The main purpose of this article is to discuss the views of the Jesuit Stanisław Dunin–Borkowski (1864–1934) about Albert Einstein’s theory of relativity. These days, Dunin–Borkowski is a rather obscure figure despite rising to fame in the interwar period as an outstanding expert in the philosophy of Baruch Spinoza. Thus, the secondary aim of this article is to remind ourselves of this somewhat forgotten scholar. As a researcher, writer, and pedagogue, Dunin–Borkowski was interested in (...) numerous fields of knowledge. Among these were the natural sciences, including physics and the influence that new physical theories had on philosophical thought. This present study therefore fills a gap in the existing research about how Polish philosophers received Einstein’s theories. The example of Dunin–Borkowski also serves as a basis for discussing some of the fundamental problems of neo-scholasticism in receiving new mathematicised scientific theories. (shrink)

The article is devoted to the comprehension of formation and development of digital sector of the national economy in the People’s Republic of China in the first decades of the 21-st century. This study examined the essense of the digital economy as such, its inception and development, and the advantages, by which it supplies the world economy in the field of trade and services. The article explores the reasons, that led the transition of the Chinese State to digitalization at a (...) later date than in the USA and other Western countries, and Japan and Korea. This study examines the beginning of the process of creating the Internet technology sector in the Chinese economy with an explanation of the factors that caused the difficulties that PRC faced at the initial stage in this area at the initial stage. The work contains an analysis of the policy of the Chinese authorities in the field of the development of high technologies in the period under study. The authors explore the causes and consequences of fundamental changes which occurred during the formation of the network component of the national economy of China in 2010-s and explain the significant successes that the People’s Republic of China has achieved in the global high-tech market, taking into account the specifics of political situation in the country and its influence on the foreign economic policy of the Celestial Empire. Contre Rousseau, Yves Simon a exposé les raisons essentielles pour l'autorité. L'obéissance, à la loi que l'autorité définit ne consiste pas simplement à s'obéir à soi. Ce n'est pas non plus un acte irrationnel. St. Thomas a montré qu'en plus de la loi éternelle et naturelle, nous avons besoin de loi humaine positive. La loi humaine est elle-même oeuvre de prudence et de commandement. Dans la tradition chrétienne, l'obéissance est une vertu. Elle est mystérieuse en ce qu'elle indique une forme (...) plus haute de rationalité et de sagesse. Celui qui obéit la loi peut comprendre à la fois sa nécessité et le fait qu'elle présente au moins une alternative valable en vue du bien commun. (shrink)

The article devotes to the initial stage of I.S. Turgenev’s creativity path, when he intended to devote himself to philosophy. The first part of the historical and philosophical research covers the studentship stage of his life, Turgenev’s involvement to the University course of philosophy primarily in Moscow, then in St. Petersburg universities. Everything happened at Moscow University due to Professor M.G. Pavlov, Shelling’s philosophy follower, who was teaching physics in a philosophical format. He listened course of lectures on metaphysics at (...) St.-Petersburg University, given by A. A. Fisher, who was one of the first who started to teach philosophy in accordance with Uvarov’s ideological triade “Orthodoxy, Autocracy and Nationality”. The second part touches upon the period of education abroad. After he had finished the philological faculty of St.-Petersburg University in 1837, he became convinced that Russian universities could provide only preliminary education and real source of knowledge could be found only abroad; that is why he goes “to finish his education” in Berlin. There he studied ancient languages, history and Hegel’s philosophy under the guidance of Professor Werder. Turgenev also prepared different parts of Shelling’s teaching for publishing in Russian periodic, after famous philosopher had given lectures in University of Berlin. The last part of this article gives a picture of Turgenev attempts to receive masters’ degree and tries to take place at the Department of Philosophy. At the beginning of 1842, after presenting the diploma of candidate, granted by St.-Petersburg University, he asked Moscow University Council to give him a permission to receive the masters’ degree; his utter motive was to occupy the place at the Department of Philosophy, which was vacant for a long time. But he failed to do so in Moscow and moved to St.-Petersburg, where he tried to pass exams needed to get degree again. However, he failed again due to not giving the dissertation work; as the result, he didn’t receive masters’ degree and, furthermore, he dedicated himself entirely to literature. However, Turgenev saved his interest to philosophical problems, which he tried to solve in prose format. (shrink)

Dr Robert Chambers has recently argued that a loan on Quistclose terms does not actually create a trust, but rather the borrower receives the entire beneficial ownership of the funds subject only to a contractual right (enforceable by an injunction) on the part of the lender to prevent the loan being employed other than for the specified purpose. Chambers' approach, or at least something broadly similar, has received some obiter support from Potter LJ in Twinsectra Ltd v. Yardley. This article (...) maintains that Chambers' analysis leaves unresolved a number of significant issues. It does not explain Potter LJ's emphasis on the requirement to segregate the Quistclose funds from the borrower's general assets. Similarly, it seems not applicable outside the typical Quistclose scenario; for instance, where the funds are wrongfully transferred to a third party before the failure of the specified purpose, where the Quistclose arrangement arises outside a contractual setting, and where the dispute involves a third party holding a (pre‐existing) charge. Accordingly, it is suggested that it would be quite premature to conclude that more orthodox explanations of the Quistclose trust should now be jettisoned. (shrink)
