This paper describes and discusses the phenomenon ‘predatory publishing’, in relation to both academic journals and books, and suggests a list of characteristics by which to identify predatory journals. It also raises the question whether traditional publishing houses have accompanied rogue publishers upon this path. It is noted that bioethics as a discipline does not stand unaffected by this trend. Towards the end of the paper it is discussed what can and should be done to eliminate or reduce the effects (...) of this development. The paper concludes that predatory publishing is a growing phenomenon that has the potential to greatly affect both bioethics and science at large. Publishing papers and books for profit, without any genuine concern for content, but with the pretence of applying authentic academic procedures of critical scrutiny, brings about a worrying erosion of trust in scientific publishing. I compare Sellars’s criticism of the ‘myth of the given’ with Quine’s criticism of the ‘two dogmas’ of empiricism, that is, the analytic–synthetic distinction and reductionism. In Sections I to III, I present Quine’s and Sellars’s views. In IV to X, I discuss similarities and differences in their views. In XI to XII, I show that Sellars’s arguments against the ‘myth of the given’ are incompatible with Quine’s rejection of the analytic–synthetic distinction.

Inference to the Best Explanation is usually employed in the Scientific Realism debates. As far as particular scientific theories are concerned, its most ready usage seems to be that of a theory of confirmation. There are however more uses of IBE, namely as an epistemological theory of testimony and as a means of categorising and justifying the sources of evidence. In this paper, I will present, develop and exemplify IBE as a theory of the quality of evidence - taking examples (...) from medicine and showing that IBE can thereby provide the epistemological underpinning and justify the criteria of grading quality of mechanistic evidence that have been recently provided in the Clarke et al. paper on how evidence of medical mechanisms is to be construed alongside population studies. Austrian economics focuses on markets but has much to say about organizations. In particular, Austrian insights on the structure of production, the heterogeneity and subjectivity of resources, the nature of uncertainty, the role of monetary calculation, and the function of the entrepreneur provide solid foundations for a distinctly Austrian theory of organizations. This chapter reviews these insights, discusses recent literature on Austrian economics and the theory of the firm, and suggests new directions for developing and extending an Austrian approach to (...) organizations. In doing so it answers the following questions: Why, do organizations, large and small, emerge and persist? How do they avoid the problem of economic calculation faced by socialist economies? Why do organizations take the shapes they do, why do their characteristics vary over time and across industries, and why do they succeed or fail? Are most organizations stable over time, or do organizations, like markets, adapt and learn? and How do entrepreneurs arrange assets and manage individuals within organizations? (shrink)

In this paper we analyse how risk factors in highly industrialised agriculture are connected to animal neglect. With Danish agriculture as a case study, we use two types of data. First, we use register data from Statistics Denmark to map how risk factors such as farmers’ financial and social troubles are connected to convictions of neglect. Second, we analyse narratives where interviewed farmers, involved in cases of neglect, describe how they themselves experienced the incidents. We find that while livestock farmers (...) in general have a low risk of animal neglect problems, a small percentage of them face severe financial difficulties, divorce and psychiatric problems, which are connected to an increased risk of being convicted for the neglect of farm animals. The narratives bring forward themes of pressure related to financial trouble, technological break down, family problems, stress and a growing concern among the farmers towards the governmental control in farm animal production. We discuss how these factors can be used to identify and help farmers with a high risk of being convicted of livestock neglect. (shrink)

E. Gracia. Lanham, MD: Rowman and Littlefield, 2007, 297 pp., $29.85 paper.There has been quite a boom lately in the market for philosophical books on popular culture. The young American philosopher William Irwin has led the way by starting the fad of "... and philosophy" books; the (...) first one that Irwin edited was Seinfeld and Philosophy. So it is only fitting that he is one of the editors of this volume on philosophical interpretation of popular culture. In contrast to most of the earlier books of this kind, a sizable number of the contributors to this volume belong to the top brass of America's aestheticians: Noël Carrol, Ted Cohen, Carolyn Korsmeyer, and Richard Shusterman, to name but a few. The book is divided into two parts, "Philosophy and Popular Culture" and "Interpretation and Popular Art Forms." These titles are self-explanatory; it might be added that the aforementioned top brass dominates the first part.Irwin provides the book with a witty and well-written introduction, but he operates with a very wide definition of popular culture, classifying movies as such as items of pop culture. However, the medium surely is not the message. The fact that novels can be part of popular culture does not make Joyce's Ulysses a pop cultural object. Irwin's chapter, "Philosophy as/and/of popular culture," is rather two papers in one. One half addresses the concept of popular culture, containing an insightful critical evaluation of, among others, Noël Carroll's concept of mass art. The other half proposes that we can use popular culture to disseminate philosophical ideas to the general public. More so than in the introduction, Irwin is actually rather critical of popular culture in this chapter. He worries about its negative effect on culture in general—no cult of pop culture here. In addition, he rejects the notion of popular culture having the potential of becoming philosophy or its surrogate. He reminds us that Socrates used examples from everyday life and the popular culture of his day to make his philosophical points. In a similar fashion, the popular culture of today can be a stepping stone for philosophers to reach wider audiences. If you cannot beat them, join them! Popular culture could, for instance, be used to warn the public against its own evil aspects. This is an excellent idea, and I could not agree more; I myself often use examples from popular culture in my own lectures with good results. Irwin should expand on this idea and present it in a separate article.Richard Shusterman's chapter does not add much to his earlier writings. It is also somewhat like two articles in one; the first is a criticism of the denigration of pleasure and entertainment as aesthetic values, and the second half is an attempt to bridge the divide between intrinsic value and instrumental value. Both halves [End Page 111] contain some excellent arguments, but popular culture tends to be on the fringe in Shusterman's argument. The focus is on other more traditional, philosophical issues. Perhaps another venue would have been more suitable for this article.In contrast to Shusterman, Caroline Korsmeyer addresses the issues of popular culture in a fairly straightforward manner. Popular culture can be educational, even philosophically so. This claim does not mean that works of popular culture are works of philosophy in the ordinary sense of the word. However, we can "treat philosophy as a success term to refer to works demanding imaginative engagement that results in the recognition... of a philosophical position, such that what is done in philosophy proper that induces a possible conclusion is done in another genre by means appropriate to its appreciation" (31). Given this understanding of philosophy, we can understand works of popular culture as vehicles of philosophy. Korsmeyer maintains that the TV series Angel conveys some of Simone de Beauvoir's ideas from one of her books. Korsmeyer's chapter also contains a delightful discussion of "the probable impossible" and "the possible improbable" in fiction. But... (shrink)

Throughout his philosophical work, Schelling came to increasingly emphasize his conviction that the ultimate principles of philosophy are essentially practical: the ego formally conceived as act in early philosophy, creation as the unfolding of structurally rich action in late philosophy. It remained unclear, however, exactly what constituted the practicality of these principles, namely which concept of action Schelling used and how it is being integrated into the totality of his system. The task this study sets itself is to investigate into (...) these issues in respect to his middle and late philosophy. With the doctrine of potencies serving as point of departure, spirit is first reconstructed as practical consciousness. Creation as an ontotheological original act with the historical world as the space of human action is then systematically developed. Freedom, foresight, purposefulness, intentionality and futurity prove to be the central practical attributes of both human and divine action. Their connection is manifested in the religious consciousness of man and instantiated metaphysically in the relationship of time and eternity. Schelling's positive philosophy shows that these practical aspects are the irreducable prerequisites to render the historical world process intelligible. (shrink)

ZusammenfassungZur aristotelischen Unterscheidung von Herstellen und Handeln (Poiesis und Praxis) gibt es zwei konkurrierende Interpretationen: nach der einen betrifft der Unterschied zwei verschiedene Aspekte an Handlungen, nach der anderen verschiedene Typen von Handlungen. Für eine Entscheidung dieser Frage sind systematische und exegetische Gesichtspunkte zu trennen: zwar bietet die aristotelische Textbasis Belege für beide Seiten, allerdings zeigt die systematische Untersuchung, dass eine zwei-Typen-Lesart sachlich verfehlt ist. Handlungen lassen sich nicht sinnvoll unterteilen in solche, die ihr Ziel lediglich außer sich, aber kein (...) Ziel in sich haben und umgekehrt. Stattdessen sind sie notwendig von einer doppelten Zielsetzung geleitet, bei welcher der Vollzug der Handlung in deren Vollendung münden soll. (shrink)

In this essay, Emil Višňovský and Štefan Zolcer outline John Dewey's contribution to democratic theory as presented in his 1916 classic Democracy and Education. The authors begin with a review of the general context of Dewey's conception of democracy, and then focus on particular democratic ideas and concepts as presented in Democracy and Education. This analysis emphasizes not so much the technical elaboration of these ideas and concepts as their philosophical framework and the meanings of democracy for education and education (...) for democracy elaborated by Dewey. Apart from other aspects of Deweyan educational democracy, Višňovský and Zolcer focus on participation as one of its key characteristics, ultimately claiming that the notion of educational democracy Dewey developed in this work is participatory. The paper enters into a polemical dialogue with the american theorist Jodi Dean and her attempts to critically examine the blogosphere through the prism of psychoanalysis. To this end, the text analyses whether user-generated content on the internet can produce meaningful and epistemologically sustainable “social enclaves”, informal communities and institutions, or whether it operates more as a series of recursive and increasingly meaningless quasi-messages. While attempting to consider blogging as both a constructive practice and a pathology, the text develops the (...) hypothesis that in special cases one can conceptually speak of “epistemic inflation”, a phenomenon that can manifest itself at the personal as well as the social, economic and/or political level. Furthermore, the paper briefly introduces the ideas, history and one of the key concepts of the influential british theory-fiction collective, CCRU (Cybernetic Culture Research Unit). (shrink)

Elementary submodels of some initial segment of the set-theoretic universe are useful in order to prove certain theorems in general topology as well as in algebra. As an illustration we give proofs of two theorems due to Arkhangelskii concerning cardinal invariants of compact spaces.

We present a proof of a Ramsey-type theorem for infinite metric spaces due to Matoušek. Then we show that for every K>1 every uncountable Polish space has a perfect subset that K-bi-Lipschitz embeds into the real line. Finally we study decompositions of infinite separable metric spaces into subsets that, for some K>1, K-bi-Lipschitz embed into the real line.

This article is devoted to two different generalizations of projective Boolean algebras: openly generated Boolean algebras and tightly ϭ-filtered Boolean algebras. We show that for every uncountable regular cardinal κ there are 2κ pairwise non-isomorphic openly generated Boolean algebras of size κ > N1 provided there is an almost free non-free abelian group of size κ. The openly generated Boolean algebras constructed here are almost free. Moreover, for every infinite regular cardinal κ we construct 2κ pairwise non-isomorphic Boolean algebras of (...) size κ that are tightly ϭ-filtered and c.c.c. These two results contrast nicely with Koppelberg's theorem in [12] that for every uncountable regular cardinal κ there are only 2<κ isomorphism types of projective Boolean algebras of size κ. The integrative experiment design proposal currently only relates to group results, but downplays individual differences between participants, which may nevertheless be substantial enough to constitute a relevant dimension in the design space. Excluding the individual participant in the integrative design will not solve all problems mentioned in the target article, because averaging results may obscure the underlying mechanisms.

Le but de cet article est de jeter quelques lumières sur le fonctionnement de la polyphonie dans le discours et l’argumentation juridiques, en insistant sur l’importance des notions-clés d’(in)défaisabilité, de présomption, de polyphonie, d’échelle argumentative. Les premiers linéaments d’une théorie générale de l’argumentation juridique sont ici exposés (1). La théorie en question se veut topique (raisonnements défaisables) et logique (raisonnements indéfaisables). Face aux théories unidimensionnelles (réductionnisme logique ou réductionnisme topique) une théorie bidimensionnelle est souhaitable, qui inclue à la fois le (...) traitement des raisonnements défaisables et indéfaisables. Afin de développer cette esquisse de théorie de l’argumentation juridique, plusieurs notions sont définies (2): la défaisabilité (2.1), la présomption (2.2), la polyphonie (2.3), les échelles argumentatives (2.4). Enfin, un tableau général de quelques marqueurs argumentatifs résume les différents rôles que peuvent jouer les arguments dans la polyphonie du droit (3). (shrink)

La notion d’arbitraire s’est imposée en théorie du droit—où il est question des moyens d’éviter l’arbitraire du juge ou du souverain—et en sémiotique, où la thèse de l’arbitraire du signe est associée à Saussure, un des pères de la “sémiologie”. Pourtant, aucune définition positive n’existe de l’arbitraire, ou du moins aucune ne s’est encore valablement imposée. Le présent article se propose de trouver les raisons pour lesquelles un concept si présent dans la théorie pâtit d’un tel manquement.

Organisationsidentität ist ein bedeutender Faktor für die Erklärung der Stabilität und des Wandels von Organisationen. Stefan Kirchner leistet einen grundlegenden Beitrag zur aktuellen Organisationsforschung, indem er mit dem Konzept der Organisationsidentität Ansätze des soziologischen Neo-Institutionalismus und der Pfadabhängigkeitstheorie zusammenführt.

Der vorliegende Tagungsband beruht auf Vorträgen, die am 8./9. Juni 2007 auf dem 3. Kieler insolvenzrechtlichen Symposium der Hanns-Martin Schleyer-Stiftung in Kiel zu aktuellen Fragen des deutschen und internationalen Insolvenzrechts gehalten worden sind. Dabei wurden Fragen zur Auswahl des Insolvenzverwalters, zum Gläubigerschutz im österreichischen Insolvenzverfahren, zur aktuellen Rechtsprechung des BGH, zur Zwangsvollstreckungshandlung, zu neuen Entwicklungen auf dem Gebiet des Eigenkapitalersatzrechts und zu Praxisproblemen des Insolvenzplans untersucht.

Von 1925 bis 1928 wurden im Berliner J. M. Spaeth-Verlag unter der Leitung von Hans Rosenkranz eine Reihe von Werken seinerzeit eher unbekannter, in der Retrospektive jedoch signifikanter Autoren der Zwischenkriegszeit publiziert. Der Beitrag thematisiert Rosenkranz als jungen Verleger und Bewunderer Stefan Zweigs. Er entwirft auf Grundlage der Archivüberlieferung einen neuen Blick auf die Geschichte des Unternehmens und kommentiert das damit verbundene literarische Programm: Welche wichtigen verlegerischen Projekte wurden in jener kurzen Zeit unternommen? Welche Rolle hatte Stefan Zweig (...) für das Zustandekommen einiger Titel und besonders in den letzten Wochen der Verlagsexistenz? Inwiefern lässt sich Programmgestaltung und ökonomische Entwicklung von J. M. Spaeth als paradigmatisch für jüdische Verlage in der Weimarer Republik verstehen? Dazu wird erstmals das Scheitern des Unternehmens während der „Bücherkrise“ Ende der 1920er Jahre aus den Quellen rekonstruiert. (shrink)

In this article, the principles of appreciative inquiry are used in order to mediate multicultural relations. Using the constructionism theory, I describe and analyze the theoretical articulations adopted to make sense of co-constructing the relationships between different people. I find that, instead of being applied as the sole theoretical foundation, constructionism principles have been incorporated in the appreciative inquiry principles, the effects of which should be the co-constructing of social reality by the interactions of different people. The paper draws on (...) the process that appreciative inquiry perspective works for rebuilding the social relationships. Its main contribution is to show how theoretical complementarities using constructionism theory are promising avenues of research in the field of multiculturalism. (shrink)

This article deals with aspects of the reception of the Liber pontificalis in the fifteenth century. The Liber pontificalis, an anonymous series of biographies of popes from St Peter onwards, was one of the principal sources for the Lives of the Popes by the humanist Platina. I address Platina’s use of sources and some of his attempts at historical criticism. I also review his attitude towards the Latin he found in the Liber pontificalis and give a few examples of how (...) he transformed the language and style of the original text. (shrink)

The academic debate why and how companies are dealing with sustainability is dominated by two main arguments—the profit-seeking and the legitimacy-seeking view. While the first argues that companies establish sustainability management measures if this helps to increase their economic success, others emphasize that companies predominantly react on societal pressure dealing with sustainability to secure legitimacy. Whereas both lines of argument have gained a lot of attention in academia, little is known about their relative importance in shaping corporate practice. This papers (...) aims to fill this gap with an empirical analysis of corporate practices of large companies in ten countries worldwide. To capture the organizations’ rationale in sustainability management practice, we systematically applied various measures related to actors and operational activities focusing on the companies’ intention to pursue sustainability management, the integration of sustainability management to the core business, and the actual implementation of related measures. Overall the findings indicate that seeking legitimacy dominates corporate sustainability management practices. (shrink)

In the past few decades, a growth in ethical consumerism has led brands to increasingly develop conscientiousness and depict ethical image at a corporate level. However, most of the research studying business ethics in the field of corporate brand management is either conceptual or has been empirically conducted in relation to goods/products contexts. This is surprising because corporate brands are more relevant in services contexts, because of the distinct nature of services and the key role that employees have in the (...) services sector. Accordingly, this article aims at empirically examining the effects of customer perceived ethicality in the context of corporate services brands. Based on data collected for eight service categories using a panel of 2179 customers, the hypothesized structural model is tested using path analysis. The results show that, in addition to a direct effect, customer perceived ethicality has a positive and indirect effect on customer loyalty, through the mediators of customer affective commitment and customer perceived quality. Further, employee empathy positively influences the impact of customer perceived ethicality on customer affective commitment, and customer loyalty positively impacts customer positive word-of-mouth. The first implication of these results is that corporate brand strategy needs to be aligned with human resources policies and practices if brands want to turn ethical strategies into employee behavior. Second, corporate brands should build more authentic communications grounded in their ethical beliefs and supported by evidence from actual employees. (shrink)
