Dans les théories traditionnelles de la sociologie du développement, les recherches se concentrent sur deux axes. D’un côté, les théories de la modernisation, qui étudient l’évolution des pays développés, de l’autre, celles du développement, qui s’intéressent aux modèles latino-américains, africains et est-asiatiques. Ces deux axes traditionnels limitent fortement le champ de vision de la sociologie du développement. Nous montrerons que les processus de transition dans les pays socialistes tels que la Chine, l’ex-URSS ou l’Europe de l’Est soulèvent toute une série (...) de débats inédits. Comment analyser la voie de développement propre à des régions et des pays différents ? Comment examiner les relations entre l’État et la société au sein du processus de développement et de transition ? Comment aborder le problème des inégalités sociales au sein de ce processus ? Autant de nouvelles questions – et ce ne sont pas les seules – qui élargissent non seulement le champ de vision de la sociologie du développement, mais qui permettent aussi d’envisager une nouvelle théorie pour cette discipline. Il s’agit d’observer le processus pratique de transition sociale dans les pays de l’ancien bloc communiste. L’objectif ? Restructurer la sociologie du développement autour de trois piliers : les théories de la modernisation, du développement et de la transition.Among the traditional theories in the sociology of development, research generally focuses on two lines. On the one hand, the theories of modernization, which mainly study the evolution of developed countries, on the other hand, the theories of development, which are interested in the patterns spread out by Latin America, Africa and East Asia. Those two directions set serious restrictions on the sociology of development’s scope. We’ll show that the transition processes of socialist countries such as China, ex-USSR or Eastern Europe actually raise a whole series of new debates. How should we analyze the specific way of development of countries or areas that are different ? How examine the relations between State and society during the development and transition process ? How should we deal with the issue of social inequalities during this process ? These new interrogations – and many others – do broaden the sociology of development’s horizons, but also help us build up a new theory for the discipline. We must scrutinize the practical process of social transition in the countries which were part of the former communist bloc, and, in so doing, rebuild the sociology of development on three pillars : the theories of modernization, of development and of transition. Food safety is a critical and persistent issue that challenges the sustainability of agri-food systems in Vietnam. The government has launched multiple food safety initiatives, but there is limited understanding of their contribution to changing the practices of small-scale producers and distributors. This study explores these changing practices by applying Social Practice Theory (SPT) to analyze the transitions in everyday routines of small-scale vegetable producers while being embedded in socio-institutional contexts of agri-food system transitions. We conducted semi-structured interviews (...) and survey with small-scale food producers and distributors in Hanoi, Vietnam to examine the transitions in production and post-production practices over the last 20 years and the intersection between smallholding practices and cross-level dynamics. The study revealed, contrary to some common perceptions, that smallholder producers are transitioning towards food safety, with the use of more bio-pesticides and eco-friendly pest control methods. The smallholders also reproduce a variety of (sustainable) intensification practices, including crop rotation, organic fertilization, and soil cultivation, to sustain soil fertility and save labor. However, there are no clear patterns of change for post-production practices, although they have been diversifying under the impacts of urbanization. The findings highlight the interplay of food safety, labor, and soil environment in shaping the transitions of smallholder practices. We suggest that success in improving safety in production practices is feasible, but that this requires more thorough interventions in distribution and consumption practices to transform the food systems at large. Historians of modern design and sociology have shown little interest in the leaders of the ever resourceful and influential British Positivist Society. One of the aims of this essay is to show that the Positivist polymath Frederic Harrison (1831–1923) cultivated ideas and practices that are compatible with modernists’ aspirations to improve the lives of the masses. It is accordingly shown that Harrison was an ardent supporter of working-class causes and that on this basis he developed sociological survey methods and (...) produced social programmes to initiate the comprehensive reorganisation of cities. Harrison intended to realise a modern utopia called the “Occidental Republic”, created by Auguste Comte, the Positivist Philosopher who – during the 1830 and 1840s – introduced both sociology and the Religion of Humanity. While many studies pore over the Positivists’ “church” rituals, this essay is the first to argue that the Religion of Humanity and sociology were of equal consequence – and that together they formed the basis of their controversial spatial theory and practice, which was considered the means to realise Comte’s utopia. This vision, it is argued, is central to appreciating how Positivism percolated into the “modern movements” of architecture and planning. (shrink)

One important aspect of the transition to modernity is the survival of elements of the Old Regime beyond the French Revolution. It has been claimed that this can explain why in the late nineteenth and early twentieth centuries some Western countries adopted national corporatist structures while others transformed into liberal market economies. One of those elements is the persistence or absence of guild traditions. This is usually analyzed in a national context. This article aims to contribute to the debate (...) by investigating the development of separate trades in Germany, the United Kingdom, and The Netherlands throughout the nineteenth century. We distinguish six scenarios of what might have happened to crafts and investigate how the prevalence of each of these scenarios in the three countries had an impact on the emerging national political economies. By focusing on trades, rather than on the national political economy, our analysis demonstrates that in each country the formation of national political economies and citizenship rights was not the result of a national pattern of guild survival. Rather, the pattern that emerged by the end of the nineteenth century was determined by the balance between old and new industries, and that between national and regional or local government. The paper analyzes Max Weber’s concepts of rationality and rationalization as components of modernization processes in modern society. The author reconstructs Weber’s interpretation of “spiritual factors” of social development, which emerge in the ethos of Protestantism. The research demonstrates how Weber’s study of capitalism in terms of rationality corresponds with concepts of other classics of German sociology, such as Ferdinand Tönnies, Werner Sombart, Georg Simmel and others. The article emphasizes the relevance of Weber’s sociology for XX— (...) XXI centuries and how its basic concepts and methodological approaches have been further developed by scholars, including Ukrainian ones. Weber’s concept of rationality is applicable not only to the mental-epistemological sphere, it also acquires a social meaning. This approach has gained recognition in phenomenological sociology, theory of social systems, communicative theory and more. In addition to the formal rationality of the economy, modern social sciences use such concepts as social, aesthetic, ethical, environmental, and practical rationality. Weber’s “diagnosis of the age” is still a component of the “diagnosis” of modern society. The gap between values and interests remains an integral feature of the “risks and threats society” in the XXI century. This situation is especially evident in international relations, when “real politics” (Realpolitik), based on interests, becomes insensitive to “value postulates”. The author also discovers ways of value (moral and ethical) reclamation of modern society, particularly in the concepts of “ethical economy”, universalist ethics of discourse, global ethos and more. A legal system consists of a complex body of practices—primary and secondary—, particularly practices of reasoning and justification. The intellectual, theorized aspect of legal order is embodied in legal doctrine: the corpus of norm-sentences, norms and rules, principles, doctrines and concepts used as basis for legal reasoning and justification. It includes elaborate conceptual structures of principles and doctrines, explicit and sophisticated forms of reflection and criticism. It is only when we have understood the nature of legal doctrine that we can (...) comprehend the workings of courts, lawyers and even legislatures. Concerning the need for a new conception of legal theory one question arises, above all, especially when external and internal observation as well as the critical reflection of the premises and presuppositions of all dealings with the law permit a degree of distance, the question, namely, whether it is not an increasing application of scientific methods that is needed, in the sense that the development of a legal theory from the beginning involves the integration of a norm-descriptive point of view and intellectual stand-point with the norm-prescriptive theory of law, by way of complementing each other, as it were (multi-level-approach to law). This, at least, appears to be the only way of clarifying also the relationship between le­gal theory and philosophy and the theory and sociology of law. Are we witnessing a dissolution of these categories similar to the earlier dissolution of the category of history, or are we witnessing an entirely novel consolidation of these categories? Has materialism essentially changed the semiotic (...) such that culture is now simply another commodity available for consumption on the world market, or has the semiotic radically subsumed the social such that cultural representation has become one with material reality itself? Has the relationship between the cultural and the economic altered in ways yet untheorized? Finally, what exactly does the culturalist turn in critical theory mean for the practice of postcolonial cultural/literary studies? And precisely what does it portend for the ongoing politics of decolonization?1 I shall attempt to engage these questions by focusing on two dominant theoretical discourses that regulate contemporary knowledge production in the humanities and social sciences: postcolonialism and globalization. While the "culturalist turn" in contemporary criticism has infected many disciplines, these two theoretical fields have been most influential in asserting the primacy or the constitutive role of the cultural in history, economics, and politics. Yet there has so far been relatively little explicit or systematic scrutiny of the links between postcolonialism and globalization theory.2The links are at once considerable and complicated. Despite differences in disciplinary origin (globalization theory in the social sciences, particularly sociology, and postcolonial theory in the humanities, particularly literary criticism), both discourses emerge at the intersection of imperialism, capitalism, and modernity. Both are concerned with the effects of unequal power relations between different geopolitical locations on the globe: postcolonial theory focuses primarily on a (Eurocentric) colonial past and studies how subaltern practices and productions in the non-Western peripheries respond to Western domination, while globalization theory concentrates mainly on [End Page 106] an (Americocentric) post/neocolonial present and examines how contemporary Western practices and productions affect the rest of the world. Furthermore, both theoretical paradigms have sought to question the universality attributed to Western modernity in metropolitan developmental theory by drawing attention to premodern, nonmodern, or alternatively modern formations in the margins. This attempt to dislocate Western modernity (from the theoretical center) has typically taken the form of dismantling those categories deemed to be central to the narrative of Western modernity—categories such as "nation," "nation-state," "culture" and so on. Consequently, both postcolonial and globalization studies have frequently focused on various forms of economic, political, social, and cultural flows that exceed the boundaries of the nation-state and operate in a deterritorialized or transnational fashion. Through these accounts, postcolonial theory has emphasized the cultural basis of history (the cultural constructedness of history as well as the archival value of cultural productions)3 while globalization theory, in turn, has highlighted the cultural basis of the economic (the economic value of cultural productions as well as the cultural production of economic value).But "besides their shared cultural grammar," the relationship between globalization and postcolonialism "is not very clear," notes Simon Gikandi in "Globalization and the Claims of Postcoloniality," a provocative essay that represents one of few attempts to explicitly articulate the relationship between the two discourses [628]. It is a background assumption of much of social science - here called modernist social science - that, in principle, there are neither questions that it cannot decline nor answers that cannot be found. Modernist social science does not accept the issues of inescapability and of attainability; they are names for adversaries that need to be fought against. In contrast to modernism in social theory, this article argues that social theory not only cannot succeed in (...) suppressing the questions of the inescapable and the attainable but indeed needs to be reconceptualized such that an understanding of inescapability and attainability becomes one of its organizing elements. The argument is developed by discussing three central problematics of social theory - the continuity of self, the certainty of knowledge and the viability of the polity - and by showing that an irreducible pluralism of modes of social theorizing exists which includes positions that emphasize the questions of inescapability and attainability. The various perspectives on self, knowledge and polity can be related to each other by reasonings that link a philosophy of the social sciences to a historical sociology of modernity. (shrink)

This article outlines a middle-range theory of pastoralist/rancher identity, offering a framework for analyzing the meanings, symbols, and practices associated with four interrelated dimensions of pastoralist identity: identification with livestock, place, family and community, and occupation. Poetic analysis of interviews from pastoral systems in transition in Mongolia’s Khangai and Gobi regions, the Spanish Pyrenees, and Colorado, USA shows how theorizing pastoralist identity, animated by place-based knowledge and emotion, may support deeper understanding of livestock-keepers’ social conflicts and responses to change. This article presents the moral and political sociology developed by the research group around Luc Boltanski and Laurent Thévenot from its gradual dissociation from the tradition of critical sociology during the 1980s to the present. Taking the major presentation of this approach, De la justification, as the point of departure, the key items of criticism to which this book was exposed are discussed, both in terms of their intellectual merit and in light of the ongoing debates in French (...) social and political theory. The work of this group was often rather erroneously taken to have provided both a new theory of society and a new normative political philosophy. What it aimed at achieving in the first place, in contrast, was a questioning of the assumptions on which reasonings in social theory and political philosophy are based and how those reasonings relate to social actors' own engagement with the world. Not least in response to the criticism received, however, the approach has been further elaborated in recent years, and it works now towards a new representation of the contemporary state of social relations and towards a comprehensive analysis of the practical political philosophies employed in political disputes. This paper argues that historical research is an important tool for modeling problem-solving in scientific invention and discovery. Two important cases in the history of modern physics—the invention of the transistor by John Bardeen and Walter Brattain and the development of the theory of superconductivity by Bardeen, Leon Cooper, and J. Robert Schrieffer—reveal factors essential to include in such a model. The focus is on problem-solving practices: problem decomposition, analogy, bridging principles, team-work, empirical tinkering, and library research. The proposal by Adam Smith that the market is a primal human reality has arguably been the most influential of the myths offered as a substitute for the authoritative story of Eden by the Enlightenment’s founding fathers. This essay examines how rival primal stories shape agents’ moral stances by directing attention, framing conceptual priorities and in situating stated and unstated analytical presuppositions in contemporary economic discourses. Contemporary scholars have recently emphasised that the root metaphor of Smith’s economic theory is (...) original barter. Tracing this scholarship, I will show how this picture of the human economic agent grounds the central tenets of the emerging global economic order. This vision will, however, then be shown to contrast with both the biblical vision of human economic activity, medieval and reformation theological appropriations of this vision, and the political and economic institutions that pre-modern Christendom developed to express their belief in a human responsibility to serve the divine sustenance of the human race. I will conclude by suggesting why the transition from Christendom to modern global capitalism demands a deeper than usual theological analysis of phenomena we usually refer to under the heading of globalisation, calling for reformulations of basic Christian and non-Christian presumptions about economic practice and ethics. A satisfactory sociology of markets requires that both order and disorder in markets be addressed, yet sociologists have seemed more concerned with theorizing market stability and order. Change, however, is too fundamental a part of markets to receive so little sociological attention. One perspective that provides a fertile ground for moving ahead with developing an agenda for studying both stability and change in markets is American pragmatist social theory. This article therefore examines the influence of a pragmatist (...) viewpoint on two broad modern theoretical approaches that have implications for the sociology of markets, one focused on stabilization processes, the other on institutional designs for promoting change. Most particularly, it draws on work carried out from a pragmatist viewpoint and illustrates a pragmatic approach to change in markets using the case of the EU’s Forest, Law Enforcement, Governance and Trade (FLEGT) action plan and initiative. Foodscapes, the ways and places in which human beings interact with food, are dominated by the global agri-food system. In many ways, it has never been easier to access such varieties or quantities of food. Be it in restaurants, supermarkets or local markets, food is often only a quick purchase away from the plate. In spite of that, there are persons who choose to follow alternative paths, moving away from reliance on the conventional system by engaging in practices of food (...) self-reliance. In this paper, using the analytical lenses of behavioural, social innovation and social practice theories, we explore why and how people strive for self-reliance and self-governing their foodscapes. We apply these lenses to data gathered from site visits and in-depth interviews with those engaged in self-reliant practices in Flanders. The practices we encountered range from permaculture to transition towns and illustrate the diverse alternative foodscapes found in Flanders. Our research reveals that while practices—and the people who engage in them—may at first appear distinct, they have commonalities as well, including similar values, needs, goals and more. These diverse elements combine to create, reshape and sustain practices within foodscapes. By further understanding the motivational, biogeophysical and social underpinnings that enable them we reveal a diverse, yet connected, continuum of practices. (shrink)

This article examines how distrust drives exchange. We propose a theoretical framework integrating the literature of trust into cultural sociology and use a case of patients giving hongbao (red envelopes containing money) to doctors in China to examine how distrust drives different forms of unofficial exchange. Based on more than two years’ ethnography, we found that hongbao exchanges between Chinese patients and doctors were, ironically, bred by the public’s generalized distrust in doctors’ moral ethics. In the absence of institutional (...) assurance, Chinese patients drew on the cultural logic of particularism and its associated cultural repertoire to induce fidelity from their physicians. They mobilized interpersonal networks to function as assurance and presented hongbao as a return of favor to the doctors. This form of exchange is gifting-oriented. Alternatively, if there were no interpersonal networks to rely on, they proactively offered hongbao to doctors at arm’s length in an attempt to personalize the relationship to seek assurance and abate their anxieties. This form of exchange is bribery-oriented. Both forms of exchange co-existed when there was one-way generalized distrust manifested from patients to doctors. When doctors also developed generalized distrust in patients, arm’s length exchanges declined, leaving embedded exchanges as the dominant form. Our study asserts the central role of culture in constituting exchange behaviors and the importance of institutions in shaping the form of exchange. It contributes to the midrange theory of trust, generating a number of hypotheses for future research on the relationships among culture, institutions, distrust, assurance, and illicit exchange. Inspired by Heidegger’s concept of the clearing of being, and by Wittgenstein’s ideas on human practice, Theodore Schatzki offers a novel approach to understanding the constitution and transformation of social life. Key to the account he develops here is the context in which social life unfolds—the "site of the social"—as a contingent and constantly metamorphosing mesh of practices and material orders. Schatzki’s analysis reveals the advantages of this site ontology over the traditional individualist, holistic, and structuralist (...) accounts that have dominated social theory since the mid-nineteenth century. Kuhn is often cited by scholars concerned with the discursive strategies by which the natural and social or human sciences justify themselves (...) and their specific claims. Kuhn's legacy is well captured by Nelson, Megill, and McCloskey in the opening essay of The Rhetoric of the Human Sciences (1987) where they link him to Stephen Toulmin and Chaïm Perelman as instigators of the study of the Rhetoric of Inquiry. In their words, Kuhn's landmark classic "challenges philosophy to account for the actual operation of scientific communities—their professional devices of communication and socialization, their political structures, their reliance on aesthetics, and their rhetorical dependence on persuasion" (Nelson, Megill, and McCloskey 1987, 12). Despite this reaction, however, Kuhn's project was in many ways modest. He was not seeking to develop a sociology of science or a rhetoric of inquiry. He sought only to account for the form of modern science's history, which is not marked by linear progress, but by a succession of dominant frameworks, or what he termed paradigms.As I will argue in this essay, Kuhn's conception of paradigms is incompatible with rhetoric, except during scientific revolutions or under conditions of incommensurability. Incommensurability is a problematic category, however, for the opening it affords rhetoric ultimately undermines the very idea of paradigms. Consequently, locating rhetoric within normal science either undermines the very category distinctions that provide science with its specificity, or reduces rhetoric from a particular genre of discourse directed toward human agency to "rhetoricality," an aspect of all discourse. As we shall see, such blurring of genre distinctions is itself fundamentally [End Page 248] problematic, for science and rhetoric as discursive genres and practices are themselves incommensurable, even if not in Kuhn's terms. Rhetoric and revolution Kuhn observed that modern science is characterized by the bracketing of major disagreements regarding basic assumptions except during periods of "crisis." While pre-modern inquiry saw the contemporaneous co-existence of fundamentally incompatible frameworks, each competing for adherents, modern science normally excludes such divisions. Instead, modern science is characterized by a succession of frameworks. Only at periods of transition that are temporally bounded, for which Kuhn coined the term "scientific revolutions," does more than one framework have currency within a given sub-specialty (1962, 10-22).Kuhn accounts for this curious historical phenomenon by arguing that modern science is precisely constituted through an enforced bracketing of debates over first principles. The first principles, or paradigm, of any field are more than a set of epistemological or ontological assumptions. They are the set of rules constitutive of science as an activity. They orient scientists in their work, providing background assumptions, methodological principles, criteria of validity, a research agenda, and so on. The hegemony of a paradigm frees scientists from having to justify their work philosophically, socially, or politically. As Kuhn observes, normally science has the form of puzzle solving (35-42). He even likens it to a game, and like any game the participants need not concern themselves with the extrinsic validity of its rules or of the game itself. As Kuhn notes: Though many scientists talk easily and well about particular individual hypotheses that underlie a concrete piece of current research, they are little better than laymen at characterizing the established bases of their field, its legitimate problems and methods. This argument carries the assumption that the dominating metaphors and perspectives of classical sociology are informed by conservatism. In sociology, this claim is supported by well-known and ambivalent theoretical structures that are developed to explain the process of social change. This study aims to make a (...) criticism of nostalgic sociology considering the idea that the fundamental assumptions of the ambivalent theoretical structure in sociology are nostalgic. In addition, this study also aims to critically read the historical development of Islamism, one of the modern ideologies, with nostalgia and utopia. The suggestion of the article is that either classical sociology or Islamism –two subject appear differently in terms of their topics- gave similar intellectual reactions about the subject that they are unable to cope with ‘the present’ and produce a ‘golden age’ discourse as a solution to ‘the present’. The argument of the study is that either the effort of idealizing ‘the past’ in classical sociology or the myth of coming back home in Islamism against cultural alienation and sense of loss which are lived in ‘the present’ are actually determined by sovereign modernity paradigm. Summary: Behind the nostalgic paradigm, there is a rebuilt history that is shaped as a transition from feudalism to capitalism. In this history, the decline of feudalism corresponds to the loss of rural community, the loss of personal expressionism and the loss of unregulated society. In classical sociology, the heritage left by the solution of this historical reconstruction of society has become common. The anomaly of the modern world is precisely where the modern society from traditional society has emerged in the pathological state created by the loss of social ties with the passing. This pathological condition was first seen in Swiss mercenaries serving away from home, diagnosing nostalgia as a diagnosis of discomfort. We know that Johannes Hofer, who has a sense of humor, has not written any prescription for this disease, which gives some common signs with his melancholy. Sociology, shaped by three different intellectual movements as intellectual responses to the French and Industrial revolutions that allow the transformation of the European society, has taken its place as its focal point, and in the pioneering names, this change is "a change in everything at a dizzying pace, everything that has happened has evaporated and the glory of the world has deteriorated.” Modernity, which refers to the ideals of enlightenment, is blessed not to progress by nature, fluid, rational, contingent, lacking certainty. In fact, this blessing has brought with it the enemy of tradition to the 'new' with reference to its etymological origin. This sophisticated and complex structure unique to modernity only, has inspired some thinkers to conceive of an idealized past or future that is now determinative. Both of these ideas are moderators. The nostalgia becomes modern because of the longing for a home that no longer exists or has never existed. Nostalgia is coeval with modernity. The article refers to Stauth-Turner's nostalgic paradigm, which provides the meta-phasic and meta-phase dominance of classical sociology detailed in Nietzsche's Dance. This paradigm consists of four main components. The first is that the history that we can summarize as a departure from the golden age when the world was a nest for man is seen as a decline and a loss. History is a history of sorrow and despair, as this decline will continue to exacerbate in the future. The example of such a feeling of grief in society theory is Weber's fate sociology. Because, according to Weber, whatever is waiting for us in the future is the polar night of the icy darkness, not the sunlight of summer. The second component of the nostalgic paradigm is the sense of secularization, together with the loss of integrity and moral certainty. This nostalgic trajectory is a very powerful secularization that emphasizes that such devastating social processes as urbanization, capitalist industrialization and the rationalization of everyday life, such as the diversity and complexity of social structure, the spread of scientific knowledge, urbanization with increasing population ratio, it brings forward its theory. With the announcement of the death of God, the gate of a competing and conflicting world has been opened, from which we have been transformed into a very godlike world. It is possible to observe a similar point of view in classical sociology in Durkheim, which has a theoretical basis for the transformation of social structures through professional distinction in the form of mechanical and organic solidarity. Durkheim analyzes social change in a deliberate way, and pre-change stake favors moral coherence. Moral coherence is now lost when collective consciousness is generally weakened in the post-change phase. The third trajectory we encounter in the nostalgic paradigm is the loss of individual autonomy and the decline of genuine social relations. With the loss of the moral unity, the individual has been caught under the domination of the bureaucratic state, in macro-social processes and institutions. It is inevitable that the individual who lost his autonomy is subject to the denial. The increasing exposure of the individual to social bureaucratic associations has been conceptualized by the iron cage metaphor in Weberian sociology. The enlightenment is the result of the panoptic collection of prison. So there is a nostalgic stance in this compound of the nostalgic paradigm that autonomy-ben lost because of the fall of the bureaucratic world under the domination of the modern state. In the nostalgic paradigm, the ultimate component is the feeling of laxity, spontaneity and loss of naturalness. Here, the individual is subject to not only macro-social processes but also micro-ethics. That is, it is understood that Adorno's "managed society" or Foucault's notion of closure prevents the individual's true emotions and enthusiasm, and that the consumer culture is preoccupied with certain preconceived ways of doing in a world dominated. To sum up, the metaphor of nostalgia that we are living in a world where we have been seized by administrative rules of a central state in a way that has lost the moral certainty and autonomy of the individual. The return to home, which is found in a significant part of the texts and practices put forward in the name of Islamism, has reached a deterministic attitude just as it was in classical sociology. In the nostalgic imagination where those who cannot cope with it are thought of as a safe harbor, there is a certain attitude towards deterministic ideologists that simplify, sanctify, and therefore falsify. Indeed, the imagination of a supra-historical, supra-community model for a time like the Golden Age discourse and for all time is itself history from the very beginning to the end. Therefore, it is a manifestation of a major historical process and the ideological design of sociality. The rhetoric discourse presented as a remedy in the present is possible with an anachronistic point of view which idealizes the past, and therefore the reality is distorted. The authentic one is extremely informal. This kind of discourse of authenticity, which is produced as opposed to the modernity that all that is solid melts into air, eventually has to make iron cages around it. As a result, the nostalgic rhetoric, which aims to be a modern chivalrous remedy that everything changes at a dizzying pace, has been determined by the paradigm of modernity, thanks to its self-reflexive nature which contains the opposite. This paper discusses the varieties of capitalism in transitional societies in Latin America and Central / Eastern Europe. The intended purpose of these transitions from semi-closed import-substituting economies in the first case and state socialist ones in the second was to institutionalize open-market economies. Twenty or thirty years later, there is a variety of types of capitalism in these countries, which I classify into three: open-market, neo-mercantilist, and anemic. The question for sociology is whether these quite different (...) variants represent temporary stages or distortions in the same process of transition or whether, on the contrary, they may institutionalize as discrete forms of peripheral capitalism. Neither standard “legacy” argu­ments nor institutionalist theories offer satisfactory answers to this question. The multiple modernities approach, on the other hand, is more appropriate as a theoretical perspective, but it has not produced yet specific propositions applicable to this question. My paper makes two claims. First, the successful transfer of institutions depends on the congruence between these institutions and the broader institutional framework of the recipient economies, a point not developed by institutionalist theories. I offer a hypothesis in this regard: Two critical nodes of congruence are the regulatory and extractive capacity of the state and the strength of civil society. Second, market capitalism (as liberal democracy as well) is a complex institution, and some of its components “travel” more easily across societies and institutional frameworks, and therefore are easier to institutionalize. From the beginning of his career Alain Touraine tried to develop a heterodox sociological terminology which promised to open up new ways of thinking about the dynamics of modern societies. This article tries to bring to light some of the Sartrean roots of Touraine's early theoretical tools and to reconstruct his intellectual development through the 1970s and 1980s when he formulated his ideas on the emergence of social movements within post-industrial society. It will be argued that Touraine's major works (...) of the 1990s - though not without some theoretical problems - offer fresh insights into the conditions of modernity and are able to correct and modify interpretations of modernity of major theorists such as Habermas and Taylor. In Between Facts and Norms, Jürgen Habermas works out the legal and political implications of his Theory of Communicative Action (1981), bringing to fruition the project announced with his publication of The Structural Transformation of the Public Sphere in 1962. This new work is a major contribution to recent debates on the rule of law and the possibilities of democracy in postindustrial societies, but it is much more. The introduction by William Rehg succinctly captures the special nature of the work, (...) noting that it offers a sweeping, sociologically informed conceptualization of law and basic rights, a normative account of the rule of law and the constitutional state, an attempt to bridge normative and empirical approaches to democracy, and an account of the social context required for democracy. Finally, the work frames and caps these arguments with a bold proposal for a new paradigm of law that goes beyond the dichotomies that have afflicted modern political theory from its inception and that still underlie current controversies between so-called liberals and civic republicans. The book includes a postscript written in 1994, which restates the argument in light of its initial reception, and two appendixes, which cover key developments that preceded the book. The article deals with theoretical, practical, partly - historical aspects of scientific research of modern Ukrainian and foreign sociologists and social workers. The aim of the research is to analyze and summarize the following three key aspects: a) historical destructive moments in the development of Ukrainian/Soviet sociology; b) the orientation of the vector of postmodernist research of foreign scholars who had no censorship restrictions on their works; c) the main problematics of current Ukrainian sociological research. The latter, despite (...) their deep materialistic tradition, find opportunities for new non-empirical approaches. In the article with the help of analysis of methodical sources, generalization of their content and presentation and interpretation of individual statistical data the authors substantiate: socio-economic, managerial and pedagogical reasons can systematically present the problematics of the current research of social workers. However, the postmodern aspect, still not "reworked" by the Ukrainian society, has not yet left its final mark on the social research. The international significance of the article lies in the interest of countries of transitional democracies and economies, previously under totalitarian influence, to acquire full emancipation and neo-liberalization concerning social problems and humane ways of solving them. The relationship between knowledge and values, experts and lay people, represents a major issue of the debate involving environment and technology. There is a growing awareness that the connection between value commitments and technical solutions, scientific expertise and lay competence, is much more entangled than once was believed. The article deals with this issue by analysing Robert Dahl's `minipopulus' and Silvio Funtowicz and Jerry Ravetz's `extended peer communities' arguments. They are subsequently inserted into the sociological debate which is, at present, (...) considerably influenced by the reflexive modernization framework. As a result, Ulrich Beck's and Anthony Giddens' theories appear as one of four ideal-typical approaches to the social construction of the issues that can be outlined, according to the priority assigned to knowledge versus power and nature versus society. The idea of an `extended peer review' of problems and solutions is remarkably close to the deliberative democracy concept. However, the high level of uncertainty characterizing major environmental and technological questions suggests that a `strong' version of deliberative democracy, such as the Discourse Ethics proposed by Habermas, is untenable in its search for a universal, rational consensus on the normative grounds of action. Thus it is necessary to develop a `weak' interpretation of the extended peer review, exploring the possibility of fair and stable agreements on bounded, practical solutions to bounded, practical problems. Classification existing in the western philosophy of education and education of directions is spent, (...) proceeding from basic principles of philosophical school or a current, first of all considering those the purpose and means which are really involved by them in process of education, social development and socially-moral education and being based on the basic installations, the purpose expressed by that or other direction, how its supporters imagine the person, its requirement, a social role, модус behaviour which the education system and education urged to form. Scientific novelty. In conditions when against crisis of an education system of the government of the USA and the leading countries of Europe are compelled to begin its long-term reform, its theorists substantially pay attention to democratic workings out of concepts of an instrumentalism of a pragmatism/neopragmatism in modern social philosophy of education, in particular on their aspiration to introduce in process of social development, education and education idea and practical model both educational, and a social equality. Considering growing requirement of a practical embodiment of ideas of freedom, justice, aspiration to realization of the human rights proclaimed a society, supporters of the concept of «new humanism» see the main objective in blocking a way to conformism, to a manipulation behaviour of the person and to create conditions for its free self-expression, for realization by the person of a fundamental choice of acts in a concrete situation and by that to warn danger of formation of the unified form of behaviour. In it principles of «new humanism» approach with a position of «new humanism» instrumentalism and neopragmatism. Conclusions. Before social philosophy of education/education it is necessary to define a problem factors which cause achievement of its main objective, to state an estimation to moral principles and personal qualities with which actually the education/education theory connects realization of the problems, to show, why these, instead of any other principles and qualities open to the person possibility to choose in a concrete situation socially powerful both morally defensible and comprehensible line of conduct in public the relation. Statement of a question on necessity of the philosophical analysis of problems of education and education in a social context serves as an indicator of understanding philosophers, teachers of an increasing role of the human and moral factor in society development. And, at last, the aspiration to develop socially-philosophical bases of pedagogics in general and education in particular, testifies that the western and domestic philosophers, teachers, representatives of social and psychological sciences, at least, the majority of them, have realized the public importance of an education system and education, its global character. The issues that we raised go beyond the framework of just pedagogical research, since they cover an area of research in the juncture of the sciences about the human being. We are talking about the interdisciplinary analysis and integration of the fundamental foundations of the solution of the problems of both theoretical and constructive-designing character. At that, the philosophy of education carries out its regulatory function determining directions and boundaries of the research. The philosophy of education inscribes itself in the (...) cultural dominant of the time, in such way fostering the choice of the development strategy of the educational systems, which will be adequate to the positive tendencies of social development, the modern spiritual search of humanity. The research in the area of education philosophy is connected with the integration of sociological, culturological, philosophical, economical, political, biological, psychological and other knowledge. The interdisciplinary character is a necessary condition of overcoming certain isolation of the modern theory of pedagogics from general processes of cultural, scientific, and social development; a condition of significant growth of its conceptual and theoretical level, serious strengthening of its role and importance in determining the prospects of education, in the development of educational programs, projects of various levels. In the field of history of Chinese philosophy, the key points and difficulties in the research on Fang Yizhi are mainly reflected in two ideological lines: one is how the academic pattern of the transition from Neo-Confucianism in the Song and Ming Dynasties to the texturalism in the Qing Dynasty happened; the other is how the traditional Chinese humanities accepted the western modern natural sciences and technologies. Relatively speaking, in the late Ming and early Qing Dynasties, there were fewer academic (...) discussions on the relationship between intellectual thought and natural science and technology, and no universally accepted explanatory paradigm has been put forward yet. To understand the relationship between science and humanities in late Ming and early Qing Dynasty, as well as that between modern western natural science and ancient Chinese traditional thought, Fang Yizhi is a precious object of study. Fang Yizhi's thinking and practice about "things" is a bridge linking the natural world and the human world. “Thing” in Chinese philosophy has both concrete and abstract attributes, including but not limited to the category of “matter” in Western philosophy. Fang Yizhi has always been regarded as an encyclopedic thinker, and his theory of things is extremely rich. The theory and practice of things are the core of Fang Yizhi's philosophy. Fang Yizhi believes that the three religions all hold that the ultimate noumenon itself is "unknowable" and at the same time is the fundamental basis of every single thing, so people can only "study its origin" from the "knowable", that is, the "thing". This train of thought lies in the base of Fang’s thinking when describing and analyzing the relationship between Dao and things, which includes both theories of the universe and the ontology. This paper holds that the basic idea of Fang Yizhi's philosophy on the theory of body and function is that ‘there is no body but there is function’, while on the theory of universe it is that what above Yin and Yang are unknowable. Because the Dao has no body, it has only the function. And because nothing above the Yin and Yang can be understood, people can only use what is below the Yin and Yang such as the principle, qi 氣, image and number, to form the universal principle through the induction of the principle of “things”. Furthermore, Fang Yizhi ascribes the body, mind, nature and destiny to the concept of things, that is to say, he regards the self as the object of rational cognition. In this relationship, "I" is not only the subject of cognition, but also the object of cognition, thus realizing introspection inward. Thirdly, utensils and heaven and earth, that is, man-made objects and natural objects, are external to the self. Although Fang Yizhi also advocated "making" things external to human beings, under the social class system of scholars, peasants, workers and businessmen, he could only engage in the research of the theory of external things, that is, the so-called science of quality and measurement. On the whole, Fang Yizhi's physical research and practice did not go beyond the scope of Chinese traditional natural science, but he was good at summarizing research methods, actively absorbing the contents of western natural science, and put forward correct ideas on many specific natural science issues. Mou Zongsan's discussion on the relationship between existence and activity inspires the author to think about the significance of the theory of “round ∴”. Fang Yizhi drew a series of laws represented by the theory of “round∴” through the induction of the principle of being. Although these laws are derived from existing things, they themselves are not static, but show two levels of active states: one is the internal dynamics of the laws, that is, the constant rotation; the other is that the law derived from the existing things can be applied to the activities of people, considering eternity and change, the right timing and other variable factors. This paper tries to follow the essence of Fang Yizhi's thought to seek for communication and connection between objects and things, between being and activity, between natural science and moral and human ethics. From the perspective of the development of modern and contemporary Chinese philosophy, the study of mind has always occupied an important position, and the corresponding philosophical research of “things” is relatively lacking. In theory, mind and thing are relative and inseparable aspects, and the thoughts on “things” in traditional Chinese thought resources are comparable to the study of mind in terms of diachronic, textual volume and theoretical depth. The rapid development of modern natural science and technology and its challenges to the human world have promoted the deep and lasting reflecting on the problem of things and the relationship between people and things in western philosophy. Scientific rationality invades every aspect of human's life. The transformation of knowledge to practical technology enhances human's ability to control and transform things. Instrumental rationality dominates human's understanding of things, and “things” fall from the meaning world of human's living situation and become the means to meet human's needs. A re-examination of this period in Chinese history, when pre-modern ideas and science and technology first collided, may be helpful to enlighten us to think about the relationship between science and technology and the world of human significance. The concept of "practices"--whether of representation, of political or scientific traditions, or of organizational culture--is central to social theory. In this book, Stephen Turner presents the first analysis and critique of the idea of practice as it has developed in the various theoretical traditions of the social sciences and the humanities. Understood broadly as a tacit understanding "shared" by a group, the concept of a practice has a fatal difficulty, Turner argues: there is no plausible mechanism (...) by which a "practice" is transmitted or reproduced. The historical uses of the concept, from Durkheim to Kripke's version of Wittgenstein, provide examples of the contortions that thinkers have been forced into by this problem, and show the ultimate implausibility of the idea. At the core of the theory is a decisive attempt to debunk the pitfalls of teleological and deterministic conception of history that litters most Liberal, Weberian and Marxist conceptions of history. Whether to a `liberal' or a `people's' democracy, the evolution of modern political systems has been consistently theorized as a `transition'. Elaborated within Marxism as the `transition to communism' and later recycled by modernization theory and comparative politics, this concept has been tightly connected to the development of macro-societal analysis. This paper argues that any attempt at writing its history should be sensitive to the deep-seated ambivalence of this concept, which has alternatively lent itself to either teleological or non-teleological (...) interpretations. But far from matching the ready-made division between Marxist and non-Marxist political sociology, this ambivalence has always been internal to these different social scientific traditions. As a result, the same conceptual issues and tensions can be identified within the Marxist and, later, Soviet doctrine on the one hand, and Western social sciences on the other hand, from the sociology of development of the 1950s to comparative democratization in the 1980s. The article is devoted to the problem of studying the activities of revolutionary and ideological virtuosi of the XX century by means of the historical sociology of modernity. It attempts both to identify the main trends in the participation of intellectually active strata of modern societies in the radical transformation of social reality, and to clarify the reasons that pushed them to do so. It is noted that the ideological background of such forms of socio-political radicalism were the (...) symbolic means of challenging the old forms of social reality and constructing new forms through secular ideologies of various types (socialism, communism, anarcho-syndicalism, fascism, national socialism, etc.). The role of conductors of the ideological message of these secular religions of salvation to the masses was usually performed by radical-minded intellectuals and students, for whom the worship of new idols and symbols of faith became the true meaning of life and struggle. In the XX century, it was the intellectuals who acted as the main creators and operators of collective salvation religions, and the social communities created on their basis. Moreover, they not only tried to save themselves with their help, but at the same time laid claim to the legitimate monopoly of determining who would be saved, and who would not. Thus, radical intellectuals acted as both the creators of the new norm and as agents of the policy of rationalization. The article pays special attention to the characteristics of the creators and social carriers of radical ideological views — and the worldviews based on them — as well as the refraction of these utopian visions in the socio-political practice of the last century. In conclusion, it is suggested that Max Weber’s historical sociology and Emile Durkheim’s symbolic theory of the “sacred”, supplemented by modern developments in the field of political sociology and socio-historical anthropology, can serve as a relevant system of theoretical coordinates for the study of ideological and revolutionary virtuosi of the XX century. In the context of agricultural activity intensification and rural abandonment, neo-rurality has emerged as a back-to-the-land migratory movement led by urban populations seeking alternative ways of life close to nature. Although the initiatives of the new peasantry are diverse, most are land related, such as agriculture and livestock farming. A priori, neorural people undertake agri-food system activities in ways that differ from the conventional model, following the principles of environmental and social sustainability. We conducted a systematic review of the (...) literature on the neo-rural phenomenon with the main objective of examining how neo-rurality has been found to support agroecological transitions. The corpus of neo-rural studies was analyzed from a social-ecological perspective, and a Multiple Correspondence Analysis (MCA) was conducted to determine whether neo-rural agri-food system activities follow agroecological principles. The results indicate that neo-rural studies is an emerging research field that has received considerable attention in western countries. Diverse conceptualizations and terms have been used to address the phenomenon, but the literature agrees on political and environmental motivations and several barriers faced by neo-rural people. This population and in particular new peasants, are employing a wide variety of agroecological practices and strategies throughout the agri-food system. Overall, neo-rural people have been reported to contribute significantly to agroecological transition. (shrink)

This article seeks to provide a comprehensive re-evaluation of the redistributive models of democracy advanced by Carles Boix, and Daron Acemoglu and James Robinson, their reception within the democratization literature, and the subsequent trajectories of their authors. Contrary to the existing literature, which commonly envisions RMDs as a unified framework, this article argues that Boix and Acemoglu and Robinson’s models should be understood as divergent theories of democratic transitions. In the aftermath of numerous criticisms, both authors have developed sharply (...) different understandings of democratization. We argue that Acemoglu and Robinson have backtracked from their original formulation toward a “Whiggish” history of the rise of liberty, while Boix has increasingly reverted to the core propositions of classical modernization theory. In the process, this article argues that RMDs have lost, and reneged on, much of their apparent explanatory power regarding transitions to and reversions from democracy. (shrink)

Georges Sorel's reputation as a proponent of violence has helped to link his ideas to fascist and totalitarian thought. Much of the literature on Sorel as developed this theme, at the expense of what Sorel himself stated as his primary purpose, "the discovery of the historical genesis of morals." How, Sorel asked, in the light of the development of modern industry and the vast powers of the modern state the individual can possess a sense of self-worth and at the same (...) time help to sustain a cultural vitality similar to the great societies of antiquity? How is it possible to avoid the utter resignation and nihilistic relativism of modern existence? In his writings Sorel outlined a sociology of virtue that combined the importance of family love as the basis of community feelings with acceptance of the basis of individual vitality as constant industrial struggle against nature. Sorel's solution is different from Marx's: in place of the ida of transcended alienation, Sorel envisions an agonal striving against nature's unceasing resistance to our efforts. The Feuerbachian unity of nature that, for Marx, had been alienated under capitalism, Sorel regarded as being inherently fragmented by scientific procedures themselves, as well as by the industrial processes that correspond to those scientific procedures. For Sorel, the struggle against nature is the struggle that enables man to overcome himself, to strive against his own inclination to passivity, sloth, and licentiousness. The Marxist concept of totality so necessary to the vision of a communist society is rejected, in favor of a pragmatic, pluralist view of nature that parallels the social pluralism of a regime of workers' syndicates. The primary function of Sorel's famous "myth of the general strike" is to link the workers' constant struggles against capitalist employers to the never-ending struggle against nature. The feelings engendered by such a strubble constitute the true core of socialism; without such feelings, socialism is doomed to the same decay that Sorel and Marx foresaw for capitalist civilization. Adorno’s conception of ideology was denounced by Habermas as incompatible with a viable form of social critique. By conflating ideology and the ‘identity principle’ inherent to modern Western reason, he argues, Adorno offered an overly negative characterisation of modernity and failed to recognise its rational potential. This paper questions this line of criticism by revisiting Adorno’s position. While he does sometimes associate ideology with identity-thinking, this association does not exhaust his views on the subject. For Adorno, ideology is just (...) as much a matter of Identität as a matter of Schein, or illusion, and its practical effects. Moreover, he views ideology as an intrinsically dynamic concept, whose definition has changed throughout human history. Drawing on his late sociological writings, I distinguish three major stages in the development of the concept of ideology, namely (a) ideology as simple illusion, a definition associated with the Enlightenment and expanded by the so-called sociology of knowledge; (b) ideology as necessary illusion, invoked by Marx to capture the structural logic of capitalism; and (c) ideology as disillusionment, related to the positivism of late capitalist society. Finally, I reflect on what this survey reveals about the relationship between illusion and identity in Adorno’s theory of ideology. (shrink)

The theory of rational choice of religion became one of the leading for scientific world, by total changing paradigm of postsecular sociology of religion. But its critics does not give to us any possibility apply it fully to non-american societies, and also analyze the impact of social factors on perception of religion personally and by collective. The problem is taking into account many other factors that also have a place in modern forms of conflict. Consideration of this theory (...) in a context of latest events in Ukraine 2013-2016 gives us possibility to look on perspectives of its implementation. A more detailed analysis shows the lack of a theory to explain the multifaceted conflict that is present in Ukraine, what means that researcher need more theoretical background to explain new phenomena. The presence of religious component in a social and political conflict creates more difficult conditions for in-depth analysis and finding root causes of primary conflict. Still theory of rational choice of religion explains part of the trends that emerged two years ago and continue to develop in the Ukrainian society. Since the first revolution and later open armed conflict led to the transition of society in another dimension, placing new challenges and tasks, but bared old problems and latent conflicts, especially in religious organizations and groups. Purpose. The purpose of the study lies in critical reconstruction of Thomas Hobbes’s social contract theory as an important principle not only of modern political anthropology, but also of modern and postmodern social projects. As well as, in the unfolding of the fundamentally important both for the newest social-philosophical and philosophical-anthropological discourses of the thesis that each individual is the origin of both personal and institutional freedom and justice, making the contract first of all with himself, with (...) his desires and sorrows and then with other people and the state. Theoretical basis. The principle of social contract offered by Hobbes became a new social, methodologically significant and relevant principle of regulation of activity, which indicates essential for the modern political philosophy and the philosophy of law transition from teleological to legal ideas of justice. For an in-depth study of the philosophical and anthropological aspects of Hobbes’s contractualism, we used the historical-comparative and contextualization method, as well as the works of leading native and foreign researchers of Hobbes, who uphold the provisions on the organic affiliation of fundamental socio-philosophical and philosophical-anthropological questions about the nature of man, the relation of coercion, freedom and justice with the discourse of social contract. Originality. On the basis of a consistent analysis of the anthropological component of Hobbes’s theory of social contract, an in-depth understanding of modern contractualism and contemporary discussions in the field of its existential and anthropological component is offered, as well as the thesis that political anthropology is the core of the philosophical anthropology because it makes possible the methodologically important understanding of the basic problems of human existence – the interaction of justice and freedom, self-interest and public good, as well as it quite clearly outlines the ways to overcome the dilemmas of liberalism and communitarianism, individualism and holism. Conclusions. Political anthropology of T. Hobbes constructed in the context of a modern social project, justified the issue of interaction between freedom and justice, which is fundamentally important to nowadays, through the search for such a way of social relations, in which an individual, being in the realm of social existence, would seek to limit his own selfishness and freedom for the sake of the common will of the majority. Thanks to Hobbes, the idea of external humility in disobedience to the inner, of freedom of conscience as a "human and citizen", of an understanding of individual independence, which is not just a permissible but accepted by state power, has been acquired with exceptional theoretical and practical meaning. Thanks to Hobbes’s works, the essence was revealed by the relationship between the cooperative and the conflicted vision of man. (shrink)

Sociology is an established academic discipline but there has been continuing debate over its status as a science and the nature of its subject matter. This led to the emergence of a phenomenological sociology and to critiques of positivist sociology. This critical reappraisal of the relevance of Marxian analysis for a science of society shows how these developments within sociology have had their counterpart in Marxism. The author analyses the status of Marx’s work and the Marxist (...) ‘tradition’ in sociology. He focuses upon those concerns which are common to both Marxian analysis and sociology – the question of subjectivity; the nature of social reality; and the dialectical relationship of the ‘doing’ or practice of a science of society to the social world within which such social analyses are situated. This article presents the notions of ethos and eidos as field level concepts for the sociology of morality and the anthropology of ethics. This is accomplished in the context of Bourdieuan social theory and, therefore, from the broad standpoint of practice theory. In the first instance these terms are used to refer to the normative structures of social fields and are conceived so as to represent the way in which such structures fall between two planes, that (...) of the implicit and the explicit. Subsequently, they are used to further understand a distinction between morality—roughly, the implicit moral order of a social field—and ethics—the more explicit and often codified elements of a social field’s normative structure. When presented in relation to academic philosophical inquiries into the ethical issues in healthcare and the life sciences—meaning the disciplines of applied ethics in general and applied ethics in particular—the analytic perspective these terms facilitate enables us to represent the fundamental conditions required for academic enquiry; taken together the ethos and eidos of an intellectual field constitute the requisite background of its normative epistemic and methodological commitments, thereby providing the structures of disciplined intellectual practices. Seen in this light it not only becomes possible to grasp applied ethics as a socially structured practice but to understand it in terms that can also be used to frame our everyday moral practices. In this way applied ethics can be acknowledged as a relatively unique part of our contemporary moral culture. (shrink)

This book’s basic hypothesis – which it proposes to test with a cognitive-sociological approach – is that legal behavior, like every form of human behavior, is directed and framed by biosocial constraints that are neither entirely genetic nor exclusively cultural. As such, from a sociological perspective the law can be seen as a super-meme, that is, as a biosocial constraint that develops only in complex societies. This super-meme theory, by highlighting a fundamental distinction between defensive and assertive biases, might explain (...) the false contradiction between law as a static and historical phenomenon, and law as a dynamic and promotional element. Socio-legal scholars today have to face the challenge of pursuing a truly interdisciplinary approach, connecting all the fields that can contribute to building a modern theory of normative behavior and social action. Understanding and framing concepts such as rationality, emotion, or justice can help to overcome the significant divide between micro and macro sociological knowledge. Social scientists who are interested in the law must be able to master the epistemological discourses of different disciplines, and to produce fruitful syntheses and bridge-operations so as to understand the legal phenomenon from each different point of view. The book adopts four perspectives: sociological, psychological, biological-evolutionary and cognitive. All of them have the potential to be mutually integrated, and constitute that general social science that provides common ground for exchange. The goal is to arrive at a broad and integrated view of the socio-legal phenomenon, paving the way for a comprehensive theory of norm-oriented and norm-perceived actions. (shrink)

In Between Facts and Norms Jürgen Habermas works out the legal and political implications of his Theory of Communicative Action, bringing to fruition the project announced with his publication of The Structural Transformation of the Public Sphere in 1962. This new work is a major contribution to recent debates on the rule of law and the possibilities of democracy in postindustrial societies, but it is much more.The introduction by William Rehg succinctly captures the special nature of the work, noting that (...) it offers a sweeping, sociologically informed conceptualization of law and basic rights, a normative account of the rule of law and the constitutional state, an attempt to bridge normative and empirical approaches to democracy, and an account of the social context required for democracy. Finally, the work frames and caps these arguments with a bold proposal for a new paradigm of law that goes beyond the dichotomies that have afflicted modern political theory from its inception and that still underlie current controversies between so- called liberals and civic republicans.The book includes a postscript written in 1994, which restates the argument in light of its initial reception, and two appendixes, which cover key developments that preceded the book.Habermas himself was actively involved in the translation, adapting the text as necessary to make it more accessible to English-speaking readers. This article examines the different approaches to the relation between law, state and economy in the works of Hans Kelsen, Carl Schmitt and Evgeny Pashukanis. It begins with Kelsen’s depiction of law as a dynamic and ‘self-regulating’ system of norms, founded on his rejection of ‘dualist’ separations of state and law, before turning to Schmitt and Pashukanis’s respective critiques. For all their differences, both agree Kelsen ignores the historical basis of the law – for Schmitt, the sovereign power of ‘the (...) political’, for Pashukanis, the social relations of commodity exchange. The article responds to these criticisms in a most un-Kelsenian manner, drawing upon historical sociological literature on early modern state formation to cast doubt on both Schmitt and Pashukanis’s historical accounts. It argues that the forms of political power and commodity exchange upon which Schmitt and Pashukanis’s theories rely were historically specific possibilities opened up by the same process of generalisation and depersonalisation of power relations that allowed for an autonomous ‘public’ system of legal norms. Thus, rather than the fixed causal ground for the development of modern law, ‘the political’ and exchange between equals exist in a relation of ‘difference-in-unity’ with the law. The article concludes that Kelsen’s notion of the Grundnorm is best explained as an attempt to capture the new possibilities and responsibilities opened up a normative system whose ultimate justification now lies only within itself. Modernity has firmly laid the foundations of modern life by melting the constants that kept pre-modern human life afloat, pouring them into patterns again within its ideal framework. But the failure of modern life to fulfill the promise of absolute happiness has led to some deterioration, thawing, fragmentation and melting in its structure. Based on this approach, Bauman underlines the transition from the solid modern age to the liquid modern age. Liquid life, which lacks a certain systematic, order, and holistic (...) framework has rendered the continuity of the sociology of the rigid and organized modern society impossible. For this reason thinking about “the sociology of sociology” is necessary with the awareness of its risks, obstacles and difficulties as well as the existence of its possibilities. Based on this awareness, this study is a theoretical study aiming to question the possibility of doing sociology on today's liquid social life and how it can be done. Liquid social life in the study; time-space, surveillance and power, consumption and human relations, culture, education, identity and risk dimensions were evaluated and the possibility of doing sociology on fluid modernity and how it can be done were discussed. This research contributes to science and sociology in order to fill the relevant gap in the literature. The research is original and important in terms of its contribution to sociology and presenting a social scientific approach to the problem of making the sociology of today's liquid life. It should also be noted that this study is a modest orientation in this effort rather than drawing a clear framework for the sociology of the sociology of liquid modernity. (shrink)
