Caribbean thinkers Suzanne Césaire and Édouard Glissant introduce their readers to more-than-human figures – the plant-human and beach walker respectively – that theorize new ways of being. Accompanied by an epistemological shift, the figures disrupt Western colonial binaries and render them inoperative. This paper argues via Audre Lorde’s work that we can understand these speculations on ‘the human’ as a double move of creating one’s being and a new (self-)understanding thereof. It has become common to distinguish between altruistic and commercial contract motherhood (or ‘surrogacy’). Altruistic arrangements are based on the ‘gift relationship’: a woman is motivated by altruism to have a baby for an infertile couple, who are free to reciprocate as they see fit. By contrast, in commercial arrangements both parties are motivated by personal gain to enter a legally enforceable agreement, which stipulates that the contract mother or ‘surrogate’ is to bear a child for the intending parents in (...) exchange for a fee. She is required to undergo medical examinations and to refrain from behaviour that could harm the foetus. The intending parents are the child's legal parents from the outset. The parties to the contract can, but are not expected to, maintain contact after the transaction is completed. We argue that contract motherhood should not be organized according to the norms of the gift relationship, and that contract mothers should be compensated for their labour. However, we accept that there are good reasons for rejecting the commercial model as a suitable framework for contract pregnancy, and argue, instead, in favour of viewing it as a profession. The United Nations General Assembly adopted the Universal Declaration of Human Rights in 1948. A burgeoning human rights movement followed, yielding many treaties and new international institutions and shaping the constitutions and laws of many states. Yet human rights continue to be contested politically and legally and there is substantial philosophical and theoretical debate over their foundations and implications. Recent evidence shows that dynamic instability is the dominant mechanism for the assembly of pure tubulin in vitro and for the great majority of microtubules in the mitotic spindle and the interphase cytoplasmic microtubule complex. The basic concepts of this model provide a framework for future characterization of the molecular basis of spatial and temporal regulation of microtubule dynamics in the cell and the function of microtubule dynamics in motile processes such as chromosome movement.

To what extent, if any, does Universal Grammar (UG) constrain second language (L2) acquisition? This is not only an empirical question, but one which is currently investigable. In this context, L2 acquisition is emerging as an important new domain of psycholinguistic research. Three logical possibilities have been articulated regarding the role of UG in L2 acquisition: The first is the hypothesis that claims that no aspect of UG is available to the L2 learner. The second is the hypothesis that claims (...) that only LI instantiated principles and LI instantiated parameter-values of UG are available to the learner. The third, called the hypothesis, asserts that UG in its entirety constrains L2 acquisition. (shrink)

Sexual abuse by clergymen, poisoned water, police brutality—these cases each involve two wrongs: the abuse itself and the attempt to avoid responsibility for it. Our focus is this second wrong—the cover up. Cover ups are accountability failures, and they share common strategies for thwarting accountability whatever the abuse and whatever the institution. We find that cover ups often succeed even when accountability mechanisms are in place. Hence, improved institutions will not be sufficient to prevent accountability failures. Accountability mechanisms are tools (...) that people must be willing to use in good faith. They fail when people are complicit. What explains complicity? We identify certain human proclivities and features of modern organizations that lead people to become complicit in the wrongdoing of others. If we focus exclusively on the design of institutions, we will fail to constrain the perpetrators of wrongdoing. Understanding complicity is key to understanding accountability failures. (shrink)

We do not know how much clinical physicians carrying out clinical trials in oncology and haematology struggle with ethical concerns. To our knowledge, no empirical research exists on these questions in a Nordic context. Therefore, this study aims to learn what kinds of ethical challenges physicians in Sweden, Denmark and Finland (n = 29) face when caring for patients in clinical trials; and what strategies, if any, they have developed to deal with them. The main findings were that clinical cancer (...) trials pose ethical challenges related to autonomy issues, unreasonable hope for benefits and the therapeutic misconception. Nevertheless, some physicians expressed that struggling with such challenges was not of great concern. This conveys a culture of hope where health care professionals and patients uphold hope and mutually support belief in clinical trials. This culture being implicit, physicians need opportunities to deliberately reflect over the characteristics that should constitute this culture. (shrink)

While lawyers' independence initially developed as a way of protecting lawyers and their clients from the power of the state, it is now also associated with the protection of the public interest from lawyers who are too close to their clients. In this context independence is seen as a way of ensuring that lawyers act ethically, that is, with regard to their overriding duty to the court and the administration of justice rather than according to sectional, personal or economic interests. It has been noted in various contexts that lawyers who work closely with powerful clients may be less able to withstand client pressure and uphold their obligations to the administration of justice. In-house lawyers are seen as particularly vulnerable due to their position within the client's organisational structure. On the other hand some have argued that the position of in-house lawyers gives them greater potential to exercise independent judgment and influence the ethical behaviour of their organisation. This paper argues that the concept of independence is multi-faceted with the essential aspect being the capacity for independent judgment or independence of mind. This is supported by status, power and structural protections. The paper goes on to critically consider the courts' interpretations of independence of in-house counsel in the context of claims of client legal privilege (also known as legal professional privilege). The paper argues that the judicial tests reveal a number of different approaches with limited connection to core concepts of independence. (shrink)

In this guest column, the medieval historian Caroline Walker Bynum uses her recent experiences as a hospital volunteer advocate for victims of sexual assault and domestic violence in New York City to meditate on the progressive politics of her younger days in the 1960s, on her current doubts about the efficacy of political action, and on the virtue of silent listening.

In this exciting new study, Eugene Gogol interweaves three strands that form the intellectual bedrock for the concept of the Other in the Latin American context: Hegel's dialectic of negativity, Marx's humanism, and autochthonal emancipatory thought. From this foundation, the book explores the relation of liberatory philosophic thought to today's social and class movements. Gogol considers the logic of capitalism on Latin American soil, the ecological crisis in Latin America, and the concept and practice of self-liberation. Still one of the (...) most contested terrains of Latin American thought, the Other has been of central concern for many luminary thinkers including Leopoldo Zea, Octavio Paz, and José Carlos Mariátegui. While these writers may not garner much publicity in the world press, the highly public and ongoing struggles of the Zapatistas and Brazil's Landless Workers Movement demonstrate the continuing need to theorize the volatile nature of Latin American social reality. In this essay Suzanne Rice examines Aristotle's ideas about virtue, character, and education as elements in an Aristotelian conception of good listening. Rice begins by surveying of several different contexts in which listening typically occurs, using this information to introduce the argument that what should count as “good listening” must be determined in relation to the situation in which listening actually occurs. On this view, Rice concludes, there are no “essential” listening virtues, but rather ways of listening that may (...) be regarded as virtuous in the context of particular concrete circumstances. Throughout his literary career Walker Percy read and studied the philosophical thought of Charles Sanders Peirce in an attempt to re-present in language the world as Percy knew it. Beginning in 1984 and ending in 1990, the year of his death, Percy corresponded with Kenneth Laine Ketner about the "semiotic" of Peirce. Their letters - honest, instructive, and often filled with down-home humor - record an epistolary friendship of two men both passionately interested in Peirce's theory of signs. This research aims to explore the relationship between corporate governance and CSR: What are the major factors that play a direct role in the establishment of this relationship? How does context and institutional background impact upon the relationship between CSR and Governance? Using in-depth semi-structured interviews from two types of governance systems in three countries over three years, this study has demonstrated that in practice, within different settings, CSR is being used both as a strategy as well as a reaction (...) to different drivers. We call this adaptive governance where governance can be defined as a flexible system of action incorporating strategic and monitoring activities that determines the way a company enacts its responsibilities to its shareholders and stakeholders and which is determined at any given time by the interrelationship of institutional drivers and behavioural norms. Governance systems and their interrelationships with CSR are demonstrated as fluid according to the national and institutional context, economic situation and industry impact. In the eyes of practitioners corporate governance includes both structural and behavioural factors as well as responsibilities and actions towards shareholders and stakeholders. Contextual factors that this research highlights to be important to the incorporation of CSR into governance include the economic environment, national governance system, regulation and soft law, shareholders, national culture, behavioural norms and industry impacts. Hypotheses on the impact of institutional contexts, industry impacts and economic situations on different types of CSR actions are proposed for further research. (shrink)

This article discusses the nature of euthanasia, and the way in which redevelopment of the concept of euthanasia in some influential recent philosophical writing has led to morally less discriminating killing/letting die/not saving being misdescribed as euthanasia. Peter Singer's defence of non-voluntary ‘euthanasia’of defective infants in his influential book Practical Ethics is critically evaluated. We argue that Singer's pseudo-euthanasia arguments in Practical Ethics are unsatisfactory as approaches to determining the legitimacy of killing, and that these arguments present a total utilitarian (...) improvement policy—not a case for non-voluntary euthanasia.
