Some obligations are conditional such that act A is morally optional, but if one chooses A, one is required to do act B rather than some other less valuable act C. Such conditional obligations arise frequently in research ethics, in the philosophical literature, and in real life. They are controversial: how does a morally optional act give rise to demanding requirements to do the best? Some think that the fact that a putative obligation has a conditional structure, so defined, is (...) a strike against its being a genuine obligation. I argue that conditional obligations are to be expected in a moral theory that has moral options. (shrink)

This article argues that two forms of mitochondrial replacement therapy, maternal spindle transfer and pro-nuclear transfer, are not therapies at all because they do not treat children who are coming into existence. Rather, these technologies merely create healthy children where none was inevitable. Even if creating healthy lives has some value, it is not to be confused with the medical value of a cure or therapy. The article addresses a recent Bioethics article, ‘Mitochondrial Replacement: Ethics and Identity,’ by Wrigley, Wilkinson, (...) and Appleby, who argue that PNT is morally favorable to MST due to the Non-Identity Problem. Wrigley et al. claim that PNT, since it occurs post-conception, preserves the identity of the resulting child, whereas MST, since it occurs pre-conception, is an identity-altering technique. As such, a child born with mitochondrial disease could complain that her parents failed to use PNT, but not MST. The present article argues that the authors are mistaken: both MST and PNT are identity-affecting techniques. But this is of little matter, for we should be cautious in drawing any moral conclusions from the application of the Non-Identity Problem to cases. The article then argues that the authors are mistaken in inferring that PNT is a type of embryonic cure or therapy for children with mitochondrial disease. In February 2016, the Institute of Medicine released a report, commissioned by the United States Food and Drug Administration, on the ethical and social‐policy implications of so‐called three‐parent in vitro fertilization. The IOM endorses commencement of clinical trials on three‐parent IVF, subject to some initial limitations. Also called mitochondrial replacement or transfer, three‐parent IVF is an intervention comprising two distinct procedures in which the genetic materials of three people—the DNA of the father and mother and the mitochondrial DNA of an (...) egg donor—can be used to create a child. Three‐parent IVF would enable a woman with mitochondrial disease to have a genetically related child without transmitting the disease to the child. The possibility for three‐parent children has prompted criticism from many corners. Critics have pointed to ethical issues including safety concerns and risks to children, genetic and germline engineering concerns, the potential exploitation of the third‐parent egg donor, donor anonymity and privacy, and objections to creating babies with three parents, which undermines natural and traditional conceptions of procreation. Additionally, developing the technology would involve experimenting on, manipulating, and disposing of embryos. Although the IOM report considers the ethical concerns about the value of the three‐parent IVF technology, the IOM failed to give due attention to an important objection to the development of this technology: three‐parent IVF lacks the social value necessary to make investment of public resources in it ethical.Unlike the other concerns, this objection is not based on conservativism about new reproductive technologies or default favoritism of the status quo. I argue that the technology does not meet a plausible social value standard to render public research investment into its development ethical. Proponents of three‐parent IVF make inaccurate and exaggerated claims that it will eradicate mitochondrial disease and save lives. Were these claims true, proponents would have a strong case for the social value of the technology. But three‐parent IVF alone will not eradicate mitochondrial disease, and it will not save lives. Rather, it can create healthy lives. As I discuss, the moral distinction is crucial. Most importantly, investment in three‐parent IVF comes at the opportunity cost of researching treatment for mitochondrial disease that would benefit actual, living disease sufferers. (shrink)

Most studies of corporate social responsibility have focused on the organisational level, while the individual level of analysis has been treated as a ‘black box’ when researching antecedents of CSR engagement or disengagement. This article offers insights into a small and medium-sized enterprise that is recognised as a pioneer in CSR. Although the extant literature suggests that the owner-manager is crucial in the implementation of CSR, this study reveals that employees drive CSR. The employees in the focal firm voluntarily joined (...) forces based on their shared perception of moral responsibility for CSR and they developed strict targets to be achieved by 2030. Despite their strong ethical and moral perspective when enacting CSR, they disengaged from their moral responsibility for CSR in various contexts. This paper contributes to the theory of moral decoupling by uncovering a novel context of disengagement—‘visionary procrastination’. Visionary procrastination is suggested to be a particularly relevant context of disengagement when individuals perceive moral responsibility for CSR. Moreover, by delivering insights into the antecedents of employee-initiated CSR on the organisational level, this study adds to the growing body of literature on the micro-foundations of CSR. By means of data from the most comprehensive source of teacher data in the nation, Schools and Public School Teacher Staffing Survey (SASS), we designeda follow-up quantitative study to test the effects of two decades of national policy mandates on instructional time allotments for core academic subjects. We used data from the SASS data from National Center for Educational Statistics (NCES) (1993/1994, 1999/2000, 2003/2004, 2007/2008) to examine national trends of continued marginalization of social studies by exploring the influence of recent (...) educational policy on defining elementary curricula in the 21st Century. With the reauthorization of NCLB in 2007 and newly mandated science testing in grades 3 through 5, we sought to understand statistically how this policy change has affected instructional decisions regarding time allocated to core academic subjects (ELA, mathematics, science and social studies) in elementary schools. Findings provide evidence of the national trend of the declining role of social studies in an era in which testing is associated with importance. Moreover, grade level disparities unique to social studies intensified the effects of 2007 NCLB policy mandates of science testing for 3rd through 5th grade students. Results provide a broader and nationally generalizable understanding of the declining role of social studies in elementary schools and the reduction of time practitioners spend teaching social studies. Thus, the growing imbalance in instructional time distributions for social studies and the tipping of the time distribution scales in favor of science document teacher responses to the expansion of testing mandates and the continued absence of studies from the national testing landscape. Millions of children worldwide could benefit from adoption. One could argue that prospective parents have a pro tanto duty to adopt rather than create children. For the sake of argument, I assume there is such a duty and focus on a pressing objection to it. Prospective parents may prefer that their children are genetically related to them. I examine eight reasons prospective parents have for preferring genetic children: for parent-child physical resemblance, for family resemblance, for psychological similarity, for the sake (...) of love, to achieve a kind of immortality, for the genetic connection itself, to be a procreator, and to experience pregnancy. I argue that, with the possible exception of the pregnancy desire, these reasons fail to defeat a duty to adopt a child rather than create one, even assuming that we do have some leeway to favor our own interests. The independence of irrelevant alternatives is a popular and important axiom of decision theory. It states, roughly, that one’s choice from a set of options should not be influenced by the addition or removal of further, unchosen options. In recent debates, a number of authors have given putative counterexamples to it, involving intuitively rational agents who violate IIA. Generally speaking, however, these counterexamples do not tend to move IIA’s proponents. Their strategy tends to be to individuate the options that the (...) agent faces differently, so that the case no longer counts as a violation of IIA. In this paper, we examine whether this strategy succeeds. We argue that the ways of individuating options required to save IIA from the most problematic counterexamples—in particular, cases where agents violate IIA due to nonconsequentialist moral beliefs—do so only at the expense of severely compromising its central function within decision theory. This research applies the theory of planned behavior to corporate managers’ decision making as it relates to fraudulent financial reporting. Specifically, we conducted two studies to examine the effects of attitude, subjective norm and perceived control on managers’ decisions to violate generally accepted accounting principles (GAAP) in order to meet an earnings target and receive an annual bonus. The results suggest that the theory of planned behavior predicts whether managers’ decisions are ethical or unethical. Cosmological arguments for God typically have two stages. The first stage argues for a first cause or a necessary being, and the second stage argues from there to God. T. Ryan Byerly offers a simple, abductive argument for the second stage where the best explanation for why the being is found to have necessary existence is that it is a perfect being. The reasoning behind this argument is that universal generalizations explain observations of their instances; for example, the universal generalization (...) that all ravens are black explains why some particular raven is observed to be black. Similarly, the fact that a being has all perfections explains why we find the being to have necessary existence. I distinguish between two readings of Byerly’s proposed theistic explanation, and conclude that his explanation does not offer an advantage to the theist in either case. (shrink)

The problem that divine foreknowledge poses for free will is one that is notoriously difficult to solve. If God believes in advance how an agent will act, this fact about the past eradicates all alternatives for the actor, given the infallibility of God’s beliefs. And if we assume, with many theists, that free will requires alternatives possibilities, then it looks as if God’s omniscience is incompatible with our free will. One solution to this problem, introduced and defended by David Hunt, (...) draws on the source incompatibilist position in the secular free debate. According to source incompatibilists, free will does not require alternative possibilities but is also not compatible with causal determinism. Hunt argues that because God’s foreknowledge does not eliminate future alternatives through causal means, it is compatible with free will. In this paper, I challenge Hunt’s position using Kevin Timpe’s distinction between “wide” and “narrow” source incompatibilists. I argue that if one wishes to be an incompatibilist concerning free will and causal determinism, one must accept that alternatives are required for free will. And if one must accept that alternatives are a necessary condition for free will, then Hunt’s solution to the foreknowledge dilemma will not succeed. (shrink)

This research note is meant to introduce into philosophical discussion the preliminary results of an empirical study on the state of blacks in philosophy, which is a joint effort of the American Philosophical Association’s Committee on the Status of Black Philosophers (APA CSBP) and the Society of Young Black Philosophers (SYBP). The study is intended to settle factual issues in furtherance of contributing to dialogues surrounding at least two philosophical questions: What, if anything, is the philosophical value of demographic diversity (...) in professional philosophy? And what is philosophy? The empirical goals of the study are (1) to identify and enumerate U.S. blacks in philosophy, (2) to determine the distribution of blacks in philosophy across career stages, (3) to determine correlates to the success of blacks in philosophy at different career stages, and (4) to compare and contrast results internally and externally to explain any career stage gaps and determine any other disparities. This article presents the current legislative and educative measures in place for plagiarism prevention in Kosovo, especially in the case of student work, and provides an analysis of the effectiveness of such measures. Two public universities are used as case studies – the University of Haxhi Zeka and the University of Kadri Zeka – and the research is based on the legal and policy documents enacted by the two universities, as well as many reports, scientific articles on plagiarism and HEI (...) official websites. The issue of plagiarism has only recently become a priority in Kosovo, with many factors hindering advancement and development in this area. (shrink)

Tina Chanter uses the work of Luce Irigaray as the focus for a critique of French and Anglo-American feminism as it is articulated in the debate over essentialism. While these two branches of feminism represent opposing views, Chanter advocates a productive exchange between the two.

During sudden school closures in spring 2020 due to the COVID-19 pandemic, teachers had to move to distance teaching. This unprecedented situation could be expected to influence teacher well-being and schools as organizations. This article reports a qualitative study that aims at understanding how changes in teachers’ professional lives that were related to school closure affected Swiss primary teachers’ professional well-being. In semi-structured online-interviews, 21 teachers from 15 schools sampled by snowball method reported their experiences during school closure and distance (...) teaching and how this situation influenced their professional well-being. Results showed that medium to high levels of teacher well-being could accompany a general negative evaluation of the move to distance teaching. Factors such as high work-load, social distancing and feelings of lack of competence and self-efficacy were among the most aversive aspects of distance teaching and associated with deteriorating professional well-being. Among a plethora of factors that supported teachers in maintaining their well-being, contextual work-related aspects such as school resources, collegial support or leadership support along with individual aspects such as resilience, coping strategies, and clear work structures were important. Additionally, it was found that teacher well-being was nourished by positive experiences with the new forms of distance teaching and feelings of professional mastery. Despite methodological limitations (snowball sampling, retrospective interviews), the findings of this study could inform schools and authorities about what is needed to support teacher well-being and might help to develop organizational strategies that aim at preventing harmful declines in teacher well-being during challenging and difficult times such as a pandemic. The focus of this article is on the political nature of whistleblowing. It argues that reprisals by management, rather than silencing the whistleblower, result in the transformation and politicisation of the individual. The process that leads to the transformation of a loyal employee into a political activist is considered through analysing the experiences of a whistleblower in the sphere of financial regulation in South Africa. The article investigates the effect of retaliation by the employer on the employee‐organisational relationship. It looks (...) in particular at the nature of the power struggle between the whistleblower and management and suggests explanations why organisations tend to respond in such a harsh fashion to whistleblowing. It concludes that the act of whistleblowing not only displays an expressive dimension, but also a political instrumental dimension that is often neglected in literature on whistleblowing. (shrink)

Adding instructional time and holding teachers accountable for teaching social studies are touted as practical, logical steps toward reforming the age-old tradition of marginalization. This qualitative case study of an urban elementary school, examines how nine teachers and one administrator enacted district reforms that added 45 min to the instructional day and implemented a series of formative and summative assessments. Through classroom observations, interviews, time journals, and official school documents, this article describes underlying perceptions and priorities that were barriers to (...) any positive impact time or testing might have afforded social studies. Two recommendations emerge from results: 1) time structures need to provide space for the teaching of and planning for social studies; and 2) testing can have positive outcomes, but these are limited when assessments structures are hierarchical, misaligned, and poorly communicated. In this paper, I will describe how Brentano was able to integrate descriptive philosophy and logical analysis fruitfully by pointing out Brentano’s concept of philosophy as a rigorous science. First I will clarify how Brentano attempted to turn philosophy into a rigorous descriptive science by applying scientific methods to philosophical questions. After spelling out the implications of such a descriptive understanding of philosophy, I will contrast this descriptive view of philosophy with a semantic-analytic understanding of philosophy as proposed by Frege. After having thus set the stage I will argue that the current separation of philosophy into the seemingly antithetical strands of phenomenology and analytic philosophy may be seen as a consequence of how the term ‘rigorous science’ in ‘philosophy as a rigorous science’ is interpreted: Does a rigorous science grasp its object with as much exactitude as possible? Or is a science rigorous when its theories are expressed unambiguously, and their implications are drawn with precision? In the course of this investigation I will also point out how Brentano’s integrative use of descriptive philosophy and analysis can provide a suitable starting point for an equally successful integration of these methods in contemporary philosophy. Examination of Sophocles’ Antigone reveals how the corpse remains a historically, culturally and politically inscribed subject. To leave Polynices’ corpse, by Creon’s decree, to the open air to be consumed by carrion is e!ectively to erase Polynice’s status as an Athenian citizen and transubstantiate the materiality of the corpse into one that is immaterial and non-human – that of a slave. Antigone’s refusal to leave the unburied remains of her brother - a refusal that has been traditionally romanticized as an (...) act of rebellion against authoritarian control - circumscribes and rei”es class boundaries between the free, the civilized, and the unfree, uncivilized slave. In e!ect, Polynices’ unburied body unearths the ways in which a “western, hegemonic canon” has e!ectively buried a history of chattel slavery that has made much of this cultural output possible. An engagement with particularly notable ruminations on Antigone, such as Hegel’s and Derrida’s, serves to exemplify how the “gure of Antigone has been appropriated in ways that consolidate, rather than disrupt, a tradition of thought that evades its own implication in slavery and colonialism. I draw on Security Council Resolution 1674 to demonstrate that the political assumptions Jacques Derrida holds in his politically-oriented texts are inconsistent with the assumptions of his linguistic texts, and that Jürgen Habermas's political theory is consistent with the political implications of his approach to language. Habermasian pragmatism offers a critical theory of society and discourse of modernity that touches on the same themes of politics and meaning as Derrida and other deconstructionists, but is more coherent, consistent, and explanatorily persuasive.

The main research focus of the sociology of business ethics is on (i) the moral foundations of people's behaviour, both within and outside the business context, (ii) how compatible or contradictory these behaviours are and (iii) how stable a society or component of a society would be if self-interest is the main governing principle, without being constrained by moral discipline. This entails providing accurate descriptions and explanations of ethical situations. Whistle-blowing research is used to examine the methodological challenges of business (...) ethics researchers. The analysis demonstrates the importance of an integrated multi-strategy approach that would facilitate an investigation of the motivations and decision processes of individual actors in the larger social context, especially within the organisation. Engaging the theology of Thomas Aquinas with the psychoanalytic theory of Jacques Lacan, Tina Beattie shows how Thomism exerted a formative influence on Lacan, and how a Lacanian approach can bring new insights to Thomas's theology. Lacan makes possible a renewed Thomism which offers a rich theology of creation, incarnation, and redemption.

In this paper I compare two models of expert judgment: the art critic in Hume’s “Of the Standard of Taste” and the “wise man” in “Of Miracles.” The art critic is a true judge of beauty because he has made himself into a person who is optimally receptive to beauty. He possesses the virtues of taste: “Strong sense, united to delicate sentiment, improved by practice, perfected by comparison, and cleared of all prejudice” (“Of the Standard of Taste,” 241). But the (...) virtues of the art critic, I argue, are also those of the “wise man,” the person who consistently “proportions his belief to the evidence” (EHU 10.4; SBN 110). Comparison of these two characters reveals that for Hume the virtues fundamental to the art critic’s critical competence are also epistemic virtues. Hume’s exposition of aesthetic excellences should thus be of interest for virtue epistemology. Because contemporary virtue epistemologists have tended to focus almost exclusively on the relationships between intellectual and moral virtues, Hume offers something new: an account of epistemic virtues based on aesthetic virtues. This paper considers whether a physician is criminally liable for administering a dose of painkillers that hastens a patient's death. The common wisdom is that a version of the doctrine of double effect legally protects the physician. That is, a physician is supposedly acting lawfully so long as the physician's primary purpose is to relieve suffering. This paper suggests that the criminal liability issue is more complex than that. Physician culpability can be based on recklessness, and recklessness hinges on whether (...) a physician has taken an unjustifiable risk of hastening death. The authors identify three conditions of justifiability. Their analysis helps to explain the distinction between euthanasia, which is legally banned, and the use of risky analgesics, which is permitted in limited circumstances. (shrink)

In the article ‘Testimonial injustice in medical machine learning’, Pozzi argues that the prescription drug monitoring programme (PDMP) leads to testimonial injustice as physicians are more inclined to trust the PDMP’s risk scores over the patient’s own account of their medication history.1 Pozzi further develops this argument by discussing how credibility shifts from patients to machine learning (ML) systems that are supposedly neutral. As a result, a sense of distrust is now formed between patients and physicians. While there are merits (...) to Pozzi’s main argument of epistemic injustice caused by PDMPs, Pozzi mentions but ultimately glosses over the problem of automation bias. In this commentary, I will discuss automation bias and the affect it has on clinical decision making as well as a technical problem exacerbated by the usage of PDMPs that can potentially cause physical harms. It is reiterated in the article that the confidence physicians have in the PDMP’s risk scores over the patient’s testimony leads to misplaced trust in the ML systems. What Pozzi describes here is known as automation bias, which occurs when there is an over-reliance on ML systems. …. (shrink)

Most people would agree that adoption is a good thing for children in need of a family. Yet adoption is often considered a second best or even last resort for parents in making their families. Against this assumption, I explore the unique value of adoption for prospective parents. I begin with a criticism of the selective focus on the value of adoption for only those people using assisted reproductive technologies. I focus on the value of adoption for all prospective parents, (...) reflecting on non-relative, non-procreative adoptions. First, adoption can meet the important need that a child has for a family, whereas procreation creates rather than meets needs. Second, adoption provides a morally noble opportunity to extend to a stranger benefits usually withheld for one's genetic kin. As such, adoption offers a unique possibility in which impartial concern for an other can be the starting point for a lifetime of love and care. Finally, adoptions can have transformative power over adoptive parents’ conception of family and self. In highlighting the unique value of adoption, I aim to challenge the widespread assumption that adoption has second best status to procreation. Indeed adoption can exemplify the human potential for moral compassion and impartial concern for the needs of others. (shrink)

This volume of essays, all but one previously unpublished, investigates the question of Levinas’s relationship to feminist thought. Levinas, known as the philosopher of the Other, was famously portrayed by Simone de Beauvoir as a patriarchal thinker who denigrated women by viewing them as the paradigmatic Other. Reconsideration of the validity of this interpretation of Levinas and exploration of what more positively can be derived from his thought for feminism are two of this volume’s primary aims. Levinas breaks with Heidegger’s (...) phenomenology by understanding the ethical relation to the Other, the face-to-face, as exceeding the language of ontology. The ethical orientation of Levinas’s philosophy assumes a subject who lives in a world of enjoyment, a world that is made accessible through the dwelling. The feminine presence presides over this dwelling, and the feminine face represents the first welcome. How is this feminine face to be understood? Does it provide a model for the infinite obligation to the Other, or is it a proto-ethical relation? The essays in this volume investigate this dilemma. What kinds of time are opened, disclosed, or foreclosed in such moments? This section explores a concept that has a long history in rhetoric and philosophy, but which is urgently called for now, in a time that many think of as critical, catastrophic, or even apocalyptic. Changes in the economy, (...) climate, and the state of our democracies demand urgent attention, and while people disagree on the course to be taken, there is a sense that—this is it!—now is the time. The concept of kairos (from ancient Greek καιρός) comprises both a critical time and a perfect opportunity; it is the right moment to act, even though the word could also be interpreted in a more general sense as referring to the issue of right timing. Considered as "one of the most untranslatable of Greek words," kairos is perhaps related to the verb kurō, "to meet" or "meet accidentally," as when an arrow meets a target, suggesting that there is a spatial component in the temporal kairos.1 The spatial dimension shines through in the earliest uses of the term discussed in both SeungJung Kim's article on ancient Greek visual arts and Robert Sullivan's article on Isocrates (436–338 BCE). According to Sullivan's survey, Isocrates most often employs the word to refer to a specific situation, occasion, state of affairs, or set of circumstances.How do you recognize, let alone seize, this kind of moment, though? The best-known depiction of this difficulty is a portrait of Kairos personified that dates back to Lysippos in the fourth century BCE, reconstructed visually in three dimensions in Kim's essay. In Greek mythology Kairos is the god of golden opportunities, which (as we all know!) tend to pass by too quickly. The portrait shows a winged figure with a flowing forelock that ideally gives you something to hold on to. I like to imagine that if you [End Page 267] manage to arrest this passing instant, time itself comes to an abrupt halt, which throws Kairos's hair out in front of his face.Of course, people do not necessarily see it as positive when someone appears to have captured the moment. At the kairos symposium hosted by art historian Barbara Baert in Brussels in October 2018, W. J. T. Mitchell held up a picture of President Donald Trump's sculpted forelock to illustrate that it all depends on the perspective. Turning the familiar Greek portrait into an image of the opportunist, Mitchell reminded all of us that had gathered to celebrate the legacy of kairos in iconographic, philosophical, theological, semantic, historical, and anthropological studies, of the ethical issues arising in such moments. The question of moral accountability is bound to come up, whether one takes kairos to refer to the act of seizing the moment, involving some form of decision, or to the moment itself, the kairos, which some might claim just seized upon them and carried them away.As Debra Hawhee and Erik Charles White before her have argued, kairos does not seem to be confined by the subjective reason operating in a "rhetorical situation," but it depends on "the forces pushing on the encounter," in addition to instinct and intuition, and possibly on habitual impulses springing from experience (Hawhee 2002, 24–25; White 1987; reconsidered by Brod 2021). Audiences may also have a significant role to play, as Kermit Campbell underscores in his discussion of the symbiosis of call and response in African American churches and his reflection on how Martin Luther King's speech at the 1963 March on Washington replied to a call: "Tell them about the dream, Martin."The moment of kairos may appear spontaneous and deliberate, both at the same time. Clinicians and health researchers frequently encounter opportunities to rescue people. Rescue cases can generate a moral duty to aid those in peril. As such, bioethicists have leveraged a duty to rescue for a variety of purposes. Yet, despite its broad application, the duty to rescue is under-analyzed. In this paper, we assess the state of theorizing about the duty to rescue. There are large gaps in bioethicists’ understanding of the force, scope, and justification of the two most cited duties to (...) rescue—the individual duty of easy rescue and the institutional rule of rescue. We argue that the duty of easy rescue faces unresolved challenges regarding its force and scope, and the rule of rescue is indefensible. If the duty to rescue is to help solve ethical problems, these theoretical gaps must be addressed. We identify two further conceptions of the duty to rescue that have received less attention—an institutional duty of easy rescue and the professional duty to rescue. Both provide guidance in addressing force and scope concerns and, thereby, traction in answering the outstanding problems with the duty to rescue. We conclude by proposing and propose research priorities for developing accounts of duties to rescue in bioethics. (shrink)
