The analyses, findings, and recommendations of the report are also reviewed, in particular the central issues that led to suggestions for policy changes.Transplantation BackgroundAs a first step, some background in the relevant aspects of organ transplantation will prove useful. For the purposes of this analysis, “transplantation” involves the transfer of cells, tissues, or solid organs from one human to another to replace the structure or function of comparable body components that, through injury or disease, are defective or of inadequate function. The IOM report deals with solid organs, primarily kidneys and livers, whose blood supply is reconnected in the organ recipient, in contrast to cells, like bone marrow, and tissues, like corneas. A variety of donor types exists for organ transplantation, each with particular medical and scientific conditions.Living donors are healthy (and usually genetically related) individuals who volunteer to provide either a whole, paired organ such as a kidney or a section of an organ such as a liver. Cadaver donors are individuals who have died and from whom a full array of organs can be taken. “Heart-beating” cadaver donors are individuals who have suffered “brain death,” that is, irreversible cessation of function of the whole brain including the brain stem; and “non-heart-beating” donors (NHBDs) are individuals who are ill or injured, but not “brain dead,” and who have suffered cardiopulmonary death, that is, irreversible cessation of cardiac and respiratory function. NHBDs can be “controlled,” which means that [End Page 83] they can be sustained by artificial life support systems until a medical and family decision is made to terminate futile life support. This can be done at a scheduled time and in a controlled manner, and organs can then be recovered for transplantation. NHBDs can also be “uncontrolled,” which means that their hearts and breathing have stopped through disease or injury at an unexpected time or in an uncontrolled manner, and they cannot be resuscitated; the organs of some individuals of this description can be recovered for transplantation. Youngner (bio)Organ Transplantation requires viable donor organs. This simple fact has become the Achilles' heel of transplantation programs. Progress in immunology and transplant surgery has outstripped the supply of available organs. Between 1988 and 1991, for example, the number of transplant candidates on waiting lists increased by about 55 percent, while the number of donors (...) increased only about 16 percent.1 By the end of March 1993, more than 30,000 potential recipients awaited transplantation (United Network for Organ Sharing Database (UNOS) 1993). Every day six of these patients die prior to receiving a heart or liver transplant, while patients needing kidney transplants must tolerate a lower quality of life on dialysis (Grenvik 1992; Evans, Orians, and Ascher 1992).This scarcity is likely to get worse. As transplantation becomes more successful, it is being offered to sicker and older patients. Attempts to transplant other solid organs, such as small bowel and pancreas, will only fuel the demand for donors. However, the current source of organs is unlikely to grow. Most organs come from patients who have been declared dead by neurologic criteria (commonly referred to as "brain dead" or heart-beating cadaver donors (HBCDs) because their hearts are beating at the time of procurement). Estimates of the potential pool of HBCDs have been revised downward from 20,000-27,000 to roughly 10,000-12,000 (Nathan et al. 1991). Improvements in automobile safety and handgun legislation will likely lead to further reductions. Moreover, the rate of procurement from HBCDs has remained relatively flat despite extensive public awareness campaigns and legislation requiring hospitals to routinely request donation from families of dead patients (Caplan et al. 1992).If organ transplantation is going to continue to flourish, alternative [End Page 103] sources of organs must be found. Recently the University of Pittsburgh Medical Center (UPMC) proposed procuring organs from patients who have been declared dead by traditional cardiopulmonary rather than brain-oriented criteria after they or their families have decided to forgo life-sustaining treatment—hereafter referred to as the Pittsburgh protocol (UPMC Policy 1993). These patients are typically referred to as non-heart-beating cadaver donors (NHBCDs) because their hearts are no longer beating at the time of organ procurement.Although NHBCDs were a major source of transplantable kidneys prior to the institution of death by neurologic criteria, their usefulness was limited by "warm ischemia time." I have difficulty telling people “I’m a doctor,” because I’m not sure I believe it myself. And yet within the past eight months, I have already been challenged to mediate situations that bring me to not only fully accept (...) my vocation as a physician, but also to grow on a mental level, a human level, and a spiritual level. In the following reflection, I recount one of those moments that occurred during a rotation in the medical intensive care unit.At 6 p.m. I was coming on for my night shift knowing that the family of one of the patients I would be caring for had decided earlier in the day to withdraw medical care for their dying sister. The woman had been admitted to the ICU the previous night unconscious and in multi organ system failure—heart, lungs, liver, kidneys, all failed—as a result of chronic alcoholism and most recently drinking daily for three weeks with barely any other dietary intake. She was being kept alive with mechanical ventilation and three IV drips of medications to maintain her blood pressure. She was 45 years old. After a few more hours of saying goodbye, her sister came up to me and said that the family was ready to proceed. To withdraw care. I thought a lot about this phrase we use [End Page 204] “withdrawing care” that night. This encounter was the first time I had ever been the physician entering these orders into the computer. To me, what I was doing that night was in fact the complete opposite of “withdrawing” care. I felt, instead, that I was giving even more care. How?First, by caring more for the patient. By making sure she was comfortably extubated, by helping to reposition her in the hospital bed in a way that appeared more natural, and by praying. I prayed that when we stopped the pressors and the ventilator, she would pass quietly and find peace in Heaven, when she perhaps found very little on Earth.Second, by caring more for her family. It was my responsibility to guide them through this dying process, a process that I had only encountered two or three times previously in my life. I felt unsure, frightened, and nervous, not wanting to make a mistake or be inadvertently insensitive. Once again, prayer and what I perceive to be God’s grace filled me with the love I needed to outline the process, to encourage family members to hold her hand and to speak with her while she died.Once the medications were stopped and she was breathing unassisted, her lungs gasped once … twice. Was the soul being released from the body or was the body clinging onto the soul? And then, within two minutes, silence. I left some space to pause and then when the time felt right, stepped forward for the death pronouncement. “The heart is not beating, the lungs have stopped breathing” was all I could manage to say. Why did I remove the “she” and “her”? Why could I not say, “She is dead”? At the time I could not have answered those questions. Thinking back, I believe it was easier for me to vocalize that her body had simply stopped functioning, while I quietly held on to the belief that her soul continued to exist. Should I have held back as I did? Would it have been better for the family to hear that their sister was unquestionably dead? Perhaps. Nevertheless, the family understood, they cried, they held their sister’s hand. The processing, representation, and perception of bodily signals (interoception) plays an important role for human behavior. Theories of embodied cognition hold that higher cognitive processes operate on perceptual symbols and that concept use involves reactivations of the sensory-motor states that occur during experience with the world. Similarly, activation of interoceptive representations and meta-representations of bodily signals supporting interoceptive awareness are profoundly associated with emotional experience and cognitive functions. This article gives an overview over present findings and models on interoception and (...) mechanisms of embodiment and highlights its relevance for disorders that are suggested to represent a translation deficit of bodily states into subjective feelings and self-awareness. In the context of modern, liberal societies, Rossler develops a theory of the private which links privacy and autonomy in a constitutive way: privacy is a necessary condition to lead an autonomous life. The (...) book develops a theory of freedom and autonomy which sees the ability to pose the "practical question" of how one wants to live, of what a person strives to be, at the centre of the modern idea of autonomy. The question of privacy is emerging as an increasingly important topic in social and political theory and is central to many current debates in law, the media and politics. his monograph examines the metaphysical commitments of the new mechanistic philosophy, a way of thinking that has returned to center stage. It challenges a variant of reductionism with regard to higher-level phenomena, which has crystallized as a default position among these so-called New Mechanists. Furthermore, it opposes those philosophers who reject the possibility of interlevel causation. Contemporary philosophers believe that the explanation of scientific phenomena requires the discovery of relevant mechanisms. As a result, new mechanists are, in the main, concerned (...) solely with epistemological questions. But, the author argues, their most central claims rely on metaphysical assumptions. Thus, they must also take into account metaphysics, a system of thought concerned with explaining the fundamental nature of being and the world around it. This branch of philosophy does indeed matter to the empirical sciences. The chapters investigate the nature of mechanisms, their components, and the ways in which they can bring about different phenomena. In addition, the author develops a novel account of causation in terms of activities. The analysis provides the basis for many further research projects on mechanisms and their relations to, for example, the mind-body problem, realization, multiple realization, natural kinds, causation, laws of nature, counterfactuals, and scientific levels. Dieser Vergleich und die Abgrenzung von Ethikkonsultation stellen eine Forschungslücke dar. Anhand von zwei Fallvignetten aus der Praxis von EK und PS werden unter Kontrastierung mit dem jeweils anderen Ansatz Unterschiede und Gemeinsamkeiten im methodischen und praktischen Vorgehen sowie Kriterien der Unterscheidung analysiert. Als Ergebnis wird eine systematische Gegenüberstellung präsentiert, die folgende Merkmale umfasst: 1. Ziele jedes Ansatzes, 2. Einberufung, 3. (...) Gegenstand, 4. Fokus, 5. Methode/Prozess, 6. Rolle des Beraters, 7. Ergebnisse, 8. Dokumentation, 9. Bearbeiten von Emotionen, 10. Bearbeiten ethischer Fragestellungen. Trotz Überschneidungen der beiden Arbeitsformen erscheinen EK und PS nicht wechselseitig austauschbar; eine Vermischung wird nicht empfohlen. Although legitimacy theory provides strong arguments that environmental, social and governance disclosure and performance can help mitigate firm-specific risks, this relationship has been repeatedly challenged by conceptual arguments, such as ‘transparency fallacy’ or ‘impression management’, and mixed empirical evidence. Therefore, we investigate this relationship in the revelatory case of initial public offerings, which represent the first sale of common stock to the wider public. IPOs are characterised by strong information asymmetry between firm insiders and society, while at the same time (...) suffering from uncertainty in firm legitimacy, culminating in amplified financial risks for both issuers and investors in aftermarket trading. Using data from the United States, we demonstrate that voluntary ESG disclosure reduces idiosyncratic volatility and downside tail risk and higher ESG ratings have lower associated firm-specific volatility and downside tail risk during the first year of trading in the aftermarket. We provide theoretical arguments for the relationships observed, suggesting that companies striving for ESG performance and communicating their efforts signal their compliance with sustainability-related norms, thus acquiring and upholding a societal license to operate. ESG performance and disclosure help companies build their reputation capital with investors after going public. We also report that ESG disclosure is a more consistent proxy for ex-ante uncertainty as an indicator of aftermarket risk, thereby replacing some of the more conventional measures, such as firm age, offered in the existing literature. Es macht Spaß zu verfolgen, wie die verschiedenen Puzzleteile vorgestellt und dann zusammengefügt werden. Allerdings kann man vor lauter Puzzleteilen leicht den Überblick verlieren. Aus diesem Grund möchte ich ein paar Überlegungen anstellen, die die Möglichkeit geben sollen, den Ansatz sowie dessen Implikationen noch einmal zu verdeutlichen.

ABSTRACTSome political ads used in the 2016 U.S. election evoked feelings colloquially known as being moved to tears. We conceptualise this phenomenon as a positive social emotion that appraises and motivates communal relations, is accompanied by physical sensations, and often labelled metaphorically. We surveyed U.S. voters in the fortnight before the 2016 U.S. election. Selected ads evoked the emotion completely and reliably, but in a partisan fashion: Clinton voters were moved to tears by three selected Clinton ads, and Trump voters (...) were moved to tears by two Trump ads. Viewers were much less moved by ads of the candidate they did not support. Being moved to tears predicted intention to vote for the candidate depicted. We conclude that some contemporary political advertising is able to move its audience to tears, and thereby motivates support. (shrink)

Cartwright et al. in European Journal for Philosophy of Science, 10 and the new mechanists agree that regular behaviors described in cp laws are generated by mechanisms. However, there is disagreement with regard to the two questions that Cartwright at al. ask: the epistemological question and the ontological question. Most importantly, Cartwright et al. argue that the explanation involved is a CL-explanation, while the new mechanists insist that mechanistic explanation and CL-explanation are competitors. In this reply, I will highlight some (...) worries regarding Cartwright et al.’s analysis of the relationship between mechanisms and cp laws and I will provide alternative answers to the two questions in line with the new mechanistic approach. Ein entsprechendes philosophisches Begriffsinstrumentarium, dem der Gedanke vom "Prius der Theorie, (...) Primat der Praxis" zugrunde liegt, hat Bloch systematisch in seiner Kategorienlehre entwickelt. Gegenstand ist das universelle menschliche Sein als "Noch-Nicht-Sein". Akzentuiert wird die auf dem Prozesscharakter der Materie beruhende M glichkeit der Ver nderung. Dabei umfasst das Denken nicht nur Gesellschaft, Kunst und Religion, sondern auch die Natur - ein Gebiet, das zunehmend zu philosophischer Insichtnahme auffordert. This paper tries to clarify the relationship between a type of knowledge and an ontological domain which at first sight seems foreign to it. It also contains the outline of a program for future research. We will show that the relationship between phenomenology and material reality is in some sense double. Hints to this duality may already be found (...) in Husserl’s Ideen II. Finally we will question a phenomenology that its author explicitly qualified as material: the philosophy of Michel Henry. We will investigate the possibility of a material phenomenology beyond Henry’s work in relation to material reality. (shrink)

Research on children's developing theories of mind has contributed to our understanding of the developmental relation of self and action (1) by exploring the relation of the development of self knowledge to the development of knowledge of others' minds and (2) by investigating the relation between theory of mind development and the development of action control. We argue that evidence on theory of mind reasoning in children with deficient action control (ADHD-diagnosed children) is especially relevant to the second issue and (...) we present some first evidence supporting the bi-directional hypothesis, that is, the view that theory of mind leads to improved action control which in turn supports the ability to represent mental states on-line. After the completion of the topological manuscript edition in section IX of the Kritische Gesamtausgabe der Werke (KGW IX), the additional chronological indexing of the late Nachlass remained a desideratum. The current manuscript closes this editorial gap. As an appendix to KGW IX, the chronology of the manuscripts 1885–89 provides the date for each distinguishable layer of inscription for every manuscript and note edited in KGW IX. In the first part of (...) the following chronology, the dated inscription layers for all late manuscripts from notebook N VII 1 to the scattered notes are recorded topologically. In this 1999 study, Beat Wyss provides a critical analysis of Hegel's theories of art history. Analogous to his philosophy of history, Hegel viewed the history of art in dialectical terms: with its origins in the Ancient Near East, Western art culminated in Classical Greece, but began its decline already in the Hellenistic period. Yet, as Wyss posits, art refuses its programmed demise. He highlights the political dimension of this contradiction, showing the implication of theories which subordinate art to (...) the will of absolute rule. Wyss follows his analysis of Hegel's theories with a discussion of the work of four modern successors - Nordau, Spengler, Sedlmayr and Lukacs - all of whom adapted Hegel's dialectical model, in an effort to demonstrate the central contradictions of twentieth-century aesthetics. The present debate on constitutional rights aims to protect the individual against the intrusive power of the state. Analysing the precarious relationship between art and money, the authors argue that constitutional rights need to be extended into the regimes of private governance. This requires four fundamental changes. (1) Constitutional rights can no longer be limited to the protection of individual actors. Instead, they need to be extended to guarantees of freedom of discourses. (2) The new experience of the twentieth century (...) is that totalizing tendencies have their origin not only in politics, but also in other fields of action, especially in technology, science, and the economy. Thus, a discursive concept of constitutional rights should be directed against any social system with totalizing tendencies. (3) Instead of concentrating on centres of economic and social power, constitutional rights in the private sphere should focus on the specific communicative medium of the expansionist social system involved. (4) This excludes the direct analogy of a ‘right’ as a quasispatial exclusion zone. More significant guarantees of discursive autonomy could be found in a ‘proceduralization’ of constitutional rights. (shrink)

Responding to bivalent stimuli slows subsequent performance. In prospective memory research, prospective memory targets can be considered as bivalent stimuli because they typically involve features relevant for both the prospective memory task and the ongoing task. The purpose of this study was to investigate how responding to a prospective memory target slows subsequent performance. In two experiments, we embedded the prospective memory task in a task-switching paradigm and we manipulated the degree of task-set overlap between the prospective memory task and (...) the ongoing task. The results showed consistent after-effects of responding to prospective memory targets. The specific trajectory of the slowing depended on the amount of task-set overlap. These results demonstrate that responding to prospective memory targets results in after-effects, a so far neglected cost on ongoing task performance. (shrink)

The paper focuses on processes of normalization through which dis/ability is simultaneously produced in specific collectives, networks, and socio-technological systems that enable the construction of such demarcations. Our point of departure is the cochlear implant, a neuroprosthetic device intended to replace and/or augment the function of the damaged inner ear. Unlike hearing aids, which amplify sounds, the CI does the work of damaged hair cells in the inner ear by providing sound signals to the brain. We examine the processes of (...) the CI’s genesis as well as its specific uses by and interrelations to the different and divergent actors that the CI assembles. We argue that the technological device and the implicated normalization process mobilize complex effects in varying socio-technical arrangements. The CI is conceived as a “boundary object” [89] or a “quasi-object” [49, 83], i.e., a metastabilized medium of translation that coordinates social, cultural, and technological action. Although intended to transform non-hearing or hard of hearing people into competent and “normal” hearing subjects, the CI system reproduces the asymmetrical structures of the disability discourse [14] through its function of “developing and maintaining coherence between intersecting social worlds” [89, 393]. Additionally, it initiates controversial discourses that have resulted in new forms of biosocial collectivities ranging from cochlear implantees with normal human hearing to human configurations who have passed through human enhancement. Our approach is thus situated at the intersection of disability and media studies and tackles the particular conditions technological media configurations impose upon the production of dis/ability. Constitutive mechanistic explanations are said to refer to mechanisms that constitute the phenomenon-to-be-explained. The most prominent approach of how to understand this constitution relation is Carl Craver’s mutual manipulability approach to constitutive relevance. Recently, the mutual manipulability approach has come under attack (Leuridan 2012; Baumgartner and Gebharter 2015; Romero 2015; Harinen 2014; Casini and Baumgartner 2016). Roughly, it is argued that this approach is inconsistent because it is spelled out in terms of interventionism (which is an approach to causation), whereas (...) constitutive relevance is said to be a non-causal relation. In this paper, I will discuss a strategy of how to resolve this inconsistency, so-called fat-handedness approaches (Baumgartner and Gebharter 2015; Casini and Baumgartner 2016; Romero 2015). I will argue that these approaches are problematic. I will present a novel suggestion of how to consistently define constitutive relevance in terms of interventionism. My approach is based on a causal interpretation of mutual manipulability, where manipulability is interpreted as a causal relation between the mechanism’s components and temporal parts of the phenomenon. Der Beitrag untersucht die Formation, also gleichermaßen die Genese und die Gestalt der Londoner Werkstatt ‚Omega‘ im frühen 20. Jahrhundert, die aus dem Bloomsbury Kreis hervorgegangen ist. Es handelt sich um einen dichten Zusammenhang von Lebens-, Arbeits- und Gestaltungsformen und das Zusammenspiel von affektiven und instrumentellen Beziehungsweisen auch in der Organisationsform, die durch weitgehende Strukturlosigkeit gekennzeichnet ist. Wie sich vor diesem Hintergrund Prozesse der Konstituierung, der Entscheidungsfindung und der oft verdeckten Hierarchiebildung in künstlerischen Gemeinschaften nachvollziehen lassen, wird vor der Folie (...) der gegenwärtigen Diskussion um Kollektive entfaltet.
