The Bellum Hispaniense, often considered alongside the two other pseudo-Caesarian commentarii, the Bellum Alexandrinum and the Bellum Africum, contains the account of Caesar's final battles with Pompey's forces in Spain during 46 and 45 b.c. In terms of its language and style, the BHisp. is certainly the most un-Caesarian of the pseudo-Caesarian Bella. The work abounds in phenomena belonging to different linguistic varieties, and is an important piece of evidence in the process of the standardization of written Latin.

Although the declaratory theory is arguably a central feature of common law adjudication, it is widely disparaged: either the law never changes, which is implausible, or it is changed retrospectively, which is unfair and contrary to the rule of law. These common objections are rooted in misconceptions about the nature of law. When we distinguish more clearly between the sources of law, whether in statute or precedent, and the corpus juris, shaped by general principles of justice, the declaratory theory is (...) vindicated. Structured by familiar precedents and principles, the common law offers a framework within which the rule of law is sustained by moral reflection and argument. There is a close analogy with Rawlsian reflective equilibrium. It is only in virtue of an inquiry into justice, guided but not irrevocably bound by past practice, that there is any law to be declared. Legal judgment is precisely a determination of the requirements of justice as they apply in all the circumstances. (shrink)

Testimony, even in the well-worked parts of antiquity, continues to accrue, some from new papyri, some from texts long known but overlooked. In the result the critic is discomfited, honest men come by their own. οιόνδ' πέβη τόδε πργμα. This document, which consists of two lives of Homer and the Agon inserted between them, has long been derived from the Μουσεîον of Alcidamas. The conjecture was contested and the survival of Alcidamas denied. The publication of twenty-five lines from a papyrus (...) of s. II.–III. p. C. by Professor J. G. The least attentive Hellenist must have noticed that the Greek tongue contains a number of pairs of nouns of identical or nearly related meaning—one in the masculine, the other in the feminine. The subject attracted the notice of Lobeck, Pathoiogia, pp. 7 sq., Technologia, pp. 267 sq.; G. Meyer in Curtius' Studien V., p. 68; Stein in the introduction to his Herodotus, p. lx ; and the resultant list will be found in Kuhner-Blass I., pp. 501, 502. It is not (...) complete , and the question deserves investigation. The only doctrine that can be called such appears to be the remark in schol. If ‘community’ is the answer, what is the problem? While questions undoubtedly arise in allocating resources to public health, such as ‘how much?’ and ‘to whom?’, we already have answers based on (i) the observation that disease and illness are bad, (ii) views of justice and fairness and (iii) an appreciation of market failure. What does the concept of community add to the existing answers? Not nothing, I shall argue, but not much either. In some cases, health providers should take (...) advantage of ties of community to deliver services more effectively. The desire to preserve communities may have some minor implications for devolved health care funding. The value of community may set some limits to inequalities in access to health care. That’s about it. I do consider some other claims of behalf of the concept, e.g. that people would not support justice in health care without a sense of community; but I don’t find these claims very plausible. Finally, I point out some ways in which communities can be damaged by the promotion of public health understood as population health. (shrink)

Scott explore the unfolding rift between Rousseau and Hume. The authors are particularly fascinated by the connection between the thinkers’ lives and thought, especially the way that the failure of each to understand the other—and himself—illuminates the limits of human understanding. In addition, they situate the philosophers’ quarrel in the social, political, and intellectual milieu that informed their actions, as well as the actions of the other participants in the dispute, such as James Boswell, Adam Smith, and Voltaire. By examining the conflict through the prism of each philosopher’s contribution to Western thought, Zaretsky and Scott reveal the implications for the two men as individuals and philosophers as well as for the contemporary world. At Timaeus 48e2–52d4 Timaeus sets out to establish that there are three principles or kinds underlying the creation of the cosmos, not just the two he acknowledged earlier. The way he does so is not simply by adding an account of the third kind to the accounts of being and becoming that he has already given. Rather he does so by showing how each of the three differs from the others. It has not been noticed how this procedure structures the (...) receptacle passage. The passage divides up into three parts, each punctuated by a list of the three kinds in a significant order. If we take X, Y and Z to stand for ‘becoming’, ‘being’ and ‘receptacle’ ’ respectively, the structure is X≠Z, X≠Y, Y≠Z. By showing the distinctness of each pair, Timaeus demonstrates that all the kinds are distinct and that they are indeed three in number. (shrink)

According to situationism in psychology, behavior is primarily influenced by external situational factors rather than internal traits or motivations such as virtues. Environmental ethicists wish to promote pro-environmental behaviors capable of providing adequate protection for the environment, but situationist critiques suggest that character traits, and environmental virtues, are not as behaviorally robust as is typically supposed. Their views present a dilemma. Because ethicists cannot rely on virtues to produce pro-environmental behaviors, the only real way of salvaging environmental virtue theory is (...) to reject or at least minimize the requirement that environmental ethics must provide protection and assistance to the environment. Virtue theory is often favored by environmentalists precisely because it does matter what one's reasons are for acting, even if one's actions are ineffective at producing positive results. However, because endorsing behaviorally ineffective virtues, for whatever reason, entails that environmental ethicists are abandoning the goal of helping and protecting the environment, environmental ethicists should consider looking elsewhere than virtues and focus instead on the role of situations.
