Background Diversity in Institutional Review Board (IRB) membership is important for both intrinsic and instrumental reasons, including fairness, promoting trust, improving decision quality, and responding to systemic racism. Yet U.S. IRBs remain racially and ethnically homogeneous, even as gender diversity has improved. Little is known about IRB chairpersons’ perspectives on membership diversity and barriers to increasing it, as well as current institutional efforts to promote diversity, equity, and inclusion (DEI) within IRB membership.Methods We surveyed IRB chairpersons leading U.S. boards registered (...) with the Office for Human Research Protections. Here, we focus exclusively on responses from a subset of 388 chairpersons of IRBs at universities and academic medical centers (AMCs).Results Board chairs were predominantly white and evenly split between men and women. Only about half reported that their boards had at least one member who is Black or African American (51%), Asian (56%), or Hispanic (48%), with 85% of university/AMC boards comprised entirely (15%) or mostly (70%) of white members. Most IRB chairpersons (64%) reported satisfaction with the current diversity of their membership. Participants largely agreed that considering diversity in the selection of IRB members is important (91%), including to improve the quality of IRB deliberation (80%), with an emphasis on racial/ethnic (85%) and gender diversity (74%). Most participants (80%) reported some type of active DEI effort regarding board membership at their university/AMC and just over half (57%) expressed satisfaction with these efforts.Conclusions Our national survey found that although university/AMC IRB chairpersons report valuing diversity in board membership, it may be lacking in key areas. Going forward, it will be important to specify clear reasons for diversity in the IRB context, as well to establish targets for acceptable levels of board diversity and to match DEI efforts to those targets. His contributions have ranged from key work on the structure of the genetic code and the existence of mRNA through the development of Caenorhabditis elegans as a key model system in developmental biology to genomic analysis and function in vertebrates. A major objection to the view that the relation of persons to human animals is coincidence rather than identity is that on this view the human animal will share the coincident person's physical properties, and so should (contrary to the view) share its mental properties. But while the same physical predicates are true of the person and the human animal, the difference in the persistence conditions of these entities implies that there will be a difference in the properties ascribed by (...) these predicates, with the result that the physical properties that determine the person's mental states will belong to the person and not to the human animal. The Covid‐19 pandemic has concentrated bioethics attention on the “lifeboat ethics” of rationing and fair allocation of scarce medical resources, such as testing, intensive care unit beds, and ventilators. This focus drives ethics resources away from persistent and systemic problems—in particular, the structural injustices that give rise to health disparities affecting disadvantaged communities of color. Bioethics, long allied with academic medicine and highly attentive to individual decision‐making, has largely neglected its responsibility to address these difficult “upstream” issues. It is time (...) to broaden our teaching, research, and practice to match the breadth of the field in order to help address these significant societal inequities and unmet health needs. (shrink)

Sydney Shoemaker is one of the most influential philosophers currently writing on philosophy of mind and metaphysics. He defends the view that perceptual and sensory states have non-representational features - 'qualia' - that determine what it is (...) like to have them. It is commonplace to point out that Alfred Kinsey's taxonomic work on gall wasps provided a methodology for his studies of human sexual behavior. It is equally commonplace to point out that, when researching and presenting his sexual studies, Kinsey's professedly neutral scientific data were constrained by a social agenda. What I have done in this paper is to join these two claims and demonstrate, with particular reference to Kinsey's Sexual Behavior in the Human Male, how his zoology helped guide (...) Kinsey to a naturalistic ethics that, despite contrasts to, shared certain parallel logical failures with the traditional ethics of his critics. (shrink)

In Physical Realization, Sydney Shoemaker considers the question of how physicalism can be true: how can all facts about the world, including mental ones, be constituted by facts about the distribution in the world of physical properties? Physicalism requires that the mental properties of a person are 'realized in' the physical properties of that person, and that all instantiations of properties in macroscopic objects are realized in microphysical states of affairs. Shoemaker offers an account of both these sorts of (...) realization, one which allows the realized properties to be causally efficacious. He also explores the implications of this account for a wide range of metaphysical issues, including the nature of persistence through time, the problem of material constitution, the possibility of emergent properties, and the nature of phenomenal consciousness. It is widely agreed upon that morality guides people with conflicting interests towards agreements of mutual benefit. We therefore might expect numerous proposals for organizing human moral cognition around the logic of bargaining, negotiation, and agreement. Yet, while “contractualist” ideas play an important role in moral philosophy, they are starkly underrepresented in the field of moral psychology. From a contractualist perspective, ideal moral judgments are those that would be agreed to by rational bargaining agents—an idea with wide-spread support in philosophy, (...) psychology, economics, biology, and cultural evolution. As a practical matter, however, investing time and effort in negotiating every interpersonal interaction is unfeasible. Instead, we propose, people use abstractions and heuristics to efficiently identify mutually beneficial arrangements. We argue that many well-studied elements of our moral minds, such as reasoning about others’ utilities (“consequentialist” reasoning) or evaluating intrinsic ethical properties of certain actions (“deontological” reasoning), can be naturally understood as resource-rational approximations of a contractualist ideal. Moreover, this view explains the flexibility of our moral minds—how our moral rules and standards get created, updated and overridden and how we deal with novel cases we have never seen before. Thus, the apparently fragmentary nature of our moral psychology—commonly described in terms of systems in conflict—can be largely unified around the principle of finding mutually beneficial agreements under resource constraint. Our resulting “triple theory” of moral cognition naturally integrates contractualist, consequentialist and deontological concerns. (shrink)

This paper aims to address when the wise person should participate in politics. The question is addressed through engagement with the Analects. Rather than provide interpretations of key terms in the Analects, we provide an account of wisdom that draws from themes in the Analects. The case is made that the wise person is committed to participating in politics primarily because of the connection between wisdom and benevolence (ren 仁 in the Analects). We address challenges to the Confucian approach from (...) the Zhuangzi concerning the potential harms of political participation. General political disengagement is not considered exemplary on the Confucian approach to wisdom, although when political engagement may be eschewed is explored. Finally, the case is made that while ren motivates the wise to participate politically, the wise also have a sense of timeliness that provides guidance as to when to refrain or withdraw from political participation. Money plays a powerful role in modern medicine, both in terms of how health services are organized and delivered and increasingly in how physicians understand themselves and their work. The phrase “the hegemony of money” is intended to capture that power.

The paper defends the view that there is a constitutive relation between believing something and believing that one believes it. This view is supported by the incoherence of affirming something while denying that one believes it, and by the role awareness of the contents one’s belief system plays in the rational regulation of that system. Not all standing beliefs are accompanied by higher-order beliefs that self-ascribe them; those that are so accompanied are ones that are “available” in the sense that (...) their subjects are poised to assent to their contents, to use them as premises in reasoning, and to be guided by them in their behavior. The account is compatible with the possibility of negative self-deception—mistakenly believing that one does not believe something—but the closest thing to positive self-deception it allows is believing falsely that a belief with a certain content is one’s dominant belief on a certain matter through failure to realize that one has a stronger belief that contradicts it. The view has implications about Moore’s paradox that contradict widely held views. On this view self-ascriptions of beliefs can be warranted and grounded on reasons—but the reasons are not phenomenally conscious mental states (as held by Christopher Peacocke) but rather available beliefs. Much has been written about the importance of narrative in teaching ethics and humanities to medical students and residents, as well as the value of narratives in clinical care. Relatively little has been said about the essential role of narrative in bioethics consultations. For most consults, the interpretation of narratives is the central moral feature, and the ethics consultant is inevitably one of the narrators. In a recent consult in which I participated, at least three narratives were in play. The (...) medical record itself was a narrative, or really, a variety of narratives. A second distinct narrative was the story of why this case had come to be categorized as an ethical concern for the medical team. A third narrative was the tentative sketch running through my mind as a consultant‐partly factual, partly anticipatory and conjectural, inevitably personal‐about what was going on here. (shrink)

Since his editorship in 1974 of the volume Lectures and Conversa· tions: Aesthetics, Psychology, and Religious Belief, Cyril Barrett's name has been associated with the interpretation of Wittgenstein's views on ethics and religious belief. At last we have in hook form his comprehensive exposition of this important dimension of the philosopher's thought. Barrett ranges from the Notebooks 1914-1916 all the way to remarks in On Certainty that stem from only a few days before Wittgenstein 's death. In addition to placing pertinent remarks of early and late periods in the context of the relevant major works and their chief themes, Barrett also expounds and analyses such shorter, more explicit treatments of ethics and religious belief as the " Lecture on Ethics," the "Remarks on Frazer's Golden Bough," and the remarks collected in Vermischte Bemerkungen (Remarks on Culture and Value). The hook is sympathetic in tone-perhaps too much so. The reader quite often feels-as I will make plain in what follows-that Barrett interprets Wittgenstein in a way that obscures the strangeness of his thought, tending to assimilate it too readily to the mainstream of Western theological reflection. Barrett has a three-fold program: "to show that (a) what Wittgen· stein has to say on ethics and religious belief was for him of the ut· most importance, if not sole importance; (h) his views on these subjects did not radically alter throughout his life, appearances to the contrary notwithstanding; and (c) what Wittgenstein said about ethics was intimately interwoven with what he said about religious belief " (xiv). The elements of this program call for different sorts of evalua· 530 BOOK REVIEWS tion. Clearly Wittgenstein thought ethics and religious belief were im· portant. So the question is whether Barrett's claim, that for Wittgen· stein they are the most important elements of his work or even the only important elements of his work, is an exaggeration. Barrett takes as determinative such remarks as Wittgenstein's statement to Ludwig Ficker that the point of the Tractatus is ethical, and he must explain or discount the fact that the vast hulk of his work has little obvious hearing on ethics or religion. Or if the hulk of that work is ethical and religious, then these terms come to mean, in a Wittgensteinian context, something quite different from their senses in Barrett's somewhat domesticated reading. As for the third element in the program-the interweaving of ethics and religion-this, too, is a question of degree. And the question is whether Barrett's analysis, keeping as it does to relatively standard notions of what constitutes religious belief, really does justice to Wittgenstein's insistence that religion must he a way of life rather than a body of doctrine. But it is Barrett's second thesis which is most interesting, most difficult to understand, and most promising, if it is true, for helping us to understand Wittgenstein's thought on ethics and religion. Barrett writes: " Wittgenstein did not abandon his earlier views on ethics and religious belief with their attendant notions of the mystical, transcendental, inexpressible, viewing sub specie aetemitate.... (T) here is no compelling reason to assume such a radical change of view and... all the features of the earlier views can he fitted into the new conceptions of language-games and forms of life" (xiii). In March 1996, the General Accounting Office (GAO) issued the reportScientific Research: Continued Vigilance Critical to Protecting Human Subjects.It stated that “an inherent conflict of interest exists when physician-researchers include their patients in research protocols. If the physicians do not clearly distinguish between research and treatment in their attempt to inform subjects, the possible benefits of a study can be overemphasized and the risks minimized.” The report also acknowledged that “the line between research and treatment is not always cleartoclinicians. Controversy (...) exists regarding whether certain medical procedures should be categorized as research.”This problem currently plagues gene transfer research. A few months prior to the GAO report, an ad hoc committee appointed by National Institutes of Health (NIH) Director Harold Varmus expressed similar concerns in its assessment of NIH investment in research on gene therapy. Since the appearance of a widely influential book, Self-Knowledge and Self-ldentity, Sydney Shoemaker has continued to work on a series of interrelated issues in the philosophy of mind and metaphysics. This volume contains a collection of the most important essays he has published since then. The topics that he deals with here include, among others, the nature of personal and other forms of identity, the relation of time to change, the nature of properties and causality and the relation between (...) the two, dualism and immortality, and the nature of mental states. All the essays show the same care and precision in argument as the earlier book, but they also reveal a substantial shift in Professor Shoemaker's position to a form of materialism. In fact, a number of papers together constitute what is probably the most subtle and rigourous defence yet of a sophisticated functionalism in the account of the mind. (shrink)

Philosophical concerns about nuclear armaments raises questions about the logical and conceptual basis for deterrence theory as well as the effects of nuclear threats on our common humanity. Most philosophical concern centers around around the morality of nuclear deterrence. It is sometimes thought that the doctrine of just war can provide a moral justification for nuclear deterrence based on threats of massive retaliation. Ye attempts to apply the doctrine of just war lead to a moral dilemma: although nuclear deterrence seems (...) justified as self-defense, there are compelling reasons for concluding that threats of retaliation are immoral. Alternative deterrence policies might be thought to overcome the moral dilemma. However, counterforce strategy and anti-missile defense, as recently proposed by President reagan, must still depend upon immoral threats of retaliation. Proposals for a nonviolent national defense offer a possible solution, and serious attention should be given to claims that nonviolent defense is relevant in the nuclear age and would deter aggression. Wittgenstein's insistence in his later philosophy that explanation comes to an end in the explication of what it is to follow a rule provides a locus for the awakening of wonder, analogous to the mystical awe referred to in the "Tractatus". While Wittgenstein did not explore this analogy, it provides a point of entry into the examination of the relevance of his work to religious concerns. Every regular practice is built on capacities of reaction, uptake, and response which are the (...) endpoints of explanation, whose sheer givenness in their relation to our physical and social environment can bring on amazement. This wonder at the end of explanation has been explored -- from quite a different perspective -- by Stephen Gould, whose conclusions complement Wittgenstein's own. (shrink)

Emergence requires that the ultimate physical micro-entities have “micro-latent” causal powers, which manifest themselves only when the entities are combined in ways that are “emergence-engendering,” in addition to the “micro-manifest” powers that account for their behavior in other circumstances. Subjects of emergent properties will have emergent micro-structural properties, specified partly in terms of these micro-latent powers, each of which will be determined by a micro-structural property specified only in terms of the micro-manifest powers of the constituents and the way they (...) are related. If the determiner and the determined properties are distinct, this determination is the basis of the supervenience of emergent properties on non-emergent physical properties. If not, emergence does not involve such supervenience. Either way, there is no problem with diachronic downward causation. (shrink)

Thanks to Barbeyrac, Pufendorf and others, there is a long-familiar picture of Grotius as offering a groundbreaking account of natural law. By now there is also a familiar observation that there is no agreement what makes Grotius’s account innovative. Sometimes this leads to skepticism about how innovative Grotius’s account of natural law really is. Some scholars suggest that Grotius’s account of natural law resembles Suárez’s account. But others continue to argue that Barbeyrac is right to see Grotius as breaking the (...) ice of previous philosophy and laying the groundwork for a distinctively modern moral philosophy. I plan to contribute to the debate by arguing that, properly understood, Grotius’s position is similar to Suárez’s on a range of fundamental questions, and, furthermore, that seeing Grotius as making a radical break with the past violates his own self-conception. 1. The multiple emergencies of global heating require bioethicists to embrace the dormant, comprehensive bioethics legacy of Van Rensselaer Potter, moving beyond the current narrower focus of the field on medicine and health care. We recommend readings that expand the core literature of bioethics to address key environmental issues. These are Jessica Pierce and Andrew Jameton's The Ethics of Environmentally Responsible Health Care; Dale Jamieson's Reason in a Dark Time; and David Wallace‐Well's The Uninhabitable Earth. Because efforts to mitigate climate disasters (...) are likely to be only partially successful, we also recommend the teachings of late Roman Stoicism and core texts of Buddhism, which provide ethical wisdom likely to be needed in the multiple crises of the Anthropocene. Any property has two sorts of causal features: “forward-looking” ones, having to do with what its instantiation can contribute to causing, and ldquo;backward-looking” ones, having to do with how its instantiation can be caused. Such features of a property are essential to it, and properties sharing all of their causal features are identical. Causal necessity is thus a special case of metaphysical necessity. Appeals to imaginability have no more force against this view than they do against the Kripkean view that (...) statements like “Gold is an element” are metaphysically necessary. (shrink)

This early work by Sydney Smith was originally published in 1854 and we are now republishing it with a brand new introductory biography. 'Elementary Sketches of Moral Philosophy' is a collection of lectures delivered by Smith at the Royal Institution in the years 1804, 1805, and 1806. Sydney Smith was born on 3rd June 1771 in Woodford, Essex, England. Smith's first book 'Six Sermons, preached in Charlotte Street Chapel, Edinburgh' was published in 1800. He married Catharine Amelia Pybus (...) in the same year and the couple settled in Edinburgh. While there, he helped set up the 'Edinburgh Review' and became its first editor in 1802. He continued to write articles for the review for the next quarter of the century which were a key element to the publication's success. (shrink)

Various theories of moral cognition posit that moral intuitions can be understood as the output of a computational process performed over structured mental representations of human action. We propose that action plan diagrams—“act trees”—can be a useful tool for theorists to succinctly and clearly present their hypotheses about the information contained in these representations. We then develop a methodology for using a series of linguistic probes to test the theories embodied in the act trees. In Study 1, we validate the (...) method by testing a specific hypothesis (diagrammed by act trees) about how subjects are representing two classic moral dilemmas and finding that the data support the hypothesis. In Studies 2–4, we explore possible explanations for discrete and surprising findings that our hypothesis did not predict. In Study 5, we apply the method to a less well‐studied case and show how new experiments generated by our method can be used to settle debates about how actions are mentally represented. In Study 6, we argue that our method captures the mental representation of human action better than an alternative approach. A brief conclusion suggests that act trees can be profitably used in various fields interested in complex representations of human action, including law, philosophy, psychology, linguistics, neuroscience, computer science, robotics, and artificial intelligence. Lai asks, “What does the cicada catcher know that Confucius doesn’t?” The knowledge that Confucius and his disciples seek may be precisely what they can never have. I explore the epistemological rift between ways of knowing by applying Karen Amimoto Ingersoll’s distinction between “seascape epistemology” (based on Native Hawaiian, Kānaka Maoli, ways of knowing) (...) and Western epistemology (framed as girding neocolonialist expansion on the Hawaiian Islands).
