This article analyzes survey data from a national sample of K-12 public school teachers (N = 5190) with a focus on the nested sample of middle and high school social studies teachers (N = 927). The authors examine social studies teachers’ views on nationalism, including the sub-categories of chauvinistic nationalism and patriotism. In the analyses, the authors show differences in levels of nationalism based on demographic and regional factors and the relationship between levels of nationalism and teachers’ beliefs about educational (...) rights for undocumented immigrant students using both correlation and linear regression analyses. We argue that teachers’ views on nationalism could be a critical factor in shaping beliefs toward equity in relation to immigrant students. (shrink)

Actualmente abundan conceptualizaciones sobre pensamiento crítico. Gran parte de estas se enfocan en habilidades cognitivas, otras en resolución de problemas; algunas más, en toma de decisiones y acción; y otras, que integran los elementos nombrados. Ante la proliferación de concepciones surge la necesidad de hacer una clasificación de estos modelos en aras de comprender mejor sus enfoques y, en especial, la incidencia de las corrientes filosóficas en los elementos constituyentes que los sustentan para que los maestros tengan claridad sobre qué (...) aporta cada uno de ellos en sus prácticas de aula. Objetivo: identificar elementos constituyentes de los fundamentos conceptuales sobre pensamiento crítico para clasificarlos en modelos según sus finalidades. Metodología: análisis conceptual, realizado desde la filosofía analítica para revisar los conceptos esenciales expuestos por 44 teóricos en sus teorías. Se diseñaron matrices de análisis con 12 constituyentes que permitieron evidenciar los elementos de cada modelo y determinar qué corrientes filosóficas los fundamentan. Resultados: se evidenciaron cuatro modelos: lógico-racional, cognitivo-emotivo, cognitivo-cientificista y sociopragmático, en los cuales han incidido los aportes de grandes filósofos, quienes en su interés epistémico han vinculado la criticidad como elemento esencial en la construcción del conocimiento. Conclusiones: estos modelos aportarán claridad a los docentes, quienes intencionan su trabajo en el aula para formar pensadores críticos que cuestionen y transformen su entorno social. (shrink)

Instituciones políticas como la Comisión Europea y el Gobierno de España han manifestadosu interés y predisposición para sentar las bases de una gobernanza ética de la Inteligencia Artificial (IA). En particular, han planteado el impulso de una Inteligencia Artificial confiable a través de unconjunto de directrices y estrategias. A pesar del beneficio que reportan estas iniciativas políticas, no es posible apreciar en su conjunto una estrategia educativa específica que contribuya a la generación de un ecosistema ético de IA fundamentado en (...) la confianza. En ese sentido, el objetivo principal de este trabajo consiste en explicar que la enseñanza de la ética aplicada en los estudios de ingeniería constituye una apuesta para el fortalecimiento profesional, la gobernanza ética yuna investigación e innovación responsables. Para alcanzar este objetivo, en primer lugar, serándetallados algunos de los aspectos esenciales que dotan de un valor significativo a la enseñanza de la ética aplicada, subrayando la responsabilidad social que presentan las universidades en este terreno. En segundo lugar, se mostrará una clasificación de las asignaturas de ética relacionadas con la ingeniería en el entorno de las universidades públicas españolas. Y, en tercer lugar, se ofrecerá un marco teórico enraizado en la ética discursiva, promoviendo una mirada cívica en el contexto educativo de las profesiones. (shrink)

Este artículo tiene el objetivo de reflexionar críticamente sobre la construcción del perfil profesional de los docentes de artes y humanidades en la Educación Superior de Ecuador, con el fin de mejorar su empleabilidad en escuelas, colegios e institutos. Por este motivo, la investigación utiliza una metodología cualitativa, de carácter exploratorio y descriptivo, que promueve una revisión filosófica y antropológica para reconceptualizar los procesos de enseñanza-aprendizaje que se dan en la asignatura ‘Educación Cultural y Artística’ (ECA) del currículo de Educación (...) General Básica (EGB). Como resultado, se muestran las estimaciones estadísticas publicadas por el Ministerio de Educación (2021) sobre la cantidad de instituciones educativas que forman estudiantes en asignaturas relacionadas con las artes tanto en Educación Básica y Bachillerato General Unificado, como en instituciones especializadas y que necesitan docentes-investigadores formados. Desde una visión educativa compleja, transdisciplinar, decolonial e intercultural, la investigación propone ocho principios filosóficos y antropológicos derivados de la cosmovisión indígena quechua del Sumak Kawsay, orientados a construir una filosofía educativa de formación docente que mejore sus competencias pedagógicas y artísticas. Para concluir, se debate sobre las políticas públicas y los planes de estudios de educación superior que orientan el perfil profesional de los estudiantes que ejercerán como docentes. (shrink)

El presente trabajo busca las ventajas de articular la inducción y la analogía con las éticas aplicadas en proyectos socioeducativos. La revisión de artículos muestra que en los proyectos sociales predominan las éticas principialistas, a las que subyace una lógica deductiva, pero algunosestudios revelan éticas aplicadas de corte dialógico y crítico estructuradas con la inducción y la analogía. Se examinan posiciones teóricas sobre el estatuto de las éticas aplicadas, confirmando quela inducción y la analogía están presentes, tanto en la casuística (...) que culmina en la construcciónde máximas o criterios prudenciales como en procedimientos que exigen la participación de losinvolucrados en cada caso concreto, y en el círculo de la hermenéutica crítica con sus dialécticas. Mediante un procedimiento analítico-sintético se examinan 12 proyectos socioeducativos realizados en modalidad no formal. Como resultado, se distinguen cuatro combinaciones: 1) ética prescriptiva y lógica deductiva, 2) ética del reconocimiento y lógicas alternadas, 3) ética dialógica y lógica deldescubrimiento y 4) ética prudencial de la hermenéutica crítica y lógica dialéctica. Se concluye que, al incluir la inducción y la analogía en las éticas aplicadas en proyectos socioeducativos,se contribuye a la mejora de los aprendizajes y a la producción de pautas de comportamiento yconvicciones morales acordes con el contexto respectivo. How should we think of perceptual experiences qua dynamic phenomena? Against an increasingly popular Heraclitean approach that frames them as irreducibly dynamic, the present book argues that perceptual experiences may be described in terms of non-dynamic categories, such as properties, relations, and states.

Bioethicists involved in end‐of‐life debates routinely distinguish between ‘killing’ and ‘letting die’. Meanwhile, previous work in cognitive science has revealed that when people characterize behaviour as either actively ‘doing’ or passively ‘allowing’, they do so not purely on descriptive grounds, but also as a function of the behaviour’s perceived morality. In the present report, we extend this line of research by examining how medical students and professionals (N = 184) and laypeople (N = 122) describe physicians’ behaviour in end‐of‐life scenarios. (...) We show that the distinction between ‘ending’ a patient’s life and ‘allowing’ it to end arises from morally motivated causal selection. That is, when a patient wishes to die, her illness is treated as the cause of death and the doctor is seen as merely allowing her life to end. In contrast, when a patient does not wish to die, the doctor’s behaviour is treated as the cause of death and, consequently, the doctor is described as ending the patient’s life. This effect emerged regardless of whether the doctor’s behaviour was omissive (as in withholding treatment) or commissive (as in applying a lethal injection). In other words, patient consent shapes causal selection in end‐of‐life situations, and in turn determines whether physicians are seen as ‘killing’ patients, or merely as ‘enabling’ their death. As a result of recent corporate scandals, several rules have focused on the role played by Boards of Directors on the planning and monitoring of corporate codes of ethics. In theory, outside directors are in a better position than insiders to protect and further the interests of all stakeholders because of their experience and their sense of moral and legal obligations. Female directors also tend to be more sensitive to ethics according to several past studies which explain this affirmation by (...) early gender socialization, the fact that women are thought to place a greater emphasis on harmonious relations and the fact that men and women use different ethical frameworks in their judgments. The goal of this paper is to determine the influence of these characteristics of the Board in terms of promoting and hindering the creation of a code of ethics. Our findings show that a greater number of female directors does not necessarily lead to more ethical companies. Moreover, within Europe as a continent, board ownership leads to an entrenchment of upper-level management, generating a divergence between the ethical interests of owners and managers. In light of this situation, the presence of independent directors is necessary to reduce such conflicts. (shrink)

In a work entitled On the Generation of Animals, Aristotle remarks that “intellect (nous) alone enters from outside (thurathen)”. Interpretations of this passage as dualistic dominate the history of ideas and allow for a joining together of Platonic and Aristotelian doctrine on the soul. This, however, pulls against the well-known Aristotelian position that soul and body are intertwined and interdependent. The most influential interpretations thereby misrepresent Aristotle’s view on soul and lack any real engagement with his embryology. This paper seeks (...) to extract the account of intellect (nous) in Aristotelian embryology from this interpretative background and place it within the context of his mature biological thought. A clear account of the actual import of this statement in its relevant context is given before explaining how it has been misunderstood by various interpretative traditions. The paper finishes by touching on how early commentary by Christian writers, freed as it was from the imperative to synthesise Greek philosophy, differed from those that came after. While realising that Aristotle’s position would not aid them in their explanations of the soul’s survival after death, their engagement with Aristotle’s science allowed for other aspects of theology concerning the fittingness of soul to body. The subtraction argument, originally put forward by Thomas Baldwin (1996), is intended to establish Metaphysical Nihilism, the thesis that there could have been no concrete objects. Some modified versions of the argument have been proposed in order to avoid some difficulties faced by the original argument. In this paper I shall concentrate on two of those versions, the so-called subtraction argument* (presented and defended in Rodriguez-Pereyra 1997, 2000, 2002), and Efird and Stoneham’s recent version of the argument (Efird and (...) Stoneham 2005). I shall defend the subtraction argument* from Alexander Paseau’s (2006) objection that because a crucial premise of the subtraction argument* may have no plausibility independent from Metaphysical Nihilism, the subtraction argument* is not suasive. Although Paseau focuses on the subtraction argument*, I shall point out that Efird and Stoneham could reply to Paseau’s objection in the same way. Thus there are (at least) two suasive versions of the subtraction argument that establish Metaphysical Nihilism. But are those two arguments equally good? I shall argue that the subtraction argument* is preferable to Efird and Stoneham’s argument. (shrink)

Mounting evidence suggests that participation in clinical trials confers neither advantage nor disadvantage on those enrolled. Narrow focus on the question of a “trial effect,” however, distracts from a broader mechanism by which patients may benefit from ongoing clinical research. We hypothesize that the existence of clinical trials infrastructure—the organizational culture, systems, and expertise that develop as a product of sustained participation in cooperative clinical trials research—may function as a quality improvement lever, improving the quality of care and outcomes of (...) all patients within an institution or region independent of their individual participation in trials. We further contend that this “infrastructure effect” can yield particular benefits for patients in low- and middle-income countries. The hypothesis of an infrastructure effect as a quality improvement intervention, if correct, justifies enhanced research capacity in LMIC as a pillar of health system development. (shrink)

O objetivo deste trabalho é desafiar as correntes tradicionais da bioética, que fundamentam ideais abstratos de imparcialidade, cidadania universal e autonomia absoluta; confrontá-los a partir do conhecimento situado e do reconhecimento da matriz de dominação interseccional vigente na América Latina. Procura investigar como transformar múltiplas desigualdades, repolitizando a justiça interseccional, a agência política em momentos críticos de progresso e colonização dos nossos bens comuns. Nossa proposta final é uma bioética crítica interseccional, representativa e participativa, que inclua de forma não subordinada (...) as vozes e os conhecimentos dos outros, focada em nossas necessidades regionais, promovendo nossa autonomia relacional e o cuidado com a vida, em e para nossos territórios, comunidades e as gerações futuras. En este breve ensayo me interesa analizar el concepto de lenguaje privado desarrollado por Ludwig Wittgenstein. La importancia radica en el desafío que plantea esta noción cuando nos ponemos a pensar sobre las posibilidades reales de un lenguaje puramente privado. En este sentido, el argumento del enfoque wittgensteiniano sostiene que el significado de las palabras no se origina en experiencias subjetivas individuales, sino en la interacción social dentro de una comunidad de hablantes. De modo que, si cada persona tuviera un (...) lenguaje exclusivamente privado, la comunicación sería imposible. Por ello, el objetivo de este escrito se centra en debatir si efectivamente el lenguaje es un fenómeno colectivo, arraigado en prácticas compartidas y acuerdos tácitos, o bien, puede tratarse de una construcción personal subjetiva. En síntesis, para examinar este planteo me centraré en el argumento propuesto por Kripke contra el lenguaje privado, y desde allí, analizaré la paradoja escéptica de Wittgenstein. (shrink)

This piece contrasts two ontological views of perceptual experience: on the one hand, Experiential Heracliteanism, a view according to which the intuitively dynamic character of experience should be described – and probably accounted for – in irreducibly dynamic terms; and, on the other, Experiential non‐Heracliteanism, a stance according to which perceptual experience may at least be described – if not explained – in terms of nondynamic constituents. I specially strive (1) to frame both proposals against the backdrop of a venerable (...) Heraclitean metaphor and (2) to highlight the virtues of Experiential non‐Heracliteanism against its currently sexier Heraclitean counterpart. (shrink)

This paper argues that focusing on Aristotle’s theory of generation as primarily ‘hylomorphic’ can lead to difficulties. This is especially evident when interpreting the association between the male and sentient soul at GA 2.5. If the focus is on the male’s contribution as form and the female’s as matter, then soul becomes divided into nutritive from female and sentient from male which makes little sense in Aristotle’s biological ontology. In contrast, by seeing Aristotle’s theory as ‘archēkinētic’, a process initiated by (...) the male, the development of nutritive and sentient capacities emerges as intertwined, neither capacity originating in only one sex. Este trabajo lleva a cabo un estudio de caso descriptivo en un aula de 4º de la ESO en la que se aborda, desde Geografía e Historia, la cuestión problemática de la memoria histórica a partir de la dictadura franquista. La experiencia didáctica se orientó a transformar los contenidos programados en el libro de texto y promover el diálogo y la reflexión. El objetivo era observar si el alumnado era capaz de entender, asumir y reivindicar, desde una perspectiva crítica, el (...) período histórico presentado, aplicándolo posteriormente a otros aprendizajes. La metodología y los instrumentos fueron de tipo cualitativo. Se confirma que 1) el alumnado muestra interés por la memoria como objeto de conocimiento; 2) da sentido al conocimiento histórico y lo pone en valor, lo que redunda en una educación basada en el desarrollo del pensamiento crítico; y 3) adquiere una conciencia cívica para situarse críticamente en el presente y proyectarse en el futuro. A la hora de plantearse la realización de actividades relacionadas con la enseñanza de los aspectos astronómicos, se presentan problemas prácticos evidentes que no ayudan a desarrollar una adecuada actividad científica escolar. Las TIC son un instrumento de gran utilidad para sortear estas dificultades, dado que permiten reproducir los fenómenos celestes y experimentar con ellos. El objetivo de este artículo es, en concreto, reflexionar sobre la utilidad de las simulaciones informáticas para la enseñanza de los aspectos histórico-astronómicos. Resumen Este artículo busca analizar y hacer una lectura de la identidad, misión, ubicación y aporte que la parroquia ha venido realizando y tejiendo en relación con el contexto urbano. Al mismo tiempo desea comprender cómo ha incidido dicho fenómeno en el modo en el que la parroquia se ve y se lee, como también la manera en que se evidencian sus exigencias y los retos en tal contexto. Es de gran relevancia la pregunta sobre la identidad y la misión (...) de la parroquia en la ciudad, ya que parecería muchas veces diluirse entre tantas propuestas y dinámicas que ofrece la ciudad y los desafíos que le ofrece el ser humano-urbano y el nuevo estilo de congregante. Por ello urge redescubrir su sentido más profundo, ya que, si la parroquia no tiene una clara identidad en medio de la ciudad, corre el riesgo de permanecer en su autorreferencialidad, perdiendo su dinamismo misionero.This article seeks to analyze and read the identity, mission, location and contribution that the parish has been making and weaving in relation to the urban context, at the same time understanding how this phenomenon has affected the way in which it is seen and it is read, as well, to show what their demands and challenges are in this context. The question about the identity and mission of the parish in the city is of great relevance, since it would seem many times to be diluted between so many proposals and dynamics that the city offers and the challenges that the human-urban being offers and the new style of congregant. For this reason, it is urgent to rediscover its deepest meaning, since if the parish does not have a clear identity in the middle of the city, it runs the risk of remaining in its self-referentiality, losing its missionary dynamism. We propose a multi-agent logic of knowledge, public announcements and arbitrary announcements, interpreted on topological spaces in the style of subset space semantics. The arbitrary announcement modality functions similarly to the effort modality in subset space logics, however, it comes with intuitive and semantic differences. We provide axiomatizations for three logics based on this setting, with S5 knowledge modality, and demonstrate their completeness. We moreover consider the weaker axiomatizations of three logics with S4 type of knowledge and prove soundness and (...) completeness results for these systems. (shrink)

This article contends that Dworkin's notion of ‘genuine’ theoretical disagreements, which is a fundamental pillar in his criticism of legal positivism and semantic disagreements, requires a realist reinterpretation. This view is defended according to two core arguments. First, a realist reinterpretation of ‘genuine’ theoretical disagreements enables Dworkin to avoid semantic criticisms such as the one advanced by Joseph Raz, who propounds a sophisticated model of criterial semantics to explain theoretical disagreements. Second, to make intelligible the distinction between theoretical and semantic (...) disagreements in law, we need to resort to realist elements. The conclusion is striking and in clear contradiction with Dworkin's ametaphysical and epistemic abstinence. The article shows that there is a problematic tension within Dworkin's constructivist project and that he should revise either its ametaphysical view and epistemic abstinence, or notions such as ‘genuine’ theoretical disagreements. In this work, we present a multi-agent logic of knowledge and change of knowledge interpreted on topological structures. Our dynamics are of the so-called semi-private character where a group G of agents is informed of some piece of information $$\varphi $$ φ, while all the other agents observe that group G is informed, but are uncertain whether the information provided is $$\varphi $$ φ or $$\lnot \varphi $$ ¬φ. This article follows up on our prior work where the dynamics were (...) public events. We provide a complete axiomatization of our logic, and give two detailed examples of situations with agents learning information through semi-private announcements. (shrink)

Se analiza el consuelo en cuanto que fenómeno de acceso a otras dimensiones constitutivas del ser humano, como la afectividad, la apelación y el cuidado. Cultural studies need nihilism. The current canon of work focuses too heavily on a political age and human condition that is rapidly being altered and replaced by the use of neoliberal technologies. A new understanding of ontology and politics is necessary to make sense of and challenge the changing technological orientation of human beings by what Deleuze has called a mutation of capital. It is not through institutional discipline that power permeates our being any longer but through our orientation to (...) exist through and for neoliberal networks via our participation with internet technologies. Neoliberal technologies include and appropriates all bodies and experiences via their reduction to data and network flow; difference is no longer a tool of resistance. This work will assert that a move to a nihilist reading of ontology is what is missing from the work of cultural scholars and from current political movements interested in challenging the power of capital in the present. This work will attempt to build through nihilism a lens and an orientation via psychoanalytic theory and the work of Slavoj Žižek that offers resistance to neoliberal governance. (shrink)

Eight years since the Spanish statute on gender violence (Ley 1/2004) has been passed, it is time to assess its implementation. This paper deals with the proof of acts that are typified under that heading. In particular, it focuses on three issues. Firstly, it questions the admissibility of accepting the victim testimony as sufficient evidence to outweigh the presumption of innocence in favour of the accused. Secondly, it analyzes whether the Spanish Supreme Court doctrine on evidence in cases of gender (...) violence allows inferring such admissibility, and whether this is applicable to every case or only to a certain type. Thirdly, it tries to identify the consequences that can be attached to that admission. (shrink)

El presente artículo, refiere una investigación de carácter cualitativo, desarrollada con el propósito de interpretar los significados construidos por los docentes sobre la evaluación en sus prácticas, se contextualiza en la escuela primaria del Núcleo Escolar Rural N°323 en el estado Falcón, Venezuela, llevada a cabo en el año escolar 2016-2017. Asumido este quehacer como multireferencial, cíclico, emergente, co-construido y cambiante, fue abordado con una metódica orientada por la fenomenología social. Para la sistematización de la información se realizaron intercambios y (...) entrevistas en profundidad, mientras que los registros fueron realizados haciendo uso del diario del investigador y equipos tecnológicos como recursos. Los datos fueron analizados siguiendo los procesos de categorización y triangulación de fuentes, con la finalidad de ampliar el fenómeno estudiado para su comprensión. En el contraste, integración e interpretación de los significados se consideraron tres categorías medulares alusivas a la evaluación como proceso complejo, los nudos críticos en las prácticas evaluativas y la evaluación como componente curricular. Los hallazgos develados dan cuenta de los significados construidos por los docentes sobre la evaluación, quienes la plantean como un proceso auténtico, con el propósito de facilitar la mejora del proceso de aprendizaje. Our main research question is how pliable Norwegian meat consumption practices are. However it is not any type of elasticity we are interested in. We are specifically interested in the scope for what we dub the “4Rs” of responsible meat consumption within existing food systems: 1. Reducing the amount of animal-based proteins used 2. Replacing animal-based protein with plant-based, or insect-based alternatives 3. Refining processes of utilization of animal-based protein to minimize emissions, loss and waste 4. Recognising animal-based protein as (...) precious –i.e. recognising the people and the animals involved in meat production. -/- These four principles are derived by analogy to ethical principles guiding the use of animals in research, the so-called “3Rs”, namely: the imperatives to reduce the number of animals needed to make a scientific inference, to replace animal experiments with other types of research, and where not possible to replace ‘more’ with ‘less’ sentient creatures, and to refine the experimental setup so it minimises the discomfort and/or distress inflicted upon the animals (Russell and Burch, 1959). There are no such principles guiding the use of animals in farming, given the farming industry intrinsically relies on increasing its resources, of which animals are one. The current profile of climate change however opens up a way to re-appreciate meat –indeed what we articulate as the fourth principle of recognizing the preciousness of meat, above, given planetary boundaries. We proceed to reflect on how these 4Rs can be modulated, from a cultural-social perspective, that is, we look at cultural factors that could stretch current food practices along the 4R aspects. This study focuses on taxonomic and typological methods of innovation policies in the European institutional context. Although many types of policies affect innovation, no universally accepted criteria exist to classify them. As innovation policy in a myriad of thematic areas—systemic model—has become pluralized, this article offers a method for classification. Such policies are grouped and categorized according to biological and neofunctional approaches.

La actividad científico-informativa constituye un componente esencial de la actividad científica. Las etapas y tareas que la integran persiguen como propósito fundamental garantizar a los investigadores la información pertinente para el desarrollo exitoso de su trabajo. De ahí la necesidad de evaluar con periodicidad su comportamiento en las bibliotecas médicas. A partir de ello, el objetivo del estudio fue sistematizar los aspectos teórico-metodológicos correspondientes a la evaluación de la actividad científico- informativa en bibliotecas médicas. Para su realización se realizó revisión (...) bibliográfica en la que se analizaron tanto documentos normativos que rigen su accionar en el sector de la salud cubano, como materiales emitidos por otras instancias nacionales e internacionales. The informative work constitutes an essential component of the scientific work. The stages and tasks that comprise it pursue as fundamental purpose to ensure relevant information in order that researchers achieve the successful development of their work. Hence the need to assess regularly their behavior in the medical libraries. Based on that, the objective of the study was to systematize the methodological aspects relating to the evaluation of the scientific-informative work at the medical libraries. In order to accomplish this a broad literature review was made which analyzed both normative documents governing its actions in the Cuban health sector, as materials issued by other national and international bodies. Este trabajo se propone documentar y reflexionar sobre la utilización de herramientas pedagógico-didácticas en tiempos de SAR-COV -2 desde el espacio de la Práctica Docente de los Institutos de Formación Docente del Distrito 040-General Madariaga, provincia de Buenos Aires (ISFD N° 169; ISFDyT N° 59). Motiva la investigación que existen pocos trabajos empíricos que documenten las experiencias de la práctica docente en esta zona y en este contexto sanitario. Desde una perspectiva crítica se dará cuenta de las concepciones, utilización de (...) herramientas y estrategias que se ponen en juego desde las prácticas y residencia de los Profesorados de Inicial y Primaria, durante la pandemia mencionada. Se trata de una investigación cualitativa, exploratoria. Como resultados principales se abordarán la resignificación de distintas herramientas pedagógico-didácticas, como las videollamadas; la organización de contenidos mediante Classroom, Plataformas digitales y el dictado de clases por canales de YouTube. La finalidad es subrayar como común denominador la búsqueda de alternativas de interacción gratuitas, por parte de las docentes que, en casi la totalidad de los casos, tuvieron que garantizar la continuidad pedagógica mediante la propia construcción de dichos canales de comunicación. En los últimos tiempos el derecho ambiental ha ganado un puesto importante en el ámbito jurídico, hecho que refleja la preocupación que hoy se tiene por la relación del hombre con su entorno. Desde hace quince años, la Universidad Colegio Mayor de Nuestra señora del Rosario, por intermedio de su Facultad de Jurisprudencia y concretamente de la Especialización y la línea de investigación en Derecho Ambiental, ha propuesto a través de diversos proyectos avanzar en el conocimiento y análisis del ordenamiento (...) jurídico ambiental, aportando así al desarrollo, estructura y consolidación de esta rama jurídica. Bajo estos parámetros, el objetivo de esta publicación es hacer algunas reflexiones en torno a distintos temas que dentro del derecho público impactan o influyen al derecho ambiental y responder a los enormes desafíos que se presentan en la materia. Por tanto, el programa quiere contribuir desde la academia al diálogo crítico y propositivo que permita dar solución a los problemas encontrados en la aplicación del derecho ambiental. En el primer capítulo, Gloria Amparo Rodriguez describe los ordenamientos jurídicos constitucionales de Colombia, Ecuador y Bolivia a fin de analizar la forma en que cada uno de ellos consagra el derecho a un ambiente sano. A continuación, Martha Ovalle y Zelba Nidia Castro de Perez realizan un estudio de los principios de precaución y prevención, exponiendo su alcance, su fundamento desde el derecho internacional y cómo vienen siendo entendidos por nuestro ordenamiento jurídico, tanto jurisprudencial como legal. Luis Adolfo Diazgranados se ocupa de la responsabilidad de los funcionarios públicos en materia ambiental, para lo cual realiza un análisis de los deberes consagrados en la normatividad vigente. Continuando con esta temática, el profesor Jorge Agudo Gonzalez, de la Universidad Autónoma de Madrid, explora la incidencia del ambiente y los recursos naturales en los procesos contractuales, a fin de mostrar cómo estas materias se han constituido en variable fundamental en el devenir de la formación, celebración y ejecución de los contratos, desde un punto de vista crítico, los aspectos importantes del proceso sancionatorio ambiental, evidenciando las falencias y vacios del a Ley 1333 de 2009. Jairo Cabrera plantea algunas reflexiones sobre la responsabilidad, valiéndose de la doctrina internacional, sobre la problemática de la reparación por daño ambiental. Por su parte, Leonardo Güiza Suárez explica el régimen general de la responsabilidad ambiental en el ordenamiento jurídico a partir del daño de los bosques naturales y su incidencia sobre los derechos humanos. Andres Gomez Rey, desde la teoría del acto administrativo, desarrolla el análisis crítico del régimen jurídico de las aguas superficiales en el derecho ambiental. Giovani J. Herrera Carrascal realiza una disertación sobre los recursos naturales y el ambiente como elementos del espacio público que a su vez constituye en un componente del medio ambiente urbano a partir de la jurisprudencia y de las competencias respectivas. Por último, Marybell Ochoa Miranda trate el tema de los residuos hospitalarios en Colombia, exponiendo su régimen jurídico, las competencias de las autoridades ambientales, los deberes que en estos asuntos tienen los ciudadanos, proponiendo lineamientos para avanzar en la consolidación de la gestión integral de residuos hospitalarios y similares.
