In the late 1960s and early 1970s, a remarkable change took place in advanced theological education in the United States: the study of Christian ethics (and other theological studies as well) moved quite rapidly from seminaries into graduate programs at religiously unaffiliated universities. The birth of the "Journal of Religious Ethics" should be understood in the context of this wider shift. The consequences of this migration have been, on the whole, regrettable. In universities, styles of analysis and metaethical issues have (...) been elevated into subject matter, impoverishing Christian moral reflection, but the principal loss has been the loss of the church itself - that set of practices necessary to make ethical reflection intelligible for Christians. First, the author examines the traditional doctrine of imputation. A look at the traditional doctrine is useful for establishing a point of departure in comparing Kelsen's doctrines of central and peripheral imputation. Second, the author turns to central imputation. Here Kelsen's doctrine follows the traditional doctrine in attributing liability or responsibility to the subject. Kelsen's legal subject, however, has been depersonalized and thus requires radical qualification. Third, the author takes up peripheral imputation, which is the main focus of the paper. (...) It is argued that with respect to the basic form of the law, exhibited by the linking of legal condition with legal consequence, peripheral imputation counts as an austere doctrine, shorn as it is of all references to legal personality or the legal subject. If Kelsen's reconstructed legal norms are empowerments, then the austere doctrine of peripheral imputation captures the rudiments of their form, exactly what would be expected if peripheral imputation does indeed serve as the category of legal cognition. Finally, the author develops the puzzle surrounding the legal “ought” in this context. Although Kelsen talks at one point as though the legal “ought” were the peculiarly legal category, the author submits that this is not the best reading of Kelsen's texts. (shrink)

In Truthfulness and Tragedy Stanley Hauerwas provides an account of moral existence and ethical rationality that shows how Christian convictions operate, or should operate, to form and direct lives. In attempting to conceptualize the basis of Christian ethics in a manner that will render Christian convictions morally intelligible, the author casts fresh light on traditional theoretical issues and articulates the distinctive Christian response to contemporary concerns such as suicide, medical ethics, and child care. The first section of the book (...) deals with methodological issues: the meaning and nature of practical reason, obligation claims, natural law, and self deception, and the affinity of story and ethics. It focuses on the relation of truthfulness and tragedy and the need for a story--a set of religious convictions or "grammar of theology"--that does justice to the tragic character of human existence. The second section addresses substantive issues: suicide, euthanasia, and the value of survival; the moral limits of population growth; the definition of "person" for medical reasons; and social involvement and Christian ethics. The overall theme is the need for a community in which truthfulness is a way of life. In the final section, devoted to the problem of how to care for retarded children, the implications of the author's ethical position are given concrete expression. He discusses the assumptions underlying the willingness to have children, criteria for humanness, medical ethics, and how truthful communities deal with suffering. In Truthfulness and Tragedy Stanley Hauerwas extends and clarifies the ethical position set forth in his earlier books Character and the Christian Life and Vision and Virtue. He is associate professor of theology at the University of Notre Dame. He was a senior fellow in Christian medical ethics at the Joseph and Rose Kennedy Institute for the Study of Reproduction and Bioethics, and taught medical ethics at the University of Texas medical branch in Galveston. Counterfactual thinking involves imagining hypothetical alternatives to reality. Philosopher David Lewis argued that people estimate the subjective plausibility that a counterfactual event might have occurred by comparing an imagined possible world in which the counterfactual statement is true against the current, actual world in which the counterfactual statement is false. Accordingly, counterfactuals considered to be true in possible worlds comparatively more similar to ours are judged as more plausible than counterfactuals deemed true in possible worlds comparatively less similar. Although Lewis (...) did not originally develop his notion of comparative similarity to be investigated as a psychological construct, this study builds upon his idea to empirically investigate comparative similarity as a possible psychological strategy for evaluating the perceived plausibility of counterfactual events. More specifically, we evaluate judgments of comparative similarity between episodic memories and episodic counterfactual events as a factor influencing people's judgments of plausibility in counterfactual simulations, and we also compare it against other factors thought to influence judgments of counterfactual plausibility, such as ease of simulation and prior simulation. Our results suggest that the greater the perceived similarity between the original memory and the episodic counterfactual event, the greater the perceived plausibility that the counterfactual event might have occurred. While similarity between actual and counterfactual events, ease of imagining, and prior simulation of the counterfactual event were all significantly related to counterfactual plausibility, comparative similarity best captured the variance in ratings of counterfactual plausibility. Implications for existing theories on the determinants of counterfactual plausibility are discussed. (shrink)

Following Einstein's prediction of the gravitational bending of light, and in the course of experimental work aimed at its verification, only sporadic and at times misleading references have been made to Johann Georg von Soldner. In a paper published in 1804, Soldner derived the gravitational bending of light on the classical Newtonian basis and calculated its value around the sun with remarkable accuracy. Soldner's paper, inaccessible even in German, is now presented in English translation and put in the perspective of (...) Soldner's life and the science of his day and ours. (shrink)

Political theology has multiple provenances. One less cited is the seventeenth century irenic dictum: “and we would all embrace a mutual unity in things necessary; in things non necessary liberty; in all things charity.” While aimed at ecumenical peace, this call for mutual unity implied a deliberative context that went beyond sectarian Christian concerns. Liberty and charity were as conducive to a comprehensive church as more modest laws of toleration. My claim is that this dictum’s themes are extemporized in recent (...) pragmatist thought. (shrink)

In 1941, Gellhorn and colleagues reported experiments in which modest reductions of blood sugar were induced in hypophysectomized/adrenodemedullated (HA) rats by intraperitoneal injection of human blood. Based on the effects of intraperitoneal injections of known amounts of Lilly insulin on blood sugar in HA rats, Gellhorn estimated that the "insulin" content of normal human blood (collected two and a half hours "after luncheon") was 200uU/ml (Gellhorn, Feldman, and Allen 1941). However, discrepancies between measurements of plasma insulin concentration by in vitro (...) bioassays, which began in earnest in the late 1940s and early 1950s, and, beginning in 1960, by radioimmunoassay (RIA), intimated that insulin was not .. Epistemic relativism comes in many forms, which have been much discussed in the last decade or so in analytic epistemology. My goal is to defend a version of epistemic relativism that sources the relativity in the metaphysics of epistemic properties and relations, most saliently knowledge. I contrast it with other relativist theses. I argue that the sort of metaphysical relativism about knowledge I favor does not threaten the objectivity of the epistemological domain.
