What is the role of intention in the identification of encoding that arises for images and other non-lexical objects of semiosis? This proposal of the “intentional function” resolves the syntagmatic problems posed by visual imagery: it identifies the viewer’s treatment of what they encounter as if it is encoded based on formal non-signifying cues visible in the image and learned through past experience. This article considers an international sample of venture capital and private equity funds to assess the role of law, corruption, and culture in setting fund manager fees. With better legal conditions, fixed fees are lower, carried interest fees are higher, clawbacks are less likely, and share distributions are more likely. Countries with lower levels of corruption have lower fixed fees and higher performance fees, and are less likely to have clawbacks and cash-only distributions. Hofstede's measure of power distance is negatively (...) related to fixed fees and the use of cash-only distributions, but positively related to performance fees and clawbacks. Overall, the data strongly indicate that corruption, culture, and legal settings are much more significant in determining fees than fund manager characteristics and/or market conditions. (shrink)

Fundamento. La historia de la Neurocirugía en el territorio está estrechamente relacionada con la de otras especialidades como la Cirugía General y la Ortopedia. Tiene sus primeras referencias establecidas en la etapa colonial en el Hospital General, documentadas en el Boletín del Colegio Médico de Camagüey. Objetivo es resaltar la importancia que tuvieron el Hospital General y el Colegio Médico de Camagüey con su boletín en la historia de la Neurocirugía y la Ortopedia. Método. Es una investigación histórica que se (...) basa en la revisión documental y utiliza el submétodo cronológico para establecer el orden de los hechos que se describen. Desarrollo. El Hospital General a partir de su reconstrucción a finales del siglo XIX, se convirtió en el principal centro médico quirúrgico de la provincia en la época colonial. Muchos de los resultados de la actividad asistencial y científica de sus médicos apareció publicada en el Boletín del Colegio Médico de Camagüey, prestigiosa revista científica que se encargó de divulgar los resultados de la medicina camagüeyana y donde aparecen artículos que evidencian cómo cirujanos generales realizaron las primeras intervenciones neuroquirúrgicas y ortopédicas. Conclusiones. Se consideran al Hospital General y al Colegio Médico de Camagüey y su boletín, como elementos indispensables al escribir la historiografía de la Neurocirugía y la Ortopedia en el territorio. Ground: the history of Neurosurgery in this place is closely linked to other specialties like General Surgery and Orthopedics. The first documented references went back to the colonial period in the General Hospital, documented in the bulletin of the medical college in Camagüey. The objective is to highlight the importance of the General Hospital and the medical college and its bulletin in the history of Neurosurgery and Orthopedics in Camagüey. Methods: This a historical investigation that was carried out taking documented revision and using chronologic sub method to establish the order of the facts that have been described. Development: Since the reconstruction of the General hospital at the end of the XIX century, it became the main medical_ surgical center in the province during the colonial period. Many of the scientific results and medical activities were published in the bulletin of the medical college, which became a well-known scientific magazine that was in charge of publishing the medical success in Camagüey. There are articles to prove that general surgeons performed the first neurosurgical and orthopedic interventions. Conclusions: The General hospital, the medical college and its bulletin are considered crucial elements to describe the history of Neurosurgery and Orthopedics in the territory. (shrink)

In Ecowomanism at the Panamá Canal: Black Women, Labor, and Environmental Ethics, Sofía Betancourt constructs environmental ethics at the intersection of the global North and global South. Betancourt explores transnational environmental justice through the lived experience of women from the African Diaspora who migrated to Panamá to work on the Canal.

Aesthetic experience is original, dynamic and ever-changing. This article covers three research questions (RQs) concerning how immersive installation artworks can elicit emotions that may contribute to their popularity. Based on Yayoi Kusama’s and Peter Kogler’s kaleidoscopic rooms, this study aims to predict the emotions of visitors of immersive installation art based on their Twitter activity. As indicators, we employed the total number of likes, comments, retweets, followers, followings, the average of tweets per user, and emotional response. According to our evaluation (...) of emotions, panic obtained the highest scores. Furthermore, compared to traditional machine learning algorithms, Tree-based Pipeline Optimization Tool (TPOT) Automated Machine Learning used in this research yielded slightly lower performance. We forecast that our findings will stimulate future research in the fields of data analysis, cultural heritage management and marketing, aesthetics and cultural analytics. (shrink)

It has been argued that in a deterministic universe, no one has any reason to do anything. Since we ought to do what we have most reason to do, no one ought to do anything either. Firstly, it is argued that an agent cannot have reason to do anything unless she can do otherwise; secondly, that the relevant ‘can’ is incompatibilist. In this paper, I argue that even if the first step of the argument for reason incompatibilism succeeds, the second (...) one does not. It is argued that reasons require alternative possibilities, because reasons are action-guiding. A supposed reason to do the impossible, or to do what was inevitable anyway, could not fill this function. I discuss different interpretations of the claim that reasons are action-guiding, and show that according to one interpretation it is sufficient that the agent believes that she has several alternative options. According to other interpretations, the agent must really have alternative options, but only in a compatibilist sense. I suggest that an interpretation of action-guidance according to which reasons can only guide actions when we have several options open to us in an incompatibilist sense cannot be found. We should therefore assume that reasons and obligations are compatible with determinism. (shrink)

This article aims to reflect on the challenges of peace education in times of Covid-19 global pandemic from a positive perspective, understood as a new opportunity for education to consider the teaching of how to make peace from our daily experiences; and in this way, humanity can forge a more peaceful future. In this task, the use of imagination, fantasy and creativity as educational resources will be revalued. Likewise, utopia is proposed as that unknown horizon, still to come, that will (...) show us, in the face of so many doubts and uncertainties, those possible scenarios which will motivate us to continue working for cultures of peace. This reflection starts from the Reconstructive-Empowering Peace Education approach that I have been proposing in my research as a member of the Interuniversity Institute of Social Development and Peace. Proof requires a dialogue between agents to clarify obscure inference steps, fill gaps, or reveal implicit assumptions in a purported proof. Hence, argumentation is an integral component of the discovery process for mathematical proofs. This work presents how argumentation theories can be applied to describe specific informal features in the development of proof-events. The concept of proof-event was coined by Goguen who described mathematical proof as a public social event that takes place in space and time. This new meta-methodological concept (...) is designed to cover not only “traditional” formal proofs but all kinds of proofs and inference steps, including incomplete or purported proofs. Our approach attempts to make proof-events more comprehensive to express the complete trajectory of a mathematical proof-event until the ultimate validation of the proving outcome. Thus, we advance an extended version of proof-event calculus which is built on argumentation theories designed to capture the internal and external structure of collaborative mathematical practice and highlight the relationship between proof, human reasoning, and cognitive processes. In addition, another area in which argumentation can make a significant contribution is dealing with the defeasible knowledge of the Web which is a product of its open and ubiquitous nature. This approach seems to be sufficient for the presentation of Web-based proving processes as manifested in the case of the Mini-Polymath 4 project. (shrink)

This article presents the development, validation and application of an instrument to measure everyday moral distress in different health care settings. The concept of moral distress has been discussed and developed over 20 years. A few instruments have been developed to measure it, predominantly in nursing. The instrument presented here consists of two factors: level of moral distress, and tolerance/openness towards moral dilemmas. It was tested in four medical departments and three pharmacies, where 259 staff members completed a questionnaire. The (...) two factors were found to be reliable. Differences in levels of moral distress were found between pharmacies and clinical departments, and between the youngest and oldest age groups; departmental staff and the youngest group experienced higher levels of moral distress. Departments reported less tolerance/openness towards moral dilemmas than pharmacies. The instrument needs to be tested further, but its strengths are the focus on everyday ethical dilemmas and its usefulness in different health care settings. (shrink)

Addressing a gap in political thought, this book examines the interplay between ethos and practical reason in everyday life. It suggests that the burgeoning literature on the ‘ethotic’ dimension of democracy leaves untreated the issue of practical reason and how it infuses political judgment and action.

La formación del profesional de la salud de perfil amplio constituye uno de los objetivos principales en la educación médica superior. Sobre la base de este planteamiento se desarrolló una investigación en la Facultad de Ciencias Médicas de la Universidad de Ciencias Médicas "Carlos J. Finlay", de Camagüey, con el objetivo de exponer los fundamentos teóricos en los que se sustenta la competencia comunicativa intercultural en la enseñanza-aprendizaje del idioma Inglés. Se utilizaron diferentes métodos de investigación de los niveles teórico (...) y empírico. Se concluyó que estos fundamentos integran factores cognitivos, afectivo-emocionales, motivacionales, sociales, culturales, axiológicos y creativos, del proceso de desarrollo de la competencia comunicativa analizada. Formation of the health professionals with a wide profile constitutes one of the main objectives in high medical education. On this basis the present work is the result of a research carried in the Faculty of Medical Sciences at the Medical College of Camaguey. Its main objective is to expose the theoretical foundations of the intercultural communicative competence in the learning and teaching of English. Neuroethics, in its modern form, investigates the impact of brain science in four basic dimensions: the self, social policy, practice and discourse. In this study, we analyzed a set of 461 peer-reviewed articles with neuroethics content, published by authors from 32 countries. We analyzed the data for: (1) trends in the development of international neuroethics over time, and (2) how challenges at the intersection of ethics and neuroscience are viewed in countries that are considered developed by International Monetary Fund (IMF) (...) standards, and in those that are developing. Our results demonstrate a steady increase in global participation in neuroethics from 1989 to 2005, characterized by an increase in numbers of articles published specifically on neuroethics, journals publishing these articles, and countries contributing to the literature. The focus from all countries was on the practice of brain science and the amelioration of neurological disease. Indicators of technology creation and diffusion in developing countries were specifically correlated with increases in publications concerning policy implications of brain science. Neuroethics is an international endeavor and, as such, should be sensitive to the impact that context has on acceptance and use of technological innovation. (shrink)

Following the COVID-19 pandemic, many countries worldwide have put lockdowns in place to prevent the virus from spreading. Evidence shows that lockdown measures can affect mental health; it is, therefore, important to identify the psychological characteristics making individuals more vulnerable. The present study aimed, first, to identify, through a cluster analysis, the psychological attributes that characterize individuals with similar psychological responses to the COVID-19 home confinement; second, to investigate whether different psychological characteristics, such as personality traits, alexithymia, and resilience, specifically (...) influence anxiety, stress, and depression, depending on the scope of the confinement. We analyzed data from 393 participants who completed an online survey on their experiences during two different phases of the Italian lockdown, characterized by more or less strict measures of confinement. Two clusters were identified which included participants reporting a better (+ER) and worse (−ER) emotional response to the lockdown, respectively. Individuals in the −ER group showed lower emotional stability, resilience, and higher alexithymia. Moreover, even if lifting part of the restrictions decreased psychological distress among all participants, a reduction in perceived stress was observed only among individuals with high resilience. Finally, personality traits, alexithymia, and resilience differently affected depression, anxiety, and stress. Our results suggest that different psychological interventions should be planned depending on the context: mental health professionals should focus on enhancing the individuals’ coping strategies to alleviate stress in emergencies, while long-term intervention aiming at alleviating anxiety and depressive symptoms should focus on alexithymic tendencies and personality constructs. In this dissertation, I argue for what I call “practical perspective compatibilism”. According to this thesis, an agent with practical freedom is sufficiently free to be a moral agent and morally responsible for his or her actions. The concept of practical freedom is originally found in the writings of Kant. Kant argued that we can view the world from either a theoretical or a practical perspective. The theoretical perspective is that of causal explanation and prediction, whereas the practical perspective is (...) that of choosing what to do and how to act. We see that we are free when we view things from a practical perspective. Determinism cannot threaten our practical freedom, since from a practical perspective we must choose what to do even if everything ultimately is determined. I argue that practical freedom is sufficient freedom-wise for moral agency and moral responsibility because morality is action-guiding. Right and wrong are concepts to be employed in deliberation and advice. This is a strong reason to regard factors irrelevant to deliberators and advisers as irrelevant when making judgements of right and wrong, and whether somebody had some other kind of freedom than practical freedom is irrelevant to deliberators and advisers. There are also prima facie reasons to regard moral responsibility as tied to rightness and wrongness, so that agents are blameworthy when they did wrong and praiseworthy when they did right. I also show that no classic arguments for incompatibilism about determinism and moral responsibility work when directed against practical perspective compatibilism. Finally, this thesis discusses metaethics in relation to compatibilism. Since competing theories imply the falsity of some respected metaethical positions, metaethical considerations lend further support to practical perspective compatibilism. (shrink)

Because the term ‘epigenetics’ has been used in a wide array of inquires within the life-sciences, it has come to bear a significant number of meanings. And just as biologists cannot come to an univocal understanding on what epigenetics connotes, the effect that its study has had in challenging contemporary neo-Darwinian, genecentred paradigms is also unclear. Some scientists and philosophers go as far as to say epigenetics has eroded dichotomies central to modern western thought, such as nature and nurture, or (...) genotype and phenotype – but the matter ignites a great deal of controversy. What seems unquestionable, however, is that the notion that genetic material is a ‘programme’ that simply manifests itself in an external correlative, thus accounting for the development of a living organism, seems to have – at the very least – shifted. Rather than attempting to pinpoint the implications of epigenetics in contemporary biology, this article focuses on the ‘literary’ dimension of scientific debate: instability of meaning, metaphorical shifts, a redrawing of margins and limits. Furthermore, it will be argued that metaphor does not merely have a pedagogical value in the field but rather works proactively throughout the genesis, development and morphology of science and theory. By outlining a ‘literary’ dimension in discussions around genetics one can identify what Squier refers to as ‘the epistemological value of the imprecise’, which in the case of epigenetics seems to have jeopardized not only the boundaries between genes and their external correlatives, but even challenged the frontiers of traditional disciplinary discourse. This paper explores the relationship between informal reasoning, creativity in mathematics, and problem solving. It underscores the importance of environments that promote interaction, hypothesis generation, examination, refutation, derivation of new solutions, drawing conclusions, and reasoning with others, as key factors in enhancing mathematical creativity. Drawing on argumentation logic, the paper proposes a novel approach to uncover specific characteristics in the development of formalized proving using “proof-events.” Argumentation logic can offer reasoning mechanisms that facilitate these environments. This paper proposes how argumentation (...) can be implemented to discover certain characteristics in the development of formalized proving with “proof-events”. The concept of a proof-event was introduced by Goguen who described mathematical proof as a multi-agent social event involving not only “classical” formal proofs, but also other informal proving actions such as deficient or alleged proofs. Argumentation is an integral component of the discovery process for a mathematical proof since a proof necessitates a dialogue between provers and interpreters to clarify and resolve gaps or assumptions. By formalizing proof-events through argumentation, this paper demonstrates how informal reasoning and conflicts arising during the proving process can be effectively simulated. The paper presents an extended version of the proof-events calculus, rooted in argumentation theories, and highlights the intricate relationships among proof, human reasoning, cognitive processes, creativity, and mathematical arguments. Increased work complexity and financial strain in the health care sector have led to higher demands on staff to handle ethical issues. These demands can elicit stress reactions, that is, moral distress. One way to support professionals in handling ethical dilemmas is education and training in ethics. This article reports on a controlled prospective study evaluating a structured education and training program in ethics concerning its effects on moral distress. The results show that the participants were positive about the training (...) program. Moral distress did not change significantly. This could be interpreted as competence development, with no effects on moral distress. Alternatively, the result could be attributed to shortcomings of the training program, or that it was too short, or it could be due to the evaluation instrument used. Organizational factors such as management involvement are also crucial. There is a need to design and evaluate ethics competence programs concerning their efficacy. (shrink)

Research ethics is increasingly formally regulated, but little is known about how ethical considerations are reported in dissertations. The aim of this literature study was to describe the status and trends of ethical considerations in Swedish doctoral dissertations written by registered nurses. A total of 77 dissertations from 1987, 1997, and 2007 met the inclusion criteria and were analyzed by descriptive statistics. Ethical considerations were mostly overlooked in 1987, but almost ubiquitous by 2007. All dissertations in 2007, except one, had (...) a section on ethical considerations; however, these were short, lacking in references, and short on content. The most common topic was informed consent and approval from research ethics review boards, followed by confidentiality and ethical aspects of methodological issues. Our results imply that the quantity and quality of ethical considerations must be improved in order to assure ethical soundness for participants, patients, researchers, and society. (shrink)

Philosophers traditionally distinguish between excuses and exemptions. We can excuse someone and still see them as a participant in normal human relationships, but when we exempt someone, we see them as something to be managed and handled: we take an objective attitude to them. Madness is typically assumed to ground exemptions, not excuses. So far, the standard philosophical picture. Seeing other people as objects to be managed and handled rather than as persons with whom one can have relationships is, however, (...) ethically problematic. If I am mad myself, consistently seeing myself this way becomes downright unsustainable. A better option, I will argue, is to fully appreciate my own difficulties and learn to show myself compassion and understanding. I, then, can excuse myself on those grounds. Furthermore, a compassionate self-excusing attitude leaves room for both nuance and improvement in a way that total exemption does not. Finally, I will argue that many mad actions ought to be considered justifiable and justified rather than in need of exemption or excuse. (shrink)

In this paper, I will argue for two interrelated theses. First, if we take phenomenological psychopathology seriously, and want to understand what it is like to undergo various psychopathological experiences, we cannot treat madpeople’s testimony as mere data for sane clinicians, philosophers, and other scholars to analyze and interpret. Madpeople must be involved with analysis an interpretation too. Second, sane clinicians and scholars must open their minds to the possibility that there may be experiences that other people have, which they (...) nevertheless cannot conceive of. I look at influential texts in which philosophers attempt to analyze and understand depersonalization and thought insertion. They go astray because they keep using their own powers of conceivability as a guide to what is or is not humanly possible to experience. Several experiences labeled inconceivable and therefore impossible by these philosophers, are experiences I have had myself. Philosophers and others would be less likely to make this mistake if they would converse and collaborate more with the madpeople concerned. When this is not feasible, they should nevertheless strive to keep an open mind. Fantastical fiction may have a role to play here, by showing how bizarre experiences may nevertheless be prima facie conceivable. (shrink)

This study examines the ethical dilemmas and difficulties encountered by Portuguese school psychologists. As part of a larger survey, participants were asked about ethical issues faced in daily practice and asked to describe ethical incidents. Of the 477 respondents, 274 reported 441 ethically troubling or challenging situations. Responses were coded into a six-category system based on the code of ethics of Portuguese psychologists. Most of the reported dilemmas concerned privacy and confidentiality principles. Results are discussed in light of relevant literature (...) and international findings. Harming other people is prima facie wrong. Unless we can be very certain that doing so is justified under the circumstances, we ought not to do it. In this paper, I argue that we ought to dismantle harsh retributivist criminal justice systems for this reason; we cannot be sufficiently certain that the harm is justified. Gregg Caruso, Ben Vilhauer and others have previously argued for the same conclusion; however, my own version sidesteps certain controversial premises of theirs. Harsh retributivist criminal (...) justice can only be morally right if the following three propositions are true: Moral responsibility exists, retributivism is right, and we can find out how much punishment offenders deserve for their crimes. Suppose that we initially assign a high credence to each of the three propositions; I assume for the sake of argument that there are good arguments in support of each. Nevertheless, these arguments ultimately depend on intuitions. Since we have philosophical peers whose intuitions differ from ours, we ought to downgrade our credence in each. However, even slightly less credence in each proposition means far less credence in a conjunction of all three. Since the stakes are high and there are morally safer options for a criminal justice system, we ought to dismantle harsh retributivist ones. (shrink)

The medical and social model of disability is discussed and debated among researchers, scholars, activists, and people in general. It is common to hold a mixed view and believe that some disabled people suffer more from social obstacles and others more from medical problems inherent in their bodies or minds. Rachel Cooper discusses possible ‘test environments’, making explicit an idea which likely plays an implicit part in many disability discussions. We place or imagine placing the disabled person in a range (...) of different environments. If there is a relevant test environment in which they do fine, their problem was societal/external; if there is not, it was medical/internal. Cooper admits that deciding on the appropriate range of test environments is an ethical and political question. In this chapter, I argue that we often ought to widen our scope when discussing psychiatric disabilities. (shrink)

Aiming to develop normative recommendations for preventing corporate irresponsibility (CiR), business and society scholars have adopted strategic approaches—exploring the causal links between corporate social responsibility (CSR) and profitability—and moral approaches—exploring the moral principles of CSR that guide managers. However, some business ethics scholars have recently argued that these studies are too simplistic as they disregard the systemic logics of broader institutional environments that generate ‘bad apples’ firms and managers. Drawing on literature that sheds light on the systemic origin of CiR (...) (i.e. the comparative institutionalist perspective and the critical management perspective), we conduct an in-depth case study on how Russian systems of institutional absences shape insensitive corporate environmental violence of a Russian extractive multinational corporation. In doing so, we develop a novel cultural approach to the analysis of CiR that advances knowledge about the systemic origin of CiR in two ways. First, this approach allows for identifying how the sources of CiR are located within firms’ home national systems of institutional absences, which shape systemic logics of CiR that make corporate violence less traceable by firms and broader society. Second, this approach allows for identifying how governments can sustain and perpetuate insensitive corporate violence through the deliberate and systemic absenting of national institutions that could pressure firms to be more socially and environmentally responsible, thus making negative consequences of corporate violence invisible to firms and broader society. We propose future research directions and suggest policy changes in Russia and other countries with similar systems of institutional absences. (shrink)

Praise, unlike blame, is generally considered well intended and beneficial, and therefore in less need of scrutiny. In line with recent developments, we argue that praise merits more thorough philosophical analysis. We show that, just like blame, praise can be problematic by expressing a failure to respect a person’s equal value or worth as a person. Such patronizing praise, however, is often more insidious, because praise tends to be regarded as well intended and beneficial, which renders it harder to recognize (...) and object to. Among other things, a philosophical analysis of patronizing praise helps people on the receiving end articulate why they feel uncomfortable or offended by it, shows patronizing praisers how their praise is problematic, and provides input for further philosophical analysis of blame.In the first section of the paper, we discuss how hypocritical praise, just like hypocritical blame, can fail to respect the equality of persons by expressing that the praiser applies more demanding moral standards to the praisee than to themself. We further discuss obstructionist praise, which loosely corresponds to complicit blame, and can similarly express that certain moral standards apply to others but not to the praiser. In the second part of the paper, we discuss another variety of patronizing praise. Praise can be an inaccurate appraisal of a person based on irrelevant considerations – like race, gender, or class – and thereby constitute a failure to recognize their equal worth as a person. Wouter Kusters argues that madness has much to offer philosophy, as does philosophy to madness. In this paper, i support both claims by drawing on a mad phenomenon which I label Radical Psychotic Doubt, or RPD. First, although skepticism is a minority position in epistemology, it has been claimed that anti-skeptical arguments remain unsatisfying. I argue that this complaint can be clarified and strengthened by showing that anti-skeptical arguments are irrelevant to RPD sufferers. Second, there's a debate about whether so-called (...) hinge commitments are beliefs or not. I argue that RPD can be used to strengthen the case that they are. Moreover, if hinges are beliefs, some madpeople are more epistemically rational than some sane philosophers. Third, drawing on my own mad experiences, I challenge evidentialism by presenting a better candidate for a truly forced cchoice about what to believe than William James' traditional religious example. I further show that in certain psychiatric contexts, evidentialism has more radical implications than Jamesian pragmatism, which comes out as more conservative. Finally, I discuss how philosophical theories like pragmatism and Pyrrhonism can provide inspiration for new and much-needed coping strategies for RPD sufferers. (shrink)

In this paper, I review arguments according to which harsh criminal punishments and poverty are undeserved and therefore unjust. Such arguments come in different forms. First, one may argue that no one deserves to be poor or be punished, because there is no such thing as desert-entailing moral responsibility. Second, one may argue that poor people in particular do not deserve to remain in poverty or to be punished if they commit crimes, because poor people suffer from psychological problems that (...) undermine their agency and moral responsibility. Third, one may argue that poor and otherwise marginalized people frequently face external obstacles that prevent them from taking alternative courses of action. The first kind of argument has its place in the philosophy seminar. Psychological difficulties may be important to attend to both in personal relationships and when holding ourselves responsible. Nevertheless, I argue that neither type of argument belongs in political contexts. Moral responsibility scepticism ultimately rests on contested intuitions. Labelling certain groups of people particularly irrational, weak-willed, or similar is belittling and disrespectful; such claims are also hard to prove, and may have the opposite effect to the intended one on people's attitudes. Arguments from external obstacles have none of these problems. Such arguments may not take us all the way to criminal justice reform, but in this context, we can supplement them with epistemic arguments and crime prevention arguments. (shrink)

In 2000 “Literatura e Utopia”, a research group led by Ildney Cavalcanti, started working at the Federal University of Alagoas, including members from three other institutions. Despite its namesake, the group focuses extensively on cultural as well as literary aspects of utopian thinking, with special regard for the colonial and postcolonial viewpoints of Latin America. Since the introduction of drugs to prevent vertical transmission of HIV, the purpose of and approach to HIV testing of pregnant women has increasingly become an area of major controversy. In recent years, many strategies to increase the uptake of HIV testing have focused on offering HIV tests to women in pregnancy-related services. New global guidance issued by the World Health Organization (WHO) and the Joint United Nations Programme on HIV/AIDS (UNAIDS) specifically notes these services as an entry point for (...) provider-initiated HIV testing and counseling (PITC). The guidance constitutes a useful first step towards a framework within which PITC sensitive to health, human rights and ethical concerns can be provided to pregnant women in health facilities. However, a number of issues will require further attention as implementation moves forward. It is incumbent on all those involved in the scale up of PITC to ensure that it promotes long-term connection with relevant health services and does not result simply in increased testing with no concrete benefits being accrued by the women being tested. Within health services, this will require significant attention to informed consent, pre- and post-test counseling, patient confidentiality, referrals and access to appropriate services, as well as reduction of stigma and discrimination. Beyond health services, efforts will be needed to address larger societal, legal, policy and contextual issues. The health and human rights of pregnant women must be a primary consideration in how HIV testing is implemented; they can benefit greatly from PITC but only if it is carried out appropriately. In political theory it goes without saying that the constitution of government raises a claim for legitimacy. With the constitution of the people, however, it is different. It is often dismissed as a historical question. The conviction is that since the people cannot decide on its own composition the boundaries of democracy must be determined by other factors, such as the contingent forces of history. This article critically assesses this view. It argues that like the constitution of government, the constitution (...) of the people raises a claim for legitimacy. The failure to see this is what makes many theorists run into the arms of history. They submit the legitimacy of the people to the arbitrary and asymmetrical forces of the present. (shrink)
