The most serious objection to Beall and Restall’s case-based logical pluralism is the so-called collapse argument. According to the collapse argument, logical pluralism is not genuinely pluralistic and collapses into a single privileged relation of logical consequence. In response, Caret offered an account of logical contextualism that supposedly maintains the merits of Beall and Restall’s case-based logical pluralism while circumventing the collapse argument. In this paper, I first point out a gap in the collapse argument in that it does not (...) affect pluralists who assume that there is no uniquely strongest admissible consequence relation. This gap, then, is closed by an improved version of the collapse argument, which makes use of Eklund’s classification of types of pluralism. Finally, I discuss how Caret’s logical contextualism cannot hold up against this new formulation of the collapse argument unless implausible assumptions about the contents of normative operators are made. Moreover, by reformulating the collapse argument, I determine the extent to which logical monism and pluralism oppose each other, paving the way for fruitful future discussion. (shrink)

Fictional ersatz realism is the metaphysical stance that abstract fictional entities exist and are dependent on fiction and literary practices. Everett tackled the position of ersatz realism by claiming that the ersatz realist cannot provide an identity criterion for fictional entities that does not imply a contradiction. Although Woodward proposed a defense to Everett's argument, I will argue that ersatz realism is no tenable position, as it still cannot provide an adequate identity criterion. To establish this result, I will provide (...) a base frame for identity criteria available to the ersatz realist. Afterwards, I will show that to any identity criterion the ersatz realist may propose there is a story such that a fictional entity corresponding to this story is not self-identical, imposing a contradiction to the metaphysical account of ersatz realism. Machine intelligence already helps medical staff with a number of tasks. Ethical decision-making, however, has not been handed over to computers. In this proof-of-concept study, we show how an algorithm based on Beauchamp and Childress’ prima-facie principles could be employed to advise on a range of moral dilemma situations that occur in medical institutions. We explain why we chose fuzzy cognitive maps to set up the advisory system and how we utilized machine learning to train it. We report on the (...) difficult task of operationalizing the principles of beneficence, non-maleficence and patient autonomy, and describe how we selected suitable input parameters that we extracted from a training dataset of clinical cases. The first performance results are promising, but an algorithmic approach to ethics also comes with several weaknesses and limitations. In this paper I examine Habermas’ conception of the market in The Theory of Communicative Action (TCA). Habermas’ characterization of the market as norm-free has been controversial and I discuss three objections to it: the claims that it (1) conflates of action types, types of action coordination and spheres of action, (2) cannot account for the normative structure of the social organization of labour, and (3) that it makes impossible to make moral judgments about behaviour in the market. I conclude (...) that while some of these objections are unfounded, we have reason to revise Habermas’ substantive claims about the market. I also stress the importance of distinguishing between the TCA’s methodology and its time-diagnostic thrust. Next, I assess the colonization thesis through a case study of the commodification of higher education. I conclude that this thesis remains plausible, but that it needs to be supplemented with a theory of ideology. (shrink)

Under which conditions may physicians who are requested to treat permanently unconscious patients refuse to do so? Wasserman et al. (2023) maintain that refusals on the basis of supposed futility are unethical as they amount to passing off personal value judgments as medical expertise. Instead, unwillingness to carry out an intervention should be framed as conscientious objection. I argue that referring to futility with regard to a patient’s presumed quality of life is appropriate if – and only if – a (...) total and irreversible loss of consciousness has been diagnosed with adequate certainty. The diagnosis turns a graded notion into a binary affair: conscious awareness is a necessary condition of any degree of quality of life to be meaningfully ascribed to an organism. Consequently, the complete absence of consciousness precludes such an ascription; further treatment is then indeed futile from a quality-of-life standpoint. (shrink)

In dieser rekonstruktiv angelegten qualitativen Analyse wird aus systemtheoretischer Perspektive der Sozialfigur Vater nachgegangen. Ausgehend von einer historisch-genetischen Rekonstruktion der Fremdbeschreibung der gepflegten Vater-Semantik seit der Antike bis ins 21. Jahrhundert werden 14 Väter in problemzentrierten Interviews auf ihre Selbstbeschreibung hin dokumentarisch analysiert. Als Ergebnisse der Forschungsarbeit werden neben gegenwärtigen kommunikativen Spielräumen auch Rekursionen auf die im ersten Teil der Arbeit herausgestellte gepflegte Semantik deutlich, die im Sinne eines Trampelpfads komplexe Verweisungsstrukturen des kommunikativ Sagbaren abstecken. Paul Ricœur considered the theme of non-peace in self-affirmation to have such existential and phenomenological bearing that he devoted his intellectual capacity to explore the self that is never immediately present to oneself or at immediate peace with oneself. Not all reasons for such originating non-peace are well observed in Ricœur scholarship. This article proposes that Ricœur approaches the self by means of occupied spatiality or under the notion of “having” the self. The argument is made that self-affirmation is reliant (...) on objectification that, subsequently, results in the self “having” or possessing itself as an object. Such necessary structure for the process of self-affirmation leads the self to grasp a notion of itself as an expropriated appropriator; this achievement leaves the self in a perpetuated state of non-peace. Here the analysis—complementary to those already presented in Ricœur scholarship—approaches religious question-setting. Making a reference to Augustine the article accords with his personal assessment considering his “unfinished state” of needing to wait and hope for “that utter peace” when the problems of human existence do not disturb him any more. This article revisits Dolf Sternberger’s 1960 theory, which, in explicit opposition to Carl Schmitt’s friend/enemy thesis, found the essence of politics and the political in peace. The essay contextualizes Sternberger’s propositions by relating them to his immediate post-1945 considerations – such as normalizing domestic politics, jettisoning authoritarianism, and laying the conceptual foundations for the nascent political science – and thereby reconstructs the questions his theory of the political sought to answer. The analysis shows in detail how the key elements of (...) Sternberger’s 1960 theory derived from the late-1940s: rather than reflecting an already normalized political situation or proposing naïve pacifism, Sternberger’s text took political conflicts seriously and provided an outline of a desired but only prospective political peace amidst a crisis. Despite substantial polarity, Sternberger’s view is largely compatible with Schmitt’s theory once we remove context-induced polemics and grave misinterpretations – and carries potential for systematic political theorizing. Innerhalb des Gedankenexperiments eines natürlichen Zustandes bewegt sich Meier in der für seine Zeit üblichen Weise der Grundlegung einer Naturrechtslehre mit der Suche nach dem obersten Prinzip, aus dem alle weiteren Grundsätze und Regeln abzuleiten sind. Berücksichtigt man die naturrechtliche Tradition von Christian Wolff und Alexander Gottlieb Baumgarten, in die sich Meier mehrfach ausdrücklich stellt, würde man nun hier das Gebot des Strebens nach Vollkommenheit erwarten. Doch überraschenderweise legt Meier seinem Recht der Natur ein anderes Prinzip zu (...) Grunde, nämlich: „beleidige niemanden äusserlich in dem natürlichen Zustande.“ Sämtliche natürlichen Rechte und Pflichten des Menschen im Naturzustand folgen für Meier aus diesem ersten Grundsatz, der nun weniger an das Vollkommenheitsgebot des Christian Wolff erinnert als vielmehr eine systematische Parallele zu dem Bereich der für den äußeren Frieden förderlichen Handlungen des justum von Christian Thomasius aufweist, dessen Regel „Behindere andere nicht in der Ausübung ihrer Rechte“ aus den Fundamenta juris naturae et gentium dem Meierschen, „keinem andern Menschen das Seine“ zu nehmen, entspricht. Within the thought-experiment of a natural condition, Meier follows the usual method of his age by basing a doctrine of natural law on the search for a highest principle from which all further principles and rules are to be derived. Considering the tradition of Christian Wolff’s and Alexander Gottlieb Baumgarten in defining natural law, a tradition in which Meier several times expressly places himself, we would expect to find here the commandment to strive for perfection. But, surprisingly, Meier bases his natural law on a different principle: “offend no-one outwardly in the natural condition.” For Meier, all natural laws and duties of mankind in the natural condition follow from this first principle, which now seems less an echo of Christian Wolff’s precept of perfection than a systematic parallel to the sphere of actions required four outward oeace, the justum of Christian Thomasius, whose rule of “Do not hinder others in the exercise of their rights,” from the Fundamenta juris naturae et gentium correspondes to Meier’s rule not to take “from any other man what is his.”. Jakob von Uexküll’s umwelt theory opens new perspectives for understanding animal extinction. The umwelt is interpreted here as a sum of structural correspondences between an animal’s subjective experience, ecosystem, physiology, and behaviour. The global environmental crisis disturbs these meaning-connections. From the umwelt perspective, we may describe extinction as umwelt collapse: The disintegration of an animal’s umwelt resulting from the cumulative errors in semiotic processes that mediate an organism and ecosystem. The loss of umwelt-ecosystem integration disturbs “ecological memory,” which provides the (...) ecosystem with adaptive modelling and self-design capacities. Making a distinction between core and mediated umwelts, and describing different types of umwelt collapse, are suitable methods for more detailed analysis. The concept of umwelt collapse enables the reinterpretation of extinction, from an internal perspective, as a semiotic breakdown. Such an approach may help us map scenarios of animal extinction, and may lead to successful compensation strategies in adapting to environmental change. (shrink)

ZusammenfassungPflegende und Ärzte haben in der beruflichen Alltagspraxis unterschiedliche Perspektiven. Dies zeigt sich insbesondere in ethisch relevanten Entscheidungssituationen, in denen sie oft zu grundlegend unterschiedlichen Urteilen kommen. Aus dieser „Unterschiedlichkeit der Perspektiven“ können in der beruflichen Alltagspraxis mitunter erhebliche Dissonanzen entstehen, die einer konstruktiven Zusammenarbeit im Wege stehen. Die vorliegende Arbeit will zum einen den in der Praxis der klinischen Ethik gewonnenen Eindruck und die daraus formulierte These einer „perspektivischen Differenz“ empirisch nachweisen. Um dies zu leisten, wurde am Universitätsklinikum Frankfurt (...) eine quantitative Erhebung durchgeführt. Zum anderen sollen die empirischen Ergebnisse zur Erklärung in einem weiteren theoretischen Kontext verortet werden. Hierfür wird im Anschluss an Bourdieu das Habituskonzept rekonstruiert, um zu erklären, warum die perspektivische Differenz weder unmittelbar wahrgenommen wird noch ohne weiteres überwunden werden kann. Die These der perspektivischen Differenz wird durch die empirische Studie gestützt. Dieser Sachverhalt ist insbesondere vor dem Hintergrund der habitustheoretischen Rekonstruktion von erheblicher Relevanz für die klinische Ethik, die einerseits Verfahren zur diskursiven Bearbeitung ethischer Konflikte in der klinischen Praxis und andererseits Konzepte für die medizinethische Fortbildung anbietet. In this paper I argue that Adorno's metacritique of freedom in Negative Dialectics and related texts remains fruitful today. I begin with some background on Adorno's conception of ‘metacritique’ and on Kant's conception of freedom, as I understand it. Next, I discuss Adorno's analysis of the experiential content of Kantian freedom, according to which Kant has reified the particular social experience of the early modern bourgeoisie in his conception of unconditioned freedom. Adorno argues against this conception of freedom and suggests (...) that freedom is always conditioned by our embodiment and by our social and historical situation. Finally, I turn to Adorno's criticism of Kant's discussion of freedom and determinism in the Critique of Pure Reason and argue that while his philosophical argument against Kant fails, his metacritical argument remains suggestive. Scepticism about freedom arises when the standpoint of theoretical reason encroaches upon the standpoint of practical reason and assimilates persons to things. (shrink)

Da es im Zentrum von Strauss' Politischer Philosophie steht, findet der Streit seinen Niederschlag in allen großen Kontroversen, die sein OEuvre umgeben. Heinrich Meiers theologisch-politisches Traktat ist die erste Schrift zu Strauss, die das Problem, von dem Strauss sagte, es sei das Thema seiner Untersuchungen gewesen, zu ihrem Thema macht. Neben dem programmatischen Vortrag "Das theologisch-politische Problem", der auf dem (...) internationalen Leo Strauss Symposium in München im Juni 2002 große Beachtung fand, enthält sie den Kommentar "Zur Genealogie des Offenbarungsglaubens", der eine kühne genealogische Skizze von Strauss aus dem Nachlass zugänglich macht und argumentativ entfaltet, sowie den Text "Der Tod als Gott. Eine Anmerkung zu Martin Heidegger", der den Blick auf einen Philosophen richtet, auf dessen Denken das theologisch-politische Problem seinen langen Schatten geworfen hat, ohne dass es bei ihm jemals ein Thema von Gewicht war. The theory of the organism-environment system starts with the proposition that in any functional sense organism and environment are inseparable and form only one unitary system. The organism cannot exist without the environment and the environment has descriptive properties only if it is connected to the organism. Although for practical purposes we do separate organism and environment, this common-sense starting point leads in psychological theory to problems which cannot be solved. Therefore, separation of organism and environment cannot be the basis (...) of any scientific explanation of human behavior. The theory leads to a reinterpretation of basic problems in many fields of inquiry and makes possible the definition of mental phenomena without their reduction either to neural or biological activity or to separate mental functions. According to the theory, mental activity is activity of the whole organism-environment system, and the traditional psychological concepts describe only different aspects of organisation of this system. Therefore, mental activity cannot be separated from the nervous system, but the nervous system is only one part of the organism­environment system. This problem will be dealt with in detail in the second part of the article. (shrink)

Abstract According to Habermas' colonization thesis, reification is a social pathology that arises when the communicative infrastructure of the lifeworld is 'colonized' by money and power. In this paper I argue that, thirty years after the publication of the Theory of Communicative Action, this thesis remains compelling. However, while Habermas offers a functionalist explanation of reification, his normative criticism of it remains largely implicit: he never explains what is wrong with reification from the perspective of the people whose social relations (...) are reified. As a result, Habermas cannot explain why only some forms of colonization lead to reification effects. In particular, he suggests that reification effects result from the juridification of communicatively structured domains of action but not from the commodification of labour power. I criticize this argument and suggest that if the normative dimension of the colonization thesis is made explicit, a more nuanced explanation of reification becomes possible. (shrink)

In this paper I examine Axel Honneth’s normative reconstruction of the market as a sphere of social freedom in his 2014 book, Freedom’s Right. Honneth’s position is complex: on the one hand, he acknowledges that modern capitalist societies do not realise social freedom; on the other hand, he insists that the promise of social freedom is implicit in the market sphere. In fact, the latter explains why modern subjects have seen capitalism as legitimate. I will reconstruct Honneth’s conception of social (...) freedom and investigate how it is realised in the sphere in which Honneth sees it most successfully at work, the sphere of interpersonal relations. I then move on to the sphere of the market economy and discuss two related problems of this view that stem from his interpretation of Hegel. Next, I consider Honneth’s method of “normative reconstruction” and his reconstructions of the sphere of consumption and, finally, the labour market. My conclusion will be that market institutions cannot realise social freedom, and that this insight should orient the philosophical direction of critical social theory. (shrink)

In this paper I criticise Axel Honneth's reactualization of reification as a concept in critical theory in his 2005 Tanner Lectures and argue that he ultimately fails on his own terms. His account is based on two premises: (1) reification is to be taken literally rather than metaphorically, and (2) it is not conceived of as a moral injury but as a social pathology. Honneth concludes that reification is ?forgetfulness of recognition?, more specifically, of antecedent recognition, an emphatic and engaged (...) relationship with oneself, others and the world, which precedes any more concrete relationship both genetically and categorially. I argue against this conception of reification on two grounds. (1) The two premises of Honneth's account cannot be squared with one another. It is not possible to literally take a person as a thing without this being a recognisable moral injury, and, therefore, I suggest that there are no cases of literal reification. (2) Honneth's account is essentially ahistorical, because it is based on an anthropological model of recognition that tacitly equates reification with autism. In conclusion, I suggest that any successful account of reification must (i) take reification metaphorically and (ii) offer a social-historical account of the origin(s) of reification. (shrink)

George Berkeley's Siris (1744) has been a neglected work, for many reasons. Some of them are good and some bad. The book is difficult to decipher, mainly because of its ancient metaphysics. He talks about the world as an animal or plant. He speculates about man as a microcosm which is analogous to the universe as a macrocosm. He recommends tar-water as a universal medicine. This was understandable in his own time. But Siris is also a Newtonian treatise which both (...) criticizes and develops important physical and chemical theories. Berkeley's own contribution is formulated in terms of light and fire. I study these arguments in detail. It is also clear that Siris is no longer an immaterialist treatise. The doctrine of ideas is not so important to him any more. However, he never changed his doctrine of causality. I analyze several versions of it. This looks like his lasting main contribution to the philosophy of science. And causality is also theologically crucial, as I try to show. We must keep in mind the fact that Berkeley might have been interesting in the contemporary science, but he insisted that science must ultimately be ruled by religion. Science is never an autonomous or sovereign field of human enterprise. (shrink)

This paper reviews the research done in Finland on medical ethics in the last three years and published in four leading journals. The general characteristics of this area are discussed and some comments on its most conspicuous representatives are offered. The conclusion reached is that medical ethics in Finland is still in a rather embryonic stage of development, and that more systematic and theoretically sophisticated approaches are required. However, since many physicians have become interested in ethical questions, it can be (...) reasonably assumed that a more lively and theoretically grounded discussion will ensue in the near future. The monograph tells a different story on the history of modern philosophy: the narrative is no longer centred on the question whether knowledge results from experience or reason, but whether experience and reason are in fact possible without language.

English summary: This book concerns a metaphysical definition of artifacts, taken as a key term of the philosophy of technology. Due to the fact that classical determinations are not only insufficient at explicating the term but also inapplicable to real artifacts, the work tries to develop a concept of artifacts using the thought of truth given by Martin Heidegger. In so far as a hermeneutic interpretation of his oeuvre shows us, truth actually is an object-generating happening. That is why an (...) analysis of forms of judgments allows the description of factic things. Assuming that there are theoretical judgments concerning technique - wherefore technique is an historically contingent kind of metaphysics - artifacts are given as geometrical universals, meaning terms, without being able to subsume thought-independent of individuals, unless artifacts exceptionally are known as subjects of practical philosophy. German description: Diese Studie befasst sich mit der metaphysischen Bestimmung des Gegenstandes Artefakt, der fur die Technikphilosophie zentral ist. Da klassische Bestimmungen weder eine zureichende Explikation des Begriffes noch die eindeutige Identifikation solcher Sachen erlauben, greift der Autor dazu auf das Denken der Wahrheit bei Martin Heidegger zuruck.
