, these thinkers contributed to a synthesis of liberalism and modern republicanism. As this book argues, Marchamont Nedham, James Harrington, Henry Neville, Algernon Sidney, and John Trenchard and Thomas Gordon, the co-authors of a series of editorials entitled Cato's Letters, provide a synthesis that responds to the demands of both republicans and liberals by offering a politically (...) engaged citizenry as well as the protection of individual rights. The book also reinterprets the writings of Machiavelli and Hobbes to show that each contributed in a fundamental way to the formation of this liberal republicanism. (shrink)

New materialisms argue for a more science-friendly humanities, ventilating questions about methodology and subject matter and the importance of the non-human. However, these new sites of attention - climate, biology, affect, geology, animals and objects - tend to leverage their difference against language and the discursive. Similarly, questions about ontology have come to eclipse, and even eschew, those of epistemology. While this collection of essays is in kinship with this radical shake-up of how and what we study, the aim is (...) to re-navigate what constitutes materiality. These efforts are encapsulated by a rewriting of the Derridean axiom, 'there is no outside text' as 'there is no outside nature.' What if nature has always been literate, numerate, social? And what happens to 'the human' if its exceptional identity and status is conceded quantum, non-local and ecological implication? (shrink)

The Tuskegee Syphilis Study is often cited as a major reason for low research participation rates among racial/ethnic minorities. We use data from a random-digit-dial telephone survey of 510 African Americans and 253 Latinos drawn from low income Los Angeles neighborhoods to investigate associations between knowledge of the study and endorsement of HIV/aids conspiracy theories. Results indicate African Americans were significantly more likely than Latinos to endorse HIV/aids conspiracy theories and were more aware of the study. Nevertheless, few Americans and (...) Latinos had ever heard of Syphilis Study suggesting that awareness is not a major factor in low participation rates. (shrink)

This article aims to present a Žižekian reading of the British author David Herbert Lawrence. The contemporary continental philosopher has tackled each of the British author’s reoccurring themes individually and thus may be used as a keystone for a valid literary interpretatio n. The paper begins by shedding light on the representation of Western ideology, moves further into the comprehension of the impacts of modern cultural capital and the limitations of industrialization. While at the same time the dissertation targets another (...) component of the romantic poet’s many writings which are characterized by the regeneration of the subject’s carnal presence as a defense mechanism against the prevalent culture of de-humanization. The argument at hand is that the reconstruction of the bodily image rendered through Lawrence’s erotic literature is not one that portrays promiscuity, but rather demonstrates a transgression of the Lacanian symbolic and the attainment of a partial rendition of a Hegelian totality. Lawrence’s six novels and set of poems are thoroughly analyzed from a strictly Žižekian p erspective to demonstrate that th e two authors share thematic representations, a common worldview and propose a manifestation of how literary analyses may be conveyed using Žižek as a philosophical lens for literary interpretation. LindIn "Dispelling the Myth of the Non-Singer: Embracing Two Aesthetics for Singing," Louise Pascale explores classroom teachers' beliefs about singing. Specifically, she looks at possible reasons why many classroom teachers who have been raised in the Western traditions of music-making do not feel comfortable singing. As a vocal music education professor and an (...) avid singer, this is a topic near and dear to my heart. My image of a vibrant elementary classroom, rooted in my experiences as a student and later as an elementary music teacher, includes singing. If, as Pascale notes, there is a growing number of teachers who define themselves as "non-singers" and who, because of this, do not include music in the classroom, there is indeed reason for alarm.As I read the introductory paragraph of this paper I immediately thought of elementary teachers who had at one time or another been labeled as "tone deaf" and who had allowed an early negative singing experience to cause them to believe they could not sing. Pascale challenged this simple explanation of the non-singer and made a strong case for a more thorough investigation of the problem.Pascale began her investigation by conducting a series of interviews with people who believed they could not sing. She found a variety of reasons for the self-proclaimed non-singers negative self image including: 1) never being selected to sing a solo; 2) not being able to lead songs, and 3) not singing in tune. Pascale used the story of a young Barbados woman, Onika, as an illustration of how these experiences could be linked to Western music traditions. Onika was born in Barbados but moved to the United States at the age of four. This young woman considered herself a singer in her native country but a non-singer in America. Onika felt she was a singer in Barbados because she enjoyed singing music in the Solka tradition; the music was fun, moved fast, and she could sing along without being concerned about how she sounded. She described herself as a non-singer in the United States because she was not able to lead songs and did not have a strong voice.I agree that the conventional Western view of music in the schools is rooted in classical traditions that value performance, perfection, and virtuosity and that these views may lead to the above mentioned assumptions regarding singing. I question, however, whether this conventional view permeates the beliefs of those [End Page 200] outside of the traditional music education circle. Onika's experiences with music in Barbados seemed to be very natural, a part of life; her experiences with music in the United States seemed limited to formal experiences in church or school settings. It would be interesting to investigate whether the dichotomy is between two cultures, the United States and Barbados, or between two different ways of experiencing music, in school and in everyday life.The main body of Pascale's work is the description of two aesthetics for singing, Aesthetic A, the classical Western tradition and Aesthetic B, a broader, multi-dimensional perspective. The list of characteristics differentiating Aesthetic A and Aesthetic B relate to the teaching of music, the process of music education. Emphasizing product and performance, stressing the importance of skill building and relying on classical repertoire are characteristics related to the traditional viewpoint, or Aesthetic A. These characteristics are contrasted with those related to Aesthetic B; the emphasis is placed on process and participation, stress is placed on social value and feeling, and vernacular repertoire is used. Pascale makes the point that Aesthetic B is not meant to replace "traditional" thinking but is a broadening of the perspective. Two questions emerge from Pascale's two aesthetics. First, is there a commonly held "traditional" culture of singing that exists in schools today? Schools and learning populations in the United States are so diverse it is hard to imagine a single philosophy driving music education. Background: Depression is the largest cause of mental ill health worldwide. Although interventions such as Dance Movement Therapy (DMT) may offer interesting and acceptable treatment options, current clinical guidelines do not include these interventions in their recommendations mainly because of what is perceived as insufficient research evidence. The 2015 Cochrane review on DMT for depression includes only three RCTs leading to inconclusive results. It is therefore, necessary to also look beyond such designs in order to identify and assess the range (...) of current evidence. Methods: We therefore, conducted a systematic review of studies that aimed to explore the effectiveness in the use of DMT with people with depression. This led to a qualitative narrative synthesis followed by a subgroup analysis and a sensitivity analysis. In all meta-analyses a random effects model was used with Standardised Mean Differences (SMD) to accommodate for the heterogeneity of studies and outcome measures. Results: From the 817 studies reviewed, eight studies met our inclusion criteria. 351 people with depression (mild to severe) participated, 192 of whom attended DMT groups while receiving treatment as usual (TAU) and 159 received TAU only. Qualitative findings suggest there was a decrease in depression scores in favour of DMT groups in all studies. Subgroup analysis performed on depression scores before and three months after the completion of DMT groups suggested changes in favour of the DMT groups. When sensitivity analysis was performed, RCTs at high risk of bias were excluded, leaving only studies with adult clients up to the age of 65. In these studies, the highest effect size was found favouring DMT plus TAU for adults with depression, when compared to TAU only. Conclusions: Based on studies with moderate to high quality, we concluded that DMT is an effective intervention in the treatment of depression with adults. Furthermore, by drawing on a wide range of designs with diverse quality, we were able to compile a comprehensive picture of relevant trends. Despite the fact that there remains a paucity of high-quality studies, the results have relevance to both policy-making and clinical practice, and become a platform for further research. (shrink)

With contributions from leading scholars in constitutional law, this volume examines how carefully designed and limited doctrines of proportionality can improve judicial decision-making, how it is applied in different jurisdictions, its role on constitutionalism outside the courts, and whether the principle of proportionality actually advances or detracts from democracy. Contributions from some of the seminal thinkers on the development of scholarship on proportionality extend their prior work and engage in an important dialogue on the topic. The COVID-19 pandemic has had a significant impact globally. Most affected, however, are those individuals and groups routinely disadvantaged by the social injustice created by the misdistribution of power, money, and resources. Simple measures that prevent the spread of COVID-19, such as frequent hand washing and social distancing, are unavailable to millions of people in the wealthiest of nations and in the poorest of nations. Disadvantaged groups are impacted more directly and in disproportionately higher numbers due to existing poor health, (...) and the disruption of services central to securing an income and an education will have lasting consequences for their futures. The unintended effect of exclusionary government policies is that privileged citizens and healthcare systems are also at greater risk. This paper seeks to highlight the impact of COVID-19 on those already suffering health inequities through consideration of some of the social determinants of health on groups in affluent and poorer nations. It also highlights some of the factors that may assist in tackling health inequities as we emerge from this pandemic. (shrink)

BackgroundCarefully planned research is critical to developing policies and interventions that counter physical, psychological and social challenges faced by young people living with HIV/aids, without increasing burdens. Such studies, however, must navigate a ‘vulnerability paradox’, since including potentially vulnerable groups also risks unintentionally worsening their situation. Through embedded social science research, linked to a cohort study involving Adolescents Living with HIV/aids (ALH) in Kenya, we develop an account of researchers’ responsibilities towards young people, incorporating concepts of vulnerability, resilience, and agency (...) as ‘interacting layers’.MethodsUsing a qualitative, iterative approach across three linked data collection phases including interviews, group discussions, observations and a participatory workshop, we explored stakeholders’ perspectives on vulnerability and resilience of young people living with HIV/aids, in relation to home and community, school, health care and health research participation. A total of 62 policy, provider, research, and community-based stakeholders were involved, including 27 ALH participating in a longitudinal cohort study. Data analysis drew on a Framework Analysis approach; ethical analysis adapts Luna’s layered account of vulnerability.ResultsALH experienced forms of vulnerability and resilience in their daily lives in which socioeconomic context, institutional policies, organisational systems and interpersonal relations were key, interrelated influences. Anticipated and experienced forms of stigma and discrimination in schools, health clinics and communities were linked to actions undermining ART adherence, worsening physical and mental health, and poor educational outcomes, indicating cascading forms of vulnerability, resulting in worsened vulnerabilities. Positive inputs within and across sectors could build resilience, improve outcomes, and support positive research experiences.ConclusionsThe most serious forms of vulnerability faced by ALH in the cohort study were related to structural, inter-sectoral influences, unrelated to study participation and underscored by constraints to their agency. Vulnerabilities, including cascading forms, were potentially responsive to policy-based and interpersonal actions. Stakeholder engagement supported cohort design and implementation, building privacy, stakeholder understanding, interpersonal relations and ancillary care policies. Structural forms of vulnerability underscore researchers’ responsibilities to work within multi-sectoral partnerships to plan and implement studies involving ALH, share findings in a timely way and contribute to policies addressing known causes of vulnerabilities. Unmet legal needs contribute to housing, income, and food insecurity, along with other conditions that harm health and drive health inequity. Addressing health injustice requires new tools for the next generations of lawyers, doctors, and other healthcare professionals. An interprofessional group of co-authors argue that law and medical schools and other university partners should develop and cultivate Academic Medical-Legal Partnerships (A-MLPs), which are uniquely positioned to leverage service, education, and research resources, to advance health justice.
