This article interrogates the specter of resistance in the writings of Giorgio Agamben and Michel Foucault, arguing they open up divergent ways of theorizing resistance to power. This article’s focus is on both philosophers’ use and interpretation of the dispositif, or apparatus, which controls and orders subjects, and which is the target for forms of resistance. Whereas for Foucault resistance is a practice existing as a transcendent possibility for any individual, Agamben reads such transcendent forms of resistance as ultimately reinforcing (...) the control of the dispositif, arguing that only a turn to ontology and immanent politics can resistance be meaningful. Drawing upon the thought of Giorgio Agamben, this essay focuses upon the potential of a single act to change a political order. Agamben’s writings retain the possibility for a paradigmatic gesture that opens a space for a politics not founded on a form of belonging grounded in a particular property, such as national identity. To illustrate this event this essay turns to Agamben’s construction of whatever-being, which is constructed hyper-hermeneutically. This term is chosen deliberately. Whatever-being retains a hermeneutic structure, but (...) is constructed through singular paradigmatic examples. These examples are evidence for whatever-being’s existence as a pure singularity, unable to be reduced to a particular quality. Such examples are gestures that allow future modes of belonging to separate themselves from oppressive foundations and dominating constructions of political existence, through revealing the possibility of a new way of being that does not require a revolutionary “zero hour” to be brought about. Michel Foucault articulated the hypothesis of biopower and biopolitics in the 1970s, and Giorgio Agamben developed this hypothesis in his Homo Sacer: Sovereign Power and Bare Life, published in English in 1998. Since these interventions, biopower and biopolitics have become indispensable as a theoretical point of reference in the humanities and social sciences. Michael Hardt and Antonio Negri argue that in the last thirty years the process of biopower and biopolitical regulation has increased, so much so that today every aspect (...) of social relation is subjected to the operations of this power. This chapter considers the position of biopower in the thought of Foucault and Agamben, and how the two conceive of power and resistance to power. It examines how biopower relates to sovereign power in both philosophers’ work, and specifically how Agamben’s development of Foucault’s thought is radical and offers a markedly different direction to scholarship on biopower and its relationship to sovereign power. Despite the relative age of Foucault’s writings, they continue to offer conceptual and theoretical tools for scholars in ways that Agamben’s theories and work do not. I use the example of the coronavirus pandemic to illustrate the shortcomings in Agamben’s thought. Finally, this chapter draws on recent work by Alexander Weheliye and Achille Mbembé to explore the close relationship between sexuality and race, and to show how both gender and race open up new avenues for exploring biopower and its relationship to sovereignty in the twenty-first century. This article compares Michel Foucault’s way of thinking about sovereignty and law within biopower to the reading given to Foucault’s work and its development by the Italian philosopher Giorgio Agamben. It is argued that Agamben supports the expulsion thesis in order to generate critical distance for his own re-imagining of biopower. The expulsion thesis is a controversial account of the position of law in Foucault’s work that does not reflect Foucault’s own nuanced views. A post-structuralist account of Foucault and law (...) is then used to show that Agamben’s conception of law is actually much more similar to Foucault’s than Agamben at first claimed. The real thrust of Agamben’s work is found in his connecting political philosophy to ontology. Agamben’s claim that the questioning of law is a fundamental ontological issue calls into question the very concept of subjectivity. This leads Agamben to embark upon a radical reconceptualization of sovereignty in relation to the subject and the law. Despite opening new areas of inquiry in relation to Being and law, Agamben’s attempt to move beyond Foucault’s work is called into question, with particular emphasis upon whether Agamben’s work is truly ontological. The figure of form-of-life is a life lived as a ‘how’ or a mode of living, beyond every relation. Form-of-life is a form of impotent, destituent power that seeks to deactivate the biopolitics that continuously divides and separates life itself. Agamben’s work is remarkably silent on the question of reproductive rights. The pregnant woman’s life is regulated continuously by biopolitics, yet Agamben does not discuss this regulation. The woman’s relationship with her foetus is difficult to reconcile with Agamben’s philosophy that (...) seeks to think beyond every relation. In addition, the right to abortion is difficult to reconcile with form-of-life. It is not clear how a woman seeking an abortion is not exercising a sovereign decision to create bare life. I use the UK’s abortion laws as a way to interrogate Agamben’s figure of form-of-life, and to illustrate how, by not accounting for reproductive rights, Agamben’s thought remains incomplete. Giorgio Agamben: Legal, Political and Philosophical Perspectives brings together contributions from scholars in a number of fields including many who have worked closely with Agamben in order to argue that Agambens thought is vital to the future directions of research in the humanities and social sciences. The book is divided into three sections, each coalescing around a different perspective. Contributions in the first section examine the potential for Agambens thought to impact upon future legal scholarship. Papers draw upon wide ranging (...) issues such as legal oaths, legal reasoning and Hegels Philosophy of Right. The second section focuses on political perspectives that include references to Marx, Žižek and Agambens concept of the messianic. The third section considers philosophical perspectives on Agambens thought, and draws upon art theory, Franz Kafka, and the thought of Gilles Deleuze, Walter Benjamin and Emmanuel Levinas. All three sections, however, address the potential of Agambens thought by re-focusing attention away from his critiques of Western politics and towards his scheme for a political future. As such the book maintains that Agamben is an important and thoroughly original figure, who has articulated a vision of politics, and of community, that is both achievable and worth recognising. This first book-length study into the influence of Emmanuel Levinas on the thought and philosophy of Giorgio Agamben, Law, Relationality and the Ethical Life demonstrates how Agamben's immanent thought can be read as presenting a compelling, albeit flawed, alternative to Levinas's ethics of the Other. The publication of the English translation of The Use of Bodies in 2016 ended Giorgio Agamben's 20-year multi-volume Homo Sacer study. Over this time, Agamben's thought has greatly influenced scholarship in law, the wider humanities, and (...) social sciences. This book places Agamben's figure of form-of-life in relation to Levinasian understandings of alterity, relationality, and the law. Considering how Agamben and Levinas craft their respective forms of embodied existence - that is, a fully formed human which can live an ethical life - the book considers Agamben's attempt to move beyond Levinasian ethics through the liminal figures of the foetus and the patient in a persistent vegetative state. These figures, which Agamben uses as examples of bare life, call into question the limits of Agamben's non-relational use and form of existence. As such, it is argued, they reveal the limitations of Agamben's own ethics, whilst suggesting that his 'abandoned' project can and must be taken further. Giorgio Agamben’s development of a messianic politics-to-come seeks to counter the law which is in force without significance, a law which creates bare life. Embodying this messianic politics, and a call for the law’s fulfilment, is the figure of whatever-being, a form-of-life. This article contends that there is an important conceptual problem in respect of Agamben’s construction of such a form-of-life, namely the issue of relationality. The problem of relationality in Agamben is explored here through the comparative lens of relationality (...) in Levinas’s thought. It is contended that Agamben’s messianic subject, his form-of-life, has a negative relation to its other, in contrast to Levinas’s positive, subject forming view of relationality. (shrink)

This book explores how the figure of the slave has been used to construct ideas of freedom in Western political and legal philosophy. The figure of the slave has supported philosophical and legal defences of colonialism, coloniality and the supremacy of the white subject. Yet for Giorgio Agamben, the slave stands (almost counterintuitively) as an exemplar of a potential form of future positive political existence. Developing this line of thought, the book reads key thinkers Agamben engages with in his thought (...) and writings - including Aristotle, Saint Paul and G W F Hegel - and draws on decolonial theory to argue that the lives of people who were enslaved and unfree, and their actions and gestures, can point towards a paradigmatic form of political belonging. By reading Agamben in a decolonial direction, we can imagine alternative forms of agency, recognition and subjectivity, which can challenge the necropolitical world of racial capitalism in which we live. This study will appeal to scholars, researchers and graduate students with an interest in the thought of Giorgio Agamben, radical politics, legal and political philosophy and decolonial theory.
