O objetivo do estudo foi identificar e caracterizar a produção do conhecimento dos pesquisadores que atuam nas Instituições de Ensino Superior do estado do Ceará. As conclusões apontaram que o desafio que se coloca é a constituição de Programas de Pós Graduação em Educação Física para o Nordeste que superem as lacunas impostas pela própria política de Pós-Graduação na área 21, que privilegia a subárea da biodinâmica e intensifica a fragmentação do conhecimento entre as ciências humanas e sociais, e as (...) ciências biológicas e da saúde, identificadas pelas características das tendências temáticas, epistemológicas e teóricas, que apontam para diferentes perspectivas de formação humana. Objetivamos elaborar um balanço sobre lógica das perguntas científicas na produção do conhecimento stricto sensu. Tomamos como fontes 100 dissertações e 32 teses escritas por docentes que trabalham em cursos de Educação Física no Estado da Bahia – 1982 a 2018, abordando enquanto objeto a lógica instituída pelas perguntas científicas na referida produção. Trata-se de uma pesquisa documental, tendo como método o materialismo histórico e dialético. Os resultados apontam que 48% das produções têm suas perguntas de investigação construída (...) a partir da lógica formal; 28% apresenta uma lógica dialética na elaboração das perguntas científicas; e 24% não apresentam problema de investigação. Este estudo objetiva relacionar a felicidade epicurista, particularmente a partir da análise da Carta a Meneceu, de Epicuro (341 a.C.-260 a. C.) ao sofrimento psíquico de pós-graduandos stricto sensu, pertencentes ao atual sistema social capitalista. A pesquisa de campo e de método mistos, utilizou como instrumento para a coleta de dados um survey interseccional, respondido por 76 discentes de um Programa de Pós-Graduação stricto sensu em Educação (PPGE), localizado no estado do Paraná-PR. A análise dos resultados (...) ocorreu a partir do conceito de felicidade expresso por Epicuro de Samos, além de pesquisadores contemporâneos que dissertam sobre o conceito de felicidade na contemporaneidade. Os resultados indicam que há uma ascendência nos casos de sofrimento psíquico dentro do ambiente acadêmico da pós-graduação, o que gera descontentamento, ansiedade e, consequentemente, infelicidade. Observou-se também que o sistema social capitalista, nos distancia da temperança, da ética e da moralidade, não obstante, também da felicidade enquanto conceito epicuriano. (shrink)

Esta pesquisa exploratória-descritiva analisou o panorama evolutivo dos projetos de pesquisa associados aos Programas de Pós-graduação brasileiros que estão relacionados diretamente com a pesquisa em Gastronomia. Para tanto, foram sistematizados os Dados Abertos disponibilizados pela Coordenação de Aperfeiçoamento de Pessoal de Nível Superior (Capes) sobre os projetos de pesquisa associados aos docentes dos Programas de Pós-graduação (PPGs). A análise de conteúdo foi a técnica utilizada para o tratamento dos dados. Conduziu-se uma busca lexical através de termos relacionados à Gastronomia para (...) identificar os projetos pertinentes. Após análise do resultado dessa busca, 107 projetos de pesquisa compuseram o corpus. As seguintes variáveis foram definidas a partir da base de dados consolidada: a) tipo de projeto; b) ano da coletada da informação sobre o projeto; c) Instituição de Ensino Superior; d) título do PPG; e) Área e Subárea de conhecimento da Capes em que o PPG estava associado. As variáveis foram tratadas de forma a apresentar o panorama evolutivo desses projetos. As descrições dos projetos foram tratadas a posteriori, resultando em 11 categorias temáticas. Os resultados apresentados reforçam a inerente multidisciplinaridade, multiplicidade temática e teórico-metodológica e a institucionalização da pesquisa em Gastronomia no Brasil. (shrink)

In this paper, we adopt a physiological perspective in order to produce an intelligible overview of biological transmission in all its diversity. This allows us to put forward the analysis of transmission mechanisms, with the aim of complementing the usual focus on transmitted factors. We underline the importance of the structural, dynamical, and functional features of transmission mechanisms throughout organisms’ life cycles in order to answer to the question of what is passed on across generations, how and why. On this (...) basis, we propose a vision of biological transmission as networks of heterogeneous physiological mechanisms, not restricted to transmission mechanisms stricto sensu. They prove to be themselves suited candidates for evolutionary explanations. They are processes both necessary for evolution to happen and resulting themselves from evolution. This leads us to call for a strategy of endogenization to account for transmission, and more specifically inheritance, as evolved and evolving physiological mechanisms. (shrink)

This article looks at the complexity of the thought processes that lead Seneca's Oedipus to choose the mors longa of blindness as punishment for his crime. It offers an analysis of the consolation of this existence on the threshold between life and death, notably with reference to the end of the Oedipus, but also of the sorrow of this liminal existence. The latter is described in Seneca's Phoenissae, which suggests an escape, by death stricto sensu, from the threshold (...) represented by blindness, by which Oedipus now feels trapped.By examining these three topics, the article shows how the threshold between life and death which Oedipus chooses at the end of Seneca's Oedipus and experiences in the Phoenissae mirrors the ambivalence and the errors of his life before he blinded himself. Ultimately, it also illustrates Oedipus’ continuing failure to achieve self-knowledge. (shrink)

Before I even begin, before even a preface or an epigraph, allow me to make two confessions or concessions. Both of them have to do with the fable and the phantasm, that is to say, with the spectral. The fabulous and the phantasmatic have a feature in common: stricto sensu and in the classical sense of these terms, they do not pertain to either the true or the false, the veracious or the mendacious. They are related, rather, to (...) an irreducible species of the simulacrum or of virtuality. The ampliativity of deduction has been defended in several ways—such as the semi-decidability of the theories, the surprise of unexpected consequences, the need of new individuals in deduction, or ampliative inference as deduction with suppressed premises (Dummett, Frege. Philosophy of mathematics. Duckworth, London, 1991; Hintikka, Logic, language-games and information. Oxford University Press, Oxford, 1973; Musgrave, Imre Lakatos and theories of scientific change. Kluwer, Boston, 1989; Rota, Indiscrete thoughts. Birkhäuser, Boston, 1997). These lines of defensive arguments fail if we characterize ampliativity (...) in a strong way, that is, in terms of ‘novelty’ stricto sensu, as an inferential process producing genuinely new pieces of information in the conclusion of a reasoning (Cellucci, Rethinking logic. Springer, Dordrecht, 2013; Ippoliti, Heuristic reasoning. Springer, Basel, 2015). Nevertheless, it is possible to defend a weaker stance of the ampliativity of deduction and its usefulness. This requires interpreting novelty more loosely, that is, as the inferential production of new relations among known entities. This stance maintains that, in this sense, deduction can provide us with new knowledge. Thus, a typical deductive activity, as re-proving theorems, can be thought as heuristic and ampliative because it establishes new relations between known elements (e.g. between given axioms or properties and the statement of the theorem). I argue that also this line of defence is defective for it does not account for the necessity and usefulness of reproving theorems. In particular, a foundationalist, axiomatic-deductive viewpoint does not fully account for the usefulness and the weak ampliative power of deduction. (shrink)

The purpose of this article is to make a rational reconstruction of the use of the proportionality test in contexts of judicial adjudication of constitutional social rights. This reconstruction will be developed in two stages. Firstly, I will deal with the question of whether the proportionality test in its variation by omission (that is, in cases of positive rights) exhibits or not a different structure with respect to its (better known and developed) variation by excess (that is, in cases of (...) negative rights). Secondly, I will describe the rules and forms of argumentation implied in the use of the proportionality test by omission, which constitute its respective sub-tests of suitability, necessity and proportionality stricto sensu. I introduce a new version of Moral Error Theory, which I call Type-B Moral Error Theory. According to a Type-B theorist there are no facts of the kind required for there to be morality in stricto sensu, but there can be irreducible ‘normative’ properties which she deems, strictly speaking, to be morally irrelevant. She accepts that there are instrumental all things considered oughts, and categorical pro tanto oughts, but denies that there are categorical all things considered oughts on (...) pain of requiring ‘queer’ facts to obtain. I detail the most central motivation of this version of the theory against its more traditional rival, according to which there are no irreducible normative properties at all. The motivation is that it, unlike its rival, can successfully be defended against the notorious charge of self-defeat. (shrink)

:Recent years have seen an increase of interest on the part of human rights theorists in the “supply-side” of human rights, i.e., in the duties or obligations correlative to human rights. Nevertheless, faced with the practically urgent and seemingly simple question of who owes the duties related to international human rights, few human rights theorists provide an elaborate answer. While some make a point of fitting the human rights practice and hence regard states as the sole human rights duty-bearers merely (...) by referring to that practice, others criticize the “state-centric” approach to human rights duty-bearers and expand the scope of the latter to include any international institution beyond the state and even private actors. Curiously, however, even those more expansive accounts of human rights duty-bearers are usually very evasive about why it should be so and especially how it should work. The time has come to broach anew the issue of the bearers of human rights duties, and responsibilities of international institutions in human rights theory, addressing two challenges: focusing on relational and directed human rights duties specifically and not on duties of global justice in general, thereby distinguishing between human rights duty-bearers and other bearers of responsibilities for human rights, on the one hand, and accounting for and justifying the point of international human rights law and practice in this respect, thereby also securing internal arguments for reform, on the other. The essay’s argument is four-pronged. It starts with a few reminders about the relational nature of human rights and the relationship between human rights and duties and what this means for the specification of human rights duties. It then focuses more specifically on the identification of human rights duty-bearers, i.e., states and international institutions of jurisdiction like the European Union, and the allocation of human rights duties to them. The third section of the article is devoted to the concurrent moral responsibilities for human rights that are incurred by other various responsibility-bearers outside institutions of jurisdiction. In the final section, the essay considers the revolution potential of the EU’s fast-developing human rights’ duties, and discusses the normative implications of the development of universal international institutions’ human rights duties stricto sensu for international law and politics more generally. Resumen: Aunque la funcionalidad y versatilidad de la perspectiva comparada es una cuestión prioritaria para una total optimización del análisis de las migraciones internacionales. No toda perspectiva o metodología de investigación comparada puede ser considerada comparación jurídica. Este artículo no pretende ser ni recoger un compendio de virtudes y defectos atribuibles a la investigación jurídica comparada en el ámbito concreto de la inmigración. Más bien, revisando algunas publicaciones, se propone reconsiderar críticamente cual es el rol de la comparación jurídica en (...) el estudio interdisciplinar de la inmigración. A tal efecto, a modo ilustrativo se han valorado los puntos débiles y fuertes de algunos ejemplos de análisis comparados sobre la inmigración y la integración a nivel europeo.Abstract: Currently, despite the functionality and versatility of the comparative approach are priority questions for the full optimization of the international immigration framework’s analysis. All kinds of comparative research method could not be peacefully considered stricto sensu a comparative law. This article does not pretend to be a compendium of attributable virtues and defects to legal comparative research on the specific field of migration. Rather, reviewing some publications, I propose to reconsider critically what is or should be the role of comparative law in the interdisciplinary study of migration. Consequently, the strengths and weaknesses of some comparative analysis regarding immigrant integration at European level have been illustratively valued. (shrink)

Partindo do pressuposto de que os obstáculos epistemológicos, propostos por Gaston Bachelard, provocam situações de imobilidade frente ao conhecimento, impossibilitando, na maioria das vezes, o desenvolvimento científico e bloqueando as capacidades dos sujeitos para uma atuação crítica e questionadora, característica da nova ciência, este artigo tem a finalidade de refletir sobre as contribuições da formação inicial do pedagogo para a desconstrução da experiência primeira. Para tanto, optou-se por uma pesquisa bibliográfica e documental pautada nos estudos de Bachelard que trata dos (...) obstáculos epistemológicos à formação do espírito científico, nas Diretrizes Curriculares Nacionais do Curso de Pedagogia e dados de Programas de Pós-Graduação Stricto Sensu de 08 Instituições Públicas e Privadas de Ensino Superior dos Estados do Rio Grande do Sul e de Santa Catarina, no recorte temporal de 2018. Tal relação, entre o que descreve as Diretrizes e o que Bachelard pontua na formação do espírito científico, apresenta-se como possibilidade de compreensão e abertura de discussões a respeito do distanciamento de profissionais pedagogos dos espaços de pesquisa e experiências científicas em educação. A partir do contato com as obras pesquisadas e as Diretrizes Curriculares Nacionais para o Curso de Pedagogia, Licenciatura, percebeu-se entendimentos sobre a formação do pedagogo pesquisador, assim como pretextos para a necessidade de se continuar insistindo nessa dimensão formativa. Ainda, constatou-se que a formação inicial pode colaborar para a constituição do espírito científico do pedagogo, ampliando suas atuações enquanto cientista da educação. Para isso, torna-se necessário que os cursos de formação inicial tenham como fundamento a existência de obstáculos que podem, de modo negativo, contribuir para a inércia de seus estudantes. S'interroger sur le sens et la nature de l'univers et du monde du vivant fait appel à l'ensemble des champs de recherche existant. Si les réponses à ces interrogations métaphysiques n'ont pas été apportées in stricto sensu, son décryptage est actualisé en permanence avec les différentes découvertes qui transforment peu à peu le regard que l'homme porte sur son environnement. Nous référons ici à la conscience de l'humain, intégrée dans le monde du Réel, et vécue comme telle et (...) non à la conscience dont le filtre normatif, né de croyances diverses, en soustrait les avancées scientifiques les plus récentes. Se questionner sur le sens de la vie avec, en miroir, celui de la mort est en résonance avec l'observation et la compréhension du fonctionnement des unités du vivant dont les différentes espèces, dans le cadre du monde animal, et les multiples variétés, dans celui du végétal, en sont la représentation matérielle. Et, c'est à partir de l'outil langagier chez l'être humain que ces questionnements ont pris naissance. La mise en relation entre système binaire et système quaternaire est à l'origine de cet ouvrage avec des interrogations : toute unité du vivant n'est-elle que le résultat d'une programmation donnée? Qu'en est-il alors de l'être humain? Robot participant du monde du vivant ou conscience inscrite dans un habitat biologique? Le langage qui nous est spécifique, ne nous permettrait-il pas de décoder des formes de réalité existantes, mais qui ne nous sont pas accessibles directement? (shrink)

The paper refers to the author's informal considerations from his article „The ontology of founding” (published in „Filozofia Nauki”, 1995, no 1-2). The starting point of the paper is a definition of „monadic whole”, i.e. such a whole, which contains no elements mutually linked up by moments of unity. Then definitions of „part stricto sensu”, „whole (in general)”, „identity of two wholes” etc., are formulated. Using the conceptual apparatus, introduced by these definitions, the author gives some theorems withoutlines (...) of their proofs. In conclusion, the explicative power of the presented formalization with reference to remaining categorial notions of ontology (i.e. notions of property, relation, universals), and in comparison to some other modern theories of parts and wholes, is discussed. Este trabalho identifica a realidade da produção do conhecimento stricto sensu em Educação Física de professores que trabalham em cursos de formação no estado da Bahia – 1982 a 2012 –, em vista as determinações históricas e epistemológicas. É parte da pesquisa em rede EPISTEFNORDESTE. Fonte de dados/informações: 142 produções stricto sensu e 5 PNPG. A metodologia tem base dialética. Resultados apontam que os PNPG, alicerçados na lógica do modo de produção capitalista, geram produções que encerram (...) limites lógicos que são entraves para o avanço da área de Educação Física na construção de uma consistente base teórica que responda aos reais problemas que a área vem impondo historicamente. The philosophic, historical, and literary Italian culture of the first half of our century was largely dominated by a trend of thought that can be correctly called “Neo-idealist,” the most prominent exponents of which were Giovanni Gentile and Benedetto Croce. The latter’s very broad scientific activity moved, and attained its highest and most durable achievements, in the ambit of the theory and history of Italian and European literature, of civil historiography, and of social and political theory. We cannot here attempt (...) even a very sketchy explanation, interpretation, and evaluation of the undoubtedly remarkable contribution which Croce’s scientific work was able to offer to the development of our century’s European culture. Here we shall confine our critical interest only to the philosophical theories stricto sensu elaborated by Croce in the course of his wider historiographic activities. They stem indeed from a personal reading, interpretation, and criticism of Hegel’s speculative idealism; and he proposed them to contemporary scholars as the extreme and most mature stage of modern thought’s whole development. Thus, should they turn out to be generally tenable, any attempt today to vindicate Hegel’s thought as fully up-to-date and valid, at least with respect to its deepest logical-metaphysical and methodological-dialectical “substance,” could not but appear to be openly anachronistic. Whence, then, the inescapable need for a careful critical examination of their content, meaning, and real plausibility in the present historical-cultural situation. (shrink)

The concept of well-defined and mutually exclusive objective facts has no counterpart in the formalism of standard quantum mechanics. Bypassing decoherence theories, we then inquire into the conditions of use of this concept of objective fact, and find that it is grounded on the possibility of making reference to spatio-temporal continuants and permanent properties. Since these conditions are not fulfilled within the quantum paradigm, one must look for appropriate substitutes. Two such substitutes are discussed. The first one is phenomenal fact (...) , whose relevance to quantum physics is evaluated in the framework of Husserl’s phenomenology. The second substitute is intersubjective agreement, which can be disconnected from objectivity stricto sensu, as quantum mechanics seems to require. A study of intersubjectivity in terms of the pragmatics of language is undertaken. This study is applied to both Everett’s symbolism of memory brackets and Bohr’s transcendental remark that description of scientific experiments cannot dispense with ordinary language. (shrink)

This essay focuses on proportionality stricto sensu as a consequential test of balancing. The basic balancing rule establishes a general criterion for deciding between the marginal benefit to the public good and the marginal limit to human rights. Based on the Israeli constitutional jurisprudence, this essay supports the adoption of a principled balancing approach that translates the basic balancing rule into a series of principled balancing tests, taking into account the importance of the rights and the type of (...) restriction. This approach provides better guidance to the balancer , restricts wide discretion in balancing, and makes the act of balancing more transparent, more structured, and more foreseeable. The advantages of proportionality stricto sensu with its three levels of abstraction are several. It stresses the need to always look for a justification of a limit on human rights; it structures the mind of the balancer; it is transparent; it creates a proper dialog between the political brunches and the judiciary, and it adds to the objectivity of judicial discretion. Proportionality stricto sensu however has it critics: some claim that it attempts to balance incommensurable items; others that balancing is irrational. The answer to the critics is that it is a common base for comparison, namely the social marginal importance and that the balancing rules—basic, principled, concrete—supply a rational basis for balancing. A democracy must entrust the judiciary—the unelected independent judiciary—to be the final decision-maker—subject to constitutional amendments—about proper ends that cannot be achieved because they are not proportionality stricto sensu. No Órganon Aristóteles descreve alguns esquemas dedutivos nos quais a presença de inconsistências não acarreta a trivialização da teoria lógica envolvida. Esta tese é corroborada por três diferentes situações teóricas estudadas por ele, as quais são apresentadas neste trabalho. Analizamos o esquema de inferência utilizado por Aristóteles no Protrepticus e o método de demonstração indireta para os silogismos categóricos. Ambos os métodos exemplificam como Aristóteles emprega estratégias de redução ao absurdo logicamente clássicas. Na sequência, discutimos os silogismos válidos a partir (...) de premissas opostas (contrárias e contraditórias) estudadas pelo Estagirita no Analytica Priora (B15). De acordo com o autor, os seguintes silogismos são válidos a partir de premissas opostas, nos quais letras latinas minúsculas denotam termos como sujeito e predicado, enquanto que letras latinas maiúsculas denotam proposições categóricas tal como na notação tradicional: (i) na segunda figura, Eba,Aba ` Eaa (Cesare), Aba, Eba ` Eaa (Camestres), Eba, I ba ` Oaa (Festino), e Aba,Oba ` Oaa (Baroco); (ii) na terceira, Eab,Aab ` Oaa (Felapton), Oab,Aab ` Oaa (Bocardo) e Eab, Iab ` Oaa (Ferison). Por fim, discutimos a passagem do Analytica Posteriora (A11) no qual Aristóteles enuncia que o Princípio de Não-Contradição não é, em geral, pressuposto de toda demonstração (silogismo científico), mas apenas daquelas nas quais a conclusão deve ser provada a partir do Princípio; o Estagirita enuncia que se um silogismo da primeira figura tiver o termo maior consistente, os outros termos da demonstração podem ser separadamente inconsistentes. Estes resultados permitem-nos propor uma interpretação de sua teoria dedutiva como uma teoria paraconsistente lato sensu. Primeiramente, efetuamos uma análise hermenêutica, avaliando seu significado lógico e a correlação desses resultados com outros aspectos da filosofia de Aristóteles. Em segundo lugar, consignamos uma interpretação dos silogismos aristotélicos a partir de premissas opostas à luz dos antilogismos propostos por Christine Ladd-Franklin em 1883, e da demonstração aristotélica com termos inconsistentes nas lógicas paraconsistentes Cn, 1 n !, introduzidas por da Costa em 1963. O artigo caracteriza a atual etapa do capitalismo a partir da centralidade dos mecanismos especulativos baseados no capital fictício e seus desdobramentos na totalidade da reprodução da vida. Identifica uma relação simbiótica entre reprodução do capital e administração pública como forma de recomposição do poder burguês nos últimos 40 anos. Para isso apresenta uma leitura da atual forma de relação entre Estado e Sociedade Civil e a conformação de novos blocos de poder hegemônicos. Nesta relação demonstra a existência de mecanismos (...) de descentralização do estado stricto sensu através da composição de parcerias público-privadas com empresas e Organizações Não-Governamentais da sociedade civil. Neste contexto questiona: quais os limites e potencialidades de fortalecimento da democracia? Inspirado na dialética negativa de Adorno, o artigo sugere a hipótese de emergência de uma nova forma de governança social oposta à governança hegemônica capitalista. Levando em consideração a resistência dos povos da América do Sul em seus territórios que constroem mecanismos próprios de poder e soberania para autodeterminarem seus destinos, reflete sobre a possibilidade de uma governança popular, como nomeada pelo filósofo Slavoj Zizek. A emoção sempre foi definida como um estado afetivo que se contrapõe à cognição ou à atividade racional. Tal distinção é hoje radicalmente negada pelas pesquisas em neurociências. As emoções, stricto sensu, se expressam sob forma de manifestações intensas, abruptas, inesperadas. Convém, por isso, reconhecer que a emoção envolve uma experiência sensorial e uma dimensão comportamental ou expressiva representada pela resposta motora que ela suscita . Assim, as emoções comportariam sentimentos e/ou atitudes , cujas manifestações variam segundo a (...) intensidade, as circunstâncias e a natureza dos agentes desencadeadores. Dessa gama enorme de possibilidades depende a caracterização precisa dos estados mentais que tais sensações suscitam e as formas de conduta que elas engendram. A atitude emocional, todavia, nem sempre se distingue do comportamento voluntário, aquele guiado pela decisão do agente. Algumas emoções não somente desencadeiam certas formas de comportamento, como são modos apropriados de os indivíduos se adaptarem às situações vividas. É dessa interação que trata o nosso trabalho. Les analyses de la mondialisation procèdent souvent de modes de réflexion qui excluent le principe de non contradiction et conduisent à des hypothèses rigides sur son évolution. La pensée complexe, selon Edgar Morin, ne présente pas cette contrainte et admet, à l’instar de la pensée chinoise stricto sensu, la coexistence de contraires, dont le dynamisme, selon la philosophie taoïste devrait aboutir à l’harmonie. Cela laisse en quelque sorte du jeu, ouvrant ainsi la porte à une pluralité de possibles. (...) Cet article présente quelques-unes des parentés entre pensée complexe et mode de réflexion chinois. Il examine aussi une touche spécifique qu’apporte Edgar Morin, héritée de la pensée grecque. Elle concerne l’accompagnement de ce jeu des contraires, par la démocratie cognitive et communicationnelle, alors que le système de pensée chinois n’intègre pas cette question. Un pont est ainsi jeté entre les modes de pensée de l’Occident et d’Extrême-Orient.Analyzes of globalization often proceed ways of thinking that excludes the principle of non-contradiction and leads to rigid assumptions about its evolution. It relates to the accompaniment of this game of opposites, the cognitive and communicative democracy, while the Chinese system of thought does not include this question. In «Mancanze, omissioni, e descrizioni negative»,55 Achille Varzi esplora le conseguenze di una forma comune di ragionamento causale, quella in cui citiamo mancanze od omissioni nel fornire una spiegazione delle cause degli eventi. Tale forma appare di comune uso nei contesti normativi del diritto, nelle spiegazioni tipiche delle scienze sociali e, più in generale, nel ragionamento ordinario. Ciò che accomuna questi casi è l’idea intuitiva secondo cui le cause possono anche consistere in eventi negativi. L’intuizione non è però metafisicamente innocua, (...) poiché per affermare che una spiegazione come "C’è stata un’esplosione perché Gianni non ha spento il gas" sia una buona spiegazione, occorre assumere che gli eventi negativi come “il non aver spento il gas da parte di Gianni” esistano al pari di eventi come l’esplosione e dal momento che, solo se sono entrambi eventi, può tra questi sussistere una relazione casuale. Dovremmo pertanto concludere che (1) è perfettamente intellegibile e rispecchia le nostre pratiche linguistiche. Spesso parliamo assumendo che ci siano cose che le persone non fanno: il gas che Gianni non ha spento, la passeggiata che non abbiamo fatto, il treno che non è arrivato, ecc. La sensatezza di questi usi esige pertanto il dover riconoscere una certa legittimità al vocabolario delle omissioni e delle descrizioni negative. Varzi sostiene che questo modo di parlare solleva tuttavia degli scrupoli ontologici,56 poiché non è possibile assumersi alcun serio impegno ontologico nei confronti di eventi negativi, ancor meno quando le nostre asserzioni richiedono di quantificare su eventi “inesistenti”. Una strategia per ovviare a questo scrupolo è sostenere che queste pratiche linguistiche sono analoghe a quelle in cui parliamo di oggetti “inesistenti”, ossia di oggetti che è come se ci fossero, ma che riconosciamo esistere soltanto in un contesto finzionale. Dunque l’analogia con gli oggetti finzionali può rendere in qualche modo espliciti i vincoli ontologici, giustificando quegli usi linguistici. Sebbene questo argomento abbia la sua plausibilità, Varzi nota che «ad un esame più attento, gli eventi non accaduti si rivelano ben più resistenti al rasoio di Occam di quanto l’analogia con gli oggetti non esistenti suggerisca » poiché il nostro linguaggio causale ci induce spesso a ritenere che «il riferimento o la quantificazione nei confronti di eventi non accaduti sia da intendersi in senso stretto e letterale»,57 in contrasto con quanto suggerisce l’analogia con gli oggetti finzionali. La difficoltà nasce dall’argomento per cui, se la causazione è una relazione tra eventi, occorre prendere sul serio l’idea che gli eventi negativi siano negativi stricto sensu. La tesi di Varzi è che questa tesi sia una contraddizione genuina e che l’unico modo di risolverla sia di rinunciare all’idea che gli eventi negativi esistano in un qualsiasi senso. In questo articolo intendo analizzare un aspetto di questa forma di parsimonia ontologica. Il mio intento è di valutare le conseguenze della tesi di Varzi dal punto di vista della spiegazione causale in contesti controfattuali e nei casi di omissione del diritto. (shrink)

Our objective will be to argue in favor of the idea that in Nietzsche there is no genealogical method, stricto sensu, with universalist and systemic-substantivist epistemic claims (traditionally conceived by justificationist and foundationalist philosophies from Plato to Hegel). However, there is a characteristic genealogical program, which opposes the majority genealogies and philosophies insofar as a self-suppression of the method is imposed as the primary and heterodox register of its reflection. We start from the hypothesis that Nietzsche’s genealogy, understood (...) programmatically, became viable because it was markedly structured on the basis of three reflexive movements that free his genealogical thinking from an analytical-methodological conduct, like the canon, which are: (i) variation of style in his writing; (ii) critical historicism or radical and (iii) discontinuity of origin. However, it would be pointless to show how clearly the Nietzschean genealogical program was outlined if we couldn’t say where it came from, for whom and for what purpose, or even more so, what it is intended to denounce. Therefore, in our conclusion, we will show, with some reservation, how the Nietzschean genealogical program lends itself to evaluating the dimension of power. (shrink)

O presente trabalho tem por objetivo debater a ideia de que o enunciado pode vir a ser uma provável categoria de análise, na tentativa de pensar o(s) discurso(s), do mesmo modo que sua geração, na moldura teórica proposta por Michel Foucault (1926-1984). O filósofo francês desenvolveu o enunciado como uma categoria de análise, em obras como As Palavras e As Coisas (1966) e a A Arqueologia do Saber (1969), em um enquadramento capaz de permitir uma determinada autonomia à formulação de (...) um conceito. Desta forma, o enunciado, na tentativa de engendrar essa mesma autonomia a uma teoria a ser erigida, permitiria a gravitação desta nos referidos discursos produzidos pelo indivíduo. O enunciado, foucaultianamente, não se refere em stricto sensu a um arcabouço gramatical, ou estritamente linguístico, mas permite a confluência na formação de noções teóricas, ou mesmo na moldura do(s) discurso(s), possibilitando a consonância de ideias que fundamentam os discursos vigentes nas ciências humanas e que delineiam o status quo. Sendo a proposição de enunciado em Foucault uma categoria não necessariamente científica, isto é, sem a envergadura de uma composição de verdade, assim como de um “dizer verdadeiro”. O enunciado, na proposta do autor, contrapõe-se ao discurso que versa sobre a nomenclatura da verdade e os mecanismos que instituem a constante produção desta e que outorgam as concepções epistemológicas (que constituem as epistemologias vigorantes) nos espaços: social, político, histórico e também cultural. Resumo: Focamos neste trabalho algumas das tensões vivenciadas por professores pesquisadores vinculados ao sistema de Pós-graduação brasileiro, no contexto das transformações recentes da universidade. Os protagonistas da PG buscam alternativas éticas para o que consideram descaminhos na produção de conhecimentos no contexto científico. O trabalho decorre dos resultados de um conjunto de pesquisas sobre temas associados à produção em nível stricto sensu, desenvolvidas na última década por diversos pesquisadores em grupos ou projetos de investigação. Os resultados vêm mostrando (...) cada vez maior interferência de organismos nacionais de regulação, controle e avaliação do sistema de PG no funcionamento da universidade, ferindo a sua autonomia. Em consequência, os professores pesquisadores que atuam na PG veem-se compelidos a obedecer a dois ‘patrões’, ou ‘senhorios’, cujas exigências são distintas e não raro antagônicas. Diante dos frequentes conflitos entre as exigências, prevalece a subserviência ao órgão externo, já que as próprias IES estão sob avaliação destes órgãos. Neste contexto, emerge o debate sobre a excelência da produção acadêmico-científica, trazendo-se à tona os limites da produção/produtivismo. Como contribuição trazemos a noção de pertinência territorial para pensar outra possível modalidade de excelência. Por fim, enriquecemos a discussão da problemática, a partir da perspectiva do pensamento decolonial, que envolve a crítica ao eurocentrismo vigente em nossa academia e propõe o ‘penso onde sou’ como caminho para que a produção científica encontre alternativas, conectadas com as realidades e necessidades dos territórios em que estão instaladas as universidades e seus programas de PG. While different in their approaches, structure and intended readership, the four books reviewed here are connected by their common aim of responding to traditional views of elegy as a minor, ‘softer’ genre, which stands in binary opposition to the magniloquence of epic. These books thus build upon long-established developments in the field of Latin literary criticism, which have contributed to a general reassessment, and deconstruction, of the taxonomic categorisations of Latin texts, and Latin poetry more specifically, pointing out its generic (...) fluidity (e.g. J.E.G. Zetzel, ‘Re-Creating the Canon: Augustan Poetry and the Alexandrian Past’, Critical Inquiry 10 [1983], 83–105; G.B. Conte, The Rhetoric of Imitation: Genre and Poetic Memory in Virgil and Other Latin Poets, ed. tr. C. Segal [1986]). Notably, R.O.A.M. Lyne's study on Virgil's Aeneid (R.O.A.M. Lyne, Further Voices in Vergil's Aeneid [1992]) exemplifies this renewed interest in identifying unaligned and ambiguous perspectives (‘further voices’), especially within poetic texts composed in the Augustan or early imperial period. It is no surprise that the elegiac contents have catalysed these underlying streams of ambiguous, unsettled and self-reflective discourse, which – once allowed into the literary landscape of Latin poetry – shake generic boundaries. That Virgil did not write anything that can be formally regarded as elegy, stricto sensu, makes his oeuvre a promising space of enquiry for oblique and subterranean elegiac resonances. (shrink)

Pese a los enormes esfuerzos que han hecho renombrados filósofos políticos e historiadores intelectuales por estigmatizar el estudio de la obra de Carl Schmitt, el interés por el razonamiento político-jurídico schmittiano ha logrado resistir a un punto tal que, hoy en día, cualquier interesado por la filosofía política o jurídica difícilmente pueda resistir la tentación o la necesidad de explorar la obra y el pensamiento schmittiano. Frente a este panorama, en esta ocasión me gustaría ofrecer algunas razones para sostener que (...) la célebre y breve implicación política de Schmitt con el nacionalsocialismo (1933-1936), desde cierto punto de vista, debería quedar al margen o, en el mejor de los casos, considerarse una cuestión incidental para aquellos que se sientan interesados por el razonamiento político o jurídico schmittiano en _stricto sensu_. A tal efecto, luego de llevar adelante unas breves consideraciones sobre la trayectoria de la reputación de Carl Schmitt, quisiera ofrecer cuatro ejemplos que ilustran algunas buenas razones para creer que la teoría política y jurídica de Schmitt corre por un carril paralelo a las consideraciones biográficas y, por lo tanto, quisiera tratar de contrarrestar la idea según la cual existe una conexión directa o necesaria entre sus desacertados compromisos políticos y el valor que, eventualmente, puede llegar a tener su razonamiento político y jurídico. Thick ethical concepts are characterized by having both a “world-guided”/descriptive and an “action-guiding”/prescriptive aspect. The purpose of this paper is to argue that if we conceive of rationality as a thick ethical concept we will be able to understand two things. First, why people are inclined to believe that rationality – even if defined in terms of rational requirements – actually is normative. The action-guiding aspect of the concept of ‘rationality’ is responsible for this. It is highlighted for example by (...) the fact that accusing somebody of behaving irrationally works as a stand-alone criticism of an action or actor. Second, we can also understand why those recent arguments by Broome and Kolodny trying to show just how rationality is normative fail. They are proceeding solely based on a world-guided definition of rationality. This does not lead to a misapplication of the concept stricto sensu; but to a thin concept which necessarily fails to grasp the evaluative force of the concept of ‘rationality’. This is particularly insightful for economists who often tend to use ‘rationality’ as a standard for judging behavior. (shrink)

Ostensibly, Husserl’s work doesn’t seem to allow for a conceptualization of a properly collective memory, i.e. a shared memory, common to all members of a somewhat tightly unified group. Indeed, Husserl’s view of a collective, at least the one most often presented in his works, appears to be one of a collective equivalent either to an “anyone and everyone” or to an aggregate sum of parts, to a loosely unified composite. All memory of members of such a collective would itself (...) be adjusted accordingly. However, Husserl also develops an idea of a collective, the “personality of a higher order” – as well as an idea of correlative social acts – which might present good candidates for authentic collectives and collective acts, including memories. This paper will attempt to clarify the constitution of said collectives and acts based on the model of Husserlian generativity understood stricto sensu and “from within”. (shrink)

Jan Patočka’s early phenomenology, as presented in The Natural World as a Philosophical Problem, does not merely adopt Husserl’s concept of the lifeworld. The paper demonstrates the originality of Patočka’s appropriation of this concept, but also its internal tensions and difficulties. Seeking to elaborate a concept of a phenomenology allowing for a theory of the lifeworld stricto sensu, i.e. of the life of the world, Patočka’s book effectively shows that there is no ahistorical, absolute or “natural” starting point (...) for phenomenology. Truth, as approachable through phenomenology, is not given, but must rather be developed. Elaborating on the concept of transcendental idealism, Patočka’s early phenomenology thus suggests a vivid idea of “intermeshing” monads ontologically grounding the world. (shrink)

Dans sa conception (...) traditionnelle in stricto sensu, la théorie de la guerre dite juste comporte, d'une part, le jus ad bellum (droit à la guerre) ou droit de faire la guerre et, d'autre part, le jus in bello qui règlemente la conduite de la guerre. Qu'en est-il de l'après-guerre et du jus post bellum? Cet ouvrage, importante contribution au débat sur la théorie de la guerre juste, répond justement à ce questionnement.". (shrink)

La notion de lieu occupe dans le système cartésien une place stratégique : elle en manifeste la singularité tant dans le domaine de la physique que dans celui de la métaphysique. En physique, les difficultés sont nombreuses : comment Descartes parvient-il à édifier une philosophie naturelle qui produit, notamment, les lois du choc et celle de la chute des graves, dans un cadre conceptuel qui nie l'existence du vide ainsi que celle de lieux différents? Jusqu'à quel point peut-on parler d'une (...) mathématisation du réel pour un corps de doctrine aussi peu algébrique que possible? Le spectre du roman cartésien doit être chassé afin de saisir la science cartésienne dans sa nouveauté radicale. Mais dès lors que l'on s'interroge sur les motifs conceptuels qui empêchent Descartes d'élaborer une mathématisation du réel, dont la Géométrie semble lui donner les moyens et les Regulae la méthode, on est conduit à préciser la nature des procédures résolutoires de la pensée, leur portée et leurs limites et, ainsi, à entrer de plain-pied dans le champ de la mathématique, tout d'abord, puis dans celui de la métaphysique. Dire ce qu'est et ce que peut un corps s'énonce à partir du savoir de ce qu'est et de ce que peut l'esprit. En effet, Descartes attribue à l'esprit la force et la puissance, non seulement d'inventer et de produire du nouveau, mais également celle, très concrète, d'imprimer une nouvelle détermination aux mouvements des esprits animaux. On peut considérer que la force chez Descartes est indexée au spirituel plutôt qu'au corporel et qu'en dehors de la question singulière de l'Eucharistie, elle n'est efficace qu'à la condition de ne pas être localisée stricto sensu en termes de lieu : Dieu agit dans le monde pour autant qu'il n'en fait pas partie et la glande pinéale est le siège principal de l'âme, sedes et non pas locus. Cette lecture de l'œuvre cartésienne trouve ainsi dans la notion de lieu un thème d'étude particulièrement fécond, dans la mesure où elle est mobilisée à la fois dans la physique et les mathématiques cartésiennes, mais également dans la question de la localisation de Dieu dans le monde, dans celle du Christ sous les espèces consacrées, et dans celle de l'âme dans le corps. Ainsi d'un lieu à un autre, nous sommes conduits au cœur du système cartésien, par un mouvement d'approfondissement réciproque des perspectives. (shrink)

Quand on s’est déjà séparé une fois d’un premier conjoint par un divorce et que l’on est à nouveau massivement en proie à une crise conflictuelle dans le couple que l’on a formé avec un autre partenaire au point que la question de la séparation se profile à nouveau, que se passe-t-il au juste dans ou pour « le couple », doublement entendu ici comme un appareil intrapsychique et groupal, selon Kaës? Question difficile s’il en est, mais d’une acuité sans (...) précédent à l’heure où la recomposition familiale est entrée dans les mœurs. Cet article ne prétend pas répondre stricto sensu à la question posée, mais vise à partager une réflexion analytique qui s’ancre dans la pensée de Michel de M’Uzan au sujet de la répétition du même et de celle de l’identique, autour d’un suivi clinique de trois ans (fréquence bimensuelle) avec un couple recomposé reçu dans un cadre associatif, où ce sont deux ex qui constituent l’entité conjugale. Une peur, immémoriale et hargneuse, se répète en séance avec l’analyste. (shrink)

Se l'attenzione maggiore degli studiosi si è da sempre concentrata sulle Dionisiache, non di meno negli ultimi vent'anni si assiste a un rinnovato interesse per l'altro poema esametrico attribuito a Nonno, la Parafrasi del Vangelo di Giovanni; ciò soprattutto per merito di Enrico Livrea e della sua scuola fiorentina, di cui anche l'autore di questo volume fa parte. Esso rappresenta una tappa ulteriore – dopo l'edizione del Canto I (De Stefani), del Canto II (Livrea), del Canto XVIII (Livrea) e del (...) Canto XX (Accorinti) – in quello che si annuncia come un progetto di edizione critica commentata di tutti canti del poema sacro nonniano: progetto certamente ambizioso ma indispensabile per fare luce piena su un momento fondamentale dell'epica tardoantica. Diversamente dalla poesia centonaria, Nonno, pur seguendo dappresso la Vorlage evangelica, volle fare opera in qualche misura originale e ci riuscì, pur con uno stile che non si potrebbe immaginare più contrastante rispetto alla austera sobrietà del dettato giovanneo. Il volume di Agosti, sostenuto da una ricchissima e pressocché completa bibliografia, si apre con una Introduzione assai ampia e decisamente pregevole per la capacità dimostrata dallo studioso di inquadrare il poema nonniano nell'ambito vasto dell'epica tardoantica non solo greca ma anche latina: da questo punto di vista illuminanti appaiono i raffronti con Giovenco, Aratore, Claudiano, Prudenzio, Commodiano, oltre che, naturalmente, con Gregorio Nazianzeno, Eudocia e gli Homerocentones. Convinto che il Nonno parafraste sia il medesimo autore delle Dionisiache, Agosti ritiene decisamente superata la tesi contraria, e intelligentemente si limita a rilevare la straordinaria affinità fra i due poemi non solo a livello stilistico, linguistico e metrico, ma anche – aspetto forse ancora più sorprendente – sotto il profilo concettuale: «Vi sono elementi di chiaro influsso cristiano nelle D. e d'altra parte la figura di Cristo tende ad assumere alcuni tratti bacchici nella P.» (p. 46). Una tesi, questa, che viene corroborata con numerosi raffronti puntuali nelle dense note di commento. Essendo gran parte del Canto Quinto, corrispondente al quinto capitolo del vangelo giovanneo, dedicato al miracolo del paralitico guarito nella piscina di Bethesda, viene affrontato il problema dello spazio dedicato ai miracoli di guarigione nel mondo pagano e cristiano del V secolo, in particolare nell'ambiente egizio dove Nonno visse e operò (ma molto cauto si mostra, a mio avviso saggiamente, l'Autore nei confronti di identificazioni troppo incerte, come quella che vorrebbe Nonno vescovo di Edessa). Il lettore deduce dalle sue considerazioni come nulla di sorprendente o di aberrante l'uomo tardoantico potesse scorgere nel racconto di Giovanni, che anzi non discorda da analoghe imprese attribuite ad Asclepio, il dio guaritore ϰατεξοχήν, ma anche a taumaturghi come Apollonio di Tiana: si trattava, se mai, di una sorta di concorrenza fra Cristo e i suoi omologhi e rivali pagani. Allo stesso modo, Agosti pensa che il pubblico della Parafrasi e quello delle Dionisiache fosse in sostanza il medesimo, forse con una percentuale cristiana maggiore nel primo caso e minore nel secondo. Ovviamente si rimane nel campo delle ipotesi, ma certo il sincretismo del tempo poteva forse spingersi tanto avanti da giustificare simile osmosi, anche se appare lecito dubitare che cristiani convinti giungessero a tollerare l'incredibile ampiezza del poema a gloria di Dioniso, e, viceversa, che a un pubblico pagano potesse veramente interessare il vangelo di Giovanni – di cui per altro Agosti segnala qualche risonanza in ambiente neoplatonico. Meritorie appaiono anche le osservazioni sul retroterra esegetico del poema sacro, «più vicino all'esegesi che alla parafrasi stricto sensu» (p. 111), con particolare riferimento al commento giovanneo di Cirillo d'Alessandria: una consonanza del resto già osservata da altri studiosi della Parafrasi. Nelle note l'Autore cita numerosi passi da Cirillo, non nascondendosi comunque la notevole libertà con cui Nonno – il cui intento primario non dovette certo essere teologico – se ne servì. Non meno interessanti le considerazioni su alcuni punti di contatto con la liturgia, tema di cui Agosti segnala la non secondaria importanza per una valutazione corretta e completa dell'epica cristiana. This paper considers the relation between philosophical discussions of, and social-scientific research into popular beliefs about, distributive justice. The first part sets out the differences and tensions between the two perspectives, identifying considerations which tend to lead adherents of each discipline to regard the other as irrelevant to its concerns. The second discusses four reasons why social scientists might benefit from philosophy: problems in identifying inconsistency, the fact that non-justice considerations might underlie distributive judgments, the way in which different principles (...) of justice can yield the same concrete distributive judgments, and the ambiguity of key terms. The third part distinguishes and evaluates three versions of the claim that normative theorising about justice can profit from empirical research into public opinion: that its findings are food for thought, that they amount to feasibility constraints, and that they are constitutive of normatively justified principles of justice. The view that popular opinion about justice has a strongly constitutive role to play in justifying principles of distributive justice stricto sensu is rejected, but it is argued that what the people think (and what they can reasonably be expected to come to think) on distributive matters can be an important factor for the political theorist to take into account, for reasons of legitimacy, or feasibility, or both. Este artículo pretende dilucidar el significado del sentir profundizando en la fenomenología genética y dialogando con la ontología fenomenológica, particularmente con la Métaphysique du sentiment de R. Barbaras. Comienza descubriendo los sentidos del cuerpo y lo que denominamos “re-flexión” corporal, siempre vinculada a la aisthesis (lato y stricto sensu) y a la afectividad. Aborda posteriormente la correlación entre fenomenología y estética como ejemplo de la pasividad en la actividad del sentir. Comprenderemos esta dinámica como movimiento ontológico que aúna (...) la aisthesis con el logos y exige ser expresado. Cézanne estará presente en esta investigación, como lo estuvo en la obra de Merleau-Ponty y de Maldiney, porque su pintura encarna ese movimiento en el que la creación es necesaria para experimentar y expresar el ser, y porque filosofía y arte son indispensables para sentir y pensar. Aceptaremos la crítica que Barbaras dirige Maldiney, mientras que continuaremos desarrollando la ontología fenomenológica de Merleau-Ponty para arrojar luz sobre le sentir. (shrink)

In this paper, I seek to demonstrate, through a rigorous study of some of his later works—most notably Beyond Good and Evil (1886), The Antichrist (1905[1888]), and Ecce Homo (1908[1888])—that Nietzsche does not at all present himself as an anti-Buddha stricto sensu, or as a figure whose teaching is diametrically (...) opposed to that of the Indian master. The late Nietzsche, more precisely, does not conceive of amor fati and nirvāṇa as opposed ethical poles—or negatives of one another. On the contrary, certain texts in Ecce Homo and The Antichrist make it clear that there are significant affinities between amor fati and nirvāṇa as Nietzsche understands it, with respect to both the relationship to the self (seeing oneself "as a fatum") and to the other (overcoming ressentiment) that it implies. This, I conclude, lends credence to Nietzsche's infamous hypothesis according to which, contrary to appearances, all ethical ideals might in fact be "insidiously consanguine, linked up, knotted with that bad thing which seems to be their contrary" (Beyond Good and Evil, §2, KSA 5:17). RESUMO Neste artigo pretendo identificar um "estilo de raciocínio" próprio à química e apontar a disseminação de seus produtos e conceitos. O objetivo é o de explicitar alguns elementos que caracterizam o estilo de pensar e de fazer da química na segunda metade do século XVIII, sua capilarização técnico-cultural. O delineamento de um estilo químico de raciocinar origina-se da constância dos espaços técnico-epistêmicos em que o saber químico é construído. A química é uma ciência de laboratório, eminentemente técnica e operatória, (...) quer dizer, trata-se de um conhecimento técnico-científico stricto sensu. Produtora de artefatos, a ciência química é inseparável da técnica, da tecnologia e da indústria, de maneira que sua identidade epistêmica é indissociável de sua história. Seu estilo caracteriza um valor profundo na cultura técnica do homo faber, do poder de agir sobre a natureza e de transformá-la através de manipulações e de rearranjos. ABSTRACT In this paper I will identify a "style of reasoning" that is proper to to Chemistry and to point to the dissemination of its products and concepts. My aim is to explain some elements that characterize the style of thinking and engaging in Chemistry in the second half of the 18th century, its techno-cultural capillary action. The shaping of a chemical style of reasoning originated from the constancy of the techno-epistemic sites in which chemical knowledge is formed. Chemistry is a laboratory science, eminently technical and operative, i.e., it deals with a techno-scientific knowledge stricto sensu. A producer of artifacts, chemical science is inseparable from technique, technology and industry, in such a way that its epistemic identity is inseparable from its history. Its style marks a profound value in the technical culture of the homo faber, the power of acting upon nature and transforming it through manipulations and rearrangements. (shrink)

The principal objective of this essay is to briefly present and discuss what could be thought of as Engelhardt's two approaches on animality. The first, rather literal use of the term, refers to non-rational animals stricto sensu, while the second and more important one thematizes humanity's ontological self-degradation resulting from the dominant pleasure-oriented culture of our time. As for the first, aiming to moderate his outright acceptance of animal use, I invoke Dworkin's insights on sanctity, which substantiate a (...) plausible alternative stance. As for the second, I attempt to critically reconstruct the way in which, according to Engelhardt, humanity, having rejected every transcendent inquiry, is increasingly embracing its lower nature. In conclusion, I will hint that this return to animality may be impeded by upcoming challenges that already leave a noticeable imprint on a global scale. (shrink)

El objetivo de este artículo es hacer una reconstrucción racional del uso del examen de proporcionalidad en contextos de adjudicación judicial de derechos sociales constitucionales. Dicho trabajo de reconstrucción será desarrollado en dos pasos. En primer lugar, se tratará el interrogante referido a si el examen de proporcionalidad en su variante “por omisión” exhibe o no una estructura diferente con respecto a su, mucho más conocida e investigada, variante “por exceso”. En segundo lugar, se describirán las reglas y formas de (...) argumentación que están implícitas en el uso del examen de proporcionalidad por omisión y que componen a sus respectivos sub-exámenes de idoneidad, necesidad y proporcionalidad stricto sensu. A relevância de dialogar um estudo teórico internacional dos EUA com o estudo empírico nacional do Brasil sobre as análises conceituais, pesquisas futuras e estratégias inclusivas aos grupos com distintos marcadores sociais das diferenças com suas relações étnico-raciais, interseccionais e de deficiências. Foram discutidos durante o período das aulas presenciais através de uma disciplina eletiva da pós-graduação stricto sensu em educação na Universidade Estadual de Santa Catarina (UDESC) ministrada por duas Professoras Doutoras Geisa Bock e Raquel Fröhlich. Realizou-se (...) as discussões com esperança de que é possível realizar pesquisas futuras quando obtém o olhar minucioso sobre as necessidades especiais dos grupos vulneráreis para progresso educacional. O artigo incentiva as conscientizações dos pesquisadores e profissionais da educação com as notas críticas internacionais e as inspirações de práticas colaborativas em suas pesquisas futuras, contribuindo para a constância do debate em face dos propósitos de equidade social perante os princípios da Educação Inclusiva. The paper investigates the cultural unit of “sanctity” in the light of the notion of “form of life”, in order to show how jazz master John Coltrane pursued sanctity as a regulative model with regards both to personhood and musicianship, so as to translate his existential quest into music. Firstly, the paper briefly summarizes: what we mean today by sanctity ; what are the relationships interweaving music and sanctity ; what we mean by form of life—a notion brought into philosophical (...) discourse by Ludwig Wittgenstein—in semiotic terms and why we can apply it to sanctity. Afterwards, the paper addresses Coltrane’s musical career, relying both on hagiographic discourse built around him and his discography, with special focus on three game-changers among his albums: Giant Steps, A Love Supreme, and Ascension. Coltrane headed a twofold conversion: he abandoned his native Methodist faith to embrace a personal form of syncretic pantheism; he abandoned the language of traditional jazz to embrace the avant-garde technique of modal composition and the once despised free jazz. Not only Coltrane wanted to be a saint, not only was he regarded as such to the extent that a “St. John William Coltrane Church” was established in San Francisco, but he tried to be one through music; namely, by conveying his spiritual journey via sonic means: proposing a musical catechism, a musical mass, and his own mystique. Consistently with the process of selection any saintly figure—and mystiques especially—undergoes in order to be canonized stricto sensu, only some tokens within Coltrane’s body of work were included in the canon, while his later works were left out due to their radicalism. Este trabalho analisa o surgimento da Pós-Graduação stricto sensu no Rio Grande do Sul a partir de material bibliográfico e documental. O foco da análise centra-se, inicialmente, no primeiro Curso de Mestrado em Educação criado em 1970, na UFSM resultante de um Convênio com a Organização dos Estados Americanos – OEA. A análise abrange o período do Convênio 1970/1977 e o período pós-convênio de 1977 aos dias atuais. Num segundo momento é analisada a expansão da pós-graduação em educação (...) no Rio Grande do Sul tanto nas universidades públicas como privadas, deflagrada pela criação dos Cursos de Mestrado da UFRGS e da PUC de Porto Alegre em 1972. RESUMEN La filosofía hegeliana en general, y en particular la “Ciencia de la lógica” y el tratamiento que en esta se hace sobre nociones como las de identidad y diferencia, generaron desde el momento mismo en que vio la luz, un sinnúmero de posiciones críticas tales como las de Schelling, los hegelianos de izquierda y, en general, de todos aquellos filósofos que, en virtud de las posibles implicaciones prácticas de una filosofía de la identidad buscaron “expurgar la semilla del dragón (...) del panteísmo hegeliano”, entre las cuales es necesario mencionar la legitimación de estados totalitarios y los genocidios asociados a ellos. Esta búsqueda, fue realizada sobre la afirmación de que el pensamiento hegeliano, al estar soportado sobre la identidad, implica una negación y, por tanto, aniquilación y reducción de la diferencia. En este sentido, el presente artículo busca examinar la noción hegeliana de la identidad, la correspondencia o no de las críticas que sobre el particular se han hecho sobre Hegel y, finalmente, analizar una de las salidas que, desde las interpretaciones hegelianas más recientes, se han hecho para responder a las críticas: la filosofía hegeliana in stricto sensu, una filosofía de la diferencia. ABSTRACT The Hegelian philosophy in general, and in particular the “Science of Logic” and the treatment that in this is made about notions as identity and difference, generated since its conception a countless critical positions such as those of Schelling, the left Hegelian and, in general, of all those philosophers who, accordingly with the posible practical implications of a philosophy of identity sought to “purge the dragon’s seed from Hegelian pantheism” among which it is worth to mention the legitimization of totalitarian states and genocide associated with them. This search was made on the assertion that Hegelian thought, being supported on the identity, implies a negation and, therefore, annihilation and reduction of the difference. In this sense, the present article seeks to examine the Hegelian notion of identity, the correspondence or not of the criticisms that have been made about Hegel and, finally, to analyze one of the outlets that, from the most recent Hegelian interpretations, have been made to respond to the criticisms: the Hegelian philosophy in stricto sensu, a philosophy of the difference. Recently, several studies have demonstrated that tetracyclines, the antibiotics most intensively used in livestock and that are also widely applied in biomedical research, interrupt mitochondrial proteostasis and physiology in animals ranging from round worms, fruit flies, and mice to human cell lines. Importantly, plant chloroplasts, like their mitochondria, are also under certain conditions vulnerable to these and other antibiotics that are leached into our environment. Together these endosymbiotic organelles are not only essential for cellular and organismal homeostasis stricto (...) class='Hi'>sensu, but also have an important role to play in the sustainability of our ecosystem as they maintain the delicate balance between autotrophs and heterotrophs, which fix and utilize energy, respectively. Therefore, stricter policies on antibiotic usage are absolutely required as their use in research confounds experimental outcomes, and their uncontrolled applications in medicine and agriculture pose a significant threat to a balanced ecosystem and the well‐being of these endosymbionts that are essential to sustain health.Also watch theVideo Abstract.
